		  insurance for totally disabled veterans</header><text display-inline="no-display-inline">Section 1922A(a) is amended by striking
		  <quote>$20,000</quote> and inserting <quote>$30,000</quote>.</text>

		  amended to read as follows:</text>

			 Reserve of a uniformed service who meets the qualifications set forth in
			 subparagraph (B) or (C) of section 1965(5) of this title, 120 days after
			 separation or release from such assignment; or</text>

		  Servicemembers' Group Life Insurance</header>
							<subsection commented="no" display-inline="no-display-inline" id="id74EACB7F8FE94AF98F0A8E50CF18DF21"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Paragraph (1) of section 501(b) of the
		  Veterans' Housing Opportunity and Benefits Improvement Act of 2006 (Public Law
		  109–233; 120 Stat. 414; 38 U.S.C. 1980A note) is amended by striking <quote>,
		  if, as determined by the Secretary concerned, that loss was a direct result of
		  a traumatic injury incurred in the theater of operations for Operation Enduring
		  Freedom or Operation Iraqi Freedom</quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idBC183F0A383446FF991F0E8B0F47B09F"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">The heading of such section is amended by
		  striking <quote><header-in-text level="subsection" style="OLC">in Operation
		  Enduring Freedom and Operation Iraqi Freedom</header-in-text></quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id9A63164AB08E4F60A30ED6EB5D2ECE9E"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
		  date</header><text display-inline="yes-display-inline">The amendments made by
		  this section shall take effect on October 1, 2010.</text>

		  Group Life Insurance</header>
							<subsection commented="no" display-inline="no-display-inline" id="idB43E7368BDEF4234B86000531149FE1E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1980A(d) is amended—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id8EAF9C41E36D4BD685D3EF12E3DCE15E"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Payments under</quote>
		  and inserting <quote>(1) Payments under</quote>; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF364BD099D9748E3913AFB401D62B7F7"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
		  paragraph:</text>

			 schedule required by paragraph (1) may distinguish in specifying payments for
			 qualifying losses between the severity of a qualifying loss of a dominant hand
			 and a qualifying loss of a nondominant
			 hand.</text>

