		<official-title display="yes">To amend title XIX of the Social Security
		  Act to permit States the option to provide Medicaid coverage for low-income
		  individuals infected with HIV.</official-title>

		<section commented="no" display-inline="no-display-inline" id="idFEEECBF1E62C48BEB39C355B040B051A" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Early Treatment for HIV Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID8F52AD882B03480ABB8E3D81040A3853" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Optional medicaid coverage of low-income
			 HIV-infected individuals</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDC2A20FBC88764694A064BDDF6E07287E"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 1902 of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396a)
			 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5D7AAD25967547D88EBF9193DC0ECE3B"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (a)(10)(A)(ii)—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID38E00365D46E45A9AC948177CAFEAF8C"><enum>(A)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of
			 subclause (XVIII);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID269A86D868E940C781BDCC67AF25EB9E"><enum>(B)</enum><text display-inline="yes-display-inline">by adding <quote>or</quote> at the end of
			 subclause (XIX); and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1A63414BD34D4D71ADDDFD58E99CA9A3"><enum>(C)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
						<quoted-block display-inline="no-display-inline" id="ID6A9BCCD4EE134C58AC31E315675F931E" style="OLC">
							<subclause commented="no" display-inline="no-display-inline" id="ID0D21F01FF6FA4CFBABAB6CD5EA78078F"><enum>(XX)</enum><text display-inline="yes-display-inline">who are described in subsection (dd)
				(relating to HIV-infected individuals);</text>
							</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID11DF1E15972A468DB0A5F022FC760E5D"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="IDE94206DD75244C10BC85B5F242488BA3" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID3F484F36EA9F416C91752FB75389C362"><enum>(dd)</enum><text display-inline="yes-display-inline">HIV-infected individuals described in this
				subsection are individuals not described in subsection (a)(10)(A)(i)—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="IDFACFBCAB258C4904A65AB32D12E81663"><enum>(1)</enum><text display-inline="yes-display-inline">who have HIV infection;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8EBF720EC40E4A13B6180409BDEED707"><enum>(2)</enum><text display-inline="yes-display-inline">whose income (as determined under the State
				plan under this title with respect to disabled individuals) does not exceed the
				maximum amount of income a disabled individual described in subsection
				(a)(10)(A)(i) may have and obtain medical assistance under the plan; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9B4A879771B447A0AD854F3E86D9206A"><enum>(3)</enum><text display-inline="yes-display-inline">whose resources (as determined under the
				State plan under this title with respect to disabled individuals) do not exceed
				the maximum amount of resources a disabled individual described in subsection
				(a)(10)(A)(i) may have and obtain medical assistance under the
				plan.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9380F02B96B14BE5A4B57BA6C9865940"><enum>(b)</enum><header display-inline="yes-display-inline">Enhanced
			 Match</header><text display-inline="yes-display-inline">The first sentence of
			 section 1905(b) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1396d(b)) is amended by striking <quote>section
			 1902(a)(10)(A)(ii)(XVIII)</quote> and inserting <quote>subclause (XVIII) or
			 (XX) of section 1902(a)(10)(A)(ii)</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDAEA61DD98B5843F1A32805C4BE8E3AD0"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming Amendments</header><text display-inline="yes-display-inline">Section 1905(a) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396d(a)) is amended in the matter preceding paragraph (1)—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID36C7ABA92D6345A4951EEA0751A0B602"><enum>(1)</enum><text display-inline="yes-display-inline">by striking <quote>or</quote> at the end of
			 clause (xii);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB7612E6D5DBB44C59EE719E3D719E34A"><enum>(2)</enum><text display-inline="yes-display-inline">by adding <quote>or</quote> at the end of
			 clause (xiii); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID11E02CE474214959A45B999BA5C896C1"><enum>(3)</enum><text display-inline="yes-display-inline">by inserting after clause (xiii) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="ID260252AF4910431C8EB9599FF089C193" style="OLC">
						<clause commented="no" display-inline="no-display-inline" id="ID6D94EBA2ADAD4A2E98CA72615262EBF5" indent="up2"><enum>(xiv)</enum><text display-inline="yes-display-inline">individuals described in section
				1902(dd);</text>
						</clause><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEDA3F814CEC24D8EBB0186A0892333D0"><enum>(d)</enum><header display-inline="yes-display-inline">Exemption From Funding Limitation for
			 Territories</header><text display-inline="yes-display-inline">Section 1108(g)
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1308(g)) is amended by adding at the end the following:</text>
				<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="ID3D439A86933A4863AFF3037F8BC1B448" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="IDAB8DB8D8127E4A9291FF377F5B207AFC"><enum>(3)</enum><header display-inline="yes-display-inline">Disregarding medical assistance for
				optional low-income hiv-infected individuals</header><text display-inline="yes-display-inline">The limitations under subsection (f) and
				the previous provisions of this subsection shall not apply to amounts expended
				for medical assistance for individuals described in section 1902(dd) who are
				only eligible for such assistance on the basis of section
				1902(a)(10)(A)(ii)(XX).</text>
					</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB2387A8D660144BD9A7631B690E76F4D"><enum>(e)</enum><header display-inline="yes-display-inline">Effective
			 Date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to calendar quarters beginning on or after the date of
			 the enactment of this Act, without regard to whether or not final regulations
			 to carry out such amendments have been promulgated by such date.</text>
