			 drug-free schools and communities</header><text>Section 4003 of the Elementary
			 and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7103">20 U.S.C. 7103</external-xref>) is amended—</text>
						<paragraph id="H983C112EB815411E99369C497E027FC0"><enum>(1)</enum><text>in paragraph (1),
			 by striking <quote>$650,000,000 for fiscal year 2002</quote> and inserting
			 <quote>$700,000,000 for fiscal year 2008</quote>; and</text>
						</paragraph><paragraph id="H5B55FC70730E4114A9EA43A078FEAC40"><enum>(2)</enum><text>in paragraph (2),

			 program</header><text>Section 4130(b) of the Elementary and Secondary Education
			 Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7140">20 U.S.C. 7140(b)</external-xref>) is amended—</text>
						<paragraph id="H86C8FFF860864A759C4150FFE3FAEE00"><enum>(1)</enum><text>in the matter
			 preceding subparagraph (A) of paragraph (1), by striking <quote>The Secretary
			 may award grants from funds made available to carry out this subpart under
			 section 4003(2)</quote> and inserting <quote>From amounts made available to
			 carry out this subpart under section 4003(2) for each fiscal year, the
			 Secretary shall reserve not less than $50,000,000 to award
			 grants</quote>;</text>
						</paragraph><paragraph id="HF3B9C46B75B54973B533C8D3DD97D75C"><enum>(2)</enum><text>in paragraph
			 (5)(B)(i), by inserting <quote>elementary school and middle school</quote>
			 after <quote>serves</quote>; and</text>

			 paragraph (5)(C)(ii)(IV), by striking <quote>4th</quote> and inserting

			 discretionary grants</header><text>Subpart 2 of part A of title IV of the
			 Elementary and Secondary Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7131">20 U.S.C. 7131 et seq.</external-xref>) is
			 amended by adding at the end the following:</text>

				discretionary grants</header>
								<subsection id="H34214CA2801145E2B22600AF38EBCC2"><enum>(a)</enum><header>Authority To make
				grants</header><text>From amounts made available to carry out this subpart
				under section 4003(2) for each fiscal year, the Secretary shall reserve not
				less than $50,000,000 to award grants, on a competitive basis, to nonprofit
				organizations to enable the nonprofit organizations to establish programs to
				assist a public elementary school or middle school in providing an innovative
				approach—</text>
									<paragraph id="H2D4D6A3F69324A31B28E7C73D234B871"><enum>(1)</enum><text>to combat gang
				activity in the school and the community surrounding the school; and</text>
									</paragraph><paragraph id="HC34AD551190A4E5F8096727DF4A5ED15"><enum>(2)</enum><text>to heighten
				awareness of, and provide tools to reduce, gang violence in the school and the
				community surrounding the school.</text>
									</paragraph></subsection><subsection id="H1688F9D9B99E406C8E9C4C01382CBDA4"><enum>(b)</enum><header>Application</header><text display-inline="yes-display-inline">To be eligible to receive a grant under
				this section, a nonprofit organization shall submit an application to the
				Secretary that includes a detailed plan to combat gang activity and reduce gang
				violence in a school and the surrounding community.</text>
								</subsection><subsection id="HC2A1EC4B28B9419EB36B36BBFBB34379"><enum>(c)</enum><header>Priority
				consideration</header><text>In awarding grants under this section, the
				Secretary shall give priority consideration to applications describing programs
				that target youth living in a community with a crime level above the average
				crime level of the State in which the community is
				located.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="H920F18E4DC9A430C907C9848C491F89F"><enum>103.</enum><header>Public and
			 assisted housing gang elimination</header>
					<subsection id="H41BF1969449B4502B91838DEC3CD25E9"><enum>(a)</enum><header>Public and
			 assisted housing</header><text>Title V of the Anti-Drug Abuse Act of 1988
			 (<external-xref legal-doc="public-law" parsable-cite="pl/100/690">Public Law 100–690</external-xref>; 102 Stat. 4295) is amended by adding at the end the
			 following new subtitle:</text>
						<quoted-block display-inline="no-display-inline" id="H82A31A00C0C940D59FB715A1D3F8698E" style="OLC">
							<subtitle id="HB00D5FE155464F288D78C1B7CBF02204"><enum>H</enum><header>Public and
				Assisted Housing Gang Elimination</header>
								<section id="H3C014100FC05442EAA45D6676C11E746"><enum>5401.</enum><header>Short
				title</header><text display-inline="no-display-inline">This subtitle may be
				cited as the <quote><short-title>Public and Assisted
				Housing Gang Elimination Act of 2007</short-title></quote>.</text>
								</section><section id="H27440B1AC436481CB17113B7EB24FB1C"><enum>5402.</enum><header>Authority to
				make grants</header><text display-inline="no-display-inline">The Secretary of
				Housing and Urban Development, in accordance with the provisions of this
				subtitle, may make grants to public housing agencies (including any Indian
				tribe or other recipient under the Native American Housing Assistance and
				Self-Determination Act of 1996) and private, for-profit and nonprofit owners of
				federally assisted low-income housing for use in eliminating gang-related
				crime.</text>
								</section><section id="H9FE7007E5C5347C7A6AE7E0049F1C6A6"><enum>5403.</enum><header>Eligible
				activities</header><text display-inline="no-display-inline">Grants under this
				subtitle may be used in public housing or other federally assisted low-income
				housing projects for—</text>
									<paragraph id="H5236ECD985F64B2882F9E56694B38434"><enum>(1)</enum><text>the employment of
				security personnel;</text>
									</paragraph><paragraph id="H7A3958310C7F4CBA86A5006626708E91"><enum>(2)</enum><text>reimbursement of
				local law enforcement agencies for additional security and protective
				services;</text>
									</paragraph><paragraph id="H221383CA46DE4D73B5274C8375D052A0"><enum>(3)</enum><text>physical
				improvements which are specifically designed to enhance security;</text>
									</paragraph><paragraph id="H128B5BBFF88D40E684E0F9BF41173393"><enum>(4)</enum><text>the employment of
				1 or more individuals—</text>
										<subparagraph id="H3EA3360586004378B03DDF15C1713FE"><enum>(A)</enum><text>to investigate
				gang-related crime on or about the real property comprising any public or other
				federally assisted low-income housing project; and</text>
										</subparagraph><subparagraph id="H2C705051ECED42AD92E61BB23108A0BA"><enum>(B)</enum><text>to provide
				evidence relating to such crime in any administrative or judicial
				proceeding;</text>
										</subparagraph></paragraph><paragraph id="H275CA1FBFE9D4BAA00D69F53650688C4"><enum>(5)</enum><text>the provision of
				training, communications equipment, and other related equipment for use by
				voluntary tenant patrols acting in cooperation with local law enforcement
				officials;</text>
									</paragraph><paragraph id="H02A198B256424C168637BD4FC1F1717"><enum>(6)</enum><text>programs designed
				to reduce gang activity in and around public or other federally assisted
				low-income housing projects, including encouraging teen-driven approaches to
				gang activity prevention; and</text>
									</paragraph><paragraph id="H6CCFE721E2694B69AEB869DB6972E3A7"><enum>(7)</enum><text>providing funding
				to nonprofit public housing resident management corporations and resident
				councils to develop security and gang prevention programs involving site
				residents.</text>
									</paragraph></section><section id="HC73D1875C62F462C8FF882DCC66697B2"><enum>5404.</enum><header>Applications</header>
									<subsection id="H4BF1C907E1314F70AEEABDA0F7FC7BF"><enum>(a)</enum><header>Required
				submission</header>
										<paragraph id="idA567D9FF92A14BC7B33C20CD8BE98A50"><enum>(1)</enum><header>In
				general</header><text>To receive a grant under this subtitle, a public housing
				agency or an owner of federally assisted low-income housing shall submit an
				application to the Secretary, at such time, in such manner, and accompanied by
				such additional information as the Secretary may reasonably require.</text>
										</paragraph><paragraph id="id26D128649CC7422D9D89163B66CCCF4D"><enum>(2)</enum><header>Required
				inclusions</header><text>Any application submitted under paragraph (1) shall
				include a plan for addressing the problem of gang-related crime on the premises
				of the housing administered or owned by the applicant for which the application
				is being submitted.</text>
										</paragraph></subsection><subsection id="HFD2C994C5B5E489B8FA871D60048625F"><enum>(b)</enum><header>Criteria</header><text>Except
				as provided by subsections (c) and (d) the Secretary shall approve applications
				under this subtitle based exclusively on—</text>
										<paragraph id="H72B1A4302E30422FA6BB80E2E962E248"><enum>(1)</enum><text>the extent of the
				gang-related crime problem in the public or federally assisted low-income
				housing project or projects proposed for assistance;</text>
										</paragraph><paragraph id="HB4A3206A06704C3B83869154F33B1027"><enum>(2)</enum><text>the quality of the
				plan of the applicant to address the crime problem in the public or federally
				assisted low-income housing project or projects proposed for assistance,
				including the extent to which the plan includes initiatives that can be
				sustained over a period of several years;</text>
										</paragraph><paragraph id="H81603A59C16F4D0085EC637D226BB046"><enum>(3)</enum><text>the capability of
				the applicant to carry out the plan; and</text>
										</paragraph><paragraph id="H71891B3CFB534E1C9017E422673DF51C"><enum>(4)</enum><text>the extent to
				which tenants, the local government, and the local community support and
				participate in the design and implementation of the activities proposed to be
				funded under the application.</text>
										</paragraph></subsection><subsection id="HA2A9637601AC4EE7B9ADEBCE50525EDA"><enum>(c)</enum><header>Federally
				assisted low-income housing</header><text>In addition to the selection criteria
				described in subsection (b), the Secretary may establish other criteria for the
				evaluation of applications submitted by owners of federally assisted low-income
				housing, except that such additional criteria shall be designed only to
				reflect—</text>
										<paragraph id="H114A822B7F87426D919CB9BEA49B60F2"><enum>(1)</enum><text>relevant
				differences between the financial resources and other characteristics of public
				housing authorities and owners of federally assisted low-income housing;
				or</text>
										</paragraph><paragraph id="H95525C2D95124808AEDBA603133B0220"><enum>(2)</enum><text>relevant
				differences between the problem of gang-related crime in public housing and the
				problem of gang-related crime in federally assisted low-income housing.</text>
										</paragraph></subsection><subsection id="H5073C05F06684588B389E89B8F136F46"><enum>(d)</enum><header>High-intensity
				interstate gang activity areas</header><text>In evaluating the extent of the
				gang-related crime problem pursuant to subsection (b), the Secretary may
				consider whether housing projects proposed for assistance are located in a
				high-intensity interstate gang activity area designated under section 211 of
				the <short-title>Fighting Gangs and Empowering Youth Act
				of 2007</short-title>.</text>
									</subsection></section><section id="H9DB407DB50F849A0B5D9C0212E2D5367"><enum>5405.</enum><header>Definitions</header><text display-inline="no-display-inline">For the purposes of this subtitle, the
				following definitions shall apply:</text>
									<paragraph id="HF15E3F4D5AAC425A853C06EBCB79BB33"><enum>(1)</enum><header>Secretary</header><text>The
				term <term>Secretary</term> means the Secretary of Housing and Urban
				Development.</text>
									</paragraph><paragraph id="H999413DB5C6C4579A8F24976BDDF0018"><enum>(2)</enum><header>Federally
				assisted low-income housing</header><text>The term <term>federally assisted
				low-income housing</term> means housing assisted under—</text>
										<subparagraph id="H2AB0386C0A0E4DEFA5007F7018C5C3B2"><enum>(A)</enum><text>section 221(d)(3),
				section 221(d)(4), or 236 of the National Housing Act;</text>
										</subparagraph><subparagraph id="H19A8BC3E37EE4203B300F7D3E1779500"><enum>(B)</enum><text>section 101 of the
				Housing and Urban Development Act of 1965;</text>
										</subparagraph><subparagraph id="H23E249B06E5A4BB2BFC0B437D7A59381"><enum>(C)</enum><text>section 8 of the
				United States Housing Act of 1937; or</text>
										</subparagraph><subparagraph id="HE66FCA6038224473AAEACDB358606D3"><enum>(D)</enum><text>the Native American
				Housing Assistance and Self-Determination Act of 1996.</text>
										</subparagraph></paragraph></section><section id="H64CB834485F14874BCD1B7E400FA9CDE"><enum>5406.</enum><header>Implementation</header><text display-inline="no-display-inline">The Secretary shall issue regulations to
				implement this subtitle within 180 days after the date of enactment of this
				subtitle.</text>
								</section><section id="HD9819C0242D24F91B531CC7C9FF16F13"><enum>5407.</enum><header>Reports</header><text display-inline="no-display-inline">The Secretary shall require any recipient of
				a grant under this subtitle to provide periodic reports that include the
				obligation and expenditure of grant funds, the progress made by the grantee in
				implementing the plan described in section 5404(a), and any change in the
				incidence of gang-related crime in projects assisted under this
				subtitle.</text>
								</section><section id="HE57C8DDFCF7D43B5AC88D5FBDE00837B"><enum>5408.</enum><header>Monitoring</header><text display-inline="no-display-inline">The Secretary shall audit and monitor the
				programs funded under this subtitle to ensure that assistance provided under
				this subtitle is administered in accordance with the provisions of this
				subtitle.</text>
								</section><section id="H3792ED0150EA43179F1408E4B89C8C6F"><enum>5409.</enum><header>Authorization
				of appropriations</header>
									<subsection id="H819D5582A8A64946B5FB797D68688782"><enum>(a)</enum><header>In
				general</header><text>There is authorized to be appropriated to carry out this
				subtitle $200,000,000 for each of the fiscal years 2008 through 2012. Any
				amount appropriated under this section shall remain available until
				expended.</text>
									</subsection><subsection id="H42DC1C7E592248D1AD5E27CE7F421FDC"><enum>(b)</enum><header>Set-aside for
				assisted housing</header><text>Of any amount made available in any fiscal year
				to carry out this subtitle, not more than 6.25 percent of such amount shall be
				available for grants for federally assisted low-income
				housing.</text>
									</subsection></section></subtitle><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H91B86BE828044ECD91C2AE4778CF9224"><enum>(b)</enum><header>Conforming
			 amendment</header><text>The table of contents in section 5001 of the Anti-Drug

					<subsection id="H2A2CC8FDC27342D08629CE28D7806F36"><enum>(a)</enum><header>In
			 general</header><text>The Attorney General may make grants to public or
			 nonprofit private entities (including faith-based organizations) for the
			 purpose of assisting the entities in carrying out projects involving innovative
			 approaches to combat gang activity.</text>
					</subsection><subsection id="HBFFA44294BE84C6DB987AD9E303B15EA"><enum>(b)</enum><header>Certain
			 approaches</header><text>Approaches under subsection (a) may include the
			 following:</text>
						<paragraph id="H24BD737F567E41F086A0DACD0755D0E"><enum>(1)</enum><text>Encouraging
			 teen-driven approaches to gang activity prevention.</text>
						</paragraph><paragraph id="HB0454E87A80B4E2B916FF8751BAC7E20"><enum>(2)</enum><text>Educating parents
			 to recognize signs of problems and potential gang involvement in their
			 children.</text>
						</paragraph><paragraph id="HDF77B793E74D4BB1ADC48CC542004D00"><enum>(3)</enum><text>Teaching parents
			 the importance of a nurturing family and home environment to keep children out
			 of gangs.</text>
						</paragraph><paragraph id="HEC761B40ADB6491785A8B3FADEFB8600"><enum>(4)</enum><text>Facilitating
			 communication between parents and children, especially programs that have been
			 evaluated and proven effective.</text>
						</paragraph></subsection><subsection id="HC0BB6918B46B4B55B8DBE77E4FE5C907"><enum>(c)</enum><header>Matching
			 funds</header>
						<paragraph id="HAF9F2B642E0B49DB9973007173D146E"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General may make a grant under this section
			 only if the entity receiving the grant agrees to make available (directly or
			 through donations from public or private entities) non-Federal contributions
			 toward the cost of activities to be performed with that grant in an amount that
			 is not less than 25 percent of such costs.</text>
						</paragraph><paragraph id="H646CC5434DC74DA890BA9F2ACA35D6F"><enum>(2)</enum><header>Determination of
			 amount contributed</header><text>Non-Federal contributions required under
			 <internal-xref idref="HAF9F2B642E0B49DB9973007173D146E" legis-path="104.(c)(1)">paragraph (1)</internal-xref> may be in cash or in
			 kind, fairly evaluated, including facilities, equipment, or services. Amounts
			 provided by the Federal Government, or services assisted or subsidized to any
			 significant extent by the Federal Government, may not be included in
			 determining the amount of such non-Federal contributions.</text>
						</paragraph></subsection><subsection id="H7D7CDEEEFDB64E4DB43BE18879115902"><enum>(d)</enum><header>Evaluation of
			 projects</header>
						<paragraph id="id829274C100B140F3B9A74D750C127DAE"><enum>(1)</enum><header>In
			 general</header><text>The Attorney General shall establish criteria for the
			 evaluation of projects involving innovative approaches under
			 <internal-xref idref="H2A2CC8FDC27342D08629CE28D7806F36" legis-path="104.(a)">subsection (a)</internal-xref>.</text>
						</paragraph><paragraph id="idFB34CE9E17894B40BB70004DF59F2F04"><enum>(2)</enum><header>Grantees</header><text>A
			 grant may be made under such subsection only if the entity involved—</text>
							<subparagraph id="HF40BA4F6F42A435CB2D4079F40C8B7AE"><enum>(A)</enum><text>agrees to conduct
			 evaluations of the approach in accordance with such criteria;</text>
							</subparagraph><subparagraph id="H5F77ED30C5874FD09D5013BD0129137D"><enum>(B)</enum><text>agrees to submit
			 to the Attorney General reports describing the results of the evaluations, as
			 the Attorney General determines to be appropriate; and</text>
							</subparagraph><subparagraph id="H0DB74115DFA4453F8CCDDC2553AE1D61"><enum>(C)</enum><text>submits to the
			 Attorney General, in the application under
			 <internal-xref idref="H02F69C92A47E4A0299E3081F19ED00B7" legis-path="104.(e)">subsection (e)</internal-xref>, a plan for conducting the
			 evaluations.</text>
							</subparagraph></paragraph></subsection><subsection id="H02F69C92A47E4A0299E3081F19ED00B7"><enum>(e)</enum><header>Application for
			 grant</header><text>The Attorney General may make a grant under
			 <internal-xref idref="H2A2CC8FDC27342D08629CE28D7806F36" legis-path="104.(a)">subsection (a)</internal-xref> only if an application for
			 the grant is submitted to the Attorney General and the application is in such
			 form, is made in such manner, and contains such agreements, assurances, and
			 information (including the agreements under subsections (c) and (d) and the
			 plan under subsection (d)(2)(C)) as the Attorney General determines to be
			 necessary to carry out this section.</text>
					</subsection><subsection id="HBE374604AA4D421CAE4FA300003E1D1C"><enum>(f)</enum><header>Report to
			 Congress</header><text>Not later than October 1, 2012, the Attorney General
			 shall submit to Congress a report describing the extent to which the approaches
			 under
			 <internal-xref idref="H2A2CC8FDC27342D08629CE28D7806F36" legis-path="104.(a)">subsection (a)</internal-xref> have been successful in
			 reducing the rate of gang activity in the communities in which the approaches
			 have been carried out. That report shall describe the various approaches used
			 under subsection (a) and the effectiveness of each of the approaches.</text>
					</subsection><subsection id="HE9C3163669FF4847A6FB6F29A5A2EEC4"><enum>(g)</enum><header>Authorization of
			 appropriations</header><text>For the purpose of carrying out this section,
			 there are authorized to be appropriated $5,000,000 for each of the fiscal years
			 2008 through 2012.</text>
					</subsection></section><section id="HCCB7FEF16A004A819E508BC166CF47A7"><enum>105.</enum><header>Strategic
			 community planning program</header><text display-inline="no-display-inline">The
			 Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13701">42 U.S.C. 13701 et seq.</external-xref>)
			 is amended by inserting after section 30403 the following:</text>

