		<official-title display="yes">To amend title VII of the Civil Rights Act
		  of 1964 and the Age Discrimination in Employment Act of 1967, and to modify the
		  operation of the Americans with Disabilities Act of 1990 and the Rehabilitation
		  Act of 1973, to clarify that a discriminatory compensation decision or other
		  practice that is unlawful under such Acts occurs each time compensation is paid
		  pursuant to the discriminatory compensation decision or other practice, to
		  amend the Fair Labor Standards Act of 1938 to provide more effective remedies
		  to victims of discrimination in the payment of wages on the basis of sex, and
		  for other purposes.</official-title>

		<title id="H534C4C9BE8D043D6B169B7549BB3E856"><enum>I</enum><header>Lilly
			 Ledbetter Fair Pay Act of 2009</header>
			<section id="H27B0332219D74B4888C4805D6291D591" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This title may be cited as the
			 <quote><short-title>Lilly Ledbetter Fair Pay Act of
			 2009</short-title></quote>.</text>
			</section><section display-inline="no-display-inline" id="H1C3C5B681B074C80B410C8C8CF4FFBEC"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
				<paragraph id="H8C08427F467E4E32B8690066393DF8A9"><enum>(1)</enum><text>The Supreme Court
			 in Ledbetter v. Goodyear Tire &amp; Rubber Co., 550 U.S. 618 (2007),
			 significantly impairs statutory protections against discrimination in
			 compensation that Congress established and that have been bedrock principles of
			 American law for decades. The Ledbetter decision undermines those statutory
			 protections by unduly restricting the time period in which victims of
			 discrimination can challenge and recover for discriminatory compensation
			 decisions or other practices, contrary to the intent of Congress.</text>
				</paragraph><paragraph id="H9CB7CF0BD9CF408FBFDF61315CB308BB"><enum>(2)</enum><text>The limitation
			 imposed by the Court on the filing of discriminatory compensation claims
			 ignores the reality of wage discrimination and is at odds with the robust
			 application of the civil rights laws that Congress intended.</text>
				</paragraph><paragraph id="H147BF055EBDA4EAAA5AA003F41363914"><enum>(3)</enum><text display-inline="yes-display-inline">With regard to any charge of discrimination
			 under any law, nothing in this Act is intended to preclude or limit an
			 aggrieved person’s right to introduce evidence of an unlawful employment
			 practice that has occurred outside the time for filing a charge of
			 discrimination.</text>
				</paragraph><paragraph id="H28E888A9771144AD9C5400F5B6C679BD"><enum>(4)</enum><text display-inline="yes-display-inline">Nothing in this Act is intended to change
			 current law treatment of when pension distributions are considered paid.</text>
				</paragraph></section><section id="H50B9BF251333416D88850954E6105404"><enum>3.</enum><header>Discrimination in
			 compensation because of race, color, religion, sex, or national
			 origin</header><text display-inline="no-display-inline">Section 706(e) of the
			 <act-name>Civil Rights Act of 1964</act-name> (42 U.S.C. 2000e–5(e)) is amended
			 by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="H93E20B6E701B44E5BBA689A402FF9545" style="OLC">
					<paragraph id="H350E26C3BE344EA896DDEE2717E16F58" indent="up1"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HBB334B58BE24401181BC6B1FCC865EF8"><enum>(A)</enum><text display-inline="yes-display-inline">For purposes of this section, an unlawful
				employment practice occurs, with respect to discrimination in compensation in
				violation of this title, when a discriminatory compensation decision or other
				practice is adopted, when an individual becomes subject to a discriminatory
				compensation decision or other practice, or when an individual is affected by
				application of a discriminatory compensation decision or other practice,
				including each time wages, benefits, or other compensation is paid, resulting
				in whole or in part from such a decision or other practice.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H90642832BE6144EBA1C9651BBAEC22AC" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">In addition to any relief authorized by
				section 1977A of the Revised Statutes (42 U.S.C. 1981a), liability may accrue
				and an aggrieved person may obtain relief as provided in subsection (g)(1),
				including recovery of back pay for up to two years preceding the filing of the
				charge, where the unlawful employment practices that have occurred during the
				charge filing period are similar or related to unlawful employment practices
				with regard to discrimination in compensation that occurred outside the time
				for filing a
				charge.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H6C401C52FE2C4570BD5C2301265BAF65"><enum>4.</enum><header>Discrimination in
			 compensation because of age</header><text display-inline="no-display-inline">Section 7(d) of the Age Discrimination in
			 Employment Act of 1967 (29 U.S.C. 626(d)) is amended—</text>
				<paragraph id="H83CCA796B3454EC3B566765C4DC25600"><enum>(1)</enum><text display-inline="yes-display-inline">in the first sentence—</text>
					<subparagraph id="H57AEF168BCD944DA002893011DB83E22"><enum>(A)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (1) and (2) as
			 subparagraphs (A) and (B), respectively; and</text>
					</subparagraph><subparagraph id="H6ED0EE3B4A854C938B913FB156E7D38"><enum>(B)</enum><text>by striking
			 <quote>(d)</quote> and inserting <quote>(d)(1)</quote>;</text>
					</subparagraph></paragraph><paragraph id="HF7D45D72DE99422FB1E101ED9C012232"><enum>(2)</enum><text>in the third
			 sentence, by striking <quote>Upon</quote> and inserting the following:</text>

						<paragraph id="HFB001777A2584B619047D77E35A42039" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">For purposes of this section, an unlawful
				practice occurs, with respect to discrimination in compensation in violation of
				this Act, when a discriminatory compensation decision or other practice is
				adopted, when a person becomes subject to a discriminatory compensation
				decision or other practice, or when a person is affected by application of a
				discriminatory compensation decision or other practice, including each time
				wages, benefits, or other compensation is paid, resulting in whole or in part
				from such a decision or other
				practice.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="HF22DFB0734BB4615BE3D31A0B591279C"><enum>5.</enum><header>Application to
			 other laws</header>
				<subsection id="H95F94D8C5829411AA2941F85F2DD9EA8"><enum>(a)</enum><header>Americans with
			 Disabilities Act of 1990</header><text>The amendments made by section 3 shall
			 apply to claims of discrimination in compensation brought under title I and
			 section 503 of the <act-name>Americans with Disabilities Act of 1990</act-name>
			 (42 U.S.C. 12111 et seq., 12203), pursuant to section 107(a) of such Act (42
			 U.S.C. 12117(a)), which adopts the powers, remedies, and procedures set forth
			 in section 706 of the <act-name>Civil Rights Act of 1964</act-name> (42 U.S.C.
