		provide advance appropriations authority for certain accounts of the Department
		of Veterans Affairs, and for other purposes.</quote>, do pass with the

					<section commented="no" display-inline="no-display-inline" id="id44092703886E486A87552B8AB57B4E16" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		  <quote><short-title>Veterans Health Care Budget Reform and
		  Transparency Act of 2009</short-title></quote>.</text>
					</section><section commented="no" display-inline="no-display-inline" id="id84C3D3A3F55C4CA08FFAB705075384CB" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress makes the following
		  findings:</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID8fedddc42aa8459fa85e51200a1f2cae"><enum>(1)</enum><text display-inline="yes-display-inline">Title 38, United States Code, authorizes
		  the Secretary of Veterans Affairs to furnish hospital and domiciliary care,
		  medical services, nursing home care, and related services to eligible and
		  enrolled veterans, but only to the extent that appropriated resources and
		  facilities are available for such purposes.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0b3d115a111248aeb588490c77261cb5"><enum>(2)</enum><text display-inline="yes-display-inline">For 19 of the past 22 fiscal years, funds
		  have not been appropriated for the Department of Veterans Affairs for the
		  provision of health care as of the commencement of the new fiscal year, causing
		  the Department great challenges in planning and managing care for enrolled
		  veterans, to the detriment of veterans.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDdb68f13a2d8b403babd4e2ca51fc522f"><enum>(3)</enum><text display-inline="yes-display-inline">The cumulative effect of insufficient,
		  late, and unpredictable funding for the Department for health care endangers
		  the viability of the health care system of the Department and impairs the
		  specialized health care resources the Department requires to maintain and
		  improve the health of sick and disabled veterans.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf2e54db17fd84685aba8fd27a87d8487"><enum>(4)</enum><text display-inline="yes-display-inline">Appropriations for the health care programs
		  of the Department have too often proven insufficient over the past decade,
		  requiring the Secretary to ration health care and Congress to approve
		  supplemental appropriations for those programs.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc4247270b8c946f1b865822a1684589e"><enum>(5)</enum><text display-inline="yes-display-inline">Providing sufficient, timely, and
		  predictable funding would ensure the Government meets its obligation to provide
		  health care to sick and disabled veterans and ensure that all veterans enrolled
		  for health care through the Department have ready access to timely and high
		  quality care.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4a425b5f4bc44617abbe15e40de66d5b"><enum>(6)</enum><text display-inline="yes-display-inline">Providing sufficient, timely, and
		  predictable funding would allow the Department to properly plan for and meet
		  the needs of veterans.</text>
						</paragraph></section><section commented="no" display-inline="no-display-inline" id="id7CE0B935DF7C4998898625BDE1B71A44" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Two-fiscal year budget authority for
		  certain medical care accounts of the Department of Veterans Affairs</header>
						<subsection commented="no" display-inline="no-display-inline" id="id6D0025C0B5B24A76A09F9B7697CAD3AB"><enum>(a)</enum><header display-inline="yes-display-inline">Two-fiscal year budget authority</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id0959A0C903AB4F708C90B2544BC473DA"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 1 of title 38, United States Code,
		  is amended by inserting after section 113 the following new section:</text>

									<section commented="no" display-inline="no-display-inline" id="id906C4D2859FA4B91BE34B48EAEA267D7" section-type="subsequent-section"><enum>113A.</enum><header display-inline="yes-display-inline">Two-fiscal year budget authority for
			 certain medical care accounts</header>
										<subsection commented="no" display-inline="no-display-inline" id="id594AB7A4022745D9BF7A4CD6476AE978"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Beginning with fiscal year 2011, new
			 discretionary budget authority provided in an appropriations Act for the
			 appropriations accounts of the Department specified in subsection (b) shall be
			 made available for the fiscal year involved, and shall include new
			 discretionary budget authority for such appropriations accounts that first
			 become available for the first fiscal year after such fiscal year.</text>
										</subsection><subsection commented="no" display-inline="no-display-inline" id="id64D1544BB6D047A29CFEE90C3AAFFDE4"><enum>(b)</enum><header display-inline="yes-display-inline">Medical care accounts</header><text display-inline="yes-display-inline">The medical care accounts of the Department
			 specified in this subsection are the medical care accounts of the Veterans
			 Health Administration as follows:</text>
											<paragraph commented="no" display-inline="no-display-inline" id="id3DA84C1D92C0405A81814C4E456835C0"><enum>(1)</enum><text display-inline="yes-display-inline">Medical Services.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8D022FE949234D1FACA9DAEF10BD629C"><enum>(2)</enum><text display-inline="yes-display-inline">Medical Support and Compliance.</text>
											</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD4612597C3F74BD9B589FF3A79383041"><enum>(3)</enum><text display-inline="yes-display-inline">Medical
			 Facilities.</text>
											</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBA9047F2B31042E581B0CABAA7AAB6E4"><enum>(2)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
		  chapter 1 of such title is amended by inserting after the item relating to
		  section 113 the following new item:</text>