				authority</header>
								<subsection id="H7E58E873A9264D438F8C4CB52A4F065"><enum>(a)</enum><header>Grants</header>
									<paragraph id="HC8734EE2831E47A187E0F9B0C53905A"><enum>(1)</enum><header>In
				general</header><text>The Attorney General may award grants on a competitive
				basis to eligible local entities to assist eligible communities in developing
				and carrying out programs that target at-risk youth and juvenile offenders ages
				11 to 19 years, who—</text>
										<subparagraph id="HD4813F7E94F14DD49FD3FE6B87EBEC77"><enum>(A)</enum><text>fail to
				successfully complete secondary school;</text>
										</subparagraph><subparagraph id="HAE02D75FFE9D48F7916B9C2721AD19F"><enum>(B)</enum><text>have entered the
				juvenile justice system; or</text>
										</subparagraph><subparagraph id="H2CCD3B3EFDC64DF291E868D453C607CB"><enum>(C)</enum><text>are at risk of
				failing to successfully complete secondary school or entering the juvenile
				justice system.</text>
										</subparagraph></paragraph><paragraph id="H88289A82A53C449382A1D912FCFBC5E9"><enum>(2)</enum><header>Grant
				amount</header><text>A grant awarded to an eligible local entity under this
				subtitle shall be for not less than $250,000 for a fiscal year. Amounts made
				available through such a grant shall remain available until expended.</text>
									</paragraph></subsection><subsection id="HD19B1A6A83FE437187D69E8AF61C0EA"><enum>(b)</enum><header>Program
				requirements</header>
									<paragraph id="H96F7621D7BAF47AFBA75999FB0F830A6"><enum>(1)</enum><header>Programs</header><text>An
				eligible local entity that receives funds under this subtitle shall develop or
				expand community programs in eligible communities that are designed to target
				at-risk youths and juvenile offenders through prevention, early intervention,
				and graduated sanctions.</text>
									</paragraph><paragraph id="H2D914259B91749B385784400635D3FF7"><enum>(2)</enum><header>Optional
				activities</header><text>An eligible local entity that receives funds under
				this subtitle may develop a variety of programs to serve the comprehensive
				needs of at-risk youth and juvenile offenders, including—</text>
										<subparagraph id="HA03061EFF0D14318A9EC623CF5D889AF"><enum>(A)</enum><text>homework
				assistance and after-school programs, including educational, social, and
				athletic activities;</text>
										</subparagraph><subparagraph id="HCD51DEF7D941488D9EC54F87DE3164D2"><enum>(B)</enum><text>mentoring
				programs;</text>
										</subparagraph><subparagraph id="H4AA227433E6E4741B900E7DE0C45607"><enum>(C)</enum><text>family counseling;
				and</text>
										</subparagraph><subparagraph id="H0B20E92838E441E88E818D253EF0636"><enum>(D)</enum><text>parental training
				programs.</text>
										</subparagraph></paragraph></subsection><subsection id="H67FB2345631D42ABAC5C46DE261C00C9"><enum>(c)</enum><header>Eligible
				community identification</header><text display-inline="yes-display-inline">The
				Attorney General shall establish by regulation the criteria necessary to
				qualify as an eligible community, which shall include criteria with respect to
				significant poverty and significant violent crime.</text>
								</subsection></section><section id="HE471FAE3BD624F888B60C430094D141"><enum>30702.</enum><header>Applications</header>
								<subsection id="H3E4B4688AC4D43B09CFCA81CEACC8375"><enum>(a)</enum><header>Application
				required</header><text>To be eligible to receive a grant under this subtitle, a
				local entity shall submit an application to the Attorney General at such time,
				in such manner, and accompanied by such information, as the Attorney General
				may reasonably require.</text>
								</subsection><subsection id="H05AE0035E40A40AD82E5914D84C5238D"><enum>(b)</enum><header>Contents of
				application</header><text>Each application submitted under
				<internal-xref idref="H3E4B4688AC4D43B09CFCA81CEACC8375" legis-path="30702.(a)">subsection (a)</internal-xref> shall—</text>
									<paragraph id="H15BA1FDBB89C4EBC98C700C1AF251803"><enum>(1)</enum><text>contain a
				comprehensive plan for the program that is designed to improve the academic and
				social development of at-risk youths and juvenile offenders in the eligible
				community, which—</text>
										<subparagraph display-inline="no-display-inline" id="H04E6A8CC30674DA495310283D91111F6"><enum>(A)</enum><text>identifies an
				eligible community to be assisted;</text>
										</subparagraph><subparagraph display-inline="no-display-inline" id="HB340A06C768A4B6492042200858200B7"><enum>(B)</enum><text>describes the
				community planning process to be used by the local entity that includes—</text>
											<clause id="H9BA549E79EF34221953308CA1FFE21AA"><enum>(i)</enum><text>parents and family

				officials;</text>
											</clause><clause id="H80E5FA4014A9435CA3E1F61BC930218E"><enum>(iii)</enum><text>teachers
				employed at schools within the eligible community;</text>
											</clause><clause id="H1AEC4736BA654116A27B2DEA00131B3B"><enum>(iv)</enum><text>local public
				officials;</text>
											</clause><clause id="HB73C251EA4F941CDB524C1F65175B51"><enum>(v)</enum><text>law
				enforcement officers and officials;</text>
											</clause><clause id="H74EA07EA5FE14A07AFF7EF5921995F6C"><enum>(vi)</enum><text>clergy and
				faith-based organizations;</text>
											</clause><clause id="H4EE6C11E92B54828AE80388227A9224C"><enum>(vii)</enum><text>public housing
				authorities;</text>
											</clause><clause id="HD8B3F399F6B3465A805F421873D1703C"><enum>(viii)</enum><text>public housing
				resident organization members, where applicable; and</text>
											</clause><clause id="H10DC569A64B044C38BD0D12DBDC86772"><enum>(ix)</enum><text>public and
				private nonprofit organizations that provide education, child protective
				services, or other human services to low-income, at-risk youth and juvenile
				offenders, and their families; and</text>
											</clause></subparagraph><subparagraph id="HA0C69E6C87724D94A219F9005D789902"><enum>(C)</enum><text>develops a
				concentrated strategy for implementation of the community planning process
				developed under
				<internal-xref idref="HB340A06C768A4B6492042200858200B7" legis-path="30702.(b)(1)(B)">subparagraph (B)</internal-xref> that targets
				clusters of at-risk youth and juvenile offenders in the eligible
				community;</text>
										</subparagraph></paragraph><paragraph id="H3BE71B9C3C054779A4F50346AD008D45"><enum>(2)</enum><text>provide evidence
				of support for accomplishing the objectives of such plan from—</text>
										<subparagraph id="H8975B81FC80F47E0B8F7D9D246C2B694"><enum>(A)</enum><text>community
				leaders;</text>
										</subparagraph><subparagraph id="H9F474CD6A5F94615A2718F3CBCA782EE"><enum>(B)</enum><text>a school
				district;</text>
										</subparagraph><subparagraph id="HD78BAD36188B47CC9B4400F435954D03"><enum>(C)</enum><text>local officials;
				and</text>
										</subparagraph><subparagraph id="HD1DE66C7F8454FBC95E78FE09BD06965"><enum>(D)</enum><text>other
				organizations that the local entity determines to be appropriate;</text>
										</subparagraph></paragraph><paragraph id="HD04DBB3BE8C842948FF907D4861CEFF0"><enum>(3)</enum><text>provide an
				assurance that the local entity will use grant funds received under this
				subsection to implement the program requirements listed in
				<internal-xref idref="HD19B1A6A83FE437187D69E8AF61C0EA" legis-path="30701.(b)">section 30701(b)</internal-xref>;</text>
									</paragraph><paragraph id="HF0C10CDF1645451C89F42C8BB6B4C4C6"><enum>(4)</enum><text>include an
				estimate of the number of at-risk youth and juvenile offenders in the eligible
				community expected to be served under the program;</text>
									</paragraph><paragraph id="H79425DAF381A40F087EBB5349CBC31CF"><enum>(5)</enum><text>provide an
				assurance that the local entity will prepare and submit to the Attorney General
				an annual report regarding any program conducted under this subtitle;
				and</text>
									</paragraph><paragraph id="H8FA5C1327453478CBEC94574ECD0E751"><enum>(6)</enum><text>provide an
				assurance that the local entity will maintain separate accounting records for
				the program.</text>
									</paragraph></subsection><subsection id="H1E8D5FECAF2441B2893B0649BA9EF4AC"><enum>(c)</enum><header>Priority</header><text>In
				awarding grants under this subtitle, the Attorney General shall give priority
				to eligible local entities that identify under
				<internal-xref idref="H04E6A8CC30674DA495310283D91111F6" legis-path="30702.(b)(1)(A)">subsection (b)(1)(A)</internal-xref> an eligible
				community that, when compared to other eligible communities, has a greater need
				than such other eligible communities for assistance under this subtitle, as
				determined by the Attorney General based on the criteria established under
				<internal-xref idref="H67FB2345631D42ABAC5C46DE261C00C9" legis-path="30701.(c)">section 30701(c)</internal-xref>.</text>
								</subsection><subsection id="H06A3AD5E521C41B58F9CB95935EB8069"><enum>(d)</enum><header>Federal
				share</header><text>The Federal share of the costs of a program developed or
				carried out with a grant under this section shall be not more than 70 percent.
				The non-Federal share of such costs may be in cash or in kind, fairly
				evaluated, including personnel, facilities, equipment, and services.</text>
								</subsection></section><section id="HFB86FFF7107C479AAE2B255EA537273"><enum>30703.</enum><header>Definitions</header><text display-inline="no-display-inline">For purposes of this subtitle—</text>
								<paragraph id="H0F082BB7D4EE42AB808B286DE215A633"><enum>(1)</enum><text>the term
				<term>local entity</term> means—</text>
									<subparagraph id="HAE1E3AE86B9747BDA8E118C9560A400"><enum>(A)</enum><text>a local educational
				agency; or</text>
									</subparagraph><subparagraph id="H4FCC4FA814A34CF900ECD5EA121E4982"><enum>(B)</enum><text>a community-based
				organization, as defined in section 9101 of the Elementary and Secondary
				Education Act of 1965 (<external-xref legal-doc="usc" parsable-cite="usc/20/7801">20 U.S.C. 7801</external-xref>); and</text>
									</subparagraph></paragraph><paragraph id="H81066CBF7B04411FB35CA0D708C4055D"><enum>(2)</enum><text>the term
				<term>eligible community</term> means an area which meets the criteria
				established by the Attorney General in accordance with
				<internal-xref idref="H67FB2345631D42ABAC5C46DE261C00C9" legis-path="30701.(c)">section 30701(c)</internal-xref>.</text>

