		<section commented="no" display-inline="no-display-inline" id="id13B97AC51A6341E2848B57C4F2DF3B71" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Restoration of import and entry
			 agricultural inspection functions to the Department of Agriculture</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDf5235ca3e88c4e9baa2ffcb9aadc7cda"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal of transfer of
			 functions</header><text display-inline="yes-display-inline">Section 421 of the
			 Homeland Security Act of 2002 (6 U.S.C. 231) is repealed.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID0689b96271b444ca8c60c8861fa44aca"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment to function of
			 secretary of homeland security</header><text display-inline="yes-display-inline">Section 402 of the Homeland Security Act of
			 2002 (6 U.S.C. 202) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDff333692904f4185bb2907218dc2b319"><enum>(1)</enum><text display-inline="yes-display-inline">by striking paragraph (7); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID909e1bd1244f4d2cb8b5569231a65d93"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating paragraph (8) as paragraph
			 (7).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0b2cb45334b04058ae269126e40b357e"><enum>(c)</enum><header display-inline="yes-display-inline">Transfer agreement</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idDA4937B9DBB04F1CAF8EC5B9B2ED2221"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than the effective date described
			 in subsection (g), the Secretary of Agriculture and the Secretary of Homeland
			 Security shall enter into an agreement to effectuate the return of functions
			 required by the amendments made by this section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDAC86AE18C0646FBB084874B66E11B24"><enum>(2)</enum><header display-inline="yes-display-inline">Use of certain employees</header><text display-inline="yes-display-inline">The agreement may include authority for the
			 Secretary of Agriculture to use employees of the Department of Homeland
			 Security to carry out authorities delegated to the Animal and Plant Health
			 Inspection Service regarding the protection of domestic livestock and
			 plants.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID90ad093310b847e8861a1c9fd83bbbf7"><enum>(d)</enum><header display-inline="yes-display-inline">Restoration of Department of Agriculture
			 employees</header><text display-inline="yes-display-inline">Not later than the
			 effective date described in subsection (e), all full-time equivalent positions
			 of the Department of Agriculture transferred to the Department of Homeland
			 Security under section 421(g) of the Homeland Security Act of 2002 (6 U.S.C.
			 231(g)) (as in effect on the day before the effective date described in
			 subsection (g)) shall be restored to the Department of Agriculture.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idFBF40DC9E8F448FDA3854C717B91D013"><enum>(e)</enum><header display-inline="yes-display-inline">Authority of APHIS</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idD124B56CCEED4E83BDE166A564F0B794"><enum>(1)</enum><header display-inline="yes-display-inline">Establishment of program</header><text display-inline="yes-display-inline">The Secretary of Agriculture shall
			 establish within the Animal and Plant Health Inspection Service a program, to
			 be known as the <quote>International Agricultural Inspection Program</quote>,
			 under which the Administrator of the Animal and Plant Health Inspection Service
			 (referred to in this subsection as the <term>Administrator</term>) shall carry
			 out import and entry agricultural inspections.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idCCE8EC8496CF4CFC948B02F23DBB095E"><enum>(2)</enum><header display-inline="yes-display-inline">Information gathering and
			 inspections</header><text display-inline="yes-display-inline">In carrying out
			 the program under paragraph (1), the Administrator shall have full access
			 to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB75D40CB28FB464E8A7FF161BE156A2C"><enum>(A)</enum><text display-inline="yes-display-inline">each secure area of any terminal for
			 screening passengers or cargo under the control of the Department of Homeland
			 Security on the day before the date of enactment of this Act for purposes of
			 carrying out inspections and gathering information; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF39FA160FFC0474BBA3A21E5B2228DBB"><enum>(B)</enum><text display-inline="yes-display-inline">each database (including any database
			 relating to cargo manifests or employee and business records) under the control
