			 purpose</header>
			<subsection id="IDfa5b60b7993b4e6782a8df39bc8c4c29"><enum>(a)</enum><header>Findings</header><text>Congress
			 finds that—</text>
				<paragraph id="ID3b07a7a216dc416188bc85e56eccf802"><enum>(1)</enum><text>the
			 Owyhee-Bruneau Canyonlands Region is one of the most spectacular high deserts
			 in the United States, unique in geology and rich in history;</text>
				</paragraph><paragraph id="IDeba1ca6b3d3a4689837b65f36450bebe"><enum>(2)</enum><text>the Shoshone
			 Paiute Indian tribes have put forth claims to aboriginal rights in the
			 Region;</text>
				</paragraph><paragraph id="IDc40e841a3a784f4a9c3530085e09132d"><enum>(3)</enum><text>since the 1860s,
			 ranching has been an important part of the heritage, culture, and economy of
			 the Region;</text>
				</paragraph><paragraph id="ID84ff013d9069472cbba5fb9de061c59c"><enum>(4)</enum><text>the Region has
			 tremendous opportunities for outdoor recreation;</text>
				</paragraph><paragraph id="ID8a601cc9c9b1473bbab888be888643c8"><enum>(5)</enum><text>there has been
			 longstanding conflict over management of the public land in the Region;</text>
				</paragraph><paragraph id="ID6ae4251a82c24660b6051ce0c58ac72b"><enum>(6)</enum><text>in 2001, the
			 Owyhee County Board of Commissioners and the Tribes brought together a diverse
			 group of interests, with the intent that the Tribes and the County, through
			 government-to-government coordination, could mutually launch a process for
			 achieving resolution of land use conflicts, protection of the landscape
			 resource, protection of cultural resources, and economic stability; and</text>
				</paragraph><paragraph id="IDf616d4463b5e435986a523179369f744"><enum>(7)</enum><text>as a result of
			 the process described in paragraph (6), the Owyhee Initiative Agreement, an
			 agreement between a coalition of representatives of landowners, ranchers,
			 environmental organizations, County government, and recreation groups appointed
			 in the County by the Board of County Commissioners, was formed to develop a
			 natural resources project that promotes ecological and economic health within
			 the County.</text>
				</paragraph></subsection><subsection id="IDc3a68dc43d2744f3840574fe3e7b5c46"><enum>(b)</enum><header>Purpose</header><text>The
			 purpose of this Act is to provide for the implementation of the Owyhee
			 Initiative Agreement to—</text>
				<paragraph id="ID1e873ad082334aa7a3a2e8afd8967c25"><enum>(1)</enum><text>preserve the
			 natural processes that create and maintain a functioning, unfragmented
			 landscape that supports and sustains a flourishing community of human, plant,
			 and animal life;</text>
				</paragraph><paragraph id="IDb91691dca6684d19b69a9119a714c733"><enum>(2)</enum><text>provide for
			 economic stability by preserving livestock grazing as an economically viable
			 use; and</text>
				</paragraph><paragraph id="ID726a31e9e83c4a48b4c570cc2a68218e"><enum>(3)</enum><text>provide for the
			 protection of cultural resources.</text>
				</paragraph></subsection></section><section id="IDd8116b62e6ea48499d6b04a2beb96d59"><enum>3.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph id="ID3ae21229ca214e6fa57ae3cf2c27abba"><enum>(1)</enum><header>Board</header><text>The
			 term <term>Board</term> means the Board of Directors of the Owyhee Initiative
			 Project.</text>
			</paragraph><paragraph id="ID16f232b44d024035b419409e9702c8ab"><enum>(2)</enum><header>Bureau</header><text>The
			 term <term>Bureau</term> means the Bureau of Land Management.</text>
			</paragraph><paragraph id="ID412f465e81cd41218cbf6c5b5023a3d3"><enum>(3)</enum><header>County</header><text>The
			 term <term>County</term> means Owyhee County, Idaho.</text>
			</paragraph><paragraph id="id1D9E71660F184F38B83A3687B997AFCD"><enum>(4)</enum><header>Ordinary high
			 water mark</header><text>The term <term>ordinary high water mark</term> shall
			 have such meaning as is given the term by the legislature of the State.</text>
			</paragraph><paragraph id="ID60306685c528434bbb4068a71c82c24c"><enum>(5)</enum><header>Owyhee
			 Front</header><text>The term <term>Owyhee Front</term> means that area of the
			 County from Jump Creek on the west to Mud Flat Road on the east and draining
			 north from the crest of the Silver City Range to the Snake River.</text>
			</paragraph><paragraph id="IDcb0c3130192c42c09b692e9a1c17d633"><enum>(6)</enum><header>Owyhee
			 Initiative Agreement</header><text>The term <term>Owyhee Initiative
			 Agreement</term> means the agreement that provides for the implementation of a
			 project for the promotion of ecological and economic health within the County
			 entered into by a coalition of representatives of landowners, ranchers,
			 environmental organizations, County government, and recreation groups appointed
			 in the County by the Board of County Commissioners, entitled <quote>Owyhee
			 Initiative Agreement</quote>, as amended on May 10, 2006.</text>
			</paragraph><paragraph id="ID9b667984011445c6a0823673f52dfe4d"><enum>(7)</enum><header>Plan</header><text>The
			 term <term>Plan</term> means the Shoshone Paiute Tribal Cultural Resource
			 Protection Plan approved by the Tribes.</text>
			</paragraph><paragraph id="ID37f51e6d3a5c4f78b3414e37dbe03705"><enum>(8)</enum><header>Secretary</header><text>The
			 term <term>Secretary</term> means the Secretary of the Interior.</text>
			</paragraph><paragraph id="ID21a751c1b3f74b65a4976d49604fe521"><enum>(9)</enum><header>State</header><text>The
			 term <term>State</term> means the State of Idaho.</text>
			</paragraph><paragraph id="id34DC5D68065C40F7A9D106FC99586FC9"><enum>(10)</enum><header>Tribes</header><text>The
			 term <term>Tribes</term> means the Shoshone-Paiute Tribes of the Duck Valley
			 Indian Reservation.</text>
			</paragraph></section><section id="ID3741d72c0b0c42b8b77dff010777704b"><enum>4.</enum><header>General
			 provisions</header>
			<subsection id="IDfb09659713024da08fff5d8330b69f80"><enum>(a)</enum><header>No
			 precedence</header><text>Nothing in this Act establishes a precedent with
			 regard to any future legislation.</text>
			</subsection><subsection id="IDe865030e9b8d49899ef8ff7755571f11"><enum>(b)</enum><header>Native American
			 recognition and uses</header><text>Nothing in this Act diminishes or otherwise
			 affects—</text>
				<paragraph id="ID22568ed8cd554f14a029585b86cb7515"><enum>(1)</enum><text>the trust
			 responsibility of the United States to Indian tribes and Indian
			 individuals;</text>
				</paragraph><paragraph id="IDd79b2cdadaff4d50897c0698efa78079"><enum>(2)</enum><text>the
			 government-to-government relationship between the United States and federally
			 recognized Indian tribes;</text>
				</paragraph><paragraph id="ID591a701e4c9b47e38f317c5f693fe96a"><enum>(3)</enum><text>the rights of any
			 Indian tribe, including rights of access to Federal land for tribal activities,
			 including spiritual, cultural, and traditional food-gathering activities;
			 or</text>