								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8CCE5AEE951D4ADEB5EDAF7869C9D26A"><enum>(b)</enum><header display-inline="yes-display-inline">Payments for qualifying losses incurred
		  before date of enactment</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id536498098A94426EB4574FF2C353FDD9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
		  prescribe in regulations mechanisms for payments under section 1980A of title
		  38, United States Code, for qualifying losses incurred before the date of the
		  enactment of this Act by reason of the requirements of paragraph (2) of
		  subsection (d) of such section (as added by subsection (a)(2) of this
		  section).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE27A6210D9D24D2F9813D8C888302D51"><enum>(2)</enum><header display-inline="yes-display-inline">Qualifying loss defined</header><text display-inline="yes-display-inline">In this subsection, the term
		  <term>qualifying loss</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="idE6DCEA9E00B54793AFC35B62621424C9"><enum>(A)</enum><text display-inline="yes-display-inline">a loss specified in the second sentence of
		  subsection (b)(1) of section 1980A of title 38, United States Code; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9BB38C91F53D4E8692B638BEC23C73BC"><enum>(B)</enum><text display-inline="yes-display-inline">any other loss specified by the Secretary
		  of Veterans Affairs pursuant to the first sentence of that subsection.</text>
									</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idACCCCB001937472CA0F8F6868F7BBA2B" section-type="subsequent-section"><enum>105.</enum><header display-inline="yes-display-inline">Enhancement of veterans' mortgage life
		  insurance</header>
							<subsection commented="no" display-inline="no-display-inline" id="id3E0FA3AAF53548299B0D1CA5F5E9E0A4"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 2106(b) is amended by striking
		  <quote>$90,000</quote> and inserting <quote>$150,000, or $200,000 after January
		  1, 2012,</quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id52F794A7D422494BB257700E264051C1"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
		  date</header><text display-inline="yes-display-inline">The amendment made by
		  subsection (a) shall take effect on October 1, 2010.</text>
							</subsection></section></title><title commented="no" id="id54d0dd08-fbd5-4d6c-abd9-d0adc5052818" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Compensation and pension matters</header>
						<section commented="no" display-inline="no-display-inline" id="id66AD83E4A1E0438AB7040B0E61912CFD" section-type="subsequent-section"><enum>201.</enum><header display-inline="yes-display-inline">Cost-of-living increase for temporary
		  dependency and indemnity compensation payable for surviving spouses with
		  dependent children under the age of 18</header><text display-inline="no-display-inline">Section 1311(f) is amended—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="id7286473A68CC4C5FBD33D23F98A2544B"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by inserting <quote>(as
		  increased from time to time under paragraph (4))</quote> after
		  <quote>$250</quote>;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0216CDE3C75946CAA36C58F13E99DA90"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph
		  (5); and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6241BB97270B47C3B2044B3F7BEDE900"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
		  following new paragraph (4):</text>
								<quoted-block changed="added" display-inline="no-display-inline" id="iddf23296f-b6d1-496f-9644-789a344e226c" reported-display-style="italic" style="USC">
									<paragraph commented="no" display-inline="no-display-inline" id="id914ea3a8-f521-4e62-91f1-01105ddd5d0e" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Whenever there is an increase in benefit
			 amounts payable under title II of the Social Security Act (42 U.S.C. 401 et
			 seq.) as a result of a determination made under section 215(i) of such Act (42
			 U.S.C. 415(i)), the Secretary shall, effective on the date of such increase in
			 benefit amounts, increase the amount payable under paragraph (1), as such
			 amount was in effect immediately prior to the date of such increase in benefit
			 amounts, by the same percentage as the percentage by which such benefit amounts
			 are increased. Any increase in a dollar amount under this paragraph shall be
			 rounded down to the next lower whole dollar
			 amount.</text>
									</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></section><section commented="no" display-inline="no-display-inline" id="idc6930e38-1140-485f-9487-c979dacbb3b4" section-type="subsequent-section"><enum>202.</enum><header display-inline="yes-display-inline">Eligibility of veterans 65 years of age or
		  older for service pension for a period of war</header>
							<subsection commented="no" display-inline="no-display-inline" id="idde73a6e2-4a90-4b52-b88f-86c5f9246d99"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 1513 is amended—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id4190c616-dde4-453c-a409-351eaa593774"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a), by striking <quote>by
		  section 1521</quote> and all that follows and inserting <quote>by subsection
		  (b), (c), (f)(1), (f)(5), or (g) of that section, as the case may be and as
		  increased from time to time under section 5312 of this title.</quote>;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idfe2e9a93-2691-48b9-8a12-21a6fcd05e6e"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (b) as
		  subsection (c); and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9c526233-5495-4591-86b0-76116ea37f32"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after subsection (a) the
		  following new subsection (b):</text>
									<quoted-block changed="added" display-inline="no-display-inline" id="id6d998427-331b-4711-8b61-c7e2dbd66501" reported-display-style="italic" style="USC">
										<subsection commented="no" display-inline="no-display-inline" id="id08ea0aa4-7564-44e3-aae7-885cc326b154"><enum>(b)</enum><text display-inline="yes-display-inline">The conditions in subsections (h) and (i)
			 of section 1521 of this title shall apply to determinations of income and
			 maximum payments of pension for purposes of this
			 section.</text>
										</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id3b171253-acb6-4299-b149-9d3c18f24b24"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendments made by this section shall
		  apply with respect to any claim for pension filed on or after the date of the
		  enactment of this Act.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="idE3B53F84464342B88021D1544EE8303D" section-type="subsequent-section"><enum>203.</enum><header display-inline="yes-display-inline">Clarification of additional requirements
		  for consideration to be afforded time, place, and circumstances of service in
		  determinations regarding service-connected disabilities</header>
							<subsection commented="no" display-inline="no-display-inline" id="idCB9E52D7C0614F69B36D4A6F6C2ED14E"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (a) of section 1154 is amended
		  to read as follows:</text>

