		<legis-type display="yes">A BILL</legis-type>
		<official-title display="yes">To ensure and foster continued patient
		  safety and quality of care by making the antitrust laws apply to negotiations
		  between groups of independent pharmacies and health plans and health insurance
		  issuers in the same manner as such laws apply to collective bargaining by labor
		  organizations under the National Labor Relations Act.</official-title>

		<section commented="no" display-inline="no-display-inline" id="HB430052626D44801B00274F86591AFA0" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Community Pharmacy Fairness Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="H556FD638C9C847CABDADB0CEB3D49E2F" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Application of the antitrust laws to
			 independent pharmacies negotiating with health plans</header>
			<subsection commented="no" display-inline="no-display-inline" id="HA2D207E1DC3E4D2B86F9015999D521F5"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any independent pharmacies who are engaged
			 in negotiations with a health plan regarding the terms of any contract under
			 which the pharmacies provide health care items or services for which benefits
			 are provided under such plan shall, in connection with such negotiations, be
			 entitled to the same treatment under the antitrust laws as the treatment to
			 which bargaining units which are recognized under the National Labor Relations
			 Act are entitled in connection with such collective bargaining. Such a pharmacy
			 shall, only in connection with such negotiations, be treated as an employee
			 engaged in concerted activities and shall not be regarded as having the status
			 of an employer, independent contractor, managerial employee, or
			 supervisor.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H790837DEEE7B4F19BA868418E974CDC6"><enum>(b)</enum><header display-inline="yes-display-inline">Protection for good faith
			 actions</header><text display-inline="yes-display-inline">Actions taken in good
			 faith reliance on subsection (a) shall not be the subject under the antitrust
			 laws of criminal sanctions nor of any civil damages, fees, or penalties beyond
			 actual damages incurred.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H0AFCF89A0B1E4952876CD66280611752"><enum>(c)</enum><header display-inline="yes-display-inline">Limitation</header>
				<paragraph commented="no" display-inline="no-display-inline" id="H5D398704C6B544E2B0F05F5D96818EFC"><enum>(1)</enum><header display-inline="yes-display-inline">No new right for collective cessation of
			 service</header><text display-inline="yes-display-inline">The exemption
			 provided in subsection (a) shall not confer any new right to participate in any
			 collective cessation of service to patients not already permitted by existing
			 law.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H3C9A8EBAB7F046BCBC92FE005E37FE26"><enum>(2)</enum><header display-inline="yes-display-inline">No change in National Labor Relations
			 Act</header><text display-inline="yes-display-inline">This section applies only
			 to independent pharmacies excluded from the National Labor Relations Act.
			 Nothing in this section shall be construed as changing or amending any
			 provision of the National Labor Relations Act, or as affecting the status of
			 any group of persons under that Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H0906ED2B473C4559BFC004B8B77E5B37"><enum>(d)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The exemption provided
			 in subsection (a) shall apply to conduct occurring beginning on the date of the
			 enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H115DE80FD8E440E68B6475D34ED8B174"><enum>(e)</enum><header display-inline="yes-display-inline">Limitation on exemption</header><text display-inline="yes-display-inline">Nothing in this section shall exempt from
			 the application of the antitrust laws any agreement or otherwise unlawful
			 conspiracy that excludes, limits the participation or reimbursement of, or
			 otherwise limits the scope of services to be provided by any independent
			 pharmacy or group of independent pharmacies with respect to the performance of
			 services that are within their scope of practice as defined or permitted by
			 relevant law or regulation.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H0E3561755E4C4F1BB33D9CC3C14903C2"><enum>(f)</enum><header display-inline="yes-display-inline">No effect on title VI of
			 <act-name parsable-cite="CRA64">Civil Rights Act of
			 1964</act-name></header><text display-inline="yes-display-inline">Nothing in
			 this section shall be construed to affect the application of title VI of the
			 <act-name parsable-cite="CRA64">Civil Rights Act of 1964</act-name>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="H510A3FE2B56C404F9DDBDD43BE41E76D"><enum>(g)</enum><header display-inline="yes-display-inline">No application to Federal
