			<subsection id="HE3994CD277FC4093B653FEA20209F710"><enum></enum><text display-inline="yes-display-inline">Congress finds
			 that—</text>
				<paragraph id="H30E635587B074A928001096500716C88"><enum>(1)</enum><text>violent crime and drug trafficking
			 are pervasive problems at the national, State, and local level;</text>
				</paragraph><paragraph id="H078437993A034AD093AE065D1D2529D6"><enum>(2)</enum><text>according to recent Federal Bureau
			 of Investigation, Uniform Crime Reports, violent crime in the United States is
			 on the rise, with a 2.3 percent increase in violent crime in 2005 (the largest
			 increase in the United States in 15 years) and an even larger 3.7 percent jump
			 during the first 6 months of 2006, and the Police Executive Research Forum
			 reports that, among jurisdictions providing information, homicides are up 10.21
			 percent, robberies are up 12.27 percent, and aggravated assaults with firearms
			 are up 9.98 percent since 2004;</text>
				</paragraph><paragraph id="H79F2D2ADD53A415F8553D0CE89A0A500"><enum>(3)</enum><text>these disturbing rises in violent
			 crime are attributable in part to the spread of criminal street gangs and the
			 willingness of gang members to commit acts of violence and drug trafficking
			 offenses;</text>
				</paragraph><paragraph id="HFBD27B2F00204357A1CEB925D2C5D5B2"><enum>(4)</enum><text>according to a recent National Drug
			 Threat Assessment, criminal street gangs are responsible for much of the retail
			 distribution of the cocaine, methamphetamine, heroin, and other illegal drugs
			 being distributed in rural and urban communities throughout the United
			 States;</text>
				</paragraph><paragraph id="H501AE51922D2466AA698292C6FAA8EA8"><enum>(5)</enum><text>gangs commit acts of violence or
			 drug offenses for numerous motives, such as membership in or loyalty to the
			 gang, for protecting gang territory, and for profit;</text>
				</paragraph><paragraph id="HD953BFF9AFF04E5CA9988B00F32158D8"><enum>(6)</enum><text>gang presence and intimidation, and
			 the organized and repetitive nature of the crimes that gangs and gang members
			 commit, has a pernicious effect on the free flow of interstate commercial
			 activities and directly affects the freedom and security of communities plagued
			 by gang activity, diminishing the value of property, inhibiting the desire of
			 national and multinational corporations to transact business in those
			 communities, and in a variety of ways directly and substantially affecting
			 interstate and foreign commerce;</text>
				</paragraph><paragraph id="HB9C4FFCA6D24480583A5D600360017CE"><enum>(7)</enum><text>gangs often recruit and utilize
			 minors to engage in acts of violence and other serious offenses out of a belief
			 that the criminal justice systems are more lenient on juvenile
			 offenders;</text>
				</paragraph><paragraph id="H2237242AA18A4059B73FC2BF39CAD938"><enum>(8)</enum><text>gangs often intimidate and threaten
			 witnesses to prevent successful prosecutions;</text>
				</paragraph><paragraph id="H2B42A407CB2349EF82D919E9000216C6"><enum>(9)</enum><text>gangs prey upon and incorporate
			 minors into their ranks, exploiting the fact that adolescents have immature
			 decision-making capacity, therefore, gang activity and recruitment can be
			 reduced and deterred through increased vigilance, appropriate criminal
			 penalties, partnerships between Federal and State and local law enforcement,
			 and proactive prevention and intervention efforts, particularly targeted at
			 juveniles and young adults, prior to and even during gang involvement;</text>
				</paragraph><paragraph id="HE74A60BD0A844D60A3A776EB3B7ED67E"><enum>(10)</enum><text>State and local prosecutors and
			 law enforcement officers have enlisted the help of Congress in the prevention,
			 investigation, and prosecution of gang crimes and in the protection of
			 witnesses and victims of gang crimes; and</text>
				</paragraph><paragraph id="H6F65E09D2AB5404AB38062C9771D826E"><enum>(11)</enum><text>because State and local
			 prosecutors and law enforcement have the expertise, experience, and connection
			 to the community that is needed to assist in combating gang violence,
			 consultation and coordination between Federal, State, and local law enforcement
			 and collaboration with other community agencies is critical to the successful
			 prosecutions of criminal street gangs and reduction of gang problems.</text>
				</paragraph></subsection></section><title committee-id="SSJU00" id="HB5D0721981CD4F8AAFD454A1820092EB"><enum>I</enum><header>New Federal
			 criminal laws needed to fight violent national, international, regional, and
			 local gangs that affect interstate and foreign commerce</header>
			<section id="H2094592DD19445DEA7C8F6DA4047D4B8"><enum>101.</enum><header>Revision and
			 extension of penalties related to criminal street gang activity</header>
				<subsection id="H3BB1BC836C424FE4AAC2D93176A2A19D"><enum>(a)</enum><header>In
			 General</header><text>Chapter 26 of title 18, United States Code, is amended to
			 read as follows:</text>

							<section id="HFDE97A75AB374AC69D3CBB20DD247E39"><enum>521.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter:</text>
								<paragraph id="HEB87B6E6E2C24120008E003E6220C1CC"><enum>(1)</enum><header>Criminal street
				gang</header><text display-inline="yes-display-inline">The term <term>criminal
				street gang</term> means a formal or informal group, organization, or
				association of 5 or more individuals—</text>
									<subparagraph id="HA83DF11949B04450B409E900ADEA7828"><enum>(A)</enum><text display-inline="yes-display-inline">each of whom has committed at least 1 gang
				crime; and</text>
									</subparagraph><subparagraph id="H98DA50937E9C45B3897430BBEACD9E9"><enum>(B)</enum><text display-inline="yes-display-inline">who collectively commit 3 or more gang
				crimes (not less than 1 of which is a serious violent felony, and if fewer than
				2 of which are serious violent felonies, not less than 1 of which is a violent
				felony) in furtherance of the group, organization, or association, in separate
				criminal episodes (not less than 1 of which occurs after the date of enactment
				of the <short-title>Gang Prevention, Intervention, and
				Suppression Act</short-title>, and the last of which occurs not later than 5
				years after the commission of a prior gang crime).</text>
									</subparagraph></paragraph><paragraph id="HFB9CC83953E14444B52CB491918EE3A"><enum>(2)</enum><header>Gang
				crime</header><text>The term <term>gang crime</term> means an offense under
				Federal law punishable by imprisonment for more than 1 year, or a felony
				offense under State law that is punishable by a term of imprisonment of 5 years
				or more in any of the following categories:</text>
									<subparagraph id="HB3325581B5394A49B85700CD62E36C2B"><enum>(A)</enum><text>A crime that has
				as an element the use, attempted use, or threatened use of physical force
				against the person of another, or is burglary, arson, kidnapping, or
				extortion.</text>
									</subparagraph><subparagraph id="H5CDB37710D50498BAFCED0028B8BA716"><enum>(B)</enum><text>A crime involving
				obstruction of justice, or tampering with or retaliating against a witness,
				victim, or informant.</text>
									</subparagraph><subparagraph id="H7FFF417FA0E945B196A67E009DC6001C"><enum>(C)</enum><text>A crime involving
				the manufacturing, importing, distributing, possessing with intent to
				distribute, or otherwise trafficking in a controlled substance or listed
				chemical (as those terms are defined in section 102 of the
				<act-name parsable-cite="CSA">Controlled Substances Act</act-name> (21 U.S.C.
				802)).</text>
									</subparagraph><subparagraph id="H3992FFB4C3C84AE0AE96A5D403FDC687"><enum>(D)</enum><text>Any conduct
				punishable under—</text>
										<clause id="HB485CA78E9AB495A90CC1C4C188F0067"><enum>(i)</enum><text>section 844
				(relating to explosive materials);</text>
										</clause><clause id="H1A2C12DE99CB4ABAB81D0068B87689EF"><enum>(ii)</enum><text>subsection
				(a)(1), (d), (g)(1) (where the underlying conviction is a violent felony or a
				serious drug offense (as those terms are defined in section 924(e)), (g)(2),
				(g)(3), (g)(4), (g)(5), (g)(8), (g)(9), (g)(10), (g)(11), (i), (j), (k), (n),
				(o), (p), (q), (u), or (x) of section 922 (relating to unlawful acts);</text>
										</clause><clause id="HB5924A2CBC02449F98AEE83C9204383D"><enum>(iii)</enum><text>subsection (b),
				(c), (g), (h), (k), (l), (m), or (n) of section 924 (relating to
				penalties);</text>
										</clause><clause id="H8F09EA11558146F3A318A9C6EBB39F2D"><enum>(iv)</enum><text>section 930
				(relating to possession of firearms and dangerous weapons in Federal
				facilities);</text>
										</clause><clause id="H057BD39D3C8A42FD95AC72773F041098"><enum>(v)</enum><text>section 931
				(relating to purchase, ownership, or possession of body armor by violent
				felons);</text>
										</clause><clause id="H31C74A5927C74374B02543A58F2EF025"><enum>(vi)</enum><text>sections 1028 and
				1029 (relating to fraud, identity theft, and related activity in connection
				with identification documents or access devices);</text>
										</clause><clause id="H7BD2525896DD4887A55E7549F8D82F67"><enum>(vii)</enum><text>section 1084
				(relating to transmission of wagering information);</text>
										</clause><clause id="H2FB3F082C9A447679EBCAA600A99D3D"><enum>(viii)</enum><text>section 1952
				(relating to interstate and foreign travel or transportation in aid of
				racketeering enterprises);</text>
										</clause><clause id="H8FD18533BEDD4266A7E435677779E085"><enum>(ix)</enum><text>section 1956
				(relating to the laundering of monetary instruments);</text>
										</clause><clause id="HD1DD1D405B814FDA87B5DA5E946E4C16"><enum>(x)</enum><text>section 1957
				(relating to engaging in monetary transactions in property derived from
				specified unlawful activity); or</text>
										</clause><clause id="H33F247DD74BC4D31B23B42D527D004EF"><enum>(xi)</enum><text>sections 2312
				through 2315 (relating to interstate transportation of stolen motor vehicles or
				stolen property).</text>
										</clause></subparagraph><subparagraph id="H3DB74FC2350B4F908E9E8DB89EDDE6F"><enum>(E)</enum><text>Any conduct
				punishable under section 274 (relating to bringing in and harboring certain
				aliens), section 277 (relating to aiding or assisting certain aliens to enter
				the United States), or section 278 (relating to importation of aliens for
				immoral purposes) of the <act-name parsable-cite="INA">Immigration and
				Nationality Act</act-name> (8 U.S.C. 1324, 1327, and 1328).</text>
									</subparagraph><subparagraph id="HB828A3494B5A445B97276759BB89DB00"><enum>(F)</enum><text>Any crime
				involving aggravated sexual abuse, sexual assault, pimping or pandering
				involving prostitution, sexual exploitation of children (including sections
				2251, 2251A, 2252 and 2260), peonage, slavery, or trafficking in persons
				(including sections 1581 through 1592) and sections 2421 through 2427 (relating
				to transport for illegal sexual activity).</text>
									</subparagraph></paragraph><paragraph id="H7CF3F2B2D7BC49CC95FB68A678636884"><enum>(3)</enum><header>Minor</header><text>The
				term <term>minor</term> means an individual who is less than 18 years of
				age.</text>
								</paragraph><paragraph id="H46DE2732DE17404182B436775E525BF7"><enum>(4)</enum><header>Serious violent
				felony</header><text>The term <term>serious violent felony</term> has the
				meaning given that term in section 3559.</text>
								</paragraph><paragraph id="HA56AD9EED8A64DD5AEE576BF25BFD761"><enum>(5)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States of the United States,
				the District of Columbia, and any commonwealth, territory, or possession of the
				United States.</text>
								</paragraph><paragraph commented="no" id="H03226B9623C94F64BC60391F2C2D33FB"><enum>(6)</enum><header>Violent
				felony</header><text display-inline="yes-display-inline">The term <term>violent
				felony</term> means any offense that has as an element the use of physical
				force against the person of another, or is burglary, arson, kidnapping, or
				extortion, but is not a serious violent felony.</text>
								</paragraph></section><section id="HFC403F313044451F9FCD3078A005974D"><enum>522.</enum><header>Criminal street
				gang prosecutions</header>
								<subsection id="H980375033A68442299AF6069745CDA5C"><enum>(a)</enum><header>Street Gang
				Crime</header><text display-inline="yes-display-inline">It shall be unlawful
				for any person to knowingly commit, or conspire (with any act to effect the
				object of the conspiracy), threaten, or attempt to commit, a gang crime for the
				purpose of furthering the activities of a criminal street gang, or gaining
				entrance to or maintaining or increasing position in a criminal street gang, or
				as consideration for anything of pecuniary value to or from a criminal street
				gang, if the activities of that criminal street gang occur in or affect
				interstate or foreign commerce.</text>
								</subsection><subsection id="HDB6388331CF645F6AE9F3E3800CFC12F"><enum>(b)</enum><header>Penalties</header>
									<paragraph id="HC3EA6C7492D94341B89751CBC4BE62EC"><enum>(1)</enum><header>Commission;
				Attempts; Conspiracy leaders</header><text display-inline="yes-display-inline">Any person who commits, attempts to commit,
				or conspires to commit (and occupies a position of organizer, a supervisory
				position, or any other position of management within the criminal street gang
				for such conspiracy) an offense described under
				<internal-xref idref="H980375033A68442299AF6069745CDA5C" legis-path="522.(a)">subsection (a)</internal-xref> that is—</text>
										<subparagraph id="HB2EFEBF8B8E1465880A2D900ADE18C21"><enum>(A)</enum><text display-inline="yes-display-inline">murder, kidnapping, or conduct that would
				violate section 2241 if the conduct occurred in the special maritime and
				territorial jurisdiction of the United States, shall be fined under this title
				and imprisoned for any term of years or for life;</text>
										</subparagraph><subparagraph id="H1B51DBEB37C34B13A2AABD24D5839985"><enum>(B)</enum><text display-inline="yes-display-inline">any other serious violent felony, shall be
				fined under this title and imprisoned for not more than 30 years;</text>
										</subparagraph><subparagraph id="HB07911D2D208451EA3448DCB6C9D35E"><enum>(C)</enum><text display-inline="yes-display-inline">any violent felony, shall be fined under
				this title and imprisoned for not more than 20 years; and</text>
										</subparagraph><subparagraph id="HBD163CEA9D7A41ABA6C8E0BF10934EF5"><enum>(D)</enum><text display-inline="yes-display-inline">not described in subparagraphs (A) through
				(C), shall be fined under this title and imprisoned for not more than 10
				years.</text>
