<official-title>To amend the National and Community Service Act of 1990 to establish Encore Service Programs, Encore Fellowship Programs, and Silver Scholarship Programs, and for other purposes.</official-title>

<section id="HBF0612BC91DE4F929FED4546CBF3EFDC" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Encore Service Act of 2009</short-title></quote>.</text></section> 
<section id="H9F84D929006044269265872DD6005299"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text> 
<paragraph id="H29CE5C823AC4448AA19027662B337E27"><enum>(1)</enum><text>Programs funded under the National and Community Service Act of 1990 have the potential to dramatically increase the number of individuals age 50 or older engaged in national service, applying decades of experience to solving community problems.</text></paragraph> 
<paragraph id="H4B8B58FD379048C19D839508EFC4F2C1"><enum>(2)</enum><text>The potential pool of older individuals who could provide national service is enormous and rapidly growing. The population of people age 50 or older, which today is more than 94,000,000 individuals, is expected to grow by over 22 percent in the next 10 years, to almost 115,000,000 individuals.</text></paragraph> 
<paragraph id="H38DDE8FF4D784C0ABB74E55CBDBB7B24"><enum>(3)</enum><text>Studies show that over half of the 78,000,000 individuals considered part of the Baby Boomer generation, those turning 50 between 1996 and 2014, are interested in providing meaningful service to their communities.</text></paragraph> 
<paragraph id="HF4CCB0911F214A7EAEF8D07C3F5A4DA"><enum>(4)</enum><text>Research further shows that older individuals are not adequately connected to national service or work opportunities in the public sector.</text></paragraph> 
<paragraph id="H3372F2D2252D42E0BC20002D4C643759"><enum>(5)</enum><text>For some individuals age 50 or older, participation in national service can serve as an important pathway and transition experience, leading them into second careers in the public or nonprofit sector.</text></paragraph> 
<paragraph id="HD29FD82EB74B4FBA8C4DAFFBD7006DB9"><enum>(6)</enum><text>Today's Retired and Senior Volunteer Program (RSVP) helps baby boomers anxious to make use of their education, skills, and expertise to protect seniors against fraud, work on a national falls prevention campaign, and volunteer to green the economy. Research shows that individuals enrolled in the program volunteer more hours of service per year than those not in the program.</text></paragraph> 
<paragraph id="HC368D44BCCF345E4AAE261A2D05CFE86"><enum>(7)</enum><text>The National Senior Volunteer Corps programs, which are national service programs that currently engage older individuals, have deployed millions of individuals in the United States in service to their communities but are currently at capacity and in need of resources to grow.</text></paragraph></section> 
<section id="H80CE2AE085A34025918F889999CC3291"><enum>3.</enum><header>References</header><text display-inline="no-display-inline">Except as otherwise expressly provided, wherever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a section or other provision, the reference shall be considered to be made to a section or other provision of the National and Community Service Act of 1990 (42 U.S.C. 12501 et seq.).</text></section> 
<title id="HDCD8F39C5EA44C4CBFD7A70E5E69810"><enum>I</enum><header>Encore Service Program</header> 
<section id="H67DA14E3DE7E4F849D32CEDD576570A"><enum>101.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 (42 U.S.C. 12511) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5C269698B09B4337B6C3DFD4DEE6BB4B" style="OLC"> 
<paragraph id="H689F5259831248E98C9E4311A9C5C13"><enum>(30)</enum><header>Encore Service Program</header><text>The term <term>Encore Service Program</term> means a national service program authorized under section 122(a)(15).</text></paragraph> 
<paragraph id="H02AA796EB23F407F0000F2F45C510411"><enum>(31)</enum><header>Encore Service Participant</header><text>The term <term>Encore Service Participant</term> means an individual age 50 or older who is a participant in an approved Encore Service Program.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HB40E8ACFA2A74804B7753627F06027CB"><enum>102.</enum><header>Eligibility</header><text display-inline="no-display-inline">Section 122(a) (42 U.S.C. 12572(a)) is amended—</text> 
<paragraph id="H7FEC2E82C2AF402B86C8E3FB3B6C3C45"><enum>(1)</enum><text>by redesignating paragraph (15) as paragraph (16); and</text></paragraph> 
<paragraph id="HA77F325406404BAF0000009FB57300EF"><enum>(2)</enum><text>by inserting after paragraph (14) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4FE72DA672FA4771A6123C91F55A402" style="OLC"> 
