		<section display-inline="no-display-inline" id="H83E4D7F96A6245EA8D742969DC1BF818" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>National Public Notification of
			 Environmental Hazards Act of 2009</short-title></quote>.</text>
		</section><section id="H783086ADEC82477FABF65FB22762B7E"><enum>2.</enum><header>Requirement for
			 public notice of removal of environmental hazards</header><text display-inline="no-display-inline">Title I of the Comprehensive Environmental
			 Response, Compensation, and Liability Act of 1980 (42 U.S.C. 9601 et seq.) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="HBF4FFF192F4340D1A554B59F0020F3E3" style="OLC">
				<section id="H4DCB098B1E344F6495DEE13D25C4A8E8"><enum>129.</enum><header>Requirement for
				public notice of removal of environmental hazards</header>
					<subsection id="H1C2577FC8F0D45719CB053DA211136F3"><enum>(a)</enum><header>Revision of
				national contingency plan</header><text>Not later than 12 months after the date
				of enactment of this section, the President shall revise the national
				contingency plan in accordance with the requirements of this section to provide
				for improved public notification and community relations in the case of a
				response action.</text>
					</subsection><subsection id="HD62A12A07B524F379F4DC083077657F8"><enum>(b)</enum><header>Requirements for
				all response actions</header>
						<paragraph id="H7966FDA6462D40719F97CB39E9EFBFC"><enum>(1)</enum><header>Applicability</header><text display-inline="yes-display-inline">The head of the lead agency for a response
				action shall take the actions specified in this subsection for each response
				action conducted by the lead agency.</text>
						</paragraph><paragraph id="H65EBD3FB17AB4D97A5F384C016C5A7E"><enum>(2)</enum><header>Designation of
				spokesperson; press releases</header>
							<subparagraph id="H2FF4D5D9813B4549BFA0420022256BC5"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency shall designate a
				spokesperson for the response action.</text>
							</subparagraph><subparagraph id="H177C30BCAC1743B088A4AABF3021CFB9"><enum>(B)</enum><header>Duties</header><text>The
				spokesperson shall—</text>
								<clause id="H9DAADDC31D024D978EE4E9E311A76036"><enum>(i)</enum><text>provide notice of
				the response action to—</text>
									<subclause id="H39E5FEF8C871418E8BC92F70BCFF58E2"><enum>(I)</enum><text display-inline="yes-display-inline">civil defense and emergency management
				agencies, as the head of the lead agency determines appropriate;</text>
									</subclause><subclause id="H85CD8D6D07824824AC3FFDEBAE158E81"><enum>(II)</enum><text>immediately
				affected residents;</text>
									</subclause><subclause id="HF9A580465C05479B005224972F8902DD"><enum>(III)</enum><text>other members of
				the community surrounding the response site; and</text>
									</subclause><subclause display-inline="no-display-inline" id="HE85ACB1EB70A4AA483DB9200219760A9"><enum>(IV)</enum><text>State and local
				officials;</text>
									</subclause></clause><clause id="H89C78F73535C4529A89380A0A374A558"><enum>(ii)</enum><text>respond to
				inquiries from the public concerning the response action; and</text>
								</clause><clause id="H281F2EDC4C5A46CD943F016DDF00534D"><enum>(iii)</enum><text>provide
				information to the public concerning the release resulting in the response
				action.</text>
								</clause></subparagraph><subparagraph id="H524E13AA444C464089B3439B781726F7"><enum>(C)</enum><header>Press
				Release</header><text>The head of the lead agency shall—</text>
								<clause id="HD079F279F02D475595D3FF68DF23F684"><enum>(i)</enum><text>issue a press
				release containing information about the response action not later than 10 days
				after the President determines that the response action is appropriate;
				and</text>
								</clause><clause id="H97961131F39540D2A97810B8D6FE4000"><enum>(ii)</enum><text>ensure the
				coordination of all press releases and other statements made by agencies
				participating in the response action with the on-scene coordinator or remedial
				project manager appointed for the response action under the national
				contingency plan.</text>
								</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HED9DA858909B4C26B0329761AF41F4F5"><enum>(3)</enum><header>Establishment of
				public information office</header>
