		  taxpayers to designate a portion of their income tax payments to a National
		  Military Family Relief Fund to be used by the Secretary of Defense to assist
		  the families of members of the Armed Forces who are serving in, or have served
		  in, Iraq or Afghanistan.</official-title>

		<section id="H2651CAF667BE42AFAC506202DA2551B3" section-type="section-one"><enum>1.</enum><header>National Military Family
			 Relief Fund to assist families of members of the Armed Forces who are serving
			 in, or have served in, Iraq or Afghanistan</header>
			<subsection id="HABBD02D726D34668A1A1089747FDE8E6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Subchapter I of
			 chapter 88 of title 10, United States Code, is amended by inserting after
			 section 1781b the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H6361A7BC95BD47E8A880A956FE2D39E5" style="USC">
					<section id="H584F830B0A314E71009635A684E1DD19"><enum>1781c.</enum><header>National
				Military Family Relief Fund to assist military families</header>
						<subsection id="H6C4931CAFAD94B3686B90056678F1544"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the Treasury a
				fund, which shall be known as the <quote>National Military Family Relief
				Fund</quote> (in this section referred to as the <quote>Fund</quote>).</text>
						</subsection><subsection id="HE5D06AE083734BFA9F55CE824BB600FF"><enum>(b)</enum><header>Credits to
				fund</header><text display-inline="yes-display-inline">There are hereby
				appropriated to the Fund in each fiscal year an amount equal to the amounts
				designated for deposit in the Fund under section 6098 of the Internal Revenue
				Code of 1986 in the taxable year ending in that fiscal year.</text>
						</subsection><subsection id="H092D973B22D9408EB99FB16F3C80FC62"><enum>(c)</enum><header>Use of
				Fund</header><text display-inline="yes-display-inline">The Secretary of Defense
				shall use amounts in the Fund, without further specific authorization in law,
				to make grants to members of the Armed Forces who are serving in, or have
				served in, Iraq or Afghanistan to assist the families of such members.</text>
						</subsection><subsection id="H5C28F4B2535840FBA6E456AF09874E5D"><enum>(d)</enum><header>Grant
				criteria</header><text display-inline="yes-display-inline">The Secretary of
				Defense shall prescribe the criteria under which grant applications will be
				solicited and grants will be made and the purposes for which grants may be
				used.</text>
						</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HB07B127E80114784B4F578FD9B20AEC1"><enum>(b)</enum><header>Clerical
			 amendment</header><text>The table of sections at the beginning of such
			 subchapter is amended by inserting after the item relating to section 1781b the
			 following new item:</text>

			</subsection></section><section display-inline="no-display-inline" id="HC19D719F0D434EB09FE1B0B54BB70275" section-type="subsequent-section"><enum>2.</enum><header>Designation of income
			 tax payments to National Military Family Relief Fund</header>
			<subsection id="HF74EBAB03DFB4AA1BDA25D7980FF985D"><enum>(a)</enum><header>In
			 general</header><text>Subchapter A of chapter 61 of the Internal Revenue Code
			 of 1986 (relating to information and returns) is amended by adding at the end
			 the following new part:</text>

				income tax payments to National Military Family Relief Fund</header>

							<toc-entry level="section">Sec. 6098. Designation to National
				  Military Family Relief Fund.</toc-entry>
						</toc>
						<section id="H4BDDFA14DD7E4A3B828F01147020665B"><enum>6098.</enum><header>Designation to
				National Military Family Relief Fund</header>
							<subsection id="HF50B94619FF64ADEAA497118DD8C00BD"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Every individual
				(other than a nonresident alien), with respect to each taxpayer’s return for
				the taxable year of the tax imposed by chapter 1—</text>
								<paragraph id="HCD8BA33029FF445EBA7D375B35CC3300"><enum>(1)</enum><text display-inline="yes-display-inline">whose adjusted income tax liability for the
				taxable year is $1 or more may designate that a specified portion (not less
				than $1) of any overpayment of tax shall be paid over to, and</text>
								</paragraph><paragraph id="H61E4DAEAB04F44EAAB80BE0072883D17"><enum>(2)</enum><text display-inline="yes-display-inline">in addition to any payment of income tax
				liability, may make a contribution of an additional amount which shall be paid
				over to,</text>
								</paragraph><continuation-text continuation-text-level="subsection">the
				National Military Family Relief Fund, established under section 1781c of title
				10, United States Code.</continuation-text></subsection><subsection id="HF96012D0A67B466C91FAEC29C461892C"><enum>(b)</enum><header>Adjusted income
				tax liability</header><text>For purposes of subsection (a), the term
				<term>adjusted income tax liability</term> means, for any individual for any
				taxable year, the excess (if any) of—</text>
								<paragraph id="HA8B142FFF7AC403AAAA14F6D42603997"><enum>(1)</enum><text>the income tax
				liability (as defined in section 6096(b)) of the individual for the taxable
				year, over</text>
								</paragraph><paragraph id="HE89BD1B8F3144D029CA9A6EEA9BFD0C1"><enum>(2)</enum><text>any amount
				designated by the individual (and, in the case of a joint return, any amount
				designated by the individual’s spouse) under section 6096(a) for such taxable
				year.</text>
								</paragraph></subsection><subsection id="H224C3F26F18E4DDC81CB7DC272E58CA3"><enum>(c)</enum><header>Manner and time
				of designation and contribution</header><text>A designation and contribution
				under subsection (a) may be made with respect to any taxable year—</text>
								<paragraph id="H46A5CC34DFEE4E75991B4D33739CC821"><enum>(1)</enum><text>at the time of
				filing the return of the tax imposed by chapter 1 for such taxable year,
				or</text>
								</paragraph><paragraph id="H320CFC43D9E44619911D298370CD1874"><enum>(2)</enum><text>at any other time
				(after the time of filing the return of the tax imposed by chapter 1 for such
				taxable year) specified in regulations prescribed by the Secretary.</text>
								</paragraph><continuation-text continuation-text-level="subsection">Such
				designation shall be made in such manner as the Secretary prescribes by
				regulations except that, if such designation is made at the time of filing the
				return of the tax imposed by chapter 1 for such taxable year, such designation
				shall be made either on the first page of the return or on the page bearing the
				taxpayer’s signature.</continuation-text></subsection><subsection id="HE2523CB8F8E4430C86D9FC1024CB8DEB"><enum>(d)</enum><header>Overpayments
				treated as refunded</header><text display-inline="yes-display-inline">For
				purposes of this title, any portion of an overpayment of tax designated under
				subsection (a) shall be treated as—</text>
								<paragraph id="HCF6BC7C7739F43D38D671CB9641E6E69"><enum>(1)</enum><text>being refunded to
				the taxpayer as of the last date prescribed for filing the return of tax
				imposed by chapter 1 (determined without regard to extensions) or, if later,
				the date the return is filed, and</text>
								</paragraph><paragraph id="H1762E38CD7ED42C88955792F24BAEBC1"><enum>(2)</enum><text>a contribution
				made by such taxpayer on such date to the United
				States.</text>
								</paragraph></subsection></section></part><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC006E2431B3941198B05FD3D783774FD"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of parts
			 for subchapter A of chapter 61 of such Code is amended by adding at the end the
			 following new item:</text>

			 date</header><text>The amendments made by this section shall apply to taxable
			 years beginning after the date of the enactment of this Act.</text>
