		<official-title>To amend the Internal Revenue Code of 1986 to increase
		  the deduction under section 179 for the purchase of qualified health care
		  information technology by medical care providers, and for other
		  purposes.</official-title>

		<section display-inline="no-display-inline" id="HC6F8A424BD9B4FA3A4C969121F540033" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Assisting Doctors to Obtain Proficient
			 and Transmissible Health Information Technology Act of
			 2009</short-title></quote> or the <quote><short-title>ADOPT HIT Act of 2009</short-title></quote> .</text>
		</section><section id="H0A61B1BFCAE54435A1938D0600D687E7"><enum>2.</enum><header>Purchase of
			 qualified health care information technology</header>
			<subsection id="HF5D58263E8544EC385633E007C99BF0"><enum>(a)</enum><header>In
			 general</header><text>Section 179 of the Internal Revenue Code of 1986
			 (relating to election to expense certain depreciable assets) is amended by
			 adding at the end the following new subsection:</text>
				<quoted-block display-inline="no-display-inline" id="H67D10351FCCD43C9A8A183954457B487" style="OLC">
					<subsection id="H69AA073CD0504F1692B56557AFE32B89"><enum>(f)</enum><header>Health care
				information technology</header>
						<paragraph id="HD0AAD852A27B4DFEA24B1800BF5CFA9"><enum>(1)</enum><header>In
				general</header><text>In the case of qualified health care information
				technology purchased by a medical care provider and placed in service during a
				taxable year—</text>
							<subparagraph id="HAF328C264FAC466492476CFF665DFFB0"><enum>(A)</enum><text>subsection (b)(1)
				shall be applied by substituting <quote>$250,000</quote> for
				<quote>$125,000</quote>,</text>
							</subparagraph><subparagraph id="H084FD0DB1C09408DB8AD3229E9D40275"><enum>(B)</enum><text>subsection (b)(2)
				shall be applied by substituting <quote>$600,000</quote> for
				<quote>$500,000</quote>, and</text>
							</subparagraph><subparagraph id="HC34632EE3A4D4493AF3856E91C5DD913"><enum>(C)</enum><text>subsection
				(b)(5)(A) shall be applied by substituting <quote>$250,000 and $600,000</quote>
				for <quote>$125,000 and $500,000</quote>.</text>
							</subparagraph></paragraph><paragraph id="HB729DB3E3E484A51B0C7AA17D64498F3"><enum>(2)</enum><header>Definitions</header><text>For
				purposes of this subsection—</text>
							<subparagraph id="H6C5E08A4C0894964A028E89E00C80010"><enum>(A)</enum><header>Qualified health
				care information technology</header><text display-inline="yes-display-inline">The term <term>qualified health care
				information technology</term> means section 179 property which—</text>
								<clause id="H24F49CD155234481A6E105AAE11346F5"><enum>(i)</enum><text>has been certified
				by the Secretary of Health and Human Services pursuant to section 3 of the
				<short-title>ADOPT HIT Act of 2009</short-title>,
				and</text>
								</clause><clause id="H94761342EA814AB7BA663800A77FFB2D"><enum>(ii)</enum><text>is used primarily
				for the electronic creation, maintenance, and exchange of medical care
				information to improve the quality or efficiency of medical care.</text>
								</clause></subparagraph><subparagraph id="H281C43F5195A42D3B18118367CDC4E45"><enum>(B)</enum><header>Medical care
				provider</header><text display-inline="yes-display-inline">The term
				<term>medical care provider</term> means any person engaged in the trade or
				business of providing medical care.</text>
							</subparagraph><subparagraph id="HE3B0E02F7D864188008B30C7EA61D679"><enum>(C)</enum><header>Medical
				care</header><text>The term <term>medical care</term> has the meaning given
				such term by section
				213(d).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H790D53D4646E457EB72F6C109199107E"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section shall apply to property
			 placed in service after December 31, 2008.</text>
			</subsection></section><section id="H915AC7D0B0B14413A734BD991DEFE999"><enum>3.</enum><header>Certification of
			 health care information technology</header>
			<subsection id="H1C60D62DFE26480CAFF60048169B8200"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services shall develop criteria to ensure and certify that
			 hardware, software, and support services for the electronic exchange of health
			 information meet certain standards, as determined by the Secretary.</text>
			</subsection><subsection id="H44AEF00FB4B04FFAA3EFDFC4464F8B7"><enum>(b)</enum><header>Certification
			 assistance</header><text display-inline="yes-display-inline">The Secretary of
			 Health and Human Services may recognize a private entity or entities to assist
			 in the certification described under paragraph (1) using the criteria developed
			 by the Secretary under this section.</text>