			 2000e–5).</text>
				</subsection><subsection id="H9E69E8F92CED429E84D00989845B09A7"><enum>(b)</enum><header>Rehabilitation
			 Act of 1973</header><text>The amendments made by section 3 shall apply to
			 claims of discrimination in compensation brought under sections 501 and 504 of
			 the <act-name>Rehabilitation Act of 1973</act-name> (29 U.S.C. 791, 794),
			 pursuant to—</text>
					<paragraph id="H6C18008CA3E14FF79324C5F91B9B82CC"><enum>(1)</enum><text>sections 501(g)
			 and 504(d) of such Act (29 U.S.C. 791(g), 794(d)), respectively, which adopt
			 the standards applied under title I of the <act-name>Americans with
			 Disabilities Act of 1990</act-name> for determining whether a violation has
			 occurred in a complaint alleging employment discrimination; and</text>
					</paragraph><paragraph id="H1EAF38D57870484BA0723165DA6600CD"><enum>(2)</enum><text>paragraphs (1) and
			 (2) of section 505(a) of such Act (29 U.S.C. 794a(a)) (as amended by subsection
			 (c)).</text>
					</paragraph></subsection><subsection id="HE6F1A1F0C2314E3C82DF842752B79EFF"><enum>(c)</enum><header>Conforming
			 amendments</header>
					<paragraph id="HDDDE97A0A2584A3E9ECEEC12D2A95E06"><enum>(1)</enum><header>Rehabilitation
			 Act of 1973</header><text>Section 505(a) of the <act-name>Rehabilitation Act of
			 1973</act-name> (29 U.S.C. 794a(a)) is amended—</text>
						<subparagraph id="H3F9A44F625184965B0F2705989C329EB"><enum>(A)</enum><text>in paragraph (1),
			 by inserting after <quote>(42 U.S.C. 2000e–5 (f) through (k))</quote> the
			 following: <quote>(and the application of section 706(e)(3) (42 U.S.C.
			 2000e–5(e)(3)) to claims of discrimination in compensation)</quote>; and</text>
						</subparagraph><subparagraph commented="no" id="H80F5E0E66EDA4FD98099CFBD1C008D7B"><enum>(B)</enum><text>in paragraph (2),
			 by inserting after <quote>1964</quote> the following: <quote>(42 U.S.C. 2000d
			 et seq.) (and in subsection (e)(3) of section 706 of such Act (42 U.S.C.
			 2000e–5), applied to claims of discrimination in compensation)</quote>.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H0124035AF8E54A4A861D7517CE2D4300"><enum>(2)</enum><header>Civil Rights Act
			 of 1964</header><text>Section 717 of the <act-name>Civil Rights Act of
			 1964</act-name> (42 U.S.C. 2000e–16) is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H730A8D9AC0804C1500438200FE217767" style="traditional">
							<subsection commented="no" id="HD73957E69E9B42DAA8C9B7505CA5670"><enum>(f)</enum><text display-inline="yes-display-inline">Section 706(e)(3) shall apply to complaints
				of discrimination in compensation under this
				section.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H7757FAEA8ABC4DEAA058FBFEE1A6BFF"><enum>(3)</enum><header>Age
			 Discrimination in Employment Act of 1967</header><text display-inline="yes-display-inline">Section 15(f) of the <act-name>Age
			 Discrimination in Employment Act of 1967</act-name> (29 U.S.C. 633a(f)) is
			 amended by striking <quote>of section</quote> and inserting <quote>of sections
			 7(d)(3) and</quote>.</text>
					</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB3E2632CD28B47CF918F51F200256F2E" section-type="subsequent-section"><enum>6.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This title and the
			 amendments made by this title, take effect as if enacted on May 28, 2007, and
			 apply to all claims of discrimination in compensation under title VII of the
			 <act-name>Civil Rights Act of 1964</act-name> (42 U.S.C. 2000e et seq.), the
			 <act-name>Age Discrimination in Employment Act of 1967</act-name> (29 U.S.C.