<paragraph id="HBAF503DE8E57419B008C44A7021E8751"><enum>(15)</enum><text>A service program that engages only individuals age 50 or older, or individuals age 50 or older and other individuals in intergenerational service activities, serving in service positions to address a specific community need.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HA9C44F073FD645B885001E64F344C9A7"><enum>103.</enum><header>Priority</header><text display-inline="no-display-inline">Section 122 (42 U.S.C. 12572) is amended—</text> 
<paragraph id="H65F4D0B8A72947958CE4E5B1B3C3A2C3"><enum>(1)</enum><text>in subsection (b), by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H4AE947E764C8439395DEAED005FE4894" style="OLC"> 
<paragraph id="H4DA63E595FE849879859000026F6976F"><enum>(5)</enum><header>Encouragement of Encore Service Programs</header><text>The Corporation shall encourage national service programs, in appropriate cases, to establish, using evidence-based approaches, Encore Service Programs, and to apply for assistance under subsection (a) for such programs.</text></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H4441A06CF117467580223B35CD8B2277"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H2D1EFF4D8343419A982DA039E800C49D" style="OLC"> 
<subsection id="H9C778BB6DCC0480A9BC6F677F3F7491E"><enum>(d)</enum><header>Priority for certain Encore Service Programs</header><text>In establishing priorities regarding the types of national service programs to be assisted under subsection (b) or (d) of section 129, the Corporation shall give priority to an Encore Service Program that has—</text> 
<paragraph id="H80E964728476479BBF17EC9F9100717C"><enum>(1)</enum><text>proven success in engaging, or detailed plans to begin engaging, individuals who are age 50 or older in service;</text></paragraph> 
<paragraph id="H66735DDD3072415EB4618BA1D98EC7FA"><enum>(2)</enum><text>a strong focus on pre-service and in-service training for participants in order to obtain measurable results that meet the needs of the community served; and</text></paragraph> 
<paragraph id="H8761F1CC7F35412BA307E2F82B38BD2C"><enum>(3)</enum><text display-inline="yes-display-inline">conducted a thorough evaluation of benefits of the Encore Service program to both the participants and the community.</text></paragraph></subsection> 
<subsection id="HD175C3921796460C8EE073EF701DB62"><enum>(e)</enum><header>Consultation</header><text>In awarding assistance or approved national service positions for Encore Service Programs, the Corporation shall consult with organizations and individuals with extensive experience in developing and administering robust national service programs that are producing measurable results and outstanding experiences for participants.</text></subsection> 
<subsection id="H524D99865F444E8E8110E6A3FCC33073"><enum>(f)</enum><header>Sense of Congress</header><text>It is the sense of Congress that, by 2018, 25 percent of individuals participating in national service programs specified in this subtitle should be older individuals who are age 50 or older.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H6CBA468EBEB1416DACAB46BAFBF64E78"><enum>104.</enum><header>Terms of service</header><text display-inline="no-display-inline">Section 139(b) (42 U.S.C. 12593(b)) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="HAE25A2AB7E184339938DD311F9EC6677" style="OLC"> 
<paragraph id="HC4F23CF9DED44E5EB34433C9CB9E3BD2"><enum>(4)</enum><header>Terms of service for Encore Service Programs</header> 
<subparagraph id="H8760A626A15044CD956F433DE1984737"><enum>(A)</enum><header>In general</header><text>Notwithstanding any other provision of this title, an individual age 50 or older performing national service in an approved national service position in an Encore Service Program shall agree to participate in the program for a term of service described in 1 of clauses (i) through (v) of subparagraph (B).</text></subparagraph> 
<subparagraph id="H7830F2EAB8DB4BB2B9D0546BD07E3B27"><enum>(B)</enum><header>Terms of service</header> 
<clause id="H69756C78897E472589345EE753A0A99F"><enum>(i)</enum><header>Full-time service</header><text>If such an individual is performing full-time service, the individual shall agree to participate in the program for the term described in paragraph (1).</text></clause> 
<clause id="HF80B06AC322B4F608C00B679276122D8"><enum>(ii)</enum><header>Half-time service</header><text>If such an individual is performing half-time service, the individual shall agree to participate in the program for not less than 900 hours during a period of not more than 1 year or not more than 2 years, as indicated in the approved application for the program.</text></clause> 
<clause id="H0C2AD24D09FA4EE9A154B39CDC788DAD"><enum>(iii)</enum><header>Reduced half-time service</header><text>If such an individual is performing reduced half-time service, the individual shall agree to participate in the program for not less than 675 hours during a period of not more than 1 year.</text></clause> 
