		<section commented="no" display-inline="no-display-inline" id="idE6CC2FFD37DE47ECB20F66AA99A16C5B" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Openness Promotes Effectiveness in our
			 National Government Act of 2007</short-title></quote> or the
			 <quote><short-title>OPEN Government Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="IDCD81831F94054908993A3D2D46FB5F7C" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID2604384A08B648AAAFC440317AD26BA5"><enum>(1)</enum><text display-inline="yes-display-inline">the Freedom of Information Act was signed
			 into law on July 4, 1966, because the American people believe that—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="ID8988FA2E83244D8B8847016DB5FCBB1F"><enum>(A)</enum><text display-inline="yes-display-inline">our constitutional democracy, our system of
			 self-government, and our commitment to popular sovereignty depends upon the
			 consent of the governed;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC76E8DE7F0CE4B839B766764C60CC3F5"><enum>(B)</enum><text display-inline="yes-display-inline">such consent is not meaningful unless it is
			 informed consent; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE9F23A17E4A84D35B4C4B98573B0168E"><enum>(C)</enum><text display-inline="yes-display-inline">as Justice Black noted in his concurring
			 opinion in Barr v. Matteo (360 U.S. 564 (1959)), <quote>The effective
			 functioning of a free government like ours depends largely on the force of an
			 informed public opinion. This calls for the widest possible understanding of
			 the quality of government service rendered by all elective or appointed public
			 officials or employees.</quote>;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6A4EB09164CA4E8D893DFC928E05633F"><enum>(2)</enum><text display-inline="yes-display-inline">the American people firmly believe that our
			 system of government must itself be governed by a presumption of
			 openness;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34CED584B3A24F8898B871C392C6D70B"><enum>(3)</enum><text display-inline="yes-display-inline">the Freedom of Information Act establishes
			 a <quote>strong presumption in favor of disclosure</quote> as noted by the
			 United States Supreme Court in United States Department of State v. Ray (502
			 U.S. 164 (1991)), a presumption that applies to all agencies governed by that
			 Act;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID51296061BBD6489EA5C738271D05F3B2"><enum>(4)</enum><text display-inline="yes-display-inline"><quote>disclosure, not secrecy, is the
			 dominant objective of the Act,</quote> as noted by the United States Supreme
			 Court in Department of Air Force v. Rose (425 U.S. 352 (1976));</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB5EB95A439B341FC88ADB950318C92A4"><enum>(5)</enum><text display-inline="yes-display-inline">in practice, the Freedom of Information Act
			 has not always lived up to the ideals of that Act; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE54DE6A4CFD64AFEA01806244CC61295"><enum>(6)</enum><text display-inline="yes-display-inline">Congress should regularly review section
			 552 of title 5, United States Code (commonly referred to as the Freedom of
			 Information Act), in order to determine whether further changes and
			 improvements are necessary to ensure that the Government remains open and
			 accessible to the American people and is always based not upon the <quote>need
			 to know</quote> but upon the fundamental <quote>right to know</quote>.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDA3044B86F00B48F78403D53B8F200C11" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Protection of fee status for news
			 media</header><text display-inline="no-display-inline">Section 552(a)(4)(A)(ii)
			 of title 5, United States Code, is amended by adding at the end the
			 following:</text>
			<quoted-block display-inline="no-display-inline" id="ID5EB5498CA21D40A3846892186F57FE7F" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="ID75ACD594822A4B039DAEEF6F10371060"><enum></enum><text display-inline="yes-display-inline">In making a determination of a
				representative of the news media under subclause (II), an agency may not deny
				that status solely on the basis of the absence of institutional associations of
				the requester, but shall consider the prior publication history of the
				requester. Prior publication history shall include books, magazine and
				newspaper articles, newsletters, television and radio broadcasts, and Internet
				publications. If the requestor has no prior publication history or current
				affiliation, the agency shall consider the requestor’s stated intent at the
				time the request is made to distribute information to a reasonably broad
				audience.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="ID56D5072F226945748B744A41FA5F7479" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Recovery of attorney fees and litigation
			 costs</header><text display-inline="no-display-inline">Section 552(a)(4)(E) of