										</subparagraph></paragraph><paragraph id="HA13A623E5DFE40CAACD8A412DD226FBE"><enum>(2)</enum><header>Other conspiracy
				members</header><text display-inline="yes-display-inline">Any person who
				conspires to commit (and who does not occupy a position of organizer, a
				supervisory position, or any other position of management within the criminal
				street gang for such conspiracy) an offense described under
				<internal-xref idref="H980375033A68442299AF6069745CDA5C" legis-path="522.(a)">subsection (a)</internal-xref> that is—</text>
										<subparagraph id="H487B6CEBD0D042E98D1B38F7E831FAF2"><enum>(A)</enum><text display-inline="yes-display-inline">murder, shall be fined under this title and
				imprisoned for not more than 25 years; and</text>
										</subparagraph><subparagraph id="H8E50D0F5B9E34671B617425979BA1D2"><enum>(B)</enum><text display-inline="yes-display-inline">any other serious violent felony or violent
				felony, shall be fined under this title and imprisoned for not more than 15
				years.</text>
										</subparagraph></paragraph><paragraph id="H8B5324199F62477B9BCB597D55723210"><enum>(3)</enum><header>Threats</header><text display-inline="yes-display-inline">Any person who threatens to commit an
				offense described under
				<internal-xref idref="H980375033A68442299AF6069745CDA5C" legis-path="522.(a)">subsection (a)</internal-xref> that is—</text>
										<subparagraph id="HF23556862164438A9308FFBB6E712354"><enum>(A)</enum><text display-inline="yes-display-inline">described in subparagraphs (A) through (C)
				of
				<internal-xref idref="HC3EA6C7492D94341B89751CBC4BE62EC" legis-path="522.(b)(1)">paragraph (1)</internal-xref>, shall be fined under
				this title and imprisoned for not more than 10 years; and</text>
										</subparagraph><subparagraph id="H18848AE8B0AB48BA92B7A7E3FCEDB497"><enum>(B)</enum><text display-inline="yes-display-inline">not described in such subparagraphs, shall
				be fined under this title and imprisoned for not more than 8 years.</text>
										</subparagraph></paragraph></subsection></section><section id="HA2ECE17EE4794ED0A224EAE3B3759F7"><enum>523.</enum><header>Recruitment of
				persons to participate in a criminal street gang</header>
								<subsection id="H865EC85CC34E49FE9BCD3B76F5A90877"><enum>(a)</enum><header>Prohibited
				Acts</header><text display-inline="yes-display-inline">It shall be unlawful to
				knowingly recruit, employ, solicit, induce, command, coerce, or cause another
				person to be or remain as a member of a criminal street gang, or attempt or
				conspire to do so (with any act to effect the object of the conspiracy), with
				the intent to cause that person to participate in a gang crime, if the
				defendant travels in interstate or foreign commerce in the course of the
				offense, or if the activities of that criminal street gang are in or affect
				interstate or foreign commerce.</text>
								</subsection><subsection id="HFABE4C15EC734A2888D125F2C2E1264C"><enum>(b)</enum><header>Penalties</header><text>Whoever
				violates subsection (a) shall—</text>
									<paragraph id="HB2B1BE1965D745EE87858DBFB2786015"><enum>(1)</enum><text display-inline="yes-display-inline">with respect to a person who is over 18
				years of age and who recruited, employed, solicited, induced, commanded,
				coerced, or caused a minor to participate or remain in a criminal street gang
				(or conspired to do so while occupying a position of organizer, a supervisory
				position, or any other position of management in such conspiracy)—</text>
										<subparagraph id="H47161AB1E099494BB647E173E7BF613"><enum>(A)</enum><text>be fined under this
				title, imprisoned not more than 10 years, or both; and</text>
										</subparagraph><subparagraph id="HB9905870F8F44509B7AE8D109CDFD2EC"><enum>(B)</enum><text>at the discretion
				of the sentencing judge, be liable for any costs incurred by the Federal
				Government, or by any State or local government, for housing, maintaining, and
				treating the minor until the person attains the age of 18 years;</text>
										</subparagraph></paragraph><paragraph id="H70A491A473EE4693B70035B11CF32171"><enum>(2)</enum><text display-inline="yes-display-inline">with respect to a person who induces,
				commands, or coerces the participation or remaining in a criminal street gang
				of another person (or conspires to do so while occupying a position of
				organizer, a supervisory position, or any other position of management in such
				conspiracy) while incarcerated, be fined under this title, imprisoned not more
				than 10 years, or both;</text>
									</paragraph><paragraph commented="no" id="HE264B1CCF2104106BE35E0A665452000"><enum>(3)</enum><text display-inline="yes-display-inline">with respect to a person who conspires to
				commit an offense described in paragraph (1) or (2) (but who does not occupy a
				position of organizer, a supervisory position, or any other position of
				management in such conspiracy), be fined under this title, imprisoned not more
				than 7 years, or both;</text>
									</paragraph><paragraph id="HC6ED398250354CF493CA1FDC8E99DE90"><enum>(4)</enum><text>with respect to a
				person who violates such subsection and is not described in paragraph (1), (2),
				or (3), (other than a person described in
				<internal-xref idref="H5D13A02A97194DBE9804D74B29B479CD" legis-path="523.(b)(5)">paragraph (5)</internal-xref>), be fined under this
				title, imprisoned not more than 5 years, or both; and</text>
									</paragraph><paragraph commented="no" id="H5D13A02A97194DBE9804D74B29B479CD"><enum>(5)</enum><text display-inline="yes-display-inline">with respect to a person who conspires to
				commit an offense which violates such subsection and is not described in
				paragraph (1), (2), or (3) (but who does not occupy a position of organizer, a
				supervisory position, or any other position of management in such conspiracy),
				be fined under this title, imprisoned not more than 3 years, or both.</text>
									</paragraph></subsection><subsection id="H382007954B1E476D8BD5DDFC263CAE23"><enum>(c)</enum><header>Consecutive
				nature of penalties</header><text>Any term of imprisonment imposed under
				subsection (b)(2) shall be consecutive to any term imposed for any other
				offense.</text>
								</subsection></section><section id="H3E444186B61C4AA5988E4DE4DAF4D1B9"><enum>524.</enum><header>Forfeiture</header>
								<subsection id="H17C60FB3FEE3474CB2C9F3157DCBBDE4"><enum>(a)</enum><header>Criminal
				Forfeiture</header><text display-inline="yes-display-inline">A person who is
				convicted of a violation of this chapter shall forfeit to the United
				States—</text>
									<paragraph id="H1E1297EC7B8E459CA475B48222325E11"><enum>(1)</enum><text>any property used,
				or intended to be used, in any manner or part, to commit, or to facilitate the
				commission of, the violation; and</text>
									</paragraph><paragraph id="HF1150B8B73F843AD877FBC4600DA6F1D"><enum>(2)</enum><text>any property
				constituting, or derived from, any proceeds obtained, directly or indirectly,
				as a result of the violation.</text>
									</paragraph></subsection><subsection id="HCA5385DDD7B04EDA82B087E0D8C31EC"><enum>(b)</enum><header>Procedures
				applicable</header><text>Pursuant to section 2461(c) of title 28, the
				provisions of section 413 of the Controlled Substances Act (21 U.S.C. 853),
				except subsections (a) and (d) of that section, shall apply to the criminal
				forfeiture of property under this
				section.</text>
								</subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HE118DB9E5C674B19B89078F3B5707566"><enum>(b)</enum><header>Amendment
			 Relating to Priority of Forfeiture Over Orders for
			 Restitution</header><text>Section 3663(c)(4) of title 18, United States Code,
			 is amended by striking <quote>chapter 46 or</quote> and inserting
			 <quote>chapter 26, chapter 46, or</quote>.</text>
				</subsection><subsection id="H05789530287744A794A531F3AF00619D"><enum>(c)</enum><header>Money
			 Laundering</header><text>Section 1956(c)(7)(D) of title 18, United States Code,
			 is amended by inserting <quote>, section 522 (relating to criminal street gang
			 prosecutions), and 523 (relating to recruitment of persons to participate in a
			 criminal street gang)</quote> before <quote>, section 541</quote>.</text>
				</subsection><subsection commented="no" display-inline="no-display-inline" id="H686C7FF6CEBE4AB1804238BC00436875"><enum>(d)</enum><header>Amendment of
			 special sentencing provision prohibiting prisoner communications</header><text display-inline="yes-display-inline">Section 3582(d) of title 18, United States
			 Code, is amended—</text>

			 violence</header>

			 other violent crimes committed during and in relation to a drug trafficking
			 crime</header>
				<subsection id="H711EF15E5B094610B490341F36C144DE"><enum>(a)</enum><header>In
			 General</header><text>Part D of the <act-name parsable-cite="CSA">Controlled
			 Substances Act</act-name> (21 U.S.C. 841 et seq.) is amended by adding at the
			 end the following:</text>
					<quoted-block act-name="Controlled" committee-id="SSJU00" id="H659BB199362D44D9873250525B023D64" style="OLC">
						<section id="H711EC0C4500C442E9D9CBAA44FC54299"><enum>424.</enum><header>Murder and
				other violent crimes committed during and in relation to a drug trafficking

							<subsection id="H1F20DEACB108404E8B317638571F044C"><enum>(a)</enum><header>In
				general</header><text>Whoever, during and in relation to any drug trafficking
				crime, knowingly commits any crime of violence against any individual that is
				an offense under Federal law punishable by imprisonment for more than 1 year or
				a felony offense under State law that is punishable by a term of imprisonment
				of 5 years or more, or threatens, attempts or conspires to do so, shall be
				punished by a fine under title 18, United States Code, and—</text>
								<paragraph display-inline="no-display-inline" id="H0623C29946994BD8B93DEE78C1D6E518"><enum>(1)</enum><text display-inline="yes-display-inline">for murder, kidnapping, or conduct that
				would violate section 2241 if the conduct occurred in the special maritime and
				territorial jurisdiction of the United States, by imprisonment for any term of
				years or for life;</text>
								</paragraph><paragraph id="H42DC285D32BF4FE7B04D17554C74A8E8"><enum>(2)</enum><text>for a serious
				violent felony (as defined in section 3559 of title 18, United States Code)
				other than a felony described in paragraph (1), by imprisonment for not more
				than 30 years;</text>
								</paragraph><paragraph id="H2A38169D9D1C4E0C8E2970219CF09152"><enum>(3)</enum><text>for a crime of
				violence that is not a serious violent felony, by imprisonment for not more
				than 20 years;</text>
								</paragraph><paragraph id="H601B8DDF20ED48DE83D7E22FE4997B7B"><enum>(4)</enum><text display-inline="yes-display-inline">for conspiring to commit a crime of
				violence, by imprisonment for not more than 10 years; and</text>
								</paragraph><paragraph id="HE2D17749D689453A822BA7BA001CE320"><enum>(5)</enum><text display-inline="yes-display-inline">for threatening to commit a crime of
				violence, by imprisonment for not more than 8 years.</text>
								</paragraph></subsection><subsection id="H263B8F86A8E4458690E39D91E8D4D7AD"><enum>(b)</enum><header>Venue</header><text>A
				prosecution for a violation of this section may be brought in—</text>
								<paragraph id="HD7995527FC8E41ABBA9F3600C6004E48"><enum>(1)</enum><text>the judicial
				district in which the murder or other crime of violence occurred; or</text>
								</paragraph><paragraph id="HF294807E959B47AEB6381E042BC3B8A2"><enum>(2)</enum><text>any judicial
				district in which the drug trafficking crime may be prosecuted.</text>
								</paragraph></subsection><subsection id="HD3C47AEC248645AAAE7816AB51EEE7AA"><enum>(c)</enum><header>Definitions</header><text>In
				this section—</text>
								<paragraph id="HD38EF4D32350417AB44631749E73E61D"><enum>(1)</enum><text display-inline="yes-display-inline">the term <term>crime of violence</term>
				means an offense that has as an element the use of physical force against the
				person of another; and</text>
								</paragraph><paragraph id="HB1D18ACFC6144A63003B7D6B85111870"><enum>(2)</enum><text>the term
				<term>drug trafficking crime</term> has the meaning given that term in section
				924(c)(2) of title 18, United States
				Code.</text>
								</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="H6628F3535E8F4326B7945FA771E5BFF"><enum>(b)</enum><header>Clerical
			 Amendment</header><text>The table of contents for the Comprehensive Drug Abuse
			 Prevention and Control Act of 1970 (Public Law 91–513; 84 Stat. 1236) is
			 amended by inserting after the item relating to section 423, the
			 following:</text>

			 limitations for violent crimes and terrorism offenses</header>
				<subsection id="H0C771DCD11EE420CB77722871DDC2C46"><enum>(a)</enum><header>Statute of
			 limitations for violent crimes</header><text>Chapter 213 of title 18, United
			 States Code, is amended by adding at the end the following:</text>

			 hearsay exception for forfeiture by wrongdoing</header><text display-inline="no-display-inline">The Judicial Conference of the United States
			 shall study section 804(b) of the Federal Rules of Evidence to determine the
			 necessity and desirability of amending that section, including the possible
			 expansion of section 804(b)(6), and shall make modifications as the Judicial
			 Conference sees fit.</text>
			</section><section display-inline="no-display-inline" id="H9029D9D7B7564528B6D05D79F74B9C2"><enum>205.</enum><header>Possession of
			 firearms by dangerous felons</header>
				<subsection id="H3B12C1A4BBC74E3AB6405B5D75BAC800"><enum>(a)</enum><header>In
			 General</header><text>Section 924(e) of title 18, United States Code, is
			 amended by striking paragraph (1) and inserting the following:</text>
					<quoted-block committee-id="SSJU00" id="H9781B943EDFB46B298AFBEA42C7E000" style="OLC">
						<paragraph id="H7E0DF0C23A3C4AEF83B8A193793100B1" indent="up1"><enum>(1)</enum><text display-inline="yes-display-inline">A
				person who violates subsection (g) of section 922 of this title and has
				previously been convicted by any court referred to in section 922(g)(1) of a
				violent felony or a serious drug offense shall—</text>
							<subparagraph id="HA05A730544B048B2AA8D3DE3471FA777"><enum>(A)</enum><text>in the case of 1 such prior
				conviction, where a period of not more than 10 years has elapsed since the
				later of the date of conviction and the date of release of the person from
				imprisonment for that conviction, be imprisoned for not more than 15 years,
				fined under this title, or both;</text>
							</subparagraph><subparagraph id="H28AD4CE1B2C54ACF9E3800F0A5A4DA6E"><enum>(B)</enum><text>in the case of 2 such prior
				convictions, committed on occasions different from one another, and where a
