2.In this Act, the following definitions
apply:
(1)The
term Administrator means the Administrator of the Federal
Emergency Management Agency appointed under section 102.
(2)The term Agency means the
Federal Emergency Management Agency established under section 101.
(3)The
term emergency has the meaning given that term in section 102 of
the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5122).
(4)The term emergency management means
preparedness for, response to, recovery from, and mitigating hazards.
(5)The
term hazard has the meaning given that term in section 602(b) of
the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5196(b)) and includes any major disaster or emergency.
(6)The term major disaster has the meaning
given that term in section 102 of the Robert T. Stafford Disaster Relief and
Emergency Assistance Act (42 U.S.C. 5122).
<enum>I</enum><header>Establishment of Federal
Emergency Management Agency</header>
<section id="H7D7642E545C944789A52896DAD870D7F"><enum>101.</enum><header>Establishment of
independent agency</header>
<subsection id="H14605FBDE7924AC6B1E409D11BD9E80E"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Federal Emergency
Management Agency is established as a cabinet-level independent establishment
in the executive branch.</text>
</subsection><subsection id="H662B23F943CE420EA98E5A6C018CB4C2"><enum>(b)</enum><header>Mission</header><text display-inline="yes-display-inline">The primary mission of the Agency shall be
to reduce the loss of life and property and protect the Nation from hazards by
leading and supporting the Nation in a comprehensive emergency management
system of preparedness, response, recovery, and mitigation.</text>
</subsection></section><section id="HEB357E45DCB24F1FB6C240768BCAD50F"><enum>102.</enum><header>Administrator; Deputy
Administrator; and other officials of the Agency</header>
<subsection id="H486C18A4FF1F42D0A82AB7D49B60FE8F"><enum>(a)</enum><header>Administrator</header>
<paragraph id="H30F2980A9B774FF7A1FDADED3C397836"><enum>(1)</enum><header>In
general</header><text>The Agency shall be headed by an Administrator, who shall
be appointed by the President, by and with the advice and consent of the
Senate, and who shall report directly to the President.</text>
</paragraph><paragraph id="H135D2EB4923E43259831B2A9A190CF13"><enum>(2)</enum><header>Qualifications</header><text>The
Administrator shall be appointed from among individuals who have extensive
experience in emergency preparedness, response, recovery, and mitigating
hazards.</text>
</paragraph><paragraph id="HB5AA347AA92042009FE67ABCDCBAAC23"><enum>(3)</enum><header>Executive
schedule</header><text>Title 5, United States Code, is amended—</text>
<subparagraph id="H165EC69FBF6D4A83A7184AC52886A873"><enum>(A)</enum><text>in section 5312 by adding
at the end the following:</text>

Administrator</header>
<paragraph id="H7328F569EC954942B3FCBAACCBA6E25E"><enum>(1)</enum><header>In
general</header><text>The Agency shall have one Deputy Administrator, who shall
be appointed by the President, by and with the advice and consent of the
Senate. The Deputy Administrator shall carry out duties and powers prescribed
by the Administrator and act for the Administrator when the Administrator is
absent or unable to serve or when the position of the Administrator is
vacant.</text>
</paragraph><paragraph id="HEF49CE30BEE944B6A4C20FD5C87D37B2"><enum>(2)</enum><header>Qualifications</header><text>The
Deputy Administrator shall be appointed from among individuals who have
extensive experience in emergency preparedness, response, recovery, and
mitigating hazards.</text>

schedule</header><text display-inline="yes-display-inline">Section 5314 of
title 5, United States Code, is amended by striking the item relating to

shall be determined by the Administrator.</text>

Assistant Administrator shall be appointed from among individuals who have a
demonstrated ability in and knowledge of emergency management or other field
relevant to their position.</text>
</paragraph></subsection><subsection id="H7FE19B13E5184D5A961354AEFDA46571"><enum>(d)</enum><header>Regional
offices</header>
<paragraph id="H48952A0A0FB24EDE8C23BCE3C25C3AC7"><enum>(1)</enum><header>In
general</header><text>There shall be in the Agency 10 Regional Offices, as
identified by the Administrator.</text>
</paragraph><paragraph id="H2117CF65964C43C18FEE5675C9826C2E"><enum>(2)</enum><header>Regional
Administrators</header>
<subparagraph id="HCEC61608436C4D78897CAF90E8DB01BB"><enum>(A)</enum><header>In
general</header><text>Each Regional Office shall be headed by a Regional
Administrator who shall be appointed by the Administrator.</text>
</subparagraph><subparagraph id="H730D9B5739434B8DA9F3B4533D5F5CD3"><enum>(B)</enum><header>Qualifications</header>
<clause id="HAD88935FAE42400A8D2FD4B5F7A29B0E"><enum>(i)</enum><header>In
general</header><text>Each Regional Administrator shall be appointed from among
individuals who have a demonstrated ability in and knowledge of emergency
management.</text>
</clause><clause id="H4034CCEF2E5D4D3CBC75F626F7A94F47"><enum>(ii)</enum><header>Considerations</header><text>In
selecting an individual to serve as a Regional Administrator for a Regional
Office, the Administrator shall consider the familiarity of the individual with
the geographical area and demographic characteristics of the population served
by the Regional Office.</text>
</clause></subparagraph></paragraph><paragraph id="HE9F454873C4A48B8B02E8E0E3CDFC89D"><enum>(3)</enum><header>Regional advisory
councils</header>
<subparagraph id="HAB84E181B5B4499690E4E1CA845DDE97"><enum>(A)</enum><header>Establishment</header><text>Each
Regional Administrator shall establish a Regional Advisory Council.</text>
</subparagraph><subparagraph id="HE253337142484D80B3D056A06DDEA29A"><enum>(B)</enum><header>Nominations</header><text>A
State, local, or tribal government located within the geographic area served by
the Regional Office may nominate officials, including Adjutants General and
emergency managers, to serve as members of the Regional Advisory Council for
that region.</text>