				</paragraph><paragraph id="ID4a9b3f50a5c940cf83601ad457e260cc"><enum>(4)</enum><text>the sovereignty
			 of any Indian tribe.</text>
				</paragraph></subsection></section><title id="idC8F857DF700C4BCFAAEF3BD615F480E9"><enum>I</enum><header>Owyhee initiative
			 agreement</header>
			<section id="ID79f3298b5d10442ab229f5a1eedf6cff"><enum>101.</enum><header>Implementation</header>
				<subsection id="id409DD56588754B11A432494608065634"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall coordinate with the Board and the
			 County in implementing this Act in accordance with applicable laws and
			 regulations.</text>
				</subsection><subsection id="id5F69B9E215CF48A4AA43603C1DC37659"><enum>(b)</enum><header>Effect on
			 public participation</header><text>Nothing in this Act diminishes or otherwise
			 affects any applicable law or regulation relating to public
			 participation.</text>
				</subsection></section><section id="ID5d65ca78daa54de0891a18189ea845f4"><enum>102.</enum><header>Science review
			 program</header>
				<subsection id="id3E42AF8ABEE54A1A95D42464FEA95B06"><enum>(a)</enum><header>In
			 general</header><text>The Secretary shall coordinate with the Board in the
			 conduct of the science review process as described in the Owyhee Initiative
			 Agreement.</text>
				</subsection><subsection id="idB8F2146BA9CB4D7DB711B176A858C51E"><enum>(b)</enum><header>Management
			 actions</header><text>Notwithstanding the review process under this section,
			 the Secretary shall proceed with management actions in a timely manner in
			 accordance with applicable laws (including regulations).</text>
				</subsection></section><section id="ID470a8ea2a28d4b428b88a8e6e4a9771d"><enum>103.</enum><header>Conservation
			 and research center program</header><text display-inline="no-display-inline">The Secretary shall coordinate with the
			 Board with respect to the conservation and research center program, as
			 described in the Owyhee Initiative Agreement.</text>
			</section><section id="IDbd463a6f77c64711abb4bb13d0a5bf12"><enum>104.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There is
			 authorized to be appropriated to the Secretary to carry out this title
			 $20,000,000.</text>
			</section></title><title id="id025FACBC3F20483895AEC7FE5634C4A0"><enum>II</enum><header>Wilderness and
			 wild and scenic rivers </header>
			<section id="ID8b87f175aaed425d817b3e0aaba45e20"><enum>201.</enum><header>Wilderness
			 designation</header>
				<subsection id="ID7a040b94d2834025860e46416ce11330"><enum>(a)</enum><header>In
			 general</header><text>In furtherance of the purposes of the Wilderness Act (16
			 U.S.C. 1131 et seq.), the following land in the State is designated as
			 wilderness and as components of the National Wilderness Preservation
			 System:</text>
					<paragraph id="IDaccb82c907fb4dfa9d4ce2b5a4e4b8ce"><enum>(1)</enum><header>Big Jacks Creek
			 Wilderness</header><text>Certain land comprising approximately 51,624 acres, as
			 generally depicted on the map entitled <quote>Big Jacks Creek
			 Wilderness</quote> and dated September 1, 2006, which shall be known as the
			 <quote>Big Jacks Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="ID860efa2b4da143a4b71c81577c199c41"><enum>(2)</enum><header>Bruneau-Jarbidge
			 Rivers wilderness</header><text>Certain land comprising approximately 91,328
			 acres, as generally depicted on the map entitled <quote>Bruneau-Jarbidge Rivers
			 Wilderness</quote> and dated September 1, 2006, which shall be known as the
			 <quote>Bruneau-Jarbidge Rivers Wilderness</quote>.</text>
					</paragraph><paragraph id="IDe60e02c70c074f5a8dc37bb638c35da2"><enum>(3)</enum><header>Little Jacks
			 Creek wilderness</header><text>Certain land comprising approximately 49,647
			 acres, as generally depicted on the map entitled <quote>Little Jacks Creek
			 Wilderness</quote> and dated September 1, 2006, which shall be known as the
			 <quote>Little Jacks Creek Wilderness</quote>.</text>
					</paragraph><paragraph id="ID9a8c19d7d76e4f30ac3fd5dcb5d6769a"><enum>(4)</enum><header>North Fork
			 Owyhee wilderness</header><text>Certain land comprising approximately 43,113
			 acres, as generally depicted on the map entitled <quote>North Fork Owyhee
			 Wilderness</quote> and dated September 1, 2006, which shall be known as the
			 <quote>North Fork Owyhee Wilderness</quote>.</text>
					</paragraph><paragraph id="ID00ff1ee0df8a4014866d6ee7210d0195"><enum>(5)</enum><header>Owyhee River
			 wilderness</header><text>Certain land comprising approximately 269,016 acres,
			 as generally depicted on the map entitled <quote>Owyhee River
			 Wilderness</quote> and dated September 1, 2006, which shall be known as the
			 <quote>Owyhee River Wilderness</quote>.</text>
					</paragraph><paragraph id="IDfbd21cfaa30b4a0c8807d4a849a14813"><enum>(6)</enum><header>Pole Creek
			 wilderness</header><text>Certain land comprising approximately 12,468 acres, as
			 generally depicted on the map entitled <quote>Pole Creek Wilderness</quote> and
			 dated September 1, 2006, which shall be known as the <quote>Pole Creek
			 Wilderness</quote>.</text>
					</paragraph></subsection><subsection id="ID642ffb670eb4402fa62126b12f877694"><enum>(b)</enum><header>Release of
			 wilderness study areas</header>
					<paragraph id="IDa9f6968b0914453f866a9d2a54538bdf"><enum>(1)</enum><header>Finding</header><text>Congress
			 finds that, for the purposes of section 603 of the Federal Land Policy and
			 Management Act of 1976 (43 U.S.C. 1782), the public land in the County
			 administered by the Bureau in the following areas has been adequately studied
			 for wilderness designation:</text>
						<subparagraph id="ID08f57d6d50454dbb8285be04cec420f2"><enum>(A)</enum><text>The Sheep Creek
			 East Wilderness Study Area.</text>
						</subparagraph><subparagraph id="IDfc9fd4649d4249bb886015d0f8b8fc36"><enum>(B)</enum><text>The Sheep Creek
			 West Wilderness Study Area.</text>
						</subparagraph><subparagraph id="ID7cab703bc27a498fba9685d89ef01998"><enum>(C)</enum><text>The Squaw Creek
			 Canyon Wilderness Study Area.</text>
						</subparagraph><subparagraph id="IDf42945faf5c049dc8b71ffd71f718471"><enum>(D)</enum><text>The West Fork Red
			 Canyon Wilderness Study Area.</text>
						</subparagraph><subparagraph id="ID437786f84a0b4bb9b00f46a2d6680aea"><enum>(E)</enum><text>The Upper Deep
			 Creek Wilderness Study Area.</text>
						</subparagraph><subparagraph id="IDfa809d7be3564603b17883cb38f2ceeb"><enum>(F)</enum><text>The Big Willow
			 Springs Wilderness Study Area.</text>
						</subparagraph><subparagraph id="ID737ef680b62741d3ac5c31a9200c47ff"><enum>(G)</enum><text>The Middle Fork
			 Owyhee River Wilderness Study Area.</text>
						</subparagraph><subparagraph id="ID00d6446ac2aa4a15b63de96586cf51c0"><enum>(H)</enum><text>Any portion of
			 the wilderness study areas—</text>
							<clause id="IDabe45d17e4424f18aba5f426b67e302d"><enum>(i)</enum><text>not
			 designated as wilderness by subsection (a); and</text>
