		<official-title display="yes">To amend chapter 11 of title 18, United
		  States Code, to ensure United States attorneys are able to act impartially, and
		  for other purposes. </official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Furthering the Independence of Federal
			 Prosecutors Act of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="idD33D36514EF2442B94E51B0082BF1CB2" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="no-display-inline">The purpose of this Act is to ensure that
			 <quote>The United States Attorney is the representative not of an ordinary
			 party to a controversy, but of a sovereignty whose obligation to govern
			 impartially is as compelling as its obligation to govern at all</quote>, as
			 stated by the Supreme Court of the United States in Berger v. United States 295
			 U.S. 78, 88 (1935).</text>
		</section><section commented="no" display-inline="no-display-inline" id="id3E9120A34CDE45479562DE4895D2F528" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">United States attorneys</header>
			<subsection commented="no" display-inline="no-display-inline" id="id75E30B7ADB544DFCBC1AABF4791CCA70"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Chapter 11 of title 18, United States Code,
			 is amended by inserting after section 219 the following:</text>
				<quoted-block display-inline="no-display-inline" id="idD05C9C9E746B41358C7EA5368B2B9AA5" style="USC">
					<section commented="no" display-inline="no-display-inline" id="id3DA1B151B7AB49D8A89CF4EA37F18B03" section-type="subsequent-section"><enum>220.</enum><header display-inline="yes-display-inline">United States attorneys</header>
						<subsection commented="no" display-inline="no-display-inline" id="idA9AF0BFBABB346C08DE0CFD8D166EFEE"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">It shall be unlawful to intentionally
				coerce, pressure, or attempt to influence the decision of a United States
				attorney regarding whether to conduct a criminal investigation or pursue a
				prosecution of any person based on that person’s race, religion, sex, national
				origin, political activities, or political beliefs.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id566AE00D552B4471855F49F38938382B"><enum>(b)</enum><header display-inline="yes-display-inline">Penalty</header><text display-inline="yes-display-inline">Any person who violates subsection (a)
				shall be fined not more than $50,000, imprisoned for not more than 1 year, or
				both.</text>
						</subsection><subsection commented="no" display-inline="no-display-inline" id="id80AABF6E4B94419F8486F07490740817"><enum>(c)</enum><header display-inline="yes-display-inline">Enforcement</header>
							<paragraph commented="no" display-inline="no-display-inline" id="id063946511E3544E9A70D3810266D1807"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">This section may be enforced only by a
				special prosecutor appointed under paragraph (2).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDECA75DC787742018B50AE997F12BD0F"><enum>(2)</enum><header display-inline="yes-display-inline">Procedures</header><text display-inline="yes-display-inline">The Director of the Administrative Office
				of the United States Courts shall establish procedures that—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="idC83579C0818A4707AEDFACA743752FBA"><enum>(A)</enum><text display-inline="yes-display-inline">upon the request of a United States
				attorney, authorize a district court of the United States to appoint a United
				States attorney as a special prosecutor to investigate an alleged violation of
				this section and prosecute a violation of this section;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id65DB371D62C74BA987C2C20F665A44AF"><enum>(B)</enum><text display-inline="yes-display-inline">require that any United States attorney
				appointed under subparagraph (A) was not involved in any conduct relating to
				that alleged violation of this section; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id61A3DC5DF4644BBDB43434930F15372D"><enum>(C)</enum><text display-inline="yes-display-inline">provide for the oversight of an
				investigation or prosecution by a United States attorney appointed under
				subparagraph (A) by the district court making that
				appointment.</text>
								</subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id75863B6E6C9442B298B7CE6B097C26F4"><enum>(b)</enum><header display-inline="yes-display-inline">Technical and conforming
			 amendment</header><text display-inline="yes-display-inline">The table of
			 sections at the beginning of chapter 11 of title 18, United States Code, is
			 amended by inserting after the item relating to section 219 the
			 following:</text>

					</toc>
					<after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id7180FAA1920346F4A84104570F1973EC" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Initiating and declining charges;
			 impermissible considerations</header>
			<subsection commented="no" display-inline="no-display-inline" id="id1BBE6B55C39546849FCC00E34EDDB113"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In determining whether to commence or
			 recommend a prosecution or take other action against a person relating to a
			 criminal investigation or prosecution, an attorney for the Government shall not
			 consider—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID404ba53a54d04ed994519a4430c53c7b"><enum>(1)</enum><text display-inline="yes-display-inline">the race, religion, sex, national origin,
			 or political association, activities or beliefs of that person;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID27fb853479b44492af9132bc17d90edf"><enum>(2)</enum><text display-inline="yes-display-inline">the personal feelings of that attorney
			 concerning that person, associates of that person, or the victim; or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDc8855d9d70214fd48134d64303bdddfd"><enum>(3)</enum><text display-inline="yes-display-inline">the possible effect of the decision on the
			 professional or personal circumstances of that attorney.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9B375C9928AA4DE09583BAEE850A63E5"><enum>(b)</enum><header display-inline="yes-display-inline">Characteristics pertinent to
			 offense</header><text display-inline="yes-display-inline">If a characteristic
			 listed in subsection (a)(1) is pertinent to an offense, the attorney for the
			 Government may consider that characteristic for the purpose intended by the
			 Congress.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idF98542EE9D6F430D9E1B95674442E1B1"><enum>(c)</enum><header display-inline="yes-display-inline">Compliance</header><text display-inline="yes-display-inline">The Attorney General of the United States
			 shall ensure compliance with this section.</text>