</subparagraph><subparagraph id="HB481BA7B2E10489D99575AF3AE93025D"><enum>(C)</enum><header>Responsibilities</header><text>Each
Regional Advisory Council shall—</text>
<clause id="H0D862CAD6844490784937BC88E3CA8F3"><enum>(i)</enum><text>advise the Regional
Administrator on emergency management issues specific to that region;</text>
</clause><clause id="H9B18FF164C8841C193AABDE7953FACD1"><enum>(ii)</enum><text>identify any geographic,
demographic, or other characteristics peculiar to any State, local, or tribal
government within the region that might make preparedness, response, recovery,
or mitigation more complicated or difficult; and</text>
</clause><clause id="HAF06D848848B471BA4DA1E72FF9A448D"><enum>(iii)</enum><text>advise the Regional
Administrator of any weakness or deficiency in preparedness, response,
recovery, or mitigation for any State, local, or tribal government within the
region of which the Regional Advisory Council is aware.</text>
</clause></subparagraph></paragraph></subsection><subsection id="HD1DD303633FD44F4AB80459623B42C83"><enum>(e)</enum><header>Area
offices</header><text>There shall be an Area Office for the Pacific, an Area
Office for the Caribbean, and an Area Office in Alaska, as components in the
appropriate Regional Offices.</text>
</subsection></section><section id="H927BE97053984998A1061F5B2D495AFE"><enum>103.</enum><header>Authority and
responsibilities</header>
<subsection id="H36A9A7F5AE8F4FD4A41E5DCBC0FCFD88"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">The Administrator
shall provide the Federal leadership necessary to prepare for, respond to,
recover from, and mitigate hazards.</text>
</subsection><subsection id="HF5F2F36FAFF84BC6A93DE966DF0DDDE8"><enum>(b)</enum><header>Stafford
Act</header><text>The Administrator shall assist the President in carrying out
the functions under the Robert T. Stafford Disaster Relief and Emergency
Assistance Act (42 U.S.C. 5121 et seq.) and carrying out all functions and
authorities given to the Administrator under that Act.</text>
</subsection><subsection id="HBA771908B24C46998BACBA572596855F"><enum>(c)</enum><header>Mission</header><text>The
responsibilities of the Administrator shall include carrying out the mission of
the Agency by leading and supporting the Nation in a comprehensive emergency
management system of—</text>
<paragraph id="H3A856C9FD860445B8D5BEDEE8C46997D"><enum>(1)</enum><text>mitigation, by taking
sustained actions to reduce or eliminate long-term risks to people and property
from hazards and their effects;</text>
</paragraph><paragraph id="H9F970251FED84A59A9FC1C06DCD343F8"><enum>(2)</enum><text>preparedness, by
planning, training, conducting exercises, and building the emergency management
profession to prepare effectively for mitigating, responding to, and recovering
from any hazard;</text>
</paragraph><paragraph id="H60E4CCD0CD3749D49A89ECAF4A9DC182"><enum>(3)</enum><text>response, by conducting
emergency operations to save lives and property through positioning emergency
equipment, personnel, and supplies, through evacuating potential victims,
through providing food, water, shelter, and medical care to those in need, and
through restoring critical public services; and</text>
</paragraph><paragraph id="H541F33D4395C42A6BB4B3139FD79C3DC"><enum>(4)</enum><text>recovery, by rebuilding
communities so individuals, businesses, and governments can function on their
own, return to normal life, and protect against future hazards.</text>
</paragraph></subsection><subsection id="HA3E9102932F341BA92706FA7ECC4661D"><enum>(d)</enum><header>Response
duties</header><text>In carrying out subsection (c)(3), the Administrator, at a
minimum, shall—</text>
<paragraph id="H700A64F2491F4AFDB6D843DABE1F27EC"><enum>(1)</enum><text>help to ensure the
effectiveness of emergency response providers in responding to a hazard;</text>
</paragraph><paragraph id="H6BD4145880164B9BA9E9EE2F9B1B280D"><enum>(2)</enum><text>coordinate and provide
the Federal Government’s response to hazards;</text>
</paragraph><paragraph id="HB5DD66DFAE694F4AB185D8335048F5BF"><enum>(3)</enum><text>build a comprehensive
national incident management system with Federal, State, and local government
personnel, agencies, and authorities to respond to hazards;</text>
</paragraph><paragraph id="HBA45B5130D7F45638EB6037A6A376A53"><enum>(4)</enum><text>consolidate existing
Federal Government emergency response plans into a single, coordinated plan to
be known as the National Response Plan;</text>
</paragraph><paragraph id="HEE3C5F242EEE402EB20CEAEB8E4E2727"><enum>(5)</enum><text>administer and ensure the
implementation of the National Response Plan, including coordinating and
ensuring the readiness of each emergency support function under the National
Response Plan; and</text>
</paragraph><paragraph id="H31CD119587424C48B8065BE4DC3242B6"><enum>(6)</enum><text>help ensure the
acquisition of operable and interoperable communications capabilities by
Federal, State, local, and tribal governments and emergency response
providers.</text>
</paragraph></subsection><subsection id="HE352CE718A5D458CADA50F27BD233D9A"><enum>(e)</enum><header>Continuity of
Government</header><text>The Administrator shall prepare and implement the
plans and programs of the Federal Government for—</text>
<paragraph id="H85DFD156F7064F788E477AC1DB78B86D"><enum>(1)</enum><text>continuity of
operations;</text>
</paragraph><paragraph id="HCF69CE6E9EA847C08C0748473EE57715"><enum>(2)</enum><text>continuity of Government;
and</text>
</paragraph><paragraph id="HC35ED8FA729B43AEA0A149BE070FE647"><enum>(3)</enum><text>continuity of
plans.</text>
</paragraph></subsection><subsection id="HC107025B563B4BFD82B31882E4AA72E5"><enum>(f)</enum><header>Other
duties</header><text>The Administrator shall—</text>
<paragraph id="HCBC49513FCD545A0BFF19CE043E90759"><enum>(1)</enum><text>coordinate the National
Advisory Council authorized by this Act;</text>
</paragraph><paragraph id="H86589ECE1FE048EBABE6D5B847ABE0D5"><enum>(2)</enum><text>maintain and operate
within the Agency the National Response Coordination Center (or its
successor);</text>