							<subparagraph id="HB78B87E2A19147418206F7F6779DADED"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency shall establish a public
				information office for the response action.</text>
							</subparagraph><subparagraph id="HDE9C4C66CEDD42BAB69688CFA5261175"><enum>(B)</enum><header>Location</header><text>The
				public information office shall be located at or near the response site and may
				be housed in a trailer or other facility.</text>
							</subparagraph><subparagraph id="H7741E4822E4D4A6AAC71E88593B25D2C"><enum>(C)</enum><header>Staffing</header><text>The
				public information office shall be staffed by individuals selected by the head
				of the agency.</text>
							</subparagraph><subparagraph id="H3F015527E65240B09DE202A9F689B28"><enum>(D)</enum><header>Duties</header><text>Individuals
				staffing the public information office shall—</text>
								<clause id="H6E4BF8A4D3DC43E6B638227C2CA4AF5"><enum>(i)</enum><text>provide information
				to the public on the actions taken with regard to the response action;</text>
								</clause><clause id="H389FB03BB1FD46B58893F7AB200300E9"><enum>(ii)</enum><text>respond to
				inquiries from the public concerning the response action; and</text>
								</clause><clause id="H8BB8F3CBC34D4867B6B9BBCEFCB36BBF"><enum>(iii)</enum><text>provide
				information to the public concerning the release resulting in the response
				action.</text>
								</clause></subparagraph><subparagraph id="H9B506F0AB3A24E24BD8EE930AAE38CA9"><enum>(E)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall establish
				the public information office not later than the date of initiation of on-site
				activities for the response action. The public information office shall remain
				available to the public for the duration of the response action.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H95B5E05A7AEA432D813B57A4003D2296"><enum>(4)</enum><header>Information
				repository</header>
							<subparagraph display-inline="no-display-inline" id="HB1C8D376D5A441528E68EB7E13DC3CAD"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency shall establish, at or near the response site, at least one local
				information repository that contains items made available for public
				information.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H2D44EFE40EB64B86A4F2E17C9C4526E"><enum>(B)</enum><header>Public
				notice</header><text display-inline="yes-display-inline">The head of the lead
				agency shall inform the public of the establishment of the information
				repository.</text>
							</subparagraph><subparagraph id="HB69B38610C614D54AB44AE2DC3026681"><enum>(C)</enum><header>Public
				access</header><text display-inline="yes-display-inline">The head of the lead
				agency shall ensure that all items in the information repository are available
				for public inspection and copying.</text>
							</subparagraph><subparagraph id="H2EA6BD2B57EE41E49D2977F4E266BCD7"><enum>(D)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall complete
				all actions required by this paragraph on or before the last day of the 60-day
				period beginning on the date of initiation of on-site activities for the
				response action.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HAEC855115D4E42F0818EB7445D1FBC9"><enum>(5)</enum><header>Administrative
				record file</header>
							<subparagraph display-inline="no-display-inline" id="H62F6E4C80FF642C5B84447001337F5A7"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency shall make available for public inspection the administrative record
				file for the response action.</text>
							</subparagraph><subparagraph commented="no" id="H727D85845B8A4268BA988BCF35E5D093"><enum>(B)</enum><header>Public
				notice</header><text display-inline="yes-display-inline">The head of the lead
				agency shall publish a prominent notice of availability of the administrative
				record file for public inspection and comment in a newspaper of general
				circulation in the area including the response site. The notice shall also
				include the following:</text>
								<clause commented="no" id="H79FA853324064579A2A6474FE77B3827"><enum>(i)</enum><text>Information about
				the response site, including the location of the site and the hazardous
				substance present at the site.</text>
								</clause><clause commented="no" id="H0AA4BFE67F634846BFD752E4464EB82E"><enum>(ii)</enum><text>The location of
