					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD32D4B6FC6BB4B84A14933165778C972"><enum>(b)</enum><header display-inline="yes-display-inline">Discretion of Student Financial Aid
			 Administrators</header><text display-inline="yes-display-inline">Section
			 479A(a) of the <act-name parsable-cite="HEA65">Higher Education Act of
			 1965</act-name> (20 U.S.C. 1087tt(a)) is amended in the third sentence by
			 inserting <quote>a family member who is a dislocated worker (as defined in
			 section 101 of the Workforce Investment Act of 1998 (29 U.S.C. 2801)),</quote>
			 after <quote>recent unemployment of a family member,</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2E2DB885710C4207B23A9487D8E392CA"><enum>(c)</enum><header display-inline="yes-display-inline">Reporting Requirements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF154263099D64752861DECD8456E6F75"><enum>(1)</enum><header display-inline="yes-display-inline">Eligibility guidelines</header><text display-inline="yes-display-inline">The Secretary of Education shall regularly
			 evaluate the impact of the eligibility guidelines in subsections (b)(1)(A)(i),
			 (b)(1)(B)(i), (c)(1)(A), and (c)(2)(A) of section 479 of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087ss(b)(1)(A)(i), (b)(1)(B)(i), (c)(1)(A), and (c)(2)(A)).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2067A74014FB4613B9C9F01A15EFAF1A"><enum>(2)</enum><header display-inline="yes-display-inline">Means-tested federal benefit
			 program</header><text display-inline="yes-display-inline">The Secretary shall
			 evaluate every 3 years the impact of including whether a student or parent
			 received benefits under a means-tested Federal benefit program (as defined in
			 section 479(d) of the <act-name parsable-cite="HEA65">Higher Education Act of
			 1965</act-name> (20 U.S.C. 1087ss(d)) as a factor in determining eligibility
			 under subsections (b) and (c) of section 479 of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087ss(b) and (c)).</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID0C0A10FE0DCA4C889A140A68FE7DB141" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Improving paper and electronic
			 forms</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDBF8FE47EB0C4486BAD2EB0FD6474ACED"><enum>(a)</enum><header display-inline="yes-display-inline">Simplified Needs Test</header><text display-inline="yes-display-inline">Section 479(a) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087ss(a)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID8884155FCEF244809125B7017EFF33CB" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDEA42492D49D949A69D69C6D4013DB48C"><enum>(3)</enum><header display-inline="yes-display-inline">Simplified forms</header><text display-inline="yes-display-inline">The Secretary shall make special efforts to
				notify families meeting the requirements of subsection (c) that such families
				may use the EZ FAFSA described in section 483(a)(2)(B) and notify families
				meeting the requirements of subsection (b) that such families may use the
				simplified electronic application form described in section
				483(a)(3)(B).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDFCCFC1116A1E4C279F4C0772F6240388"><enum>(b)</enum><header display-inline="yes-display-inline">Common Financial Aid Form Development and
			 Processing</header><text display-inline="yes-display-inline">Section 483 of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1090) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5C510B62CD6346CF95A59D7206837E35"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDAFB9F457DDD145D79F823605199C1155"><enum>(A)</enum><text display-inline="yes-display-inline">by striking paragraphs (1), (2), and
			 (5);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5850222AC8741889A2EB426D02741FC"><enum>(B)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (3), (4), (6),
			 and (7), as paragraphs (8), (9), (10), and (11), respectively;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4E3D09C538BD4C53BCB08E9AFFF84B90"><enum>(C)</enum><text display-inline="yes-display-inline">by inserting before paragraph (8), as
			 redesignated by subparagraph (B), the following:</text>

							<paragraph commented="no" display-inline="no-display-inline" id="ID4B0A71D6BE694B4388C594544EF1FE6A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID39C049B9AD14485595AC7AA47ED040FE"><enum>(A)</enum><header display-inline="yes-display-inline">Common financial reporting
				forms</header><text display-inline="yes-display-inline">The Secretary, in
				cooperation with representatives of agencies and organizations involved in
				student financial assistance, shall produce, distribute, and process free of
				charge common financial reporting forms as described in this subsection to be
				used for application and reapplication to determine the need and eligibility of
				a student for financial assistance under parts A through E (other than subpart
				4 of part A). These forms shall be made available to applicants in both paper
				and electronic formats and shall be referred to (except as otherwise provided
				in this subsection) as the <quote>Free Application for Federal Student
				Aid</quote> or <quote>FAFSA</quote>.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFD4FAA802EBD4C85942102670F49CFC4"><enum>(B)</enum><header display-inline="yes-display-inline">Early
				analysis</header><text display-inline="yes-display-inline">The Secretary shall
				permit an applicant to complete a form described in this subsection prior to
				enrollment in order to obtain an estimate from the Secretary of the applicant’s
				expected family contribution. Such applicant shall be permitted to update the
				information contained on a form submitted pursuant to the preceding sentence,
				using the process described in paragraph (4), for purposes of applying for
				assistance under this title for the first academic year for which the applicant
				applies for financial assistance under this title.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98AB013D9C2341AFA149E8FF0778286D"><enum>(2)</enum><header display-inline="yes-display-inline">Paper format</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID64D63295017245BFA77E8995C881AD04"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to subparagraph (C), the Secretary
				shall produce, distribute, and process common forms in paper format to meet the
				requirements of paragraph (1). The Secretary shall develop a common paper form
				for applicants who do not meet the requirements of section 479(c).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE8FA5CE7E5E94858851770AA6216A64B"><enum>(B)</enum><header display-inline="yes-display-inline">EZ FAFSA</header>
									<clause commented="no" display-inline="no-display-inline" id="ID2C930175424347F980DAF78BC5358FB1"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop and use a
				simplified paper application form, to be known as the <quote>EZ FAFSA</quote>,
				to be used for applicants meeting the requirements of section 479(c).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDC970009DE3474ECBA32DA38DA03B9821"><enum>(ii)</enum><header display-inline="yes-display-inline">Reduced data requirements</header><text display-inline="yes-display-inline">The EZ FAFSA shall permit an applicant to
				submit for financial assistance purposes, only the data elements required to
				make a determination of whether the applicant meets the requirements under
				section 479(c).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDE6C710DC9EEF48CBA90C738FCC651489"><enum>(iii)</enum><header display-inline="yes-display-inline">State data</header><text display-inline="yes-display-inline">The Secretary shall include on the EZ FAFSA
				space for information that is required of an applicant to be eligible for State
				financial assistance, as provided under paragraph (5), except the Secretary
				shall not include a State’s data if that State does not permit its applicants
				for State assistance to use the EZ FAFSA.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID28163E908A92419983EC7191CF2D642A"><enum>(iv)</enum><header display-inline="yes-display-inline">Free availability and
				processing</header><text display-inline="yes-display-inline">The provisions of
				paragraph (6) shall apply to the EZ FAFSA, and the data collected by means of
				the EZ FAFSA shall be available to institutions of higher education, guaranty
