		<official-title>To amend the National and Community Service Act of 1990
		  to establish a Summer of Service State grant program, a Summer of Service
		  national direct grant program, and related national activities, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="H6C83C97956A1415F8BB18FFDA6623E58" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Summer of Service Act of
			 2009</short-title></quote>.</text>
		</section><section id="H0FB510FFB7FF4E9CAD7CA51490E274A4" section-type="subsequent-section"><enum>2.</enum><header>Findings and
			 purposes</header>
			<subsection id="HF33A7E19A8854DB40085BE4F144E10A5"><enum>(a)</enum><header>Findings</header><text display-inline="yes-display-inline">Congress finds the following:</text>
				<paragraph id="H61CA17720B2F4C5482EA03A14B92DDD"><enum>(1)</enum><text>Throughout the
			 United States, there are pressing unmet human, educational, environmental and
			 public safety needs.</text>
				</paragraph><paragraph id="HCB04EEDC48014509001362C0A4EC3318"><enum>(2)</enum><text>Americans desire
			 to affirm common responsibilities and shared values, and join together in
			 positive experiences, that transcend race, religion, gender, age, disability,
			 region, income, and education.</text>
				</paragraph><paragraph id="HF98D2E4135A94F0DB52EDE278657A338"><enum>(3)</enum><text>Americans of all
			 ages can improve their communities and become better citizens through service
			 to their communities.</text>
				</paragraph><paragraph id="HF3D744C07BCB4A998C65DD536C57FC17"><enum>(4)</enum><text>When youth
			 participate in service activities and see that they are able to improve the
			 lives of others, the youth feel better able to control their own lives in a
			 positive way, avoiding risky behaviors, strengthening their community
			 connections, and becoming more engaged in their own education.</text>
				</paragraph><paragraph id="H080BA3F93F6E430E9EA3183DDC43FAD8"><enum>(5)</enum><text>When youth service
			 is tied to learning objectives, that service is shown to decrease alienation
			 and behavior problems, and increase knowledge of community needs, commitment to
			 an ethic of service, and understanding of politics and morality.</text>
				</paragraph><paragraph id="H019DB024990D4BBFA2C4AEFD25B0088"><enum>(6)</enum><text>When service is
			 tied to what students are learning in school, the students make gains on
			 achievement tests, complete their homework more often, and increase their grade
			 point averages.</text>
				</paragraph><paragraph id="HDDEE349AAD3A4066A42DBE2EE21FE8E"><enum>(7)</enum><text>Students who engage
			 in service-learning improve their communication skills, increase their
			 awareness of career possibilities, have a deeper understanding of social and
			 economic issues that face the United States, and develop more positive
			 workplace attitudes, preparing them to take their places as future leaders of
			 the United States.</text>
				</paragraph><paragraph id="H062F51907AB14402B4FA4B481F73D502"><enum>(8)</enum><text>In a national
			 poll, more than 80 percent of parents said that their child would benefit from
			 an after school program that offered community service and 95 percent of teens
			 agreed that is important to volunteer time to community efforts.</text>
				</paragraph></subsection><subsection id="HF07D3D7906E34AB28103B7C08508C1DA"><enum>(b)</enum><header>Purpose</header><text>The
			 purposes of this Act are to—</text>
				<paragraph id="HFEBF4540B9D84BDC9D31FFB05BE55300"><enum>(1)</enum><text>offer youth the
			 chance to spend a summer in service to their communities as a rite of passage
			 before high school;</text>
				</paragraph><paragraph id="HB6E7F2C3C83C445AA3191FF63FDE01DD"><enum>(2)</enum><text>teach civic
			 participation skills to youth and help youth see themselves as resources and
			 leaders for their communities;</text>
				</paragraph><paragraph id="H30DEBE0621D54D30B1C34D59736E759D"><enum>(3)</enum><text>expand educational
			 opportunities and discourage <quote>summer slide</quote> by engaging youth in
			 summer service-learning opportunities;</text>
				</paragraph><paragraph id="HFDCBAFE5FE65482B9850E175858DAA7"><enum>(4)</enum><text>encourage youth,
			 regardless of age, income, or disability, to engage in community
			 service;</text>
				</paragraph><paragraph id="HA2FC77FD447D411EB13042D095F4B9AC"><enum>(5)</enum><text>provide tangible
			 benefits to the communities in which Summer of Service programs are performed;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1E74BA5E94E3445AB55F9CCC55BEF073"><enum>(6)</enum><text>enhance the
			 social-emotional development of youth of all backgrounds.</text>
				</paragraph></subsection></section><section id="H0C2A0FB58E0146CF9335BA3049ADBEB"><enum>3.</enum><header>Summer of service
			 programs</header><text display-inline="no-display-inline">Title I of the
			 National and Community Service Act of 1990 (42 U.S.C. 12511 et seq.) is
			 amended—</text>
			<paragraph id="HD2AF7C24864844DB99F7C5DEC05486C"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subtitles F, G, H, and I
			 as subtitles G, H, I, and J, respectively;</text>
			</paragraph><paragraph id="H82862C1F141043CC85E086EAD8343004"><enum>(2)</enum><text>by redesignating
			 sections 160 through 166 as sections 159A through 159G, respectively;
			 and</text>
			</paragraph><paragraph id="HB8D4785B64B4451E85ED67B452CD1F6F"><enum>(3)</enum><text>by inserting after
			 subtitle E the following:</text>
				<quoted-block display-inline="no-display-inline" id="HEE205236A5D840B3A6203B1BA9F89F7E" style="OLC">
					<subtitle id="H19BFBFE0B1304FFC9B31B6210000D41"><enum>F</enum><header>Summer of Service
				Programs</header>
						<section id="H19EA6780F58148378DCD1EE93083449F"><enum>161.</enum><header>Definitions</header><text display-inline="no-display-inline">In this subtitle:</text>
							<paragraph id="H3D249F04F36842B09015CCF046CFE593"><enum>(1)</enum><header>Educational
				award</header><text>The term <term>educational award</term> means an award
				disbursed under section 162B(d) or 163B(d).</text>
							</paragraph><paragraph commented="no" id="H6FC4AFCE7DE6431691C11CC5F88C7F76"><enum>(2)</enum><header>Eligible
				entity</header><text>The term <term>eligible entity</term> means a public or
				private nonprofit organization, an institution of higher education, a local
				educational agency, a public elementary school or public secondary school, or a
				consortium of 2 or more of the entities described in this paragraph.</text>
							</paragraph><paragraph commented="no" id="HB639388A342C47CB9BBC3C73E929DC1"><enum>(3)</enum><header>Eligible
				youth</header><text>The term <term>eligible youth</term> means a youth who will
				be enrolled in the sixth, seventh, eighth, or ninth grade at the end of the
				summer for which the youth would participate in community service under this
				subtitle.</text>
							</paragraph></section><part id="HA5C10C9A636C47B7AC1D54C2D26BDB8C"><enum>I</enum><header>Summer of service
				State grant program</header>
							<section id="H63ADCED6A1BC4E88A67508F3DDAA6010"><enum>162.</enum><header>Grants to
				States</header>
								<subsection id="H18700E2CDEDA4BDEAABDA6A96CE9D127"><enum>(a)</enum><header>Grants</header>
									<paragraph id="H4EE0647D047C433FBCCD6768097BF4C"><enum>(1)</enum><header>In
				general</header><text>The Chief Executive Officer shall award grants on a
				competitive basis to States, to enable the State Commissions—</text>
										<subparagraph id="H0D92561A83CA415C888DA0C0E7A4C0CE"><enum>(A)</enum><text>to carry out
				State-level activities under subsection (d); and</text>
										</subparagraph><subparagraph id="H89B16896800C44C885971557AEA53466"><enum>(B)</enum><text>to award subgrants
				on a competitive basis under section 162A to eligible entities to pay for the
				Federal share of the cost of carrying out community service projects.</text>
										</subparagraph></paragraph><paragraph id="H24CDB8A67050461E898C62F7B82D937B"><enum>(2)</enum><header>Funds for
				educational awards</header><text>The Chief Executive Officer shall decide
				whether funds appropriated to carry out this part and available for educational
				awards (referred to in this part as <quote>educational award funds</quote>)
				shall be—</text>
										<subparagraph id="H43B8E838352640E0AECC361288AA2E6F"><enum>(A)</enum><text>included in the
				funds for such grants to States and subgrants to eligible entities; or</text>
										</subparagraph><subparagraph id="H19EE2A52A14B4DB3A82125B4EC00BA98"><enum>(B)</enum><text>reserved by the
				Chief Executive Officer, deposited in the National Service Trust for
