		<section id="H8D408B6A4008427DA0F3D1FD93B57C46" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Honest FHA Originator Act of
			 2009</short-title></quote>.</text>
		</section><section display-inline="no-display-inline" id="H82830CEA4BDF49C2A0A71921BE6116E5" section-type="subsequent-section"><enum>2.</enum><header>Requirements for
			 FHA-approved mortgagees</header>
			<subsection id="H144CC43AC56142FA9AE772D133FA61F0"><enum>(a)</enum><header>Mortgagee review
			 board</header><text display-inline="yes-display-inline">Paragraph (2) of
			 section 202(c) of the National Housing Act (12 U.S.C. 1708(c)) is
			 amended—</text>
				<paragraph id="HAFABA7BC6D1042E78E35606B82B83804"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (E), by inserting
			 <quote>and</quote> after the semicolon;</text>
				</paragraph><paragraph id="H560D690F1DD74AF0967D24D216EBA791"><enum>(2)</enum><text>in subparagraph
			 (F), by striking <quote>; and</quote> and inserting a period; and</text>
				</paragraph><paragraph id="HD60EA56767EA4CB7849473A22D3DEA59"><enum>(3)</enum><text>by striking
			 subparagraph (G).</text>
				</paragraph></subsection><subsection id="H9D33A8E46632454CAC5753FBF64EF8CC"><enum>(b)</enum><header>Limitations on
			 participation and mortgagee approval and use of name</header><text display-inline="yes-display-inline">Section 202 of the National Housing Act (12
			 U.S.C. 1708) is amended—</text>
				<paragraph id="H0736D7A37E174EA8873FCA880B913DAF"><enum>(1)</enum><text>by redesignating
			 subsections (d), (e), and (f) as subsections (e), (f), and (g),
			 respectively;</text>
				</paragraph><paragraph id="H3F272AE45CBB4D27A6623B56BC550BF6"><enum>(2)</enum><text>by inserting after
			 subsection (c) the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="HA27A1B1188394DF582D96AF717A67242" style="OLC">
						<subsection id="HF8EDAA8B61F44F8F9E395760254694AE"><enum>(d)</enum><header>Limitations on
				participation in origination and mortgagee approval</header>
							<paragraph id="H2A61E3CC77044DD18F07991DA61F7693"><enum>(1)</enum><header>Requirement</header><text display-inline="yes-display-inline">Any person or entity that is not approved
				by the Secretary to serve as a mortgagee, as such term is defined in subsection
				(c)(7), shall not participate in the origination of an FHA-insured loan except
				as authorized by the Secretary.</text>
							</paragraph><paragraph id="H65B609E56387401F9203A03738D550EF"><enum>(2)</enum><header>Eligibility for
				approval</header><text display-inline="yes-display-inline">In order to be
				eligible for approval by the Secretary, an applicant mortgagee shall not be,
				and shall not have any officer, partner, director, principal, or employee of
				the applicant mortgagee who is—</text>
								<subparagraph id="H175997B188AD4D4D8C77D2C0A4A3FEE3"><enum>(A)</enum><text>currently
				suspended, debarred, under a limited denial of participation (LDP), or
				otherwise restricted under part 24 or 25 of title 24 of the Code of Federal
				Regulations, or any successor regulations to such parts, or under similar
				provisions of any other Federal agency;</text>
								</subparagraph><subparagraph id="HB07C4A84C17347AFBA6FCB66DF2E55C8"><enum>(B)</enum><text>under indictment
				for, or has been convicted of, an offense that reflects adversely upon the
				applicant’s integrity, competence or fitness to meet the responsibilities of an
				approved mortgagee;</text>
								</subparagraph><subparagraph id="H0CE825FAE08F44D9B6A8690D01E8D379"><enum>(C)</enum><text>subject to
				unresolved findings contained in a Department of Housing and Urban Development
				or other governmental audit, investigation, or review;</text>
								</subparagraph><subparagraph id="HDD3FD230ABE943879CE1F2F854D7EB84"><enum>(D)</enum><text>engaged in
				business practices that do not conform to generally accepted practices of
				prudent mortgagees or that demonstrate irresponsibility;</text>