							</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id31A43918693A462380B73CE26A096333" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Comptroller General of the United States
		  study on adequacy and accuracy of baseline model projections of the Department
		  of Veterans Affairs for health care expenditures</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDa4560ec874fe4c2fa0e524bdc2612da1"><enum>(a)</enum><header display-inline="yes-display-inline">Study of adequacy and accuracy of baseline
		  model projections</header><text display-inline="yes-display-inline">The
		  Comptroller General of the United States shall conduct a study of the adequacy
		  and accuracy of the budget projections made by the Enrollee Health Care
		  Projection Model, its equivalent, or other methodologies, as utilized for the
		  purpose of estimating and projecting health care expenditures of the Department
		  of Veterans Affairs (in this section referred to as the <quote>Model</quote>)
		  with respect to the fiscal year involved and the subsequent four fiscal
		  years.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7c99294c9c304f33bb13aceda4dd976b"><enum>(b)</enum><header display-inline="yes-display-inline">Reports</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id66EF647DE3714BF2903414DF99B49F2B"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than the date of each year in
		  2011, 2012, and 2013, on which the President submits the budget request for the
		  next fiscal year under section 1105 of title 31, United States Code, the
		  Comptroller General shall submit to the appropriate committees of Congress and
		  to the Secretary a report.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2A7F609D21824034B36B8EED98544423"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">Each report under this paragraph shall
		  include, for the fiscal year beginning in the year in which such report is
		  submitted, the following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID415aff0b970549bdb951c45af7be0799"><enum>(A)</enum><text display-inline="yes-display-inline">A statement whether the amount requested in
		  the budget of the President for expenditures of the Department for health care
		  in such fiscal year is consistent with anticipated expenditures of the
		  Department for health care in such fiscal year as determined utilizing the
		  Model.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4d6dc199018e48ddabaece6e97db71b6"><enum>(B)</enum><text display-inline="yes-display-inline">The basis for such statement.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID308f3aee53e44ebca56be8fdefc2ee9c"><enum>(C)</enum><text display-inline="yes-display-inline">Such additional information as the
		  Comptroller General determines appropriate.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5607d754978b4ebea11878453b9b0bd0"><enum>(3)</enum><header display-inline="yes-display-inline">Availability to the public</header><text display-inline="yes-display-inline">Each report submitted under this subsection
		  shall also be made available to the public.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID043b5f721fde488f9917fda64d1cf5af"><enum>(4)</enum><header display-inline="yes-display-inline">Appropriate committees of Congress
		  defined</header><text display-inline="yes-display-inline">In this subsection,
		  the term <term>appropriate committees of Congress</term> means—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDe0aca3a9fe0642b483a80329154827ea"><enum>(A)</enum><text display-inline="yes-display-inline">the Committees on Veterans' Affairs,
		  Appropriations, and the Budget of the Senate; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDd5ce7a73ea0b4ab09ae09f6baa14783d"><enum>(B)</enum><text display-inline="yes-display-inline">the Committees on Veterans' Affairs,
		  Appropriations, and the Budget of the House of Representatives.</text>
								</subparagraph></paragraph></subsection></section></legis-body></amendment-block></amendment></engrossed-amendment-body>