				educational awards, and disbursed according to paragraphs (1) and (3) of
				section 162B(d).</text>
										</subparagraph></paragraph><paragraph id="HDF8950573E314E2AAB85A88888F66ECE"><enum>(3)</enum><header>Periods of
				grants</header><text>The Chief Executive Officer shall award the grants for
				periods of 3 years.</text>
									</paragraph><paragraph id="HC5D396FD3461422DBC3F8092C77909F"><enum>(4)</enum><header>Amounts of
				grants</header><text>The Chief Executive Officer shall award such a grant to a
				State for a program in a sum equal to—</text>
										<subparagraph id="HEE15305C984646F4BD5744F034806D"><enum>(A)</enum><text>the amount obtained
				by multiplying $500 and the number of youth who will participate in the program
				(to be used for program expenses);</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HF80BBA7219C9469E8EC98FFC8D98A075"><enum>(B)</enum><text>unless the Chief
				Executive Officer decides to deposit funds for educational awards in the
				National Service Trust, as described in paragraph (2)(B), an additional amount
				equal to the amount described in subparagraph (A) (to be used for educational
				awards); and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD7907671597142C798B868E0F18D81E3"><enum>(C)</enum><text>an amount
				sufficient to provide for the reservation for State-level activities described
				in subsection (d).</text>
										</subparagraph></paragraph></subsection><subsection id="H96D6CC1F99544B39BF1874CA0939D2FF"><enum>(b)</enum><header>State
				application</header><text>To be eligible to receive a grant under this section,
				a State shall submit an application to the Chief Executive Officer at such
				time, in such manner, and containing such information as the Chief Executive
				Officer may require, including information that—</text>
									<paragraph id="H9235875C01E5493FAF2BB0563559EDC4"><enum>(1)</enum><text>designates the
				State Commission as the agency responsible for the administration and
				supervision of the community service program carried out under this part in the
				State;</text>
									</paragraph><paragraph id="H7B50C3FF3E4D42158102CFB92B58848C"><enum>(2)</enum><text>describes how the
				State Commission will use funds received under this part, including funds
				reserved for State-level activities under subsection (d);</text>
									</paragraph><paragraph id="H6B424884773D46AF91470900518793EE"><enum>(3)</enum><text>describes the
				procedures and criteria the State Commission will use for reviewing
				applications and awarding subgrants on a competitive basis under section 162A
				to eligible entities for projects, including how the State Commission will give
				priority to an entity that—</text>
										<subparagraph id="HF846B7F927EB43759588691582513355"><enum>(A)</enum><text>offers a quality
				plan for or has an established track record of carrying out the activities
				described in the entity’s application;</text>
										</subparagraph><subparagraph id="H06D65F9E3C7B4D038EEAB769BC02EC72"><enum>(B)</enum><text>has a leadership
				position in the community from which the youth participating in the project
				described in the application will be drawn;</text>
										</subparagraph><subparagraph id="HAC765A250009486FAAA59CBDDFFF77E9"><enum>(C)</enum><text>proposes a project
				that focuses on service by the participants during the transition year before
				high school;</text>
										</subparagraph><subparagraph id="H834BCBA1FE99425C8200769ED2A3C233"><enum>(D)</enum><text>plans to ensure
				that at least 50 percent of the participants are low-income eligible
				youth;</text>
										</subparagraph><subparagraph id="HEEAC94A97E884A9483132F109B030306"><enum>(E)</enum><text>proposes a project
				that encourages or enables youth to continue participating in community service
				throughout the school year;</text>
										</subparagraph><subparagraph id="HFF7DCCE0BAEC41F48CB99DA703A70072"><enum>(F)</enum><text>plans to involve
				the participants in the design and operation of the project, including
				involving the participants in conducting a needs-based assessment of community
				needs;</text>
										</subparagraph><subparagraph id="H6C506B608A28436FA300D17B19338EED"><enum>(G)</enum><text>proposes a project
				that involves youth of different ages, races, sexes, ethnic groups, religions,
				disability categories, or economic backgrounds serving together; and</text>
										</subparagraph><subparagraph id="HEC10CAB76FBD49AF911D5F55D8F97115"><enum>(H)</enum><text>proposes a project
				that provides high quality service-learning experiences;</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H25F1B06F2E594A88843BB1D381F9055F"><enum>(4)</enum><text>describes the
				steps the State Commission will take, including the provision of ongoing
				technical assistance described in subsection (d)(2) and training, to ensure
				that projects funded under section 162A will implement effective strategies;
				and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F0F19FA5C3A49D6A1B856873641DAB8"><enum>(5)</enum><text>describes how the
				State Commission will evaluate the projects, which shall include, at a
				minimum—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="H2041D53C1066449FB5D6F9F81409BACF"><enum>(A)</enum><text>a description of
				the objectives and benchmarks that will be used to evaluate the projects;
				and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9B5C13FD535C4463BA12CBF850750054"><enum>(B)</enum><text>a description of
				how the State Commission will disseminate the results of the evaluations, as
				described in subsection (d)(4)(C).</text>
										</subparagraph></paragraph></subsection><subsection id="HE69A7642C17147E3AE4E9D82D4B3BC76"><enum>(c)</enum><header>Applicant
				review</header>
									<paragraph id="H92CA18F468DC437BACCBF2139F95AF5C"><enum>(1)</enum><header>Selection
				criteria</header><text>The Chief Executive Officer shall evaluate applications
				for grants under this section based on the quality, innovation, replicability,
				and sustainability of the State programs proposed by the applicants.</text>
									</paragraph><paragraph id="HFCE27FA9714C48478F3B087EA91CD5B7"><enum>(2)</enum><header>Review
				panels</header><text>The Chief Executive Officer shall employ the review panels
				established under section 165A in reviewing the applications.</text>
									</paragraph><paragraph id="H88983D0D3958418084406DA77483E49B"><enum>(3)</enum><header>Notification of
				applicants</header><text>If the Chief Executive Officer rejects an application
				submitted under this section, the Chief Executive Officer shall promptly notify
				the applicant of the reasons for the rejection of the application.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE8DCE8B7BB8A4F378E1964F200B74DD5"><enum>(4)</enum><header>Resubmission and
				reconsideration</header><text>The Chief Executive Officer shall provide an
				applicant notified of rejection with a reasonable opportunity to revise and
				resubmit the application. At the request of the applicant, the Chief Executive
				Officer shall provide technical assistance to the applicant as part of the
				resubmission process. The Chief Executive Officer shall promptly reconsider an
				application resubmitted under this paragraph.</text>
									</paragraph></subsection><subsection id="H17B1E90E4D8D41EBA94F104FC0FC9025"><enum>(d)</enum><header>State-level
				activities</header><text>A State that receives a grant under this section may
				reserve up to 5 percent of the grant funds for State-level activities, which
				may include—</text>
									<paragraph id="HC472CB24B5E9435AB788BFFE73594258"><enum>(1)</enum><text>hiring staff to
				administer the program carried out under this part in the State;</text>
									</paragraph><paragraph id="H3D6DFB7D4AE3489B802BBEBF2C8FBDD9"><enum>(2)</enum><text>providing
				technical assistance, including technical assistance concerning the
				professional development and training of personnel, to eligible entities that
				receive subgrants under section 162A;</text>
									</paragraph><paragraph id="HC80797F0A38A4536A254D47DF6432F57"><enum>(3)</enum><text>conducting
				outreach and dissemination of program-related information to ensure the
				broadest possible involvement of eligible entities and local eligible youth in
				the program carried out under this part; and</text>
									</paragraph><paragraph id="H8D188400748246588633ECE69D2E51DB"><enum>(4)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H2F9E3BC839E04169817971A26863F29E"><enum>(A)</enum><text>conducting an evaluation