							</clause><clause id="IDc8c56f9995864d37a2f1e2de2fcc67e9"><enum>(ii)</enum><text>designated for
			 release on the map dated September 1, 2006.</text>
							</clause></subparagraph></paragraph><paragraph id="ID3adfecf0b48b4d94b60e9e3c54f13ec8"><enum>(2)</enum><header>Release</header><text>Any
			 public land described in paragraph (1) that is not designated as wilderness by
			 this subsection—</text>
						<subparagraph id="ID241bedbca5ab4ade96a82d5c6b690cd6"><enum>(A)</enum><text>is no longer
			 subject to section 603(c) of the Federal Land Policy and Management Act of 1976
			 (43 U.S.C. 1782(c)); and</text>
						</subparagraph><subparagraph id="ID1be8b804874249ca88fe20bdddf3deb9"><enum>(B)</enum><text>shall be managed
			 in accordance with land management plans adopted under section 202 of that Act
			 (43 U.S.C. 1712).</text>
						</subparagraph></paragraph></subsection><subsection id="ID206efb68eb924c959e17f92387eaf29d"><enum>(c)</enum><header>Maps and legal
			 descriptions</header>
					<paragraph id="ID7db0bd90edef4664be52a6bb3cb48fd2"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Resources of the House of
			 Representatives a map and legal description for each area designated as
			 wilderness by this Act.</text>
					</paragraph><paragraph id="ID8c954809f8f647b9b74f19d504c3e80c"><enum>(2)</enum><header>Effect</header><text>Each
			 map and legal description submitted under paragraph (1) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct any minor errors in such a map or legal description.</text>
					</paragraph><paragraph id="IDf3195ccb2cbc4537a13d47e474aa4c29"><enum>(3)</enum><header>Availability of
			 maps</header><text>The maps submitted under paragraph (1) shall be available
			 for public inspection in—</text>
						<subparagraph id="id5E7497B6C39D4DA0972A597D4640C3E3"><enum>(A)</enum><text>the offices of
			 the Idaho State Director of the Bureau; and</text>
						</subparagraph><subparagraph id="id151C52290207435AB025F50FCDCDB6FD"><enum>(B)</enum><text>the offices of
			 the Boise and Twin Falls Districts of the Bureau.</text>
						</subparagraph></paragraph></subsection></section><section id="IDb43536fe05534f9fae9f18a7d3b357fd"><enum>202.</enum><header>Designation of
			 wild and scenic rivers</header>
				<subsection id="ID4aafb9a61bd3420dbc1aba0032579ea9"><enum>(a)</enum><header>Statement of
			 intent</header><text>The intent of wild, scenic, and recreational river
			 designations under this subsection is to resolve the wild, scenic, and
			 recreational river status of the segments within the County, as depicted on the
			 maps submitted under section 201(c).</text>
				</subsection><subsection id="ID54c0c70a8c2b4a01ac6f1eef7e972746"><enum>(b)</enum><header>Designation</header><text>Section
			 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) is amended—</text>
					<paragraph id="id6973EBFBC3D64D32958267865E977499"><enum>(1)</enum><text>by redesignating
			 paragraph (167) (relating to the Musconetcong River, New Jersey) as paragraph
			 (169);</text>
					</paragraph><paragraph id="idADD95DBEECC243FEB466AAF059A7DF52"><enum>(2)</enum><text>by designating
			 the undesignated paragraph relating to the White Salmon River, Washington, as
			 paragraph (167);</text>
					</paragraph><paragraph id="idF8A495CB0C414E23ADF987F649E024BF"><enum>(3)</enum><text>by designating
			 the undesignated paragraph relating to the Black Butte River, California, as
			 paragraph (168); and</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id72D4D87495614B72ABEDBCB372060DA1"><enum>(4)</enum><text>by adding at the
			 end the following:</text>

				Idaho</header><text>The 23.4 miles of Battle Creek in the State of Idaho from

				subparagraph (A), the 1.2-mile segment of the South Fork of the Owyhee River
				across the private lands in secs. 25 and 36, T. 14 S., R. 5 W., Boise Meridian,
				Idaho, shall be administered by the Secretary of the Interior as a recreational
				river.</text>
								</subparagraph></paragraph><paragraph id="IDec189a7dcc374aec88480c62edd632b3"><enum>(189)</enum><header>Wickahoney,
				Idaho</header><text>The 1.5 miles of Wickahoney Creek in the State of Idaho
				from the confluence of Big Jacks Creek to the upstream boundary of the Big
				Jacks Creek Wilderness, to be administered by the Secretary of the Interior as
				a wild
				river.</text>
							</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</paragraph></subsection><subsection id="IDdd430405c5d84d4b9da09978df9dedb9"><enum>(c)</enum><header>Extent of
			 boundaries</header><text>Notwithstanding section 3(b) of the Wild and Scenic
			 Rivers Act (16 U.S.C. 1274(b)), the boundaries of the wild and scenic river
			 corridor for a river designated as a wild and scenic river by any of paragraphs
			 (170) through (189) of section 3(a) of that Act (16 U.S.C. 1274(a)) (as added
			 by subsection (b)) shall be the ordinary high water mark.</text>
				</subsection><subsection id="ID08257fbc02814d698918c16fa8dc3a18"><enum>(d)</enum><header>Maps and legal
			 descriptions</header>
					<paragraph id="ID4c13942d1aad452488ce3b4148adbba7"><enum>(1)</enum><header>In
			 general</header><text>As soon as practicable after the date of enactment of
			 this Act, the Secretary shall submit to the Committee on Energy and Natural
			 Resources of the Senate and the Committee on Resources of the House of
			 Representatives the map and legal description of each segment of a river
			 designated as a wild and scenic river under this section or an amendment made
			 by this section.</text>
					</paragraph><paragraph id="ID0c206dcb462d4aa9905ff98fed8f0968"><enum>(2)</enum><header>Effect</header><text>Each
			 map and legal description submitted under paragraph (1) shall have the same
			 force and effect as if included in this Act, except that the Secretary may
			 correct any minor errors in the maps and legal descriptions.</text>
					</paragraph><paragraph id="ID2ae98c192c194288b56453d45c045c0a"><enum>(3)</enum><header>Availability of
			 maps</header><text>The maps submitted under paragraph (1) shall be available
			 for public inspection in—</text>
						<subparagraph id="idDF6577DC7DF445F8BF55BD290D3AFC9D"><enum>(A)</enum><text>the offices of
			 the Idaho State Director of the Bureau; and</text>
						</subparagraph><subparagraph id="id3375747709A2435DA07ABF0991B8353E"><enum>(B)</enum><text>the offices of
			 the Boise and Twin Falls districts of the Bureau.</text>
						</subparagraph></paragraph></subsection><subsection id="IDc6e981936d1b4a338eb0cd31ff4bca1b"><enum>(e)</enum><header>Water
			 rights</header><text>Water Rights relating to a segment of a river designated
			 as a wild and scenic river under any of paragraphs (170) through (189) of
			 section 3(a) of the Wild and Scenic Rivers Act (16 U.S.C. 1274(a)) (as added by
			 subsection (b)) shall be reserved in accordance with—</text>
					<paragraph id="idC8C84C72675C400DB7E2FB5F2C518AF9"><enum>(1)</enum><text>the provisions of
			 that Act (<external-xref legal-doc="usc" parsable-cite="usc/16/1271">16 U.S.C.
