		<official-title>To exclude from admission to the United States aliens who
		  have made investments contributing to the enhancement of the ability of Cuba to
		  develop its petroleum resources, and for other purposes.</official-title>

		<section id="H59E73F97503F4851B9AA37EB8900C5B0" section-type="section-one"><enum>1.</enum><header>Statement of
			 policy</header><text display-inline="no-display-inline">It shall be the policy
			 of the United States to—</text>
			<paragraph id="HD990BE1D450F4047B22777AEF966D407"><enum>(1)</enum><text display-inline="yes-display-inline">undertake the necessary measures to deny
			 the Cuban regime the financial resources to engage in activities that
			 threaten—</text>
				<subparagraph id="H8BBB5B48A3094BB59FD5165D352651E7"><enum>(A)</enum><text>United States
			 national security, its interests and its allies;</text>
				</subparagraph><subparagraph id="H3BBE5FFF4F1744D80002FA00013C4759"><enum>(B)</enum><text display-inline="yes-display-inline">the environment and natural resources of
			 the submerged lands of Cuba’s northern coast and Florida’s unique maritime
			 environment; and</text>
				</subparagraph><subparagraph id="HED78F058EF2440BA9988DF00EBFB6389"><enum>(C)</enum><text>that prolong the
			 dictatorship that oppresses the Cuban people; and</text>
				</subparagraph></paragraph><paragraph id="HC4814754E0C04BF8B7FA8802791D13C1"><enum>(2)</enum><text display-inline="yes-display-inline">deter foreign investments that would
			 enhance the ability of the Cuban regime to develop its petroleum
			 resources.</text>
			</paragraph></section><section id="H21F45C2238234BA59469497753A068C4" section-type="subsequent-section"><enum>2.</enum><header>Exclusion of certain
			 aliens</header>
			<subsection id="HCA6E02EF4A314C6986DB30AC76308DD6"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The Cuban Liberty and
			 Democratic Solidarity (LIBERTAD) Act of 1996 (22 U.S.C. 6021 et seq.) is
			 amended by inserting after section 401 the following:</text>
				<quoted-block display-inline="no-display-inline" id="H8306BF9D04304FD7ACD7C27BAA85379F" style="OLC">
					<section id="H098FCBDDC756411E9587D2C178D3E253"><enum>402.</enum><header>Exclusion from
				the United States of aliens who contribute to the ability of Cuba to develop
				petroleum resources off of Cuba's northern coast</header>
						<subsection id="HEE88B4F172064249A4727437996E163B"><enum>(a)</enum><header>In
				general</header><text>The Secretary of State shall deny a visa to, and the
				Secretary of Homeland Security shall exclude from the United States, any alien
				who the Secretary of State determines is a person who—</text>
							<paragraph id="H99B58636F1CC40BAA995BE2601AC0002"><enum>(1)</enum><text>is an officer or
				principal of an entity, or a shareholder who owns a controlling interest in an
				entity, that, on or after May 2, 2006, makes an investment that equals or
				exceeds $1,000,000 (or any combination of investments that in the aggregate
				equals or exceeds $1,000,000 in any 12-month period), that contributes to the
				enhancement of Cuba’s ability to develop petroleum resources of the submerged
				lands of Cuba’s northern coast; or</text>
							</paragraph><paragraph id="H1D42424CC6914BC5A5B52F5596C2849B"><enum>(2)</enum><text>is a spouse, minor
				child, or agent of a person described in paragraph (1).</text>
							</paragraph></subsection><subsection id="HE25A5DCAC6C6444084C060A505296CC6"><enum>(b)</enum><header>Waiver</header><text>The
				Secretary of State may waive the application of subsection (a) if the Secretary
				certifies and reports to the appropriate congressional committees, on a
				case-by-case basis, that the admission to the United States of a person
				described in subsection (a)—</text>
							<paragraph id="HE5288F1DD3C64D72A6149219BF63CD16"><enum>(1)</enum><text>is necessary for
				critical medical reasons or for purposes of litigation of an action under title
				III; or</text>
							</paragraph><paragraph commented="no" id="HD1390F1C6C69401B9FDF956B79012B16"><enum>(2)</enum><text>is appropriate if
				the requirements of sections 203, 204, and 205 have been satisfied.</text>
							</paragraph></subsection><subsection id="HE2A0FFEEDB5647B4BBD833DA63AAA703"><enum>(c)</enum><header>Definitions</header><text>In
				this section:</text>
							<paragraph commented="no" id="HE58AB212EBC34D0996E64BFF5774B483"><enum>(1)</enum><header>Develop</header><text>The
				term <term>develop</term>, with respect to petroleum resources, means the
				exploration for, or the extraction, refining, or transportation by pipeline or
				other means of, petroleum resources.</text>