			 Reduction and Reentry Assistance</header>
				<section id="H3F0A20871B9A400BA8851DCFCA3B9788"><enum>111.</enum><header>Reauthorization
			 of adult and juvenile offender State and local reentry demonstration
			 projects</header>
					<subsection commented="no" display-inline="no-display-inline" id="H1BF45551B0C0498E8335B4414C0468EE"><enum>(a)</enum><header>Grant
			 authorization</header><text>Section 2976(a) of the Omnibus Crime Control and
			 Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w(a)</external-xref>) is amended by striking
			 <quote>States, Territories</quote> and all that follows through the period at
			 the end and inserting <quote>States, local governments, territories, or Indian
			 tribes, or any combination thereof, in partnership with stakeholders, service
			 providers, and nonprofit organizations, for purpose of establishing adult and
			 juvenile offender reentry demonstration projects.</quote>.</text>
					</subsection><subsection id="HA8ED1D90086C43759400F4B2CDF61EF"><enum>(b)</enum><header>Adult and
			 juvenile offender demonstration projects authorized</header><text>Section
			 2976(b) of the Omnibus Crime Control and Safe Streets Act of 1968 (42 U.S.C.
			 3797w(b)) is amended by striking paragraphs (1) through (4) and inserting the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="H58C2F72264564D8B95FD8C4FE5C4C7A7" style="OLC">
							<paragraph id="H78F6148F3C8A4B499835E7F9F710FFF3"><enum>(1)</enum><text>establishing or
				improving the system or systems under which—</text>
								<subparagraph id="H14FC7427A5CE45289753B66FE9891258"><enum>(A)</enum><text>the correctional
				agency of the State or local government develops and carries out plans to
				facilitate the reentry into the community of each offender in State or local
				custody;</text>
								</subparagraph><subparagraph id="H0D47864E3AA3482F87C56D082724F9E6"><enum>(B)</enum><text>the supervision
				and services provided to offenders in State or local custody are coordinated
				with the supervision and services provided to offenders after reentry into the
				community;</text>
								</subparagraph><subparagraph id="H16E5C86A77A544E5A4E1510181BCB3C"><enum>(C)</enum><text>the efforts of
				various public and private entities to provide supervision and services to
				offenders, and to family members of such offenders, after offenders reenter the
				community are coordinated; and</text>
								</subparagraph><subparagraph id="H450740A6D53B4951B120E2E28D06034"><enum>(D)</enum><text>offenders awaiting
				reentry into the community are provided with documents useful in achieving a
				successful transition from prison, jail, or detention (such as identification
				papers, referrals to services, medical prescriptions, job training
				certificates, apprenticeship papers, and information on obtaining public
				assistance);</text>
								</subparagraph></paragraph><paragraph id="H1DDFABBD2E094D93B826FCE48534B3E1"><enum>(2)</enum><text>carrying out
				programs and initiatives by units of local government to strengthen reentry
				services for offenders released from local jails;</text>
							</paragraph><paragraph id="HAED6B2461E074962871EEFCA78A58FF1"><enum>(3)</enum><text>enabling prison or
				jail mentors of offenders to remain in contact with those offenders (including
				through the use of such technology as videoconferencing) during incarceration
				and after reentry into the community, and encouraging the involvement of prison
				or jail mentors in the reentry process;</text>
							</paragraph><paragraph id="H6B790567979F40A2BF2BF2F8A89D6027"><enum>(4)</enum><text>providing
				structured post-release housing and transitional housing (including group homes
				for recovering substance abusers) through which offenders are provided
				supervision and services immediately following reentry into the
				community;</text>
							</paragraph><paragraph id="HC654EE2703EF4FADA656F43FA4A61C7F"><enum>(5)</enum><text>assisting
				offenders in securing permanent housing upon release or following a stay in
				transitional housing;</text>
							</paragraph><paragraph id="HCDEBCAB5D8B84F958778FA0989527DB0"><enum>(6)</enum><text>providing
				continuity of health services (including screening, assessment, and aftercare
				for mental health services, substance abuse treatment and aftercare, and
				treatment for contagious diseases) to offenders in custody and after reentry
				into the community;</text>
							</paragraph><paragraph id="H3E0F1DAC9DF54CC3A309C8249FBAA7"><enum>(7)</enum><text>providing offenders
				with education, job training, responsible parenting and healthy relationship
				skills training designed specifically for addressing the needs of incarcerated
				and transitioning fathers and mothers, English as a second language programs,
				work experience programs, self-respect and life skills training, and other
				skills useful in achieving a successful transition from prison or jail;</text>
							</paragraph><paragraph id="HD7DA0E6CED48485CA8B179DA43BD99D"><enum>(8)</enum><text>facilitating
				collaboration among corrections and community corrections, technical schools,
				community colleges, and the workforce development and employment service
				sectors—</text>
								<subparagraph id="H9D75D768C5CE4047A31E2849209522E4"><enum>(A)</enum><text>to promote the
				employment of offenders released from prison and jail, as appropriate, through
				efforts such as educating employers about existing financial incentives;</text>
								</subparagraph><subparagraph id="H16AD2B66AC2449A9AB831E58AD846DB9"><enum>(B)</enum><text>to facilitate the
				creation of job opportunities for offenders released from prison or jail,
				including transitional jobs and time-limited subsidized work experience (as
				appropriate);</text>
								</subparagraph><subparagraph id="H2C891596434445FE891CB0AE2B4C73A5"><enum>(C)</enum><text>to connect
				offenders to employment (including supportive employment and employment
				services) before their release to the community, to provide work supports
				(including transportation and retention services), as appropriate, and to
				identify labor market needs to ensure that education and training are
				appropriate;</text>
								</subparagraph><subparagraph id="HFB737884FEF64859AC39886917FF58C5"><enum>(D)</enum><text>to address
				barriers to employment (such as licensing), that are not directly connected to
				the crime committed, and to provide case management services as necessary to
				prepare offenders for jobs that offer the potential for advancement and growth;
				and</text>
								</subparagraph><subparagraph id="HBD664A4D3581433E8221A1ED9777B837"><enum>(E)</enum><text>to address the
				risks that offenders reentering the community present to the community;</text>
								</subparagraph></paragraph><paragraph id="H0D8307DC7BCF4B838D54099307256621"><enum>(9)</enum><text>assessing the
				literacy and educational needs of offenders in custody and identifying and
				providing services appropriate to meet those needs, including follow-up
				assessments and long-term services;</text>
							</paragraph><paragraph id="H67A748D9E67A457486E3E3BCF9E96DB"><enum>(10)</enum><text>systems under
				which family members of offenders are involved in facilitating the successful
				reentry of those offenders into the community, including removing obstacles to
				the maintenance of family relationships while the offender is in custody,
				strengthening the family's capacity to function as a stable living situation
				during reentry (as appropriate), and involving family members in the planning
				and implementation of the reentry process;</text>
							</paragraph><paragraph id="H50689BC713514AA59278A800FA577100"><enum>(11)</enum><text>programs under
				which victims are included, on a voluntary basis, in the reentry
				process;</text>
							</paragraph><paragraph id="H73734843A11C48689F1E469F68419C16"><enum>(12)</enum><text>identifying and
				addressing barriers to collaborating with child welfare agencies in the joint
				provision of services to offenders in custody and to the children of such
				offenders;</text>
							</paragraph><paragraph id="H2BDC6AEA98794AF4AFACF4C3E3E4BB3"><enum>(13)</enum><text>carrying out
				programs that support children of incarcerated parents, including those in
				foster care and those cared for by grandparents or other relatives (commonly
				referred to as kinship care), including programs for mentoring children of
				incarcerated offenders;</text>
							</paragraph><paragraph id="H0B7EAD15F9984A0289E23DC6C5176CA6"><enum>(14)</enum><text>carrying out
				programs for the entire family unit, including the coordination of service
				delivery across agencies;</text>
							</paragraph><paragraph id="HE7D48A0D167742ABBBB61983CA00DE5C"><enum>(15)</enum><text>implementing
				programs in correctional agencies to—</text>
								<subparagraph id="H6D32090FC4E54060BCE4467CA44D61F6"><enum>(A)</enum><text>include the
				collection of information regarding any dependent children of an incarcerated
				offender as part of intake procedures, including the number of children, age,
				and location or jurisdiction; and</text>
								</subparagraph><subparagraph id="H1482DC05B5904CCD9100A299FEDFC318"><enum>(B)</enum><text>connect identified
				children with services as appropriate and as needed;</text>
								</subparagraph></paragraph><paragraph id="HD3511FF7A41649AE9902198EBD82EAA6"><enum>(16)</enum><text>addressing
				barriers to the visitation of children with an incarcerated parent and
				maintenance of the parent-child relationship (as appropriate to the safety and
				well-being of the children), such as the location of facilities in remote
				areas, telephone costs, mail restrictions, and visitation policies;</text>
							</paragraph><paragraph id="HBF39E38FA270478194003435764BFE09"><enum>(17)</enum><text>creating,
				developing, or enhancing incarcerated offender and family assessments
				curricula, policies, procedures, or programs (including mentoring programs), in
				coordination with victim service providers, to help prisoners with a history or
				identified risk of domestic violence, dating violence, sexual assault, or
				stalking—</text>
								<subparagraph id="H879D5CF33CD94D0F9372D38D013334A3"><enum>(A)</enum><text>to reconnect with
				their families and communities (as appropriate or when it is safe to do so),
				with particular attention paid to the safety of children affected and the
				confidentiality concerns of victims; and</text>
								</subparagraph><subparagraph id="H6C2EC78E4F204B4D9550377279B0F9B6"><enum>(B)</enum><text>to become mutually
				respectful, nonabusive parents or partners;</text>
								</subparagraph></paragraph><paragraph id="H085D7F58EDB3453EB16B4F8ECCD70068"><enum>(18)</enum><text>developing
				programs and activities that support parent-child relationships, such
				as—</text>
								<subparagraph id="HD1FF6C2B9DD2471E83B7F34B7CB21DCF"><enum>(A)</enum><text>using telephone
				conferencing to permit incarcerated parents to participate in parent-teacher
				conferences;</text>
								</subparagraph><subparagraph id="H770E40494B3E41F6A861FE27D6559EDA"><enum>(B)</enum><text>using
				videoconferencing to allow virtual visitation when incarcerated offenders are
				more than 100 miles from their families;</text>
								</subparagraph><subparagraph id="H192AFD93F15740CEB869FC179DD36B9"><enum>(C)</enum><text>the development of
				books on tape programs, through which incarcerated parents read a book into a
				tape to be sent to their children;</text>
								</subparagraph><subparagraph id="H5AF6E84E4FD64B2FA200B2FDA574CF09"><enum>(D)</enum><text>the establishment
				of family days, which provide for longer visitation hours or family
				activities;</text>
								</subparagraph><subparagraph id="HCFA0A4C7F1174B4CAFB51015D5919D1"><enum>(E)</enum><text>the creation of
				children’s areas in visitation rooms with parent-child activities;</text>
								</subparagraph><subparagraph id="H714066D98D6F472989038585EB943FEC"><enum>(F)</enum><text>the implementation
				of programs to help incarcerated parents stay connected to their children and
				learn responsible parenting and healthy relationship skills; and</text>
								</subparagraph><subparagraph id="HBEA1D7476A104A288F57A180BA7E009F"><enum>(G)</enum><text>programs for
				mentoring children of incarcerated offenders;</text>
								</subparagraph></paragraph><paragraph id="H666A6E2B4D954A8EA53E80BCF600755D"><enum>(19)</enum><text>expanding
				family-based treatment centers that offer family-based comprehensive treatment
				services for offenders reentering the community and their children as a
				complete family unit;</text>
							</paragraph><paragraph id="H1A411CA90CFA4221A2C82776AAB695C2"><enum>(20)</enum><text>conducting
				studies to determine the types of offenders who are returning to prison or
				jail, and which of those returning offenders represent the greatest risk to
				community safety;</text>
							</paragraph><paragraph id="H83757567C03D4B55BDCFD9372FB14554"><enum>(21)</enum><text>developing or
				adopting procedures to ensure that dangerous felons are not released from
				prison or jail prematurely;</text>
							</paragraph><paragraph id="HE13E8555320D4500B10700167DDD7C7C"><enum>(22)</enum><text>developing and
				implementing procedures to assist relevant authorities—</text>
								<subparagraph id="HA3CDA6B8D408418BB9808C44114667CC"><enum>(A)</enum><text>in determining
				when release is appropriate; and</text>
								</subparagraph><subparagraph id="HC87859E9BD0E48A29B7DBAEF1F5B89BE"><enum>(B)</enum><text>in the use of data
				to inform the release decision;</text>
								</subparagraph></paragraph><paragraph id="HC7C3C8FA390641DDB7896E1E3702C3FB"><enum>(23)</enum><text>developing and
				implementing procedures to identify efficiently and effectively those violators
				of probation, parole, or post-incarceration supervision who should be returned
				to prison or jail;</text>
							</paragraph><paragraph id="H5901B05B31F24291B4F5C156A0831B6F"><enum>(24)</enum><text>utilizing
				validated assessment tools to assess the risk factors of returning offenders to
				the community, and prioritizing services based on the risks related to
				offenders returning to the community;</text>
							</paragraph><paragraph id="HE767848914EF400799E0A362009833ED"><enum>(25)</enum><text>facilitating and
				encouraging timely and complete payment of restitution and fines by offenders
				to victims and the community;</text>
							</paragraph><paragraph id="HB5BE4511ABA14ECF862B76DB6EA9EEAD"><enum>(26)</enum><text>establishing or
				expanding the use of reentry courts and other programs to—</text>
								<subparagraph id="H7EBC5EAFF4F3430285E514F5A7F8F65C"><enum>(A)</enum><text>monitor offenders
				returning to the community;</text>
								</subparagraph><subparagraph id="H8A8E906634614F5A8C49A488E6B3EF00"><enum>(B)</enum><text>provide offenders
				reentering the community with—</text>
									<clause id="HFA1550CE3ADB4DA89DD44947E2305C02"><enum>(i)</enum><text>drug and alcohol
				testing and treatment; and</text>
									</clause><clause id="H5B93C6D866F34170AF7F9D17D2702D00"><enum>(ii)</enum><text>mental and
				medical health assessment and services;</text>
									</clause></subparagraph><subparagraph id="H38E39B2EEC5A43B89C86A7D1A4B865C"><enum>(C)</enum><text>facilitate
				restorative justice practices and convene family or community impact panels,
				family impact educational classes, victim impact panels, or victim impact
				educational classes;</text>
								</subparagraph><subparagraph id="HBB826B09DBB34AD29700000040C91089"><enum>(D)</enum><text>provide and
				coordinate the delivery of other community services to offenders,
				including—</text>
									<clause id="HCA68F3E64ED04F03A39527AC151FC5F8"><enum>(i)</enum><text>housing
				assistance;</text>
									</clause><clause id="H0F27AE7EBB074F8F99A977664F041C2"><enum>(ii)</enum><text>education;</text>
									</clause><clause id="H0D0871A15D194EDE80E5C1D59CD1DF23"><enum>(iii)</enum><text>employment
				training;</text>
									</clause><clause id="HC9F7DA167B9549B29E6EFCEA69AB6592"><enum>(iv)</enum><text>children and
				family support, including responsible parenting and healthy relationship skills
				training designed specifically to address the needs of incarcerated and
				transitioning parents;</text>
									</clause><clause id="H2899B35562EA4EEE837EC45394FB18AC"><enum>(v)</enum><text>conflict
				resolution skills training;</text>
									</clause><clause id="HD0D70A3FD51E4C1EA0D858B333D6D46C"><enum>(vi)</enum><text>family violence
				intervention programs;</text>
									</clause><clause id="H5503C658EE8747E084132287DF27432"><enum>(vii)</enum><text>culturally and
				linguistically competent services, as appropriate; and</text>
									</clause><clause id="HEC9F80682DE4485D8763A2C2FAEF4C9"><enum>(viii)</enum><text>other
				appropriate services, as determined by the Attorney General; and</text>
									</clause></subparagraph><subparagraph id="H3DE1C77094634F5CA49BFA24D4F53C49"><enum>(E)</enum><text>establish and
				implement graduated sanctions and incentives; and</text>
								</subparagraph></paragraph><paragraph id="H0D41587C429B496B90B5D3909EA87881"><enum>(27)</enum><text>providing
				technology and other tools to advance post-incarceration
				supervision.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H2ED266EF20494840AA32FC9724AEEDFF"><enum>(c)</enum><header>Juvenile
			 offender demonstration projects reauthorized</header><text>Section 2976(c) of
			 the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w(c)</external-xref>) is
			 amended by striking <quote>may be expended for</quote> and all that follows
			 through the period at the end and inserting <quote>may be expended for any
			 activity described in subsection (b).</quote>.</text>
					</subsection><subsection id="H188B1389BF084AF9A052EF19BEC9CCAF"><enum>(d)</enum><header>Applications;
			 requirements; priorities; performance measurements</header><text>Section 2976
			 of the Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w</external-xref>) is
			 amended—</text>
						<paragraph id="HE6B7D18F99524EFF872460CFE58EB8D4"><enum>(1)</enum><text>by redesignating
			 subsection (h) as subsection (p); and</text>
						</paragraph><paragraph id="HE1607E7859D645E6A589ECC37800F27D"><enum>(2)</enum><text>by striking
			 subsections (d) through (g) and inserting the following:</text>
							<quoted-block display-inline="no-display-inline" id="H995407A1C25E4616AF6EE048F9FB99D9" style="OLC">
								<subsection id="HE1DEDF7FA694486393234524E2DE79B3"><enum>(d)</enum><header>Applications</header><text>A
				State, unit of local government, territory, or Indian tribe (or a combination
				of such jurisdictions) desiring a grant under this section shall submit an
				application to the Attorney General that—</text>
									<paragraph id="H9C533195AC82405A962C5D5657196470"><enum>(1)</enum><text>contains a reentry
				strategic plan developed under subsection (h) that describes the long-term
				strategy and a detailed implementation schedule, including the jurisdiction's
				plans to pay for the program after Federal funding is discontinued;</text>
									</paragraph><paragraph id="H64FECDE676BD4747B744F85FAEEBF719"><enum>(2)</enum><text>identifies the
				local government role in the applicant's offender reentry strategy, as well as
				the role of governmental agencies and nonprofit organizations that will be
				coordinated by, and that will collaborate on, such strategy, and certifies the
				involvement of such agencies and organizations;</text>
									</paragraph><paragraph id="HC0A4B45F0DAE413A9000196B90078892"><enum>(3)</enum><text>describes the
				methodology and outcome measures that will be used in evaluating the program;
				and</text>
									</paragraph><paragraph id="H578D958E9392436CABD1FBB759876133"><enum>(4)</enum><text display-inline="yes-display-inline">includes a plan for the use of a State,
				local, territorial, or tribal reentry task force, as referenced in
				<internal-xref idref="H516BE64C22EB4DB9A0606855063127F0" legis-path="(i)">subsection (i)</internal-xref>, to carry out the activities
				funded under the grant.</text>
									</paragraph></subsection><subsection id="H52EF5E565A4E43E890FEF3D308A6469C"><enum>(e)</enum><header>Requirements</header><text>The
				Attorney General may make a grant to an applicant under this section only if
				the application—</text>
									<paragraph id="HC9DDC38166534F858B61D44067F0CF96"><enum>(1)</enum><text>reflects explicit
				support of the chief executive officer of the State, unit of local government,
				territory, or Indian tribe applying for a grant under this section;</text>
									</paragraph><paragraph id="H0CCEB101613E4B3DAEDDDC218EECFA79"><enum>(2)</enum><text>provides extensive
				discussion of the role of State corrections departments, community corrections
				agencies, juvenile justice systems, or local jail systems, as the case may be,
				in ensuring successful reentry of offenders into their communities;</text>
									</paragraph><paragraph id="HE7FCB483E0BA4C24ADE8E7E7B9C8128"><enum>(3)</enum><text>provides extensive
				evidence of collaboration with State and local government agencies overseeing
				health, housing, child welfare, education, substance abuse, and employment
				services, and local law enforcement;</text>
									</paragraph><paragraph id="H2D83978BD144460B917BDF5CF618A92F"><enum>(4)</enum><text>provides a plan
				for analysis of the statutory, regulatory, rules-based, and practice-based
				hurdles of the applicant to an offender’s reentry into the community
				that—</text>
										<subparagraph id="HA25368FA21F949928F05BB00FF14B239"><enum>(A)</enum><text>takes particular
				note and makes recommendations with respect to laws, regulations, rules, and
				practices that disqualify offenders from obtaining professional licenses or
				other requirements necessary for certain types of employment, and that hinder
				full civic participation;</text>
										</subparagraph><subparagraph id="H99ACC594EFC94263BE4753EF84245866"><enum>(B)</enum><text>identifies and
				makes recommendations with respect to those laws, regulations, rules, or
				practices that are not directly connected to the crime committed and the risk
				that the offender presents to the community; and</text>
										</subparagraph><subparagraph id="HD9BD540BE0304C210016514E7B4749E"><enum>(C)</enum><text>affords members of
				the public an opportunity to participate in the process described in this
				paragraph.</text>
										</subparagraph></paragraph></subsection><subsection id="HE1C83217222F4C9B981FF3BCA064984F"><enum>(f)</enum><header>Priority
				consideration</header><text>The Attorney General shall give priority to grant
				applications under this section that best—</text>
									<paragraph id="HD0DE1A40B2C94AEAAAFBC2B9D438ABF"><enum>(1)</enum><text>focus initiative on
				geographic areas with a high population of offenders reentering the
				community;</text>
									</paragraph><paragraph id="H22DD30927597477AB403A912E679F0C1"><enum>(2)</enum><text>include
				partnerships with nonprofit organizations;</text>
									</paragraph><paragraph id="HBE1C46413726462DB7CAC87EDD406E59"><enum>(3)</enum><text>provide
				consultations with crime victims and offenders who have reentered the community
				and their families;</text>
									</paragraph><paragraph id="H4BB6F35DDB44427F8B5BFC59ABEC3376"><enum>(4)</enum><text>review the process
				by which the State and local governments adjudicate violations of parole,
				probation, or post-incarceration supervision, and consider reforms to maximize
				the use of graduated, community-based sanctions for minor and technical
				violations of parole, probation, or post-incarceration supervision;</text>
									</paragraph><paragraph id="H32FC3AAB7BF6438D864821003210A636"><enum>(5)</enum><text>establish
				prerelease planning procedures for offenders to ensure that an offender's
				eligibility for Federal or State benefits (including Medicaid, Medicare, Social
				Security, and veterans benefits) upon release is established prior to release,
				subject to any limitations in law, and to ensure that offenders are provided
				with referrals to appropriate social and health services or are linked to
				appropriate nonprofit organizations; and</text>
									</paragraph><paragraph id="HD626BBDFC2E343728898A09B4539503"><enum>(6)</enum><text>target high-risk
				offenders for reentry programs through validated assessment tools.</text>
									</paragraph></subsection><subsection id="H1DB84CE9981F4D5583C6D17711C81544"><enum>(g)</enum><header>Uses of grant
				funds</header>
									<paragraph id="H2DD270EAD09147B6B5D2F3792700553C"><enum>(1)</enum><header>Federal
				share</header><text>The Federal share of the costs of a project carried out
				with a grant under this section shall be not more than 75 percent, unless the
				Attorney General—</text>
										<subparagraph id="H09459E0C2E064F1BB3E168444CBD5BA"><enum>(A)</enum><text>waives, in whole or
				in part, the requirement of this paragraph; and</text>
										</subparagraph><subparagraph id="HF4FAFCFF85404C8C89607D00ABDB0023"><enum>(B)</enum><text>publicly
				delineates the rationale for the waiver.</text>
										</subparagraph></paragraph><paragraph id="HC9BDC930584A47C997B8166E5ABA36D"><enum>(2)</enum><header>Supplement not
				supplant</header><text>Federal funds received under this section shall be used
				to supplement, not supplant, non-Federal funds that would otherwise be
				available for the activities funded under this section.</text>
									</paragraph></subsection><subsection id="H6823D4CC5F884AE39297EA2EA82B4733"><enum>(h)</enum><header>Reentry
				strategic plan</header>
									<paragraph id="H99AB204AABCA459800E1959F95E93E2"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving financial assistance under
				this section, each applicant shall develop a comprehensive strategic reentry
				plan that contains measurable annual and 5-year performance outcomes. The plan
				shall have as a goal to reduce the rate of recidivism of offenders served with
				funds received under this section by 50 percent over a period of 5
				years.</text>
									</paragraph><paragraph id="H73DBDF7F8E694204A2AEEFD1D6CC9800"><enum>(2)</enum><header>Coordination</header><text>In
				developing reentry plans under this subsection, applicants shall coordinate
				with communities and stakeholders, including persons in the fields of public
				safety, corrections, housing, health, education, substance abuse, children and
				families, employment, business, and members of nonprofit organizations that
				provide reentry services.</text>
									</paragraph><paragraph id="H0B6E5D2535CF4640BB295D1B127007F7"><enum>(3)</enum><header>Measurements of
				progress</header><text>Each reentry plan developed under this subsection shall
				include a plan to measure the progress of the applicant toward increasing
				public safety by reducing rates of recidivism and enabling offenders to
				transition successfully back into their communities.</text>
									</paragraph></subsection><subsection id="H516BE64C22EB4DB9A0606855063127F0"><enum>(i)</enum><header>Reentry task
				force</header>
									<paragraph id="H8741DBD0D9F447B0BDE3772CAF246EE7"><enum>(1)</enum><header>In
				general</header><text>As a condition of receiving a grant under this section,
				each applicant shall establish or empower a Reentry Task Force, or other
				relevant convening authority, to examine ways to pool resources and funding
				streams to promote lower recidivism rates for offenders reentering the
				community and to minimize the harmful effects of incarceration on families and
				communities by collecting data and best practices in offender reentry from
				demonstration grantees and other agencies and organizations, and to provide a
				plan, as described in subsection (e)(4).</text>
									</paragraph><paragraph id="H90C85181BF47401BBBEE158EEF07AC4"><enum>(2)</enum><header>Membership</header><text>The
				reentry task force or other authority shall be comprised of relevant—</text>
										<subparagraph id="H97FA19ABFD9A405491A672BCB34EC69"><enum>(A)</enum><text>State, tribal,
				territorial, or local leaders;</text>
										</subparagraph><subparagraph id="H1C26F63C95094D42B9EC75F8100CF32"><enum>(B)</enum><text>agencies;</text>
										</subparagraph><subparagraph id="H3497AFB5F620474BB6ED00F4175707D4"><enum>(C)</enum><text>service
				providers;</text>
										</subparagraph><subparagraph id="H97D39EB44F5748A6A20762080712C3A8"><enum>(D)</enum><text>nonprofit
				organizations; and</text>
										</subparagraph><subparagraph id="HD7BF44B0223F430AA35BFDD28D1CBE1"><enum>(E)</enum><text>stakeholders.</text>
										</subparagraph></paragraph></subsection><subsection id="H0BF23AD9F64B40138B1D53399C7618E6"><enum>(j)</enum><header>Strategic
				performance outcomes</header>
									<paragraph id="H0FA0E8BE2D5D4C2995BD47E8BBA0F4C8"><enum>(1)</enum><header>In
				general</header><text>Each applicant shall identify in the reentry strategic
				plan of that applicant developed under subsection (h) specific performance
				outcomes related to the long-term goals of increasing public safety and
				reducing recidivism.</text>
									</paragraph><paragraph id="HC1B1CCE4188A4B458F519837AD9286B"><enum>(2)</enum><header>Performance
				outcomes</header><text>The performance outcomes identified under paragraph (1)
				shall include, with respect to offenders reentering the community—</text>
										<subparagraph id="HCC41FB2931844157A9E3BA509BBCCB6D"><enum>(A)</enum><text>reduction in
				recidivism rates;</text>
										</subparagraph><subparagraph id="H680CF01B84154367BD96C1F0868ED7E2"><enum>(B)</enum><text>reduction in
				crime;</text>
										</subparagraph><subparagraph id="HE2F09BE7C46A48E8990208E38B204481"><enum>(C)</enum><text>increased
				employment and education opportunities;</text>
										</subparagraph><subparagraph id="H750C805983904C2C971627EDB83F38E"><enum>(D)</enum><text>reduction in
				violations of conditions of supervised release;</text>
										</subparagraph><subparagraph id="H441A899B8E4B4CF8A4D68EC0D8C2701"><enum>(E)</enum><text>increased payment
				of child support;</text>
										</subparagraph><subparagraph id="H9CCBA18726144E959529D58CB95E9C"><enum>(F)</enum><text>increased housing
				opportunities;</text>
										</subparagraph><subparagraph id="HF8E4477246AC4FDDA65792537E8D00F0"><enum>(G)</enum><text>reduction in drug
				and alcohol abuse; and</text>
										</subparagraph><subparagraph id="HABB9FC76975F46C7B900008806B71412"><enum>(H)</enum><text>increased
				participation in substance abuse and mental health services.</text>
										</subparagraph></paragraph><paragraph id="HE84F5DD93DBE4BA29F8E40F37E4D39BA"><enum>(3)</enum><header>Other
				outcomes</header><text>States may include in their reentry strategic plan other
				performance outcomes that increase the success rates of offenders reentering
				the community.</text>
									</paragraph><paragraph id="H0334D51A4B1A4D6C8B7819A646B73E8"><enum>(4)</enum><header>Coordination</header><text>Applicants
				shall coordinate with communities and stakeholders about the selection of
				performance outcomes identified by the applicant, and shall consult with the
				Department of Justice for assistance with data collection and measurement
				activities.</text>
									</paragraph></subsection><subsection id="H82098686A3354B55B2B3AA6DA36BA18D"><enum>(k)</enum><header>Report</header><text>Each
				grantee under this section shall submit an annual report to the Attorney
				General that—</text>
									<paragraph id="HDA710A89DF1542C0AB60033927F99477"><enum>(1)</enum><text>identifies the
				progress of that grantee toward achieving its strategic performance outcomes
				identified under
				<internal-xref idref="H0BF23AD9F64B40138B1D53399C7618E6" legis-path="(j)">subsection (j)</internal-xref>; and</text>
									</paragraph><paragraph id="H2C3CAF8CC4EE44C5BC7762EE5CA4C57"><enum>(2)</enum><text>describes other
				activities conducted by the grantee to increase the success rates of the
				reentry population, such as programs that foster effective risk management and
				treatment programming, offender accountability, and community and victim
				participation.</text>
									</paragraph></subsection><subsection id="HDFD711DDE5E5438288D1E7CC4CFD0101"><enum>(l)</enum><header>Performance
				measurement</header>
									<paragraph id="H203AB7D3B9404822A106826FA1398905"><enum>(1)</enum><header>In
				general</header><text>The Attorney General, in consultation with the grantees,
				shall—</text>
										<subparagraph id="H06E49BBB5B6342389146F63DD44C420"><enum>(A)</enum><text>identify primary
				and secondary sources of information to support the measurement of the
				strategic performance outcomes identified under
				<internal-xref idref="H0BF23AD9F64B40138B1D53399C7618E6" legis-path="(j)">subsection (j)</internal-xref>;</text>
										</subparagraph><subparagraph id="H52BEA7A0C2D34BA7963EBE0044BDD4C7"><enum>(B)</enum><text>identify sources
