		  stop illegal, unreported, and unregulated fishing, and for other

		<section commented="no" display-inline="no-display-inline" id="HC57C1279B5814FC2AFF3E7139495BDD1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Illegal, Unreported, and Unregulated
			 Fishing Enforcement Act of 2009</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HE38589108BB044218150D7604073D534" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Amendments to the High Seas Driftnet
			 Fishing Moratorium Protection Act</header>
			<subsection commented="no" display-inline="no-display-inline" id="HF01F76FE57A3422C9EC8FE5BB454D9F"><enum>(a)</enum><header display-inline="yes-display-inline">Administration and
			 enforcement</header><text display-inline="yes-display-inline">Section 606 of
			 the High Seas Driftnet Fishing Moratorium Protection Act (16 U.S.C. 1826g)
			 is amended by inserting before the first sentence the following:</text>
				<quoted-block display-inline="no-display-inline" id="H873BBF7B017942A0A27418B8F7FA9B9" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H687CFA3836334ADDA3E14FE19C2C7CCD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary and the Secretary of the
				department in which the Coast Guard is operating shall enforce this title, and
				the Acts to which this section applies, in accordance with this section. Each
				such Secretary may, by agreement, on a reimbursable basis or otherwise, utilize
				the personnel services, equipment (including aircraft and vessels), and
				facilities of any other Federal agency, and of any State agency, in the
				performance of such duties.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H10E00DC29E9341ACAF2FC622F2BCCE58"><enum>(b)</enum><header display-inline="yes-display-inline">Acts to which section applies</header><text display-inline="yes-display-inline">This section applies to—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H0AE7B5D016FC471799AC006B2BCE31D1"><enum>(1)</enum><text display-inline="yes-display-inline">the Pacific Salmon Treaty Act of 1985
				(16 U.S.C. 3631 et
				seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBE6A6FE086C440A3980550AF9F7E894E"><enum>(2)</enum><text display-inline="yes-display-inline">the Dolphin Protection Consumer Information
				Act (16 U.S.C.
				1385);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H65DB8011C2BB482D8D25DAED9D6C647C"><enum>(3)</enum><text display-inline="yes-display-inline">the Tuna Conventions Act of 1950
				(16 U.S.C. 951 et
				seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6987CBF0F6C445F3AE8ECB8BA7BF25BD"><enum>(4)</enum><text display-inline="yes-display-inline">the North Pacific Anadromous Stocks Act of
				1992 (16 U.S.C. 5001
				et seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF453EC7DD5204601908742ADAF38A19B"><enum>(5)</enum><text display-inline="yes-display-inline">the South Pacific Tuna Act of 1988
				(16 U.S.C. 973 et
				seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H36F7FD615F8E497D86C3AB6C4F37E1FB"><enum>(6)</enum><text display-inline="yes-display-inline">the Antarctic Marine Living Resources
				Convention Act of 1984 (16 U.S.C. 2431 et seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H22A26DADCA274984B744AB0773324D39"><enum>(7)</enum><text display-inline="yes-display-inline">the Atlantic Tunas Convention Act of 1975
				(16 U.S.C. 971 et
				seq.);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE8EA9CB3FE974D20B4F42BA3F748FF61"><enum>(8)</enum><text display-inline="yes-display-inline">the Northwest Atlantic Fisheries Convention
				Act of 1995 (16
				U.S.C. 5601 et seq.); and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2B44481FB1C8483CB7B6A2A0E648F100"><enum>(9)</enum><text display-inline="yes-display-inline">the Western and Central Pacific Fisheries
				Convention Implementation Act (16 U.S.C. 6901 et seq.).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HBAE3E1C7ADFC4228B41DC0AF23119C82"><enum>(c)</enum><header display-inline="yes-display-inline">Administration and
				enforcement</header><text display-inline="yes-display-inline">The Secretary
				shall prevent any person from violating this title, or any Act to which this
				section applies, in the same manner, by the same means, and with the same
				jurisdiction, powers, and duties as though sections 308 through 311 of the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1858
				through 1861) were incorporated into and made a part of and applicable to this
				title and each such Act.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="H12F293938C6F4C4FB4351E8E00D14DE4"><enum>(d)</enum><header display-inline="yes-display-inline">Special rules</header>
						<paragraph commented="no" display-inline="no-display-inline" id="HF5BE94817BE8476C8303CA008CCB34FE"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding the incorporation by
				reference of certain sections of the Magnuson-Stevens Fishery Conservation and
