<legis-type>AN ACT</legis-type> 
<official-title display="yes">To transfer certain land to the United States to be held in trust for the Hoh Indian Tribe, to place land into trust for the Hoh Indian Tribe, and for other purposes.</official-title>

<section id="H020D1563971940FCA384E49FAD07C487" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Hoh Indian Tribe Safe Homelands Act</short-title></quote>.</text> </section> 
<section id="HB26E9F07E8414FE38DBAFEBAF8DF2977"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text> 
<paragraph id="H6791C6AB079F4AF8B47905A80987FA61"><enum>(1)</enum><header>Federal land</header><text>The term <quote>Federal land</quote> means the approximately 37-acre parcel of land—</text> 
<subparagraph id="HE69F0884F3D34E40966691ECB0268EA1"><enum>(A)</enum><text>administered by the National Park Service;</text></subparagraph> 
<subparagraph id="H5DE0DA083B1749259DF5B3B339060EE4"><enum>(B)</enum><text>located in sec. 20, T. 26N, R. 13W, W.M., south of the Hoh River; and</text></subparagraph> 
<subparagraph id="H0AAABF68383B4404A6795880C4508AAA"><enum>(C)</enum><text>depicted on the Map.</text></subparagraph></paragraph> 
<paragraph id="H3D270F44E0614EA09D2A675D1B3FB842"><enum>(2)</enum><header>Map</header><text>The term <quote>Map</quote> means the map entitled <quote>Hoh Indian Tribe Safe Homelands Act Land Acquisition Map</quote> and dated May 14, 2009.</text></paragraph> 
<paragraph id="HA310482D3D4447A7A114FDC607C545FD"><enum>(3)</enum><header>Non-federal land</header><text>The term <quote>non-Federal land</quote> means the approximately 434 acres of land—</text> 
<subparagraph id="HEF948707E58B4474BDCF76ABA59446F2"><enum>(A)</enum><text>owned by the Tribe; and</text></subparagraph> 
<subparagraph id="H6A9AE04C5256451FAD7118FB3FE25565"><enum>(B)</enum><text>depicted on the Map.</text></subparagraph></paragraph> 
<paragraph id="H67690B048882401EBA9A55E14F7C5974"><enum>(4)</enum><header>Secretary</header><text>The term <quote>Secretary</quote> means the Secretary of the Interior.</text></paragraph> 
<paragraph id="HB12821276BD049339EB6C857711C634B"><enum>(5)</enum><header>Tribe</header><text>The term <quote>Tribe</quote> means the Hoh Indian Tribe.</text></paragraph></section> 
<section id="H690D00F60E7445B7B63D289949DB5FCA"><enum>3.</enum><header>Land taken into trust for benefit of Tribe</header> 
<subsection id="HF966B4D39E56404384549CDC7AB1E51C"><enum>(a)</enum><header>Federal Land</header> 
<paragraph id="H4F2A89407E0A4E71B910462E9688FEF8"><enum>(1)</enum><header>In general</header><text>Effective beginning on the date of enactment of this Act—</text> 
<subparagraph id="H02DA834EEDF64FDFB3ACF247E4193FB2"><enum>(A)</enum><text>all right, title, and interest of the United States in and to the Federal land are considered to be held in trust by the United States for the benefit of the Tribe, without any action required to be taken by the Secretary; and</text></subparagraph> 
<subparagraph id="H5D7E0AF9A6304682A5CFC7853EA9810F"><enum>(B)</enum><text>the Federal land shall be excluded from the boundaries of Olympic National Park.</text></subparagraph></paragraph> 
<paragraph id="HECD452EB5D924B2CBF8805D377EBA08C"><enum>(2)</enum><header>Survey by tribe</header> 
<subparagraph id="H3B8A60E0A78A4256B719100B83989E7C"><enum>(A)</enum><header>In general</header><text>The Tribe shall—</text> 
<clause id="H7F675BD47EF6426892FAAF4CECFAF86F"><enum>(i)</enum><text>conduct a survey of the boundaries of the Federal land; and</text></clause> 
<clause id="H354DAEFC48DD47A283697B67772A0E91"><enum>(ii)</enum><text>submit the survey to the Director of the National Park Service for review and concurrence.</text></clause></subparagraph> 
<subparagraph id="HC366F4926ECA468B9B975E7252981F63"><enum>(B)</enum><header>Action by director</header><text>Not later than 90 days after the date on which the survey is submitted under subparagraph (A)(ii), the Director of the National Park Service shall—</text> 
<clause id="HCD931D6FA7134DDD816DE39CAB7E507E"><enum>(i)</enum><text>complete the review of the survey; and</text></clause> 
<clause id="HE5DB9D7B73F34BB2BDE5626363CDA7D3"><enum>(ii)</enum><text>provide to the Tribe a notice of concurrence with the survey.</text></clause></subparagraph> 