				and methods of data collection in support of performance measurement required
				under this section;</text>
										</subparagraph><subparagraph id="HDB80EE3EB06248DE90EF05EF9D9928DB"><enum>(C)</enum><text>provide to all
				grantees technical assistance and training on performance measures and data
				collection for purposes of this section; and</text>
										</subparagraph><subparagraph id="H9AE904FE8A9041F69318C382673F1F3F"><enum>(D)</enum><text>coordinate with
				the Substance Abuse and Mental Health Services Administration on strategic
				performance outcome measures and data collection for purposes of this section
				relating to substance abuse and mental health.</text>
										</subparagraph></paragraph><paragraph id="H665E6D56A2364C7482B5734D977D9D8C"><enum>(2)</enum><header>Coordination</header><text>The
				Attorney General shall coordinate with other Federal agencies to identify
				national and other sources of information to support grantee’s performance
				measurement.</text>
									</paragraph><paragraph id="H12604FCEAB6548A88E44F600F8F786FC"><enum>(3)</enum><header>Standards for
				analysis</header><text>Any statistical analysis of population data conducted
				under this section shall be conducted in accordance with the Federal Register
				Notice dated October 30, 1997, relating to classification standards.</text>
									</paragraph></subsection><subsection id="H079E5EDA01C74993B13800C5F103B2DE"><enum>(m)</enum><header>National adult
				and juvenile offender reentry resource center</header>
									<paragraph id="H49677C8E2C6342BB9BE99C2100000018"><enum>(1)</enum><header>Authority</header><text>The
				Attorney General may, using amounts made available to carry out this section,
				make a grant to an eligible organization to provide for the establishment of a
				National Adult and Juvenile Offender Reentry Resource Center.</text>
									</paragraph><paragraph id="H6E81F5C333614A37B8080967CC004914"><enum>(2)</enum><header>Eligible
				organization</header><text>An organization eligible for the grant under
				paragraph (1) is any national nonprofit organization that—</text>
										<subparagraph id="HF3ECB21B596B4B8AA4EF60F74CA3DC25"><enum>(A)</enum><text>is approved by the
				Federal task force established under subsection (o); and</text>
										</subparagraph><subparagraph id="H41B3224F7463462AA5C6C5486566021F"><enum>(B)</enum><text>provides technical
				assistance and training to, and has special expertise and broad, national-level
				experience in, offender reentry programs, training, and research.</text>
										</subparagraph></paragraph><paragraph id="H3DF35CE599DD41B486B5BCCE4558F02E"><enum>(3)</enum><header>Use of
				funds</header><text>The organization receiving the grant under paragraph (1)
				shall establish a National Adult and Juvenile Offender Reentry Resource Center
				to—</text>
										<subparagraph id="H5962B2FDB43244A6B004CDDF004FEEB6"><enum>(A)</enum><text>provide education,
				training, and technical assistance to States, units of local governments,
				territories, tribes, service providers, nonprofit organizations, and
				corrections institutions;</text>
										</subparagraph><subparagraph id="HE1B4BBEE4A3E4847AAE1528D73B8826D"><enum>(B)</enum><text>collect data and
				best practices in offender reentry from demonstration grantees and others
				agencies and organizations;</text>
										</subparagraph><subparagraph id="H128E332C8BDF4EABA7C33C3050C182AC"><enum>(C)</enum><text>develop and
				disseminate evaluation tools, mechanisms, and measures to better assess and
				document coalition performance measures and outcomes;</text>
										</subparagraph><subparagraph id="H177B37F5FD3646EC9929BCB398C100E4"><enum>(D)</enum><text>disseminate
				knowledge to States and other relevant entities about reentry, including best
				practices, policy standards, and research findings;</text>
										</subparagraph><subparagraph id="H72838442C4ED4D35A3D4E8F8300F7A8"><enum>(E)</enum><text>develop and
				implement procedures to assist relevant authorities in—</text>
											<clause id="H510FAE14A510448282C4BB48A2394339"><enum>(i)</enum><text>determining when
				release is appropriate; and</text>
											</clause><clause id="H9C2B940A51FB4E3F9DFB289E4E4E948C"><enum>(ii)</enum><text>the use of data
				to inform the release decision;</text>
											</clause></subparagraph><subparagraph id="H9071115ED6AE4FA6A0718E0060755FD0"><enum>(F)</enum><text>develop and
				implement procedures to identify efficiently and effectively those violators of
				probation, parole, or post-incarceration supervision who should be returned to
				prison or jail and those who should receive other penalties based on defined,
				graduated sanctions;</text>
										</subparagraph><subparagraph id="H6BC9417001374567A8A2004B40C458FD"><enum>(G)</enum><text>collaborate with
				the Federal task force established under
				<internal-xref idref="H3E1EE5987D80479DA9CB167F761B34A0" legis-path="(o)">subsection (o)</internal-xref> and the Federal Resource Center
				for Children of Prisoners;</text>
										</subparagraph><subparagraph id="H5A0C94F2024447BFABE84B881C25A6F9"><enum>(H)</enum><text>develop a national
				reentry research agenda; and</text>
										</subparagraph><subparagraph id="H14843AF615A940289B00F632A3298CF6"><enum>(I)</enum><text>bridge the gap
				between reentry research and practice by translating knowledge from reentry
				research into practical information.</text>
										</subparagraph></paragraph><paragraph id="HC9381EB7D49F4495BDD1F1DB8633D18D"><enum>(4)</enum><header>Limit</header><text>Of
				amounts made available to carry out this section, not more than 4 percent shall
				be available to carry out this subsection.</text>
									</paragraph></subsection><subsection id="H1D97E0A7D04D4ED5AD73111615C092C9"><enum>(n)</enum><header>Administration</header><text>Of
				amounts made available to carry out this section—</text>
									<paragraph id="H6A200682555D4CCFA510788E2776CB16"><enum>(1)</enum><text>not more than 2
				percent shall be available for administrative expenses in carrying out this
				section; and</text>
									</paragraph><paragraph id="H2F45666D0F8C4CF0B1572BFA00E704F"><enum>(2)</enum><text display-inline="yes-display-inline">not more than 2 percent shall be made
				available to the National Institute of Justice to evaluate the effectiveness of
				the demonstration projects funded under this section in reducing recidivism and
				increasing public safety.</text>
									</paragraph></subsection><subsection id="H3E1EE5987D80479DA9CB167F761B34A0"><enum>(o)</enum><header>Task force on
				Federal programs and activities relating to reentry of offenders</header>
									<paragraph id="H1E9927DCEEBF4F9EBA8D774895548317"><enum>(1)</enum><header>Task force
				required</header><text>The Attorney General, in consultation with the Secretary
				of Housing and Urban Development, the Secretary of Labor, the Secretary of
				Education, the Secretary of Health and Human Services, the Secretary of
				Veterans Affairs, the Secretary of Agriculture, and the heads of such other
				elements of the Federal Government as the Attorney General considers
				appropriate, and in collaboration with States, units of local government,
				territories, tribes, stakeholders, service providers, and nonprofit
				organizations, shall establish an interagency task force on Federal programs
				and activities relating to the reentry of offenders into the community.</text>
									</paragraph><paragraph id="HFA3352E5081C44DB830110C402D28330"><enum>(2)</enum><header>Duties</header><text>The
				task force established under
				<internal-xref idref="H1E9927DCEEBF4F9EBA8D774895548317" legis-path="(o)(1)">paragraph (1)</internal-xref> shall—</text>
										<subparagraph id="H627002BA91444317BB98B2E1CD456C38"><enum>(A)</enum><text>identify any
				reentry program or activity that may be resulting in overlapping or duplication
				of reentry services, the scope of such overlapping or duplication, and the
				relationship of such overlapping and duplication to public safety, public
				health, and effectiveness and efficiency;</text>
										</subparagraph><subparagraph id="H2B97CC4DF8EF49BCBB77B1056FCCF736"><enum>(B)</enum><text>identify methods
				to improve collaboration and coordination of such programs and
				activities;</text>
										</subparagraph><subparagraph id="H8AB6EBE5A4504F7F83E4F5D7A899F269"><enum>(C)</enum><text>identify areas of
				responsibility in which improved collaboration and coordination of such
				programs and activities would result in increased effectiveness or
				efficiency;</text>
										</subparagraph><subparagraph id="H48DFACE19AC140AE89317305D8719371"><enum>(D)</enum><text>develop innovative
				interagency or intergovernmental programs, activities, or procedures that would
				improve outcomes of offenders reentering the community and the children of
				offenders;</text>
										</subparagraph><subparagraph id="HC22AA930A7BA4C098817042DA4AE2DA6"><enum>(E)</enum><text>develop methods
				for increasing regular communication that would increase interagency program
				effectiveness;</text>
										</subparagraph><subparagraph id="H3671F6757F444B1CB6DE854DBB9B72F4"><enum>(F)</enum><text>identify areas of
				research that can be coordinated across agencies with an emphasis on applying
				science-based practices to support, treatment, and intervention programs for
				offenders reentering the community;</text>
										</subparagraph><subparagraph id="H7067E4B6701F416DAD4D16938093D3FF"><enum>(G)</enum><text>identify funding
				areas that should be coordinated across agencies, and any gaps in funding for
				reentry services; and</text>
										</subparagraph><subparagraph id="H6BA2504B48014C97A69200E652AEC608"><enum>(H)</enum><text>in collaboration
				with the National Adult and Juvenile Offender Reentry Resources Center
				established under
				<internal-xref idref="H079E5EDA01C74993B13800C5F103B2DE" legis-path="(m)">subsection (m)</internal-xref>, identify successful reentry
				programs and collect best practices in offender reentry from demonstration
				grantees and other agencies and organizations, determine the extent to which
				such programs and practices can be replicated, and make information on such
				programs and practices available to States, localities, nonprofit
				organizations, and others.</text>
										</subparagraph></paragraph><paragraph id="HBCB9A22A45704DE0A8A56C69D0164300"><enum>(3)</enum><header>Report</header>
										<subparagraph id="HF667B9593ABC4C999BCD86F27100E19"><enum>(A)</enum><header>In
				general</header><text>Not later than 1 year after the date of enactment of the
				<short-title>Fighting Gangs and Empowering Youth Act of
				2007</short-title>, the task force established under
				<internal-xref idref="H1E9927DCEEBF4F9EBA8D774895548317" legis-path="(o)(1)">paragraph (1)</internal-xref> shall submit to Congress a
				report on barriers to reentry, including recommendations to overcome such
				barriers. The task force shall provide for public input in preparing the
				report.</text>
										</subparagraph><subparagraph id="H7109893A52024885BD9612006672F6E7"><enum>(B)</enum><header>Contents</header><text>The
				report required by
				<internal-xref idref="HF667B9593ABC4C999BCD86F27100E19" legis-path="(o)(3)(A)">subparagraph (A)</internal-xref> shall identify Federal
				and other barriers to successful reentry of offenders into the community and
				analyze the effects of such barriers on offenders and on children and other
				family members of offenders, including barriers relating to—</text>
											<clause id="H21F37D148B114F3B8972B4581D38EC08"><enum>(i)</enum><text>child support
				obligations and procedures;</text>
											</clause><clause id="HA90430D7EEBB4597A663444D50545EF3"><enum>(ii)</enum><text>Social Security
				benefits (including barriers in timely restoration of suspended disability
				benefits immediately upon release), veterans benefits, food stamps, and other
				forms of Federal public assistance;</text>
											</clause><clause id="H4960FA8599704CF78C9313361E6E9D21"><enum>(iii)</enum><text>Medicaid and
				Medicare laws, regulations, guidelines or procedures (including barriers in
				timely restoration of benefits caused by delay in reinstatement of suspended
				Social Security disability benefits);</text>
											</clause><clause id="H51ACC2858425487389B5B337E0ECA4FC"><enum>(iv)</enum><text>education
				programs, financial assistance, and full civic participation;</text>
											</clause><clause id="HE79D364A00554D1B861D80398F54EF00"><enum>(v)</enum><text>TANF program
				funding criteria and other welfare benefits;</text>
											</clause><clause id="H28E1731BEAD04C60B0A85368D3930300"><enum>(vi)</enum><text>sustainable
				employment and career advancement, including barriers that are not directly
				connected to the crime committed and the risk that the offender presents to the
				community;</text>
											</clause><clause id="H9EABE068D3364DA997FDEF938C2B1350"><enum>(vii)</enum><text>laws,
				regulations, rules, and practices that restrict Federal employment licensure
				and participation in Federal contracting programs;</text>
											</clause><clause id="H82ADB72A596D497495C1BF098976EDD"><enum>(viii)</enum><text>admissions to
				and evictions from Federal housing programs, including—</text>
												<subclause id="H7C1C5D1AEA224E0100EE3C7E04F461A5"><enum>(I)</enum><text>examining the
				number and characteristics of offenders who are evicted from or denied
				eligibility for Federal housing programs;</text>
												</subclause><subclause id="H415BE8BD7AC046ECAC1CC74B854924C"><enum>(II)</enum><text>the effect of
				eligibility denials and evictions on homelessness, family stability, and family
				reunification;</text>
												</subclause><subclause id="H32B8BAC44D2B43D6A81347EDDA120720"><enum>(III)</enum><text>the extent to
				which arrest records are the basis for denying applications;</text>
												</subclause><subclause id="HAE72877681C84B81BFFE1B97CDE2AFD5"><enum>(IV)</enum><text>the implications
				of considering misdemeanor convictions that occurred more than 5 years before
				the date of an application and felony convictions that occurred more than 10
				years before the date of an application, and the appropriateness of taking into
				account rehabilitation and other mitigating factors; and</text>
												</subclause><subclause id="H04D8E8C7C58348C284C7A90389DF4570"><enum>(V)</enum><text>the feasibility of
				using probationary or conditional eligibility based on participation in a
				supervised rehabilitation program or other appropriate social services;</text>
												</subclause></clause><clause id="H1BDC8CB8E13F4665876FCF4278FD42E3"><enum>(ix)</enum><text>reentry
				procedures, case planning, and transitions of offenders from the custody of the
				Bureau of Prisons to a Federal parole or probation program, or to community
				corrections;</text>
											</clause><clause id="HFE3A59BCDC85431FAACC01576620AC1"><enum>(x)</enum><text>laws, regulations,
				rules, and practices that may require a parolee to return to the same county
				that the parolee was living in prior to being arrested, and the potential for
				changing such laws, regulations, rules, and practices; and</text>
											</clause><clause id="H5B187E3D2A8E4CB9BDD3E0908E6FA29"><enum>(xi)</enum><text>prerelease
				planning procedures for offenders to ensure that the eligibility of an offender
				for Federal or State benefits (including Medicaid, Medicare, Social Security
				and veterans benefits) upon release is established prior to release, subject to
				any limitations in law, and to ensure that offenders are provided with
				referrals to appropriate social and health services or are linked to
				appropriate nonprofit organizations.</text>
											</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H2F72293F34A1442C9CB112D58DB3F41"><enum>(4)</enum><header>Annual
				reports</header><text>On an annual basis, the task force established under
				<internal-xref idref="H1E9927DCEEBF4F9EBA8D774895548317" legis-path="(o)(1)">paragraph (1)</internal-xref> shall submit to Congress a
				report on the activities of the task force, including specific recommendations
				of the task force on matters referred to in
				<internal-xref idref="HFA3352E5081C44DB830110C402D28330" legis-path="(o)(2)">paragraph (2)</internal-xref>.</text>
									</paragraph><paragraph id="H26F45B93E2114EAA83A7308B9524AACC"><enum>(5)</enum><header>Standards for
				Analysis</header><text>Any statistical analysis of population data under this
				section shall be conducted in accordance with the Federal Register Notice dated
				October 30, 1997, relating to classification
				standards.</text>
									</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</paragraph></subsection><subsection id="H8437805F0A93426AB564C7E4DDC4F0B2"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>Section 2976 of the Omnibus Crime Control and Safe
			 Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3797w">42 U.S.C. 3797w</external-xref>) is amended in subsection (p)(1), as
			 redesignated by
			 <internal-xref idref="HE6B7D18F99524EFF872460CFE58EB8D4" legis-path="111.(d)(1)">subsection (d)(1)</internal-xref> of this section, by
			 striking <quote>$15,000,000</quote> and all that follows, and inserting
			 <quote>$100,000,000 for each of the fiscal years 2008 and 2009.</quote>.</text>
					</subsection></section><section id="HB8F384C8ABB84859821569277CC36866"><enum>112.</enum><header>Children of
			 incarcerated parents and families</header><text display-inline="no-display-inline">The Secretary of Health and Human Services
			 may—</text>
					<paragraph id="H06E61C163963416B916EE58D101235A5"><enum>(1)</enum><text>prepare and make
			 available to States a report on any recommendations regarding the role of State
			 child protective services at the time of the arrest of an individual;
			 and</text>
					</paragraph><paragraph id="H11A55A4B51C445228478013E5E75623E"><enum>(2)</enum><text>by regulation,
			 establish such services as the Secretary determines necessary for the
			 preservation of families that have been impacted by the incarceration of a
			 family member, with special attention given to the impact on children.</text>
					</paragraph></section><section id="H57D999C3AF6D42D79EB8E0CB2302C151"><enum>113.</enum><header>Encouragement
			 of employment of former prisoners</header><text display-inline="no-display-inline">The Secretary of Labor shall take such steps
			 as are necessary to implement a program, including a program carried out
			 through the Employment and Training Administration, to educate employers, and
			 to educate one-stop partners and one-stop operators (as such terms are defined
			 in section 101 of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2801">29 U.S.C. 2801</external-xref>)), about
			 incentives (in existence as of the date of the implementation), including the
			 Federal bonding program carried out through the Employment and Training
			 Administration and tax credits, for hiring former Federal, State, or local
			 prisoners.</text>
				</section><section id="H392313B462DC42F4A2E3C0914E836780"><enum>114.</enum><header>National
			 Resource Center for Children and Families of the Incarcerated</header><text display-inline="no-display-inline">There are authorized to be appropriated to
			 the Secretary of Health and Human Services for fiscal years 2008 and 2009, such
			 sums as may be necessary for the continuing activities of the National Resource
			 Center for Children and Families of the Incarcerated, including conducting a
			 review of the policies and practices of State and Federal corrections agencies
			 to support parent-child relationships.</text>
				</section><section id="HA0D3BFC4A94F48EB816EFF6B591CF497"><enum>115.</enum><header>Use of violent
			 offender truth-in-sentencing grant funding for demonstration project
			 activities</header><text display-inline="no-display-inline">Section 20102(a) of
			 the Violent Crime Control and Law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/13702">42 U.S.C. 13702(a)</external-xref>)
			 is amended—</text>
					<paragraph id="H5C9E8BA26A844BE8B77018EEF0EF39FD"><enum>(1)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> at the end;</text>
					</paragraph><paragraph id="H074F56ACBC1F4F429044AAEBE8D3C67"><enum>(2)</enum><text>in
			 paragraph (3), by striking the period at the end and inserting <quote>;
			 and</quote>; and</text>
					</paragraph><paragraph id="HEDE490C6CE39479F973E3C71A29C27E2"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="HF8204617E80741DCBC359F523E1BE744" style="OLC">
							<paragraph id="HC4873DDA8E664270A9EDAA088B28EBB"><enum>(4)</enum><text>to carry out any
				activity described in subsection (b) or (c) of section 2976 of the Omnibus
				Crime Control and Safe Streets Act of 1968 (42 U.S.C. 3797w (b) and
				(c)).</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="H35B1F42776F64F5E8595333708464FD1"><enum>116.</enum><header>Grants to study
			 parole or post-incarceration supervision violations and revocations</header>
					<subsection id="HAA762C92CE3A426887173581F6D44248"><enum>(a)</enum><header>Grants
			 authorized</header><text>The Attorney General may award grants to States to
			 study and to improve the collection of data with respect to—</text>
						<paragraph id="H910E3388611D4EEBB4EAB77FA3DAACE8"><enum>(1)</enum><text>offenders whose
			 parole or post-incarceration supervision is revoked; and</text>
						</paragraph><paragraph id="HEDA5E3E9F9984F29802E7C567C60D9BB"><enum>(2)</enum><text>which such
			 offenders represent the greatest risk to community safety.</text>
						</paragraph></subsection><subsection id="HCB107D3DD04C440397A46B884DB962AE"><enum>(b)</enum><header>Requirements</header><text>As
			 a condition of receiving a grant under this section, the Governor or other
			 chief executive officer of a State shall—</text>
						<paragraph id="HB82945A12F7A484788A767004EE35323"><enum>(1)</enum><text>certify that the
			 State has, or intends to establish, a program that collects comprehensive and
			 reliable data with respect to individuals described in subsection (a)(1),
			 including data on—</text>
							<subparagraph id="H4DF97BC77E54434000A077790000B65B"><enum>(A)</enum><text>the number and
			 type of parole or post-incarceration supervision violations that occur within
			 that State;</text>
							</subparagraph><subparagraph id="H577A0A35F52A445E89ABC7B2001C1C89"><enum>(B)</enum><text>the reasons for
			 parole or post-incarceration supervision revocation;</text>
							</subparagraph><subparagraph id="H256EDFDB17ED4A5BABE18DBBAFABB1C"><enum>(C)</enum><text>the underlying
			 behavior that led to the revocations; and</text>
							</subparagraph><subparagraph id="H1F35C735800A4A568EAAA2E0078E1321"><enum>(D)</enum><text>the terms of
			 imprisonment or other penalties that are imposed for the violations; and</text>
							</subparagraph></paragraph><paragraph id="HAADC2404D7304DE1A61798F2D263BD40"><enum>(2)</enum><text>provide the data
			 described in paragraph (1) to the Bureau of Justice Statistics, in a form
			 prescribed by the Bureau.</text>
						</paragraph></subsection><subsection id="H11EF24AD2E8E4417B9EEE9E96FD367F"><enum>(c)</enum><header>Standards of
			 Analysis</header><text>Any statistical analysis of population data conducted
			 under this section shall be conducted in accordance with the Federal Register
			 Notice dated October 30, 1997, relating to classification standards.</text>
					</subsection><subsection id="H56FCC10CA82C4DE592DAA767E04741F3"><enum>(d)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to carry
			 out this section $1,000,000 for each fiscal years 2008 and 2009.</text>
					</subsection></section><section id="HD91B726DA124462B8F77719F3B960606"><enum>117.</enum><header>Improvement of
			 the residential substance abuse treatment for State prisoners
			 program</header><text display-inline="no-display-inline">Section 1904(d) of the
			 Omnibus Crime Control and Safe Streets Act of 1968 (<external-xref legal-doc="usc" parsable-cite="usc/42/3796ff-3">42 U.S.C. 3796ff–3(d)</external-xref>) is
			 amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H1996E67484B44FD5877C21833112C49" style="OLC">
						<subsection id="H374F28D0EA364E7EA023E24C4EC29C47"><enum>(d)</enum><header>Residential
				substance abuse treatment</header><text>In this part, the term
				<term>residential substance abuse treatment</term>—</text>
							<paragraph id="HF5DF812291AD40CB87536E97EB38E4C4"><enum>(1)</enum><text>means a course of
				individual and group activities and treatment, lasting at least 6 months, in
				residential treatment facilities set apart from the general prison population;
				and</text>
							</paragraph><paragraph id="HB189E63BA9254F2D8998B32FE1B84FA3"><enum>(2)</enum><text>may include the
				use of pharmacotherapies where appropriate, that may extend beyond the 6-month
				period.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="H4DEDA5A3AB0F4BF086C71BE9A0154BB8"><enum>118.</enum><header>Residential
			 drug abuse program in Federal prisons</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3621">Section 3621(e)(5)(A)</external-xref> of title 18, United
			 States Code, is amended by striking <quote>means a course of</quote> and all
			 that follows through the semicolon at the end and inserting the following:
			 <quote>means a course of individual and group activities and treatment, lasting
			 at least 6 months, in residential treatment facilities set apart from the
			 general prison population (which may include the use of pharmacotherapies,
			 where appropriate, that may extend beyond the 6-month period);</quote>.</text>
				</section><section id="H34534263A34D4C1FB44FAE4D58E3797E"><enum>119.</enum><header>Removal of
			 limitation on amount of funds available for corrections education programs
			 under the Adult Education and Family Literacy Act</header>
					<subsection id="H9DCA030CB7784E5A0008AB00AA4F8072"><enum>(a)</enum><header>In
			 general</header><text>Section 222(a)(1) of the Adult Education and Family
			 Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9222">20 U.S.C. 9222(a)(1)</external-xref>) is amended by striking <quote>, of which
			 not more than 10 percent of the 82.5 percent shall be available to carry out
			 section 225</quote>.</text>
					</subsection><subsection id="H1F1550DA4439497FAD89638DEB8FEA93"><enum>(b)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Secretary
			 of Education shall submit to Congress a report—</text>
						<paragraph id="H693B023D10D847AF8BC0392B622BC4D"><enum>(1)</enum><text>on
			 the use of literacy funds provided under the Adult Education and Family
			 Literacy Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9201">20 U.S.C. 9201 et seq.</external-xref>) to correctional institutions as defined
			 in section 225(d)(2) of that Act (<external-xref legal-doc="usc" parsable-cite="usc/20/9225">20 U.S.C. 9225(d)(2)</external-xref>); and</text>
						</paragraph><paragraph id="H9A24B1AEE6E449CEB95C471247A4D66C"><enum>(2)</enum><text>that specifies the
			 amount of literacy funds that are provided to each category of correctional
			 institution in each State, and identify whether funds are being sufficiently
			 allocated among the various types of institutions.</text>
						</paragraph></subsection></section><section id="HDD24B697BDB242F791118E95E5D85318"><enum>120.</enum><header>Mentoring
			 grants to nonprofit organizations</header>
					<subsection id="H9A5C3DA722CA494400A5141F49EFFCB7"><enum>(a)</enum><header>Authority To
			 make grants</header><text>From amounts made available to carry out this
			 section, the Attorney General shall make grants, in consultation with the
			 Secretary of Labor and the Secretary of Housing and Urban Development, to
			 nonprofit organizations for the purpose of providing mentoring and other
			 transitional services essential to the reentry of offenders into the
			 community.</text>
					</subsection><subsection id="H70F2CD1FCDB34C4C90A2FD2905989AB"><enum>(b)</enum><header>Use of
			 funds</header><text>A grant under subsection (a) may be used for—</text>
						<paragraph id="H73D00F8985C449C4B430D3EE4EBD7C"><enum>(1)</enum><text>mentoring adult and
			 juvenile offenders during incarceration, during transition back to the
			 community, and post-incarceration; and</text>
						</paragraph><paragraph id="H2F919D8AB7664D62BA084D6C29D0090"><enum>(2)</enum><text>transitional
			 services to assist in the reentry of offenders into the community.</text>
						</paragraph></subsection><subsection id="H2BE934092F3349D6B18126948CF6F00"><enum>(c)</enum><header>Application;
			 priority consideration</header>
						<paragraph id="id919EB4B90C6C43188B84F7919CD16C89"><enum>(1)</enum><header>In
			 general</header><text>To be eligible to receive a grant under this section, a
			 nonprofit organization shall submit an application to the Attorney General
			 based on criteria developed by the Attorney General, in consultation with the
			 Secretary of Labor and the Secretary of Housing and Urban Development.</text>
						</paragraph><paragraph id="id9534EF15A89843068BDA5A281CA0B698"><enum>(2)</enum><header>Priority</header><text>The
			 Attorney General shall give priority consideration to applications that—</text>
							<subparagraph id="H796ADF53C98F4F5D9EF3C19902800CD"><enum>(A)</enum><text>include a plan to
			 implement activities that have been demonstrated to be effective in
			 facilitating the successful reentry of offenders into the community; and</text>
							</subparagraph><subparagraph id="H0621C2B08F5E4CE0BD64A233C6232DB1"><enum>(B)</enum><text>provide for an
			 independent evaluation.</text>
							</subparagraph></paragraph></subsection><subsection id="H9B969A2D8AAE4A25B7B42E885ADD42B"><enum>(d)</enum><header>Strategic
			 performance outcomes</header><text>The Attorney General shall require each
			 applicant under this section to identify specific performance outcomes related
			 to the long-term goal of stabilizing communities by reducing recidivism and
			 reintegrating offenders into the community.</text>
					</subsection><subsection id="H014113C0D85045BFAC00406FB144C88B"><enum>(e)</enum><header>Authorization of
			 appropriations</header><text>There are authorized to be appropriated to the
			 Attorney General to carry out this section $25,000,000 for each of fiscal years
			 2008 and 2009.</text>
					</subsection></section><section id="H1521758268BC4963A7F1C224A3001DF4"><enum>121.</enum><header>Clarification
			 of authority to place prisoner in community corrections</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/3624">Section 3624(c)</external-xref> of title 18, United States
			 Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="H57BAE43561344C5091E212976D3DF1F0" style="OLC">
						<subsection id="HED1B59573CF841DD8DF210AF53A29228"><enum>(c)</enum><header>Prerelease
				custody</header>
							<paragraph id="H9BFEFA8495EE436D81317F5613BFF9C0"><enum>(1)</enum><header>In
				general</header><text>The Bureau of Prisons shall, to the extent practicable,
				assure that a prisoner serving a term of imprisonment spends 20 percent of the
				final portion of such term, not to exceed 12 months, under conditions that will
				afford the prisoner a reasonable opportunity to adjust to and prepare for
				reentry into the community. Such conditions may include a community
				correctional facility.</text>
							</paragraph><paragraph id="H9884966855B64F6FA5947D32CB19B503"><enum>(2)</enum><header>Authority</header><text>The
				Bureau of Prisons is authorized to place a prisoner in home confinement for the
				final portion of the term of imprisonment of that prisoner, not to exceed the
				shorter of 10 percent of that term of imprisonment or 6 months.</text>
							</paragraph><paragraph id="H1F900EA9242E4FBCBD82EEFCB2C3EBA1"><enum>(3)</enum><header>Assistance</header><text>The
				United States Probation System shall, to the extent practicable, offer
				assistance to a prisoner during any prerelease custody under this
				subsection.</text>
							</paragraph><paragraph id="H21D7FC400DD64B40ACB3D2ED92D5AFC0"><enum>(4)</enum><header>No
				limitations</header><text>Nothing in this subsection shall be construed to
				limit or restrict the authority of the Bureau of Prisons granted under section
				3621 of this
				title.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section commented="no" id="H625741816C30486D899BC0B57F007983"><enum>122.</enum><header>Grants to
			 States for improved workplace and community transition training for
			 incarcerated youth offenders</header><text display-inline="no-display-inline">Section 821 of the Higher Education
			 Amendments of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/20/1151">20 U.S.C. 1151</external-xref>) is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="HF57CCBA077A6461390BF46812270A807" style="OLC">
						<section commented="no" id="HCA23B2EF56E2437B9B053EA253CBAC99"><enum>821.</enum><header>Grants to
				states for improved workplace and community transition training for

