<legis-type display="yes">AN ACT</legis-type> 
<official-title display="yes">To provide for a land exchange involving certain National Forest System lands in the Mendocino National Forest in the State of California, and for other purposes.</official-title>

<section changed="deleted" commented="no" display-inline="no-display-inline" id="H15F6703A6AF142D9A492AAD088A000A4" reported-display-style="strikethrough" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Deafy Glade Land Exchange Act </short-title></quote>.</text> </section>

<subsection commented="no" display-inline="no-display-inline" id="H58D7ADF6A1FF4BA891BC213E21F0007C"><enum>(a)</enum><header display-inline="yes-display-inline">Land exchange required</header><text display-inline="yes-display-inline">If Solano County, California (in this section referred to as the <quote>County</quote>) conveys to the Secretary of Agriculture all right, title, and interest of the County in and to four parcels of land consisting of a total of approximately 160 acres identified on the map entitled <quote>Fouts Springs-Deafy Glade Federal and Non-Federal Lands</quote> and dated July 17, 2008, the Secretary shall convey to the County, in exchange, all right, title, and interest of the United States in and to the parcel of land in the Mendocino National Forest in the State of California (including any improvements on the land) comprising approximately 82 acres and known as the Fouts Springs Ranch, as also depicted on the map.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HD539CC50E78845E7B55468CA31D1EDA"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of map</header><text display-inline="yes-display-inline">The map referred to in subsection (a) shall be on file and available for public inspection in the Office of the Chief of the Forest Service. With the agreement of the County, the Secretary may make technical corrections to the map and the legal descriptions of the land to be exchanged under this section.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H8DE78BE382FC4EE69DB9387B64959700"><enum>(c)</enum><header display-inline="yes-display-inline">Land exchange process</header><text display-inline="yes-display-inline">Section 206 of the Federal Land Policy and Management Act of 1976 (<external-xref legal-doc="usc" parsable-cite="usc/43/1716">43 U.S.C. 1716</external-xref>) shall apply to the land exchange under this section.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HE2B1AD6C536342678B22809D6200FA1C"><enum>(d)</enum><header display-inline="yes-display-inline">Survey and Administrative Costs</header><text display-inline="yes-display-inline">The exact acreage and legal description of the land to be exchanged under subsection (a) shall be determined by a survey satisfactory to the Secretary. The costs of the survey and any administrative costs related to the land exchange shall be borne by the County.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H1AACD10B52B14D999B368700AC84BB00"><enum>(e)</enum><header display-inline="yes-display-inline">Condition on use of conveyed land</header><text display-inline="yes-display-inline">As a condition of the conveyance to the County under subsection (a), the County shall agree to continue to use the land acquired by the County under such subsection for purposes consistent with the purposes listed in the special use authorization for the Fouts Springs Ranch in effect as of the date of the enactment of this Act.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HDD33EAD502664C9BA86CF1BC90922BD8"><enum>(f)</enum><header display-inline="yes-display-inline">Easement authority</header><text display-inline="yes-display-inline">The Secretary may grant an easement to provide continued access to, and maintenance and use of, the facilities covered by the special use authorization referred to in subsection (e) as necessary for the continued operation of the Fouts Springs Ranch conveyed under subsection (a).</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="H5177BC1D2DF84CE69DCEA78845EF31AD"><enum>(g)</enum><header display-inline="yes-display-inline">Management of acquired land</header><text display-inline="yes-display-inline">The lands acquired by the Secretary under subsection (a) shall be added to and administered as part of the Mendocino National Forest and managed in accordance with the Act of March 1, 1911 (commonly known as the Weeks Act; <external-xref legal-doc="usc" parsable-cite="usc/16/480">16 U.S.C. 480 et seq.</external-xref>) and the laws and regulations applicable to the National Forest System.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF918592E44854CB5BB28A47707B20063"><enum>(h)</enum><header display-inline="yes-display-inline">Additional terms and conditions</header><text display-inline="yes-display-inline">The land exchange under subsection (a) shall be subject to such additional terms and conditions as the Secretary and the County may agree upon.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="HF4C683F5973E4CB7AA6EE12131FD567E"><enum>(i)</enum><header display-inline="yes-display-inline">Cancellation of portion of unobligated balance in FLREA special account</header><text display-inline="yes-display-inline">The amount available for obligation as of the date of the enactment of this Act from the unobligated balance in the special account established for the Forest Service under section 807 of the Federal Lands Recreation Enhancement Act (<external-xref legal-doc="usc" parsable-cite="usc/16/6806">16 U.S.C. 6806</external-xref>) is reduced by a total of $60,000, and the amount so reduced is hereby cancelled.</text> </subsection></section>