<clause id="H010E7A5DAFB945D7B908E5BDD702E8EA"><enum>(iv)</enum><header>Quarter-time service</header><text>If such an individual is performing quarter-time service, the individual shall agree to participate in the program for not less than 450 hours during a period of not more than 1 year.</text></clause> 
<clause id="H5F36D72F55654397AEE9D8C025DD0918"><enum>(v)</enum><header>Minimum time service</header><text>If such an individual is performing minimum time service, the individual shall agree to participate in the program for not less than 300 hours during a period of not more than 1 year.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H3A81FD08CF594E2395AC6370E5BADC9F"><enum>105.</enum><header>Living allowance</header><text display-inline="no-display-inline">Section 140(h) (42 U.S.C. 12594(h)) is amended by adding at the end the following: <quote>In the case of an individual who began the individual's first term of service in a national service program under this subtitle after the individual attained the age of 50, and who is or has been an Encore Service Participant, the individual may not receive, through such assistance or funds, an aggregate amount that is more than twice the maximum amount available under subsections (a), (d), and (e) for a term of full-time service described in section 139(b)(1).</quote>.</text></section> 
<section id="HFE9BFB8F8B304B0A96AD919CE2600917"><enum>106.</enum><header>Educational award limit and term of transferred awards</header> 
<subsection id="H9A483A319A2449BAA0F3DB8220B11220"><enum>(a)</enum><header>Educational award limit</header><text display-inline="yes-display-inline">Section 146 (42 U.S.C. 12602) is amended by striking subsection (c) and inserting the following:</text> 
<quoted-block display-inline="no-display-inline" id="H127DB2B5F05D4AB88F93C98534694CE7" style="OLC"> 
<subsection id="H9C5DBB303C884EE0BE9369F71CE69E99"><enum>(c)</enum><header>Limitation on receipt of national service educational awards</header><text>An individual may not receive, through national service educational awards, an aggregate amount that is more than the value of 2 such awards for terms of full-time service described in section 139(b)(1).</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection commented="no" id="H6B0B6CD1F7C04EF1AC67C4A0D6B9FF57"><enum>(b)</enum><header>Term for transferred educational awards</header><text>Section 146(d) of the National and Community Service Act of 1990 (42 U.S.C. 12602) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H5ED80F6B878341F5A3A647C91D27B442" style="OLC"> 
<paragraph commented="no" id="HF92C8B8ACDCB4AB08987521BC786CBAD"><enum>(3)</enum><header>Term for transferred educational awards</header><text>For purposes of applying paragraphs (1) and (2)(A) to an individual who is eligible to receive an educational award as a designated individual (as defined in section 148(f)(3)), references to a seven-year period shall be considered to be references to a 20-year period that begins on the date the individual who transferred the educational award to the designated individual completed the term of service in the approved national service position that is the basis of the award.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="HA087A629E7C04F8FA8E249E45C8D38B2"><enum>107.</enum><header>Determination of the amount of the national service educational award</header><text display-inline="no-display-inline">Section 147 (42 U.S.C. 12603) is amended by adding at the end the following:</text> 
<quoted-block display-inline="no-display-inline" id="H18BE22B92FAC4FBB92624DB181005332" style="OLC"> 
<subsection id="HF647268337D54444BC975EDECEF05E00"><enum>(d)</enum><header>Award for Encore Service Participants</header><text>An individual who is an Encore Service Participant and who successfully completes the term of service described in section 139(b)(4) that is specified in the individual's agreement under such section, shall be provided with a national service educational award in an amount that bears the same relation to the amount of a full-time national service educational award as the number of hours of service provided in the position under the agreement bears to the number of hours of service required to be provided under section 139(b)(1) to receive a full-time national service educational award.</text></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="H473610E1DC5A47F6B96257151C67D81F"><enum>108.</enum><header>Transfer of the awards</header><text display-inline="no-display-inline">Section 148 (42 U.S.C. 12604) is amended—</text> 
<paragraph id="H7FB1B14A0EF441D7AEA496007250FBF4"><enum>(1)</enum><text>by redesignating subsections (f) and (g) as subsections (g) and (h), respectively; and</text></paragraph> 
<paragraph id="H15990F605A434FE4BE1990578D9556DD"><enum>(2)</enum><text>by inserting after subsection (e) the following:</text> 
<quoted-block display-inline="no-display-inline" id="H54ADFB944CBE45278D382CE586BF3DD7" style="OLC"> 