							<subsection commented="no" id="HDCCD09EB7E0F449CA804707866B3838F"><enum>(a)</enum><header>Definition</header><text>For
				purposes of this section, the term <term>youth offender</term> means a male or
				female offender under the age of 35, who is incarcerated in a State prison,
				including a prerelease facility.</text>
							</subsection><subsection commented="no" id="HE643CBDB13F9484CA4DFBE0F35C0028"><enum>(b)</enum><header>Grant
				program</header><text>The Secretary of Education (in this section referred to
				as the <quote>Secretary</quote>)—</text>
								<paragraph commented="no" id="H48B984EF359346DF8E098089739040F2"><enum>(1)</enum><text>shall establish a
				program in accordance with this section to provide grants to the State
				correctional education agencies in the States, from allocations for the States
				under subsection (h), to assist and encourage youth offenders to acquire
				functional literacy, life, and job skills, through—</text>
									<subparagraph commented="no" id="H60EDCB7E7AC74C8587E6EB8DDB77852C"><enum>(A)</enum><text>the pursuit of a
				postsecondary education certificate, or an associate or bachelor's degree while
				in prison; and</text>
									</subparagraph><subparagraph commented="no" id="HFB2459A1C74944B19DF3A58034809B00"><enum>(B)</enum><text>employment
				counseling and other related services which start during incarceration and end
				not later than 1 year after release from confinement; and</text>
									</subparagraph></paragraph><paragraph commented="no" id="HE03DBE06D6AC4F0C93C6ED7B66246189"><enum>(2)</enum><text>may establish such
				performance objectives and reporting requirements for State correctional
				education agencies receiving grants under this section as the Secretary
				determines are necessary to assess the effectiveness of the program under this
				section.</text>
								</paragraph></subsection><subsection commented="no" id="H3E2B4D832A8347FB00BC6C62146536EE"><enum>(c)</enum><header>Application</header><text>To
				be eligible for a grant under this section, a State correctional education
				agency shall submit to the Secretary a proposal for a youth offender program
				that—</text>
								<paragraph commented="no" id="HE74383A17B2E4D468254D4C179B9286B"><enum>(1)</enum><text>identifies the
				scope of the problem, including the number of youth offenders in need of
				postsecondary education and career and technical education;</text>
								</paragraph><paragraph commented="no" id="H975D922D0B464C61A9287875E594964E"><enum>(2)</enum><text>lists the
				accredited public or private educational institution or institutions that will
				provide postsecondary educational services;</text>
								</paragraph><paragraph commented="no" id="HDDF3B317173C47239351AD8FEAFBE6FA"><enum>(3)</enum><text>lists the
				cooperating agencies, public and private, or businesses that will provide
				related services, such as counseling in the areas of career development,
				substance abuse, health, and parenting skills;</text>
								</paragraph><paragraph commented="no" id="H228D5DBF914346B287946FF3DF39ADD3"><enum>(4)</enum><text>describes specific
				performance objectives and evaluation methods (in addition to, and consistent
				with, any objectives established by the Secretary under subsection (b)(2)) that
				the State correctional education agency will use in carrying out its proposal,
				including—</text>
									<subparagraph commented="no" id="HF08CD2A062DC488397D76B92BC34A21"><enum>(A)</enum><text>specific and
				quantified student outcome measures that are compared with outcomes for
				non-program participants with similar demographic characteristics; and</text>
									</subparagraph><subparagraph commented="no" id="H2A7FA35994194489BA537D5B67FA2FF6"><enum>(B)</enum><text>measures,
				consistent with the data elements and definitions described in subsection
				(d)(1)(A), of—</text>
										<clause commented="no" id="H3B3F9E9116524006BBE554DFF21F1600"><enum>(i)</enum><text>program
				completion, including an explicit definition of what constitutes a program
				completion within the proposal;</text>
										</clause><clause commented="no" id="H0D595982D3DD48499145E6AEC023DDF1"><enum>(ii)</enum><text>knowledge and
				skill attainment, including specification of instruments that will measure
				knowledge and skill attainment;</text>
										</clause><clause commented="no" id="HD0FE180D3B9C4795ADD180DE514D5C88"><enum>(iii)</enum><text>attainment of
				employment both before and after release;</text>
										</clause><clause commented="no" id="H3C3BC2CDFC8345BBB9B66DBC70C52D5C"><enum>(iv)</enum><text>success in
				employment indicated by job retention and advancement; and</text>
										</clause><clause commented="no" id="H9382926D52014D91A730CBE563C73C14"><enum>(v)</enum><text>recidivism,
				including such subindicators as time before subsequent offense and severity of
				subsequent offense;</text>
										</clause></subparagraph></paragraph><paragraph commented="no" id="HF2FBC8FD95984662804E06823255ECE"><enum>(5)</enum><text>describes how the
				proposed programs are to be integrated with existing State correctional
				education programs (such as adult education, graduate education degree
				programs, and career and technical education) and State industry
				programs;</text>
								</paragraph><paragraph commented="no" id="HE93460F9694249EA00E088A0CBF4CAE5"><enum>(6)</enum><text>describes how the
				proposed programs will utilize technology to deliver the services under this
				section; and</text>
								</paragraph><paragraph commented="no" id="H94B1D94CD7C24230BD2B492779BA5DC4"><enum>(7)</enum><text>describes how
				students will be selected so that only youth offenders eligible under
				subsection (e) will be enrolled in a program receiving a grant under this
				section.</text>
								</paragraph></subsection><subsection commented="no" id="H30C8A4E24F4E45238DB7CB5BA119B442"><enum>(d)</enum><header>Program
				requirements</header><text>Each State correctional education agency receiving a
				grant under this section shall—</text>
								<paragraph commented="no" id="H7442E132F66B43B49D7B3B9BD1BEA556"><enum>(1)</enum><text>annually report to
				the Secretary regarding—</text>
									<subparagraph commented="no" id="H7A3ABAD324A0411381D30237FFA7B689"><enum>(A)</enum><text>the results of the
				evaluations conducted using data elements and definitions provided by the
				Secretary for the use of State correctional education programs;</text>
									</subparagraph><subparagraph commented="no" id="H17A1587753044046A416A85923B7C160"><enum>(B)</enum><text>any objectives or
				requirements established by the Secretary pursuant to subsection (b)(2);
				and</text>
									</subparagraph><subparagraph commented="no" id="HF7CAD2A14EF74C379BA0C1E02760CF60"><enum>(C)</enum><text>the additional
				performance objectives and evaluation methods contained in the proposal
				described in subsection (c)(4), as necessary to document the attainment of
				project performance objectives; and</text>
									</subparagraph></paragraph><paragraph commented="no" id="HACA8C3F1B86F4F62A21E977B6798A0B"><enum>(2)</enum><text>expend on each
				participating eligible student for an academic year, not more than the maximum
				Federal Pell Grant appropriated under section 401 of the Higher Education Act
				of 1965 for such academic year, which shall be used for—</text>
									<subparagraph commented="no" id="HF6D7B2801FF248CB9248016B536444F3"><enum>(A)</enum><text>tuition, books,
				and essential materials; and</text>
									</subparagraph><subparagraph commented="no" id="HA5411671960844E2A1CC338ED812A200"><enum>(B)</enum><text>related services
				such as career development, substance abuse counseling, parenting skills
				training, and health education.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" id="HA9E08972DB2746528F72F4ECF6987095"><enum>(e)</enum><header>Student
				eligibility</header><text>A youth offender shall be eligible for participation
				in a program receiving a grant under this section if the youth offender—</text>
								<paragraph commented="no" id="H4CA3BBBE796D424BB2BFA83DD6E20E1"><enum>(1)</enum><text>is eligible to be
				released within 5 years (including a youth offender who is eligible for parole
				within such time); and</text>
								</paragraph><paragraph commented="no" id="H448FD98DC5144DB397103CCDB00E207"><enum>(2)</enum><text>is 35 years of age
				or younger.</text>
								</paragraph></subsection><subsection commented="no" id="HF1145F8B56594E35BB06C56913DE584B"><enum>(f)</enum><header>Length of
				participation</header><text>A State correctional education agency receiving a
				grant under this section shall provide educational and related services to each
				participating youth offender for a period not to exceed 5 years, 1 year of
				which may be devoted to study in a graduate education degree program or to
				remedial education services for students who have obtained a secondary school
				diploma or its recognized equivalent. Educational and related services shall
				start during the period of incarceration in prison or prerelease, and the
				related services may continue for not more than 1 year after release from
				confinement.</text>
							</subsection><subsection commented="no" id="HEF91ACA20898440F9E03FA46513ED081"><enum>(g)</enum><header>Education
				delivery systems</header><text>State correctional education agencies and
				cooperating institutions shall, to the extent practicable, use high-tech
				applications in developing programs to meet the requirements and goals of this
				section.</text>
							</subsection><subsection commented="no" id="H822B9324927F407F93AD27C30006233"><enum>(h)</enum><header>Allocation of
				funds</header><text>From the funds appropriated pursuant to subsection (i) for
				each fiscal year, the Secretary shall allot to each State an amount that bears
				the same relationship to such funds as the total number of youth offenders
				eligible under subsection (e) in such State bears to the total number of such
				youth offenders in all States.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="HEFAA92C903BE436EBA7DCF20ABAED797"><enum>(i)</enum><header>Authorization of
				appropriations</header><text>There are authorized to be appropriated to carry
				out this section $30,000,000 for fiscal years 2008 and
				2009.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</section><section id="HD7BC068088184BF1A97BA94FEA422048"><enum>123.</enum><header>Improved
			 reentry procedures for Federal prisoners</header>
					<subsection id="H3507C6CACB464EA0BBD335652013ADA1"><enum>(a)</enum><header>General reentry
			 procedures</header><text>The Attorney General shall take such steps as are
			 necessary to modify existing procedures and policies to enhance case planning
			 and to improve the transition of offenders from the custody of the Bureau of
			 Prisons to the community, including placement of such individuals in community
			 corrections facilities.</text>
					</subsection><subsection id="H2D35552589E74680ADA60986F34073A"><enum>(b)</enum><header>Procedures
			 regarding benefits</header>
						<paragraph id="HB4620F3973B34B6D9147BE08FDF26B7"><enum>(1)</enum><header>In
			 general</header><text>The Bureau of Prisons shall establish reentry planning
			 procedures within the Release Preparation Program that include providing
			 Federal offenders with information in the following areas:</text>
							<subparagraph id="H8697FC17F4BD4BCC881FC8A0A2D8BDB1"><enum>(A)</enum><text>Health and
			 nutrition.</text>
							</subparagraph><subparagraph id="HE0A2745D293047109726C400C740A47F"><enum>(B)</enum><text>Employment.</text>
							</subparagraph><subparagraph id="H32D812A1071A4643A8004C98D500D69B"><enum>(C)</enum><text>Personal finance
			 and consumer skills.</text>
							</subparagraph><subparagraph id="HF5CBDB29D8924090859206BD68C3512F"><enum>(D)</enum><text>Information and
			 community resources.</text>
							</subparagraph><subparagraph id="H4B203A52D4F945299680A23689FB31D2"><enum>(E)</enum><text>Release
			 requirements and procedures.</text>
							</subparagraph><subparagraph id="H6BD8558FF3114CBB89E5108F6F76C275"><enum>(F)</enum><text>Personal growth
			 and development.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDE2204F242124C1B82EA4387C805069F"><enum>(2)</enum><header>Format</header><text>Any
			 written information that the Bureau of Prisons provides to offenders for
			 reentry planning purposes shall use common terminology and language. The Bureau
			 of Prisons shall provide the United States Probation and Pretrial Services
			 System with relevant information on the medical care needs and the mental
			 health treatment needs of offenders scheduled for release and reentry into the
			 community. The United States Probation and Pretrial Services System shall take
			 this information into account when developing supervision plans in an effort to
			 address the medical care and mental health care needs of such offenders. The
			 Bureau of Prisons shall provide offenders with a sufficient amount of all
			 necessary medications upon release from custody.</text>
						</paragraph></subsection></section></subtitle><subtitle id="H1C12E1DBAEC04B7096B684BFD09D7400"><enum>C</enum><header>Economic
			 Empowerment</header>
				<section id="HE4B2F8F382D34669B649A91667DD6278"><enum>131.</enum><header>Reauthorization
			 of Learn and Serve America</header><text display-inline="no-display-inline">Section 501(a)(1)(A) of the National and
			 Community Service Act of 1990 (<external-xref legal-doc="usc" parsable-cite="usc/42/12681">42 U.S.C. 12681(a)(1)(A)</external-xref>) is amended by striking
			 <quote>fiscal year 1994 and such sums as may be necessary for each of the
			 fiscal years 1995 through 1996</quote> and inserting <quote>fiscal year 2008
			 and each of the 5 succeeding fiscal years</quote>.</text>
				</section><section id="HE217DFC9CDEA4449A51B1404B9EBE920"><enum>132.</enum><header>Job
			 Corps</header><text display-inline="no-display-inline">Section 161 of the
			 Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2901">29 U.S.C. 2901</external-xref>) is amended by striking
			 <quote>such sums as may be necessary for each of the fiscal years 1999 through
			 2003</quote> and inserting <quote>$1,800,000,000 (of which $300,000,000 shall
			 be designated to create additional Job Corps centers, especially in high gang
			 activity areas) for each of fiscal years 2008 through 2012</quote>.</text>
				</section><section commented="no" display-inline="no-display-inline" id="HFA454C421F144903B51CC400FDCA4000" section-type="subsequent-section"><enum>133.</enum><header>Workforce Investment
			 Act youth activities</header><text display-inline="no-display-inline">Section
			 137(a) of the Workforce Investment Act of 1998 (<external-xref legal-doc="usc" parsable-cite="usc/29/2872">29 U.S.C. 2872(a)</external-xref>) is amended
			 by striking <quote>such sums as may be necessary for each of fiscal years 1999
			 through 2003</quote> and inserting <quote>$1,000,000,000 for each of fiscal
			 years 2008 through 2012</quote>.</text>
				</section><section id="HEF1203D663A44812A961178E34478BD"><enum>134.</enum><header>Expansion and
			 reauthorization of the mentoring initiative for system involved youth</header>
					<subsection id="HF078E64285FE4314A9C4C69115F0C0A7"><enum>(a)</enum><header>Expansion</header><text>Section
			 261(a) of the Juvenile Justice and Delinquency Prevention Act of 1974 (42
			 U.S.C. 5665(a)) is amended by inserting at the end the following: <quote>The
			 Administrator shall expand the number of sites receiving such grants from 4 to
			 12.</quote>.</text>
					</subsection><subsection id="H0B204AF8009B4A06A1AAA2E0DDA9D160"><enum>(b)</enum><header>Reauthorization</header><text>Section
			 299 of the Juvenile Justice and Delinquency Prevention Act of 1974 (42 U.S.C.
			 5671) is amended by striking subsection (c) and inserting the following:</text>