<subparagraph id="H370B3A6988F5442CAAB7849FAE8B3B73"><enum>(C)</enum><header>Availability of survey</header><text>Not later than 120 days after the date on which the notice of concurrence is provided to the Tribe under subparagraph (B)(ii), the Secretary shall—</text> 
<clause id="H1F80CBDECA71436EB86C94B7F2EFECCF"><enum>(i)</enum><text>submit a copy of the survey to the appropriate committees of Congress; and</text></clause> 
<clause id="H812F3C224A24411692B01AC9B92F3F2B"><enum>(ii)</enum><text>make the survey available for public inspection at the appropriate office of the Secretary.</text></clause></subparagraph></paragraph></subsection> 
<subsection id="H5A8C12FA070A4065B2C14791931B8561"><enum>(b)</enum><header>Non-Federal land</header> 
<paragraph id="H8DC7EDBBD4A7456AA6D20CE789032567"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">On fulfillment of each condition described in paragraph (2), and in accordance with the regulations of the Department of the Interior for implementing the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) that are applicable to trust land acquisitions for Indian tribes that are mandated by Federal legislation, the Secretary shall take the non-Federal land into trust for the benefit of the Tribe.</text></paragraph> 
<paragraph id="H838D9A39BEFD4572AE9C0B0313DA8AD6"><enum>(2)</enum><header>Conditions</header><text>The conditions referred to in paragraph (1) are that the Tribe shall—</text> 
<subparagraph id="HA78DEE617D6746618E3746B7F54CA3DB"><enum>(A)</enum><text>convey to the Secretary all right, title, and interest in and to the non-Federal land; and</text></subparagraph> 
<subparagraph id="H8DD8977302954FEF9849A9E726AF12A4"><enum>(B)</enum><text>submit to the Secretary a request to take the non-Federal land into trust for the Tribe.</text></subparagraph> </paragraph></subsection> 
<subsection id="H9674374D67EE43EAB079871DD99378FF"><enum>(c)</enum><header>Congressional intent</header><text>It is the intent of Congress that—</text> 
<paragraph id="H8DD5F332C4564C5CADB3787F4B8A8C18"><enum>(1)</enum><text>the condition of the Federal land as in existence on the date of enactment of this Act should be preserved and protected;</text></paragraph> 
<paragraph id="H3BE05C15FC2D46A3926BA3686F514CD8"><enum>(2)</enum><text>the natural environment existing on the Federal land on the date of enactment of this Act should not be altered, except as otherwise provided by this Act; and</text></paragraph> 
<paragraph id="HBE918E06CD784C9BB4671B0B3A4E083D"><enum>(3)</enum><text>the Tribe and the National Park Service shall work cooperatively regarding issues of mutual concern relating to this Act.</text></paragraph></subsection> 
<subsection id="H2ECAAEDBA700405F8EC6D59A3DCCBBA5"><enum>(d)</enum><header>Availability of map</header><text>Not later than 120 days after the survey required by subsection (a)(2)(A) has been reviewed and concurred in by the National Park Service, the Secretary shall make the Map available to the appropriate congressional committees. The Map also shall be available for public inspection at the appropriate offices of the Secretary.</text></subsection></section> 
<section id="HD00219906389459C829B31E1884CBC02"><enum>4.</enum><header>Use of Federal land by Tribe; cooperative efforts</header> 
<subsection id="HF03EB73977E64E1EA8EC76A0629D0561"><enum>(a)</enum><header>Use of Federal land by tribe</header> 
<paragraph id="H0E8583127EED4EAAAFDABB58586CA122"><enum>(1)</enum><header>Restrictions on use</header><text>The use of the Federal land by the Tribe shall be subject to the following conditions:</text> 
<subparagraph id="H12A27079C85D48029536640CA1BF8D67"><enum>(A)</enum><header>Buildings and structures</header><text>No commercial, residential, industrial, or other building or structure shall be constructed on the Federal land.</text></subparagraph> 
<subparagraph id="H888706E9A04A4E249ACB8C7CD1DDF8E3"><enum>(B)</enum><header>Natural condition and environment</header><text>The Tribe—</text> 
<clause id="H811B03A180634CAE960AC183C8736EB1"><enum>(i)</enum><text>shall preserve and protect the condition of the Federal land as in existence on the date of enactment of this Act; and</text></clause> 
<clause id="HF257AE989EED497281777EA651AB22B8"><enum>(ii)</enum><text>shall not carry out any activity that would adversely affect the natural environment of the Federal land, except as otherwise provided by this Act.</text></clause></subparagraph> 