			 regulations pertaining to service-connection of disabilities the

										<paragraph commented="no" display-inline="no-display-inline" id="id28C8EEFA3ED642159CE0ECD7924ED12C"><enum>(1)</enum><text display-inline="yes-display-inline">Provisions requiring that, in each case
			 where a veteran is seeking service-connection for any disability, due
			 consideration shall be given to the places, types, and circumstances of such
			 veteran's service as shown by—</text>
											<subparagraph commented="no" display-inline="no-display-inline" id="id0FF09902018546CDB7AACAB524BB3763"><enum>(A)</enum><text display-inline="yes-display-inline">such veteran's service record;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id76A174BD690B46FABFB2548B1135E9BF"><enum>(B)</enum><text display-inline="yes-display-inline">the official history of each organization
			 in which such veteran served;</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id942E5D8E74C243CCB7EADE003F5FC076"><enum>(C)</enum><text display-inline="yes-display-inline">such veteran's medical records; and</text>
											</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFDBAF777623949F5BF1395E1212817E0"><enum>(D)</enum><text display-inline="yes-display-inline">all pertinent medical and lay
			 evidence.</text>
											</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2dd99709a23e448e98ae6968180118ed"><enum>(2)</enum><text display-inline="yes-display-inline">Provisions generally recognizing
			 circumstances in which lay evidence consistent with the place, conditions,
			 dangers, or hardships associated with particular military service does not
			 require confirmatory official documentary evidence in order to establish the
			 occurrence of an event or exposure during active military, naval, or air
			 service.</text>
										</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAC02252E3F484313B7E73BD0AA6E8249"><enum>(3)</enum><text display-inline="yes-display-inline">The provisions required by section 5 of the
			 Veterans' Dioxin and Radiation Exposure Compensation Standards Act (Public Law
			 98–542; 98 Stat.

							</subsection><subsection commented="no" display-inline="no-display-inline" id="id8531256AF6354F10A76A52C36D1212E6"><enum>(b)</enum><header display-inline="yes-display-inline">Regulations</header>
								<paragraph commented="no" display-inline="no-display-inline" id="id921FCF91B3F144E98F6519DC5C300DE6"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 210 days after the date of
		  the enactment of this Act, the Secretary of Veterans Affairs shall promulgate
		  regulations to implement section 1154(a)(2) of title 38, United States Code, as
		  added by subsection (a).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id361E479D610F43FEBBCBD64B6882B4A0"><enum>(2)</enum><header display-inline="yes-display-inline">Interim regulations</header><text display-inline="yes-display-inline">In the case that the Secretary is unable to
		  promulgate final regulations under paragraph (1) on or before the date that is
		  210 days after the date of the enactment of this Act, the Secretary shall
		  promulgate interim regulations on or before such date to be in effect until
		  such time as the Secretary promulgates final regulations.</text>

		  veterans covered by Medicaid plans for services furnished by nursing

			 regular aid and attendance would require hospitalization, nursing home care, or
			 other residential institutional care, the veteran shall be paid, in addition to
			 any other compensation under this section, a monthly aid and attendance
			 allowance equal to the rate described in subsection (r)(2), which for purposes
			 of section 1134 of this title shall be considered as additional compensation
			 payable for disability. An allowance authorized under this subsection shall be
			 paid in lieu of any allowance authorized by subsection
			 (r)(1).</text>

			 another applicable provision of law.</text>
											</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="idC651A5DE055D43649C4D483372436643" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">In this paragraph, the term
			 <term>catastrophic disability</term>, with respect to a veteran, means a
			 permanent, severely disabling injury, disorder, or disease that compromises the
			 ability of the veteran to carry out the activities of daily living to such a
			 degree that the veteran requires personal or mechanical assistance to leave
			 home or bed, or requires constant supervision to avoid physical harm to self or
			 others.</text>
											</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id905D5165D44E427381D8EF6054421526"><enum>(b)</enum><header display-inline="yes-display-inline">Effective
		  date</header><text display-inline="yes-display-inline">The amendments made by
		  subsection (a) shall take effect on the date of the enactment of this Act and
		  shall apply with respect to awards of compensation based on original claims
		  that become effective on or after that date.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id219EF99E3B534F24BB2D59133028398F"><enum>(c)</enum><header display-inline="yes-display-inline">Technical correction regarding waiver of
		  retired pay</header><text display-inline="yes-display-inline">Section 5305 is
		  amended by striking <quote>section 1414</quote> and inserting <quote>sections