</paragraph><paragraph id="H05A8E3AA34B04499ADB315C8D9812EF4"><enum>(3)</enum><text>develop and maintain a
national emergency management system that is capable of preparing for,
responding to, recovering from, and mitigating hazards of all magnitudes,
including catastrophic disasters; and</text>
</paragraph><paragraph id="HC3E058E5964C41EB99575E69FD254C4D"><enum>(4)</enum><text>supervise grant programs
administered by the Agency.</text>
</paragraph></subsection><subsection id="H6197369ACFE1440BB737D95318E047E8"><enum>(g)</enum><header>All-hazards
approach</header><text>In carrying out the responsibilities under this section,
the Administrator shall coordinate the implementation of an all-hazards
strategy that builds those common capabilities necessary to prepare for,
respond to, recover from, and mitigate hazards.</text>
</subsection></section><section id="H8A8F5A44D12744D9B3A89ADB976C797A"><enum>104.</enum><header>Office of the
Inspector General</header><text display-inline="no-display-inline">The Agency
shall have an Office of the Inspector General, headed by an Inspector General,
in accordance with the Inspector General Act of 1978 (Public Law 95–452; 5
U.S.C. App.).</text>
</section><section id="HCAED9BDA955041258EDFA571511DBF76"><enum>105.</enum><header>Transfer of
functions</header>
<subsection id="HA64C9CA23A8848E79CA8682602856DB5"><enum>(a)</enum><header>In
general</header><text>Except as provided by subsection (c), there shall be
transferred to the Administrator the following:</text>
<paragraph id="H2F87286F6DC74CA98FD6CA0117BBE702"><enum>(1)</enum><text>All functions of the
Federal Emergency Management Agency, as constituted on January 1, 2009,
including continuity of operations and continuity of Government plans and
programs.</text>
</paragraph><paragraph commented="no" id="HE97A2ABBCF08452596D09691A3E4FD54"><enum>(2)</enum><text display-inline="yes-display-inline">The functions relating to the Agency under
the Robert T. Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
5121 et seq.) and other laws, including—</text>
<subparagraph commented="no" id="H17ACF5400D184E5BB0963371B79ADA5F"><enum>(A)</enum><text>the National Flood
Insurance Act of 1968 (42 U.S.C. 4001 et seq.);</text>
</subparagraph><subparagraph commented="no" id="H5BAF06420273445C8A99800ABCC91C12"><enum>(B)</enum><text>the Earthquake Hazards
Reduction Act of 1977 (42 U.S.C. 7701 et seq.);</text>
</subparagraph><subparagraph commented="no" id="H03B5B5C9FA1F407184397F5EA146FC40"><enum>(C)</enum><text>the National Dam Safety
Program Act (33 U.S.C. 467 et seq.);</text>
</subparagraph><subparagraph commented="no" id="H34B42105B8D14F56A9D13B718FD1DCA6"><enum>(D)</enum><text>the Federal Fire
Prevention and Control Act of 1974 (15 U.S.C. 2201 et seq.);</text>
</subparagraph><subparagraph commented="no" id="HF1A2C8E684DC475AA5C46ABE67962F03"><enum>(E)</enum><text>Reorganization Plan No. 3
of 1978 (5 U.S.C. App.);</text>
</subparagraph><subparagraph commented="no" id="H9F8CA5385414410F988780006D0F4BA6"><enum>(F)</enum><text>section 612 of the
Security and Accountability For Every Port Act of 2006 (6 U.S.C. 314a);
and</text>
</subparagraph><subparagraph id="H0A2437363C644C51B4B590B23B4ABF83"><enum>(G)</enum><text display-inline="yes-display-inline">title III of the McKinney-Vento Homeless
Assistance Act (42 U.S.C. 11331 et seq.).</text>
</subparagraph></paragraph><paragraph id="HEA3DB8FDAEA44DCBBEE78C2074EAD89E"><enum>(3)</enum><text>Any function to be
transferred to the Agency under the Post-Katrina Emergency Management Reform
Act of 2006 (103 Stat. 1394), including the amendments made by that Act, even
if the transfer has not taken place as of January 1, 2009.</text>
</paragraph></subsection><subsection commented="no" id="H0F65D6E66A734601BB7ACE14BC48F3E8"><enum>(b)</enum><header>Inspector
General</header><text>There shall be transferred to the Inspector General of
the Federal Emergency Management Agency all of the functions relating to the
Inspector General that were transferred from the Federal Emergency Management
Agency to the Department of Homeland Security on or after January 1,
2003.</text>
</subsection><subsection id="H5ABB98EE6612464280E0E59A90A5978C"><enum>(c)</enum><header>Exceptions</header><text display-inline="yes-display-inline">The following programs shall not be
affected by this Act and shall remain within the Department of Homeland
Security:</text>
<paragraph id="HBAF6CBED589B447A8180200BFBF24121"><enum>(1)</enum><text display-inline="yes-display-inline">The grant programs authorized by sections
1406, 1513, and 1532 of the Implementing Recommendations of the 9/11 Commission
Act (6 U.S.C. 1135, 1163, and 1182).</text>
</paragraph><paragraph id="HE0228BD8FEF846E2BEEA84C69FF67837"><enum>(2)</enum><text display-inline="yes-display-inline">The grant program authorized by section
70107 of title 46, United States Code.</text>
</paragraph><paragraph id="H05582EA71B504EC2B91AD2E9B5E303CF"><enum>(3)</enum><text>Programs authorized by
sections 2003 and 2004 of the Homeland Security Act of 2002 (6 U.S.C. 604 and
605), as amended by this Act.</text>
</paragraph><paragraph id="HAB73229E9450476CA70EE4728D4C8CF6"><enum>(4)</enum><text>The trucking security
grant program (Public Law 110–329; 122 Stat. 3671).</text>
</paragraph><paragraph id="H5EDA0635455247098C7985FFA00707C6"><enum>(5)</enum><text>The buffer zone
protection program (Public Law 110–329; 122 Stat. 3672).</text>
</paragraph><paragraph id="H94C7F33F0EB1401EB245AEDBFBDD69D2"><enum>(6)</enum><text>The commercial equipment
direct assistance program (Public Law 110–329; 122 Stat. 3672).</text>
</paragraph></subsection><subsection commented="no" id="HE0D8D3D1143E4401A7C79B92F243B9EA"><enum>(d)</enum><header>United States Fire
Administrator; Federal Insurance Administrator</header><text>Nothing in this
Act shall be construed to affect the appointment of the United States Fire
Administrator under section 5(b) of the Fire Prevention and Control Act of 1974
(15 U.S.C. 2204(b)) or the Federal Insurance Administrator under section
1105(a) of the Housing and Urban Development Act of 1968 (42 U.S.C.
