		<section id="idC0D0142856CC4EDC83336C697318CEE1" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Public Buildings Cost Reduction Act of
			 2007</short-title></quote>.</text>
		</section><section id="ID0135f5fe03a34be798490585040c18e8"><enum>2.</enum><header>Cost-effective
			 technology acceleration program</header>
			<subsection id="id9600ED65432241A8A8A393652C3CF8D7"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="idE413217147FB43CF9692FD6D02609193"><enum><added-phrase reported-display-style="italic">(1)</added-phrase></enum><header><added-phrase reported-display-style="italic">In general</added-phrase></header><text>The
			 Administrator of General Services (referred to in this section as the
			 <term>Administrator</term>) shall establish a program to accelerate the use of
			 more cost-effective technologies and practices at GSA facilities.</text>
				</paragraph><paragraph changed="added" id="id5B1FFBE8AEBF440E9A16C50CBCF0B66C" reported-display-style="italic"><enum>(2)</enum><header>Requirements</header><text>The
			 program established under this subsection shall—</text>
					<subparagraph id="id5C88931A9DB24016B24D1DAF0D795699"><enum>(A)</enum><text>ensure centralized
			 responsibility for the coordination of cost reduction recommendations,
			 practices, and activities of all relevant Federal agencies;</text>
					</subparagraph><subparagraph id="idD6A798635F2047D6869CF9A149D51FD5"><enum>(B)</enum><text>provide technical
			 assistance and operational guidance to applicable tenants in order to achieve
			 the goals identified in subsection (c)(2)(A); and</text>
					</subparagraph><subparagraph id="id5E7FC8541D7B4182AF772F6518D12824"><enum>(C)</enum><text>establish methods to
			 track the success of departments and agencies with respect to the goals
			 identified in subsection (c)(2)(A).</text>
					</subparagraph></paragraph></subsection><subsection id="idC5094FCAD70C4682B4B4B7D3A7947E8C"><enum>(b)</enum><header>Accelerated use
			 of cost-effective lighting technologies</header>
				<paragraph id="idA7387FB6650E4AED830EFC1DEF3AB6D5"><enum>(1)</enum><header>Review</header>
					<subparagraph id="id058603E366674B1E8BB75CB886143778"><enum>(A)</enum><header>In
			 general</header><text>As part of the program under this subsection, not later
			 than 90 days after the date of enactment of this Act, the Administrator shall
			 conduct a review of—</text>
						<clause id="id04A55A20A6C44B0886C3052400C6D3B9"><enum>(i)</enum><text>current use of
			 cost-effective lighting technologies in GSA facilities; and</text>
						</clause><clause id="id4F98263DC9564026B990725758FC3B32"><enum>(ii)</enum><text>the availability
			 to managers of GSA facilities of cost-effective lighting technologies.</text>
						</clause></subparagraph><subparagraph id="id0602312531464701932558B887A90963"><enum>(B)</enum><header>Requirements</header><text>The
			 review under subparagraph (A) shall—</text>
						<clause id="idD552730FB3E840BD8E80207E0AA1B142"><enum>(i)</enum><text>examine the use
			 of cost-effective lighting technologies and other cost-effective technologies
			 and practices by Federal agencies in GSA facilities; and</text>
						</clause><clause id="id001DDDAEADFC4981A47F6C1034320A58"><enum>(ii)</enum><text>identify, in
			 consultation with the Environmental Protection Agency, cost-effective lighting
			 technology standards that could be used for all types of GSA facilities.</text>
						</clause></subparagraph></paragraph><paragraph id="idE6172E7C7E84495AA7239FEEB06E9CF3"><enum>(2)</enum><header>Replacement</header>
					<subparagraph id="id99BE872AF8A84C94B0629648BF09D732"><enum>(A)</enum><header>In
			 general</header><text>As part of the program under this subsection, not later
			 than 180 days after the date of enactment of this Act, the Administrator shall
			 establish a cost-effective lighting technology acceleration program to achieve
			 maximum feasible replacement of existing lighting technologies with more
			 cost-effective lighting technologies in each GSA facility using available
			 appropriations.</text>
					</subparagraph><subparagraph id="id8A23701273284E5FAD3D3D41EEFFF82D"><enum>(B)</enum><header>Acceleration
			 plan timetable</header>
						<clause id="idCD6F1E2C8A0346E595782EB7D674A0FF"><enum>(i)</enum><header>In
			 general</header><text>To implement the program established under subparagraph