			 621 et seq.), title I and section 503 of the <act-name>Americans with
			 Disabilities Act of 1990</act-name>, and sections 501 and 504 of the
			 <act-name>Rehabilitation Act of 1973</act-name>, that are pending on or after
			 that date.</text>
			</section></title><title id="H23374BAC31CA4F9A9E80FC17F45339DD"><enum>II</enum><header>Paycheck Fairness
			 Act </header>
			<section display-inline="no-display-inline" id="HD96E2673FE7C4E1C944EC5C0CB699B21" section-type="subsequent-section"><enum>201.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This title may be cited
			 as the <quote><short-title>Paycheck Fairness
			 Act</short-title></quote>.</text>
			</section><section id="HD7D923B43AD6464DA0BD9328BA059593"><enum>202.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
				<paragraph id="H78113798702F489A8A5E54EF437AF444"><enum>(1)</enum><text>Women have entered
			 the workforce in record numbers over the past 50 years.</text>
				</paragraph><paragraph id="H20DA45C67CB74B8BBA87DABBD6CD40F5"><enum>(2)</enum><text>Despite the
			 enactment of the Equal Pay Act in 1963, many women continue to earn
			 significantly lower pay than men for equal work. These pay disparities exist in
			 both the private and governmental sectors. In many instances, the pay
			 disparities can only be due to continued intentional discrimination or the
			 lingering effects of past discrimination.</text>
				</paragraph><paragraph id="HBA6E558CC43342028E785B38332923C1"><enum>(3)</enum><text>The existence of
			 such pay disparities—</text>
					<subparagraph id="HC1413F1B76AD4890A565A6D4D0BAE92A"><enum>(A)</enum><text>depresses the
			 wages of working families who rely on the wages of all members of the family to
			 make ends meet;</text>
					</subparagraph><subparagraph id="HF92AA9CC0EF6443EBFCC8F16DC630191"><enum>(B)</enum><text>undermines women's
			 retirement security, which is often based on earnings while in the
			 workforce;</text>
					</subparagraph><subparagraph id="H081A08BC1098439AA265D7A52003EC32"><enum>(C)</enum><text>prevents the
			 optimum utilization of available labor resources;</text>
					</subparagraph><subparagraph id="HECBA09792B9B49FCAB9B97365DAF901C"><enum>(D)</enum><text>has been spread
			 and perpetuated, through commerce and the channels and instrumentalities of
			 commerce, among the workers of the several States;</text>
					</subparagraph><subparagraph id="HE0A29C0229534F49843F7DF35E5921C7"><enum>(E)</enum><text>burdens commerce
			 and the free flow of goods in commerce;</text>
					</subparagraph><subparagraph id="H191DB3E9FCD74ED2A0B1D2C821BFF37F"><enum>(F)</enum><text>constitutes an
			 unfair method of competition in commerce;</text>
					</subparagraph><subparagraph id="HF8078F839999450A8D95235A14012F7D"><enum>(G)</enum><text>leads to labor
			 disputes burdening and obstructing commerce and the free flow of goods in
			 commerce;</text>
					</subparagraph><subparagraph id="HA527A3E76B5341F788055FF983AA3413"><enum>(H)</enum><text>interferes with
			 the orderly and fair marketing of goods in commerce; and</text>
					</subparagraph><subparagraph id="H4DEC2748E1AF4338AAFA85FBFE22A8E8"><enum>(I)</enum><text>in many instances,
			 may deprive workers of equal protection on the basis of sex in violation of the
			 5th and 14th amendments.</text>
					</subparagraph></paragraph><paragraph id="H12EBD183434E4F5A995A09A6C3C56039"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3C2190F6A5BE4B5DA21AF4AD6C71FF79"><enum>(A)</enum><text>Artificial barriers to
			 the elimination of discrimination in the payment of wages on the basis of sex
			 continue to exist decades after the enactment of the Fair Labor Standards Act
			 of 1938 (29 U.S.C. 201 et seq.) and the <act-name parsable-cite="CRA64">Civil
			 Rights Act of 1964</act-name> (42 U.S.C. 2000a et seq.).</text>
					</subparagraph><subparagraph id="HA06C229364354347BDDAEBA718BBC5DD" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">These barriers have resulted, in
			 significant part, because the Equal Pay Act has not worked as Congress
			 originally intended. Improvements and modifications to the law are necessary to
			 ensure that the Act provides effective protection to those subject to pay
			 discrimination on the basis of their sex.</text>
					</subparagraph><subparagraph id="H2C0E20768A214D0AAADD186C0B156C07" indent="up1"><enum>(C)</enum><text>Elimination of such barriers would
			 have positive effects, including—</text>
						<clause id="H75F9509481E44DD9B5C9DA6B83EF53E5"><enum>(i)</enum><text>providing a solution to problems in
			 the economy created by unfair pay disparities;</text>
						</clause><clause id="H084F2487284F4585AF7AD66A6A1C4EB0"><enum>(ii)</enum><text>substantially reducing the number
			 of working women earning unfairly low wages, thereby reducing the dependence on
			 public assistance;</text>
						</clause><clause id="H81D980C5C4574A83A4A1B8451656DF5C"><enum>(iii)</enum><text>promoting stable families by
			 enabling all family members to earn a fair rate of pay;</text>
						</clause><clause id="H5AC49FD40B5E472D9133194415DE6DF9"><enum>(iv)</enum><text>remedying the effects of past
			 discrimination on the basis of sex and ensuring that in the future workers are
			 afforded equal protection on the basis of sex; and</text>
						</clause><clause id="HF82EF4B56176446DA4C176F7FAF0034F"><enum>(v)</enum><text>ensuring equal protection pursuant
			 to Congress’ power to enforce the 5th and 14th amendments.</text>