4129).</text>
</subsection><subsection id="H84A42D7067284B10BF6409B0B7D9A540"><enum>(e)</enum><header>Transition
period</header><text>The transfers under this section shall be carried out not
later than 120 days following the date of enactment of this Act. During the
transition period, the Secretary of Homeland Security shall provide to the
Administrator such assistance, including the use of personnel and assets, as
the Administrator may request in preparing for the transfer.</text>
</subsection><subsection id="HA052B8E206474133A3973514C3D2CF41"><enum>(f)</enum><header>Transition</header><text>The
Administrator may use—</text>
<paragraph id="H1FFB9172EC2E450C8117C4E5745B28BE"><enum>(1)</enum><text>the services of such
officers, employees, and other personnel of the Department of Homeland Security
with respect to functions transferred by this section; and</text>
</paragraph><paragraph id="H4BD77FE323C84B269B39A20DE4F2C94A"><enum>(2)</enum><text>funds appropriated to
such functions for such period of time as may reasonably be needed to
facilitate the orderly implementation of this section.</text>
</paragraph></subsection><subsection id="HAE06BEC22BBA4D9B96F7DF22D21A4B71"><enum>(g)</enum><header>Liaison office To
ensure coordination with Department of Homeland Security</header><text>The
Administrator shall establish a liaison office within the Agency to ensure
adequate coordination with the Department of Homeland Security.</text>
</subsection></section><section id="HF530E96E8D1E4010B1F8A431086053C2"><enum>106.</enum><header>Personnel and other
transfers</header>
<subsection id="H99E7B0873E554396B843A993BAAED1ED"><enum>(a)</enum><header>Personnel
Provisions</header>
<paragraph id="H2DFB46E050F84BC1A608915AA25743A9"><enum>(1)</enum><header>Appointments</header><text>The
Administrator may appoint and fix the compensation of such officers and
employees, including investigators, attorneys, and administrative law judges,
as may be necessary to carry out the respective functions transferred under
section 105. Except as otherwise provided by law, such officers and employees
shall be appointed in accordance with the civil service laws and their
compensation fixed in accordance with title 5, United States Code.</text>
</paragraph><paragraph id="HDB822542EC46419EAF73DAEC3B009C9B"><enum>(2)</enum><header>Experts and
consultants</header><text>The Administrator may obtain the services of experts
and consultants in accordance with section 3109 of title 5, United States Code,
and compensate such experts and consultants for each day (including travel
time) during which they are engaged in the actual performance of such services
at rates not in excess of the rate of pay for level IV of the Executive
Schedule under section 5315 of such title. The Administrator may pay experts
and consultants who are serving away from their homes or regular place of
business, travel expenses and per diem in lieu of subsistence at rates
authorized by sections 5702 and 5703 of such title for persons in Government
service employed intermittently.</text>
</paragraph></subsection><subsection id="H00B63E0C789443B39552A14CB2F535F0"><enum>(b)</enum><header>Delegation and
assignment</header><text>Except where otherwise expressly prohibited by law or
otherwise provided by this title, the Administrator may delegate any of the
functions transferred to the Administrator by section 105 and any function
transferred or granted to the Administrator after the date of the transfers by
section 105 to such officers and employees of the Agency as the Administrator
may designate and may authorize successive redelegations of such functions as
may be necessary or appropriate. No delegation of functions by the
Administrator under this subsection or under any other provision of this title
shall relieve the Administrator of responsibility for the administration of
such functions.</text>
</subsection><subsection id="HA8555D3A409F473BBB69815DEA571C6D"><enum>(c)</enum><header>Reorganization</header><text>The
Administrator may allocate or reallocate any function transferred under section
105 among the officers of the Agency, and may establish, consolidate, alter, or
discontinue such organizational entities in the Agency as may be necessary or
appropriate if the Administrator, on or before the 30th day preceding the date
of the allocation or reallocation, provides to Congress written notice of the
allocation or reallocation.</text>
</subsection><subsection id="H149A89026AF547D19D1EA9B1DD010D88"><enum>(d)</enum><header>Rules</header><text>The
Administrator may prescribe, in accordance with the provisions of chapters 5
and 6 of title 5, United States Code, such rules and regulations as the
Administrator determines necessary or appropriate to administer and manage the
functions of the Agency.</text>
</subsection><subsection id="H0D67A4DAC0004DCAA54CBBCF4F403832"><enum>(e)</enum><header>Transfer and
allocations of appropriations and personnel</header><text>Except as otherwise
provided in this title, the personnel employed in connection with, and the
assets, liabilities, contracts, property, records, and unexpended balances of
appropriations, authorizations, allocations, and other funds employed, used,
held, arising from, available to, or to be made available in connection with
the functions transferred by section 105, subject to section 1531 of title 31,
United States Code, shall be transferred to the Agency. Unexpended funds
transferred pursuant to this subsection shall be used only for the purposes for
which the funds were originally authorized and appropriated.</text>
</subsection><subsection id="HA8AE32D9C28E40A89480ABCD3BC34051"><enum>(f)</enum><header>Incidental
transfers</header><text>The Director of the Office of Management and Budget, in
consultation with the Administrator, may make such determinations as may be
necessary with regard to the functions transferred by section 105, and may make
such additional incidental dispositions of personnel, assets, liabilities,
grants, contracts, property, records, and unexpended balances of
appropriations, authorizations, allocations, and other funds held, used,
arising from, available to, or to be made available in connection with such
functions, as may be necessary to carry out the provisions of this title. The