			 Community Anti-gang Initiatives</header>
			<subtitle id="H2DEDAE04806D45AAACBDAD62B5550425"><enum>A</enum><header>Gang activity
			 policing program</header>
				<section id="H991891C3E0D244ED9677166355CDF674"><enum>201.</enum><header>Authority to
			 make gang activity policing grants</header><text display-inline="no-display-inline">The Attorney General may make grants to
			 States, units of local government, Indian tribes, other public and private
			 entities, and multi-jurisdictional or regional consortia thereof to increase
			 police presence, to expand and improve cooperative efforts between law
			 enforcement agencies and members of the community to address gang activity
			 problems, and to otherwise enhance public safety.</text>
				</section><section id="HED27C2CC165C447DAC4B7F80A954F69F"><enum>202.</enum><header>Eligible
			 activities</header><text display-inline="no-display-inline">Grants made under
			 this subtitle may include programs, projects, and other activities to—</text>
					<paragraph id="HAF87672D5A814ECBB8AA960024AC350"><enum>(1)</enum><text>rehire law
			 enforcement officers who have been laid off as a result of State and local
			 budget reductions for deployment to reduce gang activity;</text>
					</paragraph><paragraph id="H1C87AB13B2744978BA7FCC7B5DCDE1B4"><enum>(2)</enum><text>hire and train
			 additional career law enforcement officers for deployment to reduce gang
			 activity;</text>
					</paragraph><paragraph id="H9E8C6FB2E359441F9F793D69937D295D"><enum>(3)</enum><text>procure equipment,
			 technology, or support systems, or pay overtime, to increase the number of
			 officers deployed in gang activity policing;</text>
					</paragraph><paragraph id="HE14C7C56CFED41AAB325B6DD839F5900"><enum>(4)</enum><text>hire officers to
			 perform intelligence activities to reduce gang activity;</text>
					</paragraph><paragraph id="H79647507885E475AA853A3207249BA92"><enum>(5)</enum><text>increase the
			 number of law enforcement officers involved in activities that are focused on
			 interaction with members of the community or on proactive gang control and
			 prevention by redeploying officers to such activities;</text>
					</paragraph><paragraph id="HACDA42A67A7448698BAB08C84F865F23"><enum>(6)</enum><text>establish and
			 implement innovative programs to increase and enhance proactive crime control
			 and gang prevention programs involving law enforcement officers and young
			 persons in the community;</text>
					</paragraph><paragraph id="HB627E6854C644028B17437D26727FF67"><enum>(7)</enum><text>establish
			 school-based partnerships between local law enforcement agencies and local
			 school systems by using school resource officers who operate in and around
			 elementary and secondary schools to combat gangs;</text>
					</paragraph><paragraph id="H0906044AAD53458B9327C99DF6E031A4"><enum>(8)</enum><text>develop new
			 technologies, including interoperable communications technologies, modernized
			 criminal record technology, and forensic technology, to assist State and local
			 law enforcement agencies in reducing gang activity and to train law enforcement
			 officers to use such technologies; and</text>
					</paragraph><paragraph id="H7B26579B6BE740C8A3895FD4932FC668"><enum>(9)</enum><text>support the
			 purchase by law enforcement agencies of not more than 1 service weapon per
			 officer, upon hiring for deployment in gang activity policing or, if necessary,
			 upon the initial redeployment of an officer to gang activity policing.</text>
					</paragraph></section><section id="H1511D57651DB4ED2BA11815ECAB2B224"><enum>203.</enum><header>Preferential
			 consideration of applications for certain grants</header><text display-inline="no-display-inline">In awarding grants under this subtitle, the
			 Attorney General may give preferential consideration to applicants—</text>
					<paragraph id="H871195B3C6894705BA6CE93FDE81A849"><enum>(1)</enum><text>for hiring and
			 rehiring additional career law enforcement officers that involve a non-Federal
			 contribution exceeding the 25 percent minimum under this subtitle; and</text>
					</paragraph><paragraph id="H95E5D27CF8044A7EB334A3D600D70077"><enum>(2)</enum><text>that are located
			 in a high-intensity interstate gang activity area designated under section
			 211.</text>
					</paragraph></section><section id="HDAC8317C858549BB91D900885BEA7260"><enum>204.</enum><header>Use of
			 components</header><text display-inline="no-display-inline">The Attorney
			 General may use any component of the Department of Justice in carrying out this
			 subtitle.</text>
				</section><section id="H2EE24D96832244519473C4984118EBFE"><enum>205.</enum><header>Minimum
			 amount</header><text display-inline="no-display-inline">Unless all applications
			 submitted by any qualifying State and grantee within that State under this
			 subtitle have been funded, each qualifying State, together with grantees within
			 that State, shall receive in each fiscal year under this subtitle an amount
			 equal to not less than 0.5 percent of the total amount appropriated in that
			 fiscal year for grants under this subtitle. In this section, <term>qualifying
			 State</term> means any State that has submitted an application for a grant, or
			 in which a unit of local government, Indian tribe, other public or private
			 entity, or multijurisdictional or regional consortia thereof has submitted an
			 application for a grant, that meets the requirements established by the
			 Attorney General under this subtitle.</text>
				</section><section id="HF5BC9EE870DE4C0EB82BEF859400128F"><enum>206.</enum><header>Matching
			 funds</header>
					<subsection id="id79CE0EC5196E431987A909FF408DBB43"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Federal share of
			 the costs of a program, project, or activity carried out with a grant under
			 this subtitle shall be not more than 75 percent, unless the Attorney General
			 waives, wholly or in part, the requirement under this section of a non-Federal
			 contribution to the costs of a program, project, or activity.</text>
					</subsection><subsection id="id2E4E2192C1094146A8485E911A6074B5"><enum>(b)</enum><header>Hiring</header><text display-inline="yes-display-inline">For a grant for a period exceeding 1 year
			 for hiring or rehiring career law enforcement officers, the Federal share shall
			 decrease each year for up to 5 years, by an amount determined by the Attorney
			 General, with a goal of the continuation of the increased hiring level using
			 State or local sources of funding following the conclusion of Federal
			 support.</text>
					</subsection></section><section id="HDB78A7724FD4420FB0658F773C0537EC"><enum>207.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this subtitle $700,000,000 for each
			 of the fiscal years 2008 through 2012. Any amount appropriated under this
			 section shall remain available until expended.</text>
				</section></subtitle><subtitle id="HBDE63C49FE9C43D1AC9D1938C183B1A7"><enum>B</enum><header>High-intensity
			 interstate gang activity areas</header>
				<section id="H040D3063F2DA4ED9A35E693320055917"><enum>211.</enum><header>Designation of
			 and assistance for <quote>high-intensity</quote> interstate gang activity
			 areas</header>
					<subsection id="HD013D192C0724B2089A8DB7ACDA6955"><enum>(a)</enum><header>Definitions</header><text>In
			 this section the following definitions shall apply:</text>
						<paragraph id="HC8D7717E00CA4A2F91409800D9700B7"><enum>(1)</enum><header>Governor</header><text>The
			 term <term>Governor</term> means a Governor or other chief executive officer of
			 a State, or the Mayor of the District of Columbia.</text>
						</paragraph><paragraph id="H9238097DDEE84CF5857048835115ED46"><enum>(2)</enum><header>High-intensity
			 interstate gang activity area</header><text>The term <term>high-intensity
			 interstate gang activity area</term> means an area within a State that is
			 designated as a high-intensity interstate gang activity area under subsection
			 (b)(1).</text>
						</paragraph><paragraph id="HEA0BA318661E400582BF2E69F558066E"><enum>(3)</enum><header>State</header><text>The
			 term <term>State</term>—</text>
							<subparagraph id="id2E013EF55A794D18B13557350B46F02B"><enum>(A)</enum><text>means a State of
			 the United States, the District of Columbia, and any commonwealth, territory,
			 or possession of the United States; and</text>
							</subparagraph><subparagraph id="id56834F5C584C47CFAA7CFEA242057930"><enum>(B)</enum><text>includes an
			 <term>Indian tribe</term>, as that term is defined in section 102 of the
			 Federally Recognized Indian Tribe List Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/25/479a">25 U.S.C. 479a</external-xref>).</text>
							</subparagraph></paragraph></subsection><subsection id="H74AD701E74D14675B200CD4C005C54DE"><enum>(b)</enum><header>High-intensity
			 interstate gang activity areas</header>
						<paragraph id="H90E52ABC2DCB4DD789D290D2584EC9B4"><enum>(1)</enum><header>Designation</header><text>The
			 Attorney General, after consultation with the Governor of any appropriate
			 State, may designate as high-intensity interstate gang activity areas, a
			 specific area that is located within 1 or more States, based on the criteria
			 under
			 <internal-xref idref="HBB8AA06ED4DF4A50B735DFF8D6124F87" legis-path="211.(b)(4)">paragraph (4)</internal-xref>. To the extent that the
			 goals of a high-intensity interstate gang activity area overlap with the goals
			 of a high-intensity drug trafficking area designed under section 707 of the
			 Office of National Drug Control Policy Reauthorization Act of 1988 (21 U.S.C.
			 1706), the Attorney General may merge the 2 areas to serve both functions. The
			 Attorney General may not make the final designation of a high-intensity
			 interstate gang activity area without consulting with and receiving comment
			 from local elected officials representing communities within the affected
			 States.</text>
						</paragraph><paragraph id="H7C3A2B41F57845259224A7C8CD4A139"><enum>(2)</enum><header>Assistance</header><text>In
			 order to provide Federal assistance to high-intensity interstate gang activity
			 areas, the Attorney General shall—</text>
							<subparagraph id="HDBCF8D08FFD54A90BB4B8EE535AF5BE8"><enum>(A)</enum><text>establish criminal
			 street gang enforcement teams, consisting of Federal, State, and local law
			 enforcement authorities, for the coordinated investigation, disruption,
			 apprehension, and prosecution of criminal street gangs and offenders in each
			 high-intensity interstate gang activity area;</text>
							</subparagraph><subparagraph id="H2BAB7648D16C43B9B35D33F3CD55EBA3"><enum>(B)</enum><text>direct the
			 reassignment or detailing from any Federal department or agency (subject to the
			 approval of the head of that department or agency, in the case of a department
			 or agency other than the Department of Justice) of personnel to each criminal
			 street gang enforcement team established under
			 <internal-xref idref="HDBCF8D08FFD54A90BB4B8EE535AF5BE8" legis-path="211.(b)(2)(A)">subparagraph (A)</internal-xref>; and</text>
							</subparagraph><subparagraph id="H557B576B71EE49B0AF00E49D3DC08EC3"><enum>(C)</enum><text>provide all
			 necessary funding for the operation of such criminal street gang enforcement
			 teams in each high-intensity interstate gang activity area.</text>
							</subparagraph></paragraph><paragraph id="HACF2F29F6033490293F389191267BE80"><enum>(3)</enum><header>Composition of
			 criminal street gang enforcement team</header><text>Each team established under
			 paragraph (2)(A) shall consist of agents and officers, where feasible,
			 from—</text>
							<subparagraph id="H3FDEA112D7B9437D9817A9F7DCBC3700"><enum>(A)</enum><text>the Bureau of
			 Alcohol, Tobacco, Firearms, and Explosives;</text>
							</subparagraph><subparagraph id="H5DEA1F6CFA51401597C7F885576FBD22"><enum>(B)</enum><text>the Department of
			 Homeland Security;</text>
							</subparagraph><subparagraph id="H201314AE208747FF96A635F1277DCD3C"><enum>(C)</enum><text>the Department of
			 Housing and Urban Development;</text>
							</subparagraph><subparagraph id="H47C04E28A11E435BB3A600CB76A40044"><enum>(D)</enum><text>the Drug
			 Enforcement Administration;</text>
							</subparagraph><subparagraph id="H8E10B267BAF7422DBD6CCE339B1885F"><enum>(E)</enum><text>the Internal
			 Revenue Service;</text>
							</subparagraph><subparagraph id="H7ADE23D635DD433B91E0F59E90A475F6"><enum>(F)</enum><text>the Federal Bureau
			 of Investigation;</text>
							</subparagraph><subparagraph id="H287D843A6AE94B079D31DD1D6B34CE1B"><enum>(G)</enum><text>the United States
			 Marshals Service;</text>
							</subparagraph><subparagraph id="H3464DB6827C64F0285380600E3EC9152"><enum>(H)</enum><text>the United States
			 Postal Service;</text>
							</subparagraph><subparagraph id="HE1ADEA1BE1BA451DA9E8E73B100247D"><enum>(I)</enum><text>State and local law
			 enforcement; and</text>
							</subparagraph><subparagraph id="H77E50B2C7A154BF5BB9C70A5B5B841E9"><enum>(J)</enum><text>Federal, State,
			 and local prosecutors.</text>
							</subparagraph></paragraph><paragraph id="HBB8AA06ED4DF4A50B735DFF8D6124F87"><enum>(4)</enum><header>Criteria for
			 designation</header><text>In considering an area for designation as a
			 high-intensity interstate gang activity area under this section, the Attorney
			 General shall consider—</text>
							<subparagraph id="H47173AC2E146456FA6809CB8DEFD0192"><enum>(A)</enum><text>the current and
			 predicted levels of gang crime activity in that area;</text>
							</subparagraph><subparagraph id="H96C0345DB55C42C4B383ABD63553154"><enum>(B)</enum><text>the extent to which
			 violent crime in that area appears to be related to criminal street gang
			 activity, such as drug trafficking, murder, robbery, assaults, carjacking,
			 arson, kidnapping, extortion, and other criminal activity;</text>
							</subparagraph><subparagraph id="HAAE2CCA07E174643B1B9AF0205729185"><enum>(C)</enum><text>the extent to
			 which State and local law enforcement agencies have committed resources
			 to—</text>
								<clause id="H8E29571A99DD4B7395FCBAD0CDC72C00"><enum>(i)</enum><text>respond to the
			 gang crime problem in that area; and</text>
								</clause><clause id="H809D37053F3044B18D851F64B0BB2013"><enum>(ii)</enum><text>participate in a
			 gang enforcement team;</text>
								</clause></subparagraph><subparagraph id="HD0CB55EE36F04BC688A03D351CAF6DF0"><enum>(D)</enum><text>the extent to
			 which a significant increase in the allocation of Federal resources would
			 enhance local response to the gang crime activities in that area; and</text>
							</subparagraph><subparagraph id="H13C3ABE5FC8D4B358F00739CCB0039F0"><enum>(E)</enum><text>any other criteria
			 that the Attorney General considers to be appropriate.</text>
							</subparagraph></paragraph></subsection><subsection id="HF2585A63AB9E40B981B2D8917159C9E8"><enum>(c)</enum><header>Authorization of
			 appropriations</header>
						<paragraph id="HEC602A152E0546C58D12BA7BA399875B"><enum>(1)</enum><header>In
			 general</header><text>There are authorized to be appropriated $100,000,000 for
			 each of fiscal years 2008 to 2012 to carry out this section.</text>
						</paragraph><paragraph id="H1CBE263E269546E689234BB155EAA8B1"><enum>(2)</enum><header>Use of
			 funds</header><text>Of amounts made available under paragraph (1) in each
			 fiscal year—</text>
							<subparagraph id="H4DA08D030DA74B218B97214397905F82"><enum>(A)</enum><text>50 percent shall
			 be used to carry out subsection (b)(2); and</text>
							</subparagraph><subparagraph id="H12EF8FA16D854E7486E7E6C72B5F5FA"><enum>(B)</enum><text>50 percent shall be
			 used to make grants available for community-based programs to provide crime
			 prevention, research, and intervention services that are designed for gang
			 members and at-risk youth in a high-intensity interstate gang activity
			 area.</text>
							</subparagraph></paragraph><paragraph id="H7CD3AF9F0D04428BA710EBD7B49DD9B"><enum>(3)</enum><header>Reporting
			 requirements</header><text>Not later than February 1 of each year, the Attorney
			 General shall provide a report to Congress which describes, for each
			 high-intensity interstate gang activity area—</text>
							<subparagraph id="H1E895A9CFE2A4CAEBF95F2C2007C7000"><enum>(A)</enum><text>the specific
			 long-term and short-term goals and objectives;</text>
							</subparagraph><subparagraph id="HFDB7D609C87E4A46BBFB0003FEFD409"><enum>(B)</enum><text>the measurements
			 used to evaluate the performance of the high-intensity interstate gang activity
			 area in achieving the long-term and short-term goals;</text>
							</subparagraph><subparagraph id="H90742FDE7FEF4F148FE3AE54FDCA8F15"><enum>(C)</enum><text>the age,
			 composition, and membership of gangs in that high-intensity interstate gang
			 activity area;</text>
							</subparagraph><subparagraph id="HDE5CA5166F024B65BFC754B261022CA6"><enum>(D)</enum><text>the number and
			 nature of crimes committed by gangs in that high-intensity interstate gang
			 activity area; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H54476E3E98DF4FF094477EB4B5D450A6"><enum>(E)</enum><text>the definition of
			 the term <term>gang</term> used to compile that report.</text>
							</subparagraph></paragraph></subsection></section></subtitle><subtitle id="HAAA2E1FC4B8E4D05B384509F59C6247D"><enum>C</enum><header>Additional
			 funding</header>
				<section id="HD8779B586DF64A7DBAF156296CD38BDC"><enum>221.</enum><header>Additional
			 resources needed by the Federal Bureau of Investigation to investigate and
			 prosecute violent criminal street gangs</header>
					<subsection id="HD75A642E6E4B4AD394ECA3DBCDA1BDC5"><enum>(a)</enum><header>Responsibilities
			 of the Director of the FBI</header><text>The Director of the Federal Bureau of
			 Investigation shall use any funds made available under this section to carry
			 out the Safe Streets Program and to support the criminal street gang
			 enforcement teams, established under section 211(b)(2), in high-intensity
			 interstate gang activity areas designated under section 211(b)(1).</text>
					</subsection><subsection id="HE4E400FF4AEF4EFEB0F01DF73771C2A8"><enum>(b)</enum><header>Authorization of
			 appropriations</header><text>In addition to amounts otherwise authorized, there
			 are authorized to be appropriated $10,000,000 for each of fiscal years 2008
			 through 2012 to carry out this section, to remain available until
			 expended.</text>
					</subsection></section><section id="HBED7F80AE8B7488AB14DDEAA14939DA0"><enum>222.</enum><header>Grants to
			 prosecutors and law enforcement to combat violent crime and to protect
			 witnesses and victims of crimes</header>
					<subsection id="H3D609A9B6DBE413DA82EE8AEE6E7EA19"><enum>(a)</enum><header>In
			 general</header><text>Section 31702 of the <act-name parsable-cite="VCCLEA94">Violent Crime Control and Law Enforcement Act of
			 1994</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/13862">42 U.S.C. 13862</external-xref>) is amended—</text>
						<paragraph id="H9A76AC92A73548ADAF91C6F1A5FBB9A5"><enum>(1)</enum><text>in paragraph (3),
			 by striking <quote>and</quote> at the end;</text>
						</paragraph><paragraph id="H14A12BBB369944559E500008C478B94"><enum>(2)</enum><text>in
			 paragraph (4), by striking the period at the end and inserting a semicolon;