				Management Act under subsection (c), if there is a conflict between a provision
				of this subsection and the corresponding provision of any section of the
				Magnuson-Stevens Fishery Conservation and Management Act so incorporated, the
				provision of this subsection shall apply.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H948D4881607340F0AB57BB3639F808CD"><enum>(2)</enum><header display-inline="yes-display-inline">Additional enforcement
				authority</header><text display-inline="yes-display-inline">In addition to the
				powers of officers authorized pursuant to subsection (c), any officer who is
				authorized by the Secretary, or the head of any Federal or State agency that
				has entered into an agreement with the Secretary under subsection (a), to
				enforce the provisions of any Act to which this section applies may, with the
				same jurisdiction, powers, and duties as though section 311 of the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1861)
				were incorporated into and made a part of each such Act—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="H0D98B972810D4EB4824E7093E002D24"><enum>(A)</enum><text display-inline="yes-display-inline">search or inspect any facility or
				conveyance used or employed in, or which reasonably appears to be used or
				employed in, the storage, processing, transport, or trade of fish or fish
				products;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H506B37AE79D94DE3A2B06188E6EE63D6"><enum>(B)</enum><text display-inline="yes-display-inline">inspect records pertaining to the storage,
				processing, transport, or trade of fish or fish products;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H71FA61575DFB498094FB65C54A4953F"><enum>(C)</enum><text display-inline="yes-display-inline">detain, for a period of up to 5 days, any
				shipment of fish or fish product imported into, landed on, introduced into,
				exported from, or transported within the jurisdiction of the United States, or,
				if such fish or fish product is deemed to be perishable, sell and retain the
				proceeds therefrom for a period of up to 5 days;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H7FC1B90C78D64CE999FB2581ACFBC9F5"><enum>(D)</enum><text display-inline="yes-display-inline">make an arrest, in accordance with any
				guidelines which may be issued by the Attorney General, for any offense under
				the laws of the United States committed in the person’s presence, or for the
				commission of any felony under the laws of the United States, if the person has
				reasonable grounds to believe that the person to be arrested has committed or
				is committing a felony;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HEAA485E9E0B8411A98B2B38369DD44E"><enum>(E)</enum><text display-inline="yes-display-inline">search and seize, in accordance with any
				guidelines that are issued by the Attorney General; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H3341F2621D0F4475B7A10597FAFE22"><enum>(F)</enum><text display-inline="yes-display-inline">execute and serve any subpoena, arrest
				warrant, search warrant issued in accordance with rule 41 of the Federal Rules
				of Criminal Procedure, or other warrant or civil or criminal process issued by
				any officer or court of competent jurisdiction.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAD3C1099454D4CAC9578607BF059E230"><enum>(3)</enum><header display-inline="yes-display-inline">Disclosure of enforcement
				information</header><text display-inline="yes-display-inline">The Secretary may
				disclose, as necessary and appropriate, information, including information
				collected under joint authority of the Magnuson-Stevens Fishery Conservation
				and Management Act (16 U.S.C. 1801 et seq.) and the
				Atlantic Tunas Convention Act of 1975 (16 U.S.C. 71 et seq.) or the Western
				and Central Pacific Fisheries Convention Implementation Act (16 U.S.C. 6901 et
				seq.) or other statutes implementing international fishery
				agreements, to any other Federal or State government agency, the Food and
				Agriculture Organization of the United Nations, the secretariat or equivalent
				of an international fishery management organization or arrangement made
				pursuant to an international fishery agreement, or a foreign government,
				if—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HDD4C772576104952A5BE9DCB3E7B07B4"><enum>(A)</enum><text display-inline="yes-display-inline">such government, organization, or
				arrangement has policies and procedures to protect such information from
				unintended or unauthorized disclosure; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9936CFC11074461B00CBECECE33696E"><enum>(B)</enum><text display-inline="yes-display-inline">such disclosure is necessary—</text>
								<clause commented="no" display-inline="no-display-inline" id="H0644D04650664AE990A1459D26E89123"><enum>(i)</enum><text display-inline="yes-display-inline">to ensure compliance with any law or