Director of the Office of Management and Budget shall provide for the
termination of the affairs of all entities terminated by this title and for
such further measures and dispositions as may be necessary to effectuate the
purposes of this title.</text>
</subsection><subsection id="H76B238B23F6C4DEDB7BC4EE4DF39B88A"><enum>(g)</enum><header>Effect on
Personnel</header>
<paragraph id="HBCC1E024E2D349F491E5F68E3886648F"><enum>(1)</enum><header>In
general</header><text>Except as otherwise provided by this title, the transfer
pursuant to this title of full-time personnel (except special Government
employees) and part-time personnel holding permanent positions shall not cause
any such employee to be separated or reduced in grade or compensation for one
year after the date of transfer of such employee under this title.</text>
</paragraph><paragraph id="HD78BA6A5AC98462589BC46BE1D1E5C94"><enum>(2)</enum><header>Executive schedule
positions</header><text>Except as otherwise provided in this title, any person
who, on the day preceding the date of the transfers of functions under section
105, held a position compensated in accordance with the Executive Schedule
prescribed in chapter 53 of title 5, United States Code, and who, without a
break in service, is appointed in the Agency to a position having duties
comparable to the duties performed immediately preceding such appointment shall
continue to be compensated in such new position at not less than the rate
provided for such previous position, for the duration of the service of such
person in such new position.</text>
</paragraph></subsection></section><section id="H02120101592549629ECD5B15EA4F16EA"><enum>107.</enum><header>Savings
provisions</header>
<subsection id="H29E09EC7231F41AD8F508E32757AD9B1"><enum>(a)</enum><header>Savings
Provisions</header>
<paragraph id="HD31C981621B34CF6BA62184FF7ECB104"><enum>(1)</enum><header>Continuing effect of
legal documents</header><text>All orders, determinations, rules, regulations,
permits, agreements, grants, contracts, certificates, licenses, registrations,
privileges, and other administrative actions—</text>
<subparagraph id="H3AF2441CE02F4412B19360E1582763D4"><enum>(A)</enum><text>which have been issued,
made, granted, or allowed to become effective by the President, any Federal
agency or official thereof, or by a court of competent jurisdiction, in the
performance of functions that are transferred under section 105; and</text>
</subparagraph><subparagraph id="H3C696F083BEF47F4A779EACBA4A57068"><enum>(B)</enum><text>which are in effect on
the date of the transfers of functions under section 105, or were final before
such date and are to become effective on or after such date, shall continue in
effect according to their terms until modified, terminated, superseded, set
aside, or revoked in accordance with law by the President, the Administrator,
or other authorized official, a court of competent jurisdiction, or by
operation of law.</text>
</subparagraph></paragraph><paragraph id="H567684ADAFF14A52886F3C2A77525859"><enum>(2)</enum><header>Proceedings not
affected</header><text>The provisions of this title shall not affect any
proceedings, including notices of proposed rulemaking, or any application for
any license, permit, certificate, or financial assistance pending before the
Agency on the date of the transfers of functions under section 105, with
respect to functions transferred by section 105, but such proceedings and
applications shall continue. Orders shall be issued in such proceedings,
appeals shall be taken therefrom, and payments shall be made pursuant to such
orders, as if this title had not been enacted, and orders issued in any such
proceedings shall continue in effect until modified, terminated, superseded, or
revoked by a duly authorized official, by a court of competent jurisdiction, or
by operation of law. Nothing in this paragraph shall be deemed to prohibit the
discontinuance or modification of any such proceeding under the same terms and
conditions and to the same extent that such proceeding could have been
discontinued or modified if this title had not been enacted.</text>
</paragraph><paragraph id="H7950445412684105980847EE6BCDD50D"><enum>(3)</enum><header>Suits not
affected</header><text>The provisions of this title shall not affect suits
commenced before the date of the transfers of functions under section 105, and
in all such suits, proceedings shall be had, appeals taken, and judgments
rendered in the same manner and with the same effect as if this title had not
been enacted.</text>
</paragraph><paragraph id="H1D0A435E38024867B0710C2503D1B86D"><enum>(4)</enum><header>Nonabatement of
actions</header><text>No suit, action, or other proceeding commenced by or
against the Agency, or by or against any individual in the official capacity of
such individual as an officer of the Agency, shall abate by reason of the
enactment of this title.</text>
</paragraph><paragraph id="H80C4ABD6414C43E9B997F89E5DE05B76"><enum>(5)</enum><header>Administrative actions
relating to promulgation of regulations</header><text>Any administrative action
relating to the preparation or promulgation of a regulation by the Agency
relating to a function transferred under section 105 may be continued by the
Agency with the same effect as if this title had not been enacted.</text>
</paragraph></subsection><subsection id="HF1DAEA18CCD04246AF2D9805DB51FB2B"><enum>(b)</enum><header>References</header><text>Any
reference in any other Federal law, Executive order, rule, regulation, or
delegation of authority, or any document of or pertaining to a department,
agency, or office from which a function is transferred by section 105—</text>

transition period referred to in section 105(e), the Administrator shall submit
to Congress a report containing the recommended legislation.</text>
</subsection></section><enum>II</enum><header>Related Matters</header>
<section id="H1447F4A679ED4CBF96386827FF713F11"><enum>201.</enum><header>National Advisory
Council</header>
<subsection id="H6B529E17E6C446A89949A549167DE8B4"><enum>(a)</enum><header>Establishment</header><text>The
Administrator shall continue to maintain an advisory body to ensure effective
and ongoing coordination of Federal preparedness, response, recovery, and
mitigation for hazards, to be known as the National Advisory Council.</text>