				technology, equipment, and training for prosecutors and law enforcement in
				order to increase accurate identification of gang members and violent
				offenders, and to maintain databases with such information to facilitate
				coordination among law enforcement and prosecutors; and</text>
								</paragraph><paragraph id="H2F0FCD38FB824004A7DF7DF4A937852B"><enum>(7)</enum><text>to create and
				expand witness and victim protection programs to prevent threats, intimidation,
				and retaliation against victims of, and witnesses to, violent
				crimes.</text>

						</paragraph></subsection><subsection id="HA43AC3F136464559BA11282B676F9035"><enum>(b)</enum><header>Authorization of

			 Safe Neighborhoods program to require each United States attorney to—</text>

			 investigate, and prosecute significant criminal street gangs operating within
			 the district of that United States attorney;</text>
						</paragraph><paragraph id="H5958CDE1F30B4BC698CF7F602B5639EE"><enum>(2)</enum><text>coordinate the
			 identification, investigation, and prosecution of criminal street gangs among
			 Federal, State, and local law enforcement agencies; and</text>
						</paragraph><paragraph id="H1105D1FB9A8E45C1B72321E6BBE9C819"><enum>(3)</enum><text>coordinate and
			 establish criminal street gang enforcement teams, established under section
			 211(b)(2), in high-intensity interstate gang activity areas designated under
			 section 211(b)(1) within the district of that United States attorney.</text>
						</paragraph></subsection><subsection id="H74D8B4ECC13745D991C7128CE186BA9B"><enum>(b)</enum><header>Additional staff
			 for Project Safe Neighborhoods</header>

			 amended to read as follows:</text>

									<paragraph id="H9EFA0B3BEF3D49C686E9FCAF96B491CE"><enum>(1)</enum><header>Criminal street
				gang</header><text>The term <term>criminal street gang</term> means a formal or
				informal group, club, organization, or association of 5 or more
				individuals—</text>
										<subparagraph id="id2353FC12A4BC4905A6FE1AC118B24268"><enum>(A)</enum><text>who individually,
				jointly, or in combination, have committed or attempted to commit for the
				direct or indirect benefit of, at the direction of, in furtherance of, or in
				association with the group, club organization, or association at least 2
				separate acts, each of which is a predicate gang crime—</text>
											<clause id="idAC0AE3F82DBB43818E213CB565CCB190"><enum>(i)</enum><text>1
				of which occurs after the date of enactment of the
				<short-title>Fighting Gangs and Empowering Youth Act of
				2007</short-title>;</text>
											</clause><clause id="id7A8870E0232F4435920CFC1DC719853F"><enum>(ii)</enum><text>the last of
				which occurs not later than 5 years after the commission of a prior predicate
				gang crime (excluding any period of imprisonment); and</text>
											</clause><clause id="id140B4FEB97114329BA44EE96E419B30B"><enum>(iii)</enum><text>1 of which is a
				crime of violence or involves manufacturing, importing, distributing,
				possessing with intent to distribute, or otherwise dealing in a controlled
				substance or listed chemical (as those terms are defined in section 102 of the
				<act-name parsable-cite="CSA">Controlled Substances Act</act-name> (21 U.S.C.
				802)); and</text>
											</clause></subparagraph><subparagraph id="id8135307D2CC446BD8B4CDABDAA270365"><enum>(B)</enum><text>whose activities
				affect interstate or foreign commerce, or involve the use of any facility of,
				or travel in, interstate or foreign commerce.</text>
										</subparagraph></paragraph><paragraph id="H72B433E5EFF34991A9B7E23975787683"><enum>(2)</enum><header>Predicate gang
				crime</header><text>The term <term>predicate gang crime</term> means—</text>
										<subparagraph id="H6C9968A39EE7479EA7768FBD1ECB5E37"><enum>(A)</enum><text>any act, threat,
				conspiracy, or attempted act, which is chargeable under Federal or State law
				and punishable by imprisonment for more than 1 year involving—</text>
											<clause id="HA8728D1BD2F140A0B4F3D5D23BFF7026"><enum>(i)</enum><text>murder;</text>
											</clause><clause id="H9557FD050EFA4CB4B7E4A18EDB9B3531"><enum>(ii)</enum><text>manslaughter;</text>
											</clause><clause id="HE3BCF39E93524C6BA8D56430A26ED3D"><enum>(iii)</enum><text>maiming;</text>
											</clause><clause id="HE25A9EE41D994A73AD5B15322740B601"><enum>(iv)</enum><text>assault with a
				dangerous weapon;</text>
											</clause><clause id="HACCD0D735026435FBCD0F5B9B98028F4"><enum>(v)</enum><text>assault resulting
				in serious bodily injury;</text>
											</clause><clause id="H0923EEC124284565A1FD3B4F144692C1"><enum>(vi)</enum><text>gambling;</text>
											</clause><clause id="H4A95E80E4ADB4AFB8C0912D8DAB771FE"><enum>(vii)</enum><text>kidnapping;</text>
											</clause><clause id="H69DD1478C4A64976976123A8AC8E0868"><enum>(viii)</enum><text>robbery;</text>

				or retaliating against a witness, victim, or informant;</text>
											</clause><clause id="HE07691E7B93B44D2B6CEFBCA41DCB5F"><enum>(xiii)</enum><text>burglary;</text>
											</clause><clause id="H1928CD6165A14F599EEF00130020FCBB"><enum>(xiv)</enum><text>sexual
				assault;</text>
											</clause><clause id="H7D095B10F8E04556AC55009FDA14A5ED"><enum>(xv)</enum><text>carjacking;
				or</text>
											</clause><clause id="H1768AD93751B4DDDB417342D30006DDF"><enum>(xvi)</enum><text>manufacturing,
				importing, distributing, possessing with intent to distribute, or otherwise
				dealing in a controlled substance or listed chemicals (as those terms are
				defined in section 102 of the <act-name parsable-cite="CSA">Controlled
				Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/802">21 U.S.C. 802</external-xref>));</text>
											</clause></subparagraph><subparagraph id="H27AEFECBB2F5444E84A1968248B3CB56"><enum>(B)</enum><text>any act punishable
				by imprisonment for more than 1 year under—</text>
											<clause id="HD5AA4150542A4B0AA92FE9AF1637B84F"><enum>(i)</enum><text>section 844
				(relating to explosive materials);</text>
											</clause><clause id="HFE724FD69F584FB2869716A825005205"><enum>(ii)</enum><text>section 922(g)(1)
				(where the underlying conviction is a violent felony (as defined in section
				924(e)(2)(B) of this title) or is a serious drug offense (as defined in section
				924(e)(2)(A) of this title));</text>
											</clause><clause id="H135721D6A66C4A3B81501412EDB3BBCD"><enum>(iii)</enum><text>subsection
				(a)(2), (b), (c), (g), or (h) of section 924 (relating to receipt, possession,
				and transfer of firearms);</text>
											</clause><clause id="H29E563E6331E45EA9CA8D379D47514E0"><enum>(iv)</enum><text>sections 1028 and
				1029 (relating to fraud and related activity in connection with identification
				documents or access devices);</text>

				(relating to obstruction of justice);</text>

											</clause><clause id="H8367813E105E4D88BAA1BF9BA6E20EB"><enum>(xiii)</enum><text>section 1958
				(relating to use of interstate commerce facilities in the commission of
				murder-for-hire); or</text>
											</clause><clause id="H785A0101831D4E7CA81F0300E80471AD"><enum>(xiv)</enum><text>sections 2312
				through 2315 (relating to interstate transportation of stolen motor vehicles or
				stolen property); or</text>
											</clause></subparagraph><subparagraph id="H5DDDA52EFAA04B4F8410C5B329026776"><enum>(C)</enum><text>any violation of
				section 274 (relating to bringing in and harboring certain aliens), section 277
				(relating to aiding or assisting certain aliens to enter the United States), or
				section 278 (relating to importation of alien for immoral purpose) of the
				Immigration and Nationality Act (<external-xref legal-doc="usc" parsable-cite="usc/8/1324">8 U.S.C. 1324</external-xref>, 1327, and 1328).</text>
										</subparagraph></paragraph><paragraph id="id7B820CB6AAD8408D86043ADEABE10F41"><enum>(3)</enum><header>Sexual
				assault</header><text>The term <term>sexual assault</term> means any offense
				that involves conduct that would violate chapter 109A if the conduct occurred
				in the special maritime and territorial jurisdiction of the United
				States.</text>
									</paragraph><paragraph id="HD54694E186864BE8ADB57B405EDC69E6"><enum>(4)</enum><header>State</header><text>The
				term <term>State</term> means each of the several States of the United States,
				the District of Columbia, and any commonwealth, territory, or possession of the
				United States.</text>
									</paragraph></subsection><subsection id="H3138AE2E371049D3AA43C1F70A459BB"><enum>(b)</enum><header>Participation in
				criminal street gangs</header><text>It shall be unlawful—</text>
									<paragraph id="H03E7502E8D8A44B4AC1900685F00915B"><enum>(1)</enum><text>to commit, or
				conspire or attempt to commit a predicate gang crime—</text>
										<subparagraph id="H8EBF1CE257D04314966310BFB5DE23A"><enum>(A)</enum><text>in furtherance or
				in aid of the activities of a criminal street gang;</text>
										</subparagraph><subparagraph id="H4C01D9FC06504762A2DF11AC37B864E"><enum>(B)</enum><text>for the purpose of
				gaining entrance to or maintaining or increasing position in such a gang;
				or</text>
										</subparagraph><subparagraph id="HB6C810B626B9412A86CF3BB5693394D"><enum>(C)</enum><text>for the direct or
				indirect benefit of the criminal street gang, or in association with the
				criminal street gang; or</text>
										</subparagraph></paragraph><paragraph id="HDC2057CF76BA471B854C28DAEDF56CB"><enum>(2)</enum><text>to employ, use,
				command, counsel, persuade, induce, entice, or coerce any individual to commit,
				cause to commit, or facilitate the commission of, a predicate gang
				crime—</text>
										<subparagraph id="H106D4856D0654EB4A0C02C092848A649"><enum>(A)</enum><text>in furtherance or
				in aid of the activities of a criminal street gang;</text>
										</subparagraph><subparagraph id="HF3E8F36ED0604548907B08E0CEF57304"><enum>(B)</enum><text>for the purpose of
				gaining entrance to or maintaining or increasing position in such a gang;
				or</text>
										</subparagraph><subparagraph id="H293875CFDF0249CE88DFDAAB7583FB7D"><enum>(C)</enum><text>for the direct or
				indirect benefit of the criminal street gang, or in association with the
				criminal street gang.</text>
										</subparagraph></paragraph></subsection><subsection id="H24D3EF467AA643B5A4C11D4692047555"><enum>(c)</enum><header>Penalties</header><text>Whoever
				violates subsection (b)—</text>
									<paragraph id="H7B2DC05611294A19AD264931CAF03DF5"><enum>(1)</enum><text>shall be fined
				under this title, imprisoned for not more than 30 years, or both; and</text>
									</paragraph><paragraph id="HCFF4AA6FC61C4E9A9D07915885941C2B"><enum>(2)</enum><text>if the violation
				is based on a predicate gang crime for which the maximum penalty includes life
				imprisonment, shall be fined under this title, imprisoned for any term of years
				or for life, or both.</text>
									</paragraph></subsection><subsection id="H1FDA275AD3764F7FAD465D4408DDA2ED"><enum>(d)</enum><header>Forfeiture</header>
									<paragraph id="HFB4F8E1588574F9BBB0810D0C5EA41AD"><enum>(1)</enum><header>In
				general</header><text>The court, in imposing sentence on a person who is
				convicted of an offense under this section, shall order that the defendant
				forfeit to the United States—</text>
										<subparagraph id="HF95EA38DD0AE4451B7B71814D0804A5"><enum>(A)</enum><text>any property, real
				or personal, constituting or traceable to gross proceeds obtained from that
				offense; and</text>
										</subparagraph><subparagraph id="HF4645249D8B041DCA5DDB9BECCDE5D78"><enum>(B)</enum><text>any property used
				or intended to be used, in any manner or part, to commit or to facilitate the
				commission of that offense.</text>
										</subparagraph></paragraph><paragraph id="H5B56002D2858436A8137AA7D47FDDECB"><enum>(2)</enum><header>Criminal
				procedures</header><text>The procedures under section 413 of the
				<act-name parsable-cite="CSA">Controlled Substances Act</act-name> (21 U.S.C.
				853) (other than subsection (d) of that section) and under rule 32.2 of the
				Federal Rules of Criminal Procedure, shall apply to all stages of a criminal
				forfeiture proceeding under this section.</text>
									</paragraph><paragraph id="H50382773E5DA469399BBECDED278D58"><enum>(3)</enum><header>Civil
				procedures</header><text>Property subject to forfeiture under paragraph (1) may
				be forfeited in a civil case under the procedures set forth in chapter 46 of
				this
				title.</text>
									</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>

			 is amended by adding at the end the following:</text>

				persons to participate in a criminal street gang</header>
								<subsection id="H87F0F070B33B4446848B8948F05B5E94"><enum>(a)</enum><header>Prohibited
				acts</header><text>It shall be unlawful for any person to recruit, employ,
				solicit, induce, command, or cause another person to be or remain as a member
				of a criminal street gang, or conspire to do so, with the intent to cause that
				person to participate in a predicate gang crime.</text>
								</subsection><subsection id="H68EF0ECA773845A487CBBD7F784D696E"><enum>(b)</enum><header>Definition of
				minor</header><text>In this section, the term <term>minor</term> means a person
				who is less than 18 years of age.</text>
								</subsection><subsection id="HB1F7B4DDE6BF4BDBB3DDBD690109EE1"><enum>(c)</enum><header>Penalties</header><text>Any
				person who violates subsection (a) shall—</text>
									<paragraph id="HDB9F4B257F6D45B50087F48F827866FF"><enum>(1)</enum><text>be imprisoned not
				more than 10 years, fined under this title, or both; or</text>
									</paragraph><paragraph id="H54FF0EF5B4DB48909DF289FD48ED952E"><enum>(2)</enum><text>if the person
				recruited, solicited, induced, commanded, or caused to participate or remain in
				a criminal street gang is under the age of 18—</text>
										<subparagraph id="H1E8BD716FB594166A1A81F282C5BC73"><enum>(A)</enum><text>be imprisoned for
				not more than 20 years, fined under this title, or both; and</text>
										</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H0BC12F3559B54550AF0056BE33994022"><enum>(B)</enum><text>at the discretion
				of the sentencing judge, be liable for any costs incurred by the Federal
				Government, or by any State or local government, for housing, maintaining, and
				treating the person until the person attains the age of 18
				years.</text>
										</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H52C9836B2910452691455493C5223883"><enum>(b)</enum><header>Violent crimes
			 and criminal street gang recruitment</header><text><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/18/26">Chapter 26</external-xref> of title 18,
			 United States Code, as amended by this Act, is amended by adding at the end the
			 following:</text>
						<quoted-block display-inline="no-display-inline" id="id750EA133EA52453EA2872B7AC458B18B" style="USC">
							<section id="HE8645EFE76D043C08BF4B4EA023F246"><enum>523.</enum><header>Violent crimes
				in furtherance or in aid of a criminal street gang</header><text display-inline="no-display-inline">Any
				person who, for the purpose of gaining entrance to or maintaining or increasing
				position in, or in furtherance or in aid of, or for the direct or indirect
				benefit of, or in association with a criminal street gang, or as consideration
				for the receipt of, or as consideration for a promise or agreement to pay,
				anything of pecuniary value to or from a criminal street gang, murders,
				kidnaps, sexually assaults, maims, assaults with a dangerous weapon, commits
				assault resulting in serious bodily injury upon, commits any other crime of
				violence or threatens to commit a crime of violence against any individual, or
				attempts or conspires to do so, shall be punished, in addition and consecutive
				to the punishment provided for any other violation of this chapter—</text>
								<paragraph id="HA5A4991C9A3C40FA825D1562CBE12FE9"><enum>(1)</enum><text>for murder, by
				imprisonment for any term of years or for life, a fine under this title, or
				both;</text>
								</paragraph><paragraph id="H5E0A23C224364D6B8EB8AC3601CD5F69"><enum>(2)</enum><text>for kidnapping or
				sexual assault, by imprisonment for any term of years or for life, a fine under
				this title, or both;</text>
								</paragraph><paragraph id="H4ED21214AFFC4ED791AD044D513EC43F"><enum>(3)</enum><text>for maiming, by
				imprisonment for any term of years or for life, a fine under this title, or
				both;</text>
								</paragraph><paragraph id="H67E56CC550D3471C858F32E97E628627"><enum>(4)</enum><text>for assault with a
				dangerous weapon or assault resulting in serious bodily injury, by imprisonment
				for not more than 30 years, a fine under this title, or both;</text>

				crime of violence, by imprisonment for not more than 20 years, a fine under
				this title, or both;</text>

				commit a crime of violence specified in paragraphs (1) through (4), by
				imprisonment for not more than 10 years, a fine under this title, or

								</paragraph><paragraph id="HB29BA0D029B24C55A738B097FEEE1C66"><enum>(7)</enum><text>for attempting or
				conspiring to commit murder, kidnapping, maiming, or sexual assault, by
				imprisonment for not more than 30 years, a fine under this title, or both;

								</paragraph><paragraph id="H56871E32F2D84941A9BE385E43DCD37"><enum>(8)</enum><text>for attempting or
				conspiring to commit a crime involving assault with a dangerous weapon or

			 113(a)(3) of title 18, United States Code, is amended by striking <quote>with

			 prohibition on firearm transfer to commit crime of violence or drug trafficking

			 amended—</text>

			 amendment relating to orders for restitution</header><text>Section 3663(c)(4)
			 of title 18, United States Code, is amended by striking <quote>chapter 46 or

					</subsection><subsection id="HFC15686F56404E96A895003C5F533EBD"><enum>(i)</enum><header>Special
			 provision for Indian country</header><text>No person subject to the criminal
			 jurisdiction of an Indian tribal government shall be subject to section 3559(e)
			 of title 18, United States Code, for any offense for which Federal jurisdiction
			 is solely predicated on the fact that the offense was committed in Indian
			 country (as defined in section 1151 of such title 18) and which occurs within
			 the boundaries of such Indian country, unless the governing body of such Indian
			 tribe elects to subject the persons under the criminal jurisdiction of the
			 tribe to section 3559(e) of such title 18.</text>

			 Code, is amended—</text>
					<paragraph id="HCF524FC85CE54A24B93153AE00F6379F"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>Whoever</quote> and all
			 that follows through <quote>punished</quote> and inserting the following:
			 <quote>Any person who, as consideration for the receipt of, or as consideration
			 for a promise or agreement to pay, anything of pecuniary value from an
			 enterprise engaged in racketeering activity, or for the purpose of gaining
			 entrance to or maintaining or increasing position in an enterprise engaged in
			 racketeering activity, or in furtherance or in aid of an enterprise engaged in
			 racketeering activity, murders, kidnaps, sexually assaults (as that term is
			 defined in section 521), maims, assaults with a dangerous weapon, commits
			 assault resulting in serious bodily injury upon, or threatens to commit a crime
			 of violence against any individual in violation of the laws of any State or the
			 United States, or attempts or conspires to do so, shall be punished, in
			 addition and consecutive to the punishment provided for any other violation of
			 this chapter</quote>; and</text>
					</paragraph><paragraph id="H4D961F0793CC4A9D9D59F54646FBF46B"><enum>(2)</enum><text>by striking
			 paragraphs (2) through (6) and inserting the following:</text>

					</paragraph></section><section id="H1E26B7EA79734EEB8228AA2B145774EB"><enum>307.</enum><header>Violent crimes
			 committed during and in relation to a drug trafficking crime</header>
					<subsection id="H271152CCF98A4D32B67967CE57B5ACFB"><enum>(a)</enum><header>In
			 general</header><text>Part D of the <act-name parsable-cite="CSA">Controlled
			 Substances Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/21/841">21 U.S.C. 841 et seq.</external-xref>) is amended by adding at the
			 end the following:</text>

				general</header><text>Any person who, during and in relation to any drug
				trafficking crime, murders, kidnaps, sexually assaults, maims, assaults with a
				dangerous weapon, commits assault resulting in serious bodily injury upon,
				commits any other crime of violence or threatens to commit a crime of violence
				against, any individual, or attempts or conspires to do so, shall be punished,
				in addition and consecutive to the punishment provided for the drug trafficking
				crime—</text>
									<paragraph id="HB84D2F96543941A795D98429763EF5F"><enum>(1)</enum><text>in the case of
				murder, by imprisonment for any term of years or for life, a fine under title
				18, United States Code, or both;</text>
									</paragraph><paragraph id="HDFF2A806374C4CCF81096F56147EAB6"><enum>(2)</enum><text>in the case of
				kidnapping or sexual assault by imprisonment for any term of years or for life,
				a fine under such title 18, or both;</text>
									</paragraph><paragraph id="H5EFCE7FE0DF34EB5BD47EEA9B38E15E0"><enum>(3)</enum><text>in the case of
				maiming, by imprisonment for any term of years or for life, a fine under such
				title 18, or both;</text>
									</paragraph><paragraph id="H00E25C1B9BE042FAB666928307D037B5"><enum>(4)</enum><text>in the case of
				assault with a dangerous weapon or assault resulting in serious bodily injury,
				by imprisonment not more than 30 years, a fine under such title 18, or
				both;</text>
									</paragraph><paragraph id="H427DA7AD610F4BDF8CA800EB4EB6C2F3"><enum>(5)</enum><text>in the case of
				committing any other crime of violence, by imprisonment for not more than 20
				years, a fine under such title 18, or both;</text>
									</paragraph><paragraph id="HCD6A9E62245F4EE5845DB728B5839D65"><enum>(6)</enum><text>in the case of
				threatening to commit a crime of violence specified in paragraphs (1) through
				(4), by imprisonment for not more than 10 years, a fine under such title 18, or
				both;</text>
									</paragraph><paragraph id="H2A8745ABE798453AB6A837FDA00ED06"><enum>(7)</enum><text>in the case of
				attempting or conspiring to commit murder, kidnapping, maiming, or sexual
				assault, by imprisonment for not more than 30 years, a fine under such title
				18, or both; and</text>
									</paragraph><paragraph id="H5F50D79BA9A3410F8D7F296209F019F"><enum>(8)</enum><text>in the case of
				attempting or conspiring to commit a crime involving assault with a dangerous
				weapon or assault resulting in serious bodily injury, by imprisonment for not
				more than 20 years, a fine under such title 18, or both.</text>
									</paragraph></subsection><subsection id="H766942AB57B64B6487D05C1EB8A312AA"><enum>(b)</enum><header>Venue</header><text>A
				prosecution for a violation of this section may be brought in—</text>
									<paragraph id="H7C4FF4430D81442A961ED1BA009EE111"><enum>(1)</enum><text>the judicial
				district in which the murder or other crime of violence occurred; or</text>
									</paragraph><paragraph id="H318FACFBC9184A8D865D326435D500E5"><enum>(2)</enum><text>any judicial
				district in which the drug trafficking crime may be prosecuted.</text>
									</paragraph></subsection><subsection id="H4986D217329740B7B2FA588FFCC307A2"><enum>(c)</enum><header>Definitions</header><text>As
				used in this section—</text>
									<paragraph id="H93C0D598143C419AAF8796E583B7B785"><enum>(1)</enum><text>the term
				<term>crime of violence</term> has the meaning given that term in section 16 of
				title 18, United States Code;</text>
									</paragraph><paragraph id="HDDF07D389D0A4A0AA2B296A900B8E17B"><enum>(2)</enum><text>the term
				<term>drug trafficking crime</term> has the meaning given that term in section
				924(c)(2) of title 18, United States Code; and</text>
									</paragraph><paragraph id="id395DEF5A21414334A315B54B5B1FAD43"><enum>(3)</enum><text>the term
				<term>sexually assault</term> has the meaning given that term in section 521 of
				title 18, United States
				Code.</text>

