		<section commented="no" display-inline="no-display-inline" id="H22BF2A5320BB4162BF41B9F642659ACE" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Preventing Harassment through Outbound
			 Number Enforcement Act of 2009</short-title></quote> or the <quote><short-title>PHONE Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HA7E332B53862402C9B1E7F7A377C33D7" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Caller ID spoofing</header>
			<subsection commented="no" display-inline="no-display-inline" id="H5D930589DFDF48A9AD00EC7F60B48E98"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 47 of title 18, United States Code,
			 is amended by adding at the end the following:</text>
				<quoted-block committee-id="HJU00" display-inline="no-display-inline" id="H22B4152AC8BC4F44AD555F63F306C9AE" style="USC">
					<section commented="no" display-inline="no-display-inline" id="H3EE79A9EAC0049B794C96228FA1E7A9B" section-type="subsequent-section"><enum>1041.</enum><header display-inline="yes-display-inline">Caller ID spoofing</header>
						<subsection commented="no" display-inline="no-display-inline" id="HA2B853C1BE694893ABB0F259B8FC6FAC"><enum>(a)</enum><header display-inline="yes-display-inline">Offense</header><text display-inline="yes-display-inline">Whoever, in or affecting interstate or
				foreign commerce, knowingly uses or provides to another—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HE01F60681AF248588CD4E44582E6385F"><enum>(1)</enum><text display-inline="yes-display-inline">false caller ID information with intent
				wrongfully to obtain anything of value; or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HABA901CA93E64C53B913D7722F509D9E"><enum>(2)</enum><text display-inline="yes-display-inline">caller ID information pertaining to an
				actual person or other entity without that person’s or entity’s consent and
				with intent to deceive any person or other entity about the identity of the
				caller;</text>
							</paragraph><continuation-text commented="no" continuation-text-level="subsection">shall be punished as provided in
				subsection (b).</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="H10FEE16E55C945038BBE68E5C14ADE5C"><enum>(b)</enum><header display-inline="yes-display-inline">Punishment</header><text display-inline="yes-display-inline">Whoever violates subsection (a)
				shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="H0C4C3EB61F76427A8E92B0EF1301BCFC"><enum>(1)</enum><text display-inline="yes-display-inline">if the offense is a violation of subsection
				(a)(1), be fined under this title or imprisoned not more than 5 years, or both;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H73B14311EE0F46C58C27DA9E4F551712"><enum>(2)</enum><text display-inline="yes-display-inline">if the offense is a violation of subsection
				(a)(2), be fined under this title or imprisoned not more than one year, or
				both.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7ECD9F29BA8048DD9E41773DE7DFC82E"><enum>(c)</enum><header display-inline="yes-display-inline">Law enforcement exception</header><text display-inline="yes-display-inline">This section does not prohibit lawfully
				authorized investigative, protective, or intelligence activity of a law
				enforcement agency of the United States, a State, or a political subdivision of
				a State, or of an intelligence agency of the United States, or any activity
				authorized under chapter 224 of this title.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H1353CB1B1E2944A3B1EE4538B34B4160"><enum>(d)</enum><header display-inline="yes-display-inline">Forfeiture</header>
							<paragraph commented="no" display-inline="no-display-inline" id="H264C98869E674210B7F17DE038BEDFE4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The court, in imposing sentence on a person
				who is convicted of an offense under this section, shall order that the
				defendant forfeit to the United States—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H6C3C4148BE4B4112B37CF01DE33552EE"><enum>(A)</enum><text display-inline="yes-display-inline">any property, real or personal,
				constituting or traceable to gross proceeds obtained from such offense;
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HC4B63F206AD8478F93DC1BBF6A1BD48F"><enum>(B)</enum><text display-inline="yes-display-inline">any equipment, software or other technology
				used or intended to be used to commit or to facilitate the commission of such
				offense.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H07D75B0C77874B70ADC02E136D026301"><enum>(2)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">The procedures set forth in section 413 of
				the Controlled Substances Act (21 U.S.C. 853), other than subsection (d) of
				that section, and in Rule 32.2 of the Federal Rules of Criminal Procedure,
				shall apply to all stages of a criminal forfeiture proceeding under this
				section.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H40FD97BAA4414EFBBB580EA7AC302CC2"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HDED657A073AA421A8D56430DB33EA77A"><enum>(1)</enum><text display-inline="yes-display-inline">the term <quote>caller ID
				information</quote> means any identifying information regarding the origination
				of a telephone call, including the name or the telephone number of the caller,
				that is transmitted with the telephone call;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE938BE9429B24467A3CCA2E3D2AAD5EC"><enum>(2)</enum><text display-inline="yes-display-inline">the term <quote>telephone call</quote>
				means a call made or received using any real time voice communications service,
				regardless of the technology or network used; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H971D43BC863D4A8F9E4C535637B4B875"><enum>(3)</enum><text display-inline="yes-display-inline">the term <quote>State</quote> includes a
				State of the United States, the District of Columbia, and any commonwealth,
				territory, or possession of the United
				States.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HF7119908DD8847C8824C6477AEE572E6"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 47 of title 18, United States Code, is amended by adding at the end the
			 following new item:</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="H182E66112CD44FD2980F54D5AE06C372" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Other specified unlawful activities for
			 money laundering</header><text display-inline="no-display-inline">Section
			 1956(c)(7)(D) of title 18, United States Code, is amended by inserting
			 <quote>section 1037 (relating to fraud and related activity in connection with
			 electronic mail), section 1041 (relating to caller ID spoofing),</quote> before
			 <quote>section 1111</quote>.</text>