			 of the Department of Homeland Security on the day before the date of enactment
			 of this Act for purposes of gathering information.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2CD38C7DCBAB4B76B5A67987AA4977D5"><enum>(3)</enum><header display-inline="yes-display-inline">Inspection alerts</header><text display-inline="yes-display-inline">The Administrator may issue inspection
			 alerts, including by indicating cargo to be held for immediate
			 inspection.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id2DBDB0DDC62C4BB1886BFBFA7FE644DB"><enum>(4)</enum><header display-inline="yes-display-inline">Inspection user fees</header><text display-inline="yes-display-inline">The Administrator may, as
			 applicable—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7B240CDDD27245B9B126C2D7D7738977"><enum>(A)</enum><text display-inline="yes-display-inline">continue to collect any agricultural
			 quarantine inspection user fee; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8FB831C554284D90B74D6EF2E3B5E6A3"><enum>(B)</enum><text display-inline="yes-display-inline">administer any reserve account for the
			 fees.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id45DEF825C2D5480399E843B89ACD7F5C"><enum>(5)</enum><header display-inline="yes-display-inline">Career track program</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id4A39444318224D4D9A6B913383B934EA"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Administrator shall establish a
			 program, to be known as the <quote>import and entry agriculture inspector
			 career track program</quote>, to support the development of long-term career
			 professionals with expertise in import and entry agriculture inspection.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id591CA12BF48D4C908A3C7FC1958466A6"><enum>(B)</enum><header display-inline="yes-display-inline">Strategic plan and training</header><text display-inline="yes-display-inline">In carrying out the program under this
			 paragraph, the Administrator, in coordination with the Secretary of
			 Agriculture, shall—</text>
						<clause commented="no" display-inline="no-display-inline" id="idD57E51C01B2147DDB01810815BA47294"><enum>(i)</enum><text display-inline="yes-display-inline">develop a strategic plan to incorporate
			 import and entry agricultural inspectors into the infrastructure protecting
			 food, fiber, forests, bioenergy, and the environment of the United States from
			 animal and plant pests, diseases, and noxious weeds; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id58DCEF82F9F34334A08845266D8F3EF4"><enum>(ii)</enum><text display-inline="yes-display-inline">as part of the plan under clause (i),
			 provide training for import and entry agricultural inspectors participating in
			 the program not less frequently than once each year to improve inspection
			 skills.</text>
						</clause></subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id8B6E2B76CDF6477EAC1F048E279AD72C"><enum>(f)</enum><header display-inline="yes-display-inline">Duties of Secretary</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id05E2A95E66F245C08BFEA89134C73DE3"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary of Agriculture (referred to
			 in this subsection as the <term>Secretary</term>) shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idAE352CE6CA094B4285E4F11A327BA901"><enum>(A)</enum><text display-inline="yes-display-inline">develop standard operating procedures for
			 inspection, monitoring, and auditing relating to import and entry agricultural
			 inspections, in accordance with recommendations from the Comptroller General of
			 the United States and reports of interagency advisory groups, as applicable;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idA12F1349E0CF487EBFF2DD989362395C"><enum>(B)</enum><text display-inline="yes-display-inline">ensure that the Animal and Plant Health
			 Inspection Service has a national electronic system with real-time tracking
			 capability for monitoring, tracking, and reporting inspection activities of the
			 Service.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1982AA06EC8047EEA1D404687A0AE307"><enum>(2)</enum><header display-inline="yes-display-inline">Federal and State cooperation</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC0EA9B57EAB04CCCB6202A3E7225F483"><enum>(A)</enum><header display-inline="yes-display-inline">Communication system</header><text display-inline="yes-display-inline">The Secretary shall develop and maintain an
			 integrated, real-time communication system with respect to import and entry
			 agricultural inspections to alert State departments of agriculture of
			 significant inspection findings of the Animal and Plant Health Inspection