<subsection commented="no" id="H43025C5EEA1B46CC801C3F266C939BED"><enum>(f)</enum><header>Transfer of educational awards</header> 
<paragraph commented="no" id="HDFB6C4118AF64E428D096828FDF0B7CD"><enum>(1)</enum><header>In general</header><text>An individual who is eligible to receive a national service educational award under a program described in paragraph (2) may transfer the award to a designated individual, and subsections (b), (c), (d), and (e) shall apply to the designated individual in lieu of the individual who is eligible to receive the national service educational award, except that—</text> 
<subparagraph commented="no" id="H9E897B791F9B4A6DA63FF610F3B99E7"><enum>(A)</enum><text>amounts refunded to the account under subsection (c)(5) on behalf of a designated individual may be used by the Corporation to fund additional placements in the national service program in which the eligible individual who transferred the national service educational award participated for such award; and</text></subparagraph> 
<subparagraph commented="no" id="HED379EC0DD4E43769FF9C9D13DF2BB42"><enum>(B)</enum><text>a borrower of a qualified student loan (as defined in subsection (b)(6)) shall be eligible to have the Corporation pay, on behalf of the borrower, the interest that accrues during a period for which the borrower has obtained forbearance in accordance with subsection (e), if the eligible individual successfully completes the eligible individual's required term of service for a national service educational award and transfers the award to the borrower as a designated individual.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HCE4C0C22376742649170DCCFF8456CF7"><enum>(2)</enum><header>Conditions for transfer</header><text>A national service educational award may be transferred under this subsection if—</text> 
<subparagraph commented="no" id="H5CD6B139E433461D9F4E5FCC38FCCB2"><enum>(A)</enum><text>the educational award is for service in a national service program that is an Encore Service Program; and</text></subparagraph> 
<subparagraph commented="no" id="H1786921C5F3E491D9D1FC4CE3D5846CC"><enum>(B)</enum><text>the eligible individual began the individual's first term of service in the Encore Service Program after the individual attained the age of 50.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HD809BAF3BBF841FC8C99E5E6F1662BE9"><enum>(3)</enum><header>Definition of a designated individual</header><text>In this subsection, the term <term>designated individual</term> is an individual—</text> 
<subparagraph commented="no" id="H6F2B5DBCF7484D1A91D9B8B45F160CB"><enum>(A)</enum><text>whom an individual who is eligible to receive a national service educational award under a program described in paragraph (2) designates to receive the educational award; and</text></subparagraph> 
<subparagraph commented="no" id="H276FD2163F704D6BBAC1DD1B82F48C44"><enum>(B)</enum><text>who meets the eligibility requirements of paragraphs (3) and (4) of subsection (a), and subsection (e), of section 146.</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="HCCDB606781F443F0AB079727A40756BA"><enum>109.</enum><header>Corporation requirements</header> 
<subsection id="HB7FCFE6CC2324492BB4D5CF43F81084"><enum>(a)</enum><header>Planning for implementation</header><text display-inline="yes-display-inline">In order to carry out the objectives of section 122 (f) of the National and Community Service Act of 1990 (42 U.S.C. 12572 (f)), the Corporation shall examine national service programs carried out under subtitle C of title I of the National and Community Service Act of 1990 (42 U.S.C. 12571 et seq.) and identify and address the barriers to engaging individuals age 50 or older, including examining—</text> 
<paragraph id="HE96F6957882E41FCBE99ADE80045D36D"><enum>(1)</enum><text>how the programs are marketed to individuals age 50 or older versus young adults;</text></paragraph> 
<paragraph id="H4E922D8109914D06851CB793EDB5C66"><enum>(2)</enum><text>the extent to which the living allowance described in section 140 of that Act (42 U.S.C. 12594) is a factor;</text></paragraph> 
<paragraph id="HFD1A6797D2AE47DA8587513902008992"><enum>(3)</enum><text>the extent to which the educational award described in subtitle D of that Act (42 U.S.C. 12601 et seq.) is a factor;</text></paragraph> 
<paragraph id="H65A4CCB73A434E3AA900C5AF1D8B8868"><enum>(4)</enum><text>the correlation between the extent of the pre-service and in-service training provided and the perceived investment by the participants;</text></paragraph> 
<paragraph id="H577E5A6E8E674ABA86735D0965504BB5"><enum>(5)</enum><text>the correlation between the extent of the pre-service and in-service training provided and program impact;</text></paragraph> 
<paragraph id="HE86F79D897C9444385901B118CF5979C"><enum>(6)</enum><text>the extent to which job transition resources and training are provided; and</text></paragraph> 