				period of not more than 10 years has elapsed since the later of the date of
				conviction and the date of release of the person from imprisonment for the most
				recent such conviction, be imprisoned for not more than 20 years, fined under
				this title, or both; and</text>
							</subparagraph><subparagraph id="H75FCA5D516734F279600005532F0A476"><enum>(C)</enum><text display-inline="yes-display-inline">in
				the case of 3 such prior convictions, committed on occasions different from one
				another, and where a period of not more than 10 years has elapsed since the
				later of the date of conviction and the date of release of the person from
				imprisonment for the most recent such conviction, be imprisoned for any term of
				years or for life and fined under this title, and notwithstanding any other
				provision of law, the court shall not suspend the sentence of, or grant a
				probationary sentence to, such person with respect to the conviction under
				section
				922(g).</text>
							</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</subsection><subsection id="HB5879CA940C84923A119BADDD6EFD966"><enum>(b)</enum><header>Amendment to
			 Sentencing Guidelines</header><text>Pursuant to its authority under section
			 994(p) of title 28, United States Code, the United States Sentencing Commission
			 shall amend the Federal Sentencing Guidelines to provide for an appropriate
			 increase in the offense level for violations of section 922(g) of title 18,
			 United States Code, in accordance with section 924(e) of that title 18, as
			 amended by subsection (a).</text>
				</subsection></section><section id="H8A48FF44160D4FC19EFFEF003FD7B59B"><enum>206.</enum><header>Conforming
			 amendment</header><text display-inline="no-display-inline">The matter preceding
			 paragraph (1) in section 922(d) of title 18, United States Code, is amended by
			 inserting <quote>, transfer,</quote> after <quote>sell</quote>.</text>
			</section><section id="H3063BE5E1A5D476EAC8572D5564D3B74"><enum>207.</enum><header>Prohibition on
			 illegal gun transfers to commit drug trafficking crimes or crimes of
			 violence</header><text display-inline="no-display-inline">Section 924(h) of
			 title 18, United States Code, is amended to read as follows:</text>
				<quoted-block committee-id="SSJU00" display-inline="no-display-inline" id="HB01B066C394746A496875477768136D8" style="OLC">
					<subsection id="H373EC3BE39604288B3D34CF29F69A8BA"><enum>(h)</enum><text display-inline="yes-display-inline">Whoever knowingly transfers a firearm that
				has moved in or that otherwise affects interstate or foreign commerce, knowing
				that the firearm will be used to commit, or possessed in furtherance of, a
				crime of violence (as defined in subsection (c)(3)) or drug trafficking crime
				(as defined in subsection (c)(2)) shall be fined under this title and
				imprisoned not more than 20
				years.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section id="H76769F9EA67F4748AA5621C6D362C262"><enum>208.</enum><header>Publicity
			 campaign about new criminal penalties and gang-related outreach</header>
				<subsection id="H979C15783BFC4654AC5FFEA3E7BEAC91"><enum>(a)</enum><header>Media
			 campaigns</header><text display-inline="yes-display-inline">The Attorney
			 General is authorized to conduct media campaigns in any area designated as a
			 high intensity gang activity area under section 301 and any area with existing
			 and emerging problems with gangs, as needed, to—</text>
					<paragraph id="H284B20AA0CB64E7A9E2D2B216F487236"><enum>(1)</enum><text>educate
			 individuals in that area about the changes in criminal penalties made by this
			 Act; and</text>
					</paragraph><paragraph id="H15CAB266F4544FB88D55F33ED8D6BA42"><enum>(2)</enum><text display-inline="yes-display-inline">provide information to individuals in that
			 area about service providers in the community that provide gang-involved or
			 at-risk youth with positive alternatives to gangs and other violent groups and
			 that address the needs of those who leave gangs and other violent groups and
			 those reentering society from prison (including service providers experienced
			 at reaching youth and adults who have been involved in violence and violent
			 gangs or groups).</text>
					</paragraph></subsection><subsection id="HB1F2773708D44134AFDDAA33CCA8B420"><enum>(b)</enum><header>Report</header><text>The
			 Attorney General shall report to the Committee on the Judiciary of the Senate
			 and the Committee on the Judiciary of the House of Representatives the amount
			 of expenditures and all other aspects of the media campaigns conducted under
			 this section.</text>
				</subsection><subsection id="HABB069B886614887927269BE6598189E"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text display-inline="yes-display-inline">There is
			 authorized to be appropriated to carry out this section $10,000,000 for each of
			 the fiscal years 2010 through 2014.</text>
				</subsection></section><section id="H8B1DE1F3603C41F9B8064F6916CD00D2"><enum>209.</enum><header>Predicate
			 crimes for authorization of interception of wire, oral, and electronic
			 communications</header><text display-inline="no-display-inline">Section 2516(1)
			 of title 18, United States Code, is amended—</text>
				<paragraph id="H2135C20770644BB2929F54FBF0C7EA2"><enum>(1)</enum><text>by
			 striking <quote>or</quote> and the end of paragraph (r);</text>
				</paragraph><paragraph id="H6FF3960DF7DD4D9FAF411F00846FE5F3"><enum>(2)</enum><text>by redesignating
			 paragraph (s) as paragraph (u); and</text>

				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H2A1859DF5FAE4339A899D9E90089BE7F" section-type="subsequent-section"><enum>210.</enum><header>Clarification of
			 Hobbs Act</header><text display-inline="no-display-inline">Section 1951(b) of
			 title 18, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HDB758212E5F646C1AD51A67CF1F23500"><enum>(1)</enum><text>in paragraph (1),
			 by inserting <quote>including the unlawful impersonation of a law enforcement
			 officer (as that term is defined in section 245(c) of this title),</quote>
			 after <quote>by means of actual or threatened force,</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HBACB67A9910A44AEB6F03320459D23BC"><enum>(2)</enum><text>in paragraph (2),
			 by inserting <quote>including the unlawful impersonation of a law enforcement
			 officer (as that term is defined in section 245(c) of this title),</quote>
			 after <quote>by wrongful use of actual or threatened force,</quote>.</text>
				</paragraph></section><section commented="no" display-inline="no-display-inline" id="H8B42A4CE0C0E4CCA90B1E876075413DC" section-type="subsequent-section"><enum>211.</enum><header>Making personal
			 information about certain witnesses and informants publicly available with
			 unlawful intent</header>
				<subsection commented="no" id="H71348E49209049F1A26055BEB28C1DA"><enum>(a)</enum><header>Offense</header><text display-inline="yes-display-inline">Whoever knowingly makes restricted personal
			 information about a covered individual, or a member of the immediate family of
			 that covered individual, publicly available in or affecting interstate or
			 foreign commerce—</text>
					<paragraph commented="no" id="H8D8A15A7EB624F7D00275B41CEBC2BEF"><enum>(1)</enum><text>with the intent to
			 threaten, intimidate, or incite the commission of a crime of violence against
			 that covered individual, or a member of the immediate family of that covered
			 individual; or</text>
					</paragraph><paragraph commented="no" id="H42CABD5CEBFB48D28961D2152E04F47"><enum>(2)</enum><text>with the intent
			 that the restricted personal information will be used to threaten, intimidate,
			 or facilitate the commission of a crime of violence against that covered
			 individual, or a member of the immediate family of that covered
			 individual;</text>
					</paragraph><continuation-text commented="no" continuation-text-level="subsection">shall be fined under title 18,
			 United States Code, imprisoned not more than 10 years, or both.</continuation-text></subsection><subsection commented="no" display-inline="no-display-inline" id="H299D804A9DCA40A1A08EF870FAA4899"><enum>(b)</enum><header>Definitions</header><text>In
			 this section—</text>
					<paragraph commented="no" id="HD26429DB4DFC415CBFFAD42D316090BF"><enum>(1)</enum><text>the term
			 <term>restricted personal information</term> means, with respect to an
			 individual, the Social Security number, the home address, home phone number,
			 mobile phone number, personal email, or home fax number of that
			 individual;</text>
					</paragraph><paragraph commented="no" id="H8A83C59AFAFE4E1BB02B3BFE1BC5E7DC"><enum>(2)</enum><text display-inline="yes-display-inline">the term <term>covered individual </term>
			 means a witness or informant in a Federal or State criminal investigation or
			 prosecution;</text>
					</paragraph><paragraph commented="no" id="H9D9721FF580C4018A400D66FF6CD165"><enum>(3)</enum><text>the term
			 <term>crime of violence</term> has the meaning given that term in section 16 of
			 title 18, United States Code; and</text>
					</paragraph><paragraph commented="no" id="H6161D5BDABE94184ABCD42036E6FCDBD"><enum>(4)</enum><text>the term
			 <term>immediate family</term> has the meaning given that term in section
			 115(c)(2) of title 18, United States Code.</text>
					</paragraph></subsection></section><section id="H46469B2219D04F46BC3C59C6DC458EEA"><enum>212.</enum><header>Amendment of
			 sentencing guidelines</header>
				<subsection id="H09B6A93C7BFF4F3F968466FE9CEADCBA"><enum>(a)</enum><header>In
			 general</header><text>Pursuant to its authority under section 994 of title 28,
			 United States Code, and in accordance with this section, the United States
			 Sentencing Commission shall review and, if appropriate, amend its guidelines
			 and policy statements to conform with this title and the amendments made by
			 this title.</text>
				</subsection><subsection id="H732A917A1DE64F108617AE47B6E33379"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this section, the United States Sentencing Commission
			 shall—</text>
					<paragraph id="HEBA62383F8C746EEB6C4ABFD50E3FCA0"><enum>(1)</enum><text>establish new
			 guidelines and policy statements, as warranted, in order to implement new or
			 revised criminal offenses under this title and the amendments made by this
			 title;</text>
					</paragraph><paragraph id="H7AD98D30F9DA4572BF8263C16368E7EB"><enum>(2)</enum><text>consider the
			 extent to which the guidelines and policy statements adequately address—</text>
						<subparagraph id="H2277438D3E5E4183B8C253C9EF2BC0DC"><enum>(A)</enum><text>whether the
			 guidelines offense levels and enhancements—</text>
							<clause id="H032E30465CA341CA9D57311F2D72749E"><enum>(i)</enum><text>are
			 sufficient to deter and punish such offenses; and</text>
							</clause><clause id="H7F03A617CCB847639553F2A609113B9E"><enum>(ii)</enum><text>are
			 adequate in view of the statutory increases in penalties contained in this
			 title and the amendments made by this title; and</text>
							</clause></subparagraph><subparagraph id="HF8F5DCC1325645B391E01B8873A038BE"><enum>(B)</enum><text>whether any
			 existing or new specific offense characteristics should be added to reflect
			 congressional intent to increase penalties for the offenses set forth in this
			 title and the amendments made by this title;</text>
						</subparagraph></paragraph><paragraph id="H5F411A6630C1471E930030EE90C24B8E"><enum>(3)</enum><text>consider whether
			 specific offense characteristics should be added to increase the guideline
			 range—</text>
						<subparagraph id="HA5FA106916734B2DA8EC00C1EAD8F54C"><enum>(A)</enum><text display-inline="yes-display-inline">by additional offense levels, if a criminal
			 defendant committing a gang crime or gang recruiting offense was an alien who
			 was present in the United States in violation of section 275 or 276 of the
			 Immigration and Nationality Act (8 U.S.C. 1325 and 1326) at the time the
			 offense was committed; and</text>
						</subparagraph><subparagraph id="H3832EE67BF6B481EA9653001E68F8C70"><enum>(B)</enum><text display-inline="yes-display-inline">by further additional offense levels, if
			 such defendant had also previously been ordered removed or deported under the
			 Immigration and Nationality Act (8 U.S.C. 1101 et seq.) on the grounds of
			 having committed a crime;</text>
						</subparagraph></paragraph><paragraph id="HB0344A4A2AFA44FB9EC7BCA49BE56C22"><enum>(4)</enum><text>determine under
			 what circumstances a sentence of imprisonment imposed under this title or the
			 amendments made by this title shall run consecutively to any other sentence of
			 imprisonment imposed for any other crime, except that the Commission shall
			 ensure that a sentence of imprisonment imposed under section 424 of the
			 Controlled Substances Act (21 U.S.C. 841 et seq.), as added by this Act, shall
			 run consecutively, to an extent that the Sentencing Commission determines
			 appropriate, to the sentence imposed for the underlying drug trafficking
			 offense;</text>
					</paragraph><paragraph id="HB705EA9E1CD64251B85142B9C7251DFA"><enum>(5)</enum><text>account for any
			 aggravating or mitigating circumstances that might justify exceptions to the
			 generally applicable sentencing ranges;</text>
					</paragraph><paragraph id="HB178E86D0F1D4973AE2971AA5E367E54"><enum>(6)</enum><text>ensure reasonable
			 consistency with other relevant directives, other sentencing guidelines, and
			 statutes;</text>
					</paragraph><paragraph id="H31D005925575471C813BC7C1B6E3EBE4"><enum>(7)</enum><text>make any necessary
			 and conforming changes to the sentencing guidelines and policy statements;
			 and</text>
					</paragraph><paragraph id="H5B7E106361EF49F8B142C1B7E53B00DE"><enum>(8)</enum><text>ensure that the
			 guidelines adequately meet the purposes of sentencing set forth in section
			 3553(a)(2) of title 18, United States Code.</text>
					</paragraph></subsection></section></title><title committee-id="SSJU00" id="H81D2E2F1F6D84EE58E0000023939AC7"><enum>III</enum><header>Increased Federal
			 resources to deter and prevent seriously at-risk youth from joining illegal
			 street gangs and for other purposes</header>
			<section display-inline="no-display-inline" id="H54AF4CE23EF6453CB900C301679990D9"><enum>301.</enum><header>Designation of
			 and assistance for high intensity gang activity areas</header>
				<subsection id="H72471968038341F6B177BD432F569288"><enum>(a)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HE7DD156C95DC48FAAEB200AF00746C09"><enum>(1)</enum><header>Governor</header><text>The
			 term <term>Governor</term> means a Governor of a State, the Mayor of the
			 District of Columbia, the tribal leader of an Indian tribe, or the chief
			 executive of a Commonwealth, territory, or possession of the United
			 States.</text>
					</paragraph><paragraph id="HEE8FD239515C4DA0A83CAB84336024D0"><enum>(2)</enum><header>High intensity
