			 To Accept Ballot</header>
					<paragraph id="HB91CE26D5B294D619DB3344CD6EA0DB"><enum>(1)</enum><header>In
			 general</header><text>Title III of the Help America Vote Act of 2002 (42 U.S.C.
			 15481 et seq.) is amended by adding at the end the following new
			 subtitle:</text>

				requirements</header>
								<section id="H769447EEE9014DA0BDF540C9CAD4F9D"><enum>321.</enum><header>Use of National
				Federal write-in absentee ballot</header>
									<subsection id="HCB70EDCBA96B4FCB8C29DD7BE1F84CE"><enum>(a)</enum><header>In
				general</header><text>Any person who is otherwise qualified to vote in a
				Federal election in a State shall be permitted to use the national Federal
				write-in absentee ballot prescribed by the Commission under section 297 to cast
				a vote in an election for Federal office.</text>
									</subsection><subsection id="HC735904ADC7F4331B5108B8D99686BC"><enum>(b)</enum><header>Submission and
				processing</header>
										<paragraph id="H2D9FC459841E42ED87499F02D3688FA0"><enum>(1)</enum><header>In
				general</header><text>Except as otherwise provided in this section, a national
				Federal write-in absentee ballot shall be submitted and processed in the manner
				provided under the standards prescribed by the Commission under section
				297(b).</text>
										</paragraph><paragraph id="HABDEC008F0904E0EAC91CFC09EB6CB19"><enum>(2)</enum><header>Deadline</header><text>An
				otherwise eligible national Federal write-in absentee ballot shall be counted
				if postmarked or signed before the close of the polls on election day and
				received by the appropriate State election official on or before the date which
				is 10 days after the date of the election or the date provided for receipt of
				absentee ballots under State law, whichever is later.</text>
										</paragraph></subsection><subsection id="HD5F8AB2F009E4773AEF8069D8CD91BB6"><enum>(c)</enum><header>Special
				rules</header><text>The following rules shall apply with respect to national
				Federal write-in absentee ballots:</text>
										<paragraph id="H092D890213524CA9A33904BFDF3B1CA"><enum>(1)</enum><text>In completing the
				ballot, the voter may designate a candidate by writing in the name of the
				candidate or by writing in the name of a political party (in which case the
				ballot shall be counted for the candidate of that political party).</text>
										</paragraph><paragraph id="HCF3645FABE854F44ACF45EB70563A3A4"><enum>(2)</enum><text>In the case of the
				offices of President and Vice President, a vote for a named candidate or a vote
				by writing in the name of a political party shall be counted as a vote for the
				electors supporting the candidate involved.</text>
										</paragraph><paragraph id="HD8323A518B83483B8863C4B248408D1D"><enum>(3)</enum><text>Any abbreviation,
				misspelling, or other minor variation in the form of the name of a candidate or
				a political party shall be disregarded in determining the validity of the
				ballot.</text>
										</paragraph></subsection><subsection id="HD8A9B815D4D8433A9D527F74EED346F7"><enum>(d)</enum><header>Effective
				date</header><text>Each State shall be required to comply with the requirements
				of this section on and after January 1,
				2011.</text>

				standards</header>

				Federal write-in absentee ballot</header>
									<subsection id="HFC82F0AE24AA4F33BFDA05A0F7B655A7"><enum>(a)</enum><header>Form of
				ballot</header><text>The Commission shall prescribe a national Federal write-in
				absentee ballot (including a secrecy envelope and mailing envelope for such
				ballot) for use in elections for Federal office.</text>
									</subsection><subsection id="HC07297CEC68848498FEDF23A1814BA0"><enum>(b)</enum><header>Standards</header><text>The
				Commission shall prescribe standards for—</text>
										<paragraph id="H91A78E33A70D4191A85E7C9561795279"><enum>(1)</enum><text>distributing the
				national Federal write-in absentee ballot, including standards for distributing
				such ballot through the Internet; and</text>
										</paragraph><paragraph id="H892A16E9EEEE4CA0819BF8E015ED7379"><enum>(2)</enum><text>processing and
				submission of the national Federal write-in absentee
				ballot.</text>
										</paragraph></subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H21C997C38985440CA1B195BF95D14F09"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Section 202 of the Help America Vote Act of 2002 (42
			 U.S.C. 15322) is amended—</text>
						<subparagraph id="H9AD0411A37494969B547F99E3D2C0600"><enum>(A)</enum><text>by redesignating
			 paragraphs (5) and (6) as paragraphs (6) and (7); and</text>
						</subparagraph><subparagraph id="HA117ABE2B2EA410CA0DC290084BD79E"><enum>(B)</enum><text>by inserting after
			 paragraph (4) the following new paragraph:</text>

			 with Uniformed and Overseas Citizens Absentee Voting Act</header>
					<paragraph id="HB47359EA763E48A4BB9FDD5B00A68D6"><enum>(1)</enum><header>In
			 general</header><text>The Presidential designee under the Uniformed and
			 Overseas Absentee Voting Act, in consultation with the Election Assistance
			 Commission, shall facilitate the use and return of the national Federal
			 write-in ballot prescribed by the Commission under section 297 of the Help
			 America Vote Act of 2002 (as added by subsection (b)(1)) for absent uniformed
			 service voters and overseas voters so that such voters face no greater
			 difficulties in the submission and processing of their ballots than those faced
			 by absentee voters who reside in the United States.</text>
					</paragraph><paragraph id="HDB080A49F81B42AC9FBC048998FF4C8B"><enum>(2)</enum><header>Definitions</header><text>The
			 terms <term>absent uniformed service voter</term> and <term>overseas
			 voter</term> shall have the meanings given such terms by section 107 of the
			 Uniformed and Overseas Citizens Absentee Voting Act (42 U.S.C.