			 (A), not later than 1 year after the date of enactment of this Act, the
			 Administrator shall establish a timetable including milestones for specific
			 activities needed to replace existing lighting technologies with more
			 cost-effective lighting technologies, to the maximum extent feasible (including
			 at the maximum rate feasible), at each GSA facility.</text>
						</clause><clause id="idD3E905F232134878ADEE48B82285D0C9"><enum>(ii)</enum><header>Goal</header><text>The
			 goal of the timetable under clause (i) shall be to complete, using available
			 appropriations, maximum feasible replacement of existing lighting technologies
			 with more cost-effective lighting technologies by not later than the date that
			 is 5 years after the date of enactment of this Act.</text>
						</clause></subparagraph></paragraph></subsection><subsection id="id55FC01B559E8416AA210E0F5673BC3AD"><enum>(c)</enum><header>GSA facility
			 cost-effective technologies and practices</header><text>Not later than 180 days
			 after the date of enactment of this Act, and annually thereafter, the
			 Administrator shall—</text>
				<paragraph id="id951A40802F7340AD99CC8448A7324DC5"><enum>(1)</enum><text>ensure that a
			 manager responsible for accelerating the use of cost-effective technologies and
			 practices is designated for each GSA facility; and</text>
				</paragraph><paragraph id="id9CB689611145450E8709063476212063"><enum>(2)</enum><text>submit to
			 Congress a plan, to be implemented to the maximum extent feasible (including at
			 the maximum rate feasible) using available appropriations, by not later than
			 the date that is 5 years after the date of enactment of this Act, that—</text>
					<subparagraph id="IDdbde93edcd9a4047a7b3608d20b37f91"><enum>(A)</enum><text>identifies the
			 specific activities needed to achieve a 20-percent reduction in operational
			 costs through the application of cost-effective technologies and practices from
			 2003 levels at GSA facilities by not later than 5 years after the date of
			 enactment of this Act;</text>
					</subparagraph><subparagraph id="ID56822a81730e427fba9b4c10d210bd69"><enum>(B)</enum><text>describes
			 activities required and carried out to estimate the funds necessary to achieve
			 the reduction described in subparagraph (A);</text>
					</subparagraph><subparagraph id="ID544f10e848bc424dbdf4982e1d8e61bf"><enum>(C)</enum><text>describes the
			 status of the implementation of cost-effective technologies and practices at
			 GSA facilities, including—</text>
						<clause id="ID5769d15614f54fe9a7ac8156a5c5211a"><enum>(i)</enum><text>the
			 extent to which programs, including the program established under subsection
			 (b), are being carried out in accordance with this Act; and</text>
						</clause><clause id="IDd9a5458bd3b9496f9a8b6e01cec79be4"><enum>(ii)</enum><text>the status of
			 funding requests and appropriations for those programs;</text>
						</clause></subparagraph><subparagraph id="ID023f258d5a7e4526876db3229bb9e32f"><enum>(D)</enum><text>identifies within
			 the planning, budgeting, and construction process all types of GSA
			 facility-related procedures that inhibit new and existing GSA facilities from
			 implementing cost-effective technologies and practices;</text>
					</subparagraph><subparagraph id="IDf8fc21243c74437b975db6f61cea8d22"><enum>(E)</enum><text>recommends
			 language for uniform standards for use by Federal agencies in implementing
			 cost-effective technologies and practices;</text>
					</subparagraph><subparagraph id="IDe20641d103284ce7bce3bd193393f244"><enum>(F)</enum><text>in coordination
			 with the Office of Management and Budget, reviews the budget process for
			 capital programs with respect to alternatives for—</text>
						<clause id="ID3d0ea5079e2d4b63acdb239f1788e570"><enum>(i)</enum><text>permitting
			 Federal agencies to retain all identified savings accrued as a result of the
			 use of cost-effective technologies and practices; and</text>
						</clause><clause id="ID0a07c8eec47e4138bcec070257c3e761"><enum>(ii)</enum><text>identifying
			 short- and long-term cost savings that accrue from cost-effective technologies
			 and practices;</text>
						</clause></subparagraph><subparagraph id="ID777dc11cdfad40e69d21d80271866c8d"><enum>(G)</enum><text>achieves cost
			 savings through the application of cost-effective technologies and practices