				of the projects carried out by eligible entities under this part;</text>
										</subparagraph><subparagraph id="HC5FF7F1ACC934FEEB5FC274B0006FB43" indent="up1"><enum>(B)</enum><text>using the results of the evaluation to
				collect and compile information on best practices and models for such projects;
				and</text>
										</subparagraph><subparagraph id="HC830ECDDD1014A4880ED3F59565791" indent="up1"><enum>(C)</enum><text>disseminating widely the results of
				the evaluation.</text>
										</subparagraph></paragraph></subsection></section><section id="HCCAEEAD7A51F48C88E782594B663E31"><enum>162A.</enum><header>Subgrants to
				eligible entities</header>
								<subsection id="HB71B6D57B327453DA033B24B45766536"><enum>(a)</enum><header>Subgrants</header>
									<paragraph id="H00080CCC961C45969702CBFB4300E244"><enum>(1)</enum><header>In
				general</header><text>A State that receives a grant under section 162 shall use
				the grant funds to award subgrants on a competitive basis to eligible entities
				to pay for the Federal share of the cost of carrying out community service
				projects.</text>
									</paragraph><paragraph id="H8DB01B8FAB15473FAAD2BBDAAED9ABB"><enum>(2)</enum><header>Periods of
				subgrants</header><text>The State shall award the subgrants for periods of 3
				years.</text>
									</paragraph><paragraph id="H0C8B462456F24B06A5451096AE658E77"><enum>(3)</enum><header>Amounts of
				subgrants</header><text>The State shall award such a subgrant to an eligible
				entity for a project in a sum equal to—</text>
										<subparagraph id="HD018FE0D469F4CF79D11F5FB446DA470"><enum>(A)</enum><text>the amount
				obtained by multiplying $500 and the number of youth who will participate in
				the project (to be used for project expenses); and</text>
										</subparagraph><subparagraph id="HBFFD83E20AE24181AFCBAFAEB5A02E9F"><enum>(B)</enum><text>unless the Chief
				Executive Officer decides to deposit funds for educational awards in the
				National Service Trust, as described in section 162(a)(2)(B), an additional
				amount equal to the amount described in subparagraph (A) (to be used for
				educational awards).</text>
										</subparagraph></paragraph></subsection><subsection id="H64903B1C2EB14F9592CB9D6E160094BF"><enum>(b)</enum><header>Applications</header><text>To
				be eligible to receive a subgrant under this section for a project, an entity
				shall submit an application to the State Commission at such time, in such
				manner, and containing such information as the State Commission may require,
				including information that—</text>
									<paragraph id="H818B0BF41C1C41D8BBFC006BEFAA9F17"><enum>(1)</enum><text>designates the
				community in which the entity will carry out the project, which community may
				be the service area of an elementary school or secondary school, a school
				district, a city, town, village, or other locality, a county, the area in which
				a public housing project is located, a neighborhood, or another geographically
				or politically designated area;</text>
									</paragraph><paragraph id="H122582C719F843A886ABF0A7AFBA0288"><enum>(2)</enum><text>describes the
				manner in which the entity will—</text>
										<subparagraph id="H44B1B8B5298444A3ABB691C4679841C5"><enum>(A)</enum><text>engage a
				substantial portion of the youth in the designated community;</text>
										</subparagraph><subparagraph id="HFECE1E8700E847E8B4B91CE93D5B2917"><enum>(B)</enum><text>engage a variety
				of entities and individuals, such as youth organizations, elementary schools or
				secondary schools, elected officials, organizations offering summer camps,
				civic groups, nonprofit organizations, and other entities within the designated
				community to offer a variety of summer service opportunities as part of the
				project;</text>
										</subparagraph><subparagraph id="HA0B9C13D6C204ABF8693473FE2A4164D"><enum>(C)</enum><text>ensure that the
				youth participating in the project engage in service-learning;</text>
										</subparagraph><subparagraph id="H2448C308C3CE4066B257F5BA3684D91"><enum>(D)</enum><text>engage as
				volunteers in the project business, civic, or community organizations or
				individuals, which may include older individuals, volunteers in the National
				Senior Volunteer Corps established under title II of the Domestic Volunteer
				Service Act of 1973 (42 U.S.C. 5000 et seq.), participants in the school-based
				and community-based service-learning programs carried out under parts I and II
				of subtitle B, participants in the AmeriCorps program carried out under
				subtitle C, or students enrolled in secondary schools or institutions of higher
				education;</text>
										</subparagraph><subparagraph id="H4295822F16F94DC193A178D7FE8524CD"><enum>(E)</enum><text>ensure that youth
				participating in the project provide at least 100 hours of community service
				for the project;</text>
										</subparagraph><subparagraph id="H3B875B3051FE4D5E9DC64C211334E325"><enum>(F)</enum><text>recruit eligible
				youth to participate in the project;</text>
										</subparagraph><subparagraph id="H69D95CA5B9E643AF92D4E65EB3686124"><enum>(G)</enum><text>recruit service
				sponsors for community service activities carried out through the project, if
				the eligible entity intends to enter into an arrangement with such sponsors to
				provide project placements for the youth;</text>
										</subparagraph><subparagraph id="H60BF15FDFD37499F93844EAD92199E77"><enum>(H)</enum><text>promote leadership
				development and build an ethic of civic responsibility among the youth;</text>
										</subparagraph><subparagraph id="H2968521661E9458C8924DE02001E4476"><enum>(I)</enum><text>provide
				team-oriented, adult-supervised experiences through the project;</text>
										</subparagraph><subparagraph id="H24C6BE32172C421485EDD7B5755449BB"><enum>(J)</enum><text>conduct opening
				and closing ceremonies honoring participants in the project;</text>
										</subparagraph><subparagraph id="HBCB60AD473704A55AEAA5F6C93D2A555"><enum>(K)</enum><text>involve youth who
				are participating in the project in the design and planning of the project;
				and</text>
										</subparagraph><subparagraph id="H548099C081EB4B9E875EA7623891A1AD"><enum>(L)</enum><text>provide training,
				which may include life skills, financial education, and employment training, in
				addition to training concerning the specific community service to be provided
				through the project, for the youth; and</text>
										</subparagraph></paragraph><paragraph id="H4707E1DD958F4E47A3FA8051C82C1FE4"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE6F6F8207FCF43E6A684D23B37A1F64E"><enum>(A)</enum><text>specifies project
				outcome objectives relating to youth development or education achievement,
				community strengthening, and community improvement;</text>
										</subparagraph><subparagraph id="H0717DF73F2BC4A85A88F49E8BF2C493" indent="up1"><enum>(B)</enum><text>describes how the eligible entity will
				establish annual benchmarks for the objectives, and annually conduct an
				evaluation to measure progress toward the benchmarks; and</text>
										</subparagraph><subparagraph id="H1D3CD267A5A247A4A44F157904D6B166" indent="up1"><enum>(C)</enum><text>provides an assurance that the
				eligible entity will annually make the results of such evaluation available to
				the State.</text>
										</subparagraph></paragraph></subsection><subsection id="H2487C7785FBA4BF08B977DB230F25360"><enum>(c)</enum><header>Continued
				eligibility</header><text>To be eligible to receive funds under this section
				for a second or subsequent year of a subgrant period, an entity shall
				demonstrate that the entity has met the annual benchmarks for the objectives
				described in subsection (b)(3).</text>
								</subsection><subsection id="HC12AAAAE634F4738A3BAE19CA9C2A02D"><enum>(d)</enum><header>Selection of
				subgrant recipients</header><text>In awarding subgrants under this section, the
				State shall ensure that projects are funded in a variety of geographic areas,
				including urban and rural areas.</text>
								</subsection></section><section id="H46961FAB5AC54FE6ACA936E83B56FA9"><enum>162B.</enum><header>Summer of
				service projects</header>
								<subsection id="HF09B2B69F6594DBCB4F5ED43F4BDD8AA"><enum>(a)</enum><header>Use of
				funds</header>
									<paragraph id="H2121E2EBB9284050AAA65E7244BEC0F"><enum>(1)</enum><header>In
				general</header><text>An eligible entity that receives a subgrant under section
				162A shall use the subgrant funds to carry out a community service
				project.</text>
									</paragraph><paragraph id="HC9B181D3A678487ABC562737DFF891D2"><enum>(2)</enum><header>Specific
