		<official-title>To promote the use of certain materials harvested from
		  public lands in the production of renewable fuel, and for other
		  purposes.</official-title>

		<section id="HCAF4B4F4B96B4B6C93FDFA7531BB3C04" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Renewable Biomass Facilitation Act of
			 2009</short-title></quote>.</text>
		</section><section id="H6F57ED24D1D14B4389286FF42692E259"><enum>2.</enum><header>Renewable
			 biomass</header><text display-inline="no-display-inline">Section 201 of the
			 Energy Independence and Security Act of 2007 (Public Law 110–140; 121 Stat.
			 1519) is amended in the amendment made to section 211(o)(1) of the Clean Air
			 Act (42 U.S.C. 7545) by amending subparagraph (I) of such section 211(o)(1) to
			 read as follows:</text>
			<quoted-block id="HCB1282D1CCB04BD1BD09D56E7E774398" style="OLC">
				<subparagraph id="H3FB0A7ABB03A4DF59D28246DCD4D87F9"><enum>(I)</enum><header>Renewable
				biomass</header><text>The term <term>renewable biomass</term> means—</text>
				</subparagraph><subparagraph id="HBADE61679C2D4CB290447FE2B8986C1"><enum>(A)</enum><text>materials,
				precommercial thinnings, or removed exotic species that—</text>
					<clause id="H2EAF6C320317417DA348BB64BA1F1CA"><enum>(i)</enum><text>are
				byproducts of preventive treatments (such as trees, wood, brush, thinnings,
				chips, and slash) that are removed—</text>
						<subclause id="H6D0F43D609E04AECBC2E3EE7B8B89300"><enum>(I)</enum><text>to reduce
				hazardous fuels;</text>
						</subclause><subclause id="H5A96D7EF708F43AE9CF4656DBB87BACB"><enum>(II)</enum><text>to reduce or
				contain disease or insect infestation; or</text>
						</subclause><subclause id="H81C3A44FD9A6439B965F07D64D63D1A0"><enum>(III)</enum><text>to restore
				ecosystem health;</text>
						</subclause></clause><clause id="HAA12FF18750D4A5D8B98F05EFD192D68"><enum>(ii)</enum><text>would not
				otherwise be used for higher-value products; and</text>
					</clause><clause id="H4589C6A2F69E4A45983DBCA7EFCD0203"><enum>(iii)</enum><text>are harvested
				from National Forest System land or public lands (as defined in section 103 of
				the Federal Land Policy and Management Act of 1976) in accordance with—</text>
						<subclause id="H3B1DB4BBEFF24F8C96AE381831850085"><enum>(I)</enum><text>Federal and State
				law;</text>
						</subclause><subclause id="H4BC00C4926074B3DA40527449E2E0070"><enum>(II)</enum><text>applicable land
				management plans; and</text>
						</subclause><subclause id="HF4C9DC9C7D7C47E8A1C7A85824358BB5"><enum>(III)</enum><text>the requirements
				for old-growth maintenance, restoration, and management direction of paragraphs
				(2), (3), and (4) of subsection (e) of section 102 of the Healthy Forests
				Restoration Act of 2003 and the requirements for large-tree retention of
				subsection (f) of that section; or</text>
						</subclause></clause></subparagraph><subparagraph id="HA4AA2944196B4A98A48615B7A9DF482D"><enum>(B)</enum><text>any organic matter
				that is available on a renewable or recurring basis from non-Federal land or
				land belonging to an Indian or Indian tribe that is held in trust by the United
				States or subject to a restriction against alienation imposed by the United
				States, including—</text>
					<clause id="HEA3BF66A9F344DF6B2CF64B2A09FE6A0"><enum>(i)</enum><text>renewable plant
				material, including—</text>
						<subclause id="HEE7CCEA3990347A3BA4FF87813DBAED1"><enum>(I)</enum><text>feed
				grains;</text>
						</subclause><subclause id="H5611875FBB994A14935818764975E0C1"><enum>(II)</enum><text>other
				agricultural commodities;</text>
						</subclause><subclause id="HADE220B4D3484FE79FF265B4D63B1CDB"><enum>(III)</enum><text>other plants and
				trees; and</text>
						</subclause><subclause id="H74213779700B4D93B8BBE8B9D9F154E4"><enum>(IV)</enum><text>algae; and</text>
						</subclause></clause><clause id="HA935BB5C6E4D4D598545CBA6C731B372"><enum>(ii)</enum><text>waste material,
				including—</text>
						<subclause id="H07C737E4CAE24ADAAECE002E97FDD682"><enum>(I)</enum><text>crop
				residue;</text>
						</subclause><subclause id="H3391A2DFBEC5423BA0EDB437BD5400BA"><enum>(II)</enum><text>other vegetative
				waste material (including wood waste and wood residues);</text>
						</subclause><subclause id="H3DCCBAE27E0B454D9960955EFE852BE"><enum>(III)</enum><text>animal waste and
				byproducts (including fats, oils, greases, and manure);</text>
						</subclause><subclause id="HBD6002805E78415C8E6B6FC209D369E0"><enum>(IV)</enum><text>construction
				waste; and</text>
						</subclause><subclause id="HC2BEC43DCBB84262BBD02C520EEE200"><enum>(V)</enum><text>food waste and yard
				waste.</text>
