		  provide for the enforcement through the Office of Special Counsel of the
		  employment and reemployment rights of veterans and members of the Armed Forces
		  employed by Federal executive agencies, and for other

		<section id="H12F7CEE9770A4ADCA3266B1861B60B24" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Veterans Employment Rights Realignment
			 Act of 2009</short-title></quote>.</text>
		</section><section id="H9FC9DE2737B148E1ADFA958DA791F3CD" section-type="subsequent-section"><enum>2.</enum><header>Enforcement through
			 Office of Special Counsel of veterans’ employment or reemployment rights with
			 respect to employers that are Federal executive agencies</header>
			<subsection id="HCDA9E371DCF540A8AB918EC47C1E03AF"><enum>(a)</enum><header>Enforcement of
			 rights through Office of Special Counsel</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/4322">Section 4322</external-xref> of title 38, United
			 States Code, is amended—</text>
				<paragraph id="HAFCE53F9FCD94C81A4DA987A74AC5EDF"><enum>(1)</enum><text>by striking
			 subsection (a) and inserting the following new subsection (a):</text>
					<quoted-block display-inline="no-display-inline" id="H9B1B922EDEFB44FC832CF308F433A63C" style="USC">
						<subsection id="H06F2B15ECE4348D1B5E78C26D914D620"><enum>(a)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE27D2B33DE554B79893BE951D651C639"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HA15F16F67F344EC28C5FA377F37B639E"><enum>(A)</enum><text>A person described in
				subparagraph (B) may file a complaint with the Secretary, and the Secretary
				shall investigate such complaint.</text>
								</subparagraph><subparagraph id="HA04A9F78DB8042D895EF867B219BC109" indent="up2"><enum>(B)</enum><text>A person described in this
				subparagraph is a person who claims that—</text>
									<clause id="HCA719C5B00154FE19A3519534ADCE09A"><enum>(i)</enum><text display-inline="yes-display-inline">such person is entitled under this chapter
				to employment or reemployment rights or benefits with respect to employment by
				an employer other than an employer that is a Federal executive agency;
				and</text>
									</clause><clause id="H3C267DE5196946E884E40CFC9D894CE8"><enum>(ii)</enum><text display-inline="yes-display-inline">such employer has failed or refused, or is
				about to fail or refuse, to comply with the provisions of this chapter.</text>
									</clause></subparagraph></paragraph><paragraph id="H00D13D24EB4947EEBD79208EF6036B08" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HE8D6A4F6CFD140099969F1ED8B159C36"><enum>(A)</enum><text>A person described in
				subparagraph (B) may file a complaint with the Special Counsel established by
				<external-xref legal-doc="usc" parsable-cite="usc/5/1211">section
				1211</external-xref> of title 5.</text>
								</subparagraph><subparagraph id="H2E3CC6A7E5BD41E5B95BD7090864DF66" indent="up1"><enum>(B)</enum><text>A person described in this
				subparagraph is a person who claims that—</text>
									<clause id="H9B0791542B0B4EA1910D5BF90F94780B"><enum>(i)</enum><text display-inline="yes-display-inline">such person is entitled under this chapter
				to employment or reemployment rights or benefits with respect to employment by
				an employer that is a Federal executive agency; and</text>
									</clause><clause id="H8BEA90F8A730477E93DAD19DB69C4AD4"><enum>(ii)</enum><subclause commented="no" display-inline="yes-display-inline" id="H333A5FF232FE4DADB18CC94A2CA97ADD"><enum>(I)</enum><text>such employer has failed
				or refused, or is about to fail or refuse, to comply with the provisions of
				this chapter; or</text>
										</subclause><subclause id="HAFDE6E35A7F044C3A2DE3DC310DD276E" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">such employer or the Office of Personnel
				Management has failed or refused, or is about to fail or refuse, to comply with
				the provisions of this
				chapter.</text>
										</subclause></clause></subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph id="H56B34307A14542EBB697F9AD96E8D522"><enum>(2)</enum><text>by striking
			 subsections (d) and (e) and inserting the following new subsections (d) and
			 (e):</text>
					<quoted-block display-inline="no-display-inline" id="HFE063ADEACC14737B750B26CE2964847" style="USC">
						<subsection id="H707BC407ED9440E89DAFC7C60C83234B"><enum>(d)</enum><paragraph commented="no" display-inline="yes-display-inline" id="H00A0EC80F2BA44B8B01B45BE8F116D01"><enum>(1)</enum><text display-inline="yes-display-inline">The Secretary shall investigate each
				complaint submitted pursuant to subsection (a)(1). If the Secretary determines
				as a result of the investigation that the action alleged in such complaint
				occurred, the Secretary shall attempt to resolve the complaint by making
				reasonable efforts to ensure that the person or entity named in the complaint
				complies with the provisions of this chapter.</text>
							</paragraph><paragraph id="HADE52A10598C4DDEADAB75516692F221" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the efforts of the Secretary with
				respect to any complaint filed under subsection (a)(1) do not resolve the
				complaint, the Secretary shall notify the person who submitted the complaint
				of—</text>
								<subparagraph id="H549DF8BA02A64AAC904901E0D69E3067"><enum>(A)</enum><text>the results of the Secretary’s
				investigation; and</text>
								</subparagraph><subparagraph id="H5627E31821224539AB86B69BC762312D"><enum>(B)</enum><text>the complainant’s entitlement to
				proceed under the enforcement of rights provisions provided under section
				4323.</text>
								</subparagraph></paragraph></subsection><subsection id="HF72BB00B4A2B4ADFB1AD6F0538EB6152"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE6E042467F3143689D3B4E217086D419"><enum>(1)</enum><text>In the case of a
				complaint filed under subsection (a)(2), the Special Counsel shall investigate
				the complaint. If the Special Counsel determines as a result of the
				investigation that the action alleged in such complaint occurred, the Special
				Counsel shall attempt to resolve the complaint by making reasonable efforts to
				ensure that the person or entity named in the complaint complies with the
				provisions of this chapter.</text>
							</paragraph><paragraph id="HA154597DB42B431C927FF5AB53744CD4" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">If the efforts of the Special Counsel with
				respect to any complaint filed under subsection (a)(2) do not resolve the
				complaint, the Special Counsel shall notify the person who submitted the
				complaint of—</text>
								<subparagraph id="H22CF0681154347659D3413C6D99363CE"><enum>(A)</enum><text>the results of the investigation by
				the Special Counsel; and</text>
								</subparagraph><subparagraph id="HC90D0442D9394B0E8579388E2D71A4C1"><enum>(B)</enum><text>the complainant’s entitlement to
				proceed under the enforcement of rights provisions provided under section
				4324.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="H3A0B2300FE8B4D90BF00A546381F7B51"><enum>(b)</enum><header>Technical and
			 conforming amendments</header><text>Such title is further amended—</text>
				<paragraph id="HFF64D9E333704006A4DA836ED31643B2"><enum>(1)</enum><text>in section
			 4322(b), by striking <quote>Such complaint</quote> and inserting <quote>Each
			 complaint filed under subsection (a)</quote>;</text>
				</paragraph><paragraph id="H609A1B06D21B4EABA82C75D96056C221"><enum>(2)</enum><text>in section
			 4323(a)—</text>
					<subparagraph id="HC32A0057FD654514A835B7F3C98EFAEA"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>section 4322(e)</quote> and inserting <quote>section 4322(d)(2)</quote>;
			 and</text>
					</subparagraph><subparagraph id="H0516AD98C1274D23AF403B4E9D37FADB"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (3)(A), by striking
			 <quote>section 4322(a) </quote> and inserting <quote>section
			 4322(a)(1)</quote>;</text>
					</subparagraph></paragraph><paragraph id="H326A71EE9564402B8301B38AC8F29231"><enum>(3)</enum><text>in section
			 4324—</text>
					<subparagraph commented="no" id="H02CB5AA6718444C9AE35DE4E72416942"><enum>(A)</enum><text>in subsection
			 (a)(1)—</text>