<subsection id="ID4f6924ffc4c845e3a6e570f00f2063b5"><enum>(a)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="IDe0f64adb847a4343af906c4505ed8c0d"><enum>(1)</enum><header>County</header><text>The term <term>County</term> means Solano County, California.</text> </paragraph>
<paragraph id="ID6cb5c886ca4449ccaab02fab8ecca4dd"><enum>(2)</enum><header>Federal land</header><text>The term <term>Federal land</term> means the parcel of approximately 82 acres of land—</text> 
<subparagraph id="ID6b16b7d48f15448b95bed085fc454633"><enum>(A)</enum><text>known as the <quote>Fouts Springs Ranch</quote>; and</text> </subparagraph>
<subparagraph id="IDc6d5a814639a4171a111101d9d8075c4"><enum>(B)</enum><text>generally depicted as the <quote>Fouts Springs Parcel</quote> on the map.</text> </subparagraph></paragraph>
<paragraph id="ID563924e5825745fdb91cc4604ab95472"><enum>(3)</enum><header>Map</header><text>The term <term>map</term> means the map entitled <quote>Fouts Springs-Deafy Glade: Federal and Non-Federal Lands</quote> and dated July 17, 2008.</text> </paragraph>
<paragraph id="ID3b17e2f7cabd447386de3ba6114d5d6f"><enum>(4)</enum><header>Non-Federal land</header><text>The term <term>non-Federal land</term> means the 4 parcels of land comprising approximately 160 acres that are generally depicted as the <quote>Deafy Glade Parcel</quote> on the map.</text> </paragraph>
<paragraph id="ID73dc0f3e37944437b52f11176fd5060d"><enum>(5)</enum><header>Secretary</header><text>The term <term>Secretary</term> means the Secretary of Agriculture.</text> </paragraph></subsection>
<subsection id="ID451dede119354275a23e6f5b2a9c31c6"><enum>(b)</enum><header>Land exchange required</header><text>Subject to subsections (c) through (f), if the County conveys to the United States such right, title, and interest in and to the non-Federal land that is acceptable to the Secretary, the Secretary shall convey to the County such right, title, and interest to the Federal land that the Secretary considers to be appropriate.</text> </subsection>
<subsection id="ID705206891a5f4f11b2c59f942ab03002"><enum>(c)</enum><header>Applicable Law</header><text>Section 206 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1716) shall apply to the land exchange under this section.</text> </subsection>
<subsection id="ID7e26407a76bf4df8962f11bbc316afbf"><enum>(d)</enum><header>Survey; administrative costs</header> 
<paragraph id="ID5b9103b586e7428fa8d4287b493235f0"><enum>(1)</enum><header>In general</header><text>The exact acreage and legal description of the land to be exchanged under subsection (b) shall be determined by a survey satisfactory to the Secretary.</text> </paragraph>
<paragraph id="ID5402070b0cbf4c89825e27d668e4acbc"><enum>(2)</enum><header>Costs</header><text>The costs of the survey, appraisal, and any other administrative costs relating to the land exchange shall be paid by the County.</text> </paragraph></subsection>
<subsection id="IDb8e277719b744e03860e7d111cae1a9d"><enum>(e)</enum><header>Management of acquired land</header><text>The non-Federal land acquired by the Secretary under subsection (b) shall be—</text> 
<paragraph id="IDb7c7b80f11fc414484da851572ec1378"><enum>(1)</enum><text>added to, and administered as part of, the Mendocino National Forest; and</text> </paragraph>
<paragraph id="ID6310b1d386dc4a00a1a388b82612b81c"><enum>(2)</enum><text>managed in accordance with—</text> 
<subparagraph id="ID9f1656fab72e4ab2bd137d78c61e75c7"><enum>(A)</enum><text>the Act of March 1, 1911 (commonly known as the <quote>Weeks Law</quote>) (16 U.S.C. 480 et seq.); and</text> </subparagraph>
<subparagraph id="IDf9658925e98f4da09d60f830eefb2cb8"><enum>(B)</enum><text>the laws (including regulations) applicable to the National Forest System.</text> </subparagraph></paragraph></subsection>
<subsection id="IDd9126436636246c89008ea6b68af946d"><enum>(f)</enum><header>Additional terms and conditions</header><text>The land exchange under subsection (b) shall be subject to any additional terms and conditions that the Secretary may require, including such terms and conditions as are necessary to ensure that the use of the Federal land does not adversely impact the use of the adjacent National Forest System land.</text> </subsection></section>