						</clause></subparagraph></paragraph><paragraph id="H1259752BEABD47D2A0A86D1E7BE18171"><enum>(5)</enum><text display-inline="yes-display-inline">The Department of Labor and the Equal
			 Employment Opportunity Commission have important and unique responsibilities to
			 help ensure that women receive equal pay for equal work.</text>
				</paragraph><paragraph id="HE1752C58067C42A9B0C4FE35E8A26A87"><enum>(6)</enum><text display-inline="yes-display-inline">The Department of Labor is responsible
			 for—</text>
					<subparagraph id="H6D213D50755741439C2AC5415F00E466"><enum>(A)</enum><text display-inline="yes-display-inline">collecting and making publicly available
			 information about women’s pay;</text>
					</subparagraph><subparagraph id="H5F6A4DA9BE3D4703A1B9D4490AA86004"><enum>(B)</enum><text display-inline="yes-display-inline">ensuring that companies receiving Federal
			 contracts comply with anti-discrimination affirmative action requirements of
			 Executive Order No. 11246 (relating to equal employment opportunity);</text>
					</subparagraph><subparagraph id="H8F10602B90BA4504AC551B54C963433A"><enum>(C)</enum><text display-inline="yes-display-inline">disseminating information about women’s
			 rights in the workplace;</text>
					</subparagraph><subparagraph id="H4C953254030C4C7CAAFD552D07D4B926"><enum>(D)</enum><text display-inline="yes-display-inline">helping women who have been victims of pay
			 discrimination obtain a remedy; and</text>
					</subparagraph><subparagraph id="HA57A24AC238641E2A283CD921182AC44"><enum>(E)</enum><text>being proactive in
			 investigating and prosecuting equal pay violations, especially systemic
			 violations, and in enforcing all of its mandates.</text>
					</subparagraph></paragraph><paragraph id="HB1E11B74DDF94F2EBEE4CF8A6CF48B01"><enum>(7)</enum><text display-inline="yes-display-inline">The Equal Employment Opportunity Commission
			 is the primary enforcement agency for claims made under the Equal Pay Act, and
			 issues regulations and guidance on appropriate interpretations of the
			 law.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCD9FD8BF2AE64C809022F8FD8D92F278"><enum>(8)</enum><text>With a stronger
			 commitment by the Department of Labor and the Equal Employment Opportunity
			 Commission to their responsibilities, increased information as a result of the
			 amendments made by this Act to the Equal Pay Act of 1963, wage data, and more
			 effective remedies, women will be better able to recognize and enforce their
			 rights.</text>
				</paragraph><paragraph id="HAAC301FC99894F75AFE82B9394285228"><enum>(9)</enum><text>Certain employers
			 have already made great strides in eradicating unfair pay disparities in the
			 workplace and their achievements should be recognized.</text>
				</paragraph></section><section id="HC39991D34EBD46F69A40FBDE1A6DD1AD"><enum>203.</enum><header>Enhanced
			 enforcement of equal pay requirements</header>
				<subsection id="H84944205981841BF909E69A37001E5B5"><enum>(a)</enum><header>Bona-fide factor
			 defense and modification of same establishment requirement</header><text display-inline="yes-display-inline">Section 6(d)(1) of the Fair Labor Standards
			 Act of 1938 (29 U.S.C. 206(d)(1)) is amended—</text>
					<paragraph id="HAC186BA3F3404CF9B9A152611F60C05E"><enum>(1)</enum><text>by striking
			 <quote>No employer having</quote> and inserting <quote>(A) No employer
			 having</quote>;</text>
					</paragraph><paragraph id="HF348DBD6A69D48EAB54314D47EAE9AEB"><enum>(2)</enum><text>by striking
			 <quote>any other factor other than sex</quote> and inserting <quote>a bona fide
			 factor other than sex, such as education, training, or experience</quote>;
			 and</text>
					</paragraph><paragraph id="H38C81FD58E0549F7B110BA24950EEDE0"><enum>(3)</enum><text>by inserting at
			 the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HB8232F74B2E14B6CAF651F3FCE5632F2" style="traditional">
							<subparagraph id="H384722CCC5DD4286A5F76E2C13CF5AD1" indent="up2"><enum>(B)</enum><text display-inline="yes-display-inline">The bona fide factor defense described in
				subparagraph (A)(iv) shall apply only if the employer demonstrates that such
				factor: (i) is not based upon or derived from a sex-based differential in
				compensation; (ii) is job-related with respect to the position in question; and
				(iii) is consistent with business necessity. Such defense shall not apply where
				the employee demonstrates that an alternative employment practice exists that
				would serve the same business purpose without producing such differential and
				that the employer has refused to adopt such alternative practice.</text>
							</subparagraph><subparagraph id="H5BE47E503D1D4C4788582DDD5C9EC012" indent="up2"><enum>(C)</enum><text display-inline="yes-display-inline">For purposes of subparagraph (A), employees
				shall be deemed to work in the same establishment if the employees work for the
				same employer at workplaces located in the same county or similar political
				subdivision of a State. The preceding sentence shall not be construed as
				limiting broader applications of the term <term>establishment</term> consistent
				with rules prescribed or guidance issued by the Equal Opportunity Employment
				Commission.</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H9818448757304523B5FC06282DE50689"><enum>(b)</enum><header>Nonretaliation
			 provision</header><text>Section 15 of the Fair Labor Standards Act of 1938 (29
			 U.S.C. 215(a)(3)) is amended—</text>
					<paragraph id="H0C14867289AC48B68A735D18C3C3DF38"><enum>(1)</enum><text>in subsection