				agencies, and States in accordance with paragraph (8).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID94F05AF6EAD04703A2B246972FDA2245"><enum>(v)</enum><header display-inline="yes-display-inline">Testing</header><text display-inline="yes-display-inline">The Secretary shall conduct appropriate
				field testing on the EZ FAFSA.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4572770A46E74EE2A7A4A2AD711D57D2"><enum>(C)</enum><header display-inline="yes-display-inline">Phasing out the paper form for students who
				do not meet the requirements of the automatic zero expected family
				contribution</header>
									<clause commented="no" display-inline="no-display-inline" id="IDC6E01B8D0B7545809A03121779A3B001"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall make all efforts to
				encourage all applicants to utilize the electronic forms described in paragraph
				(3).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID3A6E4D4F4E0B49DC94CC7847238F274D"><enum>(ii)</enum><header display-inline="yes-display-inline">Phaseout of full paper fafsa</header><text display-inline="yes-display-inline">Not later than 5 years after the date of
				enactment of the Financial Aid Form Simplification and Access Act, to the
				extent practicable, the Secretary shall phaseout the printing of the full paper
				Free Application for Federal Student Aid described in subparagraph (A) and used
				by applicants who do not meet the requirements of the EZ FAFSA described in
				subparagraph (B).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDB9670B3D0DED426B916EBFC5F715F839"><enum>(iii)</enum><header display-inline="yes-display-inline">Availability of full paper fafsa</header>
										<subclause commented="no" display-inline="no-display-inline" id="ID1F1A1C0F4BB840EFBA8CD194E1D4D555"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Prior to and after the phaseout described
				in clause (ii), the Secretary shall maintain an online printable version of the
				paper forms described in subparagraphs (A) and (B).</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDCE2608CE184540E79D8E755CB7124F28"><enum>(II)</enum><header display-inline="yes-display-inline">Accessibility</header><text display-inline="yes-display-inline">The online printable version described in
				subclause (I) shall be made easily accessible and downloadable to students on
				the same website used to provide students with the electronic application forms
				described in paragraph (3).</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDE9E3277796AD49ADB76F81BEF19931FF"><enum>(III)</enum><header display-inline="yes-display-inline">Submission of forms</header><text display-inline="yes-display-inline">The Secretary shall enable, to the extent
				practicable, students to submit a form described in this clause that is
				downloaded and printed in order to meet the filing requirements of this section
				and to receive aid from programs established under this title.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID9090DD5C38C4419DA22903970F39FEA3"><enum>(iv)</enum><header display-inline="yes-display-inline">Use of savings to address the digital
				divide</header>
										<subclause commented="no" display-inline="no-display-inline" id="ID7BA6146E5C4042859612FCA43B23E621"><enum>(I)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall utilize savings accrued
				by phasing out the full paper Free Application for Federal Student Aid and
				moving more applicants to the electronic forms, to improve access to the
				electronic forms for applicants meeting the requirements of section
				479(c).</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID3EFADE07926245FBA05D3DC6FA543237"><enum>(II)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall report annually to the
				Committee on Health, Education, Labor, and Pensions of the Senate and the
				Committee on Education and Labor of the House of Representatives on steps taken
				to eliminate the digital divide and on the phaseout of the full paper Free
				Application for Federal Student Aid described in subparagraph (A). The report
				shall specifically address the impact of the digital divide on independent
				students, adults, and dependent students, including students completing
				applications described in this paragraph and paragraphs (3) and (4).</text>
										</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB4CBC38CA3E4853B34C2240FF5FFE9D"><enum>(3)</enum><header display-inline="yes-display-inline">Electronic format</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID40C6D4C5E8A3477B98115554B869724F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header>
									<clause commented="no" display-inline="no-display-inline" id="ID295CE5B525024065850F50C29743F6BC"><enum>(i)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall produce, distribute,
				and process common financial reporting forms in electronic format (such as
				through a website called <quote>FAFSA on the Web</quote>) to meet the
				requirements of paragraph (1). The Secretary shall include an electronic
				version of the EZ FAFSA form for applicants who meet the requirements of
				section 479(c) and develop common electronic forms for applicants who meet the
				requirements of section 479(b) and common electronic forms for applicants who
				do not meet the requirements of section 479(b).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDC8C4DD4D935740E6A6AA95B1AF3FBDBD"><enum>(ii)</enum><header display-inline="yes-display-inline">State data</header><text display-inline="yes-display-inline">The Secretary shall include on the common
				electronic forms described in clause (i) space for information that is required
				of an applicant to be eligible for State financial assistance, as provided
				under paragraph (5). The Secretary may not require an applicant to complete
				data required by any State other than the applicant’s State of
				residence.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDD6677B6C5766451AB155813FFC419A53"><enum>(iii)</enum><header display-inline="yes-display-inline">Streamlined format</header><text display-inline="yes-display-inline">The Secretary shall use, to the fullest
				extent practicable, all available technology to ensure that a student answers
				only the minimum number of questions necessary.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAB82E5C987B148F8A3787E78554F295E"><enum>(B)</enum><header display-inline="yes-display-inline">Simplified application</header>
									<clause commented="no" display-inline="no-display-inline" id="IDDD318BC542094AD7B4E8DCA737D428A5"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop and use a
				simplified electronic application form to be used by applicants meeting the
				requirements under section 479(b).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID2E4529B17086424C817A1C24E23E57C5"><enum>(ii)</enum><header display-inline="yes-display-inline">Reduced data requirements</header><text display-inline="yes-display-inline">The simplified electronic application form
				shall permit an applicant to submit for financial assistance purposes, only the
				data elements required to make a determination of whether the applicant meets
				the requirements under section 479(b).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID104C789068FB4724B350CD0F16F2759E"><enum>(iii)</enum><header display-inline="yes-display-inline">State data</header><text display-inline="yes-display-inline">The Secretary shall include on the
				simplified electronic application form space for information that is required
				of an applicant to be eligible for State financial assistance, as provided
				under paragraph (5), except the Secretary shall not include a State’s data if
				that State does not permit its applicants for State assistance to use the
				simplified electronic application form.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID77AABF3FB4B84D49BDB953F6D42188D4"><enum>(iv)</enum><header display-inline="yes-display-inline">Free availability and
				processing</header><text display-inline="yes-display-inline">The provisions of
				paragraph (6) shall apply to the simplified electronic application form, and
				the data collected by means of the simplified electronic application form shall
				be available to institutions of higher education, guaranty agencies, and States