			 programs</header><text display-inline="yes-display-inline">Nothing in this
			 section shall apply to negotiations between independent pharmacies and health
			 plans pertaining to benefits provided under any of the following:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="HDF02D0DA546043E38C35A74C21C2FC1C"><enum>(1)</enum><text display-inline="yes-display-inline">The Medicaid Program under title XIX of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396 et
			 seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H4565875DDC5C409CA5F8E0ABABC8B1C"><enum>(2)</enum><text display-inline="yes-display-inline">The SCHIP program under title XXI of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1397aa
			 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HF5C314AC076C437BA21CAD277F61D4BF"><enum>(3)</enum><text display-inline="yes-display-inline">Chapter 55 of title 10, United States Code
			 (relating to medical and dental care for members of the uniformed
			 services).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H46DD378F2F994B31986B24D025FB26F"><enum>(4)</enum><text display-inline="yes-display-inline">Chapter 17 of title 38, United States Code
			 (relating to Veterans’ medical care).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H463976DF345541A39561F7BF9F4BFEC"><enum>(5)</enum><text display-inline="yes-display-inline">Chapter 89 of title 5, United States Code
			 (relating to the Federal employees’ health benefits program).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HD7DD4BF9B7D1419BA22D3CFF1C4D0037"><enum>(6)</enum><text display-inline="yes-display-inline">The <act-name parsable-cite="IHCIA">Indian
			 Health Care Improvement Act</act-name> (25 U.S.C. 1601 et seq.).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="HABCF3C5D860542068CBF3791DC8D261C"><enum>(h)</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="yes-display-inline">For purposes of this section:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="H5C63A82C9F32461DAA009ECB6E177407"><enum>(1)</enum><header display-inline="yes-display-inline">Antitrust
			 laws</header><text display-inline="yes-display-inline">The term <term>antitrust
			 laws</term>—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="HD56ACF7298AC4083BD351D324BA7CCC"><enum>(A)</enum><text display-inline="yes-display-inline">has the meaning given it in subsection (a)
			 of the first section of the <act-name parsable-cite="CLAY">Clayton
			 Act</act-name> (15 U.S.C. 12(a)), except that such term includes section 5 of
			 the <act-name parsable-cite="FTCA">Federal Trade Commission Act</act-name> (15
			 U.S.C. 45) to the extent such section 5 applies to unfair methods of
			 competition; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H68C81FE955144F86BEB436D3F0641700"><enum>(B)</enum><text display-inline="yes-display-inline">includes any State law similar to the laws
			 referred to in subparagraph (A).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="HB64515354F3C4B6F96AA911B4FF4005C"><enum>(2)</enum><header display-inline="yes-display-inline">Health plan and related terms</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="H88B01398E33D4453B870FFFFF5A0995D"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The term <term>health plan</term> means a
			 group health plan or a health insurance issuer that is offering health
			 insurance coverage.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H670187DB38BC4CA9B4CE11BCBD641D38"><enum>(B)</enum><header display-inline="yes-display-inline">Health insurance coverage; health insurance
			 issuer</header><text display-inline="yes-display-inline">The terms <term>health
			 insurance coverage</term> and <term>health insurance issuer</term> have the
			 meanings given such terms under paragraphs (1) and (2), respectively, of
			 section 733(b) of the <act-name parsable-cite="ERISA">Employee Retirement
			 Income Security Act of 1974</act-name> (29 U.S.C. 1191b(b)).</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H11A37EDD97FF46399BB408661C66F1F6"><enum>(C)</enum><header display-inline="yes-display-inline">Group health plan</header><text display-inline="yes-display-inline">The term <term>group health plan</term> has
			 the meaning given that term in section 733(a)(1) of the
			 <act-name parsable-cite="ERISA">Employee Retirement Income Security Act of
			 1974</act-name> (29 U.S.C. 1191b(a)(1)).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="H77ED0311FC064DD5BFCDDBDE67652BE"><enum>(3)</enum><header display-inline="yes-display-inline">Independent pharmacy</header><text display-inline="yes-display-inline">The term <term>independent pharmacy</term>
			 means a pharmacy which is not owned (or operated) by a publicly traded company.
			 For purposes of the previous sentence, the term <term>publicly traded
			 company</term> means a company that is an issuer within the meaning of section
			 2(a)(7) of the Sarbanes-Oxley Act of 2002 (15 U.S.C. 7201(a)(7)).</text>