							</paragraph><paragraph id="H80C6F791AC6143BCB92C532702AA1F59"><enum>(2)</enum><header>Investment</header><text>The
				term <term>investment</term> means any of the following activities if such
				activity is undertaken pursuant to an agreement, or pursuant to the exercise of
				rights under such an agreement, that is entered into with the Government of
				Cuba (or any agency or instrumentality thereof) or a nongovernmental entity in
				Cuba, on or after May 2, 2006:</text>
								<subparagraph id="HC7E7E4481C0B4F2295D58FDF8FDE97AD"><enum>(A)</enum><text display-inline="yes-display-inline">The entry into a contract that includes
				responsibility for the development of petroleum resources of the submerged
				lands of Cuba’s northern coast, or the entry into a contract providing for the
				general supervision and guarantee of another person’s performance of such a
				contract.</text>
								</subparagraph><subparagraph id="H70F50AF02E85444FB27D5BADF3315B2C"><enum>(B)</enum><text>The purchase of a
				share of ownership, including an equity interest, in that development.</text>
								</subparagraph><subparagraph id="H6949893CDC5A47EF8BC3FE5819A25D61"><enum>(C)</enum><text>The entry into a
				contract providing for the participation in royalties, earnings, or profits in
				that development, without regard to the form of the participation.</text>
								</subparagraph><subparagraph id="HA0149751D1424619AC8E75422C2E257D"><enum>(D)</enum><text display-inline="yes-display-inline">The entry into, performance, or financing
				of a contract to sell or purchase goods, services, or technology related to
				that development.</text>
								</subparagraph></paragraph><paragraph id="H0EB277C07AA44C61BA47E1B7DC69DFC2"><enum>(3)</enum><header>Petroleum
				resources</header><text>The term <term>petroleum resources</term> includes
				petroleum and natural gas
				resources.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection id="H12584A1AC9064FDF96B72D24FE9C041C"><enum>(b)</enum><header>Effective
			 date</header><text>The amendment made by this section applies to aliens seeking
			 admission to the United States on or after the date of the enactment of this
			 Act.</text>
			</subsection></section><section commented="no" id="HBB6F4C7B93224CF1BC4C008092B596BF"><enum>3.</enum><header>Imposition of
			 sanctions</header>
			<subsection commented="no" id="H67A76B0DF1584353BFAD01766459CCA"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The President shall
			 impose two or more of the sanctions described in subsection (b) if the
			 President determines that a person has, on or after May 2, 2006, made an
			 investment that equals or exceeds $1,000,000 (or any combination of investments
			 that in the aggregate equals or exceeds $1,000,000 in any 12-month period) that
			 contributes to the enhancement of Cuba’s ability to develop petroleum resources
			 of the submerged lands of Cuba’s northern coast.</text>
			</subsection><subsection commented="no" id="H0C4AC6C8EC1D4A5599EB2492D68C81AD"><enum>(b)</enum><header>Sanctions
			 described</header><text display-inline="yes-display-inline">The sanctions to be
			 imposed on a sanctioned person under this section are as follows:</text>
				<paragraph commented="no" id="HF14E09FC35F1471B86CEE2A04067C93"><enum>(1)</enum><header>Export-Import
			 Bank assistance for exports to sanctioned persons</header><text display-inline="yes-display-inline">The President may direct the Export-Import
			 Bank of the United States not to give approval to the issuance of any
			 guarantee, insurance, extension of credit, or participation in the extension of
			 credit in connection with the export of any goods or services to any sanctioned
			 person.</text>
				</paragraph><paragraph commented="no" id="HE3F5F1CF7E4E4A76B6E74FEB9186A791"><enum>(2)</enum><header>Export
			 sanction</header><text display-inline="yes-display-inline">The President may
			 order the United States Government not to issue any specific license and not to
			 grant any other specific permission or authority to export any goods or
			 technology to a sanctioned person under—</text>
					<subparagraph commented="no" id="H9394583E6CE9410D802699E2A59028A7"><enum>(A)</enum><text display-inline="yes-display-inline">the Export Administration Act of 1979 (50
			 U.S.C. App. 2401 et seq.);</text>
					</subparagraph><subparagraph commented="no" id="HDF00F68D939D467983491D4928801124"><enum>(B)</enum><text display-inline="yes-display-inline">the Arms Export Control Act (22 U.S.C. 2751
			 et seq.);</text>
					</subparagraph><subparagraph commented="no" id="H2047516AE01B4864B6BE7BBA5D239FB9"><enum>(C)</enum><text display-inline="yes-display-inline">the Atomic Energy Act of 1954 (42 U.S.C.