				regulation enforced or administered by the Secretary;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H06E8587D401746768D0655690011AEC7"><enum>(ii)</enum><text display-inline="yes-display-inline">to administer or enforce any international
				fishery agreement to which the United States is a party;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H2464496BA9E340ABB06684D600FC98F5"><enum>(iii)</enum><text display-inline="yes-display-inline">to administer or enforce a binding
				conservation measure adopted by any international organization or arrangement
				to which the United States is a party;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HC5FC647E25604F55005BB2588C12FEC4"><enum>(iv)</enum><text display-inline="yes-display-inline">to assist in any investigative, judicial,
				or administrative enforcement proceeding in the United States; or</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H36DB5C77B10D447B92B0EAB9B1F4006C"><enum>(v)</enum><text display-inline="yes-display-inline">to assist in any law enforcement action
				undertaken by a law enforcement agency of a foreign government, or in relation
				to a legal proceeding undertaken by a foreign government.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HDDF5ECE257D64701A5A261CAD331103"><enum>(e)</enum><header display-inline="yes-display-inline">Prohibited acts</header><text display-inline="yes-display-inline">It is unlawful for any person—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H3EF7644A9D534785AEF51574233E1FDE"><enum>(1)</enum><text display-inline="yes-display-inline">to violate any provision of this title or
				any regulation or permit issued pursuant to this title;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HAA25A78580684EA69DDF33A775D932C4"><enum>(2)</enum><text display-inline="yes-display-inline">to refuse to permit any officer authorized
				to enforce the provisions of this title to board, search, or inspect a vessel,
				aircraft, vehicle, or shoreside facility subject to such person’s control for
				the purposes of conducting any search, investigation, or inspection in
				connection with the enforcement of this title, any regulation promulgated under
				this title, or any Act to which this section applies;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HE1C0F9915EED44EE81676708075C6758"><enum>(3)</enum><text display-inline="yes-display-inline">to forcibly assault, resist, oppose,
				impede, intimidate, or interfere with any such authorized officer in the
				conduct of any search, investigation, or inspection described in paragraph
				(2);</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H1CEBD7DC1773412D9DCF1229EC1D2B32"><enum>(4)</enum><text display-inline="yes-display-inline">to resist a lawful arrest for any act
				prohibited by this section or any Act to which this section applies;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H03AC9A57323F4422AD8D8C7032A96EE"><enum>(5)</enum><text display-inline="yes-display-inline">to interfere with, delay, or prevent, by
				any means, the apprehension, arrest, or detection of an other person, knowing
				that such person has committed any act prohibited by this section or any Act to
				which this section applies; or</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H0D15F943069A4E899D17B8DC16D1B22E"><enum>(6)</enum><text display-inline="yes-display-inline">to forcibly assault, resist, oppose,
				impede, intimidate, sexually harass, bribe, or interfere with—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="HA2A94256F28A422A8B82E85C40171400"><enum>(A)</enum><text display-inline="yes-display-inline">any observer on a vessel under this title
				or any Act to which this section applies; or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HAA0E2EBF5C414A87812110A3EC88C118"><enum>(B)</enum><text display-inline="yes-display-inline">any data collector employed by the National
				Marine Fisheries Service or under contract to any person to carry out
				responsibilities under this title or any Act to which this section
				applies.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HEB8811E0F0544692914DF6FCB51D4825"><enum>(f)</enum><header display-inline="yes-display-inline">Civil penalty</header><text display-inline="yes-display-inline">Any person who commits any act that is
				unlawful under subsection (e) shall be liable to the United States for a civil
				penalty, and may be subject to a permit sanction, under section 308 of the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
				1858).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HD4C23710972C42D7B2BBB22BE4269CBF"><enum>(g)</enum><header display-inline="yes-display-inline">Criminal penalty</header><text display-inline="yes-display-inline">Any person who commits an act that is
				unlawful under subsection (e)(2), (e)(3), (e)(4), (e)(5), or (e)(6) is deemed
				to be guilty of an offense punishable under section 309(b) of the
				Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C.