</subsection><subsection id="H79B984C1F97546A69496D2DD9659E2B5"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The National Advisory Council shall advise
the Administrator on all aspects of emergency management.</text>
</subsection><subsection id="H3266FC33AB0E4A85AFA15EB3EF47FE1D"><enum>(c)</enum><header>Membership</header>
<paragraph id="H2025DBDD54134709897FEBA6CC217B9C"><enum>(1)</enum><header>In
general</header><text>The members of the National Advisory Council shall be
appointed by the Administrator, and shall, to the extent practicable, represent
a geographic (including urban and rural) and substantive cross section of
officials, emergency managers, and emergency response providers from State,
local, and tribal governments, the private sector, and nongovernmental
organizations, including as appropriate—</text>
<subparagraph id="H729FC435C7E944E7A15E235B6595C9A9"><enum>(A)</enum><text>members selected from the
emergency management field and emergency response providers, including fire
service, law enforcement, hazardous materials response, emergency medical
services, and emergency management personnel, or organizations representing
such individuals;</text>
</subparagraph><subparagraph id="H24A39AB3EEE44188B8844CD942465599"><enum>(B)</enum><text>health scientists,
emergency and inpatient medical providers, and public health
professionals;</text>
</subparagraph><subparagraph id="HF799AE9C5FBE4CB6A924A625C44ACE9F"><enum>(C)</enum><text>experts from Federal,
State, local, and tribal governments, and the private sector, representing
standards-setting and accrediting organizations, including representatives from
the voluntary consensus codes and standards development community, particularly
those with expertise in the emergency preparedness and response field;</text>
</subparagraph><subparagraph id="H32AC2713710749FD990E152FD65ADB3B"><enum>(D)</enum><text>State, local, and tribal
government officials with expertise in preparedness, response, recovery, and
mitigation, including Adjutants General;</text>
</subparagraph><subparagraph id="H9D3C447D73D14E6BA957D6A471E75AB9"><enum>(E)</enum><text>elected State, local, and
tribal government executives;</text>
</subparagraph><subparagraph commented="no" id="HCB26E88E0C974C2FA9DCB2E3090FC34C"><enum>(F)</enum><text>experts in public and
private sector infrastructure protection, cybersecurity, and
communications;</text>
</subparagraph><subparagraph id="HDB4D4514E5964EB9B9A4F3EED657E50A"><enum>(G)</enum><text>representatives of
individuals with disabilities and other populations with special needs;
and</text>
</subparagraph><subparagraph id="H7F14A71BDA294068B9B416A893094A36"><enum>(H)</enum><text>such other individuals as
the Administrator determines to be appropriate.</text>
</subparagraph></paragraph><paragraph id="HA272949A621E4F88BF30400D4189AABF"><enum>(2)</enum><header>Coordination with the
departments of health and human services and transportation</header><text>In
the selection of members of the National Advisory Council who are health or
emergency medical services professionals, the Administrator shall work with the
Secretary of Health and Human Services and the Secretary of
Transportation.</text>
</paragraph><paragraph id="H4E5CF19AFF62423D928BDD97EDA560A1"><enum>(3)</enum><header>Ex officio
members</header><text>The Administrator shall designate 1 or more officers of
the Federal Government to serve as ex officio members of the National Advisory
Council.</text>
</paragraph><paragraph id="HE4BC3CC48FD6418487A158AE4C985173"><enum>(4)</enum><header>Terms of
office</header><text display-inline="yes-display-inline">The term of office of
each member of the National Advisory Council shall be 3 years.</text>
</paragraph></subsection><subsection id="HA107E81F395B46448B7FFC06243C6307"><enum>(d)</enum><header>Applicability of
Federal Advisory Committee Act</header>
<paragraph id="HA6A9CD6B91B1476ABEF1D3D8CF1016A7"><enum>(1)</enum><header>In
general</header><text>Subject to paragraph (2), the Federal Advisory Committee
Act (5 U.S.C. App.), including subsections (a), (b), and (d) of section 10 of
such Act, and section 552b(c) of title 5, United States Code, shall apply to
the National Advisory Council.</text>
</paragraph><paragraph id="H46B586E5EED84534A35559A56792D76D"><enum>(2)</enum><header>Termination</header><text>Section
14(a)(2) of the Federal Advisory Committee Act (5 U.S.C. App.) shall not apply
to the National Advisory Council.</text>
</paragraph></subsection></section><section display-inline="no-display-inline" id="H5C912A16F7584B108FA3D186D37FDB84" section-type="subsequent-section"><enum>202.</enum><header>National Integration
Center</header>
<subsection id="H5104937CC63B483C878B89CA0BFC7D5F"><enum>(a)</enum><header>In
General</header><text>There is established in the Agency a National Integration
Center.</text>
</subsection><subsection id="H5356543602044B48A8099C86C740FDE7"><enum>(b)</enum><header>Responsibilities</header><text display-inline="yes-display-inline">The Administrator, through the National
Integration Center, and in consultation with other Federal departments and
agencies and the National Advisory Council, shall ensure ongoing management and
maintenance, including revisions as appropriate, of the National Incident
Management System, the National Response Plan (including the Catastrophic
Incident Annex), and any successor to such system or plan.</text>
</subsection><subsection id="H27E62A22A7C94AD2A0F2ECAA1FBDC9D7"><enum>(c)</enum><header>Incident
Management</header>
<paragraph id="H14395848E56347158E25852A68F1BD33"><enum>(1)</enum><header>National Response
Plan</header><text>The Administrator shall ensure that the National Response
Plan provides for a clear chain of command to lead and coordinate the Federal
response to any hazard.</text>
</paragraph><paragraph commented="no" id="HB5715D15A2B04D79AA24134F9EF744FE"><enum>(2)</enum><header>Principal Federal
official</header><text>The position of Principal Federal Official is
abolished.</text>
</paragraph></subsection></section><section display-inline="no-display-inline" id="H3B4926B429F44239AE8D79424CE74473" section-type="subsequent-section"><enum>203.</enum><header>Credentialing and
typing</header>
<subsection id="H8B140766BC244557BCA75962C4D5ADF8"><enum>(a)</enum><header>In