			 1271</external-xref> et seq.);</text>
					</paragraph><paragraph id="id389C212CEC20498D93C25B21551290CF"><enum>(2)</enum><text>the laws and
			 regulations of the State; and</text>
					</paragraph><paragraph id="id24F1B2437D424A1B93797D772DA6BC78"><enum>(3)</enum><text>the Owyhee
			 Initiative Agreement.</text>
					</paragraph></subsection></section><section id="IDa8d6455acb1d423aa7b0ddada1ab7f65"><enum>203.</enum><header>Administration
			 of wilderness and wild and scenic rivers</header>
				<subsection id="IDc5c8560e5f1c4615ac90f834318fce77"><enum>(a)</enum><header>Management</header><text>Subject
			 to valid existing rights, each area designated as wilderness by section 201
			 shall be administered by the Secretary in accordance with the Wilderness Act
			 (16 U.S.C. 1131 et seq.), except that—</text>
					<paragraph id="ID0be6c941feb348088ff6005f622f8345"><enum>(1)</enum><text>any reference in
			 that Act to the effective date shall be considered to be a reference to the
			 date of enactment of this Act; and</text>
					</paragraph><paragraph id="ID1896249a44004b9eaaa8986078ac39bf"><enum>(2)</enum><text>any reference in
			 that Act to the Secretary of Agriculture shall be considered to be a reference
			 to the Secretary of the Interior with respect to land administered by the
			 Secretary of the Interior.</text>
					</paragraph></subsection><subsection id="IDc9b5f08bfc0e4605967fc20449f22d9b"><enum>(b)</enum><header>Inventory</header><text>In
			 accordance with the Owyhee Initiative Agreement, not later than 1 year after
			 the date on which a wilderness is designated under section 201, the Bureau
			 shall conduct an inventory of wilderness grazing management facilities and
			 activities in the wilderness.</text>
				</subsection><subsection id="ID7d83d74f99a8488ab99d46238ad91ece"><enum>(c)</enum><header>Livestock</header><text>In
			 the wilderness areas designated by section 201 that are administered by the
			 Bureau, the grazing of livestock in areas in which grazing is established as of
			 the date of enactment of this Act shall be allowed to continue, subject to such
			 reasonable regulations, policies, and practices as the Secretary considers
			 necessary, consistent with section 4(d)(4) of the Wilderness Act (16 U.S.C.
			 1133(d)(4)) and the guidelines described in Appendix A of House Report
			 101–405.</text>
				</subsection><subsection id="IDa82616c31c8f44b68b7958fec27e9246"><enum>(d)</enum><header>Recreational
			 saddle and pack stock</header><text>Nothing in this Act precludes horseback
			 riding or the use of recreational saddle or pack stock in any wilderness
			 designated by section 201.</text>
				</subsection><subsection id="IDca9b8dc4e41f4945a9b70535ed7c9aa6"><enum>(e)</enum><header>Outfitting and
			 guiding activities</header>
					<paragraph id="ID24304a5540434411a4ec725d8a739f9d"><enum>(1)</enum><header>In
			 general</header><text>Consistent with section 4(d)(6) of the Wilderness Act (16
			 U.S.C. 1133(d)(6)) and subject to any regulations that the Secretary determines
			 to be necessary, the Secretary shall permit the continuation of outfitting and
			 guiding activities in any wilderness designated by section 201.</text>
					</paragraph><paragraph id="ID7371ef8f07644b58b8a2a1dcb2b82786"><enum>(2)</enum><header>Effect of
			 designation</header><text>Designation of an area as wilderness areas under
			 section 201 shall not require the Secretary to limit the conduct of outfitting
			 activities or the use of the system of reserved camps and allocated river
			 launches designated for use by members of the public that use outfitter
			 services that are in existence before the date of enactment of this Act.</text>
					</paragraph></subsection><subsection id="ID36f000b08e28403aa1958368e266d34f"><enum>(f)</enum><header>Access to
			 non-Federal land</header><text>Nothing in this Act denies an owner of
			 non-Federal land the right to access the land.</text>
				</subsection><subsection id="ID8707e63feb8644deab71ae9ba2e9e3b3"><enum>(g)</enum><header>Roads adjacent
			 to wilderness</header><text>With respect to any road adjacent to a wilderness
			 designated by section 201 (as depicted on the applicable map), the boundary of
			 the wilderness shall be—</text>
					<paragraph id="ID58d44f134c154f12ae2217b37809c0a5"><enum>(1)</enum><text>100 feet from the
			 center line for a primary road;</text>
					</paragraph><paragraph id="IDeac7b89cbc1e41feb6640df94324136f"><enum>(2)</enum><text>50 feet from the
			 center line for a primitive wilderness boundary road; and</text>
					</paragraph><paragraph id="ID7ff1df52b9a94fa1aa3fcd2283c6af11"><enum>(3)</enum><text>30 feet on either
			 side of the center line for an interior wilderness division or cherrystem
			 road.</text>
					</paragraph></subsection><subsection id="ID4de87551fbe7467e85cdbe0b51ee6e82"><enum>(h)</enum><header>Wildlife
			 management</header>
					<paragraph id="ID96f25cc51c8a479384e4c34f94a6a331"><enum>(1)</enum><header>In
			 general</header><text>In accordance with section 4(d)(7) of the Wilderness Act
			 (16 U.S.C. 1133(d)(7)), nothing in this title affects or diminishes the
			 jurisdiction of the State with respect to fish and wildlife management,
			 including the regulation of hunting, fishing, and trapping in any wilderness
			 designated by section 201.</text>
					</paragraph><paragraph id="ID2f786ca8cf3c4dbca839f0f80deb6f70"><enum>(2)</enum><header>Management
			 activities</header>
						<subparagraph id="ID97e4947e1ab145358fadac21d9ca2054"><enum>(A)</enum><header>In
			 general</header><text>In furtherance of the purposes and principles of the
			 Wilderness Act (16 U.S.C. 1131 et seq.), management activities to maintain or
			 restore fish and wildlife populations and the habitats necessary to support
			 such populations may be carried out in any wilderness designated by section
			 201, if the management activities are—</text>
							<clause id="IDa21e84fd8cb64bc4840ad2bc00d7dce8"><enum>(i)</enum><text>consistent with
			 relevant wilderness management plans; and</text>
							</clause><clause id="IDe3683d08c27346aab09c05bc25e9bf12"><enum>(ii)</enum><text>conducted in
			 accordance with appropriate policies, such as the policies established in
			 Appendix B of House Report 101–405.</text>
							</clause></subparagraph><subparagraph id="IDb624d0017c2745188bb1c51f89d1cf9d"><enum>(B)</enum><header>Inclusions</header><text>Management
			 activities under subparagraph (A) may include the occasional and temporary use
			 of motorized vehicles, if the use, as determined by the Secretary, would
			 promote healthy, viable, and more naturally distributed wildlife populations
			 that would enhance wilderness values while causing the minimum impact necessary
			 to accomplish the promotion of such outcomes.</text>
						</subparagraph></paragraph><paragraph id="ID75d07cfdf46444f6af31103ddf66bf48"><enum>(3)</enum><header>Existing
			 activities</header><text>Consistent with section 4(d)(1) of the Wilderness Act
			 (16 U.S.C. 1133(d)(1)) and in accordance with appropriate policies, such as
			 those established in Appendix B of House Report 101–405, the State may continue
			 to use aircraft (including helicopters) in the wilderness areas designated by
			 section 201 to survey, capture, transplant, monitor, and provide water for
			 wildlife populations, including bighorn sheep and feral stock, horses, and
			 burros.</text>
					</paragraph></subsection><subsection id="ID745284d45c654ef8bcb519c27e073e8d"><enum>(i)</enum><header>Wildfire