				1859(b)).</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HC66733AB6D17451B8FE2442800198E91"><enum>(h)</enum><header display-inline="yes-display-inline">Utilization of Federal agency
				assets</header>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H7A1C94BBC5FE48F79F027F06D543DC02"><enum>(b)</enum><header display-inline="yes-display-inline">Actions To improve the effectiveness of
			 international fishery management organizations</header><text display-inline="yes-display-inline">Section 608 of such Act (16 U.S.C. 1826i)
			 is amended by—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H335FBAD6CDDD4421A8652006AB0037A4"><enum>(1)</enum><text display-inline="yes-display-inline">inserting before the first sentence the
			 following: <quote>(a) <header-in-text level="subsection" style="OLC">In
			 general.—</header-in-text></quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF82E6C5AB6F84E92B1C6A12169E12364"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a) (as designated by
			 paragraph (1) of this subsection) in the first sentence, inserting <quote>, or
			 arrangements made pursuant to an international fishery agreement,</quote> after
			 <quote>organizations</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5B97377E829E46F788F16DD8EFDB462D"><enum>(3)</enum><text display-inline="yes-display-inline">adding at the end the following new
			 subsections:</text>
					<quoted-block display-inline="no-display-inline" id="H33CAF44DD3354FD8A7FFC637229C9EB1" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="H9BE2D040875048DAB37232EB46E5C849"><enum>(b)</enum><header display-inline="yes-display-inline">Disclosure of information</header><text display-inline="yes-display-inline">The Secretary may disclose, as necessary
				and appropriate, information, including information collected under joint
				authority of the Magnuson-Stevens Fishery Conservation and Management Act
				(16 U.S.C. 1801 et
				seq.) and the Atlantic Tunas Convention Act of 1975
				(16 U.S.C. 71 et
				seq.), the Western and Central Pacific Fisheries Convention
				Implementation Act (16 U.S.C. 6901 et seq.), any other
				statute implementing an international fishery agreement, to any other Federal
				or State government agency, the Food and Agriculture Organization of the United
				Nations, or the secretariat or equivalent of an international fishery
				management organization or arrangement made pursuant to an international
				fishery agreement, if such government, organization, or arrangement,
				respectively, has policies and procedures to protect such information from
				unintended or unauthorized disclosure.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="H3581BB548B904A1E8B00F363590078F0"><enum>(c)</enum><header display-inline="yes-display-inline">IUU vessel lists</header><text display-inline="yes-display-inline">The Secretary may—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="HFC8736C15DE34BC1A79815FAF25C3029"><enum>(1)</enum><text display-inline="yes-display-inline">develop, maintain, and make public a list
				of vessels and vessel owners engaged in illegal, unreported, or unregulated
				fishing or fishing-related activities in support of illegal, unreported, or
				unregulated fishing, including vessels or vessel owners identified by an
				international fishery management organization or arrangement made pursuant to
				an international fishery agreement, that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="H6CC3E89752C145C900C93CB1CB03AEF4"><enum>(A)</enum><text display-inline="yes-display-inline">the United States is party to; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H9F3A95962E894FE39ECF81416C6B7500"><enum>(B)</enum><text display-inline="yes-display-inline">the United States is not party to, but
				whose procedures and criteria in developing and maintaining a list of such
				vessels and vessel owners are substantially similar to such procedures and
				criteria adopted pursuant to an international fishery agreement to which the
				United States is a party; and</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5F77ADCE1A754864B0BE61EB298D0012"><enum>(2)</enum><text display-inline="yes-display-inline">take appropriate action against listed
				vessels and vessel owners, including action against fish, fish parts, or fish
				products from such vessels, in accordance with applicable United States law and
				consistent with applicable international law, including principles, rights, and
				obligations established in applicable international fishery management
				agreements and trade agreements.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H7D8936E0AB2E46E58609D8195C66764B"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header><text display-inline="yes-display-inline">The Secretary may promulgate regulations to