			 title 5, United States Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idE0946278E75C4EB5B20BDE320B4850E5"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(i)</quote> after
			 <quote>(E)</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idBD1C3BCD94D14CF28B1F3FE5915C6866"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="id9D914A5925214DEAA6E01420B4DE280B" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="id305A22F61A4340CCB69B01ECA6BD4E53"><enum>(ii)</enum><text display-inline="yes-display-inline">For purposes of this section, a complainant
				has substantially prevailed if the complainant has obtained relief through
				either—</text>
						<subclause commented="no" display-inline="no-display-inline" id="idDF6C941BAEBF4A719D80C35EDB5A7E6C"><enum>(I)</enum><text display-inline="yes-display-inline">a judicial order, an administrative action,
				or an enforceable written agreement or consent decree; or</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="idAE043333A2C34CDD8557881EBECF0485"><enum>(II)</enum><text display-inline="yes-display-inline">a voluntary or unilateral change in
				position by the opposing party, where the complaintant's claim or defense was
				not
				frivolous.</text>
						</subclause></clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDFBA754AF252D40CCBB129B90199088FF" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Disciplinary actions for arbitrary and
			 capricious rejections of requests</header><text display-inline="no-display-inline">Section 552(a)(4)(F) of title 5, United
			 States Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID173C5CDCBB80443BA375DD8E5C4D6881"><enum>(1)</enum><text display-inline="yes-display-inline">by inserting <quote>(i)</quote> after
			 <quote>(F)</quote>; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEFB5B23C9E514A38A1E8A3A8D48CC92F"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="IDB078D399A0C740DBB476802C6384C88F" style="OLC">
					<clause commented="no" display-inline="no-display-inline" id="ID48FFFBF37AE247A5B6E67B2510323F58" indent="up3"><enum>(ii)</enum><text display-inline="yes-display-inline">The Attorney General shall—</text>
						<subclause commented="no" display-inline="no-display-inline" id="IDB4EC1D8771B84E0DACB2C2788785C06C"><enum>(I)</enum><text display-inline="yes-display-inline">notify the Special Counsel of each civil
				action described under the first sentence of clause (i); and</text>
						</subclause><subclause commented="no" display-inline="no-display-inline" id="ID808A00CEE88D42FA872832474BF3686C"><enum>(II)</enum><text display-inline="yes-display-inline">annually submit a report to Congress on the
				number of such civil actions in the preceding year.</text>
						</subclause></clause><clause commented="no" display-inline="no-display-inline" id="ID48061A7BF8D44C88BBB2997E154F44CA" indent="up3"><enum>(iii)</enum><text display-inline="yes-display-inline">The Special Counsel shall annually submit a
				report to Congress on the actions taken by the Special Counsel under clause
				(i).</text>
					</clause><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="IDBB6EE6145F27479FB50A782E585F04ED" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Time limits for agencies to Act on
			 requests</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDB3D65C0E3F964AEF9A966C2A1A46ED2D"><enum>(a)</enum><header display-inline="yes-display-inline">Time Limits</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID6B95369DFF044AE48FC3BFFF72EA6A7A"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 552(a)(6)(A)(i) of title 5, United
			 States Code, is amended by inserting <quote>, and the 20-day period shall
			 commence on the date on which the request is first received by the agency, and
			 shall not be tolled without the consent of the party filing the request</quote>
			 after <quote>adverse determination</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAF4AB338DEF2456F88B0287732BC0FC5"><enum>(2)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendment made by
			 this subsection shall take effect 1 year after the date of enactment of this
			 Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBB85988C22584FA78DE9049A1423278F"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of Agency Exemptions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDDA8CBB27FC1946659028413EBBC27131"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 552(a)(6) of title 5, United States
			 Code, is amended by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID4797E5F8275D4D9794971FB588DF90FD" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID45415C2BEE2C40CC9AEC6F9EE33323F9" indent="up2"><enum>(G)</enum><clause commented="no" display-inline="yes-display-inline" id="IDA98D3A844C554A64B1105BC5FBFCA294"><enum>(i)</enum><text display-inline="yes-display-inline">If an agency fails to comply with the
				applicable time limit provisions of this paragraph with respect to a request,
				the agency may not assert any exemption under subsection (b) to that request,