			 management</header><text>Consistent with section 4 of the Wilderness Act (16
			 U.S.C. 1133), nothing in this title precludes a Federal, State, or local agency
			 from conducting wildfire management operations (including operations using
			 aircraft or mechanized equipment) to manage wildfires in any wilderness
			 designated by section 201.</text>
				</subsection><subsection id="ID9e9ef8931e3a424fa5538313e8031f83"><enum>(j)</enum><header>Incorporation
			 of acquired land and interests</header><text>Any land or interest within the
			 perimeter of, or adjacent to, an area designated as a wilderness by section 201
			 or any land or interest described in section 204 that is acquired by the United
			 States after the date of enactment of this Act shall be added to and
			 administered as part of the wilderness within which the acquired land or
			 interest is located.</text>
				</subsection><subsection id="ID56ff32aa3fe8445a9aaea3fddf48ac74"><enum>(k)</enum><header>Adjacent
			 management</header>
					<paragraph id="IDd883715b28ed44c7b533ceffe5d834b0"><enum>(1)</enum><header>In
			 general</header><text>The designation of a wilderness by section 201 shall not
			 create any protective perimeters or buffer zones around the wilderness.</text>
					</paragraph><paragraph id="ID3cca4f06ce624a5cbe1443f602597996"><enum>(2)</enum><header>Nonwilderness
			 activities</header><text>The fact that nonwilderness activities or uses can be
			 seen or heard from areas within a wilderness or wild and scenic river
			 designated under this section shall not preclude the conduct of those
			 activities or uses outside the boundary of the wilderness or wild and scenic
			 river.</text>
					</paragraph></subsection><subsection id="ID19ad6f24d16f4091b29dfb68e02f811b"><enum>(l)</enum><header>Military
			 overflights</header><text>Nothing in this section restricts or
			 precludes—</text>
					<paragraph id="IDc1a2059b5796499b941d4581dfc6dfe8"><enum>(1)</enum><text>low-level
			 overflights and operations of military aircraft, helicopters, missiles, or
			 unmanned aerial vehicles over the areas designated as a wilderness by section
			 201, including military overflights that can be seen or heard within the
			 wilderness or wild and scenic river areas;</text>
					</paragraph><paragraph id="IDbcf5207cfddb4b36bbe989baf14eddc4"><enum>(2)</enum><text>flight testing
			 and evaluation;</text>
					</paragraph><paragraph id="ID8bc0619afea84e33b1d442e2073bef8e"><enum>(3)</enum><text>the designation
			 or creation of new units of special use airspace, the expansion of units of
			 special use airspace in existence on the date of enactment of this Act, or the
			 use or establishment of military flight training routes over the wilderness or
			 wild and scenic river areas; or</text>
					</paragraph><paragraph id="IDe52fd05f970b4a1f9e3b75e65985c68b"><enum>(4)</enum><text>emergency access
			 and response.</text>
					</paragraph></subsection><subsection id="ID8e5d6bc2a4dd4ddfa11957f3948b59de"><enum>(m)</enum><header>Water
			 rights</header><text>In accordance with section 4(d)(6) of the Wilderness Act
			 (16 U.S.C. 1133(d)(6)), nothing in this Act provides an express or implied
			 claim or denial of the Federal Government with respect to any exemption from
			 water laws of the State.</text>
				</subsection></section><section id="IDb0d97d8e87734a1ea0064263bb03af3f"><enum>204.</enum><header>Land exchanges
			 and acquisitions and grazing preferences</header>
				<subsection id="ID36fa60801f434b059060c6d96de7b8fb"><enum>(a)</enum><header>Exchanges and
			 acquisitions</header>
					<paragraph id="id6F7BE33664CC41D49BF2FA62921F8695"><enum>(1)</enum><header>Findings</header><text>Congress
			 finds that—</text>
						<subparagraph id="id5F1A193DE2A94358A49FC6C456EA41CF"><enum>(A)</enum><text>the consolidation
			 of land ownership would facilitate sound and efficient management for public
			 and private land and serve important public objectives, including—</text>
							<clause id="ID03808dc4a8c04f90be91ea59c9114e88"><enum>(i)</enum><text>the
			 enhancement of public access, aesthetics, and recreational opportunities within
			 and adjacent to designated wilderness and wild and scenic river areas;
			 and</text>
							</clause><clause id="IDea4dd42364054eacb74129391f1fdf25"><enum>(ii)</enum><text>the protection
			 and enhancement of wildlife habitat, including sensitive species;</text>
							</clause></subparagraph><subparagraph id="idF8E7FE1325094499BFB9B7193547842A"><enum>(B)</enum><text>time is of the
			 essence in completing appropriate land exchanges because further delays may
			 force landowners to construct roads in, develop, or sell private land
			 inholdings, and diminish the public values for which the private land is to be
			 acquired; and</text>
						</subparagraph><subparagraph id="idF939CBD822DE4803A197F73A2F67C3B1"><enum>(C)</enum><text>it is in the
			 public interest to complete the land exchanges at the earliest practicable date
			 so that the land acquired by the United States can be preserved for protection
			 of wilderness character, wildlife habitat, and permanent public use and
			 enjoyment.</text>
						</subparagraph></paragraph><paragraph id="id651A773BC6D14D8FBDE86992748E6300"><enum>(2)</enum><header>Authorization</header><text>The
			 Secretary may acquire, by purchase or other exchange, any land or interest
			 offered by an owner under paragraph (3), subject to the conditions described in
			 paragraph (4).</text>
					</paragraph><paragraph id="id0F7B0298DDA345B89A886752B3DC04B8"><enum>(3)</enum><header>Offers to
			 convey</header>
						<subparagraph id="idDFC038B8C1EE4DA2AFB8B7B62F52A610"><enum>(A)</enum><header>In
			 general</header><text>An owner of land or an interest identified under the
			 document entitled <quote>Land Exchanges and Acquisitions</quote> and dated
			 September 1, 2006, may offer to convey the land or interest to the Secretary by
			 purchase or exchange if the owner has submitted to the Secretary, on or before
			 the date of enactment of this Act—</text>
							<clause id="idFA57EB254ED642F1A2A394AF6CB6A597"><enum>(i)</enum><text>a
			 written notice of the intent to exchange or sell the land or interest;</text>
							</clause><clause id="id0C5ED565783C4876BC84FAD0780680F2"><enum>(ii)</enum><text>an
			 identification of each parcel of land and each interest to be exchanged or
			 sold;</text>
							</clause><clause id="id702F0523CB9748E79B256057E4FC235B"><enum>(iii)</enum><text>a
			 description of the value of each parcel of land and each interest as described
			 in that document; and</text>
							</clause><clause id="idE18B05D66E104B2E80762DE14FD8A78D"><enum>(iv)</enum><text>in
			 the case of an exchange, a description of the Federal land sought for the
			 exchange.</text>
							</clause></subparagraph><subparagraph id="idC2CD15668DA54DC0B1F6979F73F63692"><enum>(B)</enum><header>Conveyance by
			 sale</header>
							<clause id="idCF2108EA36B744F1B2B133570D43855E"><enum>(i)</enum><header>In
			 general</header><text>Subject to the availability of funds, the Secretary shall
			 acquire any land or interests offered for purchase under subparagraph (A) as
			 soon as practicable after the date of enactment of this Act.</text>
							</clause><clause id="idFB7CB92970FC4B8183B1F40EA6B84326"><enum>(ii)</enum><header>Election to
			 receive cash</header><text>If an owner makes an election under subparagraph
			 (C)(iii)(II), the Secretary shall acquire by sale the land or interest of the
