		<official-title display="yes">To amend the Energy Policy Act of 2005 to
		  reauthorize and improve the carbon capture and storage research, development,
		  and demonstration program of the Department of Energy and for other
		  purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Department of Energy Carbon Capture
			 and Storage Research, Development, and Demonstration Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID19fc23ef08774070a51af8c5314f03e8" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Carbon capture and storage research,
			 development, and demonstration program</header><text display-inline="no-display-inline">Section 963 of the Energy Policy Act of 2005
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/16293">42 U.S.C. 16293</external-xref>) is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idB2AA4D84BAF6409E8CACE10AA9475BAC"><enum>(1)</enum><text display-inline="yes-display-inline">in the section heading, by striking
			 <quote><header-in-text level="section" style="OLC">research and
			 development</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">and storage research, development, and
			 demonstration</header-in-text></quote>;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDb9c4e86cf3cc410c80d9c776acd061f2"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID67aa02fd7e8d4900a5389787c70a34dc"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>research and
			 development</quote> and inserting <quote>and storage research, development, and
			 demonstration</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0e2cdb966659456ea720425c48688901"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>capture technologies on
			 combustion-based systems</quote> and inserting <quote>capture and storage
			 technologies related to energy systems</quote>;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4657ca31d56b478b8de26db6303b5c9b"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (b)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDd916737898994ef1843653df93790ab6"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking
			 <quote>and</quote> at the end;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDadf6111cb1a44f21bed501918e461a4d"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (4), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDc49dc04afd2349c2b9403aab4c540eb9"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="id5231B10A946F4C6EA2AAC8C87A3D9B09" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="ID7dce52fee424477998c5020cf128f2af"><enum>(5)</enum><text display-inline="yes-display-inline">to expedite and carry out large-scale
				testing of carbon sequestration systems in a range of geological formations
				that will provide information on the cost and feasibility of deployment of
				sequestration technologies.</text>
						</paragraph><after-quoted-block>; and
				</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID22f9bc9306b14015ba6172dee869dc5d"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsection (c) and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id0D6C610B8A764CD4B91F72D853FAD7B1" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID40629bc393a048398aa7c8f2246cb73b"><enum>(c)</enum><header display-inline="yes-display-inline">Programmatic activities</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID4617adcce6e6451ba175fac0c8e69105"><enum>(1)</enum><header display-inline="yes-display-inline">Energy research and development underlying
				carbon capture and storage technologies</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID8e98de85d0824cdeb597fb9643db78e6"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall carry out fundamental
				science and engineering research (including laboratory-scale experiments,
				numeric modeling, and simulations) to develop and document the performance of
				new approaches to capture and store carbon dioxide.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDdb60dc1bfef8437f98c9596231528339"><enum>(B)</enum><header display-inline="yes-display-inline">Program integration</header><text display-inline="yes-display-inline">The Secretary shall ensure that fundamental
				research carried out under this paragraph is appropriately applied to energy
				technology development activities and the field testing of carbon sequestration
				activities, including—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDa006e52f685e4653ae886ea2e8eb04e5"><enum>(i)</enum><text display-inline="yes-display-inline">development of new or improved technologies
				for the capture of carbon dioxide;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID573f0db646c542a68bce9fa57c2cef83"><enum>(ii)</enum><text display-inline="yes-display-inline">modeling and simulation of geological
				sequestration field demonstrations; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID029aa294c67d4963b8c7d0cae70c0aac"><enum>(iii)</enum><text display-inline="yes-display-inline">quantitative assessment of risks relating
				to specific field sites for testing of sequestration technologies.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID24e33f5e574e49abafe5d5f11fcb91a4"><enum>(2)</enum><header display-inline="yes-display-inline">Field validation testing
				activities</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDbd382b65720249b9a936e014d96b016a"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall promote, to the maximum
				extent practicable, regional carbon sequestration partnerships to conduct
				geologic sequestration tests involving carbon dioxide injection and monitoring,
				mitigation, and verification operations in a variety of candidate geological
				settings, including—</text>
