		<section id="H7FFBD88BFA834B86943FB70A94C59AC7" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Thrift Store Protection
			 Act</short-title></quote>.</text>
		</section><section id="HDE11E32D469D49FB8FFFD28735001196"><enum>2.</enum><header>Certain
			 requirements inapplicable to second-hand sellers</header>
			<subsection id="H29A3AE7084914C719703852B1E56F738"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Notwithstanding any
			 other provision of law, for the 2-year period beginning on the date of
			 enactment of this Act, it shall not be a violation of subsections (a)(1) or
			 (a)(2) of section 19 of the Consumer Product Safety Act (15 U.S.C. 2068) or of
			 section 4(a) of the Federal Hazardous Substances Act (15 U.S.C. 1263(a)) for a
			 second-hand seller to sell, offer for sale, or distribute in commerce—</text>
				<paragraph id="HA40699BAA75D4FCAB35F8DE8B22E4B44"><enum>(1)</enum><text>a
			 specified used product for resale that is treated as a banned hazardous
			 substance under the <act-name parsable-cite="FHSA">Federal Hazardous Substances
			 Act</act-name> (15 U.S.C. 1261 et seq.) because of the application of section
			 101(a) of the Consumer Product Safety Improvement Act of 2008 (15 U.S.C.
			 1278a); or</text>
				</paragraph><paragraph id="H01C8D07EC5AC483D9D7105BE7C34C9B"><enum>(2)</enum><text display-inline="yes-display-inline">a specified used product without the label
			 required by section 14(c) of the Consumer Product Safety Act (15 U.S.C.
			 2063(c)).</text>
				</paragraph></subsection><subsection id="H167643BC18004C4A928EC320863DF663"><enum>(b)</enum><header>Definitions</header><text>In
			 this Act—</text>
				<paragraph id="H0E82B6890FE046E293BA4041FCB21092"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>specified used
			 product</term> means an article of clothing, a textile, shoes, or a book that,
			 when sold or offered for sale, has previously been purchased for use by a
			 consumer; and</text>
				</paragraph><paragraph id="HC05BFF5272BA472EA59BEEEDFCA98C00"><enum>(2)</enum><text>the term
			 <term>second-hand seller</term> means—</text>
					<subparagraph id="HE8D4358A6BC64E3499E7B887BC02C37B"><enum>(A)</enum><text>a consignment
			 shop, thrift shop, or similar enterprise that sells, offers for sale, or
			 distributes in commerce a product after the first retail sale of that
			 product;</text>
					</subparagraph><subparagraph id="H4C413057A05D4D27960122CA111B23AD"><enum>(B)</enum><text>an individual who
			 utilizes the Internet, a yard sale, or other casual means of selling, or
			 offering for sale, such a product; or</text>
					</subparagraph><subparagraph id="HF87C013E967846B3BC00574CC9E04285"><enum>(C)</enum><text>a person who
			 sells, or offers for sale, such a product at an auction for the benefit of a
			 nonprofit organization.</text>
					</subparagraph></paragraph></subsection></section><section id="H57D1EFB540254AE494DD2D5B73EAB171"><enum>3.</enum><header>GAO
			 Study</header><text display-inline="no-display-inline">The Comptroller General
			 shall conduct a study on the application of consumer product safety standards,
			 rules, and bans to specified used products and the impact that such application
			 has on second-hand sellers. Not later than 1 year after the date of enactment
			 of this Act, the Comptroller General shall transmit to Congress a report of the
			 study including—</text>
			<paragraph id="H5FBAA5DABD674BAB8ACC194F3100EF16"><enum>(1)</enum><text>recommendations on
			 whether and how to apply consumer product safety standards, rules, and bans to
			 such products and whether certain products can and should be exempted from such
			 standards, rules, or bans; and</text>
			</paragraph><paragraph id="H3F208D4C5F2648CEBFA76123B10F02E8"><enum>(2)</enum><text>any necessary
			 accommodations that should be made for second-hand sellers, including
			 recommendations for any necessary legislation.</text>