				uses</header><text>The eligible entity may use the subgrant funds to pay
				for—</text>
										<subparagraph id="HEB077FC12F3A470BA7952213385390D6"><enum>(A)</enum><text>hiring staff to
				administer the project;</text>
										</subparagraph><subparagraph id="H2B8C58458AB34CC4A100E44FF85798F0"><enum>(B)</enum><text>developing or
				acquiring service-learning curricula for the project, to be integrated into
				academic programs, including making modifications for students who are
				individuals with disabilities and students with limited English
				proficiency;</text>
										</subparagraph><subparagraph id="H82D038F40FD94AA6851F69D8D9BD4311"><enum>(C)</enum><text>forming local
				partnerships to develop and offer a variety of service-learning programs for
				local youth participating in the project;</text>
										</subparagraph><subparagraph id="H183161B6D985461487CFA6A9D98B2E4F"><enum>(D)</enum><text>establishing
				benchmarks, conducting evaluations, and making evaluation results available, as
				described in subparagraphs (B) and (C) of section 162A(b)(3);</text>
										</subparagraph><subparagraph id="HAFE2D015D2F44BB194892121D9687189"><enum>(E)</enum><text>conducting
				outreach and dissemination of program-related information to ensure the
				broadest possible involvement of local eligible youth and community partners in
				the project;</text>
										</subparagraph><subparagraph id="H8ECB8335C7B244A1B79C3BEB23DACBBC"><enum>(F)</enum><text>conducting
				ceremonies as described in section 162A(b)(2)(J);</text>
										</subparagraph><subparagraph id="H072C5C4420584F47B78E6531C9DD065E"><enum>(G)</enum><text>carrying out basic
				implementation of the community service project; and</text>
										</subparagraph><subparagraph id="HAD4A3F500281462F9D31992F2CB78EBB"><enum>(H)</enum><text>carrying out
				planning activities, during an initial 6 to 9 months of the subgrant
				period.</text>
										</subparagraph></paragraph><paragraph id="HE2FA9AB51F234205AF88E32DAFC500D2"><enum>(3)</enum><header>Non-Federal
				share</header><text>An eligible entity that receives a subgrant under section
				162A shall provide the non-Federal share of the costs described in section
				162A(a)(1) from private or public sources other than the subgrant funds. The
				sources may include fees charged to the parents of the youth participating in
				the community service project involved and determined on a sliding scale based
				on income.</text>
									</paragraph></subsection><subsection id="H8F1C38F636814DFAA9D666A3C9AAB390"><enum>(b)</enum><header>Service
				projects</header>
									<paragraph id="HD908686A44914708973665E594F49481"><enum>(1)</enum><header>Eligible service
				categories</header><text>The eligible entity may use the subgrant funds to
				carry out a community service project to meet unmet human, educational,
				environmental, or public safety needs.</text>
									</paragraph><paragraph id="HA51AFD42108D45D2B500279DC500F678"><enum>(2)</enum><header>Ineligible
				service categories</header><text>The eligible entity may not use the subgrant
				funds to carry out a service project in which participants perform service
				described in section 132(a).</text>
									</paragraph></subsection><subsection id="H539F6B86EB35459C8CDC1293CB69905"><enum>(c)</enum><header>Period of service
				projects</header><text>The eligible entity—</text>
									<paragraph id="HA03A6C73CC954528AA7600D023DE9011"><enum>(1)</enum><text>shall carry out
				the community service project funded under section 162A during a period, the
				majority of which occurs in the months of June, July, and August; and</text>
									</paragraph><paragraph id="HE16585733BDE4AAF968CC4D8122886F6"><enum>(2)</enum><text>may carry out the
				project in conjunction with a related after school or in-school
				service-learning project operated during the remaining months of the
				year.</text>
									</paragraph></subsection><subsection id="H61B949CA4EEB4A39B9E866DAA2C368CE"><enum>(d)</enum><header>Educational
				award</header>
									<paragraph id="H2F556005C0C94C60AA6457CC8BD5E1A3"><enum>(1)</enum><header>Eligibility</header><text>Each
				eligible youth who provides at least 100 hours of community service for a
				project carried out under this part shall be eligible to receive an educational
				award of not more than $500. An eligible youth may participate in more than 1
				such project but shall not receive in excess of $1,000 in total for such
				participation.</text>
									</paragraph><paragraph id="H867D0E52422C4EF49E35728110DED44F"><enum>(2)</enum><header>Disbursements by
				eligible entity</header><text>If the Chief Executive Officer decides under
				section 162(a)(2)(A) to include educational award funds in subgrants under this
				part, the eligible entity carrying out the project shall—</text>
										<subparagraph id="H886F4632983D46B1B38482D03C9B35C6"><enum>(A)</enum><text>disburse an
				educational award described in paragraph (1) in accordance with regulations
				issued by the Chief Executive Officer, which—</text>
											<clause id="HCABBC0DF8182473299001020829065AA"><enum>(i)</enum><text>may permit
				disbursal of the award to the parents of the youth that have established a
				qualified tuition program account under section 529 of the Internal Revenue
				Code of 1986, for deposit into the account; but</text>
											</clause><clause id="H9CF49CFE83AF4800BA24E5A64919B761"><enum>(ii)</enum><text>shall not
				otherwise permit disbursal of the award to the parents; or</text>
											</clause></subparagraph><subparagraph id="H7F84128849244748887D7932AEFAB0E7"><enum>(B)</enum><text>enter into a
				contract with a private sector organization to hold the educational award funds
				and disburse the educational award as described in subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="H44D548B6186A493F917EB254B52DEBEE"><enum>(3)</enum><header>Disbursements by
				Chief Executive Officer</header><text>If the Chief Executive Officer decides
				under section 162(a)(2)(B) to reserve educational award funds, the Chief
				Executive Officer shall disburse the educational award as described in
				paragraph (2)(A).</text>
									</paragraph></subsection></section><section id="H8BD83AFF17FA4954AF9C49EF2362681C"><enum>162C.</enum><header>Supplemental
				grants</header>
								<subsection id="H91995B32F9AC479FB857EBF96900FDEB"><enum>(a)</enum><header>In
				general</header><text>The Chief Executive Officer may award a supplemental
				grant to an eligible entity that demonstrates the matters described in
				subsection (b), to assist the entity in carrying out a community service
				project in accordance with the requirements of this part, as determined
				appropriate by the Chief Executive Officer.</text>
								</subsection><subsection id="H8E468E3F2B6C4195AA389BC36D666EE"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a supplemental grant under subsection (a), an entity
				shall submit an application to the Chief Executive Officer, at such time, in
				such manner, and containing such information as the Chief Executive Officer may
				require, including information demonstrating—</text>
									<paragraph id="HF72C91B17A754E1184C7CB00301BEA00"><enum>(1)</enum><text>that the entity
				received a subgrant under section 162A for a community service project;
				and</text>
									</paragraph><paragraph id="H53EB564CC26D4292B3D871B9B8867485"><enum>(2)</enum><text>that the entity
				would be unable to carry out the project without substantial hardship unless
				the entity received a supplemental grant under subsection (a).</text>
									</paragraph></subsection><subsection id="H5C97B9B3AC0A4EF1A9A3908B08360143"><enum>(c)</enum><header>Amount of
				grant</header><text>The Chief Executive Officer shall award such a grant to an
				eligible entity for the project in the amount obtained by multiplying $250 and
				the number of youth who will participate in the project (to be used for project
				expenses).</text>
								</subsection></section><section id="HB34EE11ED41C4AD183E9E4EFDD3FC27B"><enum>162D.</enum><header>Indian tribes
				and territories</header><text display-inline="no-display-inline">From the funds
				made available to carry out this part under section 165(b)(2)(A) for any fiscal
				year, the Chief Executive Officer shall reserve an amount of not more than 3
				percent for payments to Indian tribes, the United States Virgin Islands, Guam,
				American Samoa, and the Commonwealth of the Northern Mariana Islands, to be
				used in accordance with the requirements of this part, as determined