			 (a)(3), by striking <quote>employee has filed</quote> and all that follows and
			 inserting</text>
						<quoted-block display-inline="yes-display-inline" id="H5A2AAD4401C0416B9A24EE8602D796B8" style="OLC">
							<text>employee—</text><subparagraph id="HBDF126177E9344FC890B002DB358B64C"><enum>(A)</enum><text display-inline="yes-display-inline">has made a charge or filed any complaint or
				instituted or caused to be instituted any investigation, proceeding, hearing,
				or action under or related to this Act, including an investigation conducted by
				the employer, or has testified or is planning to testify or has assisted or
				participated in any manner in any such investigation, proceeding, hearing or
				action, or has served or is planning to serve on an industry Committee;
				or</text>
							</subparagraph><subparagraph id="HEAE0846523C2450886E5B99FB9B85E41"><enum>(B)</enum><text display-inline="yes-display-inline">has inquired about, discussed or disclosed
				the wages of the employee or another
				employee.</text>
							</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H37A7B26159C54834BE0F6E1B1108359E"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HEC2988376E7842BFBE6A6BCF410B15A2" style="traditional">
							<subsection id="HF428616874FD4035A7F630CCCB6B9BDF"><enum>(c)</enum><text display-inline="yes-display-inline">Subsection (a)(3)(B) shall not apply to
				instances in which an employee who has access to the wage information of other
				employees as a part of such employee’s essential job functions discloses the
				wages of such other employees to individuals who do not otherwise have access
				to such information, unless such disclosure is in response to a complaint or
				charge or in furtherance of an investigation, proceeding, hearing, or action
				under section 6(d), including an investigation conducted by the employer.
				Nothing in this subsection shall be construed to limit the rights of an
				employee provided under any other provision of
				law.</text>
							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="H571D1BC8E66448E4BBBE3EDD59FFFB1D"><enum>(c)</enum><header>Enhanced
			 penalties</header><text>Section 16(b) of the Fair Labor Standards Act of 1938
			 (29 U.S.C. 216(b)) is amended—</text>
					<paragraph id="H7B068668D8B441E3927407EC3416F7BD"><enum>(1)</enum><text>by inserting after
			 the first sentence the following: <quote>Any employer who violates section 6(d)
			 shall additionally be liable for such compensatory damages, or, where the
			 employee demonstrates that the employer acted with malice or reckless
			 indifference, punitive damages as may be appropriate, except that the United
			 States shall not be liable for punitive damages.</quote>;</text>
					</paragraph><paragraph id="H26963F1F029746F590CBF103B03F39F7"><enum>(2)</enum><text>in the sentence
			 beginning <quote>An action to</quote>, by striking <quote>either of the
			 preceding sentences</quote> and inserting <quote>any of the preceding sentences
			 of this subsection</quote>;</text>
					</paragraph><paragraph id="HBD8956E952364907A915364D5DD26A54"><enum>(3)</enum><text>in the sentence
			 beginning <quote>No employees shall</quote>, by striking <quote>No
			 employees</quote> and inserting <quote>Except with respect to class actions
			 brought to enforce section 6(d), no employee</quote>;</text>
					</paragraph><paragraph id="HF28B4D834DFB439CB564EDF4ACB94B94"><enum>(4)</enum><text>by inserting after
			 the sentence referred to in paragraph (3), the following:
			 <quote>Notwithstanding any other provision of Federal law, any action brought
			 to enforce section 6(d) may be maintained as a class action as provided by the
			 Federal Rules of Civil Procedure.</quote>; and</text>
					</paragraph><paragraph id="H0F592755D9A847A3A903E3196705DF54"><enum>(5)</enum><text>in the sentence
			 beginning <quote>The court in</quote>—</text>
						<subparagraph id="HFD61F6A54BB140B4A68919BE941A7B44"><enum>(A)</enum><text>by striking
			 <quote>in such action</quote> and inserting <quote>in any action brought to
			 recover the liability prescribed in any of the preceding sentences of this
			 subsection</quote>; and</text>
						</subparagraph><subparagraph id="H523176D6795843C0B3654A4999BEA1FD"><enum>(B)</enum><text>by inserting
			 before the period the following: <quote>, including expert fees</quote>.</text>
						</subparagraph></paragraph></subsection><subsection id="H72D4197F79DD4457AFB701659EE1C899"><enum>(d)</enum><header>Action by
			 Secretary</header><text>Section 16(c) of the Fair Labor Standards Act of 1938
			 (29 U.S.C. 216(c)) is amended—</text>

						</subparagraph></paragraph></subsection></section><section id="HB7B20321780A466EABE9F929225B9797"><enum>204.</enum><header>Training</header><text display-inline="no-display-inline">The Equal Employment Opportunity Commission
			 and the Office of Federal Contract Compliance Programs, subject to the
			 availability of funds appropriated under section 210, shall provide training to
			 Commission employees and affected individuals and entities on matters involving
			 discrimination in the payment of wages.</text>
			</section><section id="H4E22817737224358A994C2DA35183CAD"><enum>205.</enum><header>Negotiation
			 skills training for girls and women</header>
				<subsection id="H1CE54B167A994F2286355342182751A6"><enum>(a)</enum><header>Program
			 authorized</header>
					<paragraph id="H5539CF372E8949ED9D677707F9B6EDF0"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Labor, after consultation with the
