		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Comprehensive National Mercury
			 Monitoring Act</short-title></quote>.</text>
		</section><section id="id6BC57401267E4CD194E8C9CEC7FB8AD6"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
			<paragraph id="H57B7FFD3D33B478F00D43F9F4172A36C"><enum>(1)</enum><text display-inline="yes-display-inline">mercury is a potent neurotoxin of
			 significant ecological and public health concern;</text>
			</paragraph><paragraph id="id8BB2C97C64A147A9BAB7AD5FEFE773DD"><enum>(2)</enum><text display-inline="yes-display-inline">exposure to mercury occurs largely by
			 consumption of contaminated fish, and children and women of childbearing age
			 who consume large quantities of fish are at high risk of suffering adverse
			 effects;</text>
			</paragraph><paragraph id="idEFB355A8F6234E02B789A316D3F698BD"><enum>(3)</enum><text display-inline="yes-display-inline">it is estimated that more than 630,000
			 children born each year in the United States are exposed to elevated methyl
			 mercury in the womb and are at risk of impaired neurological
			 development;</text>
			</paragraph><paragraph id="id0DE2A84DC19B48E094B5379948D38A79"><enum>(4)</enum><text display-inline="yes-display-inline">8 percent of women in the United States of
			 childbearing age have blood mercury levels in excess of values determined to be
			 safe by the Environmental Protection Agency;</text>
			</paragraph><paragraph id="H998AA23E38F5426A8115CA87F23C4400"><enum>(5)</enum><text>as of 2004, fish
			 consumption advisories due to mercury contamination have been issued for 44
			 States, including 21 statewide advisories for freshwater and 12 statewide
			 advisories for coastal water;</text>
			</paragraph><paragraph id="idD642E1C5E40C4EEF9D2EFE02328EAB4E"><enum>(6)</enum><text>those advisories
			 represent more than 52,000 square kilometers of lakes and 1,230,000 kilometers
			 of rivers;</text>
			</paragraph><paragraph id="id046077FC68AA4F3F8A7C0FB333B67BC1"><enum>(7)</enum><text>fish and
			 shellfish are an important source of dietary protein, and a healthy fishing
			 resource is important to the economy of the United States;</text>
			</paragraph><paragraph id="idA1CC6336968E48C496B005D01FFCBC6E"><enum>(8)</enum><text>the extent of
			 fish consumption advisories underscores the extensive human and ecological
			 health risk posed by mercury pollution;</text>
			</paragraph><paragraph id="H240F15BB012C4B308C31E1D9D98901FF"><enum>(9)</enum><text display-inline="yes-display-inline">the interaction of mercury with the
			 environment and bioaccumulation in biota are not fully understood;</text>
			</paragraph><paragraph id="id6C93C9701264439BA42A921D2BB4276F"><enum>(10)</enum><text display-inline="yes-display-inline">computer models and other assessment tools
			 predict varying effectiveness in reducing mercury concentrations in fish, and
			 no broad-scale data sets exist to test model predictions;</text>
			</paragraph><paragraph id="HBBC409F7219346AAADEEC38E00562EA9"><enum>(11)</enum><text display-inline="yes-display-inline">in September 2003, the Society of
			 Environmental Toxicology and Chemistry convened a workshop of 32 mercury
			 scientists to develop a system to measure and document changes resulting from
			 reductions in mercury emissions in the United States;</text>
			</paragraph><paragraph id="H7E683856A0234F81BEA65D0066286E70"><enum>(12)</enum><text display-inline="yes-display-inline">on January 1, 2005, an article entitled
			 <quote>Monitoring the Response to Changing Mercury Deposition</quote>—</text>
				<subparagraph id="id5931563655B14465B2268366230B506A"><enum>(A)</enum><text display-inline="yes-display-inline">was published in the periodical
			 Environmental Science and Technology; and</text>
				</subparagraph><subparagraph id="id5C66E5970D1843DB8DB4B02FAB982209"><enum>(B)</enum><text display-inline="yes-display-inline">proposed a <quote>holistic, multimedia,