				appropriate by the Chief Executive Officer.</text>
							</section></part><part id="HF1AF6B654F954698A8E381BFA12C87C0"><enum>II</enum><header>Summer of service
				national direct grant program</header>
							<section id="HB3D7A1281D394E34955DE7053CE1441E"><enum>163.</enum><header>National direct
				grants</header>
								<subsection id="H21F5511F2E10450E8B18EA7050407D38"><enum>(a)</enum><header>Grants</header>
									<paragraph id="HC20531A5B92B40F2ABD9D42BCAB022D"><enum>(1)</enum><header>In
				general</header><text>The Chief Executive Officer shall award grants on a
				competitive basis to public or private organizations (referred to individually
				in this part as an <quote>organization</quote>)—</text>
										<subparagraph id="H9A1C6F2384534424B2FA9D623CBCDEF"><enum>(A)</enum><text>to carry out
				quality assurance activities under subsection (d); and</text>
										</subparagraph><subparagraph id="H9CFBCA81BFCD44F28F0021ADDAB1AB61"><enum>(B)</enum><text>to pay for the
				Federal share of the cost of carrying out a community service program—</text>
											<clause id="HA74DB435DFEF4E78AA3028D944941CDA"><enum>(i)</enum><text>in
				a State where the State Commission does not apply for funding under part I;
				or</text>
											</clause><clause id="HB3ADC343AFC84D9898E3CED218F0165"><enum>(ii)</enum><text>in
				multiple States.</text>
											</clause></subparagraph></paragraph><paragraph id="HD948BE5276CA49E9A7AB370089B0EB20"><enum>(2)</enum><header>Funds for
				educational awards</header><text>The Chief Executive Officer shall decide
				whether funds appropriated to carry out this part and available for educational
				awards (referred to in this part as <quote>educational award funds</quote>)
				shall be—</text>
										<subparagraph id="H7190D786AE484F3A8753389BF03FA416"><enum>(A)</enum><text>included in the
				funds for such grants to organizations and any subgrants to local providers;
				or</text>
										</subparagraph><subparagraph id="H4A589CCC97CE4B35888E00FF1DC633D6"><enum>(B)</enum><text>reserved by the
				Chief Executive Officer, deposited in the National Service Trust for
				educational awards, and disbursed according to paragraphs (1) and (3) of
				section 163B(d).</text>
										</subparagraph></paragraph><paragraph id="HF9FD9812FE5A4A868563A5CB7703C90"><enum>(3)</enum><header>Periods of
				grants</header><text>The Chief Executive Officer shall award the grants for
				periods of 3 years.</text>
									</paragraph><paragraph id="HFBA86B271FAD4BCD8B731603887500C9"><enum>(4)</enum><header>Amounts of
				grants</header><text>The Chief Executive Officer shall award such a grant to an
				organization for a program in a sum equal to—</text>
										<subparagraph id="H12967A5BB2E1414EA5B8463195041471"><enum>(A)</enum><text>the amount
				obtained by multiplying $500 and the number of youth who will participate in
				the program (to be used for program expenses);</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H601DA0531A52435CA952557164B97D9C"><enum>(B)</enum><text>unless the Chief
				Executive Officer decides to deposit funds for educational awards in the
				National Service Trust, as described in paragraph (2)(B), an additional amount
				equal to the amount described in subparagraph (A) (to be used for educational
				awards); and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9903C1371ADC45FB901C84684047A310"><enum>(C)</enum><text>an amount
				sufficient to provide for the reservation for quality assurance activities
				described in subsection (d).</text>
										</subparagraph></paragraph></subsection><subsection id="H7BDBBCCAC6B84A839C8C8731AAFCDC7"><enum>(b)</enum><header>National direct
				applications</header><text>To be eligible to receive a grant under this section
				for a community service program, an organization shall submit an application to
				the Chief Executive Officer at such time, in such manner, and containing such
				information as the Chief Executive Officer may require, including information
				that—</text>
									<paragraph id="H12A4B85890394C8BA45BFDBFF5DF8232"><enum>(1)</enum><text>describes how the
				organization will use funds received under this part, including funds reserved
				for quality assurance activities under subsection (d);</text>
									</paragraph><paragraph id="HA7EFCB8184F44BB89056E8FF4E0228C8"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HB0268FC0395D4112B853190097656711"><enum>(A)</enum><text>describes the procedures
				and criteria the organization will use for reviewing applications and awarding
				subgrants on a competitive basis under section 163A to local providers for
				projects, including how the organization will give priority to a provider that,
				with respect to each project described in the application—</text>
											<clause id="H962A53CB0AF04A0A8FEC8D4CDD14C677" indent="up1"><enum>(i)</enum><text>offers a quality plan for or has an
				established track record of carrying out the activities described in the
				provider's application;</text>
											</clause><clause id="H636BB3FFB8644D44981F9D34DDA977B9" indent="up1"><enum>(ii)</enum><text>has a leadership position in the
				community from which the youth participating in the project will be
				drawn;</text>
											</clause><clause id="H4DB3B34E4C004DDB8DAB57CB83FF39CA" indent="up1"><enum>(iii)</enum><text>proposes a project that focuses
				on service by the participants during the transition year before high
				school;</text>
											</clause><clause id="H092BDFCF2D66465EA46EC29520A50074" indent="up1"><enum>(iv)</enum><text>plans to ensure that at least 50
				percent of the participants are low-income eligible youth;</text>
											</clause><clause id="H20F5D6610ADF4C0CBFCF52A45341FC6" indent="up1"><enum>(v)</enum><text>proposes a project that encourages
				or enables youth to continue participating in community service throughout the
				school year;</text>
											</clause><clause id="H6C549D33CDAB428788C6D6146DC3DBA" indent="up1"><enum>(vi)</enum><text>plans to involve the participants
				in the design and operation of the project, including involving the
				participants in conducting a needs-based assessment of community needs;</text>
											</clause><clause id="HF0927531EB9B45BD9706B52E7BA3D8AC" indent="up1"><enum>(vii)</enum><text>proposes a project that involves
				youth of different ages, races, sexes, ethnic groups, religions, disability
				categories, or economic backgrounds serving together; and</text>
											</clause><clause id="HB0E3F579707D4E1EBBC750732123C6DB" indent="up1"><enum>(viii)</enum><text>proposes a project that provides
				high quality service-learning experiences; or</text>
											</clause></subparagraph><subparagraph id="H116C8764EF054B86BBFF46C15DEDB6B" indent="up1"><enum>(B)</enum><text>if the organization will carry out the
				community service program directly, demonstrates that the organization meets
				the requirements of clauses (i) through (viii) of subparagraph (A) with respect
				to each project described in the application;</text>
										</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H11B173C4E9684D6C81984E8FC200483F"><enum>(3)</enum><text>describes the
				steps the organization will take, including the provision of ongoing technical
				assistance described in subsection (d)(2) and training, to ensure that projects
				funded under this part will implement effective strategies; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA77B5B3564F4881A2B650C253F718AC"><enum>(4)</enum><text>describes how the
				organization will evaluate the projects funded under this part, which shall
				include, at a minimum—</text>
										<subparagraph commented="no" display-inline="no-display-inline" id="HA9259F2D25C44EB8B0B58FF081EFEDAF"><enum>(A)</enum><text>a description of
				the objectives and benchmarks that will be used to evaluate the projects;
				and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5EC8C5941D11414381CC1841D339E7F7"><enum>(B)</enum><text>a description of
				how the organization will disseminate widely the results of the evaluations, as
				described in subsection (d)(3)(C).</text>
										</subparagraph></paragraph></subsection><subsection id="H993C40079308464EA600E2F86D00DD61"><enum>(c)</enum><header>Applicant
				review</header>
									<paragraph id="HECA984A3A68A43FD8D872F257E3EE8EA"><enum>(1)</enum><header>Selection
				criteria</header><text>The Chief Executive Officer shall evaluate applications
				for grants under this section based on the quality, innovation, replicability,
				and sustainability of the programs proposed by the applicants.</text>