				implement this
				section.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H03473C0B32574478B9ED7DC8FD4EC2E8"><enum>(c)</enum><header display-inline="yes-display-inline">Notification regarding identification of
			 nations</header><text display-inline="yes-display-inline">Section 609(b) of
			 such Act (166
			 U.S.C. 1826j(b)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="H00E61F2E53F7456CAD75478E8D99F144" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="H1A61E3E1BD104F44BEB10694763091E8"><enum>(b)</enum><header display-inline="yes-display-inline">Notification</header><text display-inline="yes-display-inline">The Secretary shall notify the President
				and that nation of such an
				identification.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HD498D0E657A149CEA5C26D537C3BF0D7"><enum>(d)</enum><header display-inline="yes-display-inline">Nations identified under section
			 610</header><text display-inline="yes-display-inline">Section 610(b)(1) of such
			 Act (16 U.S.C.
			 1826k(b)(1)) is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="HF73D9083E644449883C41B5BBE1834AD" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="H1F3D4322F9814942A5F272E37BDA1387"><enum>(1)</enum><text display-inline="yes-display-inline">notify, as soon as possible, the President
				and nations that have been identified under subsection (a), and also notify
				other nations whose vessels engage in fishing activities or practices described
				in subsection (a), about the provisions of this section and this
				Act;</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="HB7950EA8753F4C9AA0128840F61E854F"><enum>(e)</enum><header display-inline="yes-display-inline">Effect of certification under section
			 609</header><text display-inline="yes-display-inline">Section 609(d)(3)(A)(i)
			 of such Act (16
			 U.S.C. 1826j(d)(3)(A)(i)) is amended by striking <quote>that
			 has not been certified by the Secretary under this subsection,
			 or</quote>.</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H9FA284C6C9014F5FB8E9F3CC713DD86"><enum>(b)</enum><header display-inline="yes-display-inline">Enforcement powers</header><text display-inline="yes-display-inline">Section 11 of the Northern Pacific Halibut
			 Act of 1982 (16
			 U.S.C. 773i) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H87CBC2E78A634759822CF199375D90ED" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="HD3F57E0E76CE4CE785C2143BE40658B"><enum>(g)</enum><text display-inline="yes-display-inline">In addition to the powers of officers
				authorized pursuant to subsection (b), any officer who is authorized by the
				Secretary, or by the head of any Federal or State agency that has entered into
				an agreement with the Secretary under subsection (a), to enforce the
				Convention, this Act, or any regulation adopted under this Act, may—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="H11C0725351A54E53BE508C7C8265DAF0"><enum>(1)</enum><text display-inline="yes-display-inline">search or inspect any facility or
				conveyance used or employed in, or which reasonably appears to be used or
				employed in, the storage, processing, transport, or trade of fish or fish
				products;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H292EF464C03443AD9B05837B929DF477"><enum>(2)</enum><text display-inline="yes-display-inline">inspect records pertaining to the storage,
				processing, transport, or trade of fish or fish products; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6D65FFBDDFD8404AA35D21814C8BB677"><enum>(3)</enum><text display-inline="yes-display-inline">detain, for a period of up to 5 days, any
				shipment of fish or fish product imported into, landed on, introduced into,
				exported from, or transported within the jurisdiction of the United States, or,
				if such fish or fish product is deemed to be perishable, sell and retain the
				proceeds therefrom for a period of up to 5
				days.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="HFF555E74ACF84DCD00F9FAB3B2FEE313" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Amendments to the Northwest Atlantic
			 Fisheries Convention Act of 1995</header><text display-inline="no-display-inline">Section 207 of the Northwest Atlantic
			 Fisheries Convention Act of 1995 (16 U.S.C. 5606) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="HE432529152064AE8B2B04489588C9FF2"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking
			 <quote><header-in-text level="section" style="OLC">and
			 penalties</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">and enforcement</header-in-text></quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H8846698851584FEE9CBCE5F856329E4"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)(2), by inserting <quote>,