			 long-term mercury monitoring program</quote>;</text>
				</subparagraph></paragraph><paragraph id="HAC74642C9F9646E5BD46923E77FB0751"><enum>(13)</enum><text display-inline="yes-display-inline">many regulations limiting mercury emissions
			 have taken effect or will soon be promulgated, but scientists are not
			 adequately measuring the environmental benefits of reduced mercury
			 emissions;</text>
			</paragraph><paragraph id="id0044BB29F6A54E759C57333F0170C97D"><enum>(14)</enum><text>on May 18, 2005,
			 the Administrator of the Environmental Protection Agency, using results
			 generated by a computer model that were not peer reviewed or verified by actual
			 measurements, finalized the Clean Air Mercury Rule (70 Fed. Reg. 28606 (May 18,
			 2005));</text>
			</paragraph><paragraph id="id71A692635B834D899FE00D97B7D1B4E6"><enum>(15)</enum><text display-inline="yes-display-inline">as governments advance proposals for the
			 regulation of mercury and mercury emissions, the governments should document
			 whether regulations already or soon to be in effect achieve the desired
			 results;</text>
			</paragraph><paragraph id="H05C66D64BEE6493190268E40CADAA663"><enum>(16)</enum><text display-inline="yes-display-inline">on May 15, 2006, the Office of Inspector
			 General of the Environmental Protection Agency issued a report entitled,
			 <quote>Monitoring Needed to Assess Impact of EPA's Clean Air Mercury Rule
			 (CAMR) on Potential Hotspots</quote>, and numbered 2006–P–0025, that states, in
			 part—</text>
				<subparagraph id="id4C5C2B49D8DC487AAABCF7EF97C446E5"><enum>(A)</enum><text display-inline="yes-display-inline"><quote>Without field data from an improved
			 monitoring network, EPA’s ability to advance mercury science will be limited
			 and ‘utility-attributable’ hotspots that pose health risks may occur and go
			 undetected</quote>; and</text>
				</subparagraph><subparagraph id="idD96A7049E8CA4FEF82015B14B5B55A4B"><enum>(B)</enum><text display-inline="yes-display-inline"><quote>We recommend that EPA develop and
			 implement a mercury monitoring plan to (1) assess the impact of CAMR, if
			 adopted, on mercury deposition and fish tissue; and (2) evaluate and refine
			 mercury estimation tools and models</quote>;</text>
				</subparagraph></paragraph><paragraph id="idF075492A996649F58333B79CBEB0E33E"><enum>(17)</enum><text>on January 9,
			 2007, numerous individuals published a paper in the journal entitled
			 <quote>BioScience</quote> that identified the location of biological mercury
			 hotspots in the northeastern region of the United States and the southeastern
			 region of Canada, including—</text>
				<subparagraph id="id02AB801B5948482FA0079D46E724C01A"><enum>(A)</enum><text>David Evers and
			 Wing Goodale of the BioDiversity Research Institute in Gorham, Maine;</text>
				</subparagraph><subparagraph id="idA551152FED054F528E898C9301D4CF71"><enum>(B)</enum><text>Charles Driscoll
			 of Syracuse University;</text>
				</subparagraph><subparagraph id="idCA42B7519B8D4225B8A771DB6CC5986C"><enum>(C)</enum><text>Kathleen Fallon
			 Lambert of the Hubbard Brook Research Foundation in Hanover, New
			 Hampshire;</text>
				</subparagraph><subparagraph id="idA5905D2DFFCB4E9D919807B3F4FC2C80"><enum>(D)</enum><text>Neil Kamman of
			 the Vermont Department of Environmental Conservation; and</text>
				</subparagraph><subparagraph id="id150A96EDA8D944DC9BD2B4BEF459B423"><enum>(E)</enum><text>other concerned
			 individuals;</text>
				</subparagraph></paragraph><paragraph id="idF7786000C7EC4EC5B4631373244635C0"><enum>(18)</enum><text>on January 9,
			 2007, Charles Driscoll and other concerned individuals published a paper in the
			 journal entitled <quote>BioScience</quote> that established a link
			 between—</text>
				<subparagraph id="id5220CCB7B4924E10B42BE1F01BEBC786"><enum>(A)</enum><text>mercury
			 contamination in forest and freshwater ecosystems located in the northeastern