			 Secretary of Education, is authorized to establish and carry out a grant
			 program.</text>
					</paragraph><paragraph id="H5A08C68A138548B1963DEBC3ACAD5254"><enum>(2)</enum><header>Grants</header><text>In
			 carrying out the program, the Secretary of Labor may make grants on a
			 competitive basis to eligible entities, to carry out negotiation skills
			 training programs for girls and women.</text>
					</paragraph><paragraph id="H53C1444D1DD145EDA13911FDE8C71FBC"><enum>(3)</enum><header>Eligible
			 entities</header><text>To be eligible to receive a grant under this subsection,
			 an entity shall be a public agency, such as a State, a local government in a
			 metropolitan statistical area (as defined by the Office of Management and
			 Budget), a State educational agency, or a local educational agency, a private
			 nonprofit organization, or a community-based organization.</text>
					</paragraph><paragraph id="H2D79DAD0969642C3B7B9F3AE4B7C1052"><enum>(4)</enum><header>Application</header><text>To
			 be eligible to receive a grant under this subsection, an entity shall submit an
			 application to the Secretary of Labor at such time, in such manner, and
			 containing such information as the Secretary of Labor may require.</text>
					</paragraph><paragraph id="HB1F2F3E89A0948EB8F96BC7D51C5098F"><enum>(5)</enum><header>Use of
			 funds</header><text display-inline="yes-display-inline">An entity that receives
			 a grant under this subsection shall use the funds made available through the
			 grant to carry out an effective negotiation skills training program that
			 empowers girls and women. The training provided through the program shall help
			 girls and women strengthen their negotiation skills to allow the girls and
			 women to obtain higher salaries and rates of compensation that are equal to
			 those paid to similarly-situated male employees.</text>
					</paragraph></subsection><subsection id="H551F65C88F36415FA6897590BD8A058A"><enum>(b)</enum><header>Incorporating
			 training into existing programs</header><text>The Secretary of Labor and the
			 Secretary of Education shall issue regulations or policy guidance that provides
			 for integrating the negotiation skills training, to the extent practicable,
			 into programs authorized under—</text>
					<paragraph id="HFD317258C2CD45368A4F637A618DBAB0"><enum>(1)</enum><text>in the case of the
			 Secretary of Education, the Elementary and Secondary Education Act of 1965 (20
			 U.S.C. 6301 et seq.), the Carl D. Perkins Vocational and Technical Education
			 Act of 1998 (20 U.S.C. 2301 et seq.), the Higher Education Act of 1965 (20
			 U.S.C. 1001 et seq.), and other programs carried out by the Department of
			 Education that the Secretary of Education determines to be appropriate;
			 and</text>
					</paragraph><paragraph id="H306F0A77725A49ECB256958EA32F1833"><enum>(2)</enum><text>in the case of the
			 Secretary of Labor, the Workforce Investment Act of 1998 (29 U.S.C. 2801 et
			 seq.), and other programs carried out by the Department of Labor that the
			 Secretary of Labor determines to be appropriate.</text>
					</paragraph></subsection><subsection id="H29DDBB70195749AAA89D31EDB3C2C13B"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date of
			 enactment of this Act, and annually thereafter, the Secretary of Labor and the
			 Secretary of Education shall prepare and submit to Congress a report describing
			 the activities conducted under this section and evaluating the effectiveness of
			 such activities in achieving the purposes of this Act.</text>
				</subsection></section><section id="HBFB9E55A23384371BADE18E6581D22DF"><enum>206.</enum><header>Research,
			 education, and outreach</header><text display-inline="no-display-inline">The
			 Secretary of Labor shall conduct studies and provide information to employers,
			 labor organizations, and the general public concerning the means available to
			 eliminate pay disparities between men and women, including—</text>
				<paragraph id="H58C72BB2545D430B98ED8A87EEF72B73"><enum>(1)</enum><text>conducting and
			 promoting research to develop the means to correct expeditiously the conditions
			 leading to the pay disparities;</text>
				</paragraph><paragraph id="HC1066C4E620D4CDA9A507D803E5AB352"><enum>(2)</enum><text>publishing and
			 otherwise making available to employers, labor organizations, professional
			 associations, educational institutions, the media, and the general public the
			 findings resulting from studies and other materials, relating to eliminating
			 the pay disparities;</text>
				</paragraph><paragraph id="HC63AA8354B784D52929129DBA19C9021"><enum>(3)</enum><text>sponsoring and
			 assisting State and community informational and educational programs;</text>
				</paragraph><paragraph id="H9A516F713793496DB9B709E7B46997B4"><enum>(4)</enum><text>providing
			 information to employers, labor organizations, professional associations, and
			 other interested persons on the means of eliminating the pay
			 disparities;</text>
				</paragraph><paragraph id="HDE6B15879C024E168E78C8B83BE33AF0"><enum>(5)</enum><text>recognizing and
			 promoting the achievements of employers, labor organizations, and professional
			 associations that have worked to eliminate the pay disparities; and</text>
				</paragraph><paragraph id="H23229BDF1C0E4DE7A26FCDE6818B2373"><enum>(6)</enum><text>convening a
			 national summit to discuss, and consider approaches for rectifying, the pay
			 disparities.</text>