			 1973gg–6).</text>
					</paragraph></subsection></section><section id="HF50CAD52F0A2491F9F38054D9362FDCF"><enum>102.</enum><header>Verified
			 Ballots; Preservation</header>
				<subsection id="H9706A687035447899EC182E1C1FB100"><enum>(a)</enum><header>Verification</header>
					<paragraph id="H6576D1A427874893899EE090A758FB55"><enum>(1)</enum><header>In
			 general</header><text>Section 301(a) of the Help America Vote Act of 2002 (42
			 U.S.C. 15481(a)) is amended by adding at the end the following new
			 paragraph:</text>
						<quoted-block id="H7472939B656C4641BECAFD7C41E00000">
							<paragraph id="HB92DCFC4E8E9452C85B751985F694B95"><enum>(7)</enum><header>Verified
				ballots</header><text>In order to meet the requirements of paragraph (1)(A)(i),
				on and after January 1, 2011:</text>
								<subparagraph id="HD435DB5E8FE24EF1AEAAEFCE54F8601"><enum>(A)</enum><text>The voting system
				shall provide an independent means of voter verification which meets the
				requirements of subparagraph (B) and which allows each voter to verify the
				accuracy of the ballot before it is cast and counted, and to correct any errors
				before the record of the ballot is produced and preserved under this paragraph
				and paragraph (2)(B)(iii).</text>
								</subparagraph><subparagraph id="H2B7871D518CD40F585B7178294B23027"><enum>(B)</enum><text>A means of voter
				verification meets the requirements of this subparagraph if the voting system
				allows the voter to choose from one of the following options to verify the
				voter’s vote selection:</text>
									<clause id="H8FD1D02A5B5845FB96919E342500C822"><enum>(i)</enum><text>A
				paper record.</text>
									</clause><clause id="H1610DBEB1CE84C899C352B0966E3BBF7"><enum>(ii)</enum><text>An audio
				record.</text>
									</clause><clause id="H1B37D2A5A8844BF3B7D923573E38199B"><enum>(iii)</enum><text>A pictorial
				record.</text>
									</clause><clause id="H6E4C2562FAAA411E0079D4821BE0209"><enum>(iv)</enum><text>An
				electronic record or other means that provides for voter verification that is
				accessible for individuals with disabilities, including nonvisual accessibility
				for the blind and visually impaired, in a manner that provides privacy and
				independence equal to that provided for other voters.</text>
									</clause></subparagraph><subparagraph id="H7077E5FE436E464EA953DED8BBA47C80"><enum>(C)</enum><text>Any means of
				verification described in clause (ii), (iii), or (iv) of subparagraph (B) must
				provide verification which is equal or superior to verification through the use
				of a paper record.</text>
								</subparagraph><subparagraph id="HDC22843F9F71422BA60025B5811F0092"><enum>(D)</enum><text>None of the means
				of verification under this paragraph may employ cryptography in the
				record.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H80AB1B38F2D34D4DA72665BEDA7585EE"><enum>(2)</enum><header>Conforming
			 amendment</header><text>Clause (i) of section 301(a)(1)(A) of such Act (42
			 U.S.C. 15481(a)(1)(A)(i)) is amended by inserting <quote>and consistent with
			 the requirements of paragraphs (2), (4), and (7)</quote> after
			 <quote>independent manner</quote>.</text>
					</paragraph></subsection><subsection id="H87246EFA05A24D7AB6147274E9AFC87B"><enum>(b)</enum><header>Preservation of
			 Records</header><text display-inline="yes-display-inline">Section
			 301(a)(2)(B)(iii) of such Act (42 U.S.C. 15481(a)(2)(B)(iii)) is amended to
			 read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H8BBE812D56784032BC046F2D23BEFF62" style="OLC">
						<clause id="H84BC36D5E6944577BC994FEF423C59D2"><enum>(iii)</enum><text>The record
				produced to meet the requirements of paragraph (1)(A)(i) and this paragraph
				shall be available as an official record for any audit or recount conducted
				with respect to any election in which the system is used, and shall be
				preserved after the voter has verified its accuracy—</text>
							<subclause id="HB54E7042D1654C0C90291E48C74491B7"><enum>(I)</enum><text>in the case of a
				paper record, within the polling place on the date of the election in a manner
				that ensures the security of the votes as verified; and</text>
							</subclause><subclause id="HEC03608453654F9B9918EA572B0093ED"><enum>(II)</enum><text display-inline="yes-display-inline">in the case of a record described in clause
				(ii), (iii), or (iv) of paragraph (7)(B), through a method established by the
				Commission which provides protection of the record equal to or superior to the
				methods used to preserve paper
				records.</text>
							</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H0A0A6B2D239B4E77908CC2F0EFBBF063"><enum>(c)</enum><header>Guidance</header>
					<paragraph id="HD42C3495257F48C9A61206B2455B23A3"><enum>(1)</enum><header>In
			 General</header><text>Subtitle E of title II of such Act, as added by section
			 101(b)(1), is amended by adding at the end the following new section:</text>

							<section id="HDB913D9394664E0600E219E18DB96398"><enum>298.</enum><header>Verified
				ballots</header>
								<subsection id="H19F716AB0EB449D7B1F0DA9874A55089"><enum>(a)</enum><header>Standards</header><text display-inline="yes-display-inline">The Commission shall issue uniform and
				nondiscriminatory standards—</text>
									<paragraph id="HA980F780DEFE498A9FB51E7B49B8DDF"><enum>(1)</enum><text>for verified
				ballots required under section 301(a)(7); and</text>
									</paragraph><paragraph id="H644A377C68C541999CF6A178ACDD6067"><enum>(2)</enum><text>for meeting the
				audit requirements of section 301(a)(2).</text>