			 gang activity area</header><text>The term <term>high intensity gang activity
			 area</term> or <term>HIGAA</term> means an area within 1 or more States or
			 Indian country that is designated as a high intensity gang activity area under
			 subsection (b)(1).</text>
					</paragraph><paragraph id="HB2A6EE3920D646DBAE9BE18DEE2084FD"><enum>(3)</enum><header>Indian
			 country</header><text>The term <term>Indian country</term> has the meaning
			 given the term in section 1151 of title 18, United States Code.</text>
					</paragraph><paragraph id="H7363FC33BC344BDB84480458EB99F768"><enum>(4)</enum><header>Indian
			 tribe</header><text>The term <term>Indian tribe</term> has the meaning given
			 the term in section 4(e) of the Indian Self-Determination and Education
			 Assistance Act (25 U.S.C. 450b(e)).</text>
					</paragraph><paragraph id="H113F4959EE7B48AC9239702524747703"><enum>(5)</enum><header>State</header><text>The
			 term <term>State</term> means a State of the United States, the District of
			 Columbia, and any commonwealth, territory, or possession of the United
			 States.</text>
					</paragraph><paragraph id="H3F242511395F435EA4467EE83028D471"><enum>(6)</enum><header>Tribal
			 leader</header><text>The term <term>tribal leader</term> means the chief
			 executive officer representing the governing body of an Indian tribe.</text>
					</paragraph></subsection><subsection id="H03C4D2FA9831482BA9CBB641585528D"><enum>(b)</enum><header>High Intensity
			 Gang Activity Areas</header>
					<paragraph id="HB6252F6353904CA9B50004F798136B61"><enum>(1)</enum><header>Designation</header><text>The
			 Attorney General, after consultation with the Governors of appropriate States,
			 may designate as high intensity gang activity areas, specific areas that are
			 located within 1 or more States, which may consist of 1 or more municipalities,
			 counties, or other jurisdictions as appropriate.</text>
					</paragraph><paragraph id="H3B7AE2AD8E49442AB6FD427B38C4B73B"><enum>(2)</enum><header>Assistance</header><text>In
			 order to provide Federal assistance to high intensity gang activity areas, the
			 Attorney General shall—</text>
						<subparagraph id="H27E784C9144C4597883D34BED46F8EB8"><enum>(A)</enum><text>establish local
			 collaborative working groups, which shall include—</text>
							<clause id="H9FD375D5BB92463DB18EAD6F03594B26"><enum>(i)</enum><text>criminal street
			 gang enforcement teams, consisting of Federal, State, tribal, and local law
			 enforcement authorities, for the coordinated investigation, disruption,
			 apprehension, and prosecution of criminal street gangs and offenders in each
			 high intensity gang activity area;</text>
							</clause><clause id="HF872A59D40D4439EBCAA003FBFA15CB4"><enum>(ii)</enum><text>educational,
			 community, and faith leaders in the area;</text>
							</clause><clause id="H9A269B9387D44349B4E6E6A84496141F"><enum>(iii)</enum><text>service
			 providers in the community, including those experienced at reaching youth and
			 adults who have been involved in violence and violent gangs or groups, to
			 provide gang-involved or seriously at-risk youth with positive alternatives to
			 gangs and other violent groups and to address the needs of those who leave
			 gangs and other violent groups, and those reentering society from prison;
			 and</text>
							</clause><clause id="H451C5DECD6614BE6B473A9324CE5046B"><enum>(iv)</enum><text>evaluation teams
			 to research and collect information, assess data, recommend adjustments, and
			 generally assure the accountability and effectiveness of program
			 implementation;</text>
							</clause></subparagraph><subparagraph id="HE557BF1744A245F2A3B8E2CEE028F31E"><enum>(B)</enum><text>direct the
			 reassignment or detailing from any Federal department or agency (subject to the
			 approval of the head of that department or agency, in the case of a department
			 or agency other than the Department of Justice) of personnel to each criminal
			 street gang enforcement team;</text>
						</subparagraph><subparagraph id="H1C544917E71148E1B5F50089705D4100"><enum>(C)</enum><text>direct the
			 reassignment or detailing of representatives from—</text>
							<clause id="H6BC8F546BD4B46FEADDA1D6E86612D65"><enum>(i)</enum><text>the
			 Department of Justice;</text>
							</clause><clause id="HC597541798F9405EBE76ECCA451E5950"><enum>(ii)</enum><text>the
			 Department of Education;</text>
							</clause><clause id="H1B55CDAD2E9E4065AF849FEB99F02131"><enum>(iii)</enum><text>the Department
			 of Labor;</text>
							</clause><clause id="H91165F225A9648E7AD3B007B66D297F8"><enum>(iv)</enum><text>the
			 Department of Health and Human Services;</text>
							</clause><clause id="H5B27026D3113447DB9E7A98607AB6459"><enum>(v)</enum><text>the
			 Department of Housing and Urban Development; and</text>
							</clause><clause id="H40FACDE70DF54DADAE102E608E3411E8"><enum>(vi)</enum><text>any
			 other Federal department or agency;</text>
							</clause><continuation-text continuation-text-level="subparagraph">(subject
			 to the approval of the head of that department or agency, in the case of a
			 department or agency other than the Department of Justice) to each high
			 intensity gang activity area to identify and coordinate efforts to access
			 Federal programs and resources available to provide gang prevention,
			 intervention, and reentry assistance;</continuation-text></subparagraph><subparagraph id="HE00AE91347964E73860940E6366F72FB"><enum>(D)</enum><text>prioritize and
			 administer the Federal program and resource requests made by the local
			 collaborative working group established under subparagraph (A) for each high
			 intensity gang activity area;</text>
						</subparagraph><subparagraph id="H61AAF13E6E5A47759063E55462AFD6CD"><enum>(E)</enum><text>provide all
			 necessary funding for the operation of each local collaborative working group
			 in each high intensity gang activity area; and</text>
						</subparagraph><subparagraph id="H0754747A9571435EB4461F4F85BF3063"><enum>(F)</enum><text>provide all
			 necessary funding for national and regional meetings of local collaborative
			 working groups, criminal street gang enforcement teams, and educational,
			 community, social service, faith-based, and all other related organizations, as
			 needed, to ensure effective operation of such teams through the sharing of
			 intelligence and best practices and for any other related purpose.</text>
						</subparagraph></paragraph><paragraph id="HC59D53435BE9443E80705DAE3753D68F"><enum>(3)</enum><header>Composition of
			 criminal street gang enforcement team</header><text>Each team established under
			 paragraph (2)(A)(i) shall consist of agents and officers, where feasible,
			 from—</text>
						<subparagraph id="H5F68971CA8844D7BBED34F96AFCB9193"><enum>(A)</enum><text>the Federal Bureau
			 of Investigation;</text>
						</subparagraph><subparagraph id="H1F9B3C1CBBF04F12B8C54E8222E4AE89"><enum>(B)</enum><text>the Drug
			 Enforcement Administration;</text>
						</subparagraph><subparagraph id="H29726966DB164592A53B4D72318B4E00"><enum>(C)</enum><text>the Bureau of
			 Alcohol, Tobacco, Firearms, and Explosives;</text>
						</subparagraph><subparagraph id="H8D8196DF60A848AE997433FAB59E02"><enum>(D)</enum><text>the United States
			 Marshals Service;</text>
						</subparagraph><subparagraph id="H43E7A90B2FC34A768453FCCA805BA32"><enum>(E)</enum><text>the Department of
			 Homeland Security;</text>
						</subparagraph><subparagraph id="HE1279F7CAB9645D3BDED6702A6685165"><enum>(F)</enum><text>the Department of
			 Housing and Urban Development;</text>
						</subparagraph><subparagraph id="HC99F4BECBFB94FD2BB6FB0AAD858256B"><enum>(G)</enum><text>State, local, and,
			 where appropriate, tribal law enforcement;</text>
						</subparagraph><subparagraph id="HC9795D796E0A441BA2141036C3075BC1"><enum>(H)</enum><text>Federal, State,
			 and local prosecutors; and</text>
						</subparagraph><subparagraph id="H5E792194652B4FD69BF647EC74C3EB7D"><enum>(I)</enum><text>the Bureau of
			 Indian Affairs, Office of Law Enforcement Services, where appropriate.</text>
						</subparagraph></paragraph><paragraph id="H8A33A9CE86D04406B804C89CE4C5006F"><enum>(4)</enum><header>Criteria for
			 designation</header><text>In considering an area for designation as a high
			 intensity gang activity area under this section, the Attorney General shall
			 consider—</text>
						<subparagraph id="HCC08203247474ABBBBA8BC5464E5613"><enum>(A)</enum><text>the current and
			 predicted levels of gang crime activity in the area;</text>
						</subparagraph><subparagraph id="H86C229EAC5504F5CAD4356EB048826CB"><enum>(B)</enum><text>the extent to
			 which qualitative and quantitative data indicate that violent crime in the area
			 is related to criminal street gang activity, such as murder, robbery, assaults,
			 carjacking, arson, kidnapping, extortion, drug trafficking, and other criminal
			 activity;</text>
						</subparagraph><subparagraph id="H9A08C6122AEA4403B70374C8742273A0"><enum>(C)</enum><text>the extent to
			 which State, local, and, where appropriate, tribal law enforcement agencies,
			 schools, community groups, social service agencies, job agencies, faith-based
			 organizations, and other organizations have committed resources to—</text>
							<clause id="H58E59364C23A43DD8E702FF38D482101"><enum>(i)</enum><text>respond to the
			 gang crime problem; and</text>
							</clause><clause id="H81A8A9D5C6EE42EE0095B0A1F4066412"><enum>(ii)</enum><text>participate in a
			 gang enforcement team;</text>
							</clause></subparagraph><subparagraph id="H0B2974110D7A4D9D008628F8E6DBCF12"><enum>(D)</enum><text>the extent to
			 which a significant increase in the allocation of Federal resources would
			 enhance local response to the gang crime activities in the area;</text>
						</subparagraph><subparagraph id="H77DCB1F85E574FD8A46CC12428D06238"><enum>(E)</enum><text display-inline="yes-display-inline">whether the area—</text>
							<clause id="H84FE9A8C846248CD9C35DC4EA84EDC50"><enum>(i)</enum><text>has
			 a comprehensive strategy to respond to local gang-related issues (including
			 prevention and intervention);</text>
							</clause><clause id="HC5CB8BE22FEF432EAE27A1617996A403"><enum>(ii)</enum><text>coordinates
			 Federal actions and resources to support local implementation of such
			 comprehensive strategy; and</text>
							</clause><clause id="HB43DD8BA3CBB46F1A300FBDB99BD722B"><enum>(iii)</enum><text>maximizes the
			 resources available from the various levels of government for responding to
			 gang-related issues; and</text>
							</clause></subparagraph><subparagraph id="H1C35CA846475482E972F7EA22298EDD"><enum>(F)</enum><text>any other criteria
			 that the Attorney General considers to be appropriate.</text>
						</subparagraph></paragraph><paragraph id="H17894FBA395D4E88BBF7BFC23CC41CD"><enum>(5)</enum><header>Relation to
			 HIDTAS</header><text display-inline="yes-display-inline">If the Attorney
			 General establishes a high intensity gang activity area that substantially
			 overlaps geographically with any existing high intensity drug trafficking area
			 (in this section referred to as a <quote>HIDTA</quote>), the Attorney General
			 shall direct the local collaborative working group for that high intensity gang
			 activity area to enter into an agreement with the Executive Board for that
			 HIDTA, providing that—</text>
						<subparagraph id="H0EF3F05869164C91A8E8E64758639A3"><enum>(A)</enum><text display-inline="yes-display-inline">the Executive Board of that HIDTA shall
			 establish a separate high intensity gang activity area law enforcement steering
			 committee, and select (with a preference for Federal, State, and local law
			 enforcement agencies that are within the geographic area of that high intensity
			 gang activity area) the members of that committee, subject to the concurrence
			 of the Attorney General;</text>
						</subparagraph><subparagraph id="H2EF18FF014404728A05B8DA800B7847B"><enum>(B)</enum><text>the high intensity
			 gang activity area law enforcement steering committee established under
			 subparagraph (A) shall administer the funds provided under subsection (g)(1)
			 for the criminal street gang enforcement team, after consulting with, and
			 consistent with the goals and strategies established by, that local
			 collaborative working group;</text>
						</subparagraph><subparagraph id="HEEFC5E13E027419DB4675DC21EEE4CF"><enum>(C)</enum><text>the high intensity
			 gang activity area law enforcement steering committee established under
			 subparagraph (A) shall select, from Federal, State, and local law enforcement
			 agencies within the geographic area of that high intensity gang activity area,
			 the members of the Criminal Street Gang Enforcement Team, in accordance with
			 paragraph (3); and</text>
						</subparagraph><subparagraph id="H1A140581F8404BCC9B09EF6B5B58F0E9"><enum>(D)</enum><text>the Criminal
			 Street Gang Enforcement Team of that high intensity gang activity area, and its
			 law enforcement steering committee, may, with approval of the Executive Board
			 of the HIDTA with which it substantially overlaps, utilize the
			 intelligence-sharing, administrative, and other resources of that HIDTA.</text>
						</subparagraph></paragraph></subsection><subsection id="H2EA494C215554E16A4066F4B1400E220"><enum>(c)</enum><header>Reporting
			 requirements</header>
					<paragraph id="HD165231A6D8E4D6182C400DF01359200"><enum>(1)</enum><header>In
			 general</header><text>Not later than December 1 of each year, the Attorney
			 General shall submit a report to the appropriate committees of Congress and the
			 Director of the Office of Management and Budget and the Domestic Policy Council
			 that describes, for each designated high intensity gang activity area—</text>
						<subparagraph id="H63B3BB9D21C14A9EA024D07CFD08F511"><enum>(A)</enum><text>the specific
			 long-term and short-term goals and objectives;</text>
						</subparagraph><subparagraph id="H62072E9D17814DEFB2D48D65CBC06F13"><enum>(B)</enum><text>the measurements
			 used to evaluate the performance of the high intensity gang activity area in
			 achieving the long-term and short-term goals;</text>
						</subparagraph><subparagraph id="HDD70EE0F44B248B898AFAB2ED39F139"><enum>(C)</enum><text>the age,
			 composition, and membership of gangs;</text>
						</subparagraph><subparagraph id="H5A1CC84E7BE54678B1F04F8210B47F30"><enum>(D)</enum><text>the number and
			 nature of crimes committed by gangs and gang members;</text>
						</subparagraph><subparagraph id="HAC3E99F54A854F6384D15475F612190"><enum>(E)</enum><text>the definition of
			 the term <term>gang</term> used to compile that report; and</text>
						</subparagraph><subparagraph id="HB29AFEF53A10423DB28263A25BF6D79"><enum>(F)</enum><text>the programmatic
			 outcomes and funding needs of the high intensity gang area, including—</text>
							<clause id="H8381AAED9BBC43EF89764FDF79B91408"><enum>(i)</enum><text>an