			 region of the United States; and</text>
				</subparagraph><subparagraph id="id7906D4A5F04D40D9AA2B5F8C37D24C2B"><enum>(B)</enum><text>mercury emissions
			 generated by electric utilities, incinerators, and industrial processes;
			 and</text>
				</subparagraph></paragraph><paragraph id="id67473080CA0E41BC8EAD6EFE3299145B"><enum>(19)</enum><text>those papers
			 published in the journal entitled <quote>BioScience</quote>—</text>
				<subparagraph id="id1BE727D2568D43DB80AFB5F9FDBDE872"><enum>(A)</enum><text>demonstrated the
			 importance of the use of mercury measurements in addition to modeling results;
			 and</text>
				</subparagraph><subparagraph id="idA5FED2C1320F4D9CAE24E11AE53530FC"><enum>(B)</enum><text>indicated the
			 need for a comprehensive nationwide mercury monitoring program.</text>
				</subparagraph></paragraph></section><section id="H0E7627BD9D9140F5ADB437872B55784"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="id609FE9EAB38D4010A303159826F7E114"><enum>(1)</enum><header>Administrator</header><text display-inline="yes-display-inline">The term <term>Administrator</term> means
			 the Administrator of the Environmental Protection Agency.</text>
			</paragraph><paragraph id="idDBEFAB0927EC43F99E321C7256E2B8C3"><enum>(2)</enum><header>Advisory
			 Committee</header><text>The term <term>Advisory Committee</term> means the
			 Mercury Monitoring Advisory Committee established by section 5(a).</text>
			</paragraph><paragraph id="H748D7C8FEAF74262AB45193BC98CA73E"><enum>(3)</enum><header>Ecoregion</header><text display-inline="yes-display-inline">The term <term>ecoregion</term> means a
			 large area of land and water that contains a geographically distinct assemblage
			 of natural communities, including similar land forms, climate, ecological
			 processes, and vegetation.</text>
			</paragraph><paragraph id="H7ADA3CA7CC404E928D8391585C23FA00"><enum>(4)</enum><header>Mercury
			 export</header><text display-inline="yes-display-inline">The term <term>mercury
			 export</term> means mercury flux from a watershed to the corresponding water
			 body, or from 1 water body to another (e.g. a lake to a river), generally
			 expressed as mass per unit time.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HA4A0D057BABB4FAEAFCAF6478BD6AD75"><enum>(5)</enum><header>Mercury
			 flux</header><text display-inline="yes-display-inline">The term <term>mercury
			 flux</term> means the rate of transfer of mercury between ecosystem components
			 (e.g. between water and air), or between portions of ecosystem components,
			 expressed in terms of mass per unit time or mass per unit area per time.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="HCDE416C17A3E40CFA7F5476B76EE747F"><enum>(6)</enum><header>Surface
			 sediment</header><text display-inline="yes-display-inline">The term
			 <term>surface sediment</term> means sediment in the uppermost 2 centimeters of
			 a lakebed or riverbed.</text>
			</paragraph></section><section id="HF75771D4B6DB4BC888DD8F0200C3900"><enum>4.</enum><header>Monitoring
			 program</header>
			<subsection id="H20AC5CDB764E4AA2BC1EA0ED93D68E20"><enum>(a)</enum><header>Establishment</header>
				<paragraph id="id490B124B868F4499B1C04729F6F3EE19"><enum>(1)</enum><header>In
			 general</header><text>The Administrator, in consultation with the United States
			 Fish and Wildlife Service, the United States Geological Survey, the Forest
			 Service, the National Park Service, and the National Oceanic and Atmospheric
			 Administration, shall establish a national-scale mercury monitoring
			 program.</text>
				</paragraph><paragraph id="id443A2DB75D5A405C92D0F8AC1B1EB383"><enum>(2)</enum><header>Monitoring
			 sites</header><text>In carrying out paragraph (1), not later than 1 year after
			 the date of enactment of this Act, the Administrator shall select multiple
			 monitoring sites in ecoregions of the United States.</text>