								<clause commented="no" display-inline="no-display-inline" id="ID07c1f2fdbf5e412abd7c2a260daf32ab"><enum>(i)</enum><text display-inline="yes-display-inline">operating oil and gas fields;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID95be4aa186574478ad4f6b0cd977f197"><enum>(ii)</enum><text display-inline="yes-display-inline">depleted oil and gas fields;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDbe3b85158e3d4438a6751c75cbb4a5c3"><enum>(iii)</enum><text display-inline="yes-display-inline">unmineable coal seams;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDa4a3fdf4ebd94d4fba3b73899e0c42bb"><enum>(iv)</enum><text display-inline="yes-display-inline">saline formations; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID9691cca9a82a4587989a8e4857cbe098"><enum>(v)</enum><text display-inline="yes-display-inline">deep geologic systems that may be used as
				engineered reservoirs to extract economical quantities of heat from geothermal
				resources of low permeability or porosity.</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID822175e8edde4912ab2861276475d679"><enum>(B)</enum><header display-inline="yes-display-inline">Objectives</header><text display-inline="yes-display-inline">The objectives of tests conducted under
				this paragraph shall be—</text>
								<clause commented="no" display-inline="no-display-inline" id="IDf83a46df42fd4d70bf8757e048c8bc9d"><enum>(i)</enum><text display-inline="yes-display-inline">to develop and validate geophysical tools,
				analysis, and modeling to monitor, predict, and verify carbon dioxide
				containment;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID168a54fb6b2647a399deea109a0148d5"><enum>(ii)</enum><text display-inline="yes-display-inline">to validate modeling of geological
				formations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID25797f8107bc43cd8a3b6a4d1846655c"><enum>(iii)</enum><text display-inline="yes-display-inline">to refine storage capacity estimated for
				particular geological formations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID1a6281208aa8416a9e16bc61fd959bad"><enum>(iv)</enum><text display-inline="yes-display-inline">to determine the fate of carbon dioxide
				concurrent with and following injection into geological formations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDc8b41ac197fa450ebddaa04e5a17fe2d"><enum>(v)</enum><text display-inline="yes-display-inline">to develop and implement best practices for
				operations relating to, and monitoring of, injection and storage of carbon
				dioxide in geologic formations;</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDed03db2f19ab4147a6c2b4aaedfc403a"><enum>(vi)</enum><text display-inline="yes-display-inline">to assess and ensure the safety of
				operations related to geological storage of carbon dioxide; and</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="idF41BD637FA5541DD9C947FF01B8FFD20"><enum>(vii)</enum><text display-inline="yes-display-inline">to allow the Secretary to promulgate
				policies, procedures, requirements, and guidance to ensure that the objectives
				of this subparagraph are met in large-scale testing and deployment activities
				for carbon capture and storage that are funded by the Department of
				Energy.</text>
								</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa62acaa5d1f94a14b21c0db205568ce8"><enum>(3)</enum><header display-inline="yes-display-inline">Large-scale testing and deployment</header>
							<subparagraph commented="no" display-inline="no-display-inline" id="IDd0d5a9afb3e840e490784faf4d4254d0"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall conduct not less than 7
				initial large-volume sequestration tests for geological containment of carbon
				dioxide (at least 1 of which shall be international in scope) to validate
				information on the cost and feasibility of commercial deployment of
				technologies for geological containment of carbon dioxide.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1dcbe2294c8f427092525c411af5bb41"><enum>(B)</enum><header display-inline="yes-display-inline">Diversity of formations to be
				studied</header><text display-inline="yes-display-inline">In selecting
				formations for study under this paragraph, the Secretary shall consider a
				variety of geological formations across the United States, and require
				characterization and modeling of candidate formations, as determined by the
				Secretary.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3b5bad78f43f4df09e9b123eea03eb59"><enum>(4)</enum><header display-inline="yes-display-inline">Preference in project selection from
				meritorious proposals</header><text display-inline="yes-display-inline">In
				making competitive awards under this subsection, subject to the requirements of
				section 989, the Secretary shall give preference to proposals from partnerships
				among industrial, academic, and government entities.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id852D0ACA908E416E92129F4C5F0175F9"><enum>(5)</enum><header display-inline="yes-display-inline">Cost sharing</header><text display-inline="yes-display-inline">Activities under this subsection shall be
				considered research and development activities that are subject to the
				cost-sharing requirements of section 988(b).</text>
						</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9efa10ba4aba422c97daa244c28e933a"><enum>(d)</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="yes-display-inline">There are
				authorized to be appropriated to carry out this section—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="ID4180de04291d4f789ff996ac44db7030"><enum>(1)</enum><text display-inline="yes-display-inline">$90,000,000 for fiscal year 2007;</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd5e3752fc5d04f38843b13ecc90e958c"><enum>(2)</enum><text display-inline="yes-display-inline">$105,000,000 for fiscal year 2008;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID981b76cb08ea4b6ebc2a7ddb2a2a1bed"><enum>(3)</enum><text display-inline="yes-display-inline">$120,000,000 for fiscal year
				2009.</text>