			 evidence-based analysis of the best practices and outcomes from the work of the
			 relevant local collaborative working group; and</text>
							</clause><clause id="H61569F414EAB4394A06CD9AFE527EDAA"><enum>(ii)</enum><text>an
			 analysis of whether Federal resources distributed meet the needs of the high
			 intensity gang activity area and, if any programmatic funding shortfalls exist,
			 recommendations for programs or funding to meet such shortfalls.</text>
							</clause></subparagraph></paragraph><paragraph id="HCA0457426D744D198379F38690F3D139"><enum>(2)</enum><header>Appropriate
			 committees</header><text>In this subsection, the term <term>appropriate
			 committees of Congress</term> means—</text>
						<subparagraph id="HC8D96699E8474C419BAAD0C64BF66F9"><enum>(A)</enum><text>the Committee on
			 the Judiciary, the Committee on Appropriations, and the Committee on Health,
			 Education, Labor, and Pensions of the Senate; and</text>
						</subparagraph><subparagraph id="HB41B176B96AA4D2BAB53B175C2C29BD1"><enum>(B)</enum><text>the Committee on
			 the Judiciary, the Committee on Appropriations, the Committee on Education and
			 Labor, and the Committee on Energy and Commerce of the House of
			 Representatives.</text>
						</subparagraph></paragraph></subsection><subsection id="HAB0FF3B228AD4FDC936DFB9814297DCA"><enum>(d)</enum><header>Additional
			 Assistant United States Attorneys</header><text>The Attorney General is
			 authorized to hire 94 additional Assistant United States attorneys, and
			 nonattorney coordinators and paralegals as necessary, to carry out the
			 provisions of this section.</text>
				</subsection><subsection id="H5BB0F70DD5C340AA83238E3163BB7335"><enum>(e)</enum><header>Additional
			 defense counsel</header><text>In each of the fiscal years 2010 through 2014,
			 the Director of the Administrative Office of the United States Courts is
			 authorized to hire 71 additional attorneys, nonattorney coordinators, and
			 investigators, as necessary, in Federal Defender Programs and Federal Community
			 Defender Organizations, and to make additional payments as necessary to retain
			 appointed counsel under section 3006A of title 18, United States Code, to
			 adequately respond to any increased or expanded caseloads that may occur as a
			 result of this Act or the amendments made by this Act. Funding under this
			 subsection shall not exceed the funding levels under subsection (d).</text>
				</subsection><subsection id="HB84699F9FFB9418D80AF98A9E0D2CC06"><enum>(f)</enum><header>National Gang
			 Research, Evaluation, and Policy Institute</header>
					<paragraph id="HA4C6DB40CE324E388888941324D62936"><enum>(1)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Office of Justice
			 Programs of the Department of Justice, after consulting with relevant law
			 enforcement officials, practitioners and researchers, shall establish a
			 National Gang Research, Evaluation, and Policy Institute (in this subsection
			 referred to as the <quote>Institute</quote>).</text>
					</paragraph><paragraph id="H14009647C750408FA2AEC7BD48C6B226"><enum>(2)</enum><header>Activities</header><text>The
			 Institute shall—</text>
						<subparagraph id="HEA8451DE5AFE449C904236B000630933"><enum>(A)</enum><text>promote and
			 facilitate the implementation of data-driven, effective gang violence
			 suppression, prevention, intervention, and reentry models, such as the
			 Operation Ceasefire model, the Strategic Public Health Approach, the Gang
			 Reduction Program, or any other promising municipally driven, comprehensive
			 community-wide strategy that is demonstrated to be effective in reducing gang
			 violence;</text>
						</subparagraph><subparagraph id="H7058FB4E462549B6ACBE47B6C3FE04B2"><enum>(B)</enum><text>assist
			 jurisdictions by conducting timely research on effective models and designing
			 and promoting implementation of effective local strategies, including programs
			 that have objectives and data on how they reduce gang violence (including
			 shootings and killings), using prevention, outreach, and community approaches,
			 and that demonstrate the efficacy of these approaches; and</text>
						</subparagraph><subparagraph id="H2999CFE2DB4A433A8700FA988B69048B"><enum>(C)</enum><text>provide and
			 contract for technical assistance as needed in support of its mission.</text>
						</subparagraph></paragraph><paragraph id="H27AA8547BBFD4417B778E597D0343FC8"><enum>(3)</enum><header>National
			 conference</header><text>Not later than 90 days after the date of its
			 formation, the Institute shall design and conduct a national conference to
			 reduce and prevent gang violence, and to teach and promote gang violence
			 prevention, intervention, and reentry strategies. The conference shall be
			 attended by appropriate representatives from criminal street gang enforcement
			 teams, and local collaborative working groups, including representatives of
			 educational, community, religious, and social service organizations, and gang
			 program and policy research evaluators.</text>
					</paragraph><paragraph id="H7D27C8C49AB14CBBA559F6ED09EB11"><enum>(4)</enum><header>National
			 demonstration sites</header><text display-inline="yes-display-inline">Not later
			 than 120 days after the date of its formation, the Institute shall select
			 appropriate HIGAA areas to serve as primary national demonstration sites, based
			 on the nature, concentration, and distribution of various gang types, the
			 jurisdiction's established capacity to integrate prevention, intervention,
			 reentry and enforcement efforts, and the range of particular gang-related
			 issues. After establishing primary national demonstration sites, the Institute
			 shall establish such other secondary sites, to be linked to and receive
			 evaluation, research, and technical assistance through the primary sites, as it
			 may determine appropriate.</text>
					</paragraph><paragraph id="H11C36E75FB8345F3876599829EF6F33B"><enum>(5)</enum><header>Dissemination of
			 information</header><text>Not later than 180 days after the date of its
			 formation, the Institute shall develop and begin dissemination of information
			 about methods to effectively reduce and prevent gang violence, including
			 guides, research and assessment models, case studies, evaluations, and best
			 practices. The Institute shall also create a website, designed to support the
			 implementation of successful gang violence prevention models, and disseminate
			 appropriate information to assist jurisdictions in reducing gang
			 violence.</text>
					</paragraph><paragraph id="H557F75730A0446F1994BAB2896BC0046"><enum>(6)</enum><header>Gang
			 intervention academies</header><text>Not later than 6 months after the date of
			 its formation, the Institute shall, either directly or through contracts with
			 qualified nonprofit organizations, establish not less than 1 training academy,
			 located in a high intensity gang activity area, to promote effective gang
			 intervention and community policing. The purposes of an academy established
			 under this paragraph shall be to increase professionalism of gang intervention
			 workers, improve officer training for working with gang intervention workers,
			 create best practices for independent cooperation between officers and
			 intervention workers, and develop training for community policing.</text>
					</paragraph><paragraph id="H435B63F2300D437DAD75C9F5AF120736"><enum>(7)</enum><header>Support</header><text>The
			 Institute shall obtain initial and continuing support from experienced
			 researchers and practitioners, as it determines necessary, to test and assist
			 in implementing its strategies nationally, regionally, and locally.</text>
					</paragraph><paragraph id="HB51B9F182BAA4A2A9FD0144D822CDE8"><enum>(8)</enum><header>Research
			 agenda</header><text>The Institute shall establish and implement a core
			 research agenda designed to address areas of particular challenge,
			 including—</text>
						<subparagraph id="H60F6D459005A4EE7009D2E6D407160C3"><enum>(A)</enum><text>how best to apply
			 and continue to test the models described in paragraph (2) in particularly
			 large jurisdictions;</text>
						</subparagraph><subparagraph id="HEF1581C75F9F43FEA9319D2941135435"><enum>(B)</enum><text>how to foster and
			 maximize the continuing impact of community moral voices in this
			 context;</text>
						</subparagraph><subparagraph id="H1A5952D8DD8E491FB11DCB075800FCCD"><enum>(C)</enum><text>how to ensure the
			 long-term sustainability of reduced violent crime levels once initial levels of
			 enthusiasm may subside; and</text>
						</subparagraph><subparagraph id="HC16D9E77365D4BDF9673A800F20724C8"><enum>(D)</enum><text>how to apply
			 existing intervention frameworks to emerging local, regional, national, or
			 international gang problems, such as the emergence of the gang known as
			 MS–13.</text>
						</subparagraph></paragraph><paragraph id="H621E2373D8D54FB29F2FEFDFA800552B"><enum>(9)</enum><header>Evaluation</header><text>The
			 National Institute of Justice shall evaluate, on a continuing basis,
			 comprehensive gang violence prevention, intervention, suppression, and reentry
			 strategies supported by the Institute, and shall report the results of these
			 evaluations by no later than October 1 each year to the Committee on the
			 Judiciary of the Senate and the Committee on the Judiciary of the House of
			 Representatives.</text>
					</paragraph><paragraph id="HE506FB4802494749831F003D5DD1F171"><enum>(10)</enum><header>Funds</header><text>The
			 Attorney General shall use not less than 3 percent, and not more than 5
			 percent, of the amounts made available under this section to establish and
			 operate the Institute.</text>
					</paragraph></subsection><subsection commented="no" id="HD5C4F408AA68445BABA8235F542DC12F"><enum>(g)</enum><header>Use of
			 funds</header><text>Of amounts made available to a local collaborative working
			 group under this section for each fiscal year that are remaining after the
			 costs of hiring a full time coordinator for the local collaborative effort,
			 funds shall be used as follows:</text>
					<paragraph commented="no" id="H2DB3BBDD501B4735B124AFD2FF2FE57"><enum>(1)</enum><header>Gang Enforcement
			 and Research Funding</header><text display-inline="yes-display-inline">Fifty
			 percent of the funds shall be used—</text>
						<subparagraph commented="no" id="H4CDFE00BDAC746C6BC07D12E7F44A930"><enum>(A)</enum><text>for the operation
			 of criminal street gang enforcement teams;</text>
						</subparagraph><subparagraph commented="no" id="H002F41145245406900F00466913FFACF"><enum>(B)</enum><text>for the
			 establishment and operation of the National Gang Research, Evaluation, and
			 Policy Institute; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HE963D75E7D78465200007253AF1EA4E"><enum>(C)</enum><text display-inline="yes-display-inline">to support and provide technical assistance
			 to research in criminal justice, social services, and community gang violence
			 prevention collaborations.</text>
						</subparagraph></paragraph><paragraph commented="no" id="H1B62CDA3B60043A3B6674CEA20E5E045"><enum>(2)</enum><header>Gang Prevention
			 Funding</header><text display-inline="yes-display-inline">Fifty percent of the
			 funds shall be used to provide at-risk youth with positive alternatives to
			 gangs and other violent groups and to address the needs of those who leave
			 gangs and other violent groups through—</text>
						<subparagraph commented="no" id="H9BAF8711DFE94A818CBAF3FFE4111C52"><enum>(A)</enum><text>service providers
			 in the community, including schools, school districts, and county offices of
			 education that are engaged in activities that offer support and assistance to
			 local educational agencies; and</text>
						</subparagraph><subparagraph commented="no" id="HD6377A914B2F4C418300824025E42000"><enum>(B)</enum><text>faith leaders and
			 other individuals experienced at reaching youth who have been involved in
			 violence and violent gangs or groups.</text>
						</subparagraph></paragraph></subsection><subsection id="H82DDC34F7CA844B4AB8557B6D117B4B7"><enum>(h)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $100,000,000 for each of fiscal years 2010 through 2014. Any
			 funds made available under this subsection shall remain available until
			 expended.</text>
				</subsection></section><section id="H6B72C6BAC0A54E3E84C894423B6C79BC"><enum>302.</enum><header>Gang prevention
			 grants</header>
				<subsection id="H538DE947A94640A2812073A224766508"><enum>(a)</enum><header>Authority To
			 make grants</header>
					<paragraph id="H340AC82D39B149988F76AFEFF9090930"><enum>(1)</enum><header>Grants
			 authorized</header><text>The Office of Justice Programs of the Department of
			 Justice may make grants, in accordance with such regulations as the Attorney
			 General may prescribe, to States, units of local government, tribal
			 governments, and qualified private entities, to develop community-based
			 programs that provide crime prevention, research, and intervention services
			 that are designed for gang members and at-risk youth.</text>
					</paragraph><paragraph id="HEC82DD4C1B6146C486DEC628B0375531"><enum>(2)</enum><header>Selection
			 priority</header><text display-inline="yes-display-inline">In selecting
			 entities to receive grants under this section, the Office of Justice Programs
			 shall give priority to entities that—</text>
						<subparagraph id="HA01B983A306F4084AAF91959E4AAEDCF"><enum>(A)</enum><text display-inline="yes-display-inline">have a comprehensive strategy to carry out
			 community-based programs described in
			 <internal-xref idref="H340AC82D39B149988F76AFEFF9090930" legis-path="302.(a)(1)">paragraph (1)</internal-xref> to respond to local
			 gang-related issues (including prevention and intervention), or, with respect
			 to States or qualified private entities that are not able to carry out such a
			 strategy in a local community, coordinate with a local entity in such community
			 to carry out the comprehensive strategy of such local entity;</text>
						</subparagraph><subparagraph id="H30C7196B6F954235B2F98D7CE11FAEC4"><enum>(B)</enum><text>coordinate Federal
			 actions and resources to support local implementation of such comprehensive
			 strategies; and</text>
						</subparagraph><subparagraph id="HAE2FC91838AB482F8900EA32B7D7EDE"><enum>(C)</enum><text>maximize the
			 resources available from the various levels of government for such
			 community-based programs.</text>
						</subparagraph></paragraph></subsection><subsection id="H0378B142660F4181A2E86DEF7608FD1E"><enum>(b)</enum><header>Use of grant
			 amounts</header><text>A grant under this section may be used (including through
			 subgrants) for—</text>
					<paragraph id="HEA37695CDAF843E3832E2F5287E27F26"><enum>(1)</enum><text>preventing initial
			 gang recruitment and involvement among younger teenagers;</text>