				</paragraph></subsection><subsection id="HB2A5B1C2EEAD46BA8F2C3DCA84D8FA00"><enum>(b)</enum><header>Air and
			 watersheds</header><text>The program under this section shall monitor long-term
			 changes in mercury levels in the air and watersheds, including—</text>
				<paragraph id="HCC9FF27E82D24E23B4A0AE144E04E49D"><enum>(1)</enum><text>at such locations
			 or portions of locations selected under subsection (a)(2) as the Administrator
			 determines to be appropriate, the measurement and recording of—</text>
					<subparagraph id="idB9C90891FB57411991F8D6632D6A1DF5"><enum>(A)</enum><text>wet mercury
			 deposition;</text>
					</subparagraph><subparagraph id="idBCAC8A551A85461596EF6731B72A97F0"><enum>(B)</enum><text display-inline="yes-display-inline">dry deposition of mercury; and</text>
					</subparagraph><subparagraph id="HEBDB92020D3E41F3BE99501B5729FB93"><enum>(C)</enum><text display-inline="yes-display-inline">mercury flux and mercury export; and</text>
					</subparagraph></paragraph><paragraph id="H0F25203BE7DC41EAB09DF9F9A48B2512"><enum>(2)</enum><text>at all locations
			 selected under subsection (a)(2), the measurement and recording of the level of
			 mercury reemitted from aquatic and terrestrial environments into the
			 atmosphere.</text>
				</paragraph></subsection><subsection id="HC2BE5CDBDDC442D9BDD236E137524718"><enum>(c)</enum><header>Water and soil
			 chemistry</header><text>The program under this section shall monitor mercury
			 levels in water and soil chemistry, including—</text>
				<paragraph id="H46C7E71749B048EABA1E99C9A200A1E1"><enum>(1)</enum><text display-inline="yes-display-inline">at such locations or portions of locations
			 selected under subsection (a)(2) as the Administrator determines to be
			 appropriate—</text>
					<subparagraph id="id514D59B7E2E045578670C70EDB0F81CD"><enum>(A)</enum><text display-inline="yes-display-inline">extraction and analysis of sediment cores;
			 and</text>
					</subparagraph><subparagraph id="id433925EEF8DE4D3191D2987007E212E8"><enum>(B)</enum><text>measurement and
			 recording of total mercury concentrations and methyl mercury concentrations
			 throughout the water column; and</text>
					</subparagraph></paragraph><paragraph id="idB868C8B1B13F425F9D539057448644CD"><enum>(2)</enum><text>at all locations
			 selected under subsection (a)(2)—</text>
					<subparagraph id="H86CC20C436724F8682F9A9E5A6006179"><enum>(A)</enum><text>measurement and
			 recording of total mercury concentration, methyl mercury concentration, and
			 percent methyl mercury in surface sediments; and</text>
					</subparagraph><subparagraph id="HCE417AB720DB4DACA8C49400F62CE1F1"><enum>(B)</enum><text>measurement and
			 recording of total mercury concentration and methyl mercury concentration in
			 surface water.</text>
					</subparagraph></paragraph></subsection><subsection id="HBFC3D58FBD6B4065BE67763E6B9759E2"><enum>(d)</enum><header>Aquatic plants
			 and animals</header><text>The program under this section shall monitor mercury
			 levels in plants and animals, including—</text>
				<paragraph id="H10C78C8AF09A4C4A95AA27B126D03561"><enum>(1)</enum><text>at all locations
			 selected under subsection (a)(2), measurement and recording of—</text>
					<subparagraph id="id5BE9F6823E604D68A4C3980CA4565ED8"><enum>(A)</enum><text>methyl mercury
			 levels in yearling fish;</text>
					</subparagraph><subparagraph id="HC45DC83E5A004C7B953E3019CBC34228"><enum>(B)</enum><text>mercury levels,
			 and other scientific data relevant to assessment of the health of the fish
			 population, in commercially or recreationally important fish; and</text>
					</subparagraph><subparagraph id="HAE97A04B697B440E91B1006134FB5592"><enum>(C)</enum><text>mercury levels in
			 the appropriate tissue in reptiles, amphibians, birds, and mammals; and</text>
					</subparagraph></paragraph><paragraph id="HE7E1C5BD252047BDB2ABBE2CBDECF588"><enum>(2)</enum><text display-inline="yes-display-inline">at such locations or portions of locations
