		  from exploitation by adults using the Internet, and for other

		<section display-inline="no-display-inline" id="H4B2AAFFF3E704FC8B5E9CE27E02D09CF" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Internet Stopping Adults Facilitating
			 the Exploitation of Today’s Youth (SAFETY) Act of
			 2009</short-title></quote>.</text>
		</section><section id="HDFC610E2408949A98019D404CB5C1E"><enum>2.</enum><header>Financial
			 facilitation of access to child pornography</header>
			<subsection id="H5E7C49A4C5E14F9098132B99C3C9D2A4"><enum>(a)</enum><header>Offense</header><text>Chapter
			 95 of title 18, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H4AD56B66B30048A8B8CCC478A051F6B" style="USC">
					<section id="H5775E122BF02451D8283F08C2F1D7354"><enum>1960A.</enum><header>Financial
				facilitation of access to child pornography</header><text display-inline="no-display-inline">Whoever knowingly conducts, or attempts or
				conspires to conduct, a financial transaction (as defined in section 1956(c))
				in or affecting interstate or foreign commerce, knowing that such transaction
				will facilitate access to, or the possession of, child pornography (as defined
				in section 2256) shall be fined under this title or imprisoned not more than 20
				years, or
				both.</text>

			</subsection><subsection id="H52F942CC1FCA4F8FB426C1D773005C00"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 95 of title 18, United States Code, is
			 amended by adding at the end the following new item:</text>

			</subsection></section><section id="H636A99D974134F1DA3ED4CDE857BB2B7"><enum>3.</enum><header>Internet
			 facilitation of child pornography and exploitation of children</header>
			<subsection id="H444442AEF3484CFABF8F6949DE20811"><enum>(a)</enum><header>Offense</header><text>Chapter
			 95 of title 18, United States Code, is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="HEF9DDDDF76DE4E29BE686400A02DFD52" style="USC">
					<section id="HBC46363131BA48B582EC273CC51B7F59"><enum>1960B.</enum><header>Internet
				facilitation of child pornography and exploitation of children</header>
						<subsection id="HDF6F0341E7D5401800EFC0C8A4D80794"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever, being an Internet content hosting
				provider or email service provider, knowingly engages in any conduct the
				provider knows or has reason to believe facilitates access to, or the
				possession of, child pornography (as defined in section 2256) shall be fined
				under this title or imprisoned not more than 10 years, or both.</text>
						</subsection><subsection id="HC90BAFA910EE43C1A09BF062F4C83100"><enum>(b)</enum><header>Definitions</header><text>As
				used in this section—</text>
							<paragraph id="HFACF0E71398A400CAFCADF07F7CD538F"><enum>(1)</enum><text>the term
				<term>Internet content hosting provider</term> means a service that—</text>
								<subparagraph id="H743CD0074EC34159A475CFD534C66900"><enum>(A)</enum><text>stores, through
				electromagnetic or other means, electronic data, including the content of web
				pages, electronic mail, documents, images, audio and video files, online
				discussion boards, and weblogs; and</text>
								</subparagraph><subparagraph id="HB880E778C2B7497684ED82A3621533CA"><enum>(B)</enum><text>makes such data
				available via the Internet; and</text>
								</subparagraph></paragraph><paragraph id="HC89F731A22BC426483537300FDA58ECF"><enum>(2)</enum><text>the term
				<term>email service provider</term> means a person that—</text>
								<subparagraph id="H784E20B2DFEB4E64AF70C360F1CC3E95"><enum>(A)</enum><text>provides a
				service, using the Internet, for the transmission, receipt, storage, and
				retrieval, by registered users, of electronic mail messages; and</text>
								</subparagraph><subparagraph id="H57E8DBF8B30F45E2A2B81C80DD45E66F"><enum>(B)</enum><text>receives the
				content of, and recipient list for, electronic mail messages that it transmits,