			 owner as soon as practicable after the date on which the Secretary receives a
			 notice of the election of the owner.</text>
							</clause></subparagraph><subparagraph id="id4828808A087F4787A6EEF68828855922"><enum>(C)</enum><header>Conveyance by
			 direct exchange</header>
							<clause id="id27F3F38880A246EDB58C63F0D93C5A4E"><enum>(i)</enum><header>In
			 general</header><text>On the election of an owner that has submitted an
			 appropriate notice under subparagraph (A)(i), the Secretary may acquire land or
			 property interests identified as eligible for exchange in the document entitled
			 <quote>Land Exchanges and Acquisitions</quote> and dated September 1, 2006, in
			 exchange for Federal land that is—</text>
								<subclause id="idA26C725ED32C440AABA30CEB1881AC9B"><enum>(I)</enum><text>of equal value to
			 the land or property interests, as determined by appraisals of the applicable
			 Federal land, with or without development rights;</text>
								</subclause><subclause id="id783103EFAC8D4C2485DA8D6D54DF6C16"><enum>(II)</enum><text>located in the
			 County; and</text>
								</subclause><subclause id="id3A54C76D0F744E1982C58F1772972B95"><enum>(III)</enum><text>described in
			 the document referred to in subparagraph (A).</text>
								</subclause></clause><clause id="idA69A6F05E8754322BEE205876106737E"><enum>(ii)</enum><header>Action by
			 Secretary</header><text>Not later than 60 days after the date on which the
			 appraisals of applicable land are completed, the Secretary shall offer to enter
			 into an exchange under this subparagraph with each appropriate owner of land or
			 a property interest offered for exchange under subparagraph (A).</text>
							</clause><clause id="id30F44C3584D84955870F45E3A1BF3F87"><enum>(iii)</enum><header>Decisions by
			 owners</header><text>Not later than 60 days after the date on which the
			 appraisals of applicable land are completed, an owner of land or a property
			 interest subject to an exchange under this subparagraph may elect—</text>
								<subclause id="id8BFA5576F31D48BDBE38BF2D23C0390F"><enum>(I)</enum><text>to waive any
			 applicable development right relating to the Federal land to be exchanged,
			 subject to the adjustment of the exchange to achieve like values;</text>
								</subclause><subclause id="idEFFE595D508F4D22BC3E78B0BF354675"><enum>(II)</enum><text>to receive cash
			 in lieu of Federal land for all or any portion of the land or property interest
			 to be exchanged; or</text>
								</subclause><subclause id="idFF9D9B00CD7C482FBFD34D933A1F54BD"><enum>(III)</enum><text>to withdraw
			 from participation in any exchange program.</text>
								</subclause></clause><clause id="idDB3897C3F67A485091E9F931CA126A03"><enum>(iv)</enum><header>Applicability
			 of other law</header><text>Except as otherwise provided in this section, each
			 exchange of Federal land under this section shall be subject to laws (including
			 regulations) applicable to the conveyance and acquisition of land under the
			 jurisdiction of the Bureau of Land Management.</text>
							</clause></subparagraph><subparagraph id="id765B6CDD5C5742519FA827E39D317AD8"><enum>(D)</enum><header>Facilitated
			 land exchanges</header>
							<clause id="id4262C717159848BD9034118D5F8746EC"><enum>(i)</enum><header>In
			 general</header><text>Not later than 30 days after the date of enactment of
			 this Act, the Secretary shall offer to enter into a facilitated land exchange
			 in accordance with subparagraph (A) and conducted through a land exchange
			 facilitator to be designated by the Board.</text>
							</clause><clause id="id866FCD18E864468E9857344796EE5548"><enum>(ii)</enum><header>Exchange
			 offer</header>
								<subclause id="id3F5D39253E224E5AA47EB4326C765B8A"><enum>(I)</enum><header>In
			 general</header><text>Not later than 60 days after the date on which the
			 appraisals of applicable land are completed, the land exchange facilitator
			 shall submit to the Secretary an offer to exchange private land for Federal
			 land in the County.</text>
								</subclause><subclause id="id3CA24E9D64F24D45BAA29ED515778477"><enum>(II)</enum><header>Requirement</header><text>An
			 offer to exchange under subclause (I) shall demonstrate that the appraised
			 value of the private land is equal or approximately equal to the appraised
			 value, with or without development rights, of the Federal land offered for
			 exchange.</text>
								</subclause></clause></subparagraph></paragraph><paragraph id="id8CE9DF6AE1ED44CCA7D6CFF04B678F13"><enum>(4)</enum><header>Conditions</header>
						<subparagraph id="idDE462D6489814C82A78ACAA001150EBD"><enum>(A)</enum><header>Title</header><text>Title
			 to any private land conveyed under this subsection shall—</text>
							<clause id="idA1085A552F4E4DEAA8BCE4868F4B6664"><enum>(i)</enum><text>be
			 acceptable to the Secretary; and</text>
							</clause><clause id="id36699D1F4721412398D3AC2DB75C266B"><enum>(ii)</enum><text>conform with
			 title approval standards applicable to Federal land acquisitions.</text>
							</clause></subparagraph><subparagraph id="id9650443CE4E54B9DAD794796CD200CA6"><enum>(B)</enum><header>Valid existing
			 rights</header><text>Conveyances under this subsection shall be subject to
			 valid existing rights of record.</text>
						</subparagraph></paragraph><paragraph id="id54890B638B154836903CACBEED76C11F"><enum>(5)</enum><header>Effect of
			 subsection</header><text>Nothing in this subsection—</text>
						<subparagraph id="id9E119C3406F841599BDA4767A82D262C"><enum>(A)</enum><text>creates any
			 compensable property right or title with respect to grazing preferences;
			 or</text>
						</subparagraph><subparagraph id="idAC07394A9E6749E19BB4F9DB93B59840"><enum>(B)</enum><text>affects any
			 public access route on Federal land exchanged under this subsection.</text>
						</subparagraph></paragraph></subsection><subsection id="ID67a47801c72c4ca0bbc216fc7c62aa0e"><enum>(b)</enum><header>Grazing
			 preferences</header>
					<paragraph id="id9ACB4E23575B4E6FA36FF56252871B10"><enum>(1)</enum><header>In
			 general</header><text>A holder of a valid grazing preference with respect to
			 all or a portion of any Federal land designated by this Act as a wilderness may
			 voluntarily offer to the Secretary for sale or donation all or any portion of
			 the grazing preference.</text>
					</paragraph><paragraph id="id863B543841A94CB6B004CB81CD753AA7"><enum>(2)</enum><header>Notice</header><text>To
			 offer a grazing preference for sale or donation under paragraph (1), the holder
			 of the grazing preference shall submit to the Secretary a written notice of the
			 intent of the holder, including—</text>
						<subparagraph id="id550C1E59E6F4441F9F0A9671FA8CD51F"><enum>(A)</enum><text>a description of
			 the Federal land to which the grazing preference applies; and</text>
						</subparagraph><subparagraph id="idB3492F562BD74505AE091BA438B5B74D"><enum>(B)</enum><text>the date on which
			 the holder will relinquish use of the grazing preference, which shall be not
			 later than 1 year after the date on which the notice is submitted.</text>
						</subparagraph></paragraph><paragraph id="idAA54C87A57DF4828816B96287704FCD4"><enum>(3)</enum><header>Consideration</header><text>The
			 Secretary shall provide to a holder that offers a grazing preference for sale
			 under paragraph (1) consideration in accordance with the schedule of payments
			 described in the document described in subsection (a)(3)(A).</text>