			 selected under subsection (a)(2) as the Administrator determines to be
			 appropriate, measurement and recording of mercury levels in phytoplankton,
			 algae, zooplankton, and benthic invertebrates.</text>
				</paragraph></subsection></section><section id="H03C2D233312D424385AC8B971901449F"><enum>5.</enum><header>Advisory
			 committee</header>
			<subsection id="id1C5F74D3E4EB4996852F01EB0CAA1265"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established a scientific advisory
			 committee, to be known as the <term>Mercury Monitoring Advisory
			 Committee</term>, to advise the Administrator with respect to the establishment
			 and operation (including the location of sampling sites) of the national
			 mercury monitoring program under this Act.</text>
			</subsection><subsection id="H038589C9D9914198904F97C54E00C058"><enum>(b)</enum><header>Membership</header><text>The
			 Advisory Committee shall consist of at least 13 scientists who are not
			 employees of the Federal Government, including—</text>
				<paragraph id="HC9A911592BA34736B0FE237622180502"><enum>(1)</enum><text display-inline="yes-display-inline">3 scientists appointed by the
			 Administrator;</text>
				</paragraph><paragraph id="H1AA9CDC8A87C478C00DC4491D6E9EDD7"><enum>(2)</enum><text display-inline="yes-display-inline">2 scientists appointed by the Director of
			 the United States Fish and Wildlife Service;</text>
				</paragraph><paragraph id="H9781215605A548CE00030100C312CE15"><enum>(3)</enum><text display-inline="yes-display-inline">2 scientists appointed by the Director of
			 the National Park Service;</text>
				</paragraph><paragraph id="HA8B53620D2E4443F99538661AB1254D3"><enum>(4)</enum><text display-inline="yes-display-inline">2 scientists appointed by the Director of
			 the Forest Service;</text>
				</paragraph><paragraph id="HD772F908BF314D4291CEAB346000F48E"><enum>(5)</enum><text display-inline="yes-display-inline">2 scientists appointed by the Director of
			 the United States Geological Survey; and</text>
				</paragraph><paragraph id="H7C77E25B1C3544B09B351100402BC61B"><enum>(6)</enum><text display-inline="yes-display-inline">2 scientists appointed by the Administrator
			 of the National Oceanic and Atmospheric Administration.</text>
				</paragraph></subsection></section><section id="H96EE4A3B506144F4BB65E06E982B399D"><enum>6.</enum><header>Reports and
			 public disclosure</header>
			<subsection id="H67982D133CA548BBB45D1C29B29EA8A6"><enum>(a)</enum><header>Reports</header>
				<paragraph id="idF5C60BA9B9E843489600FAA0C9551905"><enum>(1)</enum><header>Biennial
			 report</header><text display-inline="yes-display-inline">Not later than 2 years
			 after the date of enactment of this Act, and every 2 years thereafter, the
			 Administrator shall submit to Congress a report on the program under this
			 Act.</text>
				</paragraph><paragraph id="idA8022D964FDD45548A481DCEC7019177"><enum>(2)</enum><header>Quadrennial
			 assessment</header><text display-inline="yes-display-inline">In the second
			 biennial report submitted under paragraph (1), and in the biennial report
			 submitted every 4 years thereafter, the Administrator shall include an
			 assessment of the reduction in mercury deposition rates that would be required
			 to be achieved in order to prevent adverse ecological effects.</text>
				</paragraph></subsection><subsection id="H12C3823B893541A89B04A7674015A2A8"><enum>(b)</enum><header>Availability of
			 data</header><text>The Administrator shall make all data obtained pursuant to
			 this Act available to the public.</text>
			</subsection></section><section id="HB0B01F87C21844128EF721488CA8345F"><enum>7.</enum><header>Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to carry out this Act—</text>
			<paragraph id="HF4F28F0CAA4541C1B1AD511B8012A6B5"><enum>(1)</enum><text>for fiscal year
			 2008—</text>