				unless disclosure—</text>
								<subclause commented="no" display-inline="no-display-inline" id="ID9BFF24F2934B4A0BAAA2B5CAFE43E75F" indent="up1"><enum>(I)</enum><text display-inline="yes-display-inline">would endanger the national security of the
				United States;</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="ID024294197D774108B5FC0854D39847BF" indent="up1"><enum>(II)</enum><text display-inline="yes-display-inline">would disclose personal private information
				protected by section 552a or proprietary information; or</text>
								</subclause><subclause commented="no" display-inline="no-display-inline" id="IDCB1B4E26D27B4533841F944BB723D5C2" indent="up1"><enum>(III)</enum><text display-inline="yes-display-inline">is otherwise prohibited by law.</text>
								</subclause></clause><clause commented="no" display-inline="no-display-inline" id="IDCFED60DA24A74F5BA4B68F0E0030F739" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">A court may waive the application of clause
				(i) if the agency demonstrates by clear and convincing evidence that there was
				good cause for the failure to comply with the applicable time limit
				provisions.</text>
							</clause></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD387EDE20501459AB5FBEB29CD153AF2"><enum>(2)</enum><header display-inline="yes-display-inline">Effective date and
			 application</header><text display-inline="yes-display-inline">The amendment
			 made by this subsection shall take effect 1 year after the date of enactment of
			 this Act and apply to requests for information under section 552 of title 5,
			 United States Code, filed on or after that effective date.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID3532B8864FFC4B679EE0611398D70161" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Individualized tracking numbers for
			 requests and status information</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDB5CFF23CED194E5C9CA7CDB28B6B3A5A"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 552(a) of title 5, United States
			 Code, is amended by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="IDF3AEF9AD901A44CBB7DA6684C64EBD96" style="OLC">
					<paragraph commented="no" display-inline="no-display-inline" id="ID6A4940697E7444C69D2BEA71DAE1A664" indent="up1"><enum>(7)</enum><text display-inline="yes-display-inline">Each agency shall—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="ID534F29018EA34A5B87A56250C786AF7F"><enum>(A)</enum><text display-inline="yes-display-inline">establish a system to assign an
				individualized tracking number for each request for information under this
				section;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDEB599B3035DA46BA801860397155D9DA"><enum>(B)</enum><text display-inline="yes-display-inline">not later than 10 days after receiving a
				request, provide each person making a request with the tracking number assigned
				to the request; and</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6E0233A790C64DE59F43B42AD94D08BD"><enum>(C)</enum><text display-inline="yes-display-inline">establish a telephone line or Internet
				service that provides information about the status of a request to the person
				making the request using the assigned tracking number, including—</text>
							<clause commented="no" display-inline="no-display-inline" id="IDB76B1CC147574CE88F81F72CB36A4564"><enum>(i)</enum><text display-inline="yes-display-inline">the date on which the agency originally
				received the request; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDBB2538F1C65C4287836D388C18B86B40"><enum>(ii)</enum><text display-inline="yes-display-inline">an estimated date on which the agency will
				complete action on the
				request.</text>
							</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID80D0CEA2DF8C4466BA571055B9EB50FC"><enum>(b)</enum><header display-inline="yes-display-inline">Effective Date and
			 Application</header><text display-inline="yes-display-inline">The amendment
			 made by this section shall take effect 1 year after the date of enactment of
			 this Act and apply to requests for information under section 552 of title 5,
			 United States Code, filed on or after that effective date.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDC2C9609A1F0443E3AD34F323EBA1ED6D" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Specific citations in
			 exemptions</header><text display-inline="no-display-inline">Section 552(b) of
			 title 5, United States Code, is amended by striking paragraph (3) and inserting
			 the following:</text>
			<quoted-block display-inline="no-display-inline" id="ID45D052E7D2A849B6B73FF28B320B573F" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="ID2620C089C6FF418886394C2FE935DC7F"><enum>(3)</enum><text display-inline="yes-display-inline">specifically exempted from disclosure by
				statute (other than section 552b of this title), provided that such
				statute—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID06F30940822A4EE7BA88FEBF724A62D2"><enum>(A)</enum><text display-inline="yes-display-inline">if enacted after the date of enactment of