								</subparagraph><subparagraph id="HF1B26B278E02448CA27B7054254BE1C4"><enum>(E)</enum><text>convicted of, or
				who has pled guilty or nolo contendre to, a felony related to participation in
				the real estate or mortgage loan industry—</text>
									<clause id="H4F7FBAAD5F8643AEA22FF297E7B57013"><enum>(i)</enum><text>during the 7-year
				period preceding the date of the application for licensing and registration;
				or</text>
									</clause><clause id="HB6D0271178E64B4A9D8AD1A62CE67E3D"><enum>(ii)</enum><text>at any time
				preceding such date of application, if such felony involved an act of fraud,
				dishonesty, or a breach of trust, or money laundering;</text>
									</clause></subparagraph><subparagraph id="HD9A5018C07F347E3A369F5D97DEF6192"><enum>(F)</enum><text>in violation of
				provisions of the S.A.F.E. Mortgage Licensing Act of 2008 (12 U.S.C. 5101 et
				seq.) or any applicable provision of State law; or</text>
								</subparagraph><subparagraph id="HCF3FD60E03774ADAB418072851784DBF"><enum>(G)</enum><text>in violation of
				any other requirement as established by the
				Secretary.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H38416283CE9D444589350CFB3F6F6068"><enum>(3)</enum><text>by adding at the
			 end the following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="H5FEA8E05068B43BFB46632CF5E2FA1E1" style="OLC">
						<subsection id="H8D91768E92F54492BCCAC27190DEE2F3"><enum>(h)</enum><header>Use of
				name</header><text display-inline="yes-display-inline">The Secretary shall, by
				regulation, require each mortgagee approved by the Secretary for participation
				in the FHA mortgage insurance programs of the Secretary—</text>
							<paragraph id="H4174543A3C2F44C5B93ACCF9A422D273"><enum>(1)</enum><text>to use the
				business name of the mortgagee that is registered with the Secretary in
				connection with such approval in all advertisements and promotional materials,
				as such terms are defined by the Secretary, relating to the business of such
				mortgagee in such mortgage insurance programs; and</text>
							</paragraph><paragraph id="H8DAAABC4A45047F284C5970A44C43671"><enum>(2)</enum><text>to maintain copies
				of all such advertisements and promotional materials, in such form and for such
				period as the Secretary
				requires.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H2654B4A0754943878F1DD1AAD4EB5FF8"><enum>(c)</enum><header>Change of
			 status</header><text>The National Housing Act is amended by striking section
			 532 (12 U.S.C. 1735f–10) and inserting the following new section:</text>
				<quoted-block display-inline="no-display-inline" id="H9951AEDD71C54F73A260C3D4BB5B66FC" style="OLC">
					<section id="HD05B719703F94F81B1DDF1BD7BBB346B"><enum>532.</enum><header>Change of
				mortgagee status</header>
						<subsection id="HCD07D493C6694257B80BCC71B060C08C"><enum>(a)</enum><header>Notification</header><text display-inline="yes-display-inline">Upon the occurrence of any action described
				in subsection (b), an approved mortgagee shall immediately submit to the
				Secretary, in writing, notification of such occurrence.</text>
						</subsection><subsection id="H0658E6E69CBD4264915C49A44047D802"><enum>(b)</enum><header>Actions</header><text display-inline="yes-display-inline">The actions described in this subsection
				are as follows:</text>
							<paragraph id="HD0BCBF5F59D341ACB0F1CC1FFA35C460"><enum>(1)</enum><text>The debarment,
				suspension of a Limited Denial of Participation (LDP), or application of other
				sanctions, fines, or penalties applied to the mortgagee or to any officer,
				partner, director, principal, manager, supervisor, loan processor, loan
				underwriter, or loan originator of the mortgagee pursuant to applicable
				provisions of State or Federal law.</text>
							</paragraph><paragraph id="H12546EE32B9A4188B88A2C2745FF1E93"><enum>(2)</enum><text>The revocation of
				a State-issued mortgage loan originator license issued pursuant to the S.A.F.E.