			 sufficient to pay the incremental additional costs of installing the
			 cost-effective technologies and practices by not later than the date that is 5
			 years after the date of installation; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID48ac2cb9c02d472d8aadab967356256e"><enum>(H)</enum><text>includes
			 recommendations to address each of the matters, and a plan for implementation
			 of each recommendation, described in subparagraphs (A) through (G).</text>
					</subparagraph></paragraph></subsection><subsection id="id566E019E3E36479AAE8B552FA39DDED6"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated such
			 sums as are necessary to carry out this section, to remain available until
			 expended.</text>
			</subsection></section><section id="idF25D70589FEC40C5BF6C23BDC4C3C49D" section-type="subsequent-section"><enum>3.</enum><header>Environmental
			 Protection Agency demonstration grant program for local governments</header>
			<subsection id="ID8935368c67174f29a0c3376136754f38"><enum>(a)</enum><header>Grant
			 program</header>
				<paragraph id="id5DA6D96481994C99A2DA484A5A269D3F"><enum>(1)</enum><header>In
			 general</header><text>The Administrator of the Environmental Protection Agency
			 (referred to in this section as the <term>Administrator</term>) shall establish
			 a demonstration program under which the Administrator shall provide competitive
			 grants to assist local governments (such as municipalities and counties), with
			 respect to local government buildings—</text>
					<subparagraph id="idBCBE96D982AD4356806BD3EA6CF03DAF"><enum>(A)</enum><text>to deploy
			 cost-effective technologies and practices; and</text>
					</subparagraph><subparagraph id="id5C051BED8F804CFF97A01469035E560D"><enum>(B)</enum><text>to achieve
			 operational cost savings, through the application of cost-effective
			 technologies and practices, as verified by the Administrator.</text>
					</subparagraph></paragraph><paragraph id="id5A94540A527443B38DFBBCF2F9D2E50F"><enum>(2)</enum><header>Cost
			 sharing</header>
					<subparagraph id="id4EF183CAB496415DAAEB3A74EEECED30"><enum><added-phrase reported-display-style="italic">(A)</added-phrase></enum><header><added-phrase reported-display-style="italic">In general</added-phrase></header><text>The
			 Federal share of the cost of an activity carried out using a grant provided
			 under this section shall be 40 percent.</text>
					</subparagraph><subparagraph changed="added" id="id516DE9BF6ADB42CDBAB482D93C3F0AC9" reported-display-style="italic"><enum>(B)</enum><header>Waiver of non-Federal
			 share</header><text>The Administrator may waive up to 100 percent of the local
			 share of the cost of any grant under this section should the Administrator
			 determine that the community is economically distressed, pursuant to objective
			 economic criteria established by the Administrator in published
			 guidelines.</text>
					</subparagraph></paragraph><paragraph id="idB7C7058F838944CD9617A7E3CD0C1181"><enum>(3)</enum><header>Maximum
			 amount</header><text>The amount of a grant provided under this subsection shall
			 not exceed $1,000,000.</text>
				</paragraph></subsection><subsection id="ID323fdca6e34847f78ae46b89f2e11280"><enum>(b)</enum><header>Guidelines</header>
				<paragraph id="IDea8acb757357409d921a3980a1c38345"><enum>(1)</enum><header>In
			 general</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Administrator shall issue guidelines to implement the grant program
			 established under subsection (a).</text>
				</paragraph><paragraph id="IDa85274f07cac463c96ea46e7af7ffe33"><enum>(2)</enum><header>Requirements</header><text>The
			 guidelines under paragraph (1) shall establish—</text>
					<subparagraph id="IDc242e256b442474584ca5ca4620cbb97"><enum>(A)</enum><text>standards for
			 monitoring and verification of operational cost savings through the application
			 of cost-effective technologies and practices reported by grantees under this
			 section;</text>
					</subparagraph><subparagraph id="ID4ef23dc544d94c39badf71ad2851368d"><enum>(B)</enum><text>standards for
			 grantees to implement training programs, and to provide technical assistance
			 and education, relating to the retrofit of buildings using cost-effective
			 technologies and practices; and</text>
					</subparagraph><subparagraph id="idCDAF2D740BCA4E65ACE3576980B71379"><enum>(C)</enum><text>a requirement