									</paragraph><paragraph id="H49A10215AAFA44F6B1E981498B94002B"><enum>(2)</enum><header>Review
				panels</header><text>The Chief Executive Officer shall employ the review panels
				established under section 165A in reviewing the applications.</text>
									</paragraph><paragraph id="H6CD620D19A564AF1B2F3FD6079B8EE48"><enum>(3)</enum><header>Notification of
				applicants</header><text>If the Chief Executive Officer rejects an application
				submitted under this section, the Chief Executive Officer shall promptly notify
				the applicant of the reasons for the rejection of the application.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5F28E6AE852E44678909ECAAE65828A9"><enum>(4)</enum><header>Resubmission and
				reconsideration</header><text>The Chief Executive Officer shall provide an
				applicant notified of rejection with a reasonable opportunity to revise and
				resubmit the application. At the request of the applicant, the Chief Executive
				Officer shall provide technical assistance to the applicant as part of the
				resubmission process. The Chief Executive Officer shall promptly reconsider an
				application resubmitted under this paragraph.</text>
									</paragraph></subsection><subsection id="HCA1C4436C2434A8682BEA64D0009D6E"><enum>(d)</enum><header>Quality assurance
				activities</header><text>An organization that receives a grant under this
				section may reserve up to 5 percent of the grant funds for quality assurance
				activities, which may include—</text>
									<paragraph id="H79B10C8E160340A588D00BFADC3B0DF"><enum>(1)</enum><text>hiring staff to
				administer the program carried out under this part by the organization;</text>
									</paragraph><paragraph id="H14BC115B271B4A9400951189001F9426"><enum>(2)</enum><text>providing
				technical assistance, including technical assistance concerning the
				professional development and training of personnel, to local providers that
				receive subgrants under section 163A; and</text>
									</paragraph><paragraph id="H414708E25C4D4508B53B4D7899CAA477"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H6451478B1E9549CEB3B6E57E93B99F33"><enum>(A)</enum><text>conducting an evaluation
				of the projects carried out by local providers of the organization under this
				part;</text>
										</subparagraph><subparagraph id="H1D1BCA7AEB3E46859CADC79900E5B55B" indent="up1"><enum>(B)</enum><text>using the results of the evaluation to
				collect and compile information on best practices and models for such projects;
				and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HA3226324C4894C23A72EDDA62454D8E" indent="up1"><enum>(C)</enum><text>disseminating widely the results of
				the evaluation.</text>
										</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HFF8F03F497D54362849CF228F611939"><enum>163A.</enum><header>Subgrants to
				local providers</header>
								<subsection commented="no" display-inline="no-display-inline" id="HCC88673740894A799786CC0026BDC9CB"><enum>(a)</enum><header>Subgrants</header>
									<paragraph commented="no" display-inline="no-display-inline" id="HE4285E5012B8491095F7FF7681A976E4"><enum>(1)</enum><header>In
				general</header><text>An organization that receives a grant under section 163
				may use the grant funds to award subgrants on a competitive basis to local
				providers to pay for the Federal share of the cost of carrying out community
				service projects.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB485E97B3BC24A2C9CB0C4001D3841D4"><enum>(2)</enum><header>Periods of
				subgrants</header><text>The organization shall award the subgrants for periods
				of 3 years.</text>
									</paragraph><paragraph id="H158B65DC3AC3425BAD531F01EF619BE8"><enum>(3)</enum><header>Amounts of
				subgrants</header><text>The organization shall award such a subgrant to a local
				provider for a project in a sum equal to—</text>
										<subparagraph id="H960D18AE307D44A0AF87497478D6E8CC"><enum>(A)</enum><text>the amount
				obtained by multiplying $500 and the number of youth who will participate in
				the project (to be used for project expenses); and</text>
										</subparagraph><subparagraph id="HD3DEBEB264F24AE3B3E0C499BBFC1091"><enum>(B)</enum><text>unless the Chief
				Executive Officer decides to deposit funds for educational awards in the
				National Service Trust, as described in section 163(a)(2)(B), an additional
				amount equal to the amount described in subparagraph (A) (to be used for
				educational awards).</text>
										</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3B27CDA89EE34434AD064E51DCAC5FD"><enum>(b)</enum><header>Local provider
				application</header><text>To be eligible to receive a subgrant under this
				section, a local provider shall submit an application to the organization at
				such time, in such manner, and containing such information as the organization
				may require, including information that—</text>
									<paragraph id="H950133772EA44685906BB0B61F1FBBE9"><enum>(1)</enum><text>designates the
				communities in which the local provider will carry out projects under the
				subgrant, each of which communities may be the service area of an elementary
				school or secondary school, a school district, a city, town, village, or other
				locality, a county, the area in which a public housing project is located, a
				neighborhood, or another geographically or politically designated area;</text>
									</paragraph><paragraph id="HF86DD63E8A8249A086276CC8C1ED00DE"><enum>(2)</enum><text>for each project
				described in such application, describes the manner in which the local provider
				will—</text>
										<subparagraph id="H1A99E2A48E1D441398AB506D005D3D00"><enum>(A)</enum><text>engage a
				substantial portion of the youth in the designated community involved;</text>
										</subparagraph><subparagraph id="H9EDCDEE2D70A4C898735003F72188EA4"><enum>(B)</enum><text>engage a variety
				of entities and individuals, such as youth organizations, elementary schools or
				secondary schools, elected officials, organizations offering summer camps,
				civic groups, nonprofit organizations, and other entities within the designated
				community to offer a variety of summer service opportunities as part of the
				project;</text>
										</subparagraph><subparagraph id="HACBD40B2C275474CB3102D1EBA896F55"><enum>(C)</enum><text>ensure that the
				youth participating in the project engage in service-learning;</text>
										</subparagraph><subparagraph id="H16DC12EBFBFC4B9AA3DE4ED4A3E1E6F2"><enum>(D)</enum><text>engage as
				volunteers in the project business, civic, or community organizations or
				individuals, which may include older individuals, volunteers in the National
				Senior Volunteer Corps established under title II of the Domestic Volunteer
				Service Act of 1973 (42 U.S.C. 5000 et seq.), participants in the school-based
				and community-based service-learning programs carried out under parts I and II
				of subtitle B, participants in the AmeriCorps program carried out under
				subtitle C, or students enrolled in secondary schools or institutions of higher
				education;</text>
										</subparagraph><subparagraph id="HF60807A153084341A9BE600056DF9200"><enum>(E)</enum><text>ensure that youth
				participating in the project provide at least 100 hours of community service
				for the project;</text>
										</subparagraph><subparagraph id="HE439016641934D52B01500D6F42FC890"><enum>(F)</enum><text>recruit eligible
				youth to participate in the project;</text>
										</subparagraph><subparagraph id="HFE5CA7273E4444E5827F77AA2559C3E9"><enum>(G)</enum><text>recruit service
				sponsors for community service activities carried out through the project, if
				the local provider intends to enter into an arrangement with such sponsors to
				provide project placements for the youth;</text>
										</subparagraph><subparagraph id="H3F1526E3F744465B9C008E2E95E49C00"><enum>(H)</enum><text>promote leadership
				development and build an ethic of civic responsibility among the youth;</text>
										</subparagraph><subparagraph id="H932F7F1208964C8CBCD9C42D56FB86BC"><enum>(I)</enum><text>provide
				team-oriented, adult-supervised experiences through the project;</text>
										</subparagraph><subparagraph id="H09B6BC6888EC4765A93D3B15484B0800"><enum>(J)</enum><text>conduct opening
				and closing ceremonies honoring participants in the project;</text>
										</subparagraph><subparagraph id="H3A5FA39BFDB44723B9DDDB8837B94B50"><enum>(K)</enum><text>involve youth who
				are participating in the project in the design and planning of the project;
				and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD0078C17EAA443A499CE544D12955D00"><enum>(L)</enum><text>provide training,