									</paragraph></subsection><subsection id="HC17FD3C3D79C497497F3EC9364CC959F"><enum>(b)</enum><header>Audits</header><text>The
				standards issued under subsection (a) shall provide for partial audits of the
				results of elections using the records produced pursuant to section 301(a)(7),
				and shall provide that those records shall be used for the official count of
				votes in the event that the tallies derived from the records differ from the
				tallies otherwise derived from the voting system used in the election
				involved.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H4871C6680DEF42B2A2FEF7DB7F930000"><enum>(2)</enum><header>Clerical
			 amendment</header><text>The table of contents for subtitle E of title II of
			 such Act, as added by this Act, is amended by adding at the end the following
			 new item:</text>

				Date</header><text>Each State shall be required to comply with the requirements
				of this section on and after January 1,

			 general</header><text>Chapter 29 of title 18, United States Code, is amended by
			 adding at the end the following:</text>

						<section id="H3D7EF5E54D1F45DFA045192114A59E4"><enum>618.</enum><header>Deceptive
				practices in Federal elections</header>
							<subsection id="HD0C0E8B0C485472E923594F5C60052C6"><enum>(a)</enum><text display-inline="yes-display-inline">Whoever, within 60 days before a Federal
				election, knowingly communicates election-related information about that
				election, knowing that information to be false, with the intent to prevent
				another person from exercising the right to vote in that election, or attempts
				to do so, shall be fined under this title or imprisoned not more than 5 years,
				or both.</text>
							</subsection><subsection id="HEE43A441CAB24379BA05F8C66B4224AF"><enum>(b)</enum><text display-inline="yes-display-inline">As used in this section—</text>
								<paragraph id="H244DE5E67A044CA39F8113ECEECD00BB"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>Federal election</term>
				means any general, primary, run-off, or special election for the office of
				President, Vice President, presidential elector, Member of the Senate, Member
				of the House of Representatives, or Delegate or Commissioner from a territory
				or possession; and</text>
								</paragraph><paragraph id="H1B454D27C0C54967BDE855E508E89938"><enum>(2)</enum><text>the term
				<term>election related information</term> means information regarding—</text>
									<subparagraph commented="no" id="HBE9037993BC64B8E8E48722208354D91"><enum>(A)</enum><text>the time, place,
				or manner of conducting the election;</text>
									</subparagraph><subparagraph id="H19875C7BF6AE4D5C00C2081934CE9817"><enum>(B)</enum><text>the qualifications
				for or restrictions on voter eligibility for the election, including—</text>
										<clause id="HC1EAD2D1695A428F897FE3B322873090"><enum>(i)</enum><text display-inline="yes-display-inline">any criminal penalties associated with
				voting in the election; or</text>
										</clause><clause id="H893B66032CF04A15BB836CCFC0DD44B6"><enum>(ii)</enum><text>information
				regarding a voter's registration status or eligibility;</text>
										</clause></subparagraph><subparagraph id="HA43140BE99264509A0B3CE37D79EAF82"><enum>(C)</enum><text>with respect to a
				closed primary election, the political party affiliation of any candidate for
				office, if the communication of the information also contains false information
				described in subparagraph (A) or (B); or</text>
									</subparagraph><subparagraph commented="no" id="H4F9FC5CE49404C2D91EFE3E2FAC821C"><enum>(D)</enum><text>the explicit
				endorsement by any person or organization of a candidate running for any office
				voted on in the
				election.</text>
									</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HA47C9B90638A41B1B8EBE7800A8A450"><enum>(b)</enum><header>Clerical

			 guidelines</header>
				<subsection id="H46DB569D251F4592A484139FC002C39E"><enum>(a)</enum><header>Review and
			 Amendment</header><text display-inline="yes-display-inline">Not later than 90
			 days after the date of enactment of this Act, the United States Sentencing
			 Commission, pursuant to its authority under section 994 of title 28, United
			 States Code, and in accordance with this section, shall review and, if
			 appropriate, amend the Federal sentencing guidelines and policy statements
			 applicable to persons convicted of any offense under sections of title 18,
			 United States Code, that are added or modified by this title.</text>
				</subsection><subsection id="H557B28132048458FBDD65D85C9B53A0"><enum>(b)</enum><header>Authorization</header><text>The
			 United States Sentencing Commission may, for the purposes of the amendments
			 made pursuant to this section, amend the Federal sentencing guidelines in
			 accordance with the procedures set forth in section 21(a) of the Sentencing Act
			 of 1987 (28 U.S.C. 994 note) as though the authority under that section had not
			 expired.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="H80412079AA6A41D08FE3C10800CFFB34"><enum>204.</enum><header>Reporting
			 violations and remedial action</header>
				<subsection commented="no" display-inline="no-display-inline" id="H337D8C1F99AA4DC6910090D738278656"><enum>(a)</enum><header>Reporting</header><text>Any
			 person may report to the Attorney General any violation or possible violation
			 of section 594 or 618 of title 18, United States Code.</text>
				</subsection><subsection commented="no" id="HD6D9A606BF2640A0A5047204DB00CB58"><enum>(b)</enum><header>Corrective
			 action</header>