									<subsection commented="no" display-inline="no-display-inline" id="idD07544EAF9594E7FBA614BE5A99B47EB"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="id8EC1D9E1A2A74A92804F890BCE06A457"><enum>(1)</enum><text display-inline="yes-display-inline">Effective on October 1 of each year
			 (beginning in 2011), the Secretary shall increase the dollar amount in effect
			 under subsection (a) to an amount equal to 80 percent of the average retail
			 cost of new automobiles for the preceding calendar year.</text>
										</paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="id64D97018ABB9473A97639D7EA52C25AF" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary shall establish the method
			 for determining the average retail cost of new automobiles for purposes of this
			 subsection. The Secretary may use data developed in the private sector if the
			 Secretary determines the data is appropriate for purposes of this
			 subsection.</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id4D8C6EC36F98415F8AAC9C0671A375F1"><enum>(c)</enum><header display-inline="yes-display-inline">Effective
		  date</header><text display-inline="yes-display-inline">The amendments made by
		  this section shall take effect on October 1, 2010.</text>
							</subsection></section><section commented="no" display-inline="no-display-inline" id="idDFEEEF27C04A4A4C906F67938A1A24D8" section-type="subsequent-section"><enum>304.</enum><header display-inline="yes-display-inline">Payment of unpaid balances of Department of
		  Veterans Affairs guaranteed loans</header><text display-inline="no-display-inline">Section 3732(a)(2) is amended—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID93ad59a391d54fe89e908c211b4991e0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Before suit</quote> and
		  inserting <quote>(A) Before suit</quote>; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB84244BEE26B4E88AA18FD480A4D8087"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
		  subparagraph:</text>

			 under this chapter is modified under the authority provided under section
			 1322(b) of title 11, the Secretary may pay the holder of the obligation the
			 unpaid balance of the obligation due as of the date of the filing of the
			 petition under title 11 plus accrued interest, but only upon the assignment,
			 transfer, and delivery to the Secretary (in a form and manner satisfactory to
			 the Secretary) of all rights, interest, claims, evidence, and records with
			 respect to the housing
			 loan.</text>
									</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph></section></title><title commented="no" id="id2967E6A522294A13B3A7CC5186232AAD" level-type="subsequent"><enum>IV</enum><header display-inline="yes-display-inline">Employment and reemployment rights of
		  members of the Uniformed Services</header>
						<section commented="no" display-inline="no-display-inline" id="HE08F9AF29C404D3A00DC41F7034E34FC" section-type="subsequent-section"><enum>401.</enum><header display-inline="yes-display-inline">Waiver of sovereign immunity under the 11th
		  Amendment with respect to enforcement of USERRA</header>
							<subsection commented="no" display-inline="no-display-inline" id="idEAAE85C9E3154676AA90D38ADA8D9D62"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 4323 is amended—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="H1DAD5D923B24494780FA9B7BE48B2EB5"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b) by striking paragraph (2)
		  and inserting the following new paragraph:</text>