					</paragraph><paragraph id="ID11061fbbfb6642beb59449d1c1de5cd8"><enum>(4)</enum><header>Cancellation
			 and retirement of livestock grazing</header><text>Beginning on the date
			 identified under paragraph (2)(B)—</text>
						<subparagraph id="id1F9AB84D910F4D31911008D370B6453B"><enum>(A)</enum><text>the applicable
			 grazing preference shall be canceled; and</text>
						</subparagraph><subparagraph id="id5EFCC2E9E4334115BB4F260D70226993"><enum>(B)</enum><text>the associated
			 livestock grazing shall be permanently retired.</text>
						</subparagraph></paragraph><paragraph id="IDdcf809066ae64014941592e0e6562d54"><enum>(5)</enum><header>Fencing</header><text>The
			 Secretary shall install and maintain any fencing and other structures required
			 to prevent grazing use of any Federal land on which a grazing preference has
			 been voluntarily sold or donated under this subsection.</text>
					</paragraph></subsection></section><section id="ID555107b7eb8c475c93cc5d2143196b2e"><enum>205.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Bureau such sums as are necessary to carry
			 out this title.</text>
			</section></title><title id="id011FC33C3647472D83319A1C995619F5"><enum>III</enum><header>Transportation
			 and recreation management</header>
			<section id="ID783cabd6f9e543d486f069e79205f557"><enum>301.</enum><header>Transportation
			 plans</header>
				<subsection id="ID55a9e603edd54e92b0018450e81e6210"><enum>(a)</enum><header>In
			 general</header><text>The Bureau shall develop and implement transportation
			 plans for land managed by the Bureau outside of wilderness areas in the
			 County.</text>
				</subsection><subsection id="ID3337698bb4904fba94ece32aa92f60c8"><enum>(b)</enum><header>Consultation
			 and coordination</header><text>The transportation plans and cooperative
			 agreements shall be developed in consultation and coordination with appropriate
			 Federal Government entities, tribal government entities, and State and local
			 government entities consistent with—</text>
					<paragraph id="IDd39e3447685644dba39a768135912174"><enum>(1)</enum><text>the Federal Land
			 Policy and Management Act of 1976 (43 U.S.C. 1701 et seq.);</text>
					</paragraph><paragraph id="ID7c4b663810c8474a9396fc16b4248345"><enum>(2)</enum><text>the National
			 Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.); and</text>
					</paragraph><paragraph id="ID516641b2199d438290eec16907b52bb6"><enum>(3)</enum><text>any other
			 applicable laws.</text>
					</paragraph></subsection><subsection id="ID00a49cdd48354b7b881fe5019c159626"><enum>(c)</enum><header>Inclusions</header><text>The
			 Bureau shall ensure that all areas of the County managed by the Bureau,
			 including areas that are remote and rarely used for motorized recreation, are
			 included and in transportation plans developed under subsection (a) to—</text>
					<paragraph id="IDe5c2df81cf254b398b9804cf6312e1b5"><enum>(1)</enum><text>provide for
			 management of anticipated growth in recreational use of the land; and</text>
					</paragraph><paragraph id="ID0b99583d83ec4c828e7f35061fa08b7e"><enum>(2)</enum><text>develop a system
			 to provide a wide range of recreational opportunities and experiences for all
			 users.</text>
					</paragraph></subsection><subsection id="ID638f0aa612924bf8a54c568294ee9057"><enum>(d)</enum><header>Limitation</header><text>Transportation
			 plans under subsection (a) shall not affect the status of any road adjacent to
			 any wilderness (as depicted on the applicable map).</text>
				</subsection><subsection id="IDc4e72facc8a4450ca60821e1145d58b7"><enum>(e)</enum><header>System of
			 routes</header>
					<paragraph id="ID217f39edcc8f4b5cade5ff86499f6bc1"><enum>(1)</enum><header>In
			 general</header><text>Each transportation plan under subsection (a)
			 shall—</text>
						<subparagraph id="ID0afb7bd662a248fda20f7d9b8f2e8903"><enum>(A)</enum><text>establish a
			 system of designated roads and trails;</text>
						</subparagraph><subparagraph id="ID642a2afdab7d41f69c213cb7cca070cb"><enum>(B)</enum><text>include a
			 multiple use recreational trail system, that provides a wide range of
			 recreational opportunities and experiences for all users while protecting
			 natural and cultural resources;</text>
						</subparagraph><subparagraph id="ID3f517375b1f648a98aeb992fcf8339d4"><enum>(C)</enum><text>limit the use of
			 motorized and mechanized vehicles to designated roads and trails;</text>
						</subparagraph><subparagraph id="ID56a7a3956a0a436690021b72ea59048f"><enum>(D)</enum><text>address use of
			 snow vehicles on roads, trails, and areas designated for such use;</text>
						</subparagraph><subparagraph id="IDdd089ad8bfcd450dac4d36f63e9ef92c"><enum>(E)</enum><text>be based on
			 resource and route inventories;</text>
						</subparagraph><subparagraph id="ID8e31f5fd8f324bd68913379073469ef5"><enum>(F)</enum><text>include
			 designation of routes and route systems that are open or closed; and</text>
						</subparagraph><subparagraph id="IDf461e5ef2d594de2bfc44e63df2676a2"><enum>(G)</enum><text>include
			 provisions relating to, with respect to the applicable land—</text>
							<clause id="IDb2fd9083097f4d9aa875a690b9b69d71"><enum>(i)</enum><text>trail
			 construction and reconstruction;</text>
							</clause><clause id="IDc8a3bf26fb4d466ca3bd5d212182b288"><enum>(ii)</enum><text>road and trail
			 closure;</text>
							</clause><clause id="ID890766a73e3f4d408a1b88128ccad10c"><enum>(iii)</enum><text>seasonal
			 closures or restrictions;</text>
							</clause><clause id="ID3ebd6600f5c3451fb7f1f0e0d1ee4210"><enum>(iv)</enum><text>restoration of
			 disturbed areas;</text>
							</clause><clause id="ID18ecaa948d6c49059931baa9e58ec0d8"><enum>(v)</enum><text>monitoring;</text>
							</clause><clause id="ID65617e65bae34cee860307978c752788"><enum>(vi)</enum><text>maintenance;</text>
							</clause><clause id="IDba4fef170aae479da4a63952e7bef411"><enum>(vii)</enum><text>maps;</text>
							</clause><clause id="IDba0f20e846c24ca6bc0b3f0c461bc34e"><enum>(viii)</enum><text>signs;</text>
							</clause><clause id="ID045cc1ea9b5f49268f87a290797556a8"><enum>(ix)</enum><text>education;
			 and</text>
							</clause><clause id="ID9a50e3c579b5423b91d59bf90f9ca48c"><enum>(x)</enum><text>enforcement.</text>
							</clause></subparagraph></paragraph><paragraph id="IDa7d2cb94d45341309b6c0af6c9f7fce6"><enum>(2)</enum><header>Temporary
			 limitation</header>
						<subparagraph id="IDa739c5ddd5d641faa5c19eda4de7b0f9"><enum>(A)</enum><header>In
			 general</header><text>Except as provided in subparagraph (B), until the date on
			 which the Bureau completes transportation planning, all recreational motorized
			 and mechanized off-highway vehicle use shall be limited to roads and trails in
			 existence on the day before the date of enactment of this Act.</text>
						</subparagraph><subparagraph id="ID34a3106cb8a04813adffc3948e9eaa37"><enum>(B)</enum><header>Exceptions</header>
							<clause id="idEA34018D00DC4822A254863654A4E348"><enum>(i)</enum><header>In
			 general</header><text>Subparagraph (A) shall not apply to areas specifically
			 identified as open, closed, or limited under the Owyhee resource management
			 plan.</text>
							</clause><clause id="id61C929F7B94549FDB2724E8914B97146"><enum>(ii)</enum><header>Hemmingway
			 Butte area</header><text>Notwithstanding subparagraph (A), the Bureau may take
			 into consideration maintaining the Hemmingway Butte area as open to
			 cross-country travel.</text>