				which may include life skills, financial education, and employment training, in
				addition to training concerning the specific community service to be provided
				through the project, for the youth; and</text>
										</subparagraph></paragraph><paragraph id="H6E32CCE04FDE44ECBE6F59DF6387B38B"><enum>(3)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="H012F8F1CCC4348AC8BFEB853D711CBF"><enum>(A)</enum><text>specifies project outcome
				objectives relating to youth development or education achievement, community
				strengthening, and community improvement;</text>
										</subparagraph><subparagraph id="H195AF0F9597548CC9CA3D0CDB63D8F26" indent="up1"><enum>(B)</enum><text>describes how the local provider will
				establish annual benchmarks for the objectives, and annually conduct an
				evaluation to measure progress toward the benchmarks; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9BF9CB803E9C4EB68081E457AD298337" indent="up1"><enum>(C)</enum><text>provides an assurance that the local
				provider will annually make the results of such evaluation available to the
				organization.</text>
										</subparagraph></paragraph></subsection><subsection id="H556DB54D27A640D98CBB746241B3D4D9"><enum>(c)</enum><header>Continued
				eligibility</header><text>To be eligible to receive funds under this section
				for a second or subsequent year of a subgrant period, a local provider shall
				demonstrate that all the projects for which the subgrant was awarded met the
				annual benchmarks for the objectives described in subsection (b)(3).</text>
								</subsection><subsection id="HC6FAECB1B45D42C4B04C02FD77F41200"><enum>(d)</enum><header>Selection of
				subgrant recipients</header><text>In awarding subgrants under this section, the
				organization shall ensure that projects are funded in a variety of geographic
				areas, including urban and rural areas.</text>
								</subsection></section><section id="HA78FA0F752254E84A7ED1FC560CE5D27"><enum>163B.</enum><header>Summer of
				service projects</header>
								<subsection id="HE627C6D5C5CF4C00AEBD96C80900ABD1"><enum>(a)</enum><header>Use of
				funds</header>
									<paragraph id="H230C08343B024239BD2E00EFEF69AD67"><enum>(1)</enum><header>In
				general</header><text>A local provider that receives a subgrant under section
				163A shall use the subgrant funds to carry out a community service
				project.</text>
									</paragraph><paragraph id="HF0C7B9721F094E49A471267167D7C1DC"><enum>(2)</enum><header>Specific
				uses</header><text>The local provider may use the subgrant funds, to pay
				for—</text>
										<subparagraph id="HEBDA3DCABF074B85BEF95910EC35DB4"><enum>(A)</enum><text>hiring staff to
				administer the project;</text>
										</subparagraph><subparagraph id="H883AD68A883C46B4926715410004C525"><enum>(B)</enum><text>developing or
				acquiring service-learning curricula for the project, to be integrated into
				academic programs, including making modifications for students who are
				individuals with disabilities and students with limited English
				proficiency;</text>
										</subparagraph><subparagraph id="H556590F737E0499495E5F51209FB18B6"><enum>(C)</enum><text>forming local
				partnerships to develop and offer a variety of service-learning programs for
				local youth participating in the project;</text>
										</subparagraph><subparagraph id="HE136A32AA8B847F4AA4D1986BF59213E"><enum>(D)</enum><text>establishing
				benchmarks, conducting evaluations, and making evaluation results available, as
				described in subparagraphs (B) and (C) of section 163A(b)(3);</text>
										</subparagraph><subparagraph id="H3FAD331F3BED467AA3756713E703111E"><enum>(E)</enum><text>conducting
				outreach and dissemination of program-related information to ensure the
				broadest possible involvement of local eligible youth and community partners in
				the project;</text>
										</subparagraph><subparagraph id="H4C16D569249047AFAC2999F08E3FCB04"><enum>(F)</enum><text>conducting
				ceremonies as described in section 163A(b)(2)(J);</text>
										</subparagraph><subparagraph id="HA89576AF213B4CE8A0354D189CEAA381"><enum>(G)</enum><text>carrying out basic
				implementation of the community service project; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE1EB281076B478B9633DC106F2E924B"><enum>(H)</enum><text>carrying out
				planning activities, during an initial 6 to 9 months of the grant
				period.</text>
										</subparagraph></paragraph><paragraph id="HD9A36270C10740C9A0282D3B6CCADCF7"><enum>(3)</enum><header>Non-federal
				share</header><text>A local provider that receives a subgrant under section
				163A shall provide the non-Federal share of the cost described in section
				163A(a)(1) from private or public sources other than the subgrant funds. The
				sources may include fees charged to the parents of the youth participating in
				the community service project involved and determined on a sliding scale based
				on income.</text>
									</paragraph></subsection><subsection id="H66EF2629F0DB4309ADB7104D6F4BF25B"><enum>(b)</enum><header>Service
				projects</header>
									<paragraph id="HDED9C0DC5564439DB2077611FA6AB35"><enum>(1)</enum><header>Eligible service
				categories</header><text>The local provider may use the subgrant funds to carry
				out a community service project to meet unmet human, educational,
				environmental, or public safety needs.</text>
									</paragraph><paragraph id="HD26021351EA04039AF9D0900956837B1"><enum>(2)</enum><header>Ineligible
				service categories</header><text>The local provider may not use the subgrant
				funds to carry out a service project in which participants perform service
				described in section 132(a).</text>
									</paragraph></subsection><subsection id="H8101E5A38EA8402CBD3B908D171406F4"><enum>(c)</enum><header>Period of
				service projects</header><text>The local provider—</text>
									<paragraph id="H4290725389544CC19F1E128E749BC6E8"><enum>(1)</enum><text>shall carry out
				the community service project funded under section 163A during a period, the
				majority of which occurs in the months of June, July, and August; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA6B5905F22F145F3A3B925291C3C009B"><enum>(2)</enum><text>may carry out the
				project in conjunction with a related after school or in-school
				service-learning project operated during the remaining months of the
				year.</text>
									</paragraph></subsection><subsection id="H1B03A52509FE411CAD5F6843092DA894"><enum>(d)</enum><header>Educational
				award</header>
									<paragraph id="H328ECF974882443984AA5BC3D093FF24"><enum>(1)</enum><header>Eligibility</header><text>Each
				eligible youth who provides at least 100 hours of community service for a
				project carried out under this part shall be eligible to receive an educational
				award of not more than $500. An eligible youth may participate in more than 1
				such project but shall not receive in excess of $1,000 in total for such
				participation.</text>
									</paragraph><paragraph id="H67CBAEE8860F48A4AAD3C4E09BC179FC"><enum>(2)</enum><header>Disbursements by
				local provider</header><text>If the Chief Executive Officer decides under
				section 163(a)(2)(A) to include educational award funds in subgrants under this
				part, the local provider carrying out the project shall—</text>
										<subparagraph id="H72E5ADFD54B94102919498CD635FA075"><enum>(A)</enum><text>disburse an
				educational award described in paragraph (1) in accordance with regulations
				issued by the Chief Executive Officer, which—</text>
											<clause id="H87856DC569714F53838E12861EDC11D0"><enum>(i)</enum><text>may permit
				disbursal of the award to the parents of the youth that have established a
				qualified tuition program account under section 529 of the Internal Revenue
				Code of 1986, for deposit into the account; but</text>
											</clause><clause id="H8AFA2B35E9064E748C4E6E6800798D93"><enum>(ii)</enum><text>shall not
				otherwise permit disbursal of the award to the parents; or</text>
											</clause></subparagraph><subparagraph id="HBA62DD5C63614051B1B6F7D775E5D1C7"><enum>(B)</enum><text>enter into a
				contract with a private sector organization to hold the educational award funds
				and disburse the educational award as described in subparagraph (A).</text>
										</subparagraph></paragraph><paragraph id="H0E82A8968FB74CA4B4782323468146BC"><enum>(3)</enum><header>Disbursements by
				chief executive officer</header><text>If the Chief Executive Officer decides
				under section 163(a)(2)(B) to reserve educational award funds, the Chief