			 financial assistance for any program or activity of a State shall constitute a
			 waiver of sovereign immunity, under the 11th amendment to the Constitution or
			 otherwise, to a suit brought by—</text>
												<subparagraph changed="added" commented="no" display-inline="no-display-inline" id="HF2ED98B2E3A148B280D0928E34004611" indent="up1" reported-display-style="italic"><enum>(A)</enum><text display-inline="yes-display-inline">a person who is or was an employee in that
			 program or activity for the rights or benefits authorized the person by this
			 chapter;</text>
												</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="H0093CC8161324369A8B4EA6D21D600F7" indent="up1" reported-display-style="italic"><enum>(B)</enum><text display-inline="yes-display-inline">a person applying to be such an employee in
			 that program or activity for the rights or benefits authorized the person by
			 this chapter; or</text>
												</subparagraph><subparagraph changed="added" commented="no" display-inline="no-display-inline" id="H22176078772B4D34AC25512E44C898EF" indent="up1" reported-display-style="italic"><enum>(C)</enum><text display-inline="yes-display-inline">a person seeking reemployment as an
			 employee in that program or activity for the rights or benefits authorized the
			 person by this chapter.</text>
												</subparagraph></paragraph><paragraph changed="added" commented="no" display-inline="no-display-inline" id="H135637C1F01444DEB65C1ED5256700F" indent="up1" reported-display-style="italic"><enum>(2)</enum><text display-inline="yes-display-inline">In this subsection, the term <term>program
			 or activity</term> has the meaning given that term in section 309 of the
			 <act-name parsable-cite="ADA75">Age Discrimination Act of 1975</act-name> (42
			 U.S.C.
			 6107).</text>
											</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idD18870348DDC498798C58B230398A3F2"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">The amendments made by subsection (a) shall
		  apply to—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id793FAD2741B641039F671DEEEA9505CD"><enum>(1)</enum><text display-inline="yes-display-inline">any failure to comply with a provision of
		  or any violation of chapter 43 of title 38, United States Code, that occurs
		  before, on, or after the date of the enactment of this Act; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idAD4B58AA787543BB93870116AC512D1C"><enum>(2)</enum><text display-inline="yes-display-inline">all actions or complaints filed under such
		  chapter 43 that are commenced after the date of the enactment of this
		  Act.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="HB321A45F253449E589B46E49C29733D5" section-type="subsequent-section"><enum>402.</enum><header display-inline="yes-display-inline">Clarifying the definition of
		  <quote>successor in interest</quote></header>
							<subsection commented="no" display-inline="no-display-inline" id="id9A9C3155E5FB4336BF91E55AE996F522"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 4303(4) is amended by adding at the
		  end the following new subparagraph:</text>
								<quoted-block changed="added" display-inline="no-display-inline" id="HF5AF502E20EF4A02817DB25487A7FC70" reported-display-style="italic" style="OLC">
									<subparagraph commented="no" display-inline="no-display-inline" id="H63FC3C86B6914ED9BD00ACE0CBC342B4" indent="up1"><enum>(D)</enum><clause commented="no" display-inline="yes-display-inline" id="H7C4B35D0F43740D8AE427E15E1F3B9C"><enum>(i)</enum><text display-inline="yes-display-inline">Whether the term <term>successor in
			 interest</term> applies with respect to an entity described in subparagraph (A)
			 for purposes of clause (iv) of such subparagraph shall be determined on a
			 case-by-case basis using a multi-factor test that considers the following
			 factors:</text>
											<subclause changed="added" commented="no" display-inline="no-display-inline" id="H37BE33F6685F4FA4B092A5A45FDECB35" indent="up1" reported-display-style="italic"><enum>(I)</enum><text display-inline="yes-display-inline">Substantial continuity of business
			 operations.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="H94B51821BDC74681B288C7C9124736AD" indent="up1" reported-display-style="italic"><enum>(II)</enum><text display-inline="yes-display-inline">Use of the same or similar
			 facilities.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="H73A79E6307354B558482F417F24E887B" indent="up1" reported-display-style="italic"><enum>(III)</enum><text display-inline="yes-display-inline">Continuity of work force.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="H18A5458D9CF5425A9F48D88B8F30FD4B" indent="up1" reported-display-style="italic"><enum>(IV)</enum><text display-inline="yes-display-inline">Similarity of jobs and working
			 conditions.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="HE5AAFE83068642EDA4443ED7FF001C7E" indent="up1" reported-display-style="italic"><enum>(V)</enum><text display-inline="yes-display-inline">Similarity of supervisory personnel.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="H0A8A2F6BB80041B8007529BC386BE65D" indent="up1" reported-display-style="italic"><enum>(VI)</enum><text display-inline="yes-display-inline">Similarity of machinery, equipment, and
			 production methods.</text>
											</subclause><subclause changed="added" commented="no" display-inline="no-display-inline" id="H5273B3BA003F4F9798FFD8BD53D74CB0" indent="up1" reported-display-style="italic"><enum>(VII)</enum><text display-inline="yes-display-inline">Similarity of products or services.</text>
											</subclause></clause><clause changed="added" commented="no" display-inline="no-display-inline" id="HE0877AEA56E6402786CC1234E375954" indent="up1" reported-display-style="italic"><enum>(ii)</enum><text display-inline="yes-display-inline">The entity's lack of notice or awareness of
			 a potential or pending claim under this chapter at the time of a merger,
			 acquisition, or other form of succession shall not be considered when applying
			 the multi-factor test under clause
			 (i).</text>
										</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idC351CFC392E440FCBD563692FF2F530F"><enum>(b)</enum><header display-inline="yes-display-inline">Application</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall
		  apply to—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id82E17F007F1F48768C03219F15DE5A26"><enum>(1)</enum><text display-inline="yes-display-inline">any failure to comply with a provision of
		  or any violation of chapter 43 of title 38, United States Code, that occurs
		  before, on, or after the date of the enactment of this Act; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idF129A6184BB84B8E969AE5F224AB63E3"><enum>(2)</enum><text display-inline="yes-display-inline">all actions or complaints filed under such
		  chapter 43 that are pending on or after the date of the enactment of this
		  Act.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="H7001EE785EE1441EA511B3E875BFF8F1" section-type="subsequent-section"><enum>403.</enum><header display-inline="yes-display-inline">Clarifying that USERRA prohibits wage
		  discrimination against members of the Armed Forces</header>
							<subsection commented="no" display-inline="no-display-inline" id="idB8E303F109024AA8ADF098380F38EB76"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 4303(2) is amended by striking