					</paragraph><paragraph id="HD9B6CC31B8C54B78BD5015DEC0987B2F"><enum>(2)</enum><text>reducing gang
			 involvement through nonviolent and constructive activities, such as community
			 service programs, development of nonviolent conflict resolution skills,
			 employment and legal assistance, family counseling, and other safe,
			 community-based alternatives for high-risk youth;</text>
					</paragraph><paragraph id="H4F1160D949244F7F8560FB53C3626977"><enum>(3)</enum><text>developing
			 in-school and after-school gang safety, control, education, and resistance
			 procedures and programs;</text>
					</paragraph><paragraph id="HDCF620C79B0E4E55BFCC50358AF1664"><enum>(4)</enum><text>identifying and
			 addressing early childhood risk factors for gang involvement, including parent
			 training and childhood skills development;</text>
					</paragraph><paragraph id="HBB1A9EDC07664C9DBEDE7B451FB215EE"><enum>(5)</enum><text>identifying and
			 fostering protective factors that buffer children and adolescents from gang
			 involvement;</text>
					</paragraph><paragraph id="HAA2501251D4D456CA0EE7B37C28867E3"><enum>(6)</enum><text>developing and
			 identifying investigative programs designed to deter gang recruitment,
			 involvement, and activities through effective intelligence gathering;</text>
					</paragraph><paragraph id="H5152CDEEB86A442F91B96BBBAD3BB422"><enum>(7)</enum><text>developing
			 programs and youth centers for first-time nonviolent offenders facing
			 alternative penalties, such as mandated participation in community service,
			 restitution, counseling, and education and prevention programs;</text>
					</paragraph><paragraph id="HF0127BC04C7042F484DFD95FBC007397"><enum>(8)</enum><text display-inline="yes-display-inline">implementing regional, multidisciplinary
			 approaches to combat gang violence though coordinated programs for prevention
			 and intervention (including street outreach programs and other peacemaking
			 activities) or coordinated law enforcement activities that enhance
			 reintegration strategies for offender reentry; or</text>
					</paragraph><paragraph id="H5C907A057D9748519FA597F352FC1655"><enum>(9)</enum><text>identifying
			 at-risk and high-risk students through home visits organized through joint
			 collaborations between law enforcement, faith-based organizations, schools, and
			 social workers.</text>
					</paragraph></subsection><subsection id="HC73CB23853774573873F2624313FF6D5"><enum>(c)</enum><header>Grant
			 requirements</header>
					<paragraph id="H557D11268EE14BFBB4E64615B901CE8"><enum>(1)</enum><header>Maximum</header><text>The
			 amount of a grant under this section may not exceed $1,000,000.</text>
					</paragraph><paragraph id="HC5F618B59E3E4CD49334D6F921047917"><enum>(2)</enum><header>Consultation and
			 cooperation</header><text>Each recipient of a grant under this section shall
			 have in effect on the date of the application by that entity agreements to
			 consult and cooperate with local, State, or Federal law enforcement and
			 participate, as appropriate, in coordinated efforts to reduce gang activity and
			 violence.</text>
					</paragraph></subsection><subsection id="H89D70D07CC1A44338B6BCC333D58783B"><enum>(d)</enum><header>Annual
			 reports</header>
					<paragraph id="H6CB3FA9874FD42D0B3002C656FB4BE44"><enum>(1)</enum><header>Recipients</header><text>Each
			 recipient of a grant under this section shall submit to the Attorney General,
			 for each year in which funds from a grant received under this section are
			 expended, a report containing—</text>
						<subparagraph id="H680918B2471A42429528AAAEA53EC5FC"><enum>(A)</enum><text>a summary of the
			 activities carried out with grant funds during that year;</text>
						</subparagraph><subparagraph id="HA5576BF52C6E49C8BDCD0040D72F683B"><enum>(B)</enum><text>an assessment of
			 the effectiveness of the crime prevention, research, and intervention
			 activities of the recipient, based on data collected by the grant
			 recipient;</text>
						</subparagraph><subparagraph id="H15CC9AF941D54285BF5EC05160177999"><enum>(C)</enum><text>a strategic plan
			 for the year following the year described in paragraph (1);</text>
						</subparagraph><subparagraph id="H747DCF2946164CCB952EC9ECDEC8DEE7"><enum>(D)</enum><text>evidence of
			 consultation and cooperation with local, State, or Federal law enforcement or,
			 if the grant recipient is a government entity, evidence of consultation with an
			 organization engaged in any activity described in subsection (b); and</text>
						</subparagraph><subparagraph id="HEF4A2ABE28D948E88626E16BA62AA81"><enum>(E)</enum><text>such other
			 information as the Attorney General may require.</text>
						</subparagraph></paragraph><paragraph id="H325D6784424D4C57B7DF44EA49C4E3DD"><enum>(2)</enum><header>Attorney
			 General</header><text>Not later than one year after the date of the enactment
			 of this Act, and annually thereafter, the Attorney General shall submit to
			 Congress a report, based on the reports submitted under
			 <internal-xref idref="H6CB3FA9874FD42D0B3002C656FB4BE44" legis-path="302.(d)(1)">paragraph (1)</internal-xref>, identifying the best
			 practices of grant recipients under this section for responding to gang-related
			 issues, and important research relating to such best practices and issues. The
			 Attorney General shall make such report publicly available.</text>
					</paragraph></subsection><subsection id="H15EFE48EE86C4BDC90AED9613D2DE09F"><enum>(e)</enum><header>Definition</header><text>In
			 this section, the term <term>units of local government</term> includes sheriffs
			 departments, police departments, and local prosecutor offices.</text>
				</subsection><subsection id="H9E67C6A7F3E34881A7F60095F22468E2"><enum>(f)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated for grants
			 under this section $50,000,000 for each of the fiscal years 2010 through
			 2014.</text>
				</subsection></section><section id="H29FBC30781F5438C89710031087FC55E"><enum>303.</enum><header>Enhancement of
			 Project Safe Neighborhoods initiative to improve enforcement of criminal laws
			 against violent gangs</header>
				<subsection id="H2985904C0A9F4BD38DAD40A0DECB0061"><enum>(a)</enum><header>In
			 General</header><text>While maintaining the focus of Project Safe Neighborhoods
			 as a comprehensive, strategic approach to reducing gun violence in America, the
			 Attorney General is authorized to expand the Project Safe Neighborhoods program
			 to require each United States attorney to—</text>
					<paragraph id="HAD1181CB1A1748EBBB74E770DB73213D"><enum>(1)</enum><text>identify,
			 investigate, and prosecute significant criminal street gangs operating within
			 their district; and</text>
					</paragraph><paragraph id="HF08E498F78EE45A99E8427B2CB2E8CBA"><enum>(2)</enum><text>coordinate the
			 identification, investigation, and prosecution of criminal street gangs among
			 Federal, State, and local law enforcement agencies.</text>
					</paragraph></subsection><subsection id="HA12B92BB68BD4386A04BF26429F1F8D4"><enum>(b)</enum><header>Additional Staff
			 for Project Safe Neighborhoods</header>
					<paragraph id="HB8049D13273F47D0A7EB6600BFB3A4DB"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General may hire Assistant United States
			 attorneys, non-attorney coordinators, or paralegals to carry out the provisions
			 of this section.</text>
					</paragraph><paragraph id="HAF51AD6222D14774BA06A06CD791B23"><enum>(2)</enum><header>Enforcement</header><text>The
			 Attorney General may hire Bureau of Alcohol, Tobacco, Firearms, and Explosives
			 agents for, and otherwise expend additional resources in support of, the
			 Project Safe Neighborhoods/Firearms Violence Reduction program.</text>
					</paragraph></subsection><subsection id="H9006B28D2A3748A79116D7B45FE1339B"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated
			 $20,000,000 for each of the fiscal years 2010 through 2014 to carry out this
			 section. Any funds made available under this paragraph shall remain available
			 until expended.</text>
				</subsection></section><section id="HD18D08900C444E1F81441CEA386EE09B"><enum>304.</enum><header>Additional
			 resources needed by the Federal Bureau of Investigation to investigate and
			 prosecute violent criminal street gangs</header>
				<subsection id="HBB2DC10E8FC1422089223FDC02C6C133"><enum>(a)</enum><header>Expansion of
			 safe streets program</header><text>The Attorney General is authorized to expand
			 the Safe Streets Program of the Federal Bureau of Investigation for the purpose
			 of supporting criminal street gang enforcement teams.</text>
				</subsection><subsection id="H58262F6FF86A4583004140A220C7AAD"><enum>(b)</enum><header>National gang
			 activity database</header>
					<paragraph id="H84E4F380C67D49FF88ACE4C68C00BB59"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall establish a National Gang
			 Activity Database to be housed at and administered by the Department of
			 Justice.</text>
					</paragraph><paragraph id="H381CC04F822B4B758BA1441647809E67"><enum>(2)</enum><header>Description</header><text>The
			 database required by paragraph (1) shall—</text>
						<subparagraph id="HEB1970567F334BBB966E466849FABCC"><enum>(A)</enum><text>be designed to
			 disseminate gang information to law enforcement agencies throughout the country
			 and, subject to appropriate controls, to disseminate aggregate statistical
			 information to other members of the criminal justice system, community leaders,
			 academics, and the public;</text>
						</subparagraph><subparagraph id="H0FC586C91B2F4F5BA701912DF5AC983C"><enum>(B)</enum><text>contain critical
			 information on gangs, gang members, firearms, criminal activities, vehicles,
			 and other information useful for investigators in solving and reducing
			 gang-related crimes;</text>
						</subparagraph><subparagraph id="H2D778B47446244A1B8826480D634F400"><enum>(C)</enum><text>operate in a
			 manner that enables law enforcement agencies to—</text>
							<clause id="HFC0023617B5A40A3A961F478005DC0D"><enum>(i)</enum><text>identify gang
			 members involved in crimes;</text>
							</clause><clause id="HD1790A524FB1450984155409A7D24D5D"><enum>(ii)</enum><text>track the
			 movement of gangs and members throughout the region;</text>
							</clause><clause id="H529C71D5733D401AAF29F06FA2EAD8E"><enum>(iii)</enum><text>coordinate law
			 enforcement response to gang violence;</text>
							</clause><clause id="H01E307856C40470B9CD730BBB9587185"><enum>(iv)</enum><text>enhance officer
			 safety;</text>
							</clause><clause id="HA0CB044FFC3B479985323B636E083435"><enum>(v)</enum><text>provide realistic,
			 up-to-date figures and statistical data on gang crime and violence;</text>
							</clause><clause id="H74105440CD104B3D86C8A7FFEB20DF7C"><enum>(vi)</enum><text>forecast trends
			 and respond accordingly; and</text>
							</clause><clause id="HBCBCD69780664DD0A2E8B24734600C9"><enum>(vii)</enum><text>more easily solve
			 crimes and prevent violence; and</text>
							</clause></subparagraph><subparagraph id="H8089ED0E102F4629A62BE3A9497325D6"><enum>(D)</enum><text>be subject to
			 guidelines, issued by the Attorney General, specifying the criteria for adding
			 information to the database, the appropriate period for retention of such
			 information, and a process for removing individuals from the database, and
			 prohibiting disseminating gang information to any entity that is not a law
			 enforcement agency, except aggregate statistical information where
			 appropriate.</text>
						</subparagraph></paragraph><paragraph id="HB53033E9239249BFA1ACDEE1E0FDC8C5"><enum>(3)</enum><header>Use of riss
			 secure intranet</header><text>From amounts made available to carry out this
			 section, the Attorney General shall provide the Regional Information Sharing
			 Systems such sums as are necessary to use the secure intranet known as RISSNET
			 to electronically connect existing gang information systems (including the
			 RISSGang National Gang Database) with the National Gang Activity Database,
			 thereby facilitating the automated information exchange of existing gang data
			 by all connected systems without the need for additional databases or data
			 replication.</text>
					</paragraph></subsection><subsection id="H51812E207A8D4CE2B7B37459BD95EE1"><enum>(c)</enum><header>Authorization of
			 Appropriations</header>
					<paragraph id="H6B4A0A71A0DB4496AF9E29D38F009120"><enum>(1)</enum><header>In
			 general</header><text>In addition to amounts otherwise authorized, there are
			 authorized to be appropriated to the Attorney General $10,000,000 for each of
			 the fiscal years 2010 through 2014 to carry out this section.</text>
					</paragraph><paragraph id="HE83945B66A614B31AB8D24359C5D8D71"><enum>(2)</enum><header>Availability</header><text>Any
			 amounts appropriated under paragraph (1) shall remain available until
			 expended.</text>
					</paragraph></subsection></section><section id="HB3BBA9F6C70F4DB1B800F64093925D50"><enum>305.</enum><header>Grants to
			 prosecutors and law enforcement to combat violent crime</header>
				<subsection id="H35FA13D9DCCD4E3894008F25BFA7D32C"><enum>(a)</enum><header>In
			 General</header><text>Section 31702 of the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement Act of
			 1994</act-name> (42 U.S.C. 13862) is amended—</text>
					<paragraph id="H64DA2DB9F6A6462AA96300F2F2E321E4"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph id="H71C2965EB22449E5A14C300030DE972B"><enum>(2)</enum><text>in paragraph (4),
			 by striking the period at the end and inserting a semicolon; and</text>
					</paragraph><paragraph id="H3231AC48E9EE4878B582BAF1A3252060"><enum>(3)</enum><text>by adding at the
			 end the following:</text>

								</subparagraph></paragraph><paragraph id="H3D7AD360595B4AE300529CDF3985D033"><enum>(6)</enum><text>to fund
				technology, equipment, and training for prosecutors and law enforcement in
				order to increase accurate identification of gang members and violent
				offenders, and to maintain databases with such information to facilitate
				coordination among law enforcement and
				prosecutors.</text>

					</paragraph></subsection><subsection id="HD17C371120304CE1A110306300C6C329"><enum>(b)</enum><header>Authorization of
			 Appropriations</header><text>Section 31707 of the
			 <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement
			 Act of 1994</act-name> (42 U.S.C. 13867) is amended to read as follows:</text>

			 General</header><text>The National District Attorneys Association may use the
			 services of the National Advocacy Center in Columbia, South Carolina, to
			 conduct a national training program for State and local prosecutors for the
			 purpose of improving the professional skills of State and local prosecutors and
			 enhancing the ability of Federal, State, and local prosecutors to work
			 together.</text>
				</subsection><subsection id="HAD892A7A00094D8EA55F152534EEDFC9"><enum>(b)</enum><header>Training</header><text>The