				the information repository established under paragraph (4) and the hours that
				the repository is open to the public.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="H30393DB0D57E4A6BA2818BF045067C25"><enum>(iii)</enum><text>The time, date,
				and location of the next scheduled public meeting to be conducted under
				paragraph (7).</text>
								</clause><clause commented="no" id="HA2D20694886C46E59CCA3BAA00F48300"><enum>(iv)</enum><text>The dates of the
				public comment period established under paragraph (6).</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="HC17C79AFAF7140738BDC0011004D9DEB"><enum>(v)</enum><text>The name of the
				agency contact to whom individuals may submit written comments concerning the
				response action.</text>
								</clause></subparagraph><subparagraph id="H19D6D3046F4F42A2B92663E98D70DA4"><enum>(C)</enum><header>Location</header><text display-inline="yes-display-inline">The head of the lead agency shall place the
				administrative record file in at least one of the information repositories
				established under paragraph (4).</text>
							</subparagraph><subparagraph id="HE5872EC0B64A40C4B40009BCF3CCA9DB"><enum>(D)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall publish
				the notice required by subparagraph (A) on or before the last day of the 60-day
				period beginning on the date of initiation of on-site activities for the
				response action.</text>
							</subparagraph></paragraph><paragraph id="H26DB2C9E2E9740EAA21884C51F6B17F"><enum>(6)</enum><header>Public comment
				period</header>
							<subparagraph id="H172C6BE0FBD54B33BFB1FDF88DA0D0CD"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency shall provide a public comment period that allows for the submission of
				written and oral comments concerning the response action.</text>
							</subparagraph><subparagraph id="HF33425C2256642518B00B56B6E1D3F4C"><enum>(B)</enum><header>Response to
				comments</header><text display-inline="yes-display-inline">The head of the lead
				agency shall prepare a written response to significant comments submitted
				during the comment period.</text>
							</subparagraph><subparagraph id="HA2149318C0784B98A443B831CFC61F5E"><enum>(C)</enum><header>Length of
				period</header><text display-inline="yes-display-inline">The public comment
				period shall begin on the date the administrative record file is made available
				for public inspection and continue for at least 30 days. Upon timely request,
				the head of the lead agency shall extend the public comment period by a minimum
				of 15 days.</text>
							</subparagraph></paragraph><paragraph display-inline="no-display-inline" id="HD95EAEBC623840F4B7E898786BE48685"><enum>(7)</enum><header>Public
				meetings</header>
							<subparagraph id="H970E691518DA4054806148851E373C95"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency for a response action shall
				conduct public meetings concerning the response action.</text>
							</subparagraph><subparagraph id="HB9DFC255FA4E499B86ACA9008B2874A2"><enum>(B)</enum><header>Location</header><text>The
				meetings shall be held in a location in close proximity to the response
				site.</text>
							</subparagraph><subparagraph id="H28F7FDBB549E43C89304E487D8E09E3B"><enum>(C)</enum><header>Public
				notice</header><text>The head of the lead agency shall publish a prominent
				notice that informs the public about the public meeting. The notice shall
				include the following:</text>
								<clause id="H3E3994400DC2410C96E6000166B97EA5"><enum>(i)</enum><text>Information about
				the response site, including the location of the site and the hazardous
				substance present at the site.</text>
								</clause><clause id="H599BE96FCB6546E69522B6528D269747"><enum>(ii)</enum><text display-inline="yes-display-inline">The time, date, location, and purpose of
				the public meeting.</text>
								</clause></subparagraph><subparagraph id="H3CFE35CEAA6740B3B26522F7BDECA065"><enum>(D)</enum><header>Deadline</header><text>The
				head of the lead agency shall—</text>
								<clause id="HD69ECEAFFAE4472EBF8E00F3BF2000DC"><enum>(i)</enum><text display-inline="yes-display-inline">conduct an initial meeting under
				subparagraph (A) not later than 30 days after the President determines that the
				response action is appropriate; and</text>
								</clause><clause id="HC5D223632D8A488182A8C212FD00A751"><enum>(ii)</enum><text>conduct