							<subsection commented="no" display-inline="no-display-inline" id="idFAB7C5DD91A94408B0C4886B340A5440"><enum>(a)</enum><header display-inline="yes-display-inline">Study
		  required</header><text display-inline="yes-display-inline">The Comptroller
		  General of the United States shall conduct a study on the effectiveness of
		  Federal programs of education and outreach on employer obligations under
		  chapter 43 of title 38, United States Code.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idDAE1457007304DFD8C99EF41B7ABB651"><enum>(b)</enum><header display-inline="yes-display-inline">Contents of study</header><text display-inline="yes-display-inline">In carrying out the study required by
		  subsection (a), the Comptroller General shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idD57E19B322264EDA8F5D482FD7E75A0D"><enum>(1)</enum><text display-inline="yes-display-inline">assess current practices and procedures of
		  Federal agencies for educating employers about their obligations under chapter
		  43 of title 38, United States Code;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCF3A8256FDAC4AE8BBC863C84C321522"><enum>(2)</enum><text display-inline="yes-display-inline">identify best practices for bringing the
		  employment practices of small businesses into compliance with such
		  chapter;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6D2AEB3E44324762B9CA90107B2F2279"><enum>(3)</enum><text display-inline="yes-display-inline">determine whether the Employer Support for
		  the Guard and Reserve, the Small Business Administration, or other agencies
		  could collaborate to develop a program to educate employers regarding their
		  obligations under such chapter; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id042215DB98AF4DCABA3899EBB4B9AFFE"><enum>(4)</enum><text display-inline="yes-display-inline">determine the effect on recruitment and
		  retention in the National Guard and Reserves of the failure of employers to
		  meet their reemployment obligations under such chapter.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA6F5B2EE55FA46469CD6453EF1537B88"><enum>(c)</enum><header display-inline="yes-display-inline">Report to Congress</header><text display-inline="yes-display-inline">Not later than June 30, 2010, the
		  Comptroller General shall submit to Congress a report on the study conducted
		  under subsection (a), including the following:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="idDB714EEA2D2A4CCBA832D534A4A70FEC"><enum>(1)</enum><text display-inline="yes-display-inline">The findings of the Comptroller General
		  with respect to such study.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6EA2A129D0E744D7AF7CBD2974E03BE9"><enum>(2)</enum><text display-inline="yes-display-inline">The recommendations of the Comptroller
		  General for the improvement of education and outreach for employers with
		  respect to their obligations under chapter 43 of title 38, United States
		  Code.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id4A0292078CBC4692AEEFDF4F7C770947" section-type="subsequent-section"><enum>406.</enum><header display-inline="yes-display-inline">Technical amendments</header>