			 National Advocacy Center in Columbia, South Carolina, may provide comprehensive
			 continuing legal education in the areas of trial practice, substantive legal
			 updates, and support staff training.</text>
				</subsection><subsection id="H056AD81FB325446985039DA879493905"><enum>(c)</enum><header>Authorization of
			 Appropriations</header><text>There are authorized to be appropriated to the
			 Attorney General to carry out this section $6,500,000, to remain available
			 until expended, for fiscal years 2010 through 2013.</text>
				</subsection></section><section id="H43EBECAA024C4C43B458A238EDD4D399"><enum>307.</enum><header>Short-Term
			 State Witness Protection Section</header>
				<subsection id="H60AF74094DC943E2A51F027F3C8DC496"><enum>(a)</enum><header>Establishment</header>
					<paragraph id="HC7C14824F9184B310095E14FA50617A3"><enum>(1)</enum><header>In
			 general</header><text>Chapter 37 of title 28, United States Code, is amended by
			 adding at the end the following:</text>

				general</header><text>There is established in the United States Marshals
				Service a Short-Term State Witness Protection Section which shall provide
				protection for witnesses in State and local trials involving homicide or other
				major violent crimes pursuant to cooperative agreements with State and local
				criminal prosecutor's offices and the United States attorney for the District
				of Columbia.</text>
								</subsection><subsection id="H70ECA68AE08D41DA00EE7BBAFACE5E3"><enum>(b)</enum><header>Eligibility</header>
									<paragraph id="H0ED6C1ABC8C34CF899EF8340CB68FA34"><enum>(1)</enum><header>In
				general</header><text>The Short-Term State Witness Protection Section shall
				give priority in awarding grants and providing services to—</text>
										<subparagraph id="HABFE551A3F2846AB9EF0CF00C1317295"><enum>(A)</enum><text>criminal
				prosecutor's offices for States with an average of not less than 100 murders
				per year; and</text>
										</subparagraph><subparagraph id="HC8020917F0594EECBD873E1C1151BC42"><enum>(B)</enum><text>criminal
				prosecutor's offices for jurisdictions that include a city, town, or township
				with an average violent crime rate per 100,000 inhabitants that is above the
				national average.</text>
										</subparagraph></paragraph><paragraph id="H9164DD8796274EFDB224CDF411F8483E"><enum>(2)</enum><header>Calculation</header><text>The
				rate of murders and violent crime under
				<internal-xref idref="H0ED6C1ABC8C34CF899EF8340CB68FA34" legis-path="570.(b)(1)">paragraph (1)</internal-xref> shall be calculated using
				the latest available crime statistics from the Federal Bureau of Investigation
				during the 5-year period immediately preceding an application for
				protection.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph><paragraph id="H2F74438E781B4EF8ADB327FBD3484F03"><enum>(2)</enum><header>Chapter

			 prosecutor's office or the United States attorney for the District of Columbia;
			 and</text>
						</subparagraph><subparagraph id="HBC461C6457E74D0DA7D8A51F6F1CD190"><enum>(B)</enum><text>the term
			 <term>serious violent felony</term> has the same meaning as in section
			 3559(c)(2) of title 18, United States Code.</text>
						</subparagraph></paragraph><paragraph id="H2F2482055542417985DE375D3B2C453C"><enum>(2)</enum><header>Grants
			 authorized</header>
						<subparagraph id="H8360E70836B04B5A8523A0DD69E81EE7"><enum>(A)</enum><header>In
			 general</header><text>The Attorney General is authorized to make grants to
			 eligible prosecutor's offices for purposes of identifying witnesses in need of
			 protection or providing short term protection to witnesses in trials involving
			 homicide or serious violent felony.</text>
						</subparagraph><subparagraph id="HC00B9507F6A44B0884ECFC6989F040F2"><enum>(B)</enum><header>Allocation</header><text>Each
			 eligible prosecutor's office receiving a grant under this subsection
			 may—</text>
							<clause id="HA941E2994B9948409E3658AA341503A0"><enum>(i)</enum><text>use
			 the grant to identify witnesses in need of protection or provide witness
			 protection (including tattoo removal services); or</text>
							</clause><clause id="H21139A80EF2847179F574FED7C9DFCEC"><enum>(ii)</enum><text>pursuant to a
			 cooperative agreement with the Short-Term State Witness Protection Section of
			 the United States Marshals Service, credit the grant to the Short-Term State
			 Witness Protection Section to cover the costs to the section of providing
			 witness protection on behalf of the eligible prosecutor's office.</text>
							</clause></subparagraph></paragraph><paragraph id="H4A0C42BCD7FD4497A8E9C94E8923C900"><enum>(3)</enum><header>Application</header>
						<subparagraph id="H4F7C65767C784002975F28EE49A04B05"><enum>(A)</enum><header>In
			 general</header><text>Each eligible prosecutor's office desiring a grant under
			 this subsection shall submit an application to the Attorney General at such
			 time, in such manner, and accompanied by such information as the Attorney
			 General may reasonably require.</text>
						</subparagraph><subparagraph id="HB9DA661EF9E14A088F7286A7357E5C58"><enum>(B)</enum><header>Contents</header><text>Each
			 application submitted under subparagraph (A) shall—</text>
							<clause id="H77F482DB78CA4481A2F7894E854EE271"><enum>(i)</enum><text>describe the
			 activities for which assistance under this subsection is sought; and</text>
							</clause><clause id="H18FFB741D87A465586A4BDCF32A8F926"><enum>(ii)</enum><text>provide such
			 additional assurances as the Attorney General determines to be essential to
			 ensure compliance with the requirements of this subsection.</text>
							</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H3C324883DA5041FA9B4117802955F018"><enum>(c)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $90,000,000 for each of fiscal years 2010 through 2012.</text>
				</subsection></section><section commented="no" display-inline="no-display-inline" id="HBF0653B6A554472C8DDB1531DCC3E92"><enum>308.</enum><header>Witness
			 protection services</header><text display-inline="no-display-inline">Section
			 3526 of title 18, United States Code (Cooperation of other Federal agencies and
			 State governments; reimbursement of expenses), is amended by adding at the end
			 the following:</text>
				<quoted-block committee-id="SSJU00" display-inline="no-display-inline" id="H171DF6707DC9455B9D325FA73832F3E9" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="HD3852FE22BBC4C9D8CE168B7CADE19A6"><enum>(c)</enum><text display-inline="yes-display-inline">In any case in which a State government
				requests the Attorney General to provide temporary protection under section
				3521(e) of this title, the costs of providing temporary protection are not
				reimbursable if the investigation or prosecution in any way relates to crimes
				of violence committed by a criminal street gang, as defined under the laws of
				the relevant State seeking assistance under this
				title.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</section><section commented="no" display-inline="no-display-inline" id="H172CCC72629E44E6AD939E347474548B"><enum>309.</enum><header>Expansion of
			 Federal witness relocation and protection program</header><text display-inline="no-display-inline">Section 3521(a)(1) of title 18, United
			 States Code, is amended by inserting <quote>, criminal street gang, serious
			 drug offense, homicide,</quote> after <quote>organized criminal
			 activity</quote>.</text>
			</section><section id="HF97CA3BDD7BF471AB905AFD632F3F91"><enum>310.</enum><header>Family abduction
			 prevention grant program</header>
				<subsection id="H6AE5C58F1E334D590021561DAA508226"><enum>(a)</enum><header>State
			 grants</header><text>The Attorney General is authorized to make grants to
			 States for projects involving—</text>
					<paragraph id="HC065D181D927465F854603C197FBEA7C"><enum>(1)</enum><text>the extradition of
			 individuals suspected of committing a family abduction;</text>
					</paragraph><paragraph id="HF8A0FD1CB3CF4488B5AB802C2666E346"><enum>(2)</enum><text>the investigation
			 by State and local law enforcement agencies of family abduction cases;</text>
					</paragraph><paragraph id="H25D84F563F0D4865AF3BE149F65FA335"><enum>(3)</enum><text>the training of
			 State and local law enforcement agencies in responding to family abductions and
			 recovering abducted children, including the development of written guidelines
			 and technical assistance;</text>
					</paragraph><paragraph id="HD52272C1F34B46F98CA3BF2285106DA4"><enum>(4)</enum><text>outreach and media
			 campaigns to educate parents on the dangers of family abductions; and</text>
					</paragraph><paragraph id="HDC53246696E543BF85C7EEB2F3BC2F5D"><enum>(5)</enum><text>the flagging of
			 school records.</text>
					</paragraph></subsection><subsection id="H03350D24F8834E61A0D5469655183E38"><enum>(b)</enum><header>Matching
			 requirement</header><text>Not less than 50 percent of the cost of a project for
			 which a grant is made under this section shall be provided by non-Federal
			 sources.</text>
				</subsection><subsection id="H7D983A0349DF43B4A9BDB7005169D060"><enum>(c)</enum><header>Definitions</header><text>In
			 this section:</text>
					<paragraph id="HC081DC7B25A84A279F73D6E2004CEE00"><enum>(1)</enum><header>Family
			 abduction</header><text>-The term <term>family abduction</term> means the
			 taking, keeping, or concealing of a child or children by a parent, other family
			 member, or person acting on behalf of the parent or family member, that
			 prevents another individual from exercising lawful custody or visitation
			 rights.</text>
					</paragraph><paragraph id="HDB418202075F490F82E8CFAA21AE3308"><enum>(2)</enum><header>Flagging</header><text>The
			 term <term>flagging</term> means the process of notifying law enforcement
			 authorities of the name and address of any person requesting the school records
			 of an abducted child.</text>
					</paragraph><paragraph id="HD01929D529CD4CA999C001FA2569A81B"><enum>(3)</enum><header>State</header><text>The
			 term <term>State</term> means each of the several States, the District of
			 Columbia, the Commonwealth of Puerto Rico, the Commonwealth of the Northern
			 Mariana Islands, American Samoa, Guam, the Virgin Islands, any territory or
			 possession of the United States, and any Indian tribe.</text>
					</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HE5182C4FA87E478B9159446F039069D3"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $500,000 for fiscal year 2010 and such sums as may be
			 necessary for each of fiscal years 2011 and 2012.</text>
				</subsection></section><section id="H8475E7FEF9C74F40AF9E81CB1C45BE10"><enum>311.</enum><header>Study on
			 adolescent development and sentences in the Federal system</header>
				<subsection id="HDF28CF17789C4BF4982200171F0039D8"><enum>(a)</enum><header>In
			 general</header><text>The United States Sentencing Commission shall conduct a
			 study to examine the appropriateness of sentences for minors in the Federal
			 system.</text>
				</subsection><subsection id="HD7E600A72DAE4FC1ACE860F00064D638"><enum>(b)</enum><header>Contents</header><text>The
			 study conducted under subsection (a) shall—</text>
					<paragraph id="H1F09C6D913D440B8ABB83006239C2D8C"><enum>(1)</enum><text>incorporate the
			 most recent research and expertise in the field of adolescent brain development
			 and culpability;</text>
					</paragraph><paragraph id="HA02780C8B6624535B0789ECDB8DFF1E"><enum>(2)</enum><text>evaluate the toll
			 of juvenile crime, particularly violent juvenile crime, on communities;</text>
					</paragraph><paragraph id="H8C832C806F934EC1805F546C1E96E7CB"><enum>(3)</enum><text>consider the
			 appropriateness of life sentences without possibility for parole for minor
			 offenders in the Federal system; and</text>
					</paragraph><paragraph id="H478A2C6895C2435FB64B37226866A4ED"><enum>(4)</enum><text>evaluate issues of
			 recidivism by juveniles who are released from prison or detention after serving
			 determinate sentences.</text>
					</paragraph></subsection><subsection id="H9C9A442BFC8E41759648BF4EDA4D3114"><enum>(c)</enum><header>Report</header><text>Not
			 later than 1 year after the date of enactment of this Act, the United States
			 Sentencing Commission shall submit to Congress a report regarding the study
			 conducted under subsection (a), which shall—</text>
					<paragraph id="H674036326F994D24BBFF45A16555E718"><enum>(1)</enum><text>include the
			 findings of the Commission;</text>
					</paragraph><paragraph id="HF976B965923148EDB96900F364C81928"><enum>(2)</enum><text>describe
			 significant cases reviewed as part of the study; and</text>
					</paragraph><paragraph id="HFAA69368461548D1BC1540D500F4BB26"><enum>(3)</enum><text>make
			 recommendations, if any.</text>
					</paragraph></subsection><subsection id="H39A8CC1654A146378CBF19D2DB6048B6"><enum>(d)</enum><header>Revision of
			 guidelines</header><text>If determined appropriate by the United States
			 Sentencing Commission, after completing the study under subsection (a) the
			 Commission may, pursuant to its authority under section 994 of title 28, United
			 States Code, establish or revise guidelines and policy statements, as
			 warranted, relating to the sentencing of minors under this Act or the
			 amendments made by this Act.</text>
				</subsection></section></title><title id="HA702889FF6EE4CD000CBDB9C58B3B814"><enum>IV</enum><header>Resources to
			 strengthen employment and education opportunities for former offenders</header>
			<section id="H22D77263F47A447FA700EF553B297476"><enum>401.</enum><header>Grants to
			 assist juvenile offender reintegration projects</header>
				<subsection id="H0D0A63DE2BC74250A6380000E67FE400"><enum>(a)</enum><header>Authority To
			 make grants for juvenile offender reintegration projects</header><text>From
			 amounts made available to carry out this section, the Secretary of Labor, in
			 consultation with the Attorney General, shall make grants to carry out juvenile
			 offender reintegration projects that are designed to provide services to
			 eligible juvenile offenders that will reduce recidivism, increase educational
			 attainment, and enhance long-term employability of such offenders. Such grants
			 may be awarded to nonprofit organizations, workforce investment boards
			 established under title I of the Workforce Investment Act of 1998, States, and
			 units of local government.</text>
				</subsection><subsection id="HB43C6B50AF0F4FA78ED007A5BCA9DEF8"><enum>(b)</enum><header>Definitions</header><text>For
			 the purposes of this section:</text>
					<paragraph id="H3B6760133BBE49659D59D48D309DD415"><enum>(1)</enum><header>Eligible
			 juvenile offenders</header><text>The term <term>eligible juvenile
			 offenders</term> means individuals who—</text>
						<subparagraph id="HBF8998B249E24031B29BE710DF03F009"><enum>(A)</enum><text>are 14 to 21 years
			 of age; and</text>