				in accordance with paragraph (8).</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDAF857D4E9DBF4B8D9CB24796B67F8150"><enum>(v)</enum><header display-inline="yes-display-inline">Testing</header><text display-inline="yes-display-inline">The Secretary shall conduct appropriate
				field testing on the form developed under this subparagraph.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID575BDF354A774247BA7E1B20DD6373CC"><enum>(C)</enum><header display-inline="yes-display-inline">Rule of construction</header><text display-inline="yes-display-inline">Nothing in this subsection shall be
				construed to prohibit the use of the form developed by the Secretary pursuant
				to this paragraph by an eligible institution, eligible lender, guaranty agency,
				State grant agency, private computer software provider, a consortium of such
				entities, or such other entities as the Secretary may designate.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFF7826A293114C78BBA3C12F278A4F3C"><enum>(D)</enum><header display-inline="yes-display-inline">Privacy</header><text display-inline="yes-display-inline">The Secretary shall ensure that data
				collection under this paragraph complies with section 552a of title 5, United
				States Code, and that any entity using the electronic version of the forms
				developed by the Secretary pursuant to this paragraph shall maintain reasonable
				and appropriate administrative, technical, and physical safeguards to ensure
				the integrity and confidentiality of the information, and to protect against
				security threats, or unauthorized uses or disclosures of the information
				provided on the electronic version of the form. Data collected by such
				electronic version of the form shall be used only for the application, award,
				and administration of aid awarded under this title, State aid, or aid awarded
				by eligible institutions or such entities as the Secretary may designate. No
				data collected by such electronic version of the form shall be used for making
				final aid awards under this title until such data have been processed by the
				Secretary or a contractor or designee of the Secretary, except as may be
				permitted under this title.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID200178151990477195A3CCBFA0C05A0A"><enum>(E)</enum><header display-inline="yes-display-inline">Signature</header><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				Act, the Secretary may permit an electronic form to be submitted without a
				signature, if a signature is subsequently submitted by the applicant.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCB1048473E3F483A8E928E2B1D9804A2"><enum>(F)</enum><header display-inline="yes-display-inline">Personal identification numbers
				authorized</header><text display-inline="yes-display-inline">The Secretary is
				authorized to assign to applicants personal identification numbers—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDBB7E27C2D55A4CB9AD7747D3D8F9E40F"><enum>(i)</enum><text display-inline="yes-display-inline">to enable the applicants to use such
				numbers in lieu of a signature for purposes of completing a form under this
				paragraph; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDE9001395233F45238D336E69B79BC68A"><enum>(ii)</enum><text display-inline="yes-display-inline">for any purpose determined by the Secretary
				to enable the Secretary to carry out this title.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA5838D6908EB4509BF0C0CA6CE7F471F"><enum>(G)</enum><header display-inline="yes-display-inline">Personal identification number improvement
				assessment and report</header>
									<clause commented="no" display-inline="no-display-inline" id="id154A876948FD425A90212B202EAD71B4"><enum>(i)</enum><header display-inline="yes-display-inline">Assessment</header><text display-inline="yes-display-inline">The Secretary shall conduct an assessment
				of the feasibility of minimizing, and of eliminating, the time required for
				applicants to obtain a Personal Identification Number when applying for aid
				under this title through an electronic format (such as through a website called
				<quote>FAFSA on the Web</quote>) including an examination of the feasibility of
				implementing a real-time data match between the Social Security Administration
				and the Department.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id2F9036EC8B1E4EABA048963D137107B2"><enum>(ii)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">The Secretary shall report the findings of
				the assessment described in clause (i) to Congress not later than 6 months
				after the date of enactment of the Financial Aid Form Simplification and Access
				Act, including the next steps that may be taken to minimize the time required
				for applicants to obtain a Personal Identification Number when applying for aid
				under this title through an electronic format.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA6DF3D38B0E84463AB1FFB3E6E086D1D"><enum>(4)</enum><header display-inline="yes-display-inline">Reapplication</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID2DB3DB7705974577B5FD4BA225CA6655"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall develop streamlined
				reapplication forms and processes, including both paper and electronic
				reapplication processes, consistent with the requirements of this subsection,
				for an applicant who applies for financial assistance under this title in the
				next succeeding academic year subsequent to the year in which such applicant
				first applied for financial assistance under this title.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID75A5581D8A344F7A93189FCA32F74841"><enum>(B)</enum><header display-inline="yes-display-inline">Updated</header><text display-inline="yes-display-inline">The Secretary shall determine, in
				cooperation with States, institutions of higher education, and agencies and
				organizations involved in student financial assistance, the data elements that
				can be updated from the previous academic year’s application.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB96EE094DEF9499695D8E90DAF3D0E52"><enum>(C)</enum><header display-inline="yes-display-inline">Zero family contribution</header><text display-inline="yes-display-inline">Applicants determined to have a zero family
				contribution pursuant to section 479(c) shall not be required to provide any
				financial data in a reapplication form, except that which is necessary to
				determine eligibility under such section.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD9FE3DF323947B3B4ECCB4ACA3036B6"><enum>(5)</enum><header display-inline="yes-display-inline">State requirements</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDA9BAFE2243184314A308E982115F1652"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall include on the forms
				developed under this subsection, such State-specific data items as the
				Secretary determines are necessary to meet State requirements for need-based
				State aid. Such items shall be selected in consultation with States to assist
				in the awarding of State financial assistance in accordance with the terms of
				this subsection. The number of such data items shall not be less than the
				number included on the form on October 7, 1998, unless States notify the
				Secretary that they no longer require those data items for the distribution of
				State need-based aid.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3279078B631449B9982FE9FE397CA677"><enum>(B)</enum><header display-inline="yes-display-inline">Annual review</header><text display-inline="yes-display-inline">The Secretary shall conduct an annual
				review process to determine which forms and data items the States require to
				award need-based State aid and other application requirements that the States
				may impose.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB991071E1C8D4250A1C91999F12BD60B"><enum>(C)</enum><header display-inline="yes-display-inline">Federal register notice</header><text display-inline="yes-display-inline">The Secretary shall publish on an annual
				basis a notice in the Federal Register requiring each State agency to inform
				the Secretary—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID3FEB81AFC1FD42ABA476DBB94C2BCD5F"><enum>(i)</enum><text display-inline="yes-display-inline">if the agency is unable to permit
				applicants to utilize the forms described in paragraphs (2)(B) and (3)(B);
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID9FE5982C5D914967B793E663916861E6"><enum>(ii)</enum><text display-inline="yes-display-inline">of the State-specific data that the agency