				the Openness Promotes Effectiveness in our National Government Act of 2005,
				specifically cites to this section; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD11B6D2017CF4DCA99087260EA64CF18"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="IDED041EB691424533B83B2B696B068B64"><enum>(i)</enum><text display-inline="yes-display-inline">requires that the matters be withheld from
				the public in such a manner as to leave no discretion on the issue; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID50F4F9CE8EB74F468EAEE234CF1F4709" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">establishes particular criteria for
				withholding or refers to particular types of matters to be
				withheld;</text>
						</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="idB2439CF72DB648C2A9A5EEC05516DA28" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Reporting requirements</header>
			<subsection commented="no" display-inline="no-display-inline" id="id835CC3A4013941F0AE70A8D49B760668"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 552(e)(1) of title 5, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID27c997eecb674bd188a2c4b312d0f03f"><enum>(1)</enum><text display-inline="yes-display-inline">in subparagraph (B)(ii), by inserting after
			 the first comma <quote>the number of occasions on which each statute was relied
			 upon,</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID121c2d5b6f4347ff87f17c0e836bac47"><enum>(2)</enum><text display-inline="yes-display-inline">in subparagraph (C), by inserting
			 <quote>and average</quote> after <quote>median</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID16e3595f2c524d6eb5679311e774c15c"><enum>(3)</enum><text display-inline="yes-display-inline">in subparagraph (E), by inserting before
			 the semicolon <quote>, based on the date on which the requests were received by
			 the agency</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4114b5ebda2a436191a110779fc97c28"><enum>(4)</enum><text display-inline="yes-display-inline">by redesignating subparagraphs (F) and (G)
			 as subparagraphs (N) and (O), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id105E3098338246BA964601419787FCAD"><enum>(5)</enum><text display-inline="yes-display-inline">by inserting after subparagraph (E) the
			 following:</text>
					<quoted-block display-inline="no-display-inline" id="id3154BE680EE948D78483414CE2CE9219" style="OLC">
						<subparagraph commented="no" display-inline="no-display-inline" id="ID1f84de44e13547f9a691c800f14ebc33"><enum>(F)</enum><text display-inline="yes-display-inline">the average number of days for the agency
				to respond to a request beginning on the date on which the request was received
				by the agency, the median number of days for the agency to respond to such
				requests, and the range in number of days for the agency to respond to such
				requests;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6c869e3aa97e4e47acd007c715c2fddb"><enum>(G)</enum><text display-inline="yes-display-inline">based on the number of business days that
				have elapsed since each request was originally received by the agency—</text>
							<clause commented="no" display-inline="no-display-inline" id="ID965b2a4ded4c4144b28a0ab8c0f37907"><enum>(i)</enum><text display-inline="yes-display-inline">the number of requests for records to which
				the agency has responded with a determination within a period up to and
				including 20 days, and in 20-day increments up to and including 200
				days;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="ID6a73acafd8fb4750b9adf4e4c8335810"><enum>(ii)</enum><text display-inline="yes-display-inline">the number of requests for records to which
				the agency has responded with a determination within a period greater than 200
				days and less than 301 days;</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDf0503a39c21f49bbb39885b823bf44d8"><enum>(iii)</enum><text display-inline="yes-display-inline">the number of requests for records to which
				the agency has responded with a determination within a period greater than 300
				days and less than 401 days; and</text>
							</clause><clause commented="no" display-inline="no-display-inline" id="IDf621ce482a8d439da16ba1ac0191b105"><enum>(iv)</enum><text display-inline="yes-display-inline">the number of requests for records to which
				the agency has responded with a determination within a period greater than 400
				days;</text>
							</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDf483de84188f4146b71828112ecd6184"><enum>(H)</enum><text display-inline="yes-display-inline">the average number of days for the agency
				to provide the granted information beginning on the date on which the request
				was originally filed, the median number of days for the agency to provide the
				granted information, and the range in number of days for the agency to provide
				the granted information;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe6e6ce15b4214895b28593a49193def1"><enum>(I)</enum><text display-inline="yes-display-inline">the median and average number of days for