<paragraph id="H4141B8B006934FE98D950436D5EDBA57"><enum>(7)</enum><text display-inline="yes-display-inline">the outreach efforts required to carry out the objectives of section 122(f) of that Act.</text></paragraph></subsection> 
<subsection id="HC1F9C3BB00AC4208AF337854831B69B9"><enum>(b)</enum><header>Reports to Congress</header> 
<paragraph id="HDF839665469340BA96B24231555C794D"><enum>(1)</enum><header>Report on implementation</header><text display-inline="yes-display-inline">Not later than 90 days after the date of enactment of this Act, the Corporation shall prepare and submit to Congress a report on implementation of this subtitle, including addressing barriers described in subsection (a)(1) and any necessary recommendations on how to enhance programming to carry out the objectives of section 122(f) of the National and Community Service Act of 1990 (42 U.S.C. 12572(d)(1)).</text></paragraph> 
<paragraph id="HD3D42A40ECC84E7682D22C00E8861E00"><enum>(2)</enum><header>Annual reporting</header><text>The Corporation shall include, in its annual report to Congress under section 172(b) of the National and Community Service Act of 1990 (42 U.S.C. 12632(b)), a detailed description of the Encore Service Programs that have been carried out and the progress of the Corporation in carrying out those objectives.</text></paragraph></subsection> 
<subsection id="HF6CDD37EB4E541869D721F8C2556B4AB"><enum>(c)</enum><header>Definition</header><text>In this section, the term <term>Encore Service Programs</term> has the meaning given the term in section 101 of the National and Community Service Act of 1990 (42 U.S.C. 12511).</text></subsection></section></title> 
<title id="H9E5694B341BC431BB87F8DEB32F995EF"><enum>II</enum><header>Encore Fellows</header> 
<section id="HCC380674AE68438890FA63A300BBD6C5"><enum>201.</enum><header>Definitions</header><text display-inline="no-display-inline">Section 101 (42 U.S.C. 12511), as amended by section 101 of this Act, is further amended by adding at the end the following:</text>

<subsection id="HAEAECDC2B3AC49C600E756BE009DB62C"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Subtitle H (42 U.S.C. 12653 et seq.) is amended by adding at the end the following:</text>

<section id="H02C90A66E8B04EAA86660908A7440841"><enum>198E.</enum><header>Encore Fellowship Programs</header> 
<subsection id="H78916BEE1C4B4B24B1165CB9BE89C8C5"><enum>(a)</enum><header>Statement of purpose</header><text>The purpose of this section is to provide for Encore Fellowship Programs, in order to—</text> 
<paragraph id="H64C4967C2ECC408B8F3E495079E91B48"><enum>(1)</enum><text>address the need for increased professional capacity in public agencies and nonprofit private organizations that are engaged in meeting unmet human, educational, environmental, or public safety needs; and</text></paragraph> 
<paragraph id="H220D9C5C9D0B4DB1A2E0747DE6D7A4F2"><enum>(2)</enum><text>address the need for compelling learning and service opportunities to assist experienced individuals age 50 and older in shifting from their mid-life careers to suitable and rewarding careers in the public or nonprofit sector that benefit society and provide continued income to the individuals.</text></paragraph></subsection> 
<subsection id="H72B46A634A45402CA9EC1906ED6CDFB0"><enum>(b)</enum><header>Assistance authorized</header> 
<paragraph id="H31A8C43BB7D449BFBF79B406958E8B22"><enum>(1)</enum><header>In general</header><text>The Corporation may make grants under this section to eligible entities to pay for the Federal share of the cost of carrying out Encore Fellowship Programs.</text></paragraph> 
<paragraph id="HB256431CB4484FA9A6E316CF23AF4E1E"><enum>(2)</enum><header>Programs</header><text>The Fellowship Programs shall—</text> 
<subparagraph id="H6A944F6A591349B19B281B249F54BDF"><enum>(A)</enum><text>recruit individuals age 50 or older who meet the requirements of subsection (f)(2) to serve as Encore Fellows;</text></subparagraph> 
<subparagraph id="H46660B6908204864A9A8891505896C85"><enum>(B)</enum><text>provide specialized preplacement training and additional training for the Encore Fellows;</text></subparagraph> 
<subparagraph id="HE90F69B9DC364530AD4DF2A0419DCDB"><enum>(C)</enum><text>provide other activities designed to foster transitions to second careers in the public or nonprofit sector by the Encore Fellows; and</text></subparagraph> 
<subparagraph id="HA03353857BF4440BBED9B630BAE9C5D2"><enum>(D)</enum><text>place the Encore Fellows in professional positions with employers that will serve as sponsoring organizations for the programs, that meet the requirements of subsection (f)(1).</text></subparagraph></paragraph> 
<paragraph id="H126F18825745433A992915F1C789C34"><enum>(3)</enum><header>Permissible subgrants</header><text>The entities may carry out the programs directly or through subgrants to other eligible entities.</text></paragraph></subsection> 