				requires for delivery of State need-based financial aid.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID4708A9FD7F374F4D94BB5FA5D5AED9BB"><enum>(D)</enum><header display-inline="yes-display-inline">State notification to the
				secretary</header>
									<clause commented="no" display-inline="no-display-inline" id="IDA7EE62DC323D4C19A347AB42C8848666"><enum>(i)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Each State shall notify the
				Secretary—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID297C267524A54769BB38659612C01F1B"><enum>(I)</enum><text display-inline="yes-display-inline">whether the State permits an applicant to
				file a form described in paragraph (2)(B) or (3)(B) for purposes of determining
				eligibility for State need-based grant aid; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDE138806D667B47B09232D4DA26C3FC23"><enum>(II)</enum><text display-inline="yes-display-inline">of the State-specific data that the State
				requires for delivery of State need-based financial aid.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDEFA4499428CC42B7A63BA9A24AA16BB8"><enum>(ii)</enum><header display-inline="yes-display-inline">No permission</header><text display-inline="yes-display-inline">In the event that a State does not permit
				an applicant to file a form described in paragraph (2)(B) or (3)(B) for
				purposes of determining eligibility for State need-based grant aid—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDD829A42DCF27487CBB0BA9FFAF8AF31A"><enum>(I)</enum><text display-inline="yes-display-inline">the State shall notify the Secretary if it
				is not permitted to do so because of State law or because of agency policy;
				and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDAB40012AF87644DBB8973A2366E6003B"><enum>(II)</enum><text display-inline="yes-display-inline">the notification under subclause (I) shall
				include an estimate of the program cost to permit applicants to complete the
				forms described in paragraphs (2)(B) and (3)(B).</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID8CE1DDF01B7C497A9AAF35CC73F11318"><enum>(iii)</enum><header display-inline="yes-display-inline">Lack of notification by the
				state</header><text display-inline="yes-display-inline">If a State does not
				notify the Secretary pursuant to clause (i), the Secretary shall—</text>
										<subclause commented="no" display-inline="no-display-inline" id="IDEE4535D82FF5468588A2963AFBDCD05D"><enum>(I)</enum><text display-inline="yes-display-inline">permit residents of that State to complete
				the forms described in paragraphs (2)(B) and (3)(B); and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID5585990B39CA4EA88EBEB0BCC551B7FA"><enum>(II)</enum><text display-inline="yes-display-inline">not require any resident of that State to
				complete any data previously required by that State.</text>
										</subclause></clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID860BB806882F4381B47ECA5F184794AC"><enum>(E)</enum><header display-inline="yes-display-inline">Restriction</header><text display-inline="yes-display-inline">The Secretary shall not require applicants
				to complete any nonfinancial data or financial data that are not required by
				the applicant’s State agency, except as may be required for applicants who use
				the paper forms described in subparagraphs (A) and (B) of paragraph (2).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5AD011344A474A28B6A3F4F4A5F065DB"><enum>(6)</enum><header display-inline="yes-display-inline">Charges to students and parents for use of
				forms prohibited</header><text display-inline="yes-display-inline">The common
				financial reporting forms prescribed by the Secretary under this subsection
				shall be produced, distributed, and processed by the Secretary and no parent or
				student shall be charged a fee by the Secretary, a contractor, a third party
				servicer or private software provider, or any other public or private entity
				for the collection, processing, or delivery of financial aid through the use of
				such forms. The need and eligibility of a student for financial assistance
				under parts A through E (other than under subpart 4 of part A) may only be
				determined by using a form developed by the Secretary pursuant to this
				subsection. No student may receive assistance under parts A through E (other
				than under subpart 4 of part A), except by use of a form developed by the
				Secretary pursuant to this subsection. No data collected on a paper or
				electronic form or other document, which the Secretary determines was created
				to replace a form prescribed under this subsection and therefore violates the
				integrity of a simplified and free financial aid application process, for which
				a fee is charged shall be used to complete the form prescribed under this
				subsection. No person, commercial entity, or other entity shall request,
				obtain, or utilize an applicant’s Personal Identification Number for purposes
				of submitting an application on an applicant’s behalf, other than a State
				agency, an eligible institution, or a program under this title that the
				Secretary permits to so request, obtain, or utilize an applicant's Personal
				Identification Number in order to streamline the application.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9BE69F73F18B4ED18FCE1E833DFA4123"><enum>(7)</enum><header display-inline="yes-display-inline">Application processing cycle</header><text display-inline="yes-display-inline">The Secretary shall, prior to January 1 of
				a student’s planned year of enrollment to the extent practicable—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID3402443D43BF4EB4A8881CD97FA85093"><enum>(A)</enum><text display-inline="yes-display-inline">enable the student to submit a form
				described under this subsection in order to meet the filing requirements of
				this section and receive aid from programs under this title; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID237933F67F99492E8432A3F19A69AB7A"><enum>(B)</enum><text display-inline="yes-display-inline">initiate the processing of a form under
				this subsection submitted by the
				student.</text>
								</subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC10B17E073174D7A9EC25051743DB503"><enum>(D)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="ID16A0430CBBE74443808623FC68BAD211" style="OLC">
							<paragraph commented="no" display-inline="no-display-inline" id="ID5C7E471283664A76885562474ECFC3F5"><enum>(12)</enum><header display-inline="yes-display-inline">Early application and award demonstration
				program</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDFB5853166AF242688EE710EEB5403ACD"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of the <short-title>Financial Aid Form
				Simplification and Access Act</short-title>, the Secretary shall implement an
				early application demonstration program enabling dependent students to—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID390E27AE99744F8B874E684FC26140B2"><enum>(i)</enum><text display-inline="yes-display-inline">complete applications under this subsection
				in such students’ junior year of secondary school, or in the academic year that
				is 2 years prior to such students’ intended year of enrollment at an
				institution of higher education (as early as the Secretary determines
				practicable after January 1st of such junior year or academic year,
				respectively);</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID98C7123F41524E4CBA32AE7EE32F0A7D"><enum>(ii)</enum><text display-inline="yes-display-inline">receive an estimate of such students' final
				financial aid awards in such junior year or academic year, respectively;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id4A73C40A20F74EFBA9ECF0CA7A41127D"><enum>(iii)</enum><text display-inline="yes-display-inline">update, in the year prior to such students'
				planned year of enrollment (before January 1st of the planned year of
				enrollment to the extent practicable), the information contained in an
				application submitted under clause (i), using the process described in
				paragraph (4) to determine such students' final financial aid awards;
				and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id6A4FAE460F8D4E299F4491ED5A85E057"><enum>(iv)</enum><text display-inline="yes-display-inline">receive final financial aid awards based on