						</subparagraph><subparagraph id="H7FEB4D31F62643CA80E4272BD36D017D"><enum>(B)</enum><text>have been involved
			 in the criminal justice system for a gang-related offense during the one-year
			 period immediately preceding the date on which a determination of eligibility
			 is made.</text>
						</subparagraph></paragraph><paragraph id="HB46B16A4EF374C01859786BD016B4BB9"><enum>(2)</enum><header>Involved in the
			 criminal justice system</header><text display-inline="yes-display-inline">The
			 term <term>involved in the criminal justice system</term> means, with respect
			 to an individual, that the individual is being held in a juvenile or adult
			 correctional facility or detention center, has been released from a juvenile or
			 adult correctional facility or detention center, has been sentenced in court to
			 probation or an alternative sentence, or has been referred by court personnel
			 to an alternative program.</text>
					</paragraph></subsection><subsection id="HC3102EA0CA0D4527BF5BC4FDBFBC237C"><enum>(c)</enum><header>Use of
			 funds</header>
					<paragraph id="H95E4250E751648C9A8BB717430D34888"><enum>(1)</enum><header>In
			 general</header><text>Funds for juvenile offender reintegration projects under
			 this section may be expended for—</text>
						<subparagraph id="HECA56430FA464BDD8BFAF1812108B723"><enum>(A)</enum><text>providing
			 tutoring, dropout prevention activities, academic credit retrieval activities,
			 basic skills instruction and remedial education, and language instruction for
			 individuals with limited English proficiency, in order to assist eligible
			 juvenile offenders in obtaining a high school diploma or GED or to participate
			 in postsecondary education;</text>
						</subparagraph><subparagraph id="HADD7EE7EC68140F8B8C4C52278A3D700"><enum>(B)</enum><text>providing career
			 exploration and education activities, pre-apprenticeship activities, activities
			 relating to the attainment of industry-recognized credentials, and activities
			 to increase placement in registered apprenticeship programs for eligible
			 juvenile offenders;</text>
						</subparagraph><subparagraph id="HF02B481FBDD3448FA964F7D89F5B0725"><enum>(C)</enum><text>mentoring eligible
			 juvenile offenders, including the provision of support, guidance, and
			 assistance to address the challenges faced by such juvenile offenders in
			 reintegrating into the community;</text>
						</subparagraph><subparagraph id="HFA09AD6E3B3A424E9FF8DF03A47FC55F"><enum>(D)</enum><text>providing job
			 training and job placement services to eligible juvenile offenders, including
			 work readiness activities, job referrals, educational services, occupational
			 skills training, on-the-job training, and paid and unpaid work experience
			 (including internships and job shadowing activities);</text>
						</subparagraph><subparagraph id="HDE46C2FE59FA43E5B22EE16B4CEB8F75"><enum>(E)</enum><text>providing
			 outreach, orientation, intake, assessments, counseling, case management,
			 personal development activities, and other transitional services to eligible
			 juvenile offenders; and</text>
						</subparagraph><subparagraph id="HE9E2912C1A0845CA9B4D8B7053719D20"><enum>(F)</enum><text>providing
			 follow-up services to eligible juvenile offenders that will assist in
			 advancement in education and employment.</text>
						</subparagraph></paragraph><paragraph id="HFC6CC11E2C5A4F93B042B6E0BBC2A599"><enum>(2)</enum><header>Limitation on
			 use of funds</header><text>Not more than 15 percent of the funds awarded to a
			 grantee under this section may be used for administrative costs necessary to
			 carry out a project under this section.</text>
					</paragraph></subsection><subsection id="HF3C24527DD57473ABCF9D1465849785F"><enum>(d)</enum><header>Application</header><text>To
			 be considered to receive a grant under this section to carry out a juvenile
			 offender reintegration project, a nonprofit organization, workforce investment
			 board established under title I of the Workforce Investment Act of 1998, State,
			 or unit of local government, or a combination thereof, shall submit an
			 application to the Secretary of Labor at such time, in such manner and
			 accompanied by such information as the Secretary of Labor may require. Such
			 application shall include—</text>
					<paragraph id="HBA45A446A9E54CB6867CF42BACE35E84"><enum>(1)</enum><text>a
			 plan describing the design of the project to assist eligible juvenile
			 offenders, including services to be provided to such offenders;</text>
					</paragraph><paragraph commented="no" id="HD61D4450A19245E09805A36C1F37F741"><enum>(2)</enum><text display-inline="yes-display-inline">a description of any partnerships between
			 the applicant and Federal, State, or local criminal justice agencies, workforce
			 investment boards, schools and institutions of higher education, businesses,
			 and service providers in the community, including those experienced in—</text>
						<subparagraph id="H4B265D16FC67490A96C4B464D611B88"><enum>(A)</enum><text>reaching youth and
			 adults who have been involved in violence and violent gangs or groups;</text>
						</subparagraph><subparagraph id="H74A64CDD064D4F798C34A8C4A6AF1010"><enum>(B)</enum><text>providing
			 gang-involved or seriously at-risk youth with positive alternatives to gangs
			 and other violent groups; and</text>
						</subparagraph><subparagraph id="H32B4AB2239B74E048294EBB2B1EC1F83"><enum>(C)</enum><text>addressing the
			 needs of individuals who leave gangs and other violent groups, and individuals
			 reentering society from prison; and</text>
						</subparagraph></paragraph><paragraph commented="no" id="H2CD884DB1BDC43BDBCEF90996016006C"><enum>(3)</enum><text display-inline="yes-display-inline">an assurance that the applicant will
			 provide not less than 25 percent of the cost of the project to assist eligible
			 juvenile offenders from non-Federal sources.</text>
					</paragraph></subsection><subsection id="H9705D44A6BEC4A92905EC9218266DBC2"><enum>(e)</enum><header>Performance
			 outcomes</header>
					<paragraph id="HEAAFA424CA6744038067F02C8B6BC600"><enum>(1)</enum><header>Core
			 indicators</header><text>Each grantee receiving funds to carry out a project
			 under this section shall report to the Secretary of Labor on the results
			 obtained by the eligible juvenile offenders served by the activities under the
			 grant with respect to the following indicators of performance:</text>
						<subparagraph id="H207CF02C8E6D4933B8D6FC96140069D1"><enum>(A)</enum><text>Rates of
			 recidivism.</text>
						</subparagraph><subparagraph id="H3753D19C0751494B9F9E3B413530F092"><enum>(B)</enum><text>Placement in
			 employment or postsecondary education for eligible juvenile offenders age 18 or
			 older.</text>
						</subparagraph><subparagraph id="H666D7577BBDB430E918756E933763CEB"><enum>(C)</enum><text display-inline="yes-display-inline">Attainment of a degree or certificate
			 (including a high school diploma, the recognized equivalent of such a diploma,
			 or a certificate of graduation from trade school).</text>
						</subparagraph><subparagraph id="H17BBD3C319E24D6888FF4CD2BB49C2D5"><enum>(D)</enum><text>Literacy and
			 numeracy gains.</text>
						</subparagraph></paragraph><paragraph id="H6C8DC19987354F21BE01AB5CCD7822D5"><enum>(2)</enum><header>Additional
			 indicators</header><text>In addition to the indicators described in
			 <internal-xref idref="HEAAFA424CA6744038067F02C8B6BC600" legis-path="401.(e)(1)">paragraph (1)</internal-xref>, the Secretary may
			 require grantees carrying out projects under this section to report on
			 additional indicators of performance.</text>
					</paragraph></subsection><subsection id="HB12EB4F452A744CEB8EF97BBDA69CD71"><enum>(f)</enum><header>Reports</header><text>Each
			 grantee receiving funds to carry out a project under this section shall
			 maintain such records and submit such reports, in such form and containing such
			 information, as the Secretary of Labor may require regarding the activities
			 carried out and the performance of such projects.</text>
				</subsection><subsection id="H95597C0068AA4ABD94C5B8C5E2F0668C"><enum>(g)</enum><header>Technical
			 assistance</header><text>The Secretary may reserve not more than 4 percent of
			 the funds appropriated under this section to provide technical assistance and
			 for management information systems to assist grantees under this
			 section.</text>
				</subsection><subsection id="HF2286D6BCBB14C44B33CFD1F449CAC07"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of Labor to carry out this section $20,000,000 for each of the fiscal
			 years 2010 through 2014.</text>
				</subsection></section><section id="HD7BA8D29B0AB4445B6FEC1FD7191A7B5"><enum>402.</enum><header>Employment and
			 education grants to assist in reducing recidivism</header>
				<subsection id="HB9FD07A9CFDC41CAA2095EC4E3D398AD"><enum>(a)</enum><header>Grants for
			 employment services for young adult gang members</header><text>From the amounts
			 made available to carry out this subsection, the Secretary of Labor, in
			 consultation with the Attorney General, shall make grants to nonprofit
			 organizations to carry out employment programs for young adult gang members
			 that are designed to reduce recidivism and enhance long-term
			 employability.</text>
				</subsection><subsection id="HA597B757A78643E18BD9BBAB92C7F6"><enum>(b)</enum><header>Use of
			 funds</header>
					<paragraph id="H9AA76BEC2DE44346B7C376048DAB1C03"><enum>(1)</enum><header>Apprenticeship
			 and pre-apprenticeship programs</header><text>Funds awarded under this
			 subsection shall be used to provide education and training services to young
			 adult gang members as part of, or to supplement, registered apprenticeship
			 programs in the construction or other industries or pre-apprenticeship programs
			 that are certified by a registered apprenticeship program in the construction
			 or other industries.</text>
					</paragraph><paragraph id="HA7EB51152D354D43B89D164C22D6E42F"><enum>(2)</enum><header>Other
			 activities</header><text>In addition to the activities described in
			 <internal-xref idref="H9AA76BEC2DE44346B7C376048DAB1C03" legis-path="402.(b)(1)">paragraph (1)</internal-xref>, funds awarded under this
			 subsection may be used to provide outreach, orientation, intake, assessments,
			 counseling, case management, personal business development and entrepreneurial
			 activities, supportive services, and follow-up services to young adult gang
			 members.</text>
					</paragraph></subsection><subsection id="H2829B2DF3146445ABA008900AB6394FE"><enum>(c)</enum><header>Application</header><text>To
			 be considered to receive a grant under
			 <internal-xref idref="HB9FD07A9CFDC41CAA2095EC4E3D398AD" legis-path="402.(a)">subsection (a)</internal-xref>, a nonprofit organization
			 shall submit an application to the Secretary of Labor at such time, in such
			 manner and accompanied by such information as the Secretary of Labor may
			 require. At a minimum, the application shall include—</text>
					<paragraph id="H71446DAE77AC40039169ACBFB0365877"><enum>(1)</enum><text>a
			 description of the need for projects relating to gang members in the geographic
			 area to be served by the grant;</text>
					</paragraph><paragraph id="H1827324412514C608334BEA6F07B0256"><enum>(2)</enum><text>a
			 plan describing the design of the project, including services to be provided;
			 and</text>
					</paragraph><paragraph id="HF9BF68DB60AE44BD0058F092A6961F69"><enum>(3)</enum><text>a
			 description of partnerships that will support the project.</text>
					</paragraph></subsection><subsection id="H2E2696D5BB3346B3A317ACEEF746306D"><enum>(d)</enum><header>Performance
			 outcomes</header>
					<paragraph id="HB13BE21BDB5E4B00A1254E94F4CB84EF"><enum>(1)</enum><header>Core
			 indicators</header>
						<subparagraph id="H1EFB7466E2A94315B197F4D5815170B3"><enum>(A)</enum><header>Young adult gang
			 members</header><text>Each grantee receiving funds to carry out a project under
			 <internal-xref idref="HB9FD07A9CFDC41CAA2095EC4E3D398AD" legis-path="402.(a)">subsection (a)</internal-xref> shall report to the
			 Secretary of Labor on the results obtained by young adult gang members served
			 under the grant with respect to the following indicators of performance:</text>
							<clause id="HB29CEE9D04F248C5007257A65FD7A92"><enum>(i)</enum><text>Rates
			 of recidivism.</text>
							</clause><clause id="H2A1CAB7D542047BF8665B669D3CDED15"><enum>(ii)</enum><text>Placement in
			 employment.</text>
							</clause><clause id="HEC42BB52BF7F415DA9CFC39517FA00E"><enum>(iii)</enum><text>Retention in
			 employment.</text>
							</clause><clause id="H5FB74F639F39464F9584CE6E850009E1"><enum>(iv)</enum><text>Earnings.</text>
							</clause></subparagraph></paragraph><paragraph id="HF51C39A955C748849960F45B52C65172"><enum>(2)</enum><header>Additional
			 indicators</header><text>In addition to the indicators described in
			 <internal-xref idref="HB13BE21BDB5E4B00A1254E94F4CB84EF" legis-path="402.(d)(1)">paragraph (1)</internal-xref>, the Secretary of Labor
			 may require grantees carrying out projects under
			 <internal-xref idref="HB9FD07A9CFDC41CAA2095EC4E3D398AD" legis-path="402.(a)">subsection (a)</internal-xref> to report on additional
			 indicators of performance.</text>
					</paragraph></subsection><subsection id="H236B3D2C682B4862A9659EF168BFF87D"><enum>(e)</enum><header>Reports</header><text>Each
			 grantee receiving funds to carry out a project under
			 <internal-xref idref="HB9FD07A9CFDC41CAA2095EC4E3D398AD" legis-path="402.(a)">subsection (a)</internal-xref> shall maintain such records
			 and submit such reports, in such form and containing such information, as the
			 Secretary of Labor may require regarding the activities carried out and the
			 performance of such projects.</text>
				</subsection><subsection id="H5D58F42B42C3472B90F54BF250261D10"><enum>(f)</enum><header>Technical
			 assistance</header><text>The Secretary of Labor may reserve not more than 2
			 percent of the funds appropriated under this section to provide technical
			 assistance.</text>
				</subsection><subsection id="H7184FE55223D4599A1C91F59D5BBCF44"><enum>(g)</enum><header>Definition</header><text>For
			 purposes of this subsection, the term <term>young adult gang member</term>
			 means an individual who—</text>
					<paragraph id="H808C7A5E5A374C25BEE50197B89295D"><enum>(1)</enum><text>is
			 not younger than age 17 or older than age 24; and</text>
					</paragraph><paragraph id="H1924A28AA0F0468CB713AD8FF9CA873"><enum>(2)</enum><text>has been arrested
			 or adjudicated in the juvenile justice system or the adult criminal justice
			 system for a gang-related offense.</text>
					</paragraph></subsection><subsection id="H0DC63B559BE044E1B4D52D99CC2D4852"><enum>(h)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Secretary of Labor to carry out this section $20,000,000 for each of the fiscal
			 years 2010 through 2014.</text>
