		<official-title>To provide for certain administrative and support
		  services for the Dwight D. Eisenhower Memorial Commission, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Dwight
			 D. Eisenhower Memorial Commission</header><text display-inline="no-display-inline">Section 8162 of the Department of Defense
			 Appropriations Act, 2000 (Public Law 106–79; 113 Stat. 1274) is amended—</text>
			<paragraph id="idE9D32F4E90B74A6489D40173066CFBAB"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (j), and inserting
			 the following:</text>
				<quoted-block display-inline="no-display-inline" id="id7EA065ABB5654755B1873E77A45D8F35" style="OLC">
					<subsection id="id30CEF957DE5A441B89018BCD99C65CA3"><enum>(j)</enum><header>Powers of the
				commission</header>
						<paragraph id="id552A902AB8754669A035089719DBD7E7"><enum>(1)</enum><header>In
				general</header>
							<subparagraph id="idEAC14E1F706D475ABF3F0DF57EAE1453"><enum>(A)</enum><header>Powers</header><text>The
				Commission may—</text>
								<clause id="id51EBBAFAB1364D1C9343A322E6B66D21"><enum>(i)</enum><text>make such
				expenditures for services and materials for the purpose of carrying out this
				section as the Commission considers advisable from funds appropriated or
				received as gifts for that purpose;</text>
								</clause><clause id="idC47146917BF94E25A7298A122CE1FDC0"><enum>(ii)</enum><text>solicit and
				accept contributions to be used in carrying out this section or to be used in
				connection with the construction or other expenses of the memorial;</text>
								</clause><clause id="id40EC5A830F3C49E2A4E303E7AB7AF533"><enum>(iii)</enum><text>hold hearings
				and enter into contracts;</text>
								</clause><clause id="id5A3BACF3BD454B39A40B86A959C53656"><enum>(iv)</enum><text>enter into
				contracts for specialized or professional services as necessary to carry out
				this section; and</text>
								</clause><clause id="idF5F3842DE1334E119E63802C882A389B"><enum>(v)</enum><text>take such actions
				as are necessary to carry out this section.</text>
								</clause></subparagraph><subparagraph id="id3DF2C6A367CF46E589424D1A53AA3C4E"><enum>(B)</enum><header>Specialized or
				professional services</header><text>Services under subparagraph (A)(iv) may
				be—</text>
								<clause id="id9DB1397501A146DA801B40C207306DEC"><enum>(i)</enum><text>obtained without
				regard to the provisions of title 5, United States Code, including section 3109
				of that title; and</text>
								</clause><clause id="id35F906547D0A4B62B989AD4A0CDAB536"><enum>(ii)</enum><text>may be paid
				without regard to the provisions of title 5, United States Code, including
				chapter 51 and subchapter III of chapter 53 of that title<deleted-phrase committee-id="SSEG00" reported-display-style="strikethrough">;</deleted-phrase><added-phrase committee-id="SSEG00" reported-display-style="italic">.</added-phrase></text>
								</clause></subparagraph></paragraph><paragraph commented="no" id="idB673953523A84F318433DEFC0B774B1F"><enum>(2)</enum><header>Gifts of
				property</header><text>The Commission may accept gifts of real or personal
				property to be used in carrying out this section, including to be used in
				connection with the construction or other expenses of the memorial.</text>
						</paragraph><paragraph changed="deleted" committee-id="SSEG00" id="id3AB8312626814A87B36BB6A1B66F6C05" reported-display-style="strikethrough"><enum>(3)</enum><header>Federal
				cooperation</header><text>To ensure the overall success of the efforts of the
				Commission, the Commission may call upon any Federal department or agency to
				assist in and give support to the Commission. The head of each Federal
				department or agency shall furnish such information or assistance requested by
				the Commission, as appropriate, unless prohibited by law.</text>
						</paragraph><paragraph changed="added" committee-id="SSEG00" id="id2D91823329CC490EADC74E06BC548ABE" reported-display-style="italic"><enum>(3)</enum><header>Federal
				cooperation</header><text>At the request of the Commission, a Federal
				department or agency may provide any information or other assistance to the
				Commission that the head of the Federal department or agency determines to be
				appropriate.</text>
						</paragraph><paragraph id="idA54047EFEF404F36A5C2D748461C65CB"><enum>(4)</enum><header>Powers of
				members and agents</header>
							<subparagraph id="idBC6C54FF2F044966A94886772E490523"><enum>(A)</enum><header>In