					<paragraph commented="no" id="HC24BD8B5586F4F05921CFE651438DBD6"><enum>(1)</enum><header>In
			 general</header><text>Immediately after receiving a report under subsection
			 (a), the Attorney General shall consider and review such report and, if the
			 Attorney General determines that there is a reasonable basis to find that a
			 violation has occurred, the Attorney General shall—</text>
						<subparagraph commented="no" id="HFC816B89E26B4F8682F123C6DA47DD7"><enum>(A)</enum><text>undertake all
			 effective measures necessary to provide correct information to voters affected
			 by the false information;</text>
						</subparagraph><subparagraph id="HC5905E9813E7441CBB95D74135BDD97"><enum>(B)</enum><text display-inline="yes-display-inline">refer any matter under the jurisdiction of
			 the Civil Rights Division of the Department of Justice to such division for
			 prosecution; and</text>
						</subparagraph><subparagraph commented="no" id="HEB8A12542B4B451900ED5BD1DC825B08"><enum>(C)</enum><text>refer the matter
			 to the appropriate Federal and State authorities for criminal prosecution or
			 civil action after the election.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H9857DD8AA0CA495FB9D338FC89FD96EA"><enum>(2)</enum><header>Regulations</header>
						<subparagraph commented="no" id="H494454947D3E4A4FB9E3B4EEF03736E5"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General shall promulgate regulations
			 regarding the methods and means of corrective actions to be taken under
			 paragraph (1). Such regulations shall be developed in consultation with the
			 Election Assistance Commission, civil rights organizations, voting rights
			 groups, State and local election officials, voter protection groups, and other
			 interested community organizations.</text>
						</subparagraph><subparagraph commented="no" id="HC2323E8A8C834FE2A965F4847E349888"><enum>(B)</enum><header>Study</header>
							<clause commented="no" id="HAEEB9350DA5B472FB69DF0DE61D47BA3"><enum>(i)</enum><header>In
			 general</header><text>The Attorney General, in consultation with the Federal
			 Communications Commission and the Election Assistance Commission, shall conduct
			 a study on the feasibility of providing the corrective information under
			 paragraph (1) through public service announcements, the emergency alert system,
			 or other forms of public broadcast.</text>
							</clause><clause commented="no" id="HFE48A403E6AA44028E6D9356C3C7BF5C"><enum>(ii)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Attorney
			 General shall submit to Congress a report detailing the results of the study
			 conducted under clause (i).</text>
							</clause></subparagraph></paragraph><paragraph id="HCB06993BFF4E4AAEA47230FF73AC1165"><enum>(3)</enum><header>Publicizing
			 remedies</header><text display-inline="yes-display-inline">The Attorney General
			 shall make public through the Internet, radio, television, and newspaper
			 advertisements information on the responsibilities, contact information, and
			 complaint procedures applicable under this section.</text>
					</paragraph></subsection><subsection id="H2389FD6CA19E48E5880015C4E11398ED"><enum>(c)</enum><header>Reports to
			 Congress</header>
					<paragraph id="HAD3F9519065A4C389B07302B3FA6DB5B"><enum>(1)</enum><header>In
			 general</header><text>Not later than 90 days after any primary, general, or
			 run-off election for Federal office, the Attorney General shall submit to
			 Congress a report compiling and detailing any allegations of false information
			 submitted pursuant to subsection (a) and relating to such election.</text>
					</paragraph><paragraph id="H0A394EB097364E1E9EA7E2F368777D02"><enum>(2)</enum><header>Contents</header><text>Each
			 report submitted under paragraph (1) shall include—</text>
						<subparagraph id="H7CAD2D3BE0BB41068534504C7D2F3F00"><enum>(A)</enum><text>detailed
			 information on specific allegations of deceptive tactics;</text>
						</subparagraph><subparagraph id="H1C1CC3DB90C04238A649F1433E64EAA7"><enum>(B)</enum><text>statistical
			 compilations of how many allegations were made and of what type;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8D3D72FC303448138D3233DD9E198E02"><enum>(C)</enum><text>the geographic
			 locations of and the populations affected by the alleged deceptive
			 information;</text>
						</subparagraph><subparagraph id="H32E17A121E0D4731850784A9EF9291B"><enum>(D)</enum><text>the status of the
			 investigations of such allegations;</text>
						</subparagraph><subparagraph id="H1709CDAC1B214AC288936E21E52CDB2"><enum>(E)</enum><text>any corrective
			 actions taken in response to such allegations;</text>
						</subparagraph><subparagraph id="H5C89B9F984E44F50B83700AA41815E35"><enum>(F)</enum><text>the rationale used
			 for any corrective actions or for any refusal to pursue an allegation;</text>
						</subparagraph><subparagraph id="H07D3EB21387E4FA9A39F3C23B9BD14C1"><enum>(G)</enum><text>the effectiveness
			 of any such corrective actions;</text>
						</subparagraph><subparagraph id="H6F31F056AF3E4F67A8CFA92D6F30F0A1"><enum>(H)</enum><text>whether a Voting
			 Integrity Task Force was established with respect to such election, and, if so,
			 how such task force was staffed and funded;</text>
						</subparagraph><subparagraph id="HE2D06706FCBA4FE8B781FBAEC99F6E7"><enum>(I)</enum><text>any referrals of
			 information to other Federal, State, or local agencies;</text>
						</subparagraph><subparagraph id="HE1B0B92703604850996D8323FBEC8FC4"><enum>(J)</enum><text>any suit
			 instituted under section 2004(b)(2) of the Revised Statutes (42 U.S.C.