				updated information described in clause (iii).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID14754837A51C4FB59596E782007DCA8A"><enum>(B)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of the demonstration program
				under this paragraph is to measure the benefits, in terms of student
				aspirations and plans to attend college, and the adverse effects, in terms of
				program costs, integrity, distribution, and delivery of aid under this title,
				of implementing an early application system for all dependent students that
				allows dependent students to apply for financial aid using information from the
				year prior to the year prior to enrollment at an institution of higher
				education. Additional objectives associated with implementation of the
				demonstration program are the following:</text>
									<clause commented="no" display-inline="no-display-inline" id="IDB8E2B16AC84D4AEEB88F78BACD0AAFD5"><enum>(i)</enum><text display-inline="yes-display-inline">Measure the feasibility of enabling
				dependent students to apply for Federal, State, and institutional financial aid
				in such students’ junior year of secondary school, or in the academic year that
				is 2 years prior to such students’ intended year of enrollment at an
				institution of higher education, using information from the year prior to the
				year prior to enrollment, by completing any of the application forms under this
				subsection.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID767F727F96D942BF8A1DD557D8A26422"><enum>(ii)</enum><text display-inline="yes-display-inline">Determine the feasibility, benefits, and
				adverse effects of utilizing information from the Internal Revenue Service in
				order to simplify the Federal student aid application process.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDB965FE788FBD4C979102FF19F13E6C23"><enum>(iii)</enum><text display-inline="yes-display-inline">Identify whether receiving estimates of
				final financial aid awards not later than a student’s junior year, or the
				academic year that is 2 years prior to such students’ intended year of
				enrollment at an institution of higher education, positively impacts the
				college aspirations and plans of such student.</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDD1B191AAE7DA400B9A0B60B4DAD67F1C"><enum>(iv)</enum><text display-inline="yes-display-inline">Measure the impact of using income
				information from the year prior to the year prior to enrollment on—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID5E90BCEFE6074BAB9B60E2C3BFC7CA02"><enum>(I)</enum><text display-inline="yes-display-inline">eligibility for financial aid under this
				title and for other institutional aid; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="ID0E61CCA42D7147E6ACEF904DB89976D5"><enum>(II)</enum><text display-inline="yes-display-inline">the cost of financial aid programs under
				this title.</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDA0545ABA03DD486CABF18740B3C0A9AB"><enum>(v)</enum><text display-inline="yes-display-inline">Effectively evaluate the benefits and
				adverse effects of the demonstration program on program costs, integrity,
				distribution, and delivery of aid.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1B5C712E1CE9439182BAB7F821D4660A"><enum>(C)</enum><header display-inline="yes-display-inline">Participants</header><text display-inline="yes-display-inline">The Secretary shall select, in consultation
				with States and institutions of higher education, States and institutions of
				higher education within the States interested in participating in the
				demonstration program under this paragraph. The States and institutions of
				higher education shall participate in programs under this title and be willing
				to make estimates of final financial aid awards to students based on such
				students’ application information from the year prior to the year prior to
				enrollment. The Secretary shall also select as participants in the
				demonstration program secondary schools that are located in the participating
				States and dependent students who reside in the participating States.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBED8F5A3E38C41269BBF11EDD5143578"><enum>(D)</enum><header display-inline="yes-display-inline">Application process</header><text display-inline="yes-display-inline">The Secretary shall ensure that the
				following provisions are included in the demonstration program:</text>
									<clause commented="no" display-inline="no-display-inline" id="ID7EAB29D93C9C401AAD7F1C96DFD0A217"><enum>(i)</enum><text display-inline="yes-display-inline">Participating States and institutions of
				higher education shall—</text>
										<subclause commented="no" display-inline="no-display-inline" id="ID6C0404BFC7954DB7A6DFFF2FC610ED81"><enum>(I)</enum><text display-inline="yes-display-inline">encourage participating students to apply
				for estimates of final financial aid awards as provided under this title in
				such students’ junior year of secondary school, or in the academic year that is
				2 years prior to such students’ intended year of enrollment at an institution
				of higher education, using information from the year prior to the year prior to
				enrollment;</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="IDFE9A3E49B777469C98C025F1355EFF0B"><enum>(II)</enum><text display-inline="yes-display-inline">provide estimates of final financial aid
				awards to participating students based on the students' application information
				from the year prior to the year of enrollment; and</text>
										</subclause><subclause commented="no" display-inline="no-display-inline" id="id099835C102B540E287922D1058E55DDF"><enum>(III)</enum><text display-inline="yes-display-inline">make final financial aid awards to
				participating students based on the updated information contained on a form
				submitted using the process described in paragraph (4).</text>
										</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDCC3F4A52F9F5499888C4C656E8C3124D"><enum>(ii)</enum><text display-inline="yes-display-inline">Financial aid administrators at
				participating institutions of higher education shall be allowed to use such
				administrators’ discretion in awarding financial aid to participating students,
				as outlined under section 479A.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID0FD4FD409F034206936ED52D8C4B7E27"><enum>(E)</enum><header display-inline="yes-display-inline">Feasibility study</header><text display-inline="yes-display-inline">The Secretary shall include in the
				demonstration program a study of the feasibility of utilizing data from the
				Internal Revenue Service in order to—</text>
									<clause commented="no" display-inline="no-display-inline" id="id28A88A8ABE4247CE90FAD3208DAFA1E5"><enum>(i)</enum><text display-inline="yes-display-inline">pre-populate electronic application forms
				for financial aid under this title (such as through a website called
				<quote>FAFSA on the Web</quote>) with applicant information from the Internal
				Revenue Service;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id86A697E1278B43008EAE8BEFBEAC9237"><enum>(ii)</enum><text display-inline="yes-display-inline">verify data provided by students
				participating in the demonstration program, including the feasibility of a data
				match; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="id0F9E3D9C458542E4B6125D05C5532056"><enum>(iii)</enum><text display-inline="yes-display-inline">award and deliver financial aid under this
				title.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDEF51F712E334CD4B8D60FDEAFD9C51D"><enum>(F)</enum><header display-inline="yes-display-inline">Evaluation</header><text display-inline="yes-display-inline">The Secretary shall conduct a rigorous
				evaluation of the demonstration program in order to measure the program’s
				benefits and adverse effects as the benefits and affects relate to the purpose
				and objectives described in subparagraph (B).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE994D47563B74BE9AF82B8B3E27294B3"><enum>(G)</enum><header display-inline="yes-display-inline">Outreach</header><text display-inline="yes-display-inline">The Secretary shall make appropriate
				efforts in order to notify States of the demonstration program. Upon
				determination of which States will be participating in the demonstration
				program, the Secretary shall continue to make efforts to notify institutions of