<subsection id="H0C1E6DFD37AF40E8B721B4671C618B58"><enum>(c)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall—</text> 
<paragraph id="H11756C7EC660402EB0A9A67859BC32BB"><enum>(1)</enum><text>be a State Commission, or national nonprofit organization, with demonstrated experience in establishing and carrying out a project to recruit, train, and place participants or volunteers, and that is qualified to receive assistance under section 121;</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H7EB8CFD3493443D4A717F900F629D48"><enum>(2)</enum><text>demonstrate the ability to disseminate information about the Encore Fellowship Program that promotes the concept of mid-life transitions to public or nonprofit sector work;</text></paragraph> 
<paragraph id="H3FBB51FE5B4F46BEBC202620E69CAD6"><enum>(3)</enum><text>demonstrate the expertise and capacity to provide meaningful management and leadership training opportunities; and</text></paragraph> 
<paragraph id="H3E9519B14BEA41288887D693F501F503"><enum>(4)</enum><text>demonstrate knowledge of public or nonprofit sector professional needs and capacity to help meet the needs through an Encore Fellowship Program.</text></paragraph></subsection> 
<subsection id="HC72DFF88587245E7B71C218B53FA7583"><enum>(d)</enum><header>Application</header><text>To be eligible to receive a grant under this section, an entity shall submit an application to the Corporation at such time, in such manner, and containing such information as the Corporation may require.</text></subsection> 
<subsection id="H4D97ED7CC14A40B1A29B4BEF41C6B42D"><enum>(e)</enum><header>Use of funds</header><text>An entity that receives a grant (or, as applicable, a subgrant) under this section may use the assistance made available through the grant (or subgrant) to assist with the activities described in subsection (b)(2). The entity may use the assistance for the allowances described in subsection (g).</text></subsection> 
<subsection id="H6A140617DE214190B1E9AB8758ECCE76"><enum>(f)</enum><header>Selection criteria</header> 
<paragraph id="H28947EEE3B444D67BAA92FFE65883ECC"><enum>(1)</enum><header>Sponsoring organization</header><text>The recipient of a grant under subsection (b) shall develop criteria for the selection of sponsoring organizations, who shall—</text> 
<subparagraph id="HAB0D541D2B9F40EF8B7956A61B73F6E4"><enum>(A)</enum><text>be public agencies or private nonprofit organizations;</text></subparagraph> 
<subparagraph id="HB7449FAF3CCC40F0997B34CA316D54C8"><enum>(B)</enum><text>be engaged in meeting unmet human, educational, environmental, or public safety needs;</text></subparagraph> 
<subparagraph id="H6AB2F11BDF314FC200B25000A57C1D9D"><enum>(C)</enum><text>demonstrate need and capacity for the professional skills of Encore Fellows;</text></subparagraph> 
<subparagraph id="H7B1E8BAE213F49298FFCC202CFEBC4CC"><enum>(D)</enum><text>agree to sponsor Encore Fellows in full-time professional positions for a period of not less than 9 months and not more than 1 year;</text></subparagraph> 
<subparagraph id="H259F06BCD9264158945996A8B278386"><enum>(E)</enum><text>demonstrate experience in establishing and implementing, or detailed plans to begin establishing and implementing, meaningful professional development opportunities; and</text></subparagraph> 
<subparagraph id="H0CDAA98C96264147909479B8F5073B48"><enum>(F)</enum><text>agree to collaborate on, and participate in, the provision of specialized preplacement training and additional training for the participants, and provision of other activities designed to foster transitions to second careers in the public or nonprofit sector by participants.</text></subparagraph></paragraph> 
<paragraph id="H5439E976948B45A7B400C19CA03CABEF"><enum>(2)</enum><header>Participants</header><text>The recipient of a grant under subsection (b) shall develop criteria for the selection of participants, who shall—</text> 
<subparagraph id="H64BD58799B6642D691C1D4A8CC76A76E"><enum>(A)</enum><text>be individuals age 50 or older;</text></subparagraph> 
<subparagraph id="H262416D392AF4CE18851EC7C97ED6B0"><enum>(B)</enum><text>intend to engage in work that meets unmet human, educational, environmental, or public safety needs upon completion of their fellowships;</text></subparagraph> 
<subparagraph id="HD5FADFD94DB84856A5DFB28300A060EB"><enum>(C)</enum><text>demonstrate professional qualifications or experience; and</text></subparagraph> 
<subparagraph id="H18EF34AB48BB4D6F9FE9D4E9FA4E6FB3"><enum>(D)</enum><text>agree to participate in the Encore Fellowship Program involved on a full-time basis for not less than 9 months and not more than 1 year.</text></subparagraph></paragraph></subsection> 
<subsection id="HA8A0F2FC6D7449238ED1C3D48D55069"><enum>(g)</enum><header>Provision of living allowance and related matters</header> 