			 1971(b)(2)) in connection with such allegations; and</text>
						</subparagraph><subparagraph id="H68BEB362301B4153A888006326CA61D4"><enum>(K)</enum><text>any criminal
			 prosecution instituted under title 18, United States Code, in connection with
			 such allegations.</text>
						</subparagraph></paragraph><paragraph id="H878FED0EF5F4486B8360D6523866EEB6"><enum>(3)</enum><header>Report made
			 public</header><text>On the date that the Attorney General submits the report
			 required under paragraph (1), the Attorney General shall also make the report
			 publicly available through the Internet and other appropriate means.</text>
					</paragraph></subsection><subsection commented="no" id="H9D91C8D89AA447178679A5187F6C594F"><enum>(d)</enum><header>Delegation of
			 duties</header>
					<paragraph commented="no" id="HFDDB9F1D022141C9BA213BB28701B415"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall delegate the responsibilities
			 under this section to a Voting Integrity Task Force established under paragraph
			 (2).</text>
					</paragraph><paragraph commented="no" id="H1EC847B89F894484805383588F38B9C8"><enum>(2)</enum><header>Voting integrity
			 task force</header>
						<subparagraph commented="no" id="H1843B670910B4804AB24CB76D2071489"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General shall establish a Voting Integrity
			 Task Force to carry out the requirements of this section with respect to any
			 general, primary, run-off, or special election for Federal office.</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HBE6BBC34581E46DDA6E182D3DF1FBE23"><enum>(B)</enum><header>Composition</header><text>Any
			 Voting Integrity Task Force established under paragraph (1) shall be under the
			 direction of the Assistant Attorney General for the Civil Rights Division and
			 the Assistant Attorney General for the Criminal Division, jointly.</text>
						</subparagraph></paragraph></subsection><subsection commented="no" id="H1202885E1A784B9F9F31A4B7BD2F6063"><enum>(e)</enum><header>Federal
			 office</header><text>For purposes of this section, the term <term>Federal
			 office</term> means the office of President, Vice President, presidential
			 elector, Member of the Senate, Member of the House of Representatives, or
			 Delegate or Commissioner from a territory or possession of the United
			 States.</text>
				</subsection></section></title><title id="H7245B1585EFA481185AD269DAF9D12EC"><enum>III</enum><header>Prohibiting
			 Voter Caging</header>
			<section id="HF4C449BF74A646548690651D4314BF1C"><enum>301.</enum><header>Voter caging
			 and other questionable challenges prohibited</header>
				<subsection id="HC88C184EC8E645F1BC8E3139D0E296FA"><enum>(a)</enum><header>In
			 General</header><text>Chapter 29 of title 18, United States Code, as amended by
			 section 201(a), is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="H398656518B5740FAB1594506AA6D6D67" style="USC">
						<section id="H82692BB81F3E43808DF2AFBA38E04B9"><enum>619.</enum><header>Voter caging and
				other questionable challenges</header>
							<subsection id="H2056ADE06550425E89E0DA948DF528A0"><enum>(a)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="HAA441346212A4D08806D0182695B366D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>voter caging document</term>
				means—</text>
									<subparagraph id="H04612089554D480F84F67BCB69E80046"><enum>(A)</enum><text>a nonforwardable
				document that is returned to the sender or a third party as undelivered or
				undeliverable despite an attempt to deliver such document to the address of a
				registered voter or applicant; or</text>
									</subparagraph><subparagraph id="H04CD9FE2F42E45B59C341B8C733F6B00"><enum>(B)</enum><text>any document with
				instructions to an addressee that the document be returned to the sender or a
				third party but is not so returned, despite an attempt to deliver such document
				to the address of a registered voter or applicant, unless at least two Federal
				election cycles have passed since the date of the attempted delivery;</text>
									</subparagraph></paragraph><paragraph id="H390EAA971AA84DBDB637F6DD1D85A800"><enum>(2)</enum><text>the term
				<term>voter caging list</term> means a list of individuals compiled from voter
				caging documents; and</text>
								</paragraph><paragraph id="H2E5DAFA746884BCFA02470E38700B58B"><enum>(3)</enum><text>the term
				<term>unverified match list</term> means a list produced by matching the
				information of registered voters or applicants for voter registration to a list
				of individuals who are ineligible to vote in the registrar’s jurisdiction, by
				virtue of death, conviction, change of address, or otherwise; unless one of the
				pieces of information matched includes a signature, photograph, or unique
				identifying number ensuring that the information from each source refers to the
				same individual.</text>
								</paragraph></subsection><subsection id="H1CBB96BF193A434BAF6900902C00F188"><enum>(b)</enum><header>Prohibition
				Against Voter Caging</header><text display-inline="yes-display-inline">No State
				or local election official shall prevent an individual from registering or
				voting in any election for Federal office, or permit in connection with any
				election for Federal office a formal challenge under State law to an
				individual’s registration status or eligibility to vote, if the basis for such
				decision is evidence consisting of—</text>
								<paragraph id="H8ED8EC42784A4F26B6C81E7D38A402D8"><enum>(1)</enum><text>a voter caging
				document or voter caging list;</text>
								</paragraph><paragraph id="H1549773E1880431FB1B5947E92062F62"><enum>(2)</enum><text>an unverified
				match list;</text>
								</paragraph><paragraph id="H53D00B7CFBF34101A73FD04C14C29B00"><enum>(3)</enum><text display-inline="yes-display-inline">an error or omission on any record or paper
				relating to any application, registration, or other act requisite to voting, if
				such error or omission is not material to an individual’s eligibility to vote
				under section 2004 of the Revised Statutes, as amended (42 U.S.C.