				higher education and dependent students within such participating States of the
				opportunity to participate in the demonstration program and of the
				participation requirements.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3615A87702404113AB44A049641963A1"><enum>(H)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">The Secretary shall consult with the
				Advisory Committee on Student Financial Assistance, established under section
				491, on the design and implementation of the demonstration program and on the
				evaluation described in paragraph
				(F).</text>
								</subparagraph></paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID041CA6971BA34194B1CEB1216233F9B0"><enum>(2)</enum><text display-inline="yes-display-inline">by striking subsection (b) and inserting
			 the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID8CE29066925847039AC194FB79D3E126" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDC447D4D948514DA1944C3C4F4C05E23C"><enum>(b)</enum><header display-inline="yes-display-inline">Early Awareness of Aid Eligibility</header>
							<paragraph commented="no" display-inline="no-display-inline" id="ID849685BFCFDB458DAFCEF0CD79793B34"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall make every effort to
				provide students with early information about potential financial aid
				eligibility.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC02DDC4B77864E37BDC387484C3F0238"><enum>(2)</enum><header display-inline="yes-display-inline">Availability of means to determine
				eligibility</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID62679DF62CCF43E683FDFD9291FC5B7E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall provide, in cooperation
				with States, institutions of higher education, agencies, and organizations
				involved in student financial assistance, through a widely disseminated printed
				form and through the Internet or other electronic means, a system for
				individuals to determine easily, by entering relevant data, approximately the
				amount of grant, work-study, and loan assistance for which an individual would
				be eligible under this title upon completion and verification of a form under
				subsection (a).</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID21804A45DD374BE292314035D8826895"><enum>(B)</enum><header display-inline="yes-display-inline">Determination of whether to use simplified
				application</header><text display-inline="yes-display-inline">The system
				established under this paragraph shall also permit an individual to determine
				whether or not the individual may apply for aid using an EZ FAFSA described in
				subsection (a)(2)(B) or a simplified electronic application form described in
				subsection (a)(3)(B).</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID40F9C2B067614575B4A62D3C37FAF33F"><enum>(3)</enum><header display-inline="yes-display-inline">Availability of means to communicate
				eligibility</header>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID0F46EBB00C58475292F3E9EB01B5ACD9"><enum>(A)</enum><header display-inline="yes-display-inline">Lower-income students</header><text display-inline="yes-display-inline">The Secretary shall—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID3E801DE9303C4426A765ECC4C366C801"><enum>(i)</enum><text display-inline="yes-display-inline">make special efforts to notify students who
				qualify for a free or reduced price lunch under the school lunch program
				established under the Richard B. Russell <act-name parsable-cite="NSLA">National School Lunch Act</act-name> (42 U.S.C. 1751 et
				seq.), benefits under the food stamp program under the
				<act-name parsable-cite="FSA77">Food Stamp Act of 1977</act-name> (7 U.S.C.
				2011 et seq.), or benefits under such programs as the Secretary shall
				determine, of such students’ potential eligibility for a maximum Federal Pell
				Grant under subpart 1 of part A; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID09F67CB755E04E11B269CC63A0384917"><enum>(ii)</enum><text display-inline="yes-display-inline">disseminate informational materials
				regarding the linkage between eligibility for means-tested Federal benefit
				programs and eligibility for a Federal Pell Grant, as determined necessary by
				the Secretary.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID58018ED5385E4BCFB26D86DE9BC120D8"><enum>(B)</enum><header display-inline="yes-display-inline">Middle school students</header><text display-inline="yes-display-inline">The Secretary shall, in cooperation with
				States, middle schools, programs under this title that serve middle school
				students, and other cooperating independent outreach programs, make special
				efforts to notify middle school students of the availability of financial
				assistance under this title and of the approximate amounts of grant,
				work-study, and loan assistance an individual would be eligible for under this
				title.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD98E7748C1BE48D1B89DD8689155BEBD"><enum>(C)</enum><header display-inline="yes-display-inline">Secondary school students</header><text display-inline="yes-display-inline">The Secretary, in cooperation with States,
				secondary schools, programs under this title that serve secondary school
				students, and cooperating independent outreach programs, shall make special
				efforts to notify students in their junior year of secondary school, or in the
				academic year that is 2 years prior to such students’ intended year of
				enrollment at an institution of higher education, of the approximate amounts of
				grant, work-study, and loan assistance an individual would be eligible for
				under this title upon completion and verification of an application form under
				subsection
				(a).</text>
								</subparagraph></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2599706787F840179FAA475DA81A5C20"><enum>(3)</enum><text display-inline="yes-display-inline">in subsection (c)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id40C7145291024279B167C5F08BE08C31"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>Labor and Human
			 Resources</quote> and inserting <quote>Health, Education, Labor, and
			 Pensions</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idCFEEA1301B1A4356B545EB425D6A5F5B"><enum>(B)</enum><text display-inline="yes-display-inline">by striking <quote>the Workforce</quote>
			 and inserting <quote>Labor</quote>; and</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBB0E1F0327EB409687666910FA0946F9"><enum>(4)</enum><text display-inline="yes-display-inline">by striking subsections (d) and (e), and
			 inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID10970F3EDC0D499791B9028EAEE4AAD7" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDE1F3894048694612BE6E8B50CF4DA286"><enum>(d)</enum><header display-inline="yes-display-inline">Assistance in Preparation of Financial Aid
				Application</header>
							<paragraph commented="no" display-inline="no-display-inline" id="IDF0BABFDD16384FDDBDA75BE143416A47"><enum>(1)</enum><header display-inline="yes-display-inline">Preparation authorized</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
				limit an applicant from using a preparer for consultative or preparation
				services for the completion of the common financial reporting forms described
				in subsection (a).</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CC56BC93EAE431E9303AB4FB6334205"><enum>(2)</enum><header display-inline="yes-display-inline">Preparer identification</header><text display-inline="yes-display-inline">Any common financial reporting form
				required to be made under this title shall include the name, signature, address
				or employer’s address, social security number or employer identification
				number, and organizational affiliation of the preparer of such common financial
				reporting form.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID416A83EA7AD6447D9E78DA417C816743"><enum>(3)</enum><header display-inline="yes-display-inline">Special rule</header><text display-inline="yes-display-inline">Nothing in this Act shall be construed to
				limit preparers of common financial reporting forms required to be made under
				this title from collecting source information, including Internal Revenue
				Service tax forms, in providing consultative and preparation services in