			 that each local government that receives a grant under this section shall
			 achieve facility-wide cost savings, through renovation of existing local
			 government buildings using cost-effective technologies and practices, of at
			 least 40 percent as compared to the baseline operational costs of the buildings
			 before the renovation (as calculated assuming a 3-year, weather-normalized
			 average).</text>
					</subparagraph></paragraph></subsection><subsection id="ID3e070d6942124dc8a221929ed9c21277"><enum>(c)</enum><header>Compliance with
			 State and local law</header><text>Nothing in this section or any program
			 carried out using a grant provided under this section supersedes or otherwise
			 affects any State or local law, to the extent that the State or local law
			 contains a requirement that is more stringent than the relevant requirement of
			 this section.</text>
			</subsection><subsection id="IDdc45ee8619254439ba8374596d7033e0"><enum>(d)</enum><header>Authorization
			 of appropriations</header><text>There is authorized to be appropriated to carry
			 out this section $20,000,000 for each of fiscal years 2007 through 2012.</text>
			</subsection><subsection id="idE2B17266D7BB4058B0B567E7DB60FFA8"><enum>(e)</enum><header>Reports</header>
				<paragraph id="idC2A9A6ABD60144D299B603E8380DCB15"><enum>(1)</enum><header>In
			 general</header><text>The Administrator shall provide annual reports to
			 Congress on cost savings achieved and actions taken and recommendations made
			 under this section, and any recommendations for further action.</text>
				</paragraph><paragraph id="IDa93240dc59254705a319b5578701c361"><enum>(2)</enum><header>Final
			 report</header><text>The Administrator shall issue a final report at the
			 conclusion of the program, including findings, a summary of total cost savings
			 achieved, and recommendations for further action.</text>
				</paragraph></subsection><subsection id="id146CC7444E23413F9C000365C8699FD3"><enum>(f)</enum><header>Termination</header><text>The
			 program under this section shall terminate on September 30, 2012.</text>
			</subsection></section><section id="id32E5B6F86AAB4027A6A8EA3EDBBD4B30"><enum>4.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="IDed6615d3e0e44bf5bb80dd70b674a093"><enum>(1)</enum><header>Cost-effective
			 lighting technology</header>
				<subparagraph id="id43BBE90854F24CBC8530FE26275C11AB"><enum>(A)</enum><header>In
			 general</header><text>The term <term>cost-effective lighting technology</term>
			 means a lighting technology that—</text>
					<clause id="idC7116AAD9B5648A0BC9963FED4687A51"><enum>(i)</enum><text>will result in
			 substantial operational cost savings by ensuring an installed consumption of
			 not more than 1 watt per square foot; or</text>
					</clause><clause id="id7BBFAD380AAB4833AE3B98215BF66DA0"><enum>(ii)</enum><text>is
			 contained in a list under—</text>
						<subclause id="idFC7F0910186D482C9FB932AFC4F2DC8C"><enum>(I)</enum><text>section 553 of
			 Public Law 95–619 (42 U.S.C. 8259b); and</text>
						</subclause><subclause id="id361987415F704EC9B0BC78CA66B3C3B9"><enum>(II)</enum><text>Federal
			 acquisition regulation 23–203.</text>
						</subclause></clause></subparagraph><subparagraph id="idABC2500938354BDE844CB2B8F334A5FB"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>cost-effective lighting technology</term> includes—</text>
					<clause id="id7B982A29DEB74F7BBA48CD8794CF84B2"><enum>(i)</enum><text>lamps;</text>
					</clause><clause id="id5BC54B449AE142AC8170A8CD6E07FC4A"><enum>(ii)</enum><text>ballasts;</text>
					</clause><clause id="idB5DA0678DEBE495C917FF68A8BD7E6A4"><enum>(iii)</enum><text>luminaires;</text>
					</clause><clause id="id4073150B6FD94E169C9E6465E0762F05"><enum>(iv)</enum><text>lighting
			 controls;</text>
					</clause><clause id="id2525497FC4874C078F1E258483AC0ED5"><enum>(v)</enum><text>daylighting;
			 and</text>
					</clause><clause id="id7CDA89F41AD64377895A3B1B3889FD2F"><enum>(vi)</enum><text>early use of
			 other highly cost-effective lighting technologies.</text>
					</clause></subparagraph></paragraph><paragraph id="IDe5a447d3847b4d7a848c643462f995ec"><enum>(2)</enum><header>Cost-effective
			 technologies and practices</header><text>The term <term>cost-effective
			 technologies and practices</term> means a technology or practice that—</text>