				Mortgage Licensing Act of 2008 (12 U.S.C. 5101 et seq.) or any other similar
				declaration of ineligibility pursuant to State
				law.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H74AD35B50AF64DD893B8A4753BBE42F4"><enum>(d)</enum><header>Civil money
			 penalties</header><text display-inline="yes-display-inline">Section 536 of the
			 National Housing Act (12 U.S.C. 1735f–14) is amended—</text>
				<paragraph id="H2E80DA4376B741FCB8D20D75D6167784"><enum>(1)</enum><text>in subsection
			 (b)—</text>
					<subparagraph id="HD59ACD4485604A768AF4B6D813E185D4"><enum>(A)</enum><text>in paragraph
			 (1)—</text>
						<clause id="H30B0717FFC254C398C553CF2078F72DC"><enum>(i)</enum><text>in
			 the matter preceding subparagraph (A), by inserting <quote>or any of its
			 owners, officers, or directors</quote> after <quote>mortgagee or
			 lender</quote>;</text>
						</clause><clause id="H2DBCE9EACCEA40EF83DC4421C5CA1363"><enum>(ii)</enum><text>in
			 subparagraph (H), by striking <quote>title I</quote> and all that follows
			 through <quote>Act of 1989)</quote> and inserting “title I or II”; and</text>
						</clause><clause id="H5186BCF0BAEA42DD85E8D2C24126B6FB"><enum>(iii)</enum><text>by
			 inserting after subparagraph (J) the following:</text>
							<quoted-block display-inline="no-display-inline" id="HDB0FF219652A442183FD0E2EC0BA214C" style="OLC">
								<subparagraph id="HEEA6359EC9324B0E9A1E315670648FBA"><enum>(K)</enum><text display-inline="yes-display-inline">Violation of section 202(d) of this Act (12
				U.S.C. 1708(d)).</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="HE60EDC06CF304C7FA2E629FBCCECA2FD"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause id="HE80B270037E04E61A66A54BF3FC847F4"><enum>(i)</enum><text>in
			 subparagraph (B), by striking <quote>or</quote> at the end;</text>
						</clause><clause id="H2531CE1794424FA097C5894B7E9085BF"><enum>(ii)</enum><text>in
			 subparagraph (C), by striking the period at the end and inserting <quote>;
			 or</quote>; and</text>
						</clause><clause id="H9027CD0A9947404D95FB63469428D568"><enum>(iii)</enum><text>by
			 adding at the end the following new subparagraph:</text>
							<quoted-block display-inline="no-display-inline" id="H99BD05041AEF4DF3B2E378C88189A2FB" style="OLC">
								<subparagraph id="H60B84EADA091491D967524B489F6B9AE"><enum>(D)</enum><text display-inline="yes-display-inline">causing or participating in any of the
				violations set forth in paragraph (1) of this
				subsection.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph id="H6E6355553F954DB2A454206E45EE3FBE"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (g), by striking <quote>The
			 term</quote> and all that follows through the end of the sentence and inserting
			 <quote>For purposes of this section, a person acts knowingly when a person has
			 actual knowledge of acts or should have known of the acts.</quote>.</text>
				</paragraph></subsection><subsection id="H5E5B3CA120734EDD922E1A0E3D98F6A7"><enum>(e)</enum><header>Expanded review
			 of FHA mortgagee applicants and newly approved mortgagees</header><text>Not
			 later than the expiration of the 3-month period beginning upon the date of the
			 enactment of this Act, the Secretary of Housing and Urban Development
			 shall—</text>
				<paragraph id="H304B2283CC3F487DB5693D96E231B96D"><enum>(1)</enum><text>expand the
			 existing process for reviewing new applicants for approval for participation in
			 the mortgage insurance programs of the Secretary for mortgages on 1- to
			 4-family residences for the purpose of identifying applicants who represent a
			 high risk to the Mutual Mortgage Insurance Fund; and</text>
				</paragraph><paragraph id="H4627C09831CD410396D24C73A077F085"><enum>(2)</enum><text display-inline="yes-display-inline">implement procedures that, for mortgagees
			 approved during the 12-month period ending upon such date of enactment—</text>
					<subparagraph id="HF3E8124D26D247348AE192335AEAFEFD"><enum>(A)</enum><text>expand the number
			 of mortgages originated by such mortgagees that are reviewed for compliance
			 with applicable laws, regulations, and policies; and</text>
					</subparagraph><subparagraph id="HF6E1626E7B47413889690B3731EF36FB"><enum>(B)</enum><text>include a process
			 for random reviews of such mortgagees and a process for reviews that is based
			 on volume of mortgages originated by such mortgagees.</text>
					</subparagraph></paragraph></subsection></section></legis-body>