				completing the forms.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA4B9B8377C2F4028B737EF18D5BF3A03"><enum>(4)</enum><header display-inline="yes-display-inline">Additional requirements</header><text display-inline="yes-display-inline">A preparer that provides consultative or
				preparation services pursuant to this subsection shall—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID548A4C305E2748FC9579F01BAEE7ECC9"><enum>(A)</enum><text display-inline="yes-display-inline">clearly inform individuals upon initial
				contact (including advertising in clear and conspicuous language on the website
				of the preparer, including by providing a link directly to the website
				described in subsection (a)(3), if the preparer provides such services through
				a website) that the common financial reporting forms that are required to
				determine eligibility for financial assistance under parts A through E (other
				than subpart 4 of part A) may be completed for free via paper or electronic
				forms provided by the Secretary;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3272B21A46674B909E3FF4B010BA33ED"><enum>(B)</enum><text display-inline="yes-display-inline">refrain from producing or disseminating any
				form other than the forms produced by the Secretary under subsection (a);
				and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID15AB7EDD26764A758399B9DFB22EF207"><enum>(C)</enum><text display-inline="yes-display-inline">not charge any fee to any individual
				seeking such services who meets the requirements under subsection (b) or (c) of
				section
				479.</text>
								</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1DD42DD1BAF04D73BBEBB4583BA15898"><enum>(c)</enum><header display-inline="yes-display-inline">Toll-Free Application and
			 Information</header><text display-inline="yes-display-inline">Section 479 of
			 the <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087ss), as amended by subsection (b)(4), is further amended by adding
			 at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="IDC52165E53DAD43E8BA814592CA6681EE" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="IDD7C87D9AAC5F4EAF8DDCC92605EBD306"><enum>(e)</enum><header display-inline="yes-display-inline">Toll-Free Application and
				Information</header><text display-inline="yes-display-inline">The Secretary
				shall contract for, or establish, and publicize a toll-free telephone service
				to provide an application mechanism and timely and accurate information to the
				general public. The information provided shall include specific instructions on
				completing the application form for assistance under this title. Such service
				shall also include a service accessible by telecommunications devices for the
				deaf (TDD’s) and shall, in addition to the services provided for in the
				previous sentence, refer such students to the national clearinghouse on
				postsecondary education or another appropriate provider of technical assistance
				and information on postsecondary educational services, that is supported under
				section 663 of the Individuals with Disabilities Education Act (20 U.S.C.
				1463). Not later than 2 years after the date of enactment of the Financial Aid
				Form Simplification and Access Act, the Secretary shall test and implement, to
				the extent practicable, a toll-free telephone-based application system to
				permit applicants who are eligible to utilize the EZ FAFSA described in section
				483(a) over such
				system.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB69E9852042A491FB522844DFBB1EC66"><enum>(d)</enum><header display-inline="yes-display-inline">Master Calendar</header><text display-inline="yes-display-inline">Section 482(a)(1)(B) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1089(a)(1)(B)) is amended to read as follows:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID144014F7438B4C749D8F2DE3172E2251" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="ID87FD6311EDC547DA93F1994668C7F87C"><enum>(B)</enum><text display-inline="yes-display-inline">by March 1: proposed modifications and
				updates pursuant to sections 478, 479(c), and 483(a)(5) published in the
				Federal
				Register;</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID88062AA993CF42B79D0896C06EC1E5B8"><enum>(e)</enum><header display-inline="yes-display-inline">Simplifying the Verification
			 Process</header><text display-inline="yes-display-inline">Section 484 of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1091) is amended by adding at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID94BAFD08C6354438ADC5574CC8B785D2" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="ID951B9FC7A9A043A7A77C486359D4DF28"><enum>(s)</enum><header display-inline="yes-display-inline">Verification of Student
				Eligibility</header>
						<paragraph commented="no" display-inline="no-display-inline" id="ID548BDE86E65D4898917B22263352F833"><enum>(1)</enum><header display-inline="yes-display-inline">Regulatory review</header><text display-inline="yes-display-inline">The Secretary shall review all regulations
				of the Department related to verifying the information provided on a student’s
				financial aid application in order to simplify the verification process for
				students and institutions.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98B8098B44BD414AA915D233F33CEF9E"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than 2 years after the date of
				enactment of the <short-title>Financial Aid Form
				Simplification and Access Act</short-title>, the Secretary shall prepare and
				submit a final report to the Committee on Health, Education, Labor, and
				Pensions of the Senate and the Committee on Education and Labor of the House of
				Representatives on steps taken, to the extent practicable, to simplify the
				verification process. The report shall specifically address steps taken
				to—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID8870674A7423412386FEE85424A79D69"><enum>(A)</enum><text display-inline="yes-display-inline">reduce the burden of verification on
				students who are selected for verification at multiple institutions;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8A4E3949EE5A42959FCA6B825AC7C4E2"><enum>(B)</enum><text display-inline="yes-display-inline">reduce the number of data elements that are
				required to be verified for applicants meeting the requirements of subsection
				(b) or (c) of section 479, so that only those data elements required to
				determine eligibility under subsection (b) or (c) of section 479 are subject to
				verification;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB20A5190311641C9A28853D4C8E4EB27"><enum>(C)</enum><text display-inline="yes-display-inline">reduce the burden and costs associated with
				verification for institutions that are eligible to participate in Federal
				student aid programs under this title; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC8ECBC8455854329A95F37645227EC1C"><enum>(D)</enum><text display-inline="yes-display-inline">increase the use of technology in the
				verification
				process.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>

			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1087vv(d)) is amended to read as follows:</text>

						<paragraph commented="no" display-inline="no-display-inline" id="ID99C46DC5BF2345239909E8C9F2BD6318"><enum>(1)</enum><header display-inline="yes-display-inline">Definition</header><text display-inline="yes-display-inline">The term <term>independent</term>, when
				used with respect to a student, means any individual who—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="ID5126BE1B456143959909B20C34B553B9"><enum>(A)</enum><text display-inline="yes-display-inline">is 24 years of age or older by December 31
				of the award year;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDDFBA1FB5CF6C4AE49592F34FD8211BF0"><enum>(B)</enum><text display-inline="yes-display-inline">is an orphan, in foster care, or a ward of
				the court, or was in foster care or a ward of the court until the individual
				reached the age of 18;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDAF8C0D23A7A54B3380386CB6836C8E1D"><enum>(C)</enum><text display-inline="yes-display-inline">is an emancipated minor or is in legal
				guardianship as determined by a court of competent jurisdiction in the
				individual’s State of legal residence;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID94FC91375F03417EAE865EC6E840FE56"><enum>(D)</enum><text display-inline="yes-display-inline">is a veteran of the Armed Forces of the