							</subsection><subsection id="IDB6A5072572AB44DBB8125DC8C4E858FD"><enum>(b)</enum><header>Increase in amount of
		  plot allowances</header><text>Section 2303(b) is amended by striking
		  <quote>$300</quote> each place it appears and inserting <quote>$745 (as
		  increased from time to time under subsection (c))</quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id2B67B0BD20E24972830916CFC9221182"><enum>(c)</enum><header>Annual
		  adjustment</header><text>Section 2303 is amended by adding at the end the
		  following new subsection:</text>
								<quoted-block changed="added" display-inline="no-display-inline" id="idFC5C2F58AFBC4787B91FD63505E8587F" reported-display-style="italic" style="OLC">
									<subsection commented="no" display-inline="no-display-inline" id="idDB8E4EC27718402587641BBE68E9E125"><enum>(c)</enum><text>With respect to any
			 fiscal year, the Secretary shall provide a percentage increase (rounded to the
			 nearest dollar) in the burial and funeral expenses under subsection (a) and in
			 the plot allowance under subsection (b), equal to the percentage by
			 which—</text>
										<paragraph id="ID770B0E4F15084F7AB4E5FC094FDA0076"><enum>(1)</enum><text>the Consumer Price Index
			 (all items, United States city average) for the 12-month period ending on the
			 June 30 preceding the beginning of the fiscal year for which the increase is
			 made, exceeds</text>
										</paragraph><paragraph id="ID9304B44C295D4C86A03B349D0200B7B5"><enum>(2)</enum><text>the Consumer Price Index
			 for the 12-month period preceding the 12-month period described in paragraph
			 (1).</text>
										</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
							</subsection><subsection id="IDF8C7625881104D16BB9D4F240086F3A8"><enum>(d)</enum><header>Effective date</header>
								<paragraph id="idB5CB6BAA5CDC4A77BD3BD12A645DCB24"><enum>(1)</enum><header>In
		  general</header><text>Except as provided in paragraph (2), the amendments made
		  by this section shall apply with respect to deaths occurring on or after
		  October 1, 2010.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB125A388DCBF407E8C29B86162E9735D"><enum>(2)</enum><header>Prohibition on
		  cost-of-living adjustment for fiscal year 2011</header><text>No adjustments
		  shall be made under section 2303(c) of title 38, United States Code, as added
		  by subsection (c), for fiscal year 2011.</text>
								</paragraph></subsection></section></title><title commented="no" id="idb163f819-15d1-46d6-93a1-bbba870739d1" level-type="subsequent"><enum>VI</enum><header display-inline="yes-display-inline">Other matters</header>
						<section commented="no" display-inline="no-display-inline" id="idBD38FBC25BD64FF9852A904DDC723F2B" section-type="subsequent-section"><enum>601.</enum><header display-inline="yes-display-inline">National Academies review of best
		  treatments for Gulf War Illness</header>
							<subsection commented="no" display-inline="no-display-inline" id="id6FAA506AD692421AB6F919F177F596FD"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall
		  enter into a contract with the Institute of Medicine of the National Academies
		  to conduct a comprehensive review of the best treatments for Gulf War
		  Illness.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id36E3BFCEA2CC442BA793EAF6CA65FA60"><enum>(b)</enum><header display-inline="yes-display-inline">Group of medical
		  professionals</header><text display-inline="yes-display-inline">In conducting
		  the study required under subsection (a), the Institute of Medicine shall
		  convene a group of medical professionals who are experienced in treating
		  individuals diagnosed with Gulf War illness as follows:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id63489D04107844DEB1FDBAD69E4E185F"><enum>(1)</enum><text display-inline="yes-display-inline">Members of the Armed Forces who served
		  during the Persian Gulf War in the Southwest Asia theater of operations.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id22CBCA001532452097B0553A36C11576"><enum>(2)</enum><text display-inline="yes-display-inline">Members of the Armed Forces who served in
		  the Post 9/11 Global Operations theaters.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idA7E7046C703946DCA9F167D2F6460FFC"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header><text display-inline="yes-display-inline">The contract required by subsection (a)
		  shall require the Institute of Medicine to submit to the Secretary and to the
		  appropriate committees of Congress a report on the review required under
		  subsection (a) not later than December 31, 2011. The final report shall include
		  such recommendations for legislative or administrative action as the Institute
		  considers appropriate in light of the results of the review.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id38EB1966EC954243AB16ABCFE476F9B8"><enum>(d)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Secretary shall provide the Institute
		  of Medicine with such funds as are necessary to ensure the timely completion of
		  the review required under subsection (a).</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id4726763E6AE24D65881BBC1D5713EC2A"><enum>(e)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">In this section:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="id852259C81B284AA3849F5E7EA57D44B4"><enum>(1)</enum><header display-inline="yes-display-inline">Appropriate committees of
		  Congress</header><text display-inline="yes-display-inline">The term
		  <term>appropriate committees of Congress</term> means—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="id9836FCC5A61D453C8CDC56700889CD03"><enum>(A)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs of the
		  Senate; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id1DC2132918ED4CED8C813CD4C408C9B0"><enum>(B)</enum><text display-inline="yes-display-inline">the Committee on Veterans' Affairs of the
		  House of Representatives.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id528F75A5DBD14F0AA3A34AD7DFF25637"><enum>(2)</enum><header display-inline="yes-display-inline">Gulf War Illness</header><text display-inline="yes-display-inline">The term <term>Gulf War Illness</term>
		  means a medically unexplained chronic multisymptom illness, such as chronic
		  fatigue syndrome, fibromyalgia, and irritable bowel syndrome, that is defined
		  by a cluster of signs or symptoms relating to service in the Persian Gulf War
		  or Post 9/11 Global Operations theaters.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id137A9F116B22453097C75D43B0646070"><enum>(3)</enum><header display-inline="yes-display-inline">Persian Gulf War</header><text display-inline="yes-display-inline">The term <term>Persian Gulf War</term> has
		  the meaning given that term in section 101(33) of title 38, United States
		  Code.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2ED2B58234DC4CFF8E6EE1412EE969E4"><enum>(4)</enum><header display-inline="yes-display-inline">Post 9/11 Global Operations
		  theaters</header><text display-inline="yes-display-inline">The term <term>Post
		  9/11 Global Operations theaters</term> means Afghanistan, Iraq, or any other
		  theater in which the Global War on Terrorism Expeditionary Medal is awarded for
		  service.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id9A577C98EF2E40EEA7203E393B2F59A3" section-type="subsequent-section"><enum>602.</enum><header display-inline="yes-display-inline">Extension of National Academy of Sciences
		  reviews and evaluations regarding illness and service in Persian Gulf
		  War</header>
							<subsection commented="no" display-inline="no-display-inline" id="idA2E0CA072F26443A814F94DF3FDAC665"><enum>(a)</enum><header display-inline="yes-display-inline">Review and evaluation of toxic drugs and
		  illnesses associated with Persian Gulf War</header><text display-inline="yes-display-inline">Section 1603(j) of the Persian Gulf War
		  Veterans Act of 1998 (38 U.S.C. 1117 note) is amended by striking
		  <quote>October 1, 2010</quote> and inserting <quote>October 1,
		  2015</quote>.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="id8BEC088146844512B54590B0D19D61C9"><enum>(b)</enum><header display-inline="yes-display-inline">Review and evaluation of available evidence