				1971(a)(2)(B)); or</text>
								</paragraph><paragraph id="H8C8983AC6230477C9EDA5E1BF8C77E84"><enum>(4)</enum><text>any other evidence
				so designated for purposes of this section by the Election Assistance
				Commission,</text>
								</paragraph><continuation-text continuation-text-level="subsection">except
				that the election official may use such evidence if it is corroborated by
				independent evidence of the individual’s ineligibility to register or vote.</continuation-text></subsection><subsection id="H8CD2B2F195E54590949EA060D07073C5"><enum>(c)</enum><header>Requirements For
				Challenges by Persons Other Than Election Officials</header>
								<paragraph id="H762A7A4E35DC46588C00A9783FF64B79"><enum>(1)</enum><header>Attestation of
				first-hand knowledge of ineligibility</header><text display-inline="yes-display-inline">No person, other than a State or local
				election official, shall submit a formal challenge to an individual’s
				eligibility to register to vote in an election for Federal office or to vote in
				an election for Federal office unless that challenge is supported by personal,
				first-hand knowledge regarding the grounds for ineligibility which is—</text>
									<subparagraph id="H4EAE92E438A84453BBC376136855897B"><enum>(A)</enum><text>documented in
				writing; and</text>
									</subparagraph><subparagraph id="HC88E61F8624640D49FA060C289B7FEF"><enum>(B)</enum><text>subject to an oath
				or attestation under penalty of perjury that the individual who is the subject
				of the challenge is ineligible to register to vote or vote in that
				election.</text>
									</subparagraph></paragraph><paragraph id="H6151567AC0CE49EF9221E349CE104BB"><enum>(2)</enum><header>Prohibiting
				challenges based on certain evidence</header><text display-inline="yes-display-inline">No person, other than a State or local
				election official, shall submit a formal challenge to an individual’s
				eligibility to register to vote in an election for Federal office or to vote in
				an election for Federal office if the basis for such challenge is evidence
				consisting of—</text>
									<subparagraph id="H0C41890D0AC04D09B6FEB0C69815A8C8"><enum>(A)</enum><text>a voter caging
				document or voter caging list;</text>
									</subparagraph><subparagraph id="HA97522B679284C258CAC513C883D316F"><enum>(B)</enum><text>an unverified
				match list;</text>
									</subparagraph><subparagraph id="H5AAEC4CCF7704549B2B0104336734141"><enum>(C)</enum><text>an error or
				omission on any record or paper relating to any application, registration, or
				other act requisite to voting, if such error or omission is not material to an
				individual’s eligibility to vote under section 2004 of the Revised Statutes, as
				amended (42 U.S.C. 1971(a)(2)(B)); or</text>
									</subparagraph><subparagraph id="H38C32B62F20643CE9023ED999D4E009B"><enum>(D)</enum><text display-inline="yes-display-inline">any other evidence so designated for
				purposes of this section by the Election Assistance Commission.</text>
									</subparagraph></paragraph></subsection><subsection id="H1C0A751E03BD4401932173B0C59302B"><enum>(d)</enum><header>Penalties for
				Knowing Misconduct</header><text display-inline="yes-display-inline">Whoever
				knowingly challenges the eligibility of one or more individuals to register or
				vote or knowingly causes the eligibility of such individuals to be challenged
				in violation of this section with the intent that one or more eligible voters
				be disqualified, shall be fined under this title or imprisoned not more than 5
				years, or both, for each such violation. Each violation shall be a separate
				offense.</text>
							</subsection><subsection id="HC8302457F1CD49218CD171ABBA7370ED"><enum>(e)</enum><header>No Effect on
				Related Laws</header><text display-inline="yes-display-inline">Nothing in this
				section is intended to override the protections of the National Voter
				Registration Act of 1993 (42 U.S.C. 1973gg et seq.) or to affect the Voting
				Rights Act of 1965 (42 U.S.C. 1973 et
				seq.).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HBD11834F88524DEBBEE523A9EADF60D2"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of sections for chapter 29 of title 18,
			 United States Code, as amended by section 201(b), is amended by adding at the
			 end the following:</text>

				</subsection></section><section id="HFCAFF4181F5544748D3D3BC00A7ABAE"><enum>302.</enum><header>Severability</header><text display-inline="no-display-inline">If any provision of this title or any
			 amendment made by this title, or the application of a provision to any person
			 or circumstance, is held to be unconstitutional, the remainder of this title
			 and the amendments made by this title, and the application of the provisions to
			 any person or circumstance, shall not be affected by the holding.</text>
			</section></title><title id="HB92B0378CE514560A4148E6D59628962"><enum>IV</enum><header>Restoring Voting
			 Rights</header>
			<section id="HE8F24C06B9C441959F7F9739E7732D17"><enum>401.</enum><header>Rights of
			 citizens</header><text display-inline="no-display-inline">The right of an
			 individual who is a citizen of the United States to vote in any election for
			 Federal office shall not be denied or abridged because that individual has been
			 convicted of a criminal offense unless such individual is serving a felony
			 sentence in a correctional institution or facility at the time of the
			 election.</text>
			</section><section id="HCA6549E767FC4222B0076814009836B4"><enum>402.</enum><header>Enforcement</header>
				<subsection id="HDA3035C6E5D14DB689AD13C000E4A41"><enum>(a)</enum><header>Attorney
			 general</header><text>The Attorney General may, in a civil action, obtain such
			 declaratory or injunctive relief as is necessary to remedy a violation of this
			 title.</text>