			 investigation,</quote> before <quote>or inspection</quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H46603D7E67C7405CB335B1509351902D"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (a)(3), by inserting <quote>,
			 investigation,</quote> before <quote>or inspection</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E6334E5DB874462AA3BBD80AFBD2960"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsections (b) through (f) and
			 inserting the following:</text>

					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HAC4784502B4C405AAAB6EC3DDA83C66" section-type="subsequent-section"><enum>16.</enum><header display-inline="yes-display-inline">Amendment to the Magnuson-Stevens Fishery
			 Conservation and Management Act</header><text display-inline="no-display-inline">Section 307(1)(Q) of the Magnuson-Stevens
			 Fishery Conservation and Management Act (16 U.S.C. 1857(1)(Q)) is amended by
			 inserting before the semicolon the following: <quote>or any treaty or in
			 contravention of any binding conservation measure adopted by an international
			 agreement or organization to which the United States is a party</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H843F17971DFE45D5819912EF89A6A9A7" section-type="subsequent-section"><enum>17.</enum><header display-inline="yes-display-inline">International cooperation and assistance
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="H0CFECA923EE049C093D2E533F00514F"><enum>(a)</enum><header display-inline="yes-display-inline">International cooperation and assistance
			 program</header><text display-inline="yes-display-inline">The Secretary of
			 Commerce, acting through the National Marine Fisheries Service, may establish
			 an international cooperation and assistance program, including grants, to
			 provide assistance for sustainable fishery management capacity building
			 efforts.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H93D9DBDE528349F394001E2B7E624851"><enum>(b)</enum><header display-inline="yes-display-inline">Authorized activities</header><text display-inline="yes-display-inline">In carrying out the program, the Secretary
			 may—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H72E58158E08D465A9594015B00B689B"><enum>(1)</enum><text display-inline="yes-display-inline">provide funding and technical expertise to
			 other nations to assist them in addressing illegal, unreported, or unregulated
			 fishing activities;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCBC10A43D8854DC8A90877C65DE3E3B4"><enum>(2)</enum><text display-inline="yes-display-inline">provide funding and technical expertise to
			 other nations to assist them in reducing the loss and environmental impacts of
			 derelict fishing gear, reducing the bycatch of living marine resources, and
			 promoting international marine resource conservation;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H9041F5910F5B405B9D15B27C002DC466"><enum>(3)</enum><text display-inline="yes-display-inline">provide funding, technical expertise, and
			 training to other nations to aid them in building capacity for enhanced
			 fisheries management, fisheries monitoring, catch and trade tracking
			 activities, enforcement, and international marine resource conservation;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H5BE0973FFD3A4D8780C096B1D87643CA"><enum>(4)</enum><text display-inline="yes-display-inline">establish partnerships with other Federal
			 agencies or non-governmental organizations, as appropriate, to ensure that
			 fisheries development assistance to other nations is directed toward projects
			 that promote sustainable fisheries; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H47CA4AE15AE542F7AB00FDE18567613F"><enum>(5)</enum><text display-inline="yes-display-inline">conduct outreach and education efforts in
			 order to promote public and private sector awareness of international fisheries
			 sustainability issues, including the need to combat illegal, unreported, or
			 unregulated fishing activity and to promote international marine resource
			 conservation.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6619910B0DC043CD87F8B44B71B100AC"><enum>(c)</enum><header display-inline="yes-display-inline">Guidelines</header><text display-inline="yes-display-inline">The Secretary may establish guidelines
			 necessary to implement the program.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H9DECEA4B77444F4A9D428CE247DEA688"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to the Secretary
			 $5,000,000<linebreak></linebreak><pagebreak></pagebreak> for each of fiscal years 2010 through 2015
			 to carry out this section.</text>