				the agency to respond to administrative appeals based on the date on which the
				appeals originally were received by the agency, the highest number of business
				days taken by the agency to respond to an administrative appeal, and the lowest
				number of business days taken by the agency to respond to an administrative
				appeal;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID18bfe4945fa6449787385dad39abfb71"><enum>(J)</enum><text display-inline="yes-display-inline">data on the 10 active requests with the
				earliest filing dates pending at each agency, including the amount of time that
				has elapsed since each request was originally received by the agency;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe5f15fac99734559ab89e123c8ad1bc7"><enum>(K)</enum><text display-inline="yes-display-inline">data on the 10 active administrative
				appeals with the earliest filing dates pending before the agency as of
				September 30 of the preceding year, including the number of business days that
				have elapsed since the requests were originally received by the agency;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDe8f12ee471b442cbabe01b1badb74d73"><enum>(L)</enum><text display-inline="yes-display-inline">the number of expedited review requests
				that are granted and denied, the average and median number of days for
				adjudicating expedited review requests, and the number adjudicated within the
				required 10 days;</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6741bf2705bf4545afa0a9573754987d"><enum>(M)</enum><text display-inline="yes-display-inline">the number of fee waiver requests that are
				granted and denied, and the average and median number of days for adjudicating
				fee waiver
				determinations;</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idED8B2B00648943738E88807ACAB7A17A"><enum>(b)</enum><header display-inline="yes-display-inline">Applicability to agency and each principal
			 component of the agency</header><text display-inline="yes-display-inline">Section 552(e) of title 5, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id88AE0E1C1476487F91192A57E0643E26"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating paragraphs (2) through (5)
			 as paragraphs (3) through (6), respectively; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idE5CE2C1C9A244EEC8FCE0693DD8B0353"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after paragraph (1) the
			 following:</text>

			 Code, (as redesignated by subsection (b) of this section) is amended by adding
			 after the period “In addition, each agency shall make the raw statistical data
			 used in its reports available electronically to the public upon
			 request.”.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDCE1F2BF4366642FE9AB435BFAD47DB5A" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Openness of agency records maintained by a
			 private entity</header><text display-inline="no-display-inline">Section 552(f)
			 of title 5, United States Code, is amended by striking paragraph (2) and
			 inserting the following:</text>

				record subject to the requirements of this section when maintained by an agency

			 is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID6185724F460046378FA279E76F4F6D17"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 596 as section
			 597; and</text>

				Government Information Services within the Administrative Conference of the
				United States.</text>
							</subsection><subsection commented="no" display-inline="no-display-inline" id="ID18D6C5E1CC9045FCAA66077753C68CD3"><enum>(b)</enum><text display-inline="yes-display-inline">The Office of Government Information
				Services shall—</text>

				administrative agencies under section 552 and compliance with that section by
				administrative agencies;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID910B92D386DC47F0BD9ECABA2F3A348A"><enum>(2)</enum><text display-inline="yes-display-inline">conduct audits of administrative agencies
				on such policies and compliance and issue reports detailing the results of such
				audits;</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID5B0E2858F0994F6C83AA4319B6FB38F2"><enum>(3)</enum><text display-inline="yes-display-inline">recommend policy changes to Congress and
				the President to improve the administration of section 552, including whether
				agencies are receiving and expending adequate funds to ensure compliance with
				that section; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD8DDA9CD3C154FC1A76094C63FAB3A48"><enum>(4)</enum><text display-inline="yes-display-inline">offer mediation services between persons
				making requests under section 552 and administrative agencies as a
				non-exclusive alternative to litigation and, at the discretion of the Office,
				issue advisory opinions if mediation has not resolved the
				dispute.</text>