			 to hearsay exception for forfeiture by wrongdoing</header><text display-inline="no-display-inline">Rule 804(b)(6) of the Federal Rules of
			 Evidence is amended by striking <quote>A statement</quote> and all that follows
			 and inserting: <quote>A statement offered against a party that has engaged,
			 acquiesced, or conspired, in wrongdoing that was intended to, and did, procure
			 the unavailability of the declarant as a witness.</quote>.</text>
				</section><section id="H9BA4E4FD39654C13BEBBF07EFA00E6F0"><enum>311.</enum><header>Clarification
			 of venue for retaliation against a witness</header><text display-inline="no-display-inline"><external-xref legal-doc="usc" parsable-cite="usc/18/1513">Section 1513</external-xref> of title 18, United States
			 Code, is amended by—</text>
					<paragraph id="HC4448DBAF7204D86BAB9DAF8CD6CCF26"><enum>(1)</enum><text>redesignating
			 subsection (e) beginning with <quote>Whoever conspires</quote> as subsection
			 (f); and</text>
					</paragraph><paragraph id="HC183E65433C942CFA3FF4E4BF4B9173"><enum>(2)</enum><text>adding at the end
			 the following:</text>

				under this section may be brought in the district in which the official

							</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></section><section id="HC59D0FB0D9D540E39748E38D00C80094"><enum>312.</enum><header>Amendment of
			 sentencing guidelines relating to certain gang and violent crimes</header>
					<subsection id="HDD9D2101798C4B88AE6D5165E834B5E8"><enum>(a)</enum><header>Directive to the
			 United States Sentencing Commission</header><text>Pursuant to its authority
			 under <external-xref legal-doc="usc" parsable-cite="usc/28/994">section 994(p)</external-xref> of title 28, United States Code, and in accordance with
			 this section, the United States Sentencing Commission shall review and, if
			 appropriate, amend its guidelines and its policy statements to conform to the
			 amendments made by this title.</text>
					</subsection><subsection id="H84743CEE851F47C8B0E505885E73B900"><enum>(b)</enum><header>Requirements</header><text>In
			 carrying out this section, the Sentencing Commission shall—</text>
						<paragraph id="H8B9295EC16164773B184A6141C86F163"><enum>(1)</enum><text>establish new
			 guidelines and policy statements, as warranted, in order to implement new or
			 revised criminal offenses created under this title;</text>
						</paragraph><paragraph id="HD335D7DA93EE4C278534C7E009BF647C"><enum>(2)</enum><text>ensure that the
			 sentencing guidelines and policy statements reflect the serious nature of the
			 offenses and the penalties set forth in this title, the growing incidence of
			 serious gang and violent crimes, and the need to modify the sentencing
			 guidelines and policy statements to deter, prevent, and punish such
			 offenses;</text>
						</paragraph><paragraph id="H25B06E933F1F4E65B418828DE4535BA2"><enum>(3)</enum><text>consider the
			 extent to which the guidelines and policy statements adequately address—</text>
							<subparagraph id="HA156F495C7634D18961D52030001D0D1"><enum>(A)</enum><text>whether the
			 guideline offense levels and enhancements for gang and violent crimes—</text>
								<clause id="H9EF5204901F54741B5A4A081619BD373"><enum>(i)</enum><text>are
			 sufficient to deter and punish such offenses; and</text>
								</clause><clause id="H174C32E5E76A4EF497836F37DA02D7A7"><enum>(ii)</enum><text>are
			 adequate in view of the statutory increases in penalties contained in the
			 amendments made by this title; and</text>
								</clause></subparagraph><subparagraph id="H9084CD358F6D4D84975FA2E5FC74D33E"><enum>(B)</enum><text>whether any
			 existing or new specific offense characteristics should be added to reflect
			 congressional intent to increase gang and violent crime penalties, punish
			 offenders, and deter gang and violent crime;</text>
							</subparagraph></paragraph><paragraph id="H4EE6CA381EB64E99A52DD600006C6EAD"><enum>(4)</enum><text>assure reasonable
			 consistency with other relevant directives and with other sentencing
			 guidelines;</text>
						</paragraph><paragraph id="H78EB373257A64458AF656998C9C1F1E"><enum>(5)</enum><text>account for any
			 additional aggravating or mitigating circumstances that might justify
			 exceptions to the generally applicable sentencing ranges;</text>
						</paragraph><paragraph id="H9B0EA3F5EB0B4424AA946395C5367E40"><enum>(6)</enum><text>make any necessary
			 conforming changes to the sentencing guidelines; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3E3F78C0A35A4288959FE7752D8E5E90"><enum>(7)</enum><text>assure that the
			 guidelines adequately meet the purposes of sentencing under section 3553(a)(2)
			 of title 18, United States Code.</text>
						</paragraph></subsection></section><section id="H2BB31C65E10A4935AC3D35C639E6EB28"><enum>313.</enum><header>Study on
			 expanding Federal authority for juvenile offenders</header>
					<subsection id="H66F29A2789914FE18454BF7200F6D096"><enum>(a)</enum><header>In
			 general</header><text>Not later than 9 months after the date of enactment of
			 this Act, the Comptroller General of the United States shall submit to the
			 Committee on the Judiciary of the Senate and the Committee on the Judiciary of
			 the House of Representatives a report on the costs and benefits associated with
			 expanding Federal authority to prosecute offenders under the age of 18 years
			 who are gang members who commit criminal offenses.</text>
					</subsection><subsection id="H70C495C6068745D782FBC19940CA44C9"><enum>(b)</enum><header>Contents</header><text>The
			 report submitted under subsection (a) shall—</text>
						<paragraph id="H15F31CE1CE77483B830234897C78E47B"><enum>(1)</enum><text>examine the
			 ability of the judicial systems of the States to respond effectively to
			 juveniles who are members of criminal street gangs, as that term is defined in
			 <external-xref legal-doc="usc" parsable-cite="usc/18/521">section 521</external-xref> of title 18, United States Code, as amended by this Act;</text>
						</paragraph><paragraph id="H3AA87B43C8E54A37BECC21145EA079D3"><enum>(2)</enum><text>examine the extent
			 to which offenders who are 16 and 17 years old are members of criminal street
			 gangs, and are accused of committing violent crimes and prosecuted in the adult
			 criminal justice systems of the individual States;</text>
						</paragraph><paragraph id="H85F69638A2484DBCBBC679B2EB1C42CF"><enum>(3)</enum><text>determine the
			 percentage of crimes committed by members of criminal street gangs that are
			 committed by offenders who are 16 and 17 years old;</text>
						</paragraph><paragraph id="H842497F40A724C25B8D83FA12CE264A7"><enum>(4)</enum><text>examine the extent
			 to which United States attorneys bring criminal indictments and prosecute
			 offenders under the age of 18 years, and the extent to which United States
			 Attorneys' offices include prosecutors with experience prosecuting juveniles
			 for adult criminal violations;</text>
						</paragraph><paragraph id="HC4A93A0408E34580B850B33D6583BC1E"><enum>(5)</enum><text>examine the extent
			 to which the Bureau of Prisons houses offenders under the age of 18 years, and
			 has the ability and experience to meet the needs of young offenders;</text>
						</paragraph><paragraph id="HEBA255619AC54F69A725AFDA3A6D573"><enum>(6)</enum><text>estimate the cost
			 to the Federal Government of prosecuting and incarcerating members of criminal
			 street gangs who are 16 or 17 years old and are accused of violent crimes;
			 and</text>
						</paragraph><paragraph id="HAC2EC1F2D13B49F0A1A663DD49003BA8"><enum>(7)</enum><text>detail any
			 benefits for Federal prosecutions that would be realized by expanding Federal
			 authority to bring charges against members of criminal street gangs who are 16
			 or 17 years old and are accused of violent crimes.</text>
						</paragraph></subsection></section></subtitle><subtitle id="HEC307B0E65144B6EBA41A52E31D5E41C"><enum>B</enum><header>Firearms
			 offenses</header>
				<section display-inline="no-display-inline" id="H78C8AF77316E415EAB505269199F7197"><enum>321.</enum><header>Expansion of
			 rebuttable presumption against release of persons charged with firearms
			 offenses</header><text display-inline="no-display-inline">Section 3142 of title
			 18, United States Code, is amended—</text>
					<paragraph id="HB9EC0E22739F4270B2000024702426F2"><enum>(1)</enum><text>in subsection (e),
			 in the matter following paragraph (3)—</text>
						<subparagraph id="H6C66EB0E695B44FAB84C3B939EFC7087"><enum>(A)</enum><text>by inserting
			 <quote>an offense under section 922(g)(1) where the underlying conviction is a
			 serious drug offense (as that term is defined in section 924(e)(2)(A) of this
			 title) for which a period of not more than 10 years has elapsed since the date
			 of the conviction or the release of the person from imprisonment, whichever is
			 later, or is a serious violent felony (as that term is defined in section
			 3559(c)(2)(F) of this title),</quote> after <quote>that the person
			 committed</quote>; and</text>
						</subparagraph><subparagraph id="H2F873DFB4A894B22B65BD2C4C7D1F2F9"><enum>(B)</enum><text>by inserting a
			 comma before <quote>or an offense involving a minor</quote>; and</text>
						</subparagraph></paragraph><paragraph id="H489373CD65CB4200B28B5E936284B24C"><enum>(2)</enum><text>in subsection
			 (f)(1)—</text>
						<subparagraph id="HC8E7BF7D9B41425E815DEB9105AFFCF3"><enum>(A)</enum><text>in subparagraph
			 (D), by striking <quote>or</quote> at the end; and</text>
						</subparagraph><subparagraph id="H72342F5C7C4B412B00B630C4F4C1E15B"><enum>(B)</enum><text>by adding at the
			 end the following:</text>

			 penalties for use of firearm in crime of violence or drug trafficking
			 crime</header>
					<subsection id="HDBC16438A9B3419DBF2F2107DB5484A9"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924(c)(1)(A)</external-xref> of title 18, United States Code, is
			 amended—</text>
						<paragraph id="H50EA88F3B5EB46C6A2C13100FCC098FA"><enum>(1)</enum><text>by striking
			 <quote>shall</quote> and inserting <quote>or conspires to use, carry, or
			 possess a firearm during and in relation to any such crime shall, for each
			 instance in which the firearm is so used, carried, or possessed</quote>;</text>
						</paragraph><paragraph id="H4D8F5018F53B42AB9D27BB42772DDE24"><enum>(2)</enum><text>in clause
			 (i)—</text>
							<subparagraph id="HD51B1A8E361C411796F500F6CB825D3B"><enum>(A)</enum><text>by striking

						</paragraph></subsection></section><section id="H540D285C8F81444DA309A09164DABF4E"><enum>323.</enum><header>Possession of
			 firearms by dangerous felons</header>
					<subsection id="H8D2852B57DD4401DAD9F59D2B2F68351"><enum>(a)</enum><header>In
			 general</header><text><external-xref legal-doc="usc" parsable-cite="usc/18/924">Section 924(e)(1)</external-xref> of title 18, United States Code, is
			 amended to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H505572F43BF844BDB4389F59504BAA9B" style="OLC">
							<subsection id="H20E21D981A194F81B572553F707C0039"><enum>(e)</enum><paragraph commented="no" display-inline="yes-display-inline" id="HE43DCC25AD974AFFAF2C60348834CC23"><enum>(1)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="HDFCDCE46E195495BA5B46FF35C562887"><enum>(A)</enum><text>Whoever violates section
				922(g), previously having been convicted by any court of a violent felony or a
				serious drug offense—</text>
										<clause id="H697DF89997334C55AC1B3045D8586222" indent="up1"><enum>(i)</enum><text>if the person has 1 such prior
				conviction, and not more than 10 years has elapsed since the date of that prior
				conviction or the release of the person from imprisonment for that prior
				conviction, shall be imprisoned not more than 15 years, fined under this title,
				or both;</text>
										</clause><clause id="H9ABA7D28EC7E4E41B5D0B717EA25980" indent="up1"><enum>(ii)</enum><text>if the person has 2 such prior
				convictions, committed on occasions different from one another, of any
				combination of such crimes and not more than 10 years has elapsed since the
				date of either of the prior convictions or of the release of the person from
				imprisonment for either of the prior convictions, shall be imprisoned not more
				than 20 years, fined under this title, or both; or</text>
										</clause><clause id="HA027E6FA2D4F4913A357702EA7AFFEDF" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">if the person has 3 such prior convictions,
				committed on occasions different from one another, of any combination of such
				crimes, shall be imprisoned not less than 15 years and fined under this
				title.</text>
										</clause></subparagraph><subparagraph id="HCE9F692FF6C7463D84C17DE0D9C03EC5" indent="up2"><enum>(B)</enum><text>Notwithstanding any other provision
				of law, the court shall not suspend the sentence of, or grant a probationary
				sentence to, the person referred to in subparagraph (A) of this paragraph with
				respect to the conviction under section
				922(g).</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="HCEAAEC069E93421AAA9D95186B08F929"><enum>(b)</enum><header>Amendment to
			 sentencing guidelines</header><text>Pursuant to its authority under section
			 994(p) of title 28, United States Code, the United States Sentencing Commission
			 shall amend the Federal Sentencing Guidelines to provide for an appropriate
			 increase in the offense level for violations of <external-xref legal-doc="usc" parsable-cite="usc/18/922">section 922(g)</external-xref> of title 18,
			 United States Code, in accordance with section 924(e) of such title 18, as
			 amended by subsection (a) of this section.</text>
					</subsection><subsection commented="no" display-inline="no-display-inline" id="HE723A4B935DE41F7005F36995D2CCA53"><enum>(c)</enum><header>Conforming
			 amendment</header><text display-inline="yes-display-inline">Section 922(d) of
			 title 18, United States Code, is amended in the matter preceding paragraph (1)
			 by inserting <quote>, transfer,</quote> after <quote>sell</quote>.</text>
					</subsection></section></subtitle><subtitle id="H11DA693B85AC4C64A610FE50C0A097D4"><enum>C</enum><header>Crime
			 Data</header>
				<section id="H6E4D8738363F43C9A6B0DB239126634F"><enum>331.</enum><header>Standardization
			 of crime reporting and investigation</header>
					<subsection id="HFF968D40F6514589A09D8E62EF23B065"><enum>(a)</enum><header>Expanding
			 uniform crime reporting</header><text>Section 7332(c) of the Uniform Federal
			 Crime Reporting Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/28/534">28 U.S.C. 534</external-xref> note) is amended by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="H1788C5C13EF0435C84919B92F77B2835" style="OLC">
							<paragraph id="H94E3689C6187411D86A05E9D56C4DB27"><enum>(4)</enum><header>Juvenile
				crime</header><text>The Attorney General shall create a separate category in
				the Uniform Crime Reports to distinguish criminal offenses committed by
				juveniles.</text>
							</paragraph><paragraph id="H1830C6D6DB9F480494CC317E4936FD14"><enum>(5)</enum><header>Reporting by
				States and local governments</header>
								<subparagraph id="H4E4F38992C1843CB9991BF1269EA8B00"><enum>(A)</enum><header>In
				general</header><text>For each fiscal year beginning after the date of
				enactment of the <short-title>Fighting Gangs and
				Empowering Youth Act of 2007</short-title>, all departments and agencies within
				a State or unit of local government which routinely investigate complaints of
				criminal activity, shall meet the requirements of paragraph (2).</text>
								</subparagraph><subparagraph id="HFB15289030EB47F9BF00E302132B094C"><enum>(B)</enum><header>Ineligibility
				for funds</header><text display-inline="yes-display-inline">For any fiscal year
				beginning after the date of enactment of the <short-title>Fighting Gangs and Empowering Youth Act of
				2007</short-title>, a State or unit of local government that fails to comply
				with
				<internal-xref idref="H4E4F38992C1843CB9991BF1269EA8B00" legis-path="(5)(A)">subparagraph (A)</internal-xref> shall not be eligible to
				receive any of the funds that would otherwise be allocated for that fiscal year
				to the State or unit of local government under subtitle A of title II of such
				Act.</text>
								</subparagraph><subparagraph id="H6C3CC8925C484EFAB9E760E6FF2EE146"><enum>(C)</enum><header>Reallocation</header><text>Amounts
				not allocated to a State or unit of local government under the subtitle
				referred to in
				<internal-xref idref="HFB15289030EB47F9BF00E302132B094C" legis-path="(5)(B)">subparagraph (B)</internal-xref> for failure to fully
				comply with
				<internal-xref idref="H4E4F38992C1843CB9991BF1269EA8B00" legis-path="(5)(A)">subparagraph (A)</internal-xref> shall be reallocated under
				that subtitle to States and units of local government that have not failed to
				comply with such subparagraph.</text>
								</subparagraph><subparagraph id="HB29A6CDE838E4741BDA1C618B61F579B"><enum>(D)</enum><header>Waiver</header><text>The
				Attorney General shall waive the requirements of
				<internal-xref idref="H4E4F38992C1843CB9991BF1269EA8B00" legis-path="(5)(A)">subparagraph (A)</internal-xref> if compliance with such
				subparagraph by a State or unit of local government would be unconstitutional
				under the constitution of the applicable
				State.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection><subsection id="H8EF0835D264C47B494034B75E780F2C5"><enum>(b)</enum><header> National
			 strategy for investigation coordination</header><text display-inline="yes-display-inline">Section 7332 of the Uniform Federal Crime
			 Reporting Act of 1988 (<external-xref legal-doc="usc" parsable-cite="usc/28/534">28 U.S.C. 534</external-xref> note) is amended by adding at the end the
			 following:</text>
						<quoted-block id="H5313C7A21DB149FDBB9E69CE07A22551">
							<subsection id="HB5C73BED3ABD4CC99E005726D1BCE042"><enum>(h)</enum><header>National
				strategy for investigation coordination</header>
								<paragraph id="H3EA844D618F147D38678ADA95DDB6F30"><enum>(1)</enum><header>Coordination</header><text>The
				Attorney General shall develop a national strategy to coordinate, consolidate,
				and standardize all investigations by Federal law enforcement agencies of
				crimes that are included in the Uniform Crime Reports.</text>
								</paragraph><paragraph id="HF62B0A94D36A40B3BBADE72EAA85187D"><enum>(2)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than January 1, 2009, the
				Attorney General shall submit a report to the President and Congress—</text>
									<subparagraph id="H1A27EAE9D5A346ECB9C8F804BD04BDC"><enum>(A)</enum><text display-inline="yes-display-inline">outlining the strategy developed under
				paragraph (1); and</text>
									</subparagraph><subparagraph id="H5995C2BF45A0480E831B1F86641511D6"><enum>(B)</enum><text display-inline="yes-display-inline">describing the efforts and strategy of the
				Department of Justice in consolidating and standardizing data on all crimes
				that are included in the Uniform Crime
				Reports.</text>
									</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subsection></section><section id="HCB0416053D924A90BFC6513561AA359D"><enum>332.</enum><header>Consolidating
			 and standardizing gang-related crime data</header><text display-inline="no-display-inline">Section 150008 of the Violent Crime Control
			 and law Enforcement Act of 1994 (<external-xref legal-doc="usc" parsable-cite="usc/42/14062">42 U.S.C. 14062</external-xref>) is amended—</text>
					<paragraph id="H5D28A5DA37874B6CA7A7BB17C018BD56"><enum>(1)</enum><text>in subsection (a),
			 by inserting <quote>, consolidate, and standardize all</quote> after
			 <quote>strategy to coordinate</quote>;</text>
					</paragraph><paragraph id="H7085B60E0CFF4ECF8B3B61B73336D9B3"><enum>(2)</enum><text>in subsection (b),
			 by striking <quote>acquire and collect</quote> and inserting <quote>acquire,
			 collect, consolidate, and standardize all</quote>;</text>
					</paragraph><paragraph id="HA8D4C6A19E3A498098A067E994C6317"><enum>(3)</enum><text>by
			 amending subsection (c) to read as follows:</text>
						<quoted-block display-inline="no-display-inline" id="H44FA4567E5394D15A97BD8639368438E" style="OLC">
							<subsection id="H76BF3D1395F24DFD00452F4F7525CBA1"><enum>(c)</enum><header>Report</header><text>Not
				later than January 1, 2009, the Attorney General shall submit a report to the
				President and Congress—</text>
								<paragraph id="H0207266375DD4C148F64EAB46277ADF2"><enum>(1)</enum><text display-inline="yes-display-inline">outlining the strategy developed under
				subsection (a); and</text>
								</paragraph><paragraph id="H78D6B6AC9B2B4DC58CE279717E75C8D5"><enum>(2)</enum><text>describing the
				efforts and strategy of the Department of Justice in consolidating and
				standardizing data on national gang
				offenses.</text>
								</paragraph></subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</paragraph><paragraph id="HC7B6511F94534E8485AD80B4B2E90982"><enum>(4)</enum><text>in subsection (d),
			 by striking <quote>$1,000,000 for fiscal year 1996</quote> and inserting
			 <quote>$2,000,000 for fiscal year 2008</quote>.</text>