			 2011 et seq.); or</text>
					</subparagraph><subparagraph commented="no" id="H5D1E8261E5F544248508B32E3B03174"><enum>(D)</enum><text display-inline="yes-display-inline">any other statute that requires the prior
			 review and approval of the United States Government as a condition for the
			 export or reexport of goods or services.</text>
					</subparagraph></paragraph><paragraph commented="no" id="H52BCFE3930EC4B3A9C1F002F04EC4900"><enum>(3)</enum><header>Loans from
			 United States financial institutions</header><text display-inline="yes-display-inline">The United States Government may prohibit
			 any United States financial institution from making loans or providing credits
			 to any sanctioned person totaling more than $10,000,000 in any 12-month period
			 unless such person is engaged in activities to relieve human suffering and the
			 loans or credits are provided for such activities.</text>
				</paragraph><paragraph commented="no" id="H11406D4D56104CBD8B21D1F3C175ABDF"><enum>(4)</enum><header>Prohibitions on
			 financial institutions</header>
					<subparagraph commented="no" id="id859145BF4AA94AA19B6725E51EDF4018"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">The following
			 prohibitions may be imposed against a sanctioned person that is a financial
			 institution:</text>
						<clause commented="no" id="H203308A72B29417095EC79E600851555"><enum>(i)</enum><header>Prohibition on
			 designation as primary dealer</header><text display-inline="yes-display-inline">Neither the Board of Governors of the
			 Federal Reserve System nor the Federal Reserve Bank of New York may designate,
			 or permit the continuation of any prior designation of, such financial
			 institution as a primary dealer in United States Government debt
			 instruments.</text>
						</clause><clause commented="no" id="HC3B6EEF9F6E847ADB64E3B88B7A9F368"><enum>(ii)</enum><header>Prohibition on
			 service as a repository of government funds</header><text display-inline="yes-display-inline">Such financial institution may not serve as
			 agent of the United States Government or serve as repository for United States
			 Government funds.</text>
						</clause></subparagraph><subparagraph commented="no" id="idFC70077790D14E37BAE563AF3A544A83"><enum>(B)</enum><header>Treatment of
			 sanctions</header><text display-inline="yes-display-inline">The imposition of
			 either sanction under clause (i) or (ii) of subparagraph (A) shall be treated
			 as one sanction for purposes of this section, and the imposition of both such
			 sanctions shall be treated as two sanctions for purposes of this
			 section.</text>
					</subparagraph></paragraph><paragraph commented="no" id="HEFC12C02DA834A52BC26DDFE900C221"><enum>(5)</enum><header>Procurement
			 sanction</header><text display-inline="yes-display-inline">The United States
			 Government may not procure, or enter into any contract for the procurement of,
			 any goods or services from a sanctioned person.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="H6ED29E34175740698042ACACFECC39EF"><enum>(c)</enum><header>Person
			 defined</header><text>In this section, the term <quote>person</quote> includes
			 a foreign subsidiary of a person referred to in subsection (a).</text>