<subparagraph id="HB23BBA33819748758BD0B1A6AE922961"><enum>(C)</enum><header>Logging and hunting</header><text>To maintain use of the Federal land as a natural wildlife corridor and provide for protection of existing resources of the Federal land, no logging or hunting shall be allowed on the Federal land.</text></subparagraph> 
<subparagraph id="H991DB7EF4AC84855A03CCB6086659EC1"><enum>(D)</enum><header>Roads</header> 
<clause id="H0E4864282B0C4541A178F9E96F5C095B"><enum>(i)</enum><header>Routine maintenance</header><text>Routine maintenance may be conducted on the 2-lane county road that crosses the Federal land as in existence on the date of enactment of this Act.</text></clause> 
<clause id="H354FAA0C257C424B8931659CCB18A65B"><enum>(ii)</enum><header>Expansion</header><text>The county road described in clause (i) may not be widened or otherwise expanded.</text></clause> 
<clause id="H96015D0F72C84C7391C022749318444D"><enum>(iii)</enum><header>Reconstruction</header><text>If the county road described in clause (i) is compromised due to a flood or other natural or unexpected occurrence, the county road may be reconstructed to ensure access to relevant areas.</text></clause> 
<clause id="HC45AD803ADF149878E0DF2F513C15727"><enum>(iv)</enum><header>Other access routes</header><text>Except as provided in clause (iii) and subsection (b)(2), no other road or access route shall be permitted on the Federal land.</text></clause></subparagraph></paragraph> 
<paragraph id="HEC9AFC872BA545A69B8B9419AF699B5B"><enum>(2)</enum><header>Uses approved by treaty</header> 
<subparagraph id="HD9398074878F4CBABBB8818D593C1162"><enum>(A)</enum><header>In general</header><text>The Tribe may authorize any member of the Tribe to use the Federal land for—</text> 
<clause id="HEAFA9DA23B6A42299A2C52015C6FCAFD"><enum>(i)</enum><text>ceremonial purposes; or</text></clause> 
<clause id="H38CEF2B3F9C1444EA95EB9954240A819"><enum>(ii)</enum><text>any other activity approved by a treaty between the United States and the Tribe.</text></clause></subparagraph> 
<subparagraph id="H84762FA95B6548DFA72B450C0E743F92"><enum>(B)</enum><header>No effect on treaty rights of tribe</header><text>Nothing in this Act affects any treaty right of the Tribe in existence on the date of enactment of this Act.</text></subparagraph></paragraph></subsection> 
<subsection id="H7D604238D25F47FEAA7AA4126C69D745"><enum>(b)</enum><header>Cooperative efforts</header><text>The Secretary and the Tribe—</text> 
<paragraph id="HED29C3983CFE42C899CC6386333077E5"><enum>(1)</enum><text>shall enter into cooperative agreements—</text> 
<subparagraph id="H39E8FCBA588B496B85570489D4477C22"><enum>(A)</enum><text>for joint provision of emergency fire aid, on completion of the proposed emergency fire response building of the Tribe; and</text></subparagraph> 
<subparagraph id="H20680C35C3EE489A95FDC0B412A91D12"><enum>(B)</enum><text>to provide opportunities for the public to learn more regarding the culture and traditions of the Tribe;</text></subparagraph></paragraph> 
<paragraph id="H1AD0FEF552834CDEB5480B14D40916B2"><enum>(2)</enum><text>may develop and establish on land taken into trust for the benefit of the Tribe pursuant to this Act a multipurpose, nonmotorized trail from Highway 101 to the Pacific Ocean; and</text></paragraph> 
<paragraph id="HE5516ACD9A9F46AE9DA9A710B2B9DAE0"><enum>(3)</enum><text>shall work cooperatively on any other issues of mutual concern relating to land taken into trust for the benefit of the Tribe pursuant to this Act.</text></paragraph></subsection></section> 
<section id="H549CE00FEFBC4515A7CD3496609BBE01"><enum>5.</enum><header>Gaming prohibition</header><text display-inline="no-display-inline">The Tribe may not conduct on any land taken into trust pursuant to this Act any gaming activities—</text> 
<paragraph id="H10C598580CE546468123544E97A224C0"><enum>(1)</enum><text>as a matter of claimed inherent authority; or</text></paragraph> 
<paragraph id="H67386B7D0572480EA6C6F8C46E16C2B6"><enum>(2)</enum><text>under any Federal law (including the Indian Gaming Regulatory Act (25 U.S.C. 2701 et seq.) (including any regulations promulgated by the Secretary or the National Indian Gaming Commission pursuant to that Act)).</text></paragraph></section>