				additional meetings under subparagraph (A) quarterly throughout the duration of
				the response action.</text>
								</clause></subparagraph></paragraph><paragraph display-inline="no-display-inline" id="H3BFCD554EA6848949E866200B519F253"><enum>(8)</enum><header>Establishment of
				toll-free telephone number</header>
							<subparagraph id="HBBC01AE14AFE4A9AB9D5AA2E58AF7B5E"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency for a response action shall establish a toll-free telephone number to
				provide information to the public about the response action.</text>
							</subparagraph><subparagraph id="H6E9982CA4D0E47D9AA9D94B8C22D8E42"><enum>(B)</enum><header>Automation</header><text display-inline="yes-display-inline">If the provision of information through the
				telephone number is automated, the information shall include a telephone number
				for contacting a representative of the lead agency who can answer further
				questions about the response action.</text>
							</subparagraph><subparagraph id="HD93EBA217C6D4749A9F12596DB2BF88D"><enum>(C)</enum><header>Deadlines</header><text>The
				head of the lead agency shall—</text>
								<clause id="H279A74FA30BC43E1B8E62E6EE1A84BDC"><enum>(i)</enum><text>establish such
				telephone number not later than 30 days after the date on which the President
				determines that the response action is appropriate; and</text>
								</clause><clause id="HC789507AA1E14FCDAAD53631F8D29620"><enum>(ii)</enum><text>update
				information provided through such telephone number at least weekly.</text>
								</clause></subparagraph></paragraph><paragraph id="H149D01C56D824524B046D754A08ED908"><enum>(9)</enum><header>Establishment of
				Web site</header>
							<subparagraph id="HBF86BB4B2A4A444FAEF4709D0300DDD6"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency shall establish a public
				Internet Web site (or comparable facility using a successor protocol or
				technology) to provide information to the public about the response
				action.</text>
							</subparagraph><subparagraph id="HEB175C1C266A4BB390A0D79131754241"><enum>(B)</enum><header>Updates</header><text display-inline="yes-display-inline">The head of the lead agency shall update
				the information on the Web site (or comparable facility) frequently.</text>
							</subparagraph><subparagraph id="H9B597DDCDD6E407FBCD5138C40EDEAED"><enum>(C)</enum><header>Link from EPA
				Web site</header><text>The head of the lead agency shall ensure that a link to
				the Web site (or comparable facility) is provided on the public Internet Web
				site (or comparable facility) of the Environmental Protection Agency.</text>
							</subparagraph><subparagraph id="HE97CD7475BB24529B9859B85E9DC7427"><enum>(D)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall make the
				Web site (or comparable facility) required by subparagraph (A) available to the
				public not later than 30 days after the date on which the President determines
				that the response action is appropriate.</text>
							</subparagraph></paragraph><paragraph id="H38CEF092A8BC4DEAAAE9D827D6D34C5"><enum>(10)</enum><header>Visits to
				residences and businesses</header>
							<subparagraph id="H178B0883B3A343C288EC43A8EFD9C707"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency shall ensure that each
				residence and business located within a ½ mile radius of the response site is
				visited by a representative of the lead agency.</text>
							</subparagraph><subparagraph id="H3F37E765AED643C6A7649039809FC9BF"><enum>(B)</enum><header>Duties</header><text display-inline="yes-display-inline">A representative conducting a visit under
				subparagraph (A) shall—</text>
								<clause id="HEEA73891F9424ADD95535F850082EA9C"><enum>(i)</enum><text>provide the
				residence or business with information, including printed materials, on actions
				taken at the response site;</text>
								</clause><clause id="HF02B2F48703441AEB4B1D66CD3BE5BB"><enum>(ii)</enum><text>respond to
				inquiries from the residence or business concerning the response action;
				and</text>
								</clause><clause id="H03654E0F03FA4597B00004D74F43E662"><enum>(iii)</enum><text>provide
				information to the residence or business concerning the release resulting in
				the response action.</text>