			 4325(c), by striking <quote>section 4322(d)</quote> and inserting

				</paragraph><paragraph id="HC6D86EAAEFC0415C807DD150692F0CAA"><enum>(5)</enum><text display-inline="yes-display-inline">in section 4326—</text>
					<subparagraph id="H805ABB08A9224C8AB0F352D34FFFEC51"><enum>(A)</enum><text>in subsection (a),
			 by inserting <quote>or the Special Counsel’s</quote> after
			 <quote>Secretary’s</quote>; and</text>
					</subparagraph><subparagraph id="H5435A5AA46244B8FAD5C09C9A10D5688"><enum>(B)</enum><text>by striking
			 <quote>Secretary</quote> each place it appears and inserting <quote>Secretary
			 or the Special Counsel</quote>.</text>
					</subparagraph></paragraph></subsection><subsection id="HADDBFF90C73C4977A8E65FA957D22B60"><enum>(c)</enum><header>Conforming
			 repeal</header><text display-inline="yes-display-inline">The Veterans Benefits
			 Improvement Act of 2004 (<external-xref legal-doc="public-law" parsable-cite="pl/108/454">Public Law 108–454</external-xref>) is amended by
			 striking section 204.</text>
			</subsection><subsection id="HACBE68451EA340DFB2B93F59B2474A75"><enum>(d)</enum><header>Effective
			 date</header><text>The amendments made by this section shall apply with respect
			 to complaints filed on or after the date of the enactment of this Act.</text>