<paragraph id="HE659F094C4DD45A1A9B6CEE6F1FC84CE"><enum>(1)</enum><header>Living allowance</header><text>An entity that receives a grant (or, as applicable, a subgrant) under this section for an Encore Fellowship Program shall provide to each Encore Fellow in the program a living allowance for a fiscal year in an amount equal to 200 percent of the average subsistence allowance provided to VISTA volunteers under section 105 of the Domestic Volunteer Service Act of 1973 (42 U.S.C. 4955) for that fiscal year.</text></paragraph> 
<paragraph id="H218C587D7A9D4CBDA2D226E6E2AC5B69"><enum>(2)</enum><header>Permissible salary and benefits</header> 
<subparagraph id="HE084DC7648054DBD9936BC51D3422100"><enum>(A)</enum><header>In general</header><text>An Encore Fellow may receive a salary in excess of the maximum living allowance authorized in paragraph (1), and employment benefits, subject to subparagraph (B).</text></subparagraph> 
<subparagraph id="H564F3DF9D049454BB8879733E8FF7CAB"><enum>(B)</enum><header>Provision by sponsoring organization</header><text>The sponsoring organization shall pay 100 percent of the amount of the salary that exceeds the amount of the maximum living allowance, and 100 percent of the cost of the benefits.</text></subparagraph></paragraph> 
<paragraph id="H2FBF49F93C664E7C95DA43F20971B447"><enum>(3)</enum><header>Ineligibility for national service educational award</header><text>An Encore Fellow shall be ineligible for a national service education award under subtitle D.</text></paragraph></subsection> 
<subsection id="H58B1FDD590CE4D08B413D5CAF3C4DA02"><enum>(h)</enum><header>Matching funds requirements</header><text>The Federal share of the cost of carrying out an Encore Fellowship Program that receives assistance under this section, whether the assistance is provided directly or as a subgrant from the original recipient of the assistance, may not exceed 70 percent of such cost. The provisions of section 121(e)(2) shall apply to the program, for purpose of providing for the remaining share of the cost.</text></subsection> 
<subsection id="HAFC9EE547FA44A13980043C7480012F5"><enum>(i)</enum><header>Limit on administrative cost</header><text>Not more than 6 percent of the amount of assistance provided to the recipient of a grant (or subgrant) under this section for a fiscal year may be used to pay for administrative costs incurred by—</text> 
<paragraph id="H063CDBE009204BF9BCC8E1DD2274EFFC"><enum>(1)</enum><text>the recipient of the grant (or subgrant); and</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H62287ED0A14C4D149C2FEDCC399E1632"><enum>(2)</enum><text>sponsoring organizations for Encore Fellowship Programs carried out or supported by the assistance.</text></paragraph></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H4AAF387F3A5D4FF09C70249D885CFC04"><enum>(j)</enum><header>Evaluation</header><text>The Corporation shall evaluate the programs carried out under this section, and include the results of the evaluations in the Corporation's annual report to Congress under section 172(b).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE339223A165E41C081E5EEF042FD00C"><enum>(b)</enum><header>Authorization of appropriations</header><text>Section 501(a)(2) of the National and Community Service Act of 1990 (42 U.S.C. 12681(a)(2)) is amended—</text> 
<paragraph id="HFB7804ACE31E432FBE00E8F558867BB5"><enum>(1)</enum><text>by inserting <quote>(other than section 198E)</quote> after <quote>H of title I</quote> each place it appears; and</text></paragraph>

<subsection id="HB98D80E115334EBB87745E74C74D8C64"><enum>(b)</enum><header>Eligible entities</header><text>To be eligible to receive a grant under this section, an entity shall be a public agency or private nonprofit organization with experience in administering service programs, (including the programs described in or administered under title II of the Domestic Volunteer Service Act of 1973 (42 U.S.C. 5000 et seq.)).</text></subsection> 
<subsection id="HBB4DE2D5F285447BBCDDD683000051FC"><enum>(c)</enum><header>Applications</header><text>To be eligible to receive a grant under this section, an entity shall submit to the Corporation an application at such time, in such manner, and containing such information as the Corporation may reasonably require.</text></subsection> 
<subsection id="H49A0BCF933BB4FF5B68ED52895C49424"><enum>(d)</enum><header>Criteria and priorities for grants</header><text>The Corporation shall establish criteria and priorities for awarding grants under this section.</text></subsection> 
<subsection id="H0BFD9E72D11144519500F3B533FB0975"><enum>(e)</enum><header>Requirements for scholarship</header><text>An entity that receives a grant under subsection (a) shall use the funds made available through the grant to award a scholarship described in subsection (a) to recipients, each of whom—</text> 
<paragraph id="H6CC592E85D12491A851F735141B93B63"><enum>(1)</enum><text>is, or has been designated for the scholarship by, a volunteer who—</text> 