				<subparagraph id="ID5e240c5ac4cf4bd4a810bc36967804bc"><enum>(A)</enum><text>will result in
			 substantial operational cost savings by reducing utility costs; and</text>
				</subparagraph><subparagraph id="ID25ae31fb8bef4a80a359ef9980b7e715"><enum>(B)</enum><text>complies with the
			 provisions of section 553 of Public Law 95–619 (42 U.S.C. 8259b) and Federal
			 acquisition regulation 23–203.</text>
				</subparagraph></paragraph><paragraph id="id739D517F63C84FC7ACEDE70C18547ACE"><enum>(3)</enum><header>Operational
			 cost savings</header>
				<subparagraph id="IDc356465f372c4deab9d7a9653f585a8d"><enum>(A)</enum><header>In
			 general</header><text>The term <term>operational cost savings</term> means a
			 reduction in end-use operational costs through the application of
			 cost-effective technologies and practices, including a reduction in electricity
			 consumption relative to consumption by the same customer or at the same
			 facility in a given year, as defined in guidelines promulgated by the
			 Administrator pursuant to section 3(b), that achieves cost savings sufficient
			 to pay the incremental additional costs of using cost-effective technologies
			 and practices by not later than the date that is 5 years after the date of
			 installation.</text>
				</subparagraph><subparagraph id="ID49f00f43b31e450292324cee151f951d"><enum>(B)</enum><header>Inclusions</header><text>The
			 term <term>operational cost savings</term> includes savings achieved at a
			 facility as a result of—</text>
					<clause id="id7AE21089F11A431C915DC7A6A8DE066C"><enum>(i)</enum><text>the
			 installation or use of cost-effective technologies and practices; or</text>
					</clause><clause id="id83BE152EA9BE4E2F89DF0EBDA065543A"><enum>(ii)</enum><text>the planting of
			 vegetation that shades the facility and reduces the heating, cooling, or
			 lighting needs of the facility.</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8f9e48273a8047f29902901fe0deab0e"><enum>(C)</enum><header>Exclusion</header><text>The
			 term <term>operational cost savings</term> does not include savings from
			 measures that would likely be adopted in the absence of cost-effective
			 technology and practices programs, as determined by the Administrator.</text>
				</subparagraph></paragraph><paragraph id="id72402D887CDF42F6A9C82C44E9BB618E"><enum>(4)</enum><header>GSA
			 facility</header>
				<subparagraph id="idF7C1EE7AFD6846CBB67E91EE7403D77D"><enum>(A)</enum><header>In
			 general</header><text>The term <term>GSA facility</term> means any building,
			 structure, or facility, in whole or in part (including the associated support
			 systems of the building, structure, or facility) that—</text>
					<clause id="id7D2514C5E9804FBE8843B1C22CBC3D17"><enum>(i)</enum><text>is
			 constructed (including facilities constructed for lease), renovated, or
			 purchased, in whole or in part, by the Administrator for use by the Federal
			 Government; or</text>
					</clause><clause id="id01B74B29F4E14310B862DDD1EC6C7560"><enum>(ii)</enum><text>is
			 leased, in whole or in part, by the Administrator for use by the Federal
			 Government—</text>
						<subclause id="idAE2ACA757DB04E7BBE4D805D6115FC16"><enum>(I)</enum><text>except as
			 provided in subclause (II), for a term of not less than 5 years; or</text>
						</subclause><subclause id="id8B3C8B58ED0D4C9BBDAC8AC39DFC77C0"><enum>(II)</enum><text>for a term of
			 less than 5 years, if the Administrator determines that use of cost-effective
			 technologies and practices would result in the payback of expenses.</text>
						</subclause></clause></subparagraph><subparagraph id="id51D07FFB4FB04700AF0674BFD2C5EF2F"><enum>(B)</enum><header>Inclusion</header><text>The
			 term <term>GSA facility</term> includes any group of buildings, structures, or
			 facilities described in subparagraph (A) (including the associated
			 energy-consuming support systems of the buildings, structures, and
			 facilities).</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB9B299C0AC5B4058B1147A0FEC291C74"><enum>(C)</enum><header>Exemption</header><text>The
			 Administrator may exempt from the definition of <term>GSA facility</term> under
			 this paragraph a building, structure, or facility that meets the requirements
			 of section 543(c) of Public Law 95–619 (42 U.S.C. 8253(c)).</text>
				</subparagraph></paragraph></section></legis-body>