				Executive Officer shall disburse the educational award as described in
				paragraph (2)(A).</text>
									</paragraph></subsection><subsection id="HD6C536AC25344446001D102F13CB8B16"><enum>(e)</enum><header>Application of
				section</header><text>References in this section to local providers, with
				respect to the use of subgrant funds received under section 163A, apply equally
				to organizations that carry out community service projects directly, with
				respect to the use of grant funds received under section 163.</text>
								</subsection></section><section id="HEE07A19E27EF4E78B484E0E500A330DB"><enum>163C.</enum><header>Supplemental
				grants</header>
								<subsection id="HD5230C8E612C478C90440186D7AC297"><enum>(a)</enum><header>In
				general</header><text>The Chief Executive Officer may award a supplemental
				grant to a local provider that demonstrates the matters described in subsection
				(b), to assist the provider in carrying out a community service project in
				accordance with the requirements of this part, as determined appropriate by the
				Chief Executive Officer.</text>
								</subsection><subsection id="HC586F3A0D9774170B5524FC227754681"><enum>(b)</enum><header>Application</header><text>To
				be eligible to receive a supplemental grant under subsection (a), a provider
				shall submit an application to the Chief Executive Officer, at such time, in
				such manner, and containing such information as the Chief Executive Officer may
				require, including information demonstrating—</text>
									<paragraph id="H4E67DACB918C454F005BAC73934514B"><enum>(1)</enum><text>that the provider
				received a subgrant under section 163A for a community service project;
				and</text>
									</paragraph><paragraph id="H31D4FC05DB3044C2AA3E0419ED262E7E"><enum>(2)</enum><text>that the provider
				would be unable to carry out the project without substantial hardship unless
				the provider received a supplemental grant under subsection (a).</text>
									</paragraph></subsection><subsection id="HCD8AF447C2F64259A500C9137EF79689"><enum>(c)</enum><header>Amount of
				grant</header><text>The Chief Executive Officer shall award such a grant to a
				local provider for the project in the amount obtained by multiplying $250 and
				the number of youth who will participate in the project (to be used for project
				expenses).</text>
								</subsection></section></part><part id="H9EBC58ED421942EA97E989B28BB68E53"><enum>III</enum><header>Summer of
				Service National Activities</header>
							<section id="HE3F47A9E0E1F4F25860789A008FEB00"><enum>164.</enum><header>National
				activities</header>
								<subsection id="H119612D29EF8413800FA4E4C1F791E9C"><enum>(a)</enum><header>National quality
				and outreach activities</header><text>The Chief Executive Officer may use funds
				reserved under section 165(b)(1), either directly or through grants and
				contracts, to—</text>
									<paragraph id="H806E06E5470D4D8AAD391361E8176925"><enum>(1)</enum><text>provide technical
				assistance and training to recipients of grants and subgrants under parts I and
				II;</text>
									</paragraph><paragraph id="HCB5649B9F7F547E1B903C5614DCA75D5"><enum>(2)</enum><text>conduct outreach
				and dissemination of program-related information to ensure the broadest
				possible involvement of States, eligible entities, organizations, local
				providers, and eligible youth in programs carried out under parts I and II;
				and</text>
									</paragraph><paragraph id="H90C28692348E4107BE71BBD6BB375354"><enum>(3)</enum><text>to carry out other
				activities designed to improve the quality of programs carried out under parts
				I and II.</text>
									</paragraph></subsection><subsection id="H2E07BE3C6DAC4CC4A2F05866AD63A88E"><enum>(b)</enum><header>National
				evaluation</header>
									<paragraph id="H7A5BED40860F49C39B73C511D03477F7"><enum>(1)</enum><header>Reservation</header><text>For
				each fiscal year, the Chief Executive Officer shall reserve not more than the
				greater of $500,000, or 1 percent, of the funds described in subsection (a) for
				the purposes described in paragraph (2).</text>
									</paragraph><paragraph id="HD5657AF8A921470093E4001F00AE6234"><enum>(2)</enum><header>Evaluation</header><text>The
				Chief Executive Officer shall use the reserved funds—</text>
										<subparagraph id="H9E8FB926AF8E4DF19223B44100007F14"><enum>(A)</enum><text>to arrange for an
				independent evaluation of the programs carried out under parts I and II, to be
				conducted in the second and third years in which the programs are
				implemented;</text>
										</subparagraph><subparagraph id="HB797B26638F04D089E19EE3122468FDA"><enum>(B)</enum><text>using the results
				of the evaluation, to collect and compile information on models and best
				practices for such programs; and</text>
										</subparagraph><subparagraph id="HBA44D6E4E49642B4B7455C758E554D36"><enum>(C)</enum><text>to disseminate
				widely the results of the evaluation.</text>
										</subparagraph></paragraph><paragraph id="HFA12A0DFF0E44A2094D501274B5F2100"><enum>(3)</enum><header>Report</header><text>The
				Chief Executive Officer shall annually submit to the Committee on Health,
				Education, Labor, and Pensions of the Senate and the Committee on Education and
				the Workforce of the House of Representatives, a report concerning the results
				of the evaluations conducted under paragraph (2). Such reports shall also
				contain information on models of best practices and any other findings or
				recommendations developed by the Chief Executive Officer based on such
				evaluations. Such reports shall be made available to the general public.</text>
									</paragraph></subsection></section></part><part id="HA0378AF123434E259F1C9F387626A78"><enum>IV</enum><header>General
				provisions</header>
							<section id="H1EA80620ABAF444596F4197169C9E015"><enum>165.</enum><header>Authorization
				of appropriations and availability</header>
								<subsection id="H754C27D311A94F55AC35005929380705"><enum>(a)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this subtitle $100,000,000 for fiscal year 2010 and such sums as may be
				necessary for each subsequent fiscal year.</text>
								</subsection><subsection id="HCF1E182826F34E2CBCF0DBF42127D8C1"><enum>(b)</enum><header>Availability</header><text>Of
				the funds appropriated under subsection (a) for a fiscal year, the Chief
				Executive Officer—</text>
									<paragraph id="HE9BA4E005806408A81FD03D2978F60A9"><enum>(1)</enum><text>shall reserve not
				more than 4 percent to carry out activities under part III (relating to
				national activities); and</text>
									</paragraph><paragraph id="H90AFCCDEA31B4B618C658EA2CADD042"><enum>(2)</enum><text>from the remainder
				of such funds, shall make available—</text>
										<subparagraph id="HD8CE1B3C0ADA4D86BDAA857E72958DC6"><enum>(A)</enum><text>a portion equal to
				66<fraction>2/3</fraction> percent of such funds for programs carried out under
				part I (relating to the State grant program), including programs carried out
				under section 162D; and</text>
										</subparagraph><subparagraph id="HC7949635F2D241468EB3D380CF788949"><enum>(B)</enum><text>a portion equal to
				33<fraction>1/3</fraction> percent of such funds for programs carried out under
				part II (relating to the national direct grant program).</text>
										</subparagraph></paragraph></subsection><subsection id="H51CB904D0A714B428493968BFBD083AE"><enum>(c)</enum><header>Reallocation</header><text>If
				the Chief Executive Officer determines that funds from the portion described in
				subsection (b)(2)(A) will not be needed to carry out programs under part I for
				a fiscal year, the Chief Executive Officer shall make the funds available for
				programs under part II for that fiscal year.</text>
								</subsection></section><section id="H6A539CEF278446C0B7B54386FF02DBF5"><enum>165A.</enum><header>Review
				panels</header><text display-inline="no-display-inline">The Chief Executive
				Officer shall establish panels of experts for the purpose of reviewing
				applications submitted under sections 162, 162C, 162D, and 163.</text>
							</section><section commented="no" display-inline="no-display-inline" id="HCFE7E94079994224BEEC10D72C8BB5A3" section-type="subsequent-section"><enum>165B.</enum><header>Construction</header><text display-inline="no-display-inline">An individual participating in service in a
				program described in this subtitle shall not be considered to be an employee
				engaged in employment for purposes of the Fair Labor Standards Act of 1938 (29
				U.S.C. 201 et
				seq.).</text>