<subparagraph id="H7058662EC16A456FA4E99DE157007800"><enum>(A)</enum><text>has performed not less than 500 hours of volunteer service, of a type specified by the Corporation under subsection (f)(1), during a 12-month period that is—</text> 
<clause id="HF071DCCA8176441B9291D1AB14DFB1E9"><enum>(i)</enum><text>after the volunteer at issue has attained age 55; and</text></clause> 
<clause id="H574FA39BE62248AE9183680076BAA57B"><enum>(ii)</enum><text>after the date of the enactment of this section; or</text></clause></subparagraph> 
<subparagraph id="H45103079EB8A4AA698551C10BCFF7E9"><enum>(B)</enum><text>has performed not less than 250 hours but less than 500 hours of volunteer service of that type during such a 12-month period, based on compelling personal circumstances; and</text></subparagraph></paragraph> 
<paragraph id="H5549FAF270FA4634002BCC31EF509A2"><enum>(2)</enum><text>has received, during the 5-year period preceding the date that the scholarship is awarded, fewer than 2 scholarships under this section.</text></paragraph></subsection> 
<subsection id="H73DF0FB8204E4136BCFA4FF1F190D154"><enum>(f)</enum><header>Services, criteria, and priorities for scholarships</header><text>The Corporation shall—</text> 
<paragraph id="H7082CFC4D5AF4075BA8BF7D1689E9CAA"><enum>(1)</enum><text>specify the types of volunteer service a volunteer may engage in to meet term of service requirements for a scholarship under this section, which shall include—</text> 
<subparagraph id="HDCC338C6B1774DC0ADF5452C427EBADF"><enum>(A)</enum><text>tutoring or mentoring in a school, after-school program, or other community-based educational setting; and</text></subparagraph> 
<subparagraph id="HF5BE7527091643F98106EBA7600AE79"><enum>(B)</enum><text>assisting persons with special needs, including persons who are homebound, to continue living independently; and</text></subparagraph></paragraph> 
<paragraph id="H80EF2F094FC34065A2B1698EFCD0157E"><enum>(2)</enum><text>establish criteria and priorities for eligible entities to use in awarding scholarships under this section.</text></paragraph></subsection> 
<subsection id="H3FE4A1C1DDBB479EA100AF4FE3ED75D4"><enum>(g)</enum><header>Amount of scholarship</header><text>The entities shall award the scholarships—</text> 
<paragraph id="H877B7C3437704ED0BC51FD371F8BB00"><enum>(1)</enum><text>in an amount of not more than $1,000; or</text></paragraph> 
<paragraph id="HA82F649E05E7483085E94F086C797684"><enum>(2)</enum><text>in a amount that is prorated based on the individual's hours of service, for an individual who meets the requirements of subsection (e) with a term of service described in subsection (e)(1)(B).</text></paragraph></subsection> 
<subsection id="HA5864402DFDF4147ABCA4FD7CE24A160"><enum>(h)</enum><header>Use of scholarships</header><text>A scholarship awarded under this section may be used—</text> 
<paragraph id="H1B1DCBF5B4C04555B43FFDA92CB24F"><enum>(1)</enum><text>by the volunteer or the person designated by the volunteer, in accordance with subsection (e);</text></paragraph> 
<paragraph id="H87A3C8DD26E142F18BEEE8EEA64F1CD"><enum>(2)</enum><text>only for qualified tuition and related expenses, as defined in section 117 of the Internal Revenue Code of 1986, and only under such conditions as are set forth by the Corporation through regulation; and</text></paragraph> 
<paragraph id="HFEFAD75C33584B80BD4BB79541D19821"><enum>(3)</enum><text>not later than 20 years after the date of the award of the scholarship, to allow time for <quote>an individual</quote> designated under subsection (e)(1) to use the scholarship.</text></paragraph></subsection> 
<subsection id="H86B80991BD4747FB83B2AE2D59F77C81"><enum>(i)</enum><header>Authorization of appropriations</header><text>Of the funds appropriated to carry out this section—</text> 
<paragraph id="H439688265FE049209467AF4EFD001C1D"><enum>(1)</enum><text>not more than 15 percent shall be used for administrative purposes by the Corporation;</text></paragraph> 
<paragraph id="H40BBF7BF3DEB45E9AD60B9C26B4DA07D"><enum>(2)</enum><text>not less than 50 percent shall be made available for grants under subsection (a) and used to award scholarships to volunteers who have met the term of service requirements for the scholarships by providing tutoring or mentoring described in subsection (f)(1)(A);</text></paragraph> 
<paragraph id="HA5DC5B8F4239412387AFCB88E603CC73"><enum>(3)</enum><text>not less than 10 percent shall be made available for such grants and used to award scholarships to volunteers who have met the requirements by providing assistance described in subsection (f)(1)(B); and</text></paragraph> 
<paragraph id="H6439E71C092D4ADF006D2F63DDD2B8F3"><enum>(4)</enum><text>not more than 10 percent shall be made available for such grants and used for administrative purposes by the eligible entities receiving the grants.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>