			 Service.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9CBA1B446C254D6AB403FE1A0D7BA9B1"><enum>(B)</enum><header display-inline="yes-display-inline">Advisory committee</header>
						<clause commented="no" display-inline="no-display-inline" id="idBE89728DF7D84530BA708073DF5DCB3C"><enum>(i)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Secretary shall establish a committee,
			 to be known as the <quote>International Trade Inspection Advisory
			 Committee</quote> (referred to in this subparagraph as the
			 <term>committee</term>), to advise the Secretary on policies and other issues
			 relating to import and entry agricultural inspection.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idBA44C193855747D2A228D92828FFB8DD"><enum>(ii)</enum><header display-inline="yes-display-inline">Model</header><text display-inline="yes-display-inline">In establishing the committee, the
			 Secretary shall use as a model the Agricultural Trade Advisory
			 Committee.</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idABFC771667E94EF4BD902E0E96DB7258"><enum>(iii)</enum><header display-inline="yes-display-inline">Membership</header><text display-inline="yes-display-inline">The committee shall be composed of members
			 representing—</text>
							<subclause commented="no" display-inline="no-display-inline" id="id77696485782D443DA866FC184A8D040D"><enum>(I)</enum><text display-inline="yes-display-inline">State departments of agriculture;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idFF3AA244990241A4B5F555CE508EC529"><enum>(II)</enum><text display-inline="yes-display-inline">directors of ports and airports in the
			 United States;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idEA85047DD53242569EF18334C8A475E4"><enum>(III)</enum><text display-inline="yes-display-inline">the transportation industry;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idF1AD03ED0A244D0B8E0BA2ABEA160D64"><enum>(IV)</enum><text display-inline="yes-display-inline">the public; and</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="idDF2DECC737BD4AD7A6F67727A85E829C"><enum>(V)</enum><text display-inline="yes-display-inline">such other entities as the Secretary
			 determines to be appropriate.</text>
							</subclause></clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75B9ABA1F85C4DCD8CCE5B922ECC59F0"><enum>(3)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not less frequently than once each year,
			 the Secretary shall submit to Congress a report containing an assessment
			 of—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id78F0774899654D789B73C7E154AC0A85"><enum>(A)</enum><text display-inline="yes-display-inline">the resource needs for import and entry
			 agricultural inspection, including the number of inspectors required;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id12B9ED8D39F848D6A8893DC1539605D8"><enum>(B)</enum><text display-inline="yes-display-inline">the adequacy of—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7DB9F2D807444E3AB49BB6BC961033B4"><enum>(i)</enum><text display-inline="yes-display-inline">inspection and monitoring procedures and
			 facilities in the United States; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id62E070F2438B419986BC7F63A0038486"><enum>(ii)</enum><text display-inline="yes-display-inline">the strategic plan developed under
			 subsection (e)(5)(B)(i); and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id83657EC3A3294B769E000B2A66C37AEB"><enum>(C)</enum><text display-inline="yes-display-inline">new and potential technologies and
			 practices, including recommendations regarding the technologies and practices,
			 to improve import and entry agricultural inspection.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDAB876B27E1340CEABE0E2A2FBD56EA7"><enum>(4)</enum><header display-inline="yes-display-inline">Funding</header><text display-inline="yes-display-inline">The Secretary shall pay the costs of each
			 import and entry agricultural inspector employed by the Animal and Plant Health
			 Inspection Service—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idBBC85ABF7BC941EBBE1EA1BBAD21ACEC"><enum>(A)</enum><text display-inline="yes-display-inline">from amounts made available to the
			 Department of Agriculture for the applicable fiscal year; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id4EAFB90C0A8F44B3BCF8D230E76EC535"><enum>(B)</enum><text display-inline="yes-display-inline">if amounts described in subparagraph (A)
			 are unavailable, from amounts of the Commodity Credit Corporation.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6d2fad2706e44db5b3f4bef62cea74b4"><enum>(g)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section take effect on the date that is 180 days after the date of
			 enactment of this Act.</text>
