		<official-title display="yes">To amend title 46, United States Code, to
		  provide benefits to certain individuals who served in the United States
		  merchant marine (including the Army Transport Service and the Naval Transport
		  Service) during World War II, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H4F2C4741595947F488453980BEDCA695" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Belated Thank You to the Merchant
			 Mariners of World War II Act of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="HD4616692C1A143759BF698F7E2DF5FBB" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Monthly benefit for World War II merchant
			 mariners and survivors under title 46, United States Code</header>
			<subsection commented="no" display-inline="no-display-inline" id="H7982A51280124FAFBB3FB99E00145B84"><enum>(a)</enum><header display-inline="yes-display-inline">Monthly benefit</header><text display-inline="yes-display-inline"><external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">Chapter 112</external-xref> of title 46,
			 United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HB553DAE92E8345518B28B77074EC874B"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting after the table of sections
			 the following new subchapter heading:</text>
					<quoted-block display-inline="no-display-inline" id="H956D539C0BA349CCB8B4A1EFB3CB6C73" style="USC">
						<subchapter commented="no" id="HDACF24CC430E425B83A6C975AEB4866" level-type="subsequent"><enum>I</enum><header display-inline="yes-display-inline">Burial and cemetery benefits for
				veterans</header>
						</subchapter><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><continuation-text commented="no" continuation-text-level="subsection">and</continuation-text><paragraph commented="no" display-inline="no-display-inline" id="H39495FDD8D88476D84346BD0383550B2"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 subchapter:</text>
					<quoted-block display-inline="no-display-inline" id="H659C4ED53BF843C4AA37339C30E13920" style="USC">
						<subchapter commented="no" id="HCFA1E9A074C845FE900743C07D96BED" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Monthly benefit</header>
							<section commented="no" display-inline="no-display-inline" id="HDBFCAB23781F415C8EF34D41C977D61" section-type="subsequent-section"><enum>11211.</enum><header display-inline="yes-display-inline">Monthly benefit</header>
								<subsection commented="no" display-inline="no-display-inline" id="HB3C2BE8023B14DD200D3BDBA2CDF7685"><enum>(a)</enum><header display-inline="yes-display-inline">Payment</header><text display-inline="yes-display-inline">The Secretary of Veterans Affairs shall pay
				to each individual issued a certificate of honorable service pursuant to
				section 11213(b) of this title a monthly benefit of $1,000.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H59B6946F85794FAA8B4F11DFA2214D9D"><enum>(b)</enum><header display-inline="yes-display-inline">Surviving spouses</header>
									<paragraph commented="no" display-inline="no-display-inline" id="H6312DCD5923A472C97155D395C571D14"><enum>(1)</enum><header display-inline="yes-display-inline">Payment to surviving spouses</header><text display-inline="yes-display-inline">Subject to paragraph (2), the Secretary of
				Veterans Affairs shall pay to the surviving spouse of each individual issued a
				certificate of honorable service pursuant to section 11213(b) of this title a
				monthly benefit of $1,000.</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF601C87BE1324BA6BF970043AA3CA010"><enum>(2)</enum><header display-inline="yes-display-inline">Exclusion</header><text display-inline="yes-display-inline">No benefit shall be paid under paragraph
				(1) to a surviving spouse of an individual issued a certificate of honorable
				service pursuant to section 11213(b) unless the surviving spouse was married to
				such individual for not less than one year.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idE5741E8072C04053886F9A9B061D987D"><enum>(c)</enum><header display-inline="yes-display-inline">Retroactive eligibility for
				benefits</header><text display-inline="yes-display-inline">The Secretary of
				Veterans Affairs shall pay—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="id84AC9ADC8D584E87A06B331D19E941D4"><enum>(1)</enum><text display-inline="yes-display-inline">to each individual issued a certificate of
				honorable service under to section 11213(b) of this title the monthly benefit
				described in subsection (a) as if such individual had received such certificate
				of honorable service on the date of the enactment of the
				<short-title>Belated Thank You to the Merchant Mariners of