				</subsection><subsection id="H657FCE7A92EE484EA92D63E8936D2DAB"><enum>(b)</enum><header>Private right of
			 action</header>
					<paragraph id="H417CCCCBC25848AC8C9504B981BDC5C"><enum>(1)</enum><header>Notice to
			 election official</header><text>A person who is aggrieved by a violation of
			 this title may provide written notice of the violation to the chief election
			 official of the State involved.</text>
					</paragraph><paragraph id="HD78BFC46B172433F8D036C93D3602879"><enum>(2)</enum><header>Action
			 permitted</header><text>Except as provided in paragraph (3), if the violation
			 is not corrected within 90 days after receipt of a notice under paragraph (1),
			 or within 20 days after receipt of the notice if the violation occurred within
			 120 days before the date of an election for Federal office, the aggrieved
			 person may, in a civil action obtain declaratory or injunctive relief with
			 respect to the violation.</text>
					</paragraph><paragraph id="H268E25A3BF72421582ADBE4E13DCD545"><enum>(3)</enum><header>Waiver of notice
			 for violations occurring near date of election</header><text>If the violation
			 occurred within 30 days before the date of an election for Federal office, the
			 aggrieved person need not provide notice to the chief election official of the
			 State under paragraph (1) before bringing a civil action to obtain declaratory
			 or injunctive relief with respect to the violation.</text>
					</paragraph></subsection></section><section id="HC6CED13299C3451B9F8D00DCB9038348"><enum>403.</enum><header>Notification of
			 restoration of voting rights</header>
				<subsection id="H9EA21423E3934B088F00C716CEF0047"><enum>(a)</enum><header>State
			 notification</header>
					<paragraph id="H6D0DE8FF406848FB98A0EB64D711CFB"><enum>(1)</enum><header>Notification</header><text>On
			 the date determined under paragraph (2), each State shall notify in writing any
			 individual who has been convicted of a criminal offense under the law of that
			 State that such individual has the right to vote in an election for Federal
			 office pursuant to this title and may register to vote in any such
			 election.</text>
					</paragraph><paragraph id="H73E7E364551642B7B1EFBE259E3CE616"><enum>(2)</enum><header>Date of
			 notification</header>
						<subparagraph id="HBEBD1E57216D4BD69E83F736FE232660"><enum>(A)</enum><header>Felony
			 conviction</header><text>In the case of such an individual who has been
			 convicted of a felony, the notification required under paragraph (1) shall be
			 given on the date on which the individual—</text>
							<clause id="H5DBB8A750859410FB64F3193C502C4DF"><enum>(i)</enum><text>is
			 sentenced to serve only a term of probation; or</text>
							</clause><clause id="HE94811CBDA0E4EC3911CEDEA92764B69"><enum>(ii)</enum><text>is
			 released from the custody of that State (other than to the custody of another
			 State or the Federal Government to serve a term of imprisonment for a felony
			 conviction).</text>
							</clause></subparagraph><subparagraph id="HB8CC35442B554A4AA436C400D9F9931"><enum>(B)</enum><header>Misdemeanor
			 conviction</header><text>In the case of such an individual who has been
			 convicted of a misdemeanor, the notification required under paragraph (1) shall
			 be given on the date on which such individual is sentenced.</text>
						</subparagraph></paragraph></subsection><subsection id="H9FAEFD56280148EDBA69EE0713ECCD0"><enum>(b)</enum><header>Federal
			 notification</header>
					<paragraph id="HF72B57507CCC4DD7B3A7F5A22EB89459"><enum>(1)</enum><header>Notification</header><text>On
			 the date determined under paragraph (2), the Director of the Bureau of Prisons
			 shall notify in writing any individual who has been convicted of a criminal
			 offense under Federal law that such individual has the right to vote in an
			 election for Federal office pursuant to this title and may register to vote in
			 any such election.</text>
					</paragraph><paragraph id="HFE396328D4EB47E9B7A791569B895783"><enum>(2)</enum><header>Date of
			 notification</header>
						<subparagraph id="H8C1C5AB1E1EC407ABDF81474E5000478"><enum>(A)</enum><header>Felony
			 conviction</header><text>In the case of such an individual who has been
			 convicted of a felony, the notification required under paragraph (1) shall be
			 given on the date on which the individual—</text>
							<clause id="H1E2522CF89314480B328E3E2FD982160"><enum>(i)</enum><text>is
			 sentenced to serve only a term of probation by a court established by an Act of
			 Congress; or</text>
							</clause><clause id="HFC91EE7BA47040CAAB6C0607112B1CE2"><enum>(ii)</enum><text>is
			 released from the custody of the Bureau of Prisons (other than to the custody
			 of a State to serve a term of imprisonment for a felony conviction).</text>
							</clause></subparagraph><subparagraph id="HDB1062E15336415EB1EB49DADE00D000"><enum>(B)</enum><header>Misdemeanor
			 conviction</header><text>In the case of such an individual who has been
			 convicted of a misdemeanor, the notification required under paragraph (1) shall
			 be given on the date on which such individual is sentenced.</text>
						</subparagraph></paragraph></subsection></section><section id="HEA3110F05BA5443B8FABF8D9686DDEE"><enum>404.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this title:</text>
				<paragraph id="HD6B9221372824C45A6D6A202F8CBB83C"><enum>(1)</enum><header>Correctional
			 institution or facility</header><text>The term <term>correctional institution
			 or facility</term> means any prison, penitentiary, jail, or other institution
			 or facility for the confinement of individuals convicted of criminal offenses,
			 whether publicly or privately operated, except that such term does not include
			 any residential community treatment center (or similar public or private
			 facility).</text>
				</paragraph><paragraph id="H33CC6BAC06454592B6A53816D3740091"><enum>(2)</enum><header>Election</header><text>The
