		<section id="idFBF0047940AD44C5B5B16961E8D8DF92" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>College Textbook Affordability Act of
			 2007</short-title></quote>.</text>
		</section><section id="id17D510AAD84C4E4AA6F38E4865C0D2F4"><enum>2.</enum><header>Purpose and
			 intent</header><text display-inline="no-display-inline">The purpose of this Act
			 is to ensure that every student in higher education is offered better and more
			 timely access to affordable course materials by educating and informing
			 faculty, students, administrators, institutions of higher education,
			 bookstores, and publishers on all aspects of the selection, purchase, sale, and
			 use of the course materials. It is the intent of this Act to have all involved
			 parties work together to identify ways to decrease the cost of college
			 textbooks and supplemental materials for students while protecting the academic
			 freedom of faculty members to provide high quality course materials for
			 students.</text>
		</section><section id="id5B183EA49236446EBD5C64AD33A097DB" section-type="subsequent-section"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="idD1827A91D4B24920956F54213C9ED6B9"><enum>(1)</enum><header>College
			 textbook</header><text>The term <term>college textbook</term> means a textbook,
			 or a set of textbooks, used for a course in postsecondary education at an
			 institution of higher education.</text>
			</paragraph><paragraph id="id35963A552C604FEAA49E200F25AD4993"><enum>(2)</enum><header>Course
			 schedule</header><text>The term <term>course schedule</term> means a listing of
			 the courses or classes offered by an institution of higher education for an
			 academic period.</text>
			</paragraph><paragraph id="id60FF0869A2914DD48F9A41C91BDE74C1"><enum>(3)</enum><header>Institution of
			 higher education</header><text>The term <term>institution of higher
			 education</term> has the meaning given the term in section 102 of the Higher
			 Education Act of 1965 (20 U.S.C. 1002).</text>
			</paragraph><paragraph id="idA50429E245B344E29F4B00CFD73E0E74"><enum>(4)</enum><header>Publisher</header><text>The
			 term <term>publisher</term> means a publisher of college textbooks or
			 supplemental materials involved in or affecting interstate commerce.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD23FDB24439D4DD5A273C16DE329DFCC"><enum>(5)</enum><header>Supplemental
			 material</header><text>The term <term>supplemental material</term> means
			 educational material published or produced to accompany a college
			 textbook.</text>
			</paragraph></section><section id="id8F9E0A7AD6C343F587C2EBCBE62BBC88" section-type="subsequent-section"><enum>4.</enum><header>Publisher
			 requirements</header>
			<subsection id="id03985E082C4F42FBA71A771F8B6C2234"><enum>(a)</enum><header>College
			 textbook pricing information</header><text display-inline="yes-display-inline">When a publisher provides a faculty member
			 of an institution of higher education with information regarding a college
			 textbook or supplemental material available in the subject area in which the
			 faculty member teaches, the publisher shall include, with any such information
			 and in writing, the following:</text>
				<paragraph id="id77B0EAE6A6854353A17981B7E65FC175"><enum>(1)</enum><text display-inline="yes-display-inline">The price at which the publisher would make
			 the college textbook or supplemental material available to the bookstore on the
			 campus of, or otherwise associated with, such institution of higher
			 education.</text>
				</paragraph><paragraph id="idC97973342399400EA7BD2787FB47500B"><enum>(2)</enum><text display-inline="yes-display-inline">Any history of revisions for the college
			 textbook or supplemental material.</text>
				</paragraph><paragraph id="id699A430665C54FE38D219F3D9050B52C"><enum>(3)</enum><text>Whether the
			 college textbook or supplemental material is available in any other format,
			 including paperback and unbound, and the price at which the publisher would
			 make the college textbook or supplemental material in the other format
			 available to the bookstore on the campus of, or otherwise associated with, such
			 institution of higher education.</text>
				</paragraph></subsection><subsection id="id9D455416DC2C4A6CB634A428589AD9CE"><enum>(b)</enum><header>Unbundling of
			 supplemental materials</header><text display-inline="yes-display-inline">A
			 publisher that sells a college textbook and any supplemental material
			 accompanying such college textbook as a single bundled item shall also sell the
			 college textbook and each supplemental material as separate and unbundled
			 items.</text>
			</subsection></section><section id="id78194D978343409F9B7681B6549C01C8"><enum>5.</enum><header>Provision of
			 ISBN college textbook information in course schedules</header>
			<subsection id="id2CE3D7D698944295A9AAC0CBE3C768D7"><enum>(a)</enum><header>Internet course
			 schedules</header><text display-inline="yes-display-inline">Each institution of
			 higher education that receives Federal assistance and that publishes the
			 institution's course schedule for the subsequent academic period on the
			 Internet shall—</text>
				<paragraph id="idE669B01CB6E14B71BA2738ED95D31392"><enum>(1)</enum><text display-inline="yes-display-inline">include, in the course schedule, the
			 International Standard Book Number (ISBN) and the retail price for each college
			 textbook or supplemental material required or recommended for a course or class
			 listed on the course schedule that has been assigned such a number; and</text>
				</paragraph><paragraph id="id63A15BD65768436487E4E2B5F94DF5A0"><enum>(2)</enum><text>update the
			 information required under paragraph (1) as necessary.</text>
				</paragraph></subsection><subsection id="idEB8EAF21F0F94F8ABD5E2DA3DE65BDC3"><enum>(b)</enum><header>Written course
			 schedules</header><text>In the case of an institution of higher education that
			 receives Federal assistance and that does not publish the institution's course
			 schedule for the subsequent academic period on the Internet, the institution of
			 higher education shall include the information required under subsection (a)(1)
			 in any printed version of the institution's course schedule and shall provide
			 students with updates to such information as necessary.</text>
			</subsection></section><section id="idD99F40A41C054A42B90109E1BE9D3D09"><enum>6.</enum><header>Availability of
			 information for college textbook sellers</header><text display-inline="no-display-inline">An institution of higher education that
			 receives Federal assistance shall make available, as soon as is practicable,
			 upon the request of any seller of college textbooks (other than a publisher)
			 that meets the requirements established by the institution, the most accurate
			 information available regarding—</text>
			<paragraph id="id7FB3A92673C94B80BEE23F4D281EE34C"><enum>(1)</enum><text>the institution's
			 course schedule for the subsequent academic period; and</text>
			</paragraph><paragraph id="idDBC17777431540D1A7B17153D47DE769"><enum>(2)</enum><text>for each course
			 or class offered by the institution for the subsequent academic period—</text>
				<subparagraph id="id8BBA0C6D77A44ADFA19E9AB662C45387"><enum>(A)</enum><text>the International
			 Standard Book Number (ISBN) for each college textbook or supplemental material
			 required or recommended for such course or class that has been assigned such a
			 number;</text>
				</subparagraph><subparagraph id="idE2A34FD720714AFFABC73ED38C692B2E"><enum>(B)</enum><text>the number of
			 students enrolled in such course or class; and</text>
				</subparagraph><subparagraph id="id45B625BD80554532B4F28873DA17605A"><enum>(C)</enum><text>the maximum
			 student enrollment for such course or class.</text>
				</subparagraph></paragraph></section></legis-body>