				United States (as defined in subsection (c)(1)) or is currently serving on
				active duty in the Armed Forces;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE45B1C40A1E1462D95047DC0AB0EE063"><enum>(E)</enum><text display-inline="yes-display-inline">is a graduate or professional
				student;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID236DF2C5C2B04CFBB7E11CDD1AB2C9FB"><enum>(F)</enum><text display-inline="yes-display-inline">is a married individual;</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDBE392E7758624CC78AC1F2BA2379B8B9"><enum>(G)</enum><text display-inline="yes-display-inline">has legal dependents other than a spouse;
				or</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID169F54FA94BF4FD984C9F394F68BF438"><enum>(H)</enum><text display-inline="yes-display-inline">is a student for whom a financial aid
				administrator makes a documented determination of independence by reason of
				other unusual circumstances.</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID14985721B67A4B739D6D527BDCBA37B6"><enum>(2)</enum><header display-inline="yes-display-inline">Simplifying the dependency override
				process</header><text display-inline="yes-display-inline">Nothing in this
				section shall be construed to prohibit a financial aid administrator from
				making a determination of independence, as described in paragraph (1)(H), based
				upon a determination of independence previously made by another financial aid
				administrator in the same application
				year.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDBB9A284D50AA45388D72B54CC7D93628"><enum>(b)</enum><header display-inline="yes-display-inline">Tailoring Electronic Applications for
			 Students with Special Circumstances</header><text display-inline="yes-display-inline">Section 483(a) of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1090(a)), as amended by section 3(b)(1)(D), is further amended by adding
			 at the end the following:</text>
				<quoted-block act-name="Higher Education Act of 1965" display-inline="no-display-inline" id="ID17E3EE7BB2234AA8AA77A3DD767064C3" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID1DABE7A906E34EFFB5AA582D0AFF29EC"><enum>(13)</enum><header display-inline="yes-display-inline">Applications for students seeking a
				documented determination of independence</header><text display-inline="yes-display-inline">In the case of a dependent student seeking
				a documented determination of independence by a financial aid administrator, as
				described in section 480(d), nothing in this section shall prohibit the
				Secretary from—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID97587170BD93467BAA868B8E8E259724"><enum>(A)</enum><text display-inline="yes-display-inline">allowing such student to—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDFA72C5E0F32A4B35B7DF822CA9E927E1"><enum>(i)</enum><text display-inline="yes-display-inline">indicate the student’s request for a
				documented determination of independence on an electronic form developed
				pursuant to this subsection; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID9CAD98E39B324E1F9855220DFB26EF84"><enum>(ii)</enum><text display-inline="yes-display-inline">submit such form for preliminary processing
				that only contains those data elements required of independent students, as
				defined in section 480(d);</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID20D715AFFB2F43D18E7E31556BA7A177"><enum>(B)</enum><text display-inline="yes-display-inline">collecting and processing on a preliminary
				basis data provided by such a student using the electronic forms developed
				pursuant to this subsection; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2B6091610E0B4A9B925FC49C9B014FA8"><enum>(C)</enum><text display-inline="yes-display-inline">distributing such data to institutions of
				higher education, guaranty agencies, and States for the purposes of processing
				loan applications and determining need and eligibility for institutional and
				State financial aid awards on a preliminary basis, pending a documented
				determination of independence by a financial aid
				administrator.</text>
						</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id3469EFC5C7E34F15A3F189257E7C2B03" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Definitions</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8FA53B6EDF1E48FAB7430494D7957EFC"><enum>(a)</enum><header display-inline="yes-display-inline">Total income</header><text display-inline="yes-display-inline">Section 480(a)(2) of the Higher Education
			 Act of (20 U.S.C. 1087vv(a)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id35DDBFB8BF0B426294B7E5A574FF0A69"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>and no portion</quote>
			 and inserting <quote>no portion</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDBE9563F7FF24E709F03A665E79EF97B"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting <quote>and no distribution
			 from any qualified education benefit described in subsection (f)(3) that is not
			 subject to Federal income tax,</quote> after <quote>1986,</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9EB0FFD559854A06878C386750BA010D"><enum>(b)</enum><header display-inline="yes-display-inline">Assets</header><text display-inline="yes-display-inline">Section 480(f) of the Higher Education Act
			 of 1965 (20 U.S.C. 1087vv(f)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id67BE60F0472545DCB6ABD58EF02A8244"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>shall
			 not be considered an asset of a student for purposes of section 475</quote> and
			 inserting <quote>shall be considered an asset of the parent for purposes of
			 section 475</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE3CB4F64FA194F48831727D19E4F153A"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (4) and (5) as
			 paragraphs (5) and (6), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9582DD8768254DF3AE4A86962F93A8BD"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
			 following:</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id85534FA6C20C4F88981578712D60D2DC"><enum>(c)</enum><header display-inline="yes-display-inline">Other financial assistance</header><text display-inline="yes-display-inline">Section 480(j)(2) of the Higher Education
			 Act of 1965 (20 U.S.C. 1087vv(j)(2)) is amended by inserting <quote>, or a
			 distribution that is not includable in gross income under section 529 of such
			 Code, under another prepaid tuition plan offered by a State, or under a
			 Coverdell education savings account under section 530 of such Code,</quote>
			 after <quote>1986</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9EACB17ABFA54399A89C72F3A909AABE" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Advisory Committee on Student Financial
			 Assistance</header><text display-inline="no-display-inline">Section 491 of the
			 <act-name parsable-cite="HEA65">Higher Education Act of 1965</act-name> (20
			 U.S.C. 1098) is further amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID14DE9A3D8E8B4A93AFCBDB3F2F8608C8"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(2)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID7CBDB7171958416AADDB0B9A48BF23CC"><enum>(A)</enum><text display-inline="yes-display-inline">in subparagraph (B), by striking
			 <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9E5EF81845BC47C984630908A28EAA1E"><enum>(B)</enum><text display-inline="yes-display-inline">in subparagraph (C), by striking the period
			 at the end and inserting a semicolon; and</text>

				their eligibility for other forms of State and institutional need-based student
				assistance; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2325F2D7DE2649B0838F3AD4BBF6A476"><enum>(E)</enum><text display-inline="yes-display-inline">to make recommendations that will expand
				and improve partnerships among the Federal Government, States, institutions,
				and private entities to increase the awareness and total amount of need-based
				student assistance available to low- and moderate-income
				students.</text>
						</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID96450776461C49E3AC82C8B5DEF5E967"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID095022A49B294CF88B82B3CDF31085E8"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (6), by striking <quote>, but
			 nothing in this section shall authorize the committee to perform such studies,