				receives, or stores for the person or entity procuring such
				services.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HE6FF147BA3614D0000DDE002B59BA05"><enum>(b)</enum><header>Clerical
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 95 of title 18, United States Code, is
			 amended by adding at the end the following new item:</text>

			</subsection></section><section id="HC420EEA0D6634EE88E72C82B00D9A1BB"><enum>4.</enum><header>Money laundering
			 predicate</header><text display-inline="no-display-inline">Section
			 1956(c)(7)(D) of title 18, United States Code, is amended—</text>
			<paragraph id="HFF01E873B8F1490D997C60C6975657E4"><enum>(1)</enum><text>by inserting
			 <quote>1466A (relating to obscene visual representation of the abuse of
			 children),</quote> before <quote>section 1708</quote>;</text>
			</paragraph><paragraph id="H3CB4D427ABF2467D8977B6D5F7536B8B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>1960A (relating to
			 financial facilitation of access to child pornography), 1960B (relating to
			 Internet facilitation of child pornography and exploitation of
			 children),</quote> before <quote>section 2113</quote>; and</text>
			</paragraph><paragraph id="H9E1280C14EBC476D967810DF6E913EC0"><enum>(3)</enum><text>by inserting
			 <quote>2260A (relating to increased penalties for registered sex
			 offenders),</quote> before <quote>section 2280</quote>.</text>
			</paragraph></section><section id="HDFE6CD5C7E9647C4A168A66651298F58"><enum>5.</enum><header>Retention of
			 records by electronic communication service providers</header><text display-inline="no-display-inline">Section 2703 of title 18, United States
			 Code, is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HF1E4E2578A744D959866A7F0EB630042" style="USC">
				<subsection id="HA137622DC9474548A3DCD78CBDBFA0EA"><enum>(h)</enum><header>Retention of
				certain records and information</header><text>A provider of an electronic
				communication service or remote computing service shall retain for a period of
				at least two years all records or other information pertaining to the identity
				of a user of a temporarily assigned network address the service assigns to that
				user.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" id="H5F473C551CD8441BB19F21A8E9739BA4"><enum>6.</enum><header>Increased
			 penalties for sexual exploitation of children</header><text display-inline="no-display-inline">Section 2251(e) of title 18, United States
			 Code, is amended—</text>
			<paragraph commented="no" id="HC148B3BB5EE14B53B62C736400182EA3"><enum>(1)</enum><text>by striking
			 <quote>15 years nor more than 30 years</quote> and inserting <quote>20 years or
			 for life</quote>; and</text>
			</paragraph><paragraph commented="no" id="H576DDB1CB0C34CEEBC4FC333CC4AE8"><enum>(2)</enum><text>by striking
			 <quote>not less than 25 years nor more than 50 years,</quote> and all that
			 follows through <quote>not less than 30 years nor more than life.</quote> and
			 inserting <quote>life.</quote>.</text>
			</paragraph></section><section commented="no" id="H3CAB4CAEDDC742438F1CD3CAEEFC1AD"><enum>7.</enum><header>Increased
			 penalties for activities relating to material involving the sexual exploitation
			 of children</header><text display-inline="no-display-inline">Section 2252(b) of
			 title 18, United States Code, is amended—</text>
			<paragraph commented="no" id="H5F028E470BEC469C90D6D11E554F8BF"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph commented="no" id="HF610710A6D4C48E4B2129100DC259663"><enum>(A)</enum><text>by striking
			 <quote>5 years and not more than 20 years</quote> and inserting <quote>15 years
			 or for life</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="H360DD345524C4591AC66F1A697B3B5E2"><enum>(B)</enum><text>by striking
			 <quote>not less than 15 years nor more than 40 years.</quote> and inserting