								</clause></subparagraph><subparagraph id="HB379BCA71457420FA3075735C9F82DCE"><enum>(C)</enum><header>Deadlines</header><text display-inline="yes-display-inline">The head of the lead agency shall ensure
				that—</text>
								<clause id="H43CBC56426A243249F6785DA3BB0008B"><enum>(i)</enum><text display-inline="yes-display-inline">the visits required by subparagraph (A)
				occur not later than 30 days after the President determines that the response
				action is appropriate; and</text>
								</clause><clause id="H82F752C9F03D456993BC823CCE606DAF"><enum>(ii)</enum><text>such visits
				reoccur quarterly throughout the duration of the response action.</text>
								</clause></subparagraph></paragraph><paragraph id="HAAF7BB268C604C5E8BE7C4452E88DFFC"><enum>(11)</enum><header>Printed
				information</header>
							<subparagraph id="H4001164331494EE200CD36ED361C9C35"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency for a response action shall
				mail printed materials containing information about the removal action to all
				residences and businesses located within a ½ mile radius of the response
				site.</text>
							</subparagraph><subparagraph id="HB089E03E73C74621BF6E4EEBB73DF998"><enum>(B)</enum><header>Deadlines</header><text display-inline="yes-display-inline">The head of the lead agency shall—</text>
								<clause id="H4F50AE9C741D44179C7FD076EC9E0881"><enum>(i)</enum><text display-inline="yes-display-inline">mail the materials required by subparagraph
				(A) not later than 30 days after the President determines that response action
				is appropriate; and</text>
								</clause><clause id="H6156C38317D24A4E86FB69ED7DB450B"><enum>(ii)</enum><text>update and mail
				the materials quarterly throughout the duration of the response action.</text>
								</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HAA5111C57C2046838152E56463A31CF9"><enum>(c)</enum><header>Requirement for
				response actions with planning periods of at least 180 days</header>
						<paragraph id="HEEA43A3BFC0B41089B99CA273DC8D913"><enum>(1)</enum><header>Applicability</header><text display-inline="yes-display-inline">The head of the lead agency for a response
				action shall take the actions specified in this subsection, in addition to the
				actions specified in subsection (b), if the President determines, based on a
				site evaluation, that a response action is appropriate and the head of the lead
				agency determines that a planning period of at least 180 days exists prior to
				the date of initiation of on-site activities for the response action. If
				subsection (d) applies to the response action, the head of the lead agency
				shall also take the actions specified in that subsection.</text>
						</paragraph><paragraph id="H257BEB73F52F4258B729AD454DF67FB0"><enum>(2)</enum><header>Engineering
				Evaluation and Cost Analysis</header>
							<subparagraph id="H050E23898B824F1C8FC4F0C3C2E911D6"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency shall make the engineering evaluation and cost analysis prepared for the
				response action available to the public.</text>
							</subparagraph><subparagraph id="HC969BA0FF1FA41FCA34EBFCAC9856707"><enum>(B)</enum><header>Notice</header><text display-inline="yes-display-inline">The head of the lead agency shall publish a
				prominent notice of availability of the engineering evaluation and cost
				analysis in a local newspaper of general circulation in the community where the
				response site is located. Such notice shall contain a brief description of the
				contents of the engineering evaluation and cost analysis and a description of
				the location where the evaluation and analysis is located.</text>
							</subparagraph><subparagraph display-inline="no-display-inline" id="H54C79F50931E417ABEEF86108FCBD461"><enum>(C)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall complete
				the actions required under subparagraphs (A) and (B) not later than the date on
				which an engineering evaluation and cost analysis approval memorandum for the
				response action is signed.</text>
							</subparagraph></paragraph></subsection><subsection commented="no" id="H737419AD8398490486FE9E642B46B930"><enum>(d)</enum><header>Requirements for
				response actions lasting more than 120 days</header>
						<paragraph id="H72A690881AB04D3B001D64337BD381FA"><enum>(1)</enum><header>Applicability</header><text display-inline="yes-display-inline">The head of the lead agency for a response