			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9E353FFD9AD94C54B45163D41CAEADD0" section-type="subsequent-section"><enum>12.</enum><header display-inline="yes-display-inline">Accessibility of critical infrastructure
			 information</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID241DE94F7DD54BB18465A82F7A464E17"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Not later than January 1 of each of the 3
			 years following the date of the enactment of this Act, the Comptroller General
			 of the United States shall submit to Congress a report on the implementation
			 and use of section 214 of the Homeland Security Act of 2002 (6 U.S.C. 133),
			 including—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5F81A0E089F34055ACD3C048FA932DC0"><enum>(1)</enum><text display-inline="yes-display-inline">the number of persons in the private
			 sector, and the number of State and local agencies, that voluntarily furnished
			 records to the Department under this section;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB8F0F26FFF2140769B898980FC229BD6"><enum>(2)</enum><text display-inline="yes-display-inline">the number of requests for access to
			 records granted or denied under this section;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID82C70535F867465298CEC8A8348CBF57"><enum>(3)</enum><text display-inline="yes-display-inline">such recommendations as the Comptroller
			 General considers appropriate regarding improvements in the collection and
			 analysis of sensitive information held by persons in the private sector, or by
			 State and local agencies, relating to vul­ner­a­bil­i­ties of and threats to
			 critical infrastructure, including the response to such vulnerabilities and
			 threats; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID132722E80913413591E040152E92985C"><enum>(4)</enum><text display-inline="yes-display-inline">an examination of whether the nondisclosure
			 of such information has led to the increased protection of critical
			 infrastructure.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID5E597418F81048C9BC3CEEF06A5D4EB7"><enum>(b)</enum><header display-inline="yes-display-inline">Form</header><text display-inline="yes-display-inline">The report shall be submitted in
			 unclassified form, but may include a classified annex.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDDC3DBE3422D7417499093557C237A8BF" section-type="subsequent-section"><enum>13.</enum><header display-inline="yes-display-inline">Report on personnel policies related to
			 foia</header><text display-inline="no-display-inline">Not later than 1 year
			 after the date of enactment of this Act, the Office of Personnel Management
			 shall submit to Congress a report that examines—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID42EF39DE1ABF40F9816C234E46089F58"><enum>(1)</enum><text display-inline="yes-display-inline">whether changes to executive branch
			 personnel policies could be made that would—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDA7F58AC9B6404BDA96E0196CB58D19BB"><enum>(A)</enum><text display-inline="yes-display-inline">provide greater encouragement to all
			 Federal employees to fulfill their duties under section 552 of title 5, United
			 States Code; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE7558267A8944794AE88A1BA45D71392"><enum>(B)</enum><text display-inline="yes-display-inline">enhance the stature of officials
			 administering that section within the executive branch;</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26BEDF688FBA45FFA2DF44C2A34FE13A"><enum>(2)</enum><text display-inline="yes-display-inline">whether performance of compliance with
			 section 552 of title 5, United States Code, should be included as a factor in
			 personnel performance evaluations for any or all categories of Federal
			 employees and officers;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID3E265F0820E5481CA9966B2DBBDB0C35"><enum>(3)</enum><text display-inline="yes-display-inline">whether an employment classification series
			 specific to compliance with sections 552 and 552a of title 5, United States
			 Code, should be established;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID33FDF443228A43719F59336F0F7E91B3"><enum>(4)</enum><text display-inline="yes-display-inline">whether the highest level officials in
			 particular agencies administering such sections should be paid at a rate of pay
			 equal to or greater than a particular minimum rate; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID79EB1CDD4CAF4A63BD9091A39D611FFE"><enum>(5)</enum><text display-inline="yes-display-inline">whether other changes to personnel policies
			 can be made to ensure that there is a clear career advancement track for
			 individuals interested in devoting themselves to a career in compliance with
			 such sections; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0C489E49A2D04E7A8F07024CADE8F21D"><enum>(6)</enum><text display-inline="yes-display-inline">whether the executive branch should require
			 any or all categories of Federal employees to undertake awareness training of
			 such sections.</text>