			 <quote>not less than 30 years or for life.</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" id="H3B4F255A3CE247C19DED99DA53AACE98"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph commented="no" id="H3C5A341461C64D33A375D67473F79E6B"><enum>(A)</enum><text>by striking
			 <quote>or imprisoned not more than 10 years, or both</quote> and inserting
			 <quote>and imprisoned for not less than 3 years nor more than 20 years</quote>;
			 and</text>
				</subparagraph><subparagraph commented="no" id="H0341931D42E24393B6A6EC9FEADEBD30"><enum>(B)</enum><text>by striking
			 <quote>10 years nor more than 20 years.</quote> and inserting <quote>20 years
			 or for life.</quote>.</text>
				</subparagraph></paragraph></section><section commented="no" id="HDDAAC9054F13469582DC6C15D21D6D7"><enum>8.</enum><header>Increased
			 penalties for activities relating to material constituting or containing child
			 pornography</header><text display-inline="no-display-inline">Section 2252A(b)
			 of title 18, United States Code, is amended—</text>
			<paragraph commented="no" id="H715A8128C24C4557A80043CC15ADE8FB"><enum>(1)</enum><text>in paragraph
			 (1)—</text>
				<subparagraph commented="no" id="HDA8BF803B22F4BB5A7A6245296EAF540"><enum>(A)</enum><text>by striking
			 <quote>5 years and not more than 20 years</quote> and inserting <quote>15 years
			 or for life</quote>; and</text>
				</subparagraph><subparagraph commented="no" id="H0225BF68572B46AE892EE9D8B4AD65C6"><enum>(B)</enum><text>by striking
			 <quote>not less than 15 years nor more than 40 years</quote> and inserting
			 <quote>not less than 30 years or for life</quote>; and</text>
				</subparagraph></paragraph><paragraph commented="no" id="HC71C72E15BA94273806542726C846213"><enum>(2)</enum><text>in paragraph
			 (2)—</text>
				<subparagraph commented="no" id="H836D266DA97A44E89ED095A26F445B97"><enum>(A)</enum><text>by striking
			 <quote>or imprisoned not more than 10 years, or both</quote> and inserting
			 <quote>and imprisoned for not less than 3 years nor more than 20 years</quote>;
			 and</text>
				</subparagraph><subparagraph commented="no" id="HE34ECF23563C44A0AECE9E33549F1537"><enum>(B)</enum><text>by striking
			 <quote>10 years nor more than 20 years</quote> and inserting <quote>20 years or
			 for life</quote>.</text>
				</subparagraph></paragraph></section><section display-inline="no-display-inline" id="HEFF8EAAADC1945B3B9D193BD960075D3" section-type="subsequent-section"><enum>9.</enum><header>Additional RICO
			 predicates</header><text display-inline="no-display-inline">Section 1961(1) of
			 title 18, United States Code, is amended—</text>
			<paragraph id="H74DB66164AF54F60AE8B4D004B941499"><enum>(1)</enum><text>by inserting
			 <quote>section 641 (relating to embezzlement or theft of public money,
			 property, or records,</quote> after <quote>473 (relating to
			 counterfeiting),</quote>; and</text>
			</paragraph><paragraph id="H94F7F171FD72412D86A3EEA92EFCBAB5"><enum>(2)</enum><text>by inserting
			 <quote>section 666 (relating to theft or bribery concerning programs receiving
			 Federal funds),</quote> after <quote>section 664 (relating to embezzlement from
			 pension and welfare funds),</quote>.</text>
			</paragraph></section><section id="H71234788FBD947908255C7ECD30001C0"><enum>10.</enum><header>Additional
			 resources for the Innocent Images National Initiative</header>
			<subsection id="H614EB01F4C7D4F7885140053CEA157D"><enum>(a)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There are
			 authorized to be appropriated to the Director of the Federal Bureau of
			 Investigation to carry out the Innocent Images National Initiative, $30,000,000
			 for each of the fiscal years 2010 through 2014.</text>
			</subsection><subsection id="H510BF066B1384907BA43E9974E4BDB2F"><enum>(b)</enum><header>Availability</header><text>Any
			 amounts appropriated pursuant to
			 <internal-xref idref="H614EB01F4C7D4F7885140053CEA157D" legis-path="12.(a)">subsection (a)</internal-xref> shall remain available until
			 expended.</text>