				action shall take the actions specified in this subsection, in addition to the
				actions specified in subsection (b), for a response action that the head of the
				lead agency determines will continue after the end of the 120-day period
				beginning on the date of initiation of on-site activities for the response
				action. If subsection (c) applies to the response action, the head of the lead
				agency shall also take the actions specified in that subsection.</text>
						</paragraph><paragraph commented="no" id="H907442C3A67E4D11B1D2A4B7534238E2"><enum>(2)</enum><header>Interviews</header>
							<subparagraph id="HCEC4D4598B6A401CA9D8FEA006BCEFC"><enum>(A)</enum><header>In
				general</header><text display-inline="yes-display-inline">The head of the lead
				agency shall conduct interviews with local officials, community residents,
				public interest groups, and other interested or affected persons, as
				appropriate, to solicit their concerns, information needs, and how and when
				such persons would like to be involved in the response action.</text>
							</subparagraph><subparagraph id="H7EC7F8AC4449445F9DC9068661084569"><enum>(B)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall complete
				the interviews required by subparagraph (A) on or before the last day of the
				90-day period beginning on the date of initiation of on-site activities for the
				response action.</text>
							</subparagraph></paragraph><paragraph commented="no" id="H4A0A02946A94439FA163BF36144FA85B"><enum>(3)</enum><header>Community
				relations plan</header>
							<subparagraph id="HF4F161A6B5C34A25859D6700E2DC3F58"><enum>(A)</enum><header>In
				general</header><text>The head of the lead agency shall prepare a formal
				community relations plan based on the interviews conducted under paragraph (2)
				and other relevant information.</text>
							</subparagraph><subparagraph id="H3DA2DE9DE37A4D92BF41E21CCBAB8C3B"><enum>(B)</enum><header>Contents</header><text>The
				community relations plan shall specify the community relations activities that
				the head of the lead agency expects to undertake during the response
				action.</text>
							</subparagraph><subparagraph id="H4B5DDD95A4424F7289151C2F934F07D2"><enum>(C)</enum><header>Deadline</header><text display-inline="yes-display-inline">The head of the lead agency shall develop
				the community relations plan on or before last day of the 120-day period
				beginning on the date of initiation of on-site activities for the response
				action.</text>
							</subparagraph></paragraph></subsection><subsection id="H21AB72B4B25D498D8E3D9F4049A72D80"><enum>(e)</enum><header>Definitions</header><text>In
				this section, the following definitions apply:</text>
						<paragraph id="HD01D9605052F4BCA811DE067AC00299D"><enum>(1)</enum><header>Engineering
				evaluation and cost analysis</header><text display-inline="yes-display-inline">The term <term>engineering evaluation and
				cost analysis</term> means an engineering evaluation and cost analysis required
				by section 300.415(a)(4)(i) of title 40, Code of Federal Regulations, as in
				effect on October 1, 2007.</text>
						</paragraph><paragraph id="H08825E5FB6BD4026A002A1824E5F8F16"><enum>(2)</enum><header>Lead
				agency</header><text>The term <term>lead agency</term> means the agency
				responsible for planning and implementing a response action under the national
				contingency plan.</text>
						</paragraph><paragraph id="HC8AD3B96B99546C9AC23D9A2D9CBD42"><enum>(3)</enum><header>Significant
				comment</header><text display-inline="yes-display-inline">The term
				<term>significant comment</term> means a public comment determined to be
				significant by the head of the lead agency responsible for the response
				action.</text>
						</paragraph><paragraph id="H601F5748777745938CC0992E00E4B8F4"><enum>(4)</enum><header>Response
				action</header><text>The term <term>response action</term> means a response
				carried out under the national contingency plan, including a response as
				defined by section 101 of this Act and a removal as defined by section 311(a)
				of the Federal Water Pollution Control Act (33 U.S.C. 1321(a)).</text>
						</paragraph><paragraph id="HDC980ACEE5F9436D801B769DD760D3C1"><enum>(5)</enum><header>Response
				site</header><text>The term <term>response site</term> means the location of a
				response.</text>