		  Enhancement Act of 1998 (Public Law 105–368; 112 Stat. 3321) is amended by
		  striking <quote>11 years after</quote> and all that follows through
		  <quote>under subsection (b)</quote> and inserting <quote>on October 1,
		  2018</quote>.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1EB71BC47E0B4CBB824084CF71D63C7E"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Section 1604 of the Persian Gulf War
		  Veterans Act of 1998 (Public Law 105–277; 38 U.S.C. 1117 note) is
		  repealed.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="idE8C80ABF78B74982A392FA5C6421716F" section-type="subsequent-section"><enum>603.</enum><header display-inline="yes-display-inline">Extension of authority for regional office
		  in Republic of the Philippines</header><text display-inline="no-display-inline">Section 315(b) is amended by striking
		  <quote>December 31, 2009</quote> and inserting <quote>December 31,
		  2011</quote>.</text>
						</section><section commented="no" display-inline="no-display-inline" id="id4856EA51619E458FA1322C940FF526A4" section-type="subsequent-section"><enum>604.</enum><header display-inline="yes-display-inline">Aggregate amount of educational assistance
		  available to individuals who receive both survivors' and dependents educational
		  assistance and other veterans and related educational assistance</header>
							<subsection commented="no" display-inline="no-display-inline" id="idF7FA1983E9504AEDB738BFF37CE918CD"><enum>(a)</enum><header display-inline="yes-display-inline">Aggregate amount available</header><text display-inline="yes-display-inline">Section 3695 is amended—</text>

										</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id16BA3E4DE6DB41CD95C2B3148DB80241"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">The amendment made by subsection (a) shall
		  take effect on October 1, 2010, and shall not operate to revive any entitlement
		  to assistance under chapter 35 of title 38, United States Code, or the
		  provisions of law referred to in section 3695(a) of such title, as in effect on
		  the day before such date, that was terminated by reason of the operation of
		  section 3695(a) of such title, as so in effect, before such date.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="idF68828F5F0044511A1D2CEC4EB30CD53"><enum>(c)</enum><header display-inline="yes-display-inline">Revival of entitlement reduced by prior
		  utilization of chapter 35 assistance</header>
								<paragraph commented="no" display-inline="no-display-inline" id="idD6C8FD5E14FA44B18AC0097E727D0D04"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to paragraph (2), in the case of an
		  individual whose period of entitlement to assistance under a provision of law
		  referred to in section 3695(a) of title 38, United States Code (other than
		  chapter 35 of such title), as in effect on September 30, 2010, was reduced
		  under such section 3695(a), as so in effect, by reason of the utilization of
		  entitlement to assistance under chapter 35 of such title before October 1,
		  2010, the period of entitlement to assistance of such individual under such
		  provision shall be determined without regard to any entitlement so utilized by
		  the individual under chapter 35 of such title.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDFF85BDE530B466FA178B19E5BF867D6"><enum>(2)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">The maximum period of entitlement to
		  assistance of an individual under paragraph (1) may not exceed 81
		  months.</text>
								</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id94D9250768154DE7B7E1D83851BA0E0D" section-type="subsequent-section"><enum>605.</enum><header display-inline="yes-display-inline">Technical correction</header><text display-inline="no-display-inline">Section 5503(c) is amended by striking
		  <quote>veterans'</quote> and inserting <quote>veteran's</quote>.</text>