				general</header><text>If authorized by the Commission, any member or agent of
				the Commission may take any action that the Commission is authorized to take
				under this section.</text>
							</subparagraph><subparagraph id="idA10FD16689974C4AB46FB6287E429EDF"><enum>(B)</enum><header>Architect</header><text>The
				Commission may appoint an architect as an agent of the Commission to—</text>
								<clause id="id347FF95E94CA4F80A0510A1BED61F68C"><enum>(i)</enum><text>represent the
				Commission on various governmental source selection and planning boards on the
				selection of the firms that will design and construct the memorial; and</text>
								</clause><clause id="id924DF79D464647C4B52074889357DF3C"><enum>(ii)</enum><text>perform other
				duties as designated by the Chairperson of the Commission.</text>
								</clause></subparagraph><subparagraph id="id5315CEB0FB0D4F33B984AE4290DCA700"><enum>(C)</enum><header>Treatment</header><text>An
				authorized member or agent of the Commission (including an individual appointed
				under subparagraph (B)) providing services to the Commission shall be
				considered an employee of the Federal Government in the performance of those
				services for the purposes of chapter 171 of title 28, United States Code,
				relating to tort claims.</text>
							</subparagraph></paragraph><paragraph id="idC6390252A29A42CEA1864724A22C6EE6"><enum>(5)</enum><header>Travel</header><text>Each
				member of the Commission shall be allowed travel expenses, including per diem
				in lieu of subsistence, at rates authorized for employees of agencies under
				subchapter I of chapter 57 of title 5, United States Code, while away from
				their homes or regular places of business in the performance of services for
				the Commission.</text>
						</paragraph></subsection><after-quoted-block>;
				</after-quoted-block></quoted-block>
			</paragraph><paragraph id="id735A94DA15074C749B27ABA932790613"><enum>(2)</enum><text>by redesignating
			 subsection (o) as subsection (q); and</text>
			</paragraph><paragraph id="ID3c1e8a1e991b439b86b44243fe848a71"><enum>(3)</enum><text>by adding at the
			 end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id29016FA27C1A48E3A4227AF7A402ED20" style="OLC">
					<subsection id="ID0ab65d8c564f48949bbbd90c51f9aea7"><enum>(o)</enum><header>Staff and
				support services</header>
						<paragraph id="ID087e80e47a6e4f1e95e423740c94b687"><enum>(1)</enum><header>Executive
				director</header><text>There shall be an Executive Director appointed by the
				Commission to be paid at a rate not to exceed the maximum rate of basic pay for
				level IV of the Executive Schedule.</text>
						</paragraph><paragraph id="IDc91a5ad100f04c79a069150ae3bc1632"><enum>(2)</enum><header>Staff</header>
							<subparagraph id="id5453B506F862423291EB4B0E96ED036C"><enum>(A)</enum><header>In
				general</header><text>The staff of the Commission may be appointed and
				terminated without regard to the provisions of title 5, United States Code,
				governing appointments in the competitive service, and may be paid without
				regard to the provisions of chapter 51 and subchapter III of chapter 53 of that
				title, relating to classification and General Schedule pay rates, except that
				an individual appointed under this paragraph may not receive pay in excess of
				the maximum rate of basic pay for GS–15 of the General Schedule.</text>
							</subparagraph><subparagraph id="id8BB68C02A35246108283FF4F8322811C"><enum>(B)</enum><header>Senior
				staff</header><text>Notwithstanding subparagraph (A), not more than 3 staff
				employees of the Commission (in addition to the Executive Director) may be paid
				at a rate not to exceed the maximum rate of basic pay for level IV of the
				Executive Schedule</text>
							</subparagraph></paragraph><paragraph changed="deleted" committee-id="SSEG00" id="IDdd1d7b6dcc594c2bbe86eca96c62b5c6" reported-display-style="strikethrough"><enum>(3)</enum><header>Staff of Federal
				agencies</header><text>Upon request by the Chairperson of the Commission, the
				Vice-Chairperson, or the Executive Director, the head of any Federal department
				or agency may detail, on a nonreimbursable basis, any of the personnel of the
				department or agency to the Commission to assist the Commission to carry out
				its duties under this section.</text>
						</paragraph><paragraph changed="added" committee-id="SSEG00" id="id5599607861764657B4C34EE8851C3450" reported-display-style="italic"><enum>(3)</enum><header>Staff of federal
