		<official-title>To amend the Servicemembers Civil Relief Act to guarantee
		  the equity of spouses of military personnel with regard to matters of
		  residency, and for other purposes.</official-title>

		<section id="H037157602D4E481F8CED4BAC93D7AACA" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Military Spouses Residency Relief
			 Act</short-title></quote>.</text>
		</section><section id="H9EFA0F677DA34EB5AB04307FD3004402"><enum>2.</enum><header>Guarantee of
			 residency for spouses of military personnel for voting purposes</header>
			<subsection id="H07E3E92EBA8E425480FC7200AE49E023"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 705 of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 595) is amended—</text>
				<paragraph id="H7EEBDB3A8633432BA92493DC87A085E"><enum>(1)</enum><text>by
			 striking <quote>For</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="HC8583D3AF5AE460BB6B85D3100C84FBB" style="OLC">
						<subsection id="H8A24B89DE5CE4CF09EB8005E007894BF"><enum>(a)</enum><header>In
				general</header><text>For</text>
						</subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="HDDAED5563B964CE59FC300207E33D1D9"><enum>(2)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H549EA49E596E4FB49E72E6B8CA919F00" style="OLC">
						<subsection id="H0BF931F8B6BE4E3A9628EDE4B713D52"><enum>(b)</enum><header>Spouses</header><text display-inline="yes-display-inline">For the purposes of voting for any Federal
				office (as defined in section 301 of the Federal Election Campaign Act of 1971
				(2 U.S.C. 431)) or a State or local office, a person who is absent from a State
				because the person is accompanying the person’s spouse who is absent from that
				same State in compliance with military or naval orders shall not, solely by
				reason of that absence—</text>
							<paragraph id="H4FE6686F63C34FE7ABB5A365A320B2D"><enum>(1)</enum><text>be deemed to have
				lost a residence or domicile in that State, without regard to whether or not
				the person intends to return to that State;</text>
							</paragraph><paragraph id="HAF5CFF340AF3476587BED0DE2B5E2F91"><enum>(2)</enum><text>be deemed to have
				acquired a residence or domicile in any other State; or</text>
							</paragraph><paragraph id="H95AA5921C7EB49698B137957D4D1B973"><enum>(3)</enum><text>be deemed to have
				become a resident in or a resident of any other
				State.</text>
							</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H4918A8DD15444AEAAD00C217AB5D007E"><enum>(3)</enum><text>in the section
			 heading, by inserting <quote><header-in-text level="section" style="OLC">and
			 spouses of military personnel</header-in-text></quote> before the period at the
			 end.</text>
				</paragraph></subsection><subsection id="H86278EC53CDA4FD5B100AE17AC58E96F"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of contents in section 1(b) of such Act (50
			 U.S.C. App. 501) is amended by striking the item relating to section 705 and
			 inserting the following new item:</text>

					<toc regeneration="no-regeneration">
						<toc-entry level="section">Sec. 705. Guarantee of residency for
				military personnel and spouses of military
				personnel.</toc-entry>
					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H46E1EDE34C5349BDB5EAC415AEB900A4"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Subsection (b) of section 705 of such Act
			 (50 U.S.C. App. 595), as added by subsection (a) of this section, shall apply
			 with respect to absences from States described in such subsection (b) on or
			 after the date of the enactment of this Act, regardless of the date of the
			 military or naval order concerned.</text>
			</subsection></section><section id="HC8E435495C4C48DFB1282331007F77ED"><enum>3.</enum><header>Determination for
			 tax purposes of residence of spouses of military personnel</header>
			<subsection id="HCC3D6F07CCF740CF945644AECB843545"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 511 of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 571) is amended—</text>
				<paragraph id="HBD793D75AC90425B948D13019E531FE9"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="H2D7809EFA4724C06AD8088A3E2303788"><enum>(A)</enum><text>by striking
			 <quote>A servicemember</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF3F821367D0640F7B3AC4EA100B49644" style="OLC">
							<paragraph id="H13D8908EDAA04D1690F011A790589784"><enum>(1)</enum><header>In
				general</header><text>A servicemember</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="H590E103C9DE842C88014E3E3E9DB3DE"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H826C423F7EE647CBBC7C11A39DCA6CD0" style="OLC">
							<paragraph id="H9A12279B85244F10BA3FA67615006231"><enum>(2)</enum><header>Spouses</header><text display-inline="yes-display-inline">A spouse of a servicemember shall neither
				lose nor acquire a residence or domicile for purposes of taxation with respect
				to the person, personal property, or income of the spouse by reason of being
				absent or present in any tax jurisdiction of the United States solely to be
				with the servicemember in compliance with the servicemember’s military orders
				if the residence or domicile, as the case may be, is the same for the
				servicemember and the spouse.</text>
							</paragraph><after-quoted-block>;
				</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="H9E047788E73D433CB3F7BA03B8A45BCD"><enum>(2)</enum><text>by redesignating
			 subsections (c), (d), (e), and (f) as subsections (d), (e), (f), and (g),
			 respectively;</text>
				</paragraph><paragraph id="HDEDC726587264AC995B2D5E6E14776F9"><enum>(3)</enum><text>by inserting after
			 subsection (b) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H8C26F16BC20645F897100000173BE654" style="OLC">
						<subsection id="HDBC1CC1B408D416395BCFC1532826EC1"><enum>(c)</enum><header>Income of a
				Military Spouse</header><text display-inline="yes-display-inline">Income for
				services performed by the spouse of a servicemember shall not be deemed to be
				income for services performed or from sources within a tax jurisdiction of the
				United States if the spouse is not a resident or domiciliary of the
				jurisdiction in which the income is earned because the spouse is in the
				jurisdiction solely to be with the servicemember serving in compliance with
				military orders.</text>
						</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H6622165D13354034BDD97FFDBB945617"><enum>(4)</enum><text>in subsection (d),
			 as redesignated by paragraph (2)—</text>
					<subparagraph id="H7C399563E6304FC5B8F908CF559DC624"><enum>(A)</enum><text>in paragraph (1),
			 by inserting <quote>or the spouse of a servicemember</quote> after <quote>The
			 personal property of a servicemember</quote>; and</text>
					</subparagraph><subparagraph id="HB491512B9B424DDD84D01082BC4BC265"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2), by inserting <quote>or
			 the spouse’s</quote> after <quote>servicemember’s</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="H90B8E223C5A94F70AA688E7600F47DE8"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">Subsections (a)(2) and (c) of section 511
			 of such Act (50 U.S.C. App. 571), as added by subsection (a) of this section,
			 and the amendments made to such section 511 by subsection (a)(4) of this
			 section, shall apply with respect to any return of State or local income tax
			 filed for any taxable year beginning with the taxable year that includes the
			 date of the enactment of this Act.</text>
			</subsection></section><section id="H5EFE2D25C1704EEE8B53E1BA5D14742C"><enum>4.</enum><header>Suspension of
			 land rights residency requirement for spouses of military personnel</header>
			<subsection id="HCBB4A4FD1E7F4AD891EB8D29C73695C8"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 508 of the
			 Servicemembers Civil Relief Act (50 U.S.C. App. 568) is amended in subsection
			 (b) by inserting <quote>or the spouse of such servicemember</quote> after
			 <quote>a servicemember in military service</quote>.</text>
			</subsection><subsection id="H9DA5DBE426FF4F29945B13D500B4AAB"><enum>(b)</enum><header>Application</header><text>The
			 amendment made by subsection (a) shall apply with respect to servicemembers in
			 military service (as defined in section 101 of such Act (50 U.S.C. App. 511))
			 on or after the date of the enactment of this Act.</text>