			 term <term>election</term> means—</text>
					<subparagraph id="HFAB15083D824475DAE6678B2202707DB"><enum>(A)</enum><text>a general,
			 special, primary, or runoff election;</text>
					</subparagraph><subparagraph id="H783A8ABB0A4E433990AFD9C3948E6D39"><enum>(B)</enum><text>a convention or
			 caucus of a political party held to nominate a candidate;</text>
					</subparagraph><subparagraph id="HE0A8BFFCD38C4E02B9B81870493E5591"><enum>(C)</enum><text>a primary election
			 held for the selection of delegates to a national nominating convention of a
			 political party; or</text>
					</subparagraph><subparagraph id="HA4214B323DB84E3FB7D08CCF63433C27"><enum>(D)</enum><text>a primary election
			 held for the expression of a preference for the nomination of persons for
			 election to the office of President.</text>
					</subparagraph></paragraph><paragraph id="HD3B526A3C6644790B097869289BDFBE7"><enum>(3)</enum><header>Federal
			 office</header><text>The term <term>Federal office</term> means the office of
			 President or Vice President of the United States, or of Senator or
			 Representative in, or Delegate or Resident Commissioner to, the Congress of the
			 United States.</text>
				</paragraph><paragraph id="H63E79CA4FE304512952B39A1EDE56D4F"><enum>(4)</enum><header>Probation</header><text>The
			 term <term>probation</term> means probation, imposed by a Federal, State, or
			 local court, with or without a condition on the individual involved
			 concerning—</text>
					<subparagraph id="H5A962703EF134A5A005F7369721828D4"><enum>(A)</enum><text>the individual’s
			 freedom of movement;</text>
					</subparagraph><subparagraph id="H9C58C32B381045078656FFEC7D752FD3"><enum>(B)</enum><text>the payment of
			 damages by the individual;</text>
					</subparagraph><subparagraph id="H000D404F42B54F08892F40B7B2E99A1"><enum>(C)</enum><text>periodic reporting
			 by the individual to an officer of the court; or</text>
					</subparagraph><subparagraph id="HDEC94BAE4FF146F49D07362E351300C0"><enum>(D)</enum><text>supervision of the
			 individual by an officer of the court.</text>
					</subparagraph></paragraph></section><section id="HF12DA6544450409893912C48935B34F1"><enum>405.</enum><header>Relation to
			 other laws</header>
				<subsection id="H3AFB5C6823E545A0A75200E51D598478"><enum>(a)</enum><header>State laws
			 relating to voting rights</header><text>Nothing in this title shall be
			 construed to prohibit the States enacting any State law which affords the right
			 to vote in any election for Federal office on terms less restrictive than those
			 established by this title.</text>
				</subsection><subsection id="H1C598EE6AC7B4A28946FDB9DDED2B2EE"><enum>(b)</enum><header>Certain Federal
			 Acts</header><text>The rights and remedies established by this title are in
			 addition to all other rights and remedies provided by law, and neither rights
			 and remedies established by this title shall supersede, restrict, or limit the
			 application of the Voting Rights Act of 1965 (42 U.S.C. 1973 et seq.) or the
			 National Voter Registration Act (42 U.S.C. 1973–gg).</text>
				</subsection></section><section id="HB5EB7AAF7B4F4294B25C21AF97C900E8"><enum>406.</enum><header>Federal prison
			 funds</header><text display-inline="no-display-inline">No State, unit of local
			 government, or other person may receive or use, to construct or otherwise
			 improve a prison, jail, or other place of incarceration, any Federal grant
			 amounts unless that person has in effect a program under which each individual
			 incarcerated in that person’s jurisdiction who is a citizen of the United
			 States is notified, upon release from such incarceration, of that individual’s
			 rights under section 401.</text>
			</section><section id="HACDB7677E9E34C9596E64C68D9239F61"><enum>407.</enum><header>Effective
			 date</header><text display-inline="no-display-inline">This title shall apply to
			 citizens of the United States voting in any election for Federal office held
			 after the date of the enactment of this Act.</text>
			</section></title><title id="H44E7385E53C94D89B975A0B14900F33D"><enum>V</enum><header>Election Day as
			 Legal Public Holiday</header>
			<section id="H382E5A7C69104CA08CF3AF7E83C4515"><enum>501.</enum><header>Treatment of
			 election day in same manner as legal public holiday for purposes of Federal
			 employment</header><text display-inline="no-display-inline">For purposes of any
			 law relating to Federal employment, the Tuesday next after the first Monday in
			 November in 2010 and each even-numbered year thereafter shall be treated in the
			 same manner as a legal public holiday described in section 6103 of title 5,
			 United States Code.</text>
			</section><section id="HDBA47AE87AFE4FD999AF8525B8C01011"><enum>502.</enum><header>Study by
			 Comptroller General of impact on voter participation</header>
				<subsection id="HD83D088B38BD4C63BBD43BED08D55C8D"><enum>(a)</enum><header>In
			 general</header><text>The Comptroller General shall conduct a study of the
			 impact of section 501 on voter participation.</text>
				</subsection><subsection id="HE95FDC1689444C86B000D2FCD5B6E25"><enum>(b)</enum><header>Report</header><text>Not
			 later than May 1, 2015, the Comptroller General shall submit a report to
			 Congress and the President on the results of the study conducted under
			 subsection (a).</text>
				</subsection></section><section id="HB3C66F869C1841AE94007BFA761EA6AA"><enum>503.</enum><header>Sense of
			 Congress regarding treatment of day by private employers</header><text display-inline="no-display-inline">It is the sense of Congress that private
			 employers in the United States should give their employees a day off on the
			 Tuesday next after the first Monday in November in 2010 and each even-numbered
			 year thereafter to enable the employees to cast votes in the elections held on
			 that day.</text>