				agencies</header><text>On request of the Commission, the head of any Federal
				department or agency may detail any of the personnel of the department or
				agency to the Commission to assist the Commission to carry out its duties under
				this section.</text>
						</paragraph><paragraph id="idE7FFCED5F98C4CA89C292E529B5C2951"><enum>(4)</enum><header>Federal
				support</header><text>The Commission shall obtain administrative and support
				services from the General Services Administration on a reimbursable basis. The
				Commission may use all contracts, schedules, and acquisition vehicles allowed
				to external clients through the General Services Administration.</text>
						</paragraph><paragraph id="ID16048e27b4c54fe99e46900115293663"><enum>(5)</enum><header>Cooperative
				agreements</header><text>The Commission may enter into cooperative agreements
				with Federal agencies, State, local, tribal and international governments, and
				private interests and organizations which will further the goals and purposes
				of this section.</text>
						</paragraph><paragraph id="ID04d741c6b4d244a48fac3794bdaeb27e"><enum>(6)</enum><header>Temporary,
				intermittent, and part-time services</header>
							<subparagraph id="id9028DBDD2FE04CB6A7483406CEBE03CD"><enum>(A)</enum><header>In
				general</header><text>The Commission may obtain temporary, intermittent, and
				part-time services under section 3109 of title 5, United States Code, at rates
				not to exceed the maximum annual rate of basic pay payable under section 5376
				of that title.</text>
							</subparagraph><subparagraph id="id0FC1801AAAD3416299628EF481E370C0"><enum>(B)</enum><header>Non-applicability
				to certain services</header><text>This paragraph shall not apply to services
				under subsection (j)(1)(A)(iv).</text>
							</subparagraph></paragraph><paragraph id="IDfd8d9b43f1ad483eb6d7033421d3136c"><enum>(7)</enum><header>Volunteer
				services</header>
							<subparagraph id="id2BDEB5D6607849A78CD0C8A5A26DA3DD"><enum>(A)</enum><header>In
				general</header><text>Notwithstanding section 1342 of title 31, United States
				Code, the Commission may accept and utilize the services of volunteers serving
				without compensation.</text>
							</subparagraph><subparagraph id="id67FDB97093F44AA49F67A727EBF56D04"><enum>(B)</enum><header>Reimbursement</header><text>The
				Commission may reimburse such volunteers for local travel and office supplies,
				and for other travel expenses, including per diem in lieu of subsistence, as
				authorized by section 5703 of title 5, United States Code.</text>
							</subparagraph><subparagraph changed="deleted" committee-id="SSEG00" id="id761D222326D34FAF91F5572DDCC71664" reported-display-style="strikethrough"><enum>(C)</enum><header>Treatment</header><text>A
				person providing volunteer services to the Commission shall be considered an
				employee of the Federal government in the performance of those services for the
				purposes of—</text>
								<clause id="idFFD0DD83A4B5408BA6546AA8F7AC4AE5"><enum>(i)</enum><text>chapter 81 of
				title 5, United States Code, relating to compensation for work-related
				injuries;</text>
								</clause><clause id="id48ACA70DC5FC496D99390F1B0219D6C7"><enum>(ii)</enum><text>chapter 171 of
				title 28, United States Code, relating to tort claims; and</text>
								</clause><clause id="id4A3FB1A755C3446C870ADA706CB021E3"><enum>(iii)</enum><text>chapter 11 of
				title 18, United States Code, relating to conflicts of interest.</text>
								</clause></subparagraph><subparagraph changed="added" committee-id="SSEG00" id="id0721FAB052DB45DFB077E55AA28662D9" reported-display-style="italic"><enum>(C)</enum><header>Liability</header>
								<clause id="id12F65A459C804946A7BFE171DE34D21B"><enum>(i)</enum><header>In
				general</header><text>Subject to clause (ii), a volunteer described in
				subparagraph (A) shall be considered to be a volunteer for purposes of the
				Volunteer Protection Act of 1997 (42 U.S.C. 14501 et seq.).</text>
								</clause><clause id="idE0AA3E9D08614EAE8EAF024827D889CC"><enum>(ii)</enum><header>Exception</header><text>Section
				4(d) of the Volunteer Protection Act of 1997 (42 U.S.C. 14503(d)) shall not
				apply for purposes of a claim against a volunteer described in subparagraph
				(A).</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID8f2e44264c25471daefb8eadcd9f671b"><enum>(p)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated such
				sums as necessary to carry out this
				section.</text>