							</clause></subparagraph></paragraph></subsection><subsection id="ID701bba6db58241d9b41876a44071faab"><enum>(f)</enum><header>Schedule</header>
					<paragraph id="ID01e9d86299504010b1cf5df42a98f0fa"><enum>(1)</enum><header>Owyhee
			 front</header><text>Not later than 1 year after the date of enactment of this
			 Act, the Bureau shall complete a transportation plan for the Owyhee
			 Front.</text>
					</paragraph><paragraph id="IDf2550f96112c41f7bbb44da0e22c2fa9"><enum>(2)</enum><header>Other Federal
			 lands in the county</header><text>Not later than 3 years after the date of
			 enactment of this Act, the Bureau shall complete a transportation plan for
			 Federal land in the County outside the Owyhee Front.</text>
					</paragraph></subsection></section><section id="ID84fb42b507b2416a96a4be94943e7ba7"><enum>302.</enum><header>Authority</header><text display-inline="no-display-inline">Transportation and travel management under
			 this title shall not affect the authority of the Bureau to manage or regulate
			 off-highway vehicle use under title 43, Code of Federal Regulations (as in
			 effect on September 25, 2005).</text>
			</section><section id="IDd3bdc567171f45cd979810c3045bb3c6"><enum>303.</enum><header>Cooperative
			 agreements</header>
				<subsection id="ID8fbc42bfa5824717ab6ebfdecc404bf0"><enum>(a)</enum><header>In
			 general</header><text>As soon as practicable, after the date of enactment of
			 this Act, the Bureau shall offer to enter into cooperative agreements with the
			 County—</text>
					<paragraph id="IDed41a422ae024e52ad10b0eaf22526b2"><enum>(1)</enum><text>to establish a
			 cooperative search and rescue program; and</text>
					</paragraph><paragraph id="IDb7a78d34d97246aab3e92070aa3b311e"><enum>(2)</enum><text>to implement and
			 enforce the transportation plans described in this section.</text>
					</paragraph></subsection><subsection id="ID9041fa538e19445f8b77ef09ad8126eb"><enum>(b)</enum><header>Authorization
			 of appropriations</header><text>There are authorized to be appropriated to the
			 Bureau such sums as are necessary—</text>
					<paragraph id="ID0f67c5b8bbe34383afe583b72beb6c64"><enum>(1)</enum><text>to carry out
			 search and rescue operations in the County; and</text>
					</paragraph><paragraph id="ID082fab0321274ed6a2c60aee042945b9"><enum>(2)</enum><text>to develop,
			 implement, and enforce off-highway motor vehicle transportation plans under
			 this section.</text>
					</paragraph></subsection></section><section id="IDc47407aab2044ee3893fd6f749f0ac61"><enum>304.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Bureau such sums as are necessary to
			 accelerate completion and implementation by the Bureau of the transportation
			 plan for the Owyhee Front and subsequent transportation plans for the remainder
			 of the County.</text>
			</section></title><title id="id4A6FC6272D094EAAACB874815822DA7F"><enum>IV</enum><header>Cultural
			 resources</header>
			<section id="ID0f5c3227dad442e49c362c79b497bc7f"><enum>401.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds that—</text>
				<paragraph id="ID93e302142e3e4266b14d1b4d4a103fdb"><enum>(1)</enum><text>the County is
			 rich in history and culture going back thousands of years;</text>
				</paragraph><paragraph id="ID6f82e58af45a484d8f54a20009f10ed9"><enum>(2)</enum><text>the cultural and
			 historical resources important to the people and ancestors of the Tribes must
			 be protected against abuse and desecration, whether intentional or
			 unintentional;</text>
				</paragraph><paragraph id="ID3809f95cf75d4e0d953b1df27b27418a"><enum>(3)</enum><text>there are
			 opportunities—</text>
					<subparagraph id="ID34defe2362fb40a49eab05a12c4a8d54"><enum>(A)</enum><text>to increase
			 knowledge of cultural resources;</text>
					</subparagraph><subparagraph id="IDd2d20ae70fce43d0af7b7f786b6ef1b1"><enum>(B)</enum><text>to monitor
			 influences from outside forces; and</text>
					</subparagraph><subparagraph id="IDc803cada02284ab69c005fc3205316b2"><enum>(C)</enum><text>to improve the
			 inspection and supervision of major cultural sites;</text>
					</subparagraph></paragraph><paragraph id="ID4b1b61fdd5c24a3eb6b5e26d05895333"><enum>(4)</enum><text>inventory and
			 monitoring programs that identify and document cultural sites and the condition
			 of those sites over time would—</text>
					<subparagraph id="ID545bd1b67bcd4eadb3770d6ca7e9104c"><enum>(A)</enum><text>assist in
			 ensuring the preservation of the sites; and</text>
					</subparagraph><subparagraph id="ID345412f45b9a4410b4cd09c4ea81a904"><enum>(B)</enum><text>help to focus
			 resources—</text>
						<clause id="ID10a1b31789614b27aaaee6c1158c64b0"><enum>(i)</enum><text>to
			 ensure compliance with prohibitions against destruction and or removal of
			 cultural items; and</text>
						</clause><clause id="IDbf8fdd109202428bbc93cbb4f12af234"><enum>(ii)</enum><text>to
			 prevent inadvertent negative impacts;</text>
						</clause></subparagraph></paragraph><paragraph id="ID5de32711725643ef852ea3807c27fce2"><enum>(5)</enum><text>the Owyhee
			 Initiative Agreement will—</text>
					<subparagraph id="IDb153bc5148d7467eb22fb2fbe37bcee5"><enum>(A)</enum><text>support a broad
			 range of measures to protect cultural sites and resources important to the
			 continuation of the traditions and beliefs of the Tribes; and</text>
					</subparagraph><subparagraph id="ID5c07342bb44c47c48f2f7e6abf5b9d87"><enum>(B)</enum><text>provide for the
			 implementation of the Plan; and</text>
					</subparagraph></paragraph><paragraph id="ID1aa490d294c74a0ba7157413f368fb64"><enum>(6)</enum><text>the
			 implementation of the Plan should—</text>
					<subparagraph id="idA1BBF7728BA54FA38A9285AC7467B2AC"><enum>(A)</enum><text>be consistent
			 with the Indian Self-Determination and Education Assistance Act (25 U.S.C. 450
			 et seq.); and</text>
					</subparagraph><subparagraph id="id1ACC584255A942878636C1C85CA21393"><enum>(B)</enum><text>recognize
			 that—</text>
						<clause id="ID7f96a909a36147eca34dc270fc9cb761"><enum>(i)</enum><text>the
			 right of Indians to self-government results from the inherent sovereignty of
			 Indian tribes; and</text>
						</clause><clause id="ID452ab45e53064cb8bcc3a07685a5a98d"><enum>(ii)</enum><text>the United
			 States—</text>
							<subclause id="id1B471D25FBB74F1585521F0B8F38A597"><enum>(I)</enum><text>has a special and
			 unique legal and political relationship with federally recognized Indian
			 tribes; and</text>
							</subclause><subclause id="id3443C5BEC3024C14B2CA38979F9BCD48"><enum>(II)</enum><text>is obligated to
			 develop a government-to-government relationship with Indian tribes under the
			 Constitution, treaties, Federal law, and the course of dealings with Indian
			 tribes.</text>
							</subclause></clause></subparagraph></paragraph></section><section id="ID12ddb15002d54494b8d2fa4cf242cf0a"><enum>402.</enum><header>Implementation</header><text display-inline="no-display-inline">The Tribes shall implement the Plan.</text>
			</section><section id="IDa06cb30e441d4a5d9de21571917e242b"><enum>403.</enum><header>Authorization
			 of appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated to the Tribes to carry out this title—</text>
				<paragraph id="ID887e2f8779ea4ff78d3213cc81edd765"><enum>(1)</enum><text>$900,000 for
			 fiscal year 2008; and</text>
				</paragraph><paragraph id="IDf4b4f438b68241f78cb396cc1da6fad1"><enum>(2)</enum><text>$900,000 for each
			 of fiscal years 2009 through 2012.</text>