				World War II Act of 2007</short-title>; and</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id5AA8A5717B4E46F98D976B4EDA286BC8"><enum>(2)</enum><text display-inline="yes-display-inline">to each surviving spouse issued a
				certificate of honorable service on behalf of a deceased individual under
				section 11213(e) of this title the monthly benefit described in subsection
				(b)(1) as if such surviving spouse had received such certificate of honorable
				service on the date of the enactment of <short-title>Belated Thank You to the Merchant Mariners of World War II
				Act of 2007</short-title>.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H091B37547D51489ABFED770070B9FCAA"><enum>(d)</enum><header display-inline="yes-display-inline">Exemption from taxation</header><text display-inline="yes-display-inline">Payments of benefits under this section are
				exempt from taxation as provided in
				section
				5301(a) of title 38.</text>
								</subsection></section><section commented="no" display-inline="no-display-inline" id="H27F358095BD94642B522E86DB3BC6CE2" section-type="subsequent-section"><enum>11212.</enum><header display-inline="yes-display-inline">Qualified service</header><text display-inline="no-display-inline">For purposes of this subchapter, an
				individual shall be considered to have engaged in qualified service if, between
				December 7, 1941 and December 31, 1946, the individual—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="HE2664D39E75C44DB9B00C64CDE50A6AB"><enum>(1)</enum><text display-inline="yes-display-inline">was a member of the United States merchant
				marine (including the Army Transport Service and the Naval Transport Service)
				serving as a crewmember of a vessel that was—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="H62C558A3BE0A4FDEA50495F2DC96F56"><enum>(A)</enum><text display-inline="yes-display-inline">operated by the War Shipping Administration
				or the Office of Defense Transportation (or an agent of such Administration or
				Office);</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H5EDC803AEB764E8DAF810072AA5EDA4C"><enum>(B)</enum><text display-inline="yes-display-inline">operated in waters other than—</text>
										<clause commented="no" display-inline="no-display-inline" id="HE11908CB33724BCCA0858B00A900BD20"><enum>(i)</enum><text display-inline="yes-display-inline">inland waters;</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="H450B62A40FD045CFBF4D9993E6B4B6BD"><enum>(ii)</enum><text display-inline="yes-display-inline">the Great Lakes; and</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="HF56808D83670403DB8FBB32C44B405A2"><enum>(iii)</enum><text display-inline="yes-display-inline">other lakes, bays, and harbors of the
				United States;</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H93F8AF98E0904316A4E37423C45D994F"><enum>(C)</enum><text display-inline="yes-display-inline">under contract or charter to, or property
				of, the Government of the United States; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="HD055FCFC2DF74A248D2190BCD09E2BFF"><enum>(D)</enum><text display-inline="yes-display-inline">serving the Armed Forces; and</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HDA002C0D735646A600A518775C4A6D5"><enum>(2)</enum><text display-inline="yes-display-inline">while serving as described in paragraph
				(1), was licensed or otherwise documented for service as a crewmember of such a
				vessel by an officer or employee of the United States authorized to license or
				document the person for such service.</text>
								</paragraph></section><section commented="no" display-inline="no-display-inline" id="HC7152A6B443540F089EA462B6C1C0E" section-type="subsequent-section"><enum>11213.</enum><header display-inline="yes-display-inline">Certificate of honorable service</header>
								<subsection commented="no" display-inline="no-display-inline" id="HB2001D3DB3984935980016E105DD27F6"><enum>(a)</enum><header display-inline="yes-display-inline">Application for service
				certificate</header><text display-inline="yes-display-inline">An individual
				seeking benefits under section 11211 of this title shall submit an application
				for a certificate of honorable service—</text>
									<paragraph commented="no" display-inline="no-display-inline" id="idA0E20BB93BDB472C8B66E216934F7FA7"><enum>(1)</enum><text display-inline="yes-display-inline">to the Secretary of Transportation;
				or</text>
									</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE1B259372A274EE19B2CEE0000B3569C"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an individual who was a
