		<official-title>To amend title 38, United States Code, to expand access
		  to hospital care for veterans in major disaster areas, and for other
		  purposes.</official-title>

		<section id="H4352BF53A6C845C8AB735F2106E544B7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>RECOVER Act (Restoring Essential Care
			 for Our Veterans for Effective Recovery)</short-title></quote>.</text>
		</section><section id="H169B66D133DE41EE95F081488859A49"><enum>2.</enum><header>Provision of
			 in-patient care to veterans in major disaster areas</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/38/1703">Section 1703</external-xref> of title 38, United States
			 Code, is amended—</text>
			<paragraph id="H2C9087E38C7F49EBB18E22A066D6396"><enum>(1)</enum><text>in
			 subsection (a), by striking <quote>When Department facilities</quote> and
			 inserting <quote>Subject to subsection (e), when Department facilities</quote>;
			 and</text>
			</paragraph><paragraph id="HFE9CD75F01FA4B939D35D25B49E81BA1"><enum>(2)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HDC4BAF0C40C241A9BD12B5E2236404E9" style="OLC">
					<subsection id="H35FD69EAD8D64B3FA2C2FA53F3D77B68"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HD189DCB3A1F244C08000A09CFCAA7116"><enum>(1)</enum><text>If the Department
				medical facility that would otherwise provide covered medical services to
				veterans residing in an area for which a major disaster is declared is unable
				to provide such services for a period of at least 180 days by reason of the
				major disaster, the Secretary shall seek to enter into a contract with one or
				more non-Department facilities located in the area to provide such services to
				veterans who reside within 150 miles of the medical facility that is unable to
				provide such services.</text>
						</paragraph><paragraph id="HBEA40B123AD2477986C98F91FC68A5ED" indent="up1"><enum>(2)</enum><text>Under a contract entered into under
				paragraph (1), the non-Department facility shall provide covered medical
				services—</text>
							<subparagraph id="H76A71C2B666343688F50E0F08E02DFEA"><enum>(A)</enum><text>that would normally be provided by the
				Department medical facility that is unable to provide such services by reason
				of the major disaster; and</text>
							</subparagraph><subparagraph id="HE382E2923A654123944666A5AF076876"><enum>(B)</enum><text>for which the veteran seeking such
				services is eligible under section 1710 of this title.</text>
							</subparagraph></paragraph><paragraph id="H57B3FD81197B4C0B91E3FFA7910841C2" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Paragraph (1) shall not apply in the case
				of a Department medical facility that is closed or that the Secretary intends
				to close as part of the Capital Asset Realignment for Enhanced Services (CARES)
				process.</text>
						</paragraph><paragraph id="H5E87FE4C1A754D69B46E5CE71C5761AF" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">The Secretary shall ensure that a contract
				under paragraph (1) provides for payment by the Secretary to the non-Department
				facility. Such payment shall be—</text>
							<subparagraph id="H21C523BC296D4D1993DF211DDB6CEE31"><enum>(A)</enum><text display-inline="yes-display-inline">for covered medical services provided to a
				veteran by the non-Department facility before the date on which the Department
				medical facility referred to in paragraph (1) is able to provide such services;
				and</text>
							</subparagraph><subparagraph id="H776389E0C8EB46D9B128CDD3AC29D944"><enum>(B)</enum><text>limited to payment for such services
				for which the veteran is eligible under section 1710 of this title.</text>
							</subparagraph></paragraph><paragraph id="H9D0C6F636EBE4C91B101974FE66C5E3E" indent="up1"><enum>(5)</enum><text>Nothing in this subsection shall
				affect the eligibility of any veteran to receive hospital care or medical
				services at any Department medical facility.</text>
						</paragraph><paragraph id="HB15554E957B945CCBB696901CD00402D" indent="up1"><enum>(6)</enum><text>This subsection shall apply with
				respect to any Department medical facility that is unable to provide covered
				medical services on or after August 29, 2005, by reason of a major
				disaster.</text>
						</paragraph><paragraph id="H3BF2FC83DAB549A8B59200D38C07A3E" indent="up1"><enum>(7)</enum><text>For the purposes of this
				subsection—</text>
							<subparagraph id="HFA913E58FA71418D90DBE2AD7F5CF525"><enum>(A)</enum><text>the term <quote>covered medical
				services</quote> means—</text>
								<clause id="HAF2A58E2846246F5A5C417357DF9316E"><enum>(i)</enum><text>non-emergency hospital care
				services; and</text>
								</clause><clause id="H5BB3A9CBE64B468895B4B7D3B66B9B8"><enum>(ii)</enum><text>inpatient medical services;</text>
								</clause></subparagraph><subparagraph id="HBC37E29D1AAF4F8497F148D38F5AB23"><enum>(B)</enum><text>the term <term>inpatient medical
				services</term> means medical services provided to an inpatient of a hospital;
				and</text>
							</subparagraph><subparagraph id="H5D4A89FFF207433CB782E91094B3C24E"><enum>(C)</enum><text display-inline="yes-display-inline">the term <term>major disaster</term> means
				a major disaster declared by the President under section 401 of the Robert T.
				Stafford Disaster Relief and Emergency Assistance Act (42 U.S.C.
				5170).</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