				</paragraph></section><section id="HEB00FDB4FA374738B0069FE6980BD474"><enum>207.</enum><header>Establishment
			 of the National Award for Pay Equity in the Workplace</header>
				<subsection id="HBAC7372DAEAE40DBAB831A465F9091A5"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">There is established
			 the Secretary of Labor’s National Award for Pay Equity in the Workplace, which
			 shall be awarded, as appropriate, to encourage proactive efforts to comply with
			 section 6(d) of the Fair Labor Standards Act of 1938 (29 U.S.C. 206(d)).</text>
				</subsection><subsection id="H50AF5ECC40514514BCDBC8637D771542"><enum>(b)</enum><header>Criteria for
			 qualification</header><text display-inline="yes-display-inline">The Secretary
			 of Labor shall set criteria for receipt of the award, including a requirement
			 that an employer has made substantial effort to eliminate pay disparities
			 between men and women, and deserves special recognition as a consequence of
			 such effort. The Secretary shall establish procedures for the application and
			 presentation of the award.</text>
				</subsection><subsection id="H969078C29BAB403C80B52281E5BB4EAB"><enum>(c)</enum><header>Business</header><text>In
			 this section, the term <term>employer</term> includes—</text>
					<paragraph id="H59DCAF67DA664E9CAF9D8C0B6F9FCE3E"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H00923320F7534209B0BCDAE0A59C3F96"><enum>(A)</enum><text>a corporation, including
			 a nonprofit corporation;</text>
						</subparagraph><subparagraph id="H782783B9DE21470FA725B988ED80B4C3" indent="up1"><enum>(B)</enum><text>a partnership;</text>
						</subparagraph><subparagraph id="H4788601A5C274230B277B1BF247744AD" indent="up1"><enum>(C)</enum><text>a professional association;</text>
						</subparagraph><subparagraph id="HA83459F84D64486487638BBE09AAC078" indent="up1"><enum>(D)</enum><text>a labor organization; and</text>
						</subparagraph><subparagraph id="H410B38544A3446C1BD01C10CE41EAE16" indent="up1"><enum>(E)</enum><text>a business entity similar to an entity
			 described in any of subparagraphs (A) through (D);</text>
						</subparagraph></paragraph><paragraph id="HE9F10F618AA64635BF731C5209098BBB"><enum>(2)</enum><text>an entity carrying
			 out an education referral program, a training program, such as an
			 apprenticeship or management training program, or a similar program; and</text>
					</paragraph><paragraph id="H5FAE8BFBA0D644699EDAE98B1740FA62"><enum>(3)</enum><text>an entity carrying
			 out a joint program, formed by a combination of any entities described in
			 paragraph (1) or (2).</text>
					</paragraph></subsection></section><section id="H068AE99244F24A8EB01B3BE4B15DD9F5"><enum>208.</enum><header>Collection of
			 pay information by the equal employment opportunity Commission</header><text display-inline="no-display-inline">Section 709 of the
			 <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name> (42 U.S.C.
			 2000e–8) is amended by adding at the end the following:</text>
				<quoted-block act-name="Civil Rights Act of 1964" id="HAD2E2F1C06ED4304BD1A2D9406FB9164">
					<subsection id="H976BA3142A9A40EC99C00393771CD213"><enum>(f)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE721E6E7760D40A684CE1F3A2FB39535"><enum>(1)</enum><text>Not later than 18 months
				after the date of enactment of this subsection, the Commission shall—</text>
							<subparagraph id="H13E02D50D50D4B3C80E212B4289824AD" indent="up1"><enum>(A)</enum><text>complete a survey of the data that is
				currently available to the Federal Government relating to employee pay
				information for use in the enforcement of Federal laws prohibiting pay
				discrimination and, in consultation with other relevant Federal agencies,
				identify additional data collections that will enhance the enforcement of such
				laws; and</text>
							</subparagraph><subparagraph id="H375567E21E4548DBAAD6817DF554D22F" indent="up1"><enum>(B)</enum><text>based on the results of the survey and
				consultations under subparagraph (A), issue regulations to provide for the
				collection of pay information data from employers as described by the sex,
				race, and national origin of employees.</text>
							</subparagraph></paragraph><paragraph id="H663CE20C04DE4FA6BA0B274066291720" indent="up1"><enum>(2)</enum><text>In implementing paragraph (1), the
				Commission shall have as its primary consideration the most effective and
				efficient means for enhancing the enforcement of Federal laws prohibiting pay
				discrimination. For this purpose, the Commission shall consider factors
				including the imposition of burdens on employers, the frequency of required
				reports (including which employers should be required to prepare reports),
				appropriate protections for maintaining data confidentiality, and the most
				effective format for the data collection
				reports.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H5DF8B78AD9C54D65A6B6B10E8B435AC0"><enum>209.</enum><header>Reinstatement
			 of pay equity programs and pay equity data collection</header>
				<subsection id="H1CC43DEE5FEE44B4BDAA06CD88C836C1"><enum>(a)</enum><header>Bureau of Labor
			 Statistics data collection</header><text>The Commissioner of Labor Statistics
			 shall continue to collect data on women workers in the Current Employment
			 Statistics survey.</text>
				</subsection><subsection id="H7AE16CDCE9FB4CF0BB640EFE081B2729"><enum>(b)</enum><header>Office of
			 Federal Contract Compliance Programs initiatives</header><text>The Director of
			 the Office of Federal Contract Compliance Programs shall ensure that employees