				member of the Army Transport Service or the Naval Transport Service, to the
				Secretary of Defense.</text>
									</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H1C2753A02AF94C709FDA29C9B9F166CB"><enum>(b)</enum><header display-inline="yes-display-inline">Issuance of service
				certificate</header><text display-inline="yes-display-inline">The Secretary who
				receives an application under subsection (a) shall issue a certificate of
				honorable service to the applicant if, as determined by that Secretary, the
				individual engaged in qualified service described in section 11212 of this
				title and meets the standards referred to in subsection (d) of this
				section.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="HDDBF0F96DA4042B485E31EDB4D0000"><enum>(c)</enum><header display-inline="yes-display-inline">Timing for certification</header><text display-inline="yes-display-inline">A Secretary receiving an application under
				subsection (a) shall act on the application not later than one year after the
				date of that receipt.</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H26293232458F4D558400C76797E5A739"><enum>(d)</enum><header display-inline="yes-display-inline">Standards relating to service</header><text display-inline="yes-display-inline">In making a determination under subsection
				(b), the Secretary acting on the application shall apply the same standards
				relating to the nature and duration of service that apply to the issuance of a
				discharge from service under honorable conditions under section 401(a)(1)(B) of
				the GI Bill Improvement Act of 1977 (<external-xref legal-doc="public-law" parsable-cite="pl/95/202">Public Law 95–202</external-xref>; 38 U.S.C. 106
				note).</text>
								</subsection><subsection commented="no" display-inline="no-display-inline" id="H3B4ADCA4E56F4AC59E1F3535E33568AF"><enum>(e)</enum><header display-inline="yes-display-inline">Surviving spouses</header><text display-inline="yes-display-inline">The surviving spouse of a deceased
				individual who engaged in qualifying service described in section 11212 may
				submit an application for a certificate of honorable service under subsection
				(a) and be issued such a certificate on behalf of such individual under
				subsection (b) for the purpose of receiving benefits under section 11211(b) of
				this title.</text>
								</subsection></section><section commented="no" display-inline="no-display-inline" id="H2D5D2ED919EA4E8BA25986655B93496E" section-type="subsequent-section"><enum>11214.</enum><header display-inline="yes-display-inline">Surviving spouse defined</header><text display-inline="no-display-inline">In this subchapter, the term <term>surviving
				spouse</term> has the meaning given such term in
				section
				101 of title 38, except that in applying the meaning in this
				subchapter, the term <term>veteran</term> means an individual who performed
				qualified service described in section 11212 of this title.</text>
							</section><section commented="no" display-inline="no-display-inline" id="HE4D12B969A68489900E8008613305B1D" section-type="subsequent-section"><enum>11215.</enum><header display-inline="yes-display-inline">Authorization of
				appropriations</header><text display-inline="no-display-inline">There are
				authorized to be appropriated to the Secretary of Veterans Affairs such sums as
				may be necessary for the purpose of carrying out this
				subchapter.</text>
							</section></subchapter><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H212D8E2644B841F2B83EF485E3C6B00"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Subsection (c) of
			 section
			 11201 of title 46, United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H01AC9E8E19D94BCA00077900EE97F984"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (1), by striking
			 <quote>chapter</quote> and inserting <quote>subchapter</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4E3C6549D61F4158A000E13C552FAA1B"><enum>(2)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>this
			 chapter</quote> both places it appears and inserting <quote>this
			 subchapter</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HF199B16170754B1FA6189DA321B27946"><enum>(c)</enum><header display-inline="yes-display-inline">Clerical amendments</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 <external-xref legal-doc="usc-chapter" parsable-cite="usc-chapter/46/112">chapter 112</external-xref> of title 46,
			 United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H2B3EB9595EF84F428C6C7B15FB17D800"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting at the beginning the following
			 new item:</text>