General</header><text>The Administrator shall continue to implement a
memorandum of understanding with the administrators of the Emergency Management
Assistance Compact, State, local, and tribal governments, and organizations
that represent emergency response providers to collaborate on developing
standards for deployment capabilities, including for credentialing and typing
of incident management personnel, emergency response providers, and other
personnel (including temporary personnel) and resources likely needed to
respond to a hazard.</text>
</subsection><subsection id="HBF936DC24B1141BDA158FEFCA84C6FD7"><enum>(b)</enum><header>Distribution</header>
<paragraph id="H0B6921A2ACF349B083B18410C417DF4D"><enum>(1)</enum><header>In
general</header><text>The Administrator shall provide the standards developed
under subsection (a), including detailed written guidance, to—</text>
<subparagraph id="H0F5AFBFBC67E47F1BC946B3DB7CC2C74"><enum>(A)</enum><text>each Federal agency that
has responsibilities under the National Response Plan to aid that agency with
credentialing and typing incident management personnel, emergency response
providers, and other personnel (including temporary personnel) and resources
likely needed to respond to a hazard; and</text>
</subparagraph><subparagraph id="H419FC976CEE24B4FBC5243FCC42D0FC4"><enum>(B)</enum><text>State, local, and tribal
governments, to aid such governments with credentialing and typing of State,
local, and tribal incident management personnel, emergency response providers,
and other personnel (including temporary personnel) and resources likely needed
to respond to a hazard.</text>
</subparagraph></paragraph><paragraph id="HCF0B82B7099749D9979AAC0FE4D1D05A"><enum>(2)</enum><header>Assistance</header><text>The
Administrator shall provide expertise and technical assistance to aid Federal,
State, local, and tribal government agencies with credentialing and typing
incident management personnel, emergency response providers, and other
personnel (including temporary personnel) and resources likely needed to
respond to a hazard.</text>
</paragraph></subsection><subsection id="HA94557640FD947B1922BBCA41B0F02DF"><enum>(c)</enum><header>Credentialing and
Typing of Personnel</header><text display-inline="yes-display-inline">Each
Federal agency with responsibilities under the National Response Plan shall
ensure that incident management personnel, emergency response providers, and
other personnel (including temporary personnel) and resources likely needed to
respond to a hazard are credentialed or typed, as appropriate, in accordance
with this section.</text>
</subsection><subsection id="HABFD130B0F82492CA853B0D3776CD121"><enum>(d)</enum><header>Consultation on Health
Care Standards</header><text>In developing standards for credentialing health
care professionals under this section, the Administrator shall consult with the
Secretary of Health and Human Services.</text>
</subsection><subsection id="H8E72DD6A6B484D54BB993E538FE821DF"><enum>(e)</enum><header>Definition</header><text display-inline="yes-display-inline">For purposes of this section, the term
<quote>credentialing</quote> means to provide documentation that identifies
personnel and authenticates and verifies the qualifications of such personnel
by ensuring that such personnel possess a minimum common level of training,
experience, physical and medical fitness, and capability appropriate for a
particular position in accordance with standards created under this
section.</text>
</subsection></section><section display-inline="no-display-inline" id="H97BC1718E9B94E6897B5DD17D6C2C3DD" section-type="subsequent-section"><enum>204.</enum><header>Disability
coordinator</header>
<subsection id="H428F2A2F67764527B01771DE7079682C"><enum>(a)</enum><header>In
general</header><text>The Administrator shall appoint in the Agency a
Disability Coordinator in order to ensure that the needs of individuals with
disabilities are being properly addressed in emergency preparedness and
disaster relief. The Disability Coordinator shall report directly to the
Administrator.</text>
</subsection><subsection id="HD72391FD9058402FBC2F6277A4E3F46E"><enum>(b)</enum><header>Consultation</header><text>The
Disability Coordinator shall be appointed after consultation with organizations
representing individuals with disabilities, the National Council on
Disabilities, and the Interagency Coordinating Council on Preparedness and
Individuals with Disabilities established under Executive Order No. 13347 (6
U.S.C. 312 note).</text>
</subsection><subsection id="HA11AC5F4AA77460597E58367C34743A7"><enum>(c)</enum><header>Transitional
provision</header><text>The individual serving in the Agency as Disability
Coordinator on the date of enactment of this Act may continue to serve in that
position at the discretion of the Administrator.</text>
</subsection></section><section id="H8325D7B43D3E4C2CBC9FF57EAEFF3D9A"><enum>205.</enum><header>Nuclear incident
response</header>
<subsection id="HCB5114382CA9443D8CC2F050163228AB"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">At the direction of
the Administrator (in connection with an actual or threatened terrorist attack,
major disaster, or other emergency in the United States), the Nuclear Incident
Response Team shall operate as an organizational unit of the Agency. While so
operating, the Nuclear Incident Response Team shall be subject to the
direction, authority, and control of the Administrator.</text>
</subsection><subsection id="HDED2223E9D4A4D4482F2C5E16498014C"><enum>(b)</enum><header>Rule of
construction</header><text>Nothing in this section shall be construed to limit
the ordinary responsibility of the Secretary of Energy or the Administrator of
the Environmental Protection Agency for organizing, training, equipping, or
utilizing their respective entities in the Nuclear Incident Response Team, or
(subject to the provisions of this section) from exercising direction,
authority, or control over them when they are not operating as a unit of the
Agency.</text>
</subsection></section><section id="HAD213C9D082441688BAF654E3075FE58"><enum>206.</enum><header>Urban area all hazards
preparedness grant program</header><text display-inline="no-display-inline">Subtitle A of title VI of the Robert T.
Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C. 5196 et seq.)
is amended by adding at the end the following:</text>

<section id="H1411B62C4ACE40D9952E386661E5A7D7"><enum>617.</enum><header>Urban area all hazards
preparedness grant program</header>
<subsection id="HF30C0AEE68A54C9580ED3EFC7B6F9364"><enum>(a)</enum><header>In
general</header><text display-inline="yes-display-inline">To assist urban areas
to prepare for any hazard, the Administrator shall establish an urban area all
hazards preparedness grant program.</text>
</subsection><subsection id="HF0AAB59E94A141DD913818C3F2A26E16"><enum>(b)</enum><header>Eligibility</header><text>The
100 most populous metropolitan statistical areas, as defined by the Office of
Management and Budget, shall be eligible to receive a grant award under this
section. The Administrator may consider additional urban areas for a grant
award based on criteria established by the Administrator.</text>
</subsection><subsection id="H4CF721C11F7C49B2B1186570081152EB"><enum>(c)</enum><header>Notification and
information</header><text display-inline="yes-display-inline">Not later than 30
days before the Administrator accepts applications for the urban area all
hazards preparedness grant program, the Administrator shall notify the chief
elected official of each urban area and the Governor of the State in which such
urban area is located if the urban area is eligible for a grant under this
section and provide information regarding the application procedures and grant
award criteria. Such notification and information shall also be published in
the Federal Register not later than 15 days before the Administrator accepts
applications for the grant program.</text>
</subsection><subsection id="H44E40701784246C3805E14D6CE5FFED1"><enum>(d)</enum><header>Application</header><text display-inline="yes-display-inline">An urban area eligible under subsection (b)
may apply to the Administrator for a grant award under this section. Such
application shall demonstrate, to the satisfaction of the Administrator,
that—</text>
<paragraph id="H615324FE0DD543B28F0EFD67EB9E2463"><enum>(1)</enum><text>the urban area will use
funds awarded under this section to develop or implement activities that
support the emergency management goals of the State in which an urban area is
located; and</text>
</paragraph><paragraph id="H57248973C8E643B5BE710DC2EFB00EC4"><enum>(2)</enum><text>the State has reviewed
the application.</text>
</paragraph></subsection><subsection id="HDA359D0EC9054CCEA2A1CD32012AC457"><enum>(e)</enum><header>Allocation of
funds</header>
<paragraph id="H871D6F23D03B486490028E887D05AC0D"><enum>(1)</enum><header>In
general</header><text>The Administrator shall allocate funds to each State in
which an urban area selected to receive a grant award under this section is
located based on—</text>
<subparagraph id="HC75E52D7772B4AACA204DFCACB92A5EE"><enum>(A)</enum><text>the population of each
eligible urban area;</text>
</subparagraph><subparagraph id="H847E4094689E425287EC9ED0E9994BC4"><enum>(B)</enum><text>the relative level of
risk of any hazard faced by each eligible urban area; and</text>
</subparagraph><subparagraph id="H5487B43BDA424608BF8990F2049BE713"><enum>(C)</enum><text>other factors as
determined appropriate by the Administrator.</text>
</subparagraph></paragraph><paragraph id="H0EB4E009CAE04751B11AE072943E44E6"><enum>(2)</enum><header>Minimum
allocation</header><text>In determining the allocation amount under paragraph
(1), the Administrator may provide each eligible urban area with a minimum
allocation.</text>
</paragraph><paragraph id="H67F267CAA9C4406DA4DC2E4986CD427B"><enum>(3)</enum><header>State distribution of
funds</header>
<subparagraph id="H635A9A9DA6E14A48B6C164652A2436C7"><enum>(A)</enum><header>In
general</header><text>Not later than 45 days after the date on which a State
receives a grant award under this section, the State shall provide each urban
area awarded a grant not less than 80 percent of the award amount for such
area. Any funds retained by a State shall be expended on items, services, or
activities related to emergency preparedness that benefit such urban area for
activities described in subsection (f).</text>
</subparagraph><subparagraph id="H09AD5E0031874C3EB380795C0DC267CF"><enum>(B)</enum><header>Funds
retained</header><text>A State shall provide each urban area awarded such a
grant with an accounting of the items, services, or activities on which any
funds retained by the State under subparagraph (A) were expended.</text>
</subparagraph></paragraph><paragraph id="HB3978185E7B4480BA087B4A161D72341"><enum>(4)</enum><header>Interstate urban
areas</header><text display-inline="yes-display-inline">If an urban area
selected to receive a grant award under this section is located in 2 or more
States, the Administrator shall distribute to each such State a portion of the
grant funds that the Administrator determines to be appropriate.</text>
</paragraph></subsection><subsection id="HAF6AFF8EEE1A45DBBB305F076998EF38"><enum>(f)</enum><header>Uses of
funds</header><text>An urban area that receives a grant award under this
section may use funds only for activities determined by the Administrator to
enhance the preparedness of an urban area for a hazard, and shall
include—</text>
<paragraph id="H6AD3274A854E419FAA2EADB95BBC1BF7"><enum>(1)</enum><text>planning;</text>
</paragraph><paragraph id="HB6E0B9510078457B9602ADDA4AEB588F"><enum>(2)</enum><text>purchase and maintenance
of equipment;</text>
</paragraph><paragraph id="H3E21A797604D4CA68D6894F3B84A2300"><enum>(3)</enum><text>training;</text>
</paragraph><paragraph id="HAA26EA42505B4804983E9BB341D3BBA7"><enum>(4)</enum><text>exercises; and</text>
</paragraph><paragraph id="H760A1E5B18B44BF7A686BF0A3A792989"><enum>(5)</enum><text>management and
administration.</text>
</paragraph></subsection><subsection id="H7526D908C4BA4301B1A8FC1917E91779"><enum>(g)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
enactment of this Act, the Administrator shall issue regulations to implement
the urban area all hazards preparedness grant program under this
section.</text>
</subsection><subsection id="HBC2B47F8E9A74DBEA5CCB4B43BFCDFA9"><enum>(h)</enum><header>Authorization of
Appropriations</header><text>There is authorized to be appropriated to carry
out this section—</text>
<paragraph id="H7344EFD2A8564E97BCDF911151BA8003"><enum>(1)</enum><text>$525,000,000 for fiscal
year 2010;</text>
</paragraph><paragraph id="H44380581722B4AE9B96C8A5052BFC590"><enum>(2)</enum><text>$575,000,000 for fiscal
year 2011; and</text>
</paragraph><paragraph id="HD9EB53FC142D4FCDB381ACCE5A0F305A"><enum>(3)</enum><text>$650,000,000 for fiscal
year
2012.</text>