			 of the Office—</text>
					<paragraph id="H9A177BD629374C3C91BB3C52039131F4"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H3C753B0ADC2B4A0FB49B2354B1996BCA"><enum>(A)</enum><text>shall use the full range
			 of investigatory tools at the Office's disposal, including pay grade
			 methodology;</text>
						</subparagraph><subparagraph id="H2B4B3A6A8CBF43A6BB6C86E2205E554F" indent="up1"><enum>(B)</enum><text>in considering evidence of possible
			 compensation discrimination—</text>
							<clause id="H726FEB99110B4EFC8B0BEC5CC8E30310"><enum>(i)</enum><text>shall not limit its consideration
			 to a small number of types of evidence; and</text>
							</clause><clause id="H459D8058E8534B7FB3891D693E58C8F5"><enum>(ii)</enum><text>shall not limit its evaluation of
			 the evidence to a small number of methods of evaluating the evidence;
			 and</text>
							</clause></subparagraph><subparagraph id="HA77C882E40DC4DA7832D8CD6E940130A" indent="up1"><enum>(C)</enum><text>shall not require a multiple
			 regression analysis or anecdotal evidence for a compensation discrimination
			 case;</text>
						</subparagraph></paragraph><paragraph id="H4A9D6A6682D74F0A9063046005884901"><enum>(2)</enum><text>for purposes of
			 its investigative, compliance, and enforcement activities, shall define
			 <term>similarly situated employees</term> in a way that is consistent with and
			 not more stringent than the definition provided in item 1 of subsection A of
			 section 10–III of the Equal Employment Opportunity Commission Compliance Manual
			 (2000), and shall consider only factors that the Office's investigation reveals
			 were used in making compensation decisions; and</text>
					</paragraph><paragraph id="H03CECC5126CE42EBBDE9CF300BD90275"><enum>(3)</enum><text display-inline="yes-display-inline">shall reinstate the Equal Opportunity
			 Survey, as required by section 60–2.18 of title 41, Code of Federal Regulations
			 (as in effect on September 7, 2006), designating not less than half of all
			 nonconstruction contractor establishments each year to prepare and file such
			 survey, and shall review and utilize the responses to such survey to identify
			 contractor establishments for further evaluation and for other enforcement
			 purposes as appropriate.</text>
					</paragraph></subsection><subsection id="H408ECF1FB6754EFA926B499A5056D792"><enum>(c)</enum><header>Department of
			 Labor distribution of wage discrimination information</header><text>The
			 Secretary of Labor shall make readily available (in print, on the Department of
			 Labor website, and through any other forum that the Department may use to
			 distribute compensation discrimination information), accurate information on
			 compensation discrimination, including statistics, explanations of employee
			 rights, historical analyses of such discrimination, instructions for employers
			 on compliance, and any other information that will assist the public in
			 understanding and addressing such discrimination.</text>
				</subsection></section><section id="HE9891998AE684F17A015C23DA87230FF"><enum>210.</enum><header>Authorization
			 of appropriations</header>
				<subsection id="H93058094C6B44D409F79CE2951F18A0B"><enum>(a)</enum><header>Authorization of
			 Appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated $15,000,000 to carry out this title.</text>
				</subsection><subsection id="H7C84ACA78EAE472B92B564727637AFB2"><enum>(b)</enum><header>Prohibition on
			 Earmarks</header><text display-inline="yes-display-inline">None of the funds
			 appropriated pursuant to subsection (a) for purposes of the grant program in
			 section 205 of this Act may be used for a Congressional earmark as defined in
			 clause 9(d) of rule XXI of the Rules of the House of Representatives.</text>
				</subsection></section><section display-inline="no-display-inline" id="H7A4A8046EBC14FDFBAB4217E8D311EB6" section-type="subsequent-section"><enum>211.</enum><header>Small Business
			 Assistance</header>
				<subsection id="H34E2C3DD26ED485D8AF3D1686860ECB3"><enum>(a)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">This title and the
			 amendments made by this title shall take effect on the date that is 6 months
			 after the date of enactment of this Act.</text>
				</subsection><subsection id="HB9AF359F294B4C7EAAC87923AB84BB2E"><enum>(b)</enum><header>Technical
			 assistance materials</header><text>The Secretary of Labor and the Commissioner
			 of the Equal Employment Opportunity Commission shall jointly develop technical
			 assistance material to assist small businesses in complying with the
			 requirements of this title and the amendments made by this title.</text>
				</subsection><subsection id="HCD4FCDADA76E4C6EA62D9EF5E8A6F4A8"><enum>(c)</enum><header>Small
			 Businesses</header><text>A small business shall be exempt from the provisions
			 of this title to the same extent that such business is exempt from the
			 requirements of the Fair Labor Standards Act pursuant to section 3(s)(1)(A)(i)
			 and (ii) of such Act.</text>
				</subsection></section><section display-inline="no-display-inline" id="HD9F06F43A24D4B379EA91DEFE5F280F1" section-type="subsequent-section"><enum>212.</enum><header>Rule of
			 Construction</header><text display-inline="no-display-inline">Nothing in this
			 title, or in any amendments made by this title, shall affect the obligation of
			 employers and employees to fully comply with all applicable immigration laws,
			 including any penalties, fines, or other sanctions.</text>
