		<section id="HFA638F97C0774DDAB71C13FD7E43008F" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Children’s Product Safety Enhancement
			 and Clarification Act of 2009</short-title></quote>.</text>
		</section><section id="H9468310557BF4E76972C93AA10FF46A2"><enum>2.</enum><header>Mandatory
			 exclusion of fabric products from lead limits; Special considerations in
			 enforcement with respect to small businesses, thrift stores selling used goods,
			 and donations to charities</header>
			<subsection id="H81F80615FE424F6C9F71DE514BE19765"><enum>(a)</enum><header>Mandatory
			 exclusion of fabric products from lead limits</header><text display-inline="yes-display-inline">Section 101(b) of the Consumer Product
			 Safety Improvement Act of 2008 (15 U.S.C. 1278a(b)) is amended by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="HBDD82261FF2340D2BE2FB7BA7BFDE3A2" style="OLC">
					<paragraph id="H6431A9E69023436DB27CA8BA1919DFA8"><enum>(6)</enum><header>Mandatory
				exclusion of fabric products</header><text display-inline="yes-display-inline">Subsection (a) of this section shall not
				apply to a children’s product (as defined in section 3(a)(16) of the Consumer
				Product Safety Act) made solely out of fabric (as defined in section 2(f) of
				the Textile Fiber Products Identification
				Act).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H3C67D3F29EC7485B8700038E27BEF01E"><enum>(b)</enum><header>Special
			 considerations in enforcement with respect to small businesses, thrift stores
			 selling used goods, and donations to charities</header><text>Section 101 of
			 such Act (15 U.S.C. 1278a) is amended by adding at the end the
			 following:</text>
				<quoted-block display-inline="no-display-inline" id="H7D670ECFD3D84106BC332FE2502F4163" style="OLC">
					<subsection id="H47574C306B8547DD9C4D68CA79D50281"><enum>(h)</enum><header>Special
				considerations in enforcement with respect to small businesses, thrift stores
				selling used goods, and donations to charities</header>
						<paragraph id="H5D999C23A4624B65A53C1352F4DE9F32"><enum>(1)</enum><header>In
				general</header><text>In enforcing this section with respect to an entity
				described in paragraph (2), or a donation described in paragraph (3) made or to
				be made by any entity, the Commission shall do the following:</text>
							<subparagraph id="H71A3B2F00F09487EBBA65632C043EE97"><enum>(A)</enum><text>Work cooperatively
				with the entity.</text>
							</subparagraph><subparagraph id="H1F2C048E5F8043E8B192254F739CB231"><enum>(B)</enum><text>Take into account
				economic, administrative, or other limits on the ability of the entity to
				comply with this section.</text>
							</subparagraph><subparagraph id="H75AF5D25571C4CD9A8A2C60383ED647C"><enum>(C)</enum><text>Construe this
				section, as it applies to the entity or the donation, favorably to the
				entity.</text>
							</subparagraph></paragraph><paragraph id="H96B4974AAAC94AC79B362940464767B4"><enum>(2)</enum><header>Entity
				described</header><text display-inline="yes-display-inline">An entity is
				described in this paragraph if the entity—</text>
							<subparagraph id="H5F9A76245C164DB3BF6BEBE7C1545478"><enum>(A)</enum><text>has made a good
				faith effort to comply with this section; and</text>
							</subparagraph><subparagraph id="H6EA77B092F4A4C4C939359BE428DFAC5"><enum>(B)</enum><text>is any of the
				following:</text>
								<clause id="HB3F363DF81DA47FCA3D8497539BCC6A5"><enum>(i)</enum><text display-inline="yes-display-inline">A business concern that meets the
				requirements of section 3(a) of the Small Business Act and the regulations
				promulgated pursuant to that section.</text>
								</clause><clause id="HF19BAE66ECA5472BB1F6E89C64731469"><enum>(ii)</enum><text display-inline="yes-display-inline">A person who sells, including on
				consignment, a children’s product (as defined in section 3(a)(16) of the
				Consumer Product Safety Act) that, when sold or offered for sale, has been
				previously purchased by a consumer.</text>
								</clause></subparagraph></paragraph><paragraph id="HE56D0D049915477E97C0B090F3989923"><enum>(3)</enum><header>Donation
				described</header><text>A donation is described in this paragraph if the
				donation is of a children’s product (as defined in section 3(a)(16) of the
				Consumer Product Safety Act) by a person to an organization that is—</text>
							<subparagraph id="H9CBF7EF254434889884DDFABC8B2CCD1"><enum>(A)</enum><text>described in
				section 501(c)(3) of the Internal Revenue Code of 1986; and</text>
							</subparagraph><subparagraph id="H53D52742BAC148D6B94FCF6E4A700B8"><enum>(B)</enum><text>exempt from
				taxation under section 501(a) of such
				Code.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="HC4B06FD962CE4605B181CD61759C1842"><enum>(c)</enum><header>Effective
			 date</header><text>The amendments made by this section shall take effect as if
			 included in the enactment of section 101 of the Consumer Product Safety
			 Improvement Act of 2008.</text>
			</subsection></section><section id="HEE0E7FD8EEC84D78A6524DC8BC1C978D"><enum>3.</enum><header>Exemption of
			 fabric products from mandatory third party testing</header>
			<subsection id="HC087EC1CEE4742199E16B7A555FA795E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 14(a)(2) of
			 the Consumer Product Safety Act (15 U.S.C. 2063(a)(2)), as amended by section
			 102(a)(2) of the Consumer Product Safety Improvement Act of 2008, is amended by
			 inserting after <quote>a children’s product safety rule</quote> the following:
			 <quote>(except a children’s product made solely out of fabric (as defined in
			 section 2(f) of the Textile Fiber Products Identification Act))</quote>.</text>
			</subsection><subsection id="HCD5D90009D954803846CC09632F25500"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 subsection (a) shall take effect as if included in the enactment of section 102
			 of the Consumer Product Safety Improvement Act of 2008.</text>
