		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Star-Spangled Banner and War of 1812
			 Bicentennial Commission Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID4AF07167B91243058EE8E8B5DAF3018D" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Findings and purpose</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDB641D1D2F22845789053683562DB5605"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress finds that—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID7F547C434FF54EF6A9F17F2581D66272"><enum>(1)</enum><text display-inline="yes-display-inline">the War of 1812 served as a crucial test
			 for the United States Constitution and the newly established democratic
			 Government;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA11E80DF40544C39AEEB2104D26AF910"><enum>(2)</enum><text display-inline="yes-display-inline">vast regions of the new multi-party
			 democracy, including the Chesapeake Bay, the Gulf of Mexico and the Niagara
			 Frontier, were affected by the War of 1812 including the States of Alabama,
			 Connecticut, Delaware, Florida, Georgia, Iowa, Illinois, Indiana, Kentucky,
			 Louisiana, Massachusetts, Maryland, Maine, Michigan, Missouri, Mississippi, New
			 Jersey, North Carolina, New Hampshire, New York, Ohio, Oregon, Pennsylvania,
			 Rhode Island, South Carolina, Tennessee, Virginia, Vermont, Wisconsin, West
			 Virginia, and the District of Columbia;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd56c889c554b4820933e8f729eefa873"><enum>(3)</enum><text display-inline="yes-display-inline">the British occupation of American
			 territory along the Great Lakes and in other regions, the burning of
			 Washington, DC, the American victories at Fort McHenry, New Orleans, and
			 Plattsburgh, among other battles, had far reaching effects on American
			 society;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2454975CD133486DB1AB7CE2A24AE8D7"><enum>(4)</enum><text display-inline="yes-display-inline">at the Battle of Baltimore, Francis Scott
			 Key wrote the poem that celebrated the flag and later was titled <quote>the
			 Star-Spangled Banner</quote>;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAA9A54CBC2864E49965894B88AE1A54F"><enum>(5)</enum><text display-inline="yes-display-inline">the poem led to the establishment of the
			 flag as an American icon and became the words of the national anthem of the
			 United States in 1932; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA4C00E74B4014466BD9D848F1F86EB8E"><enum>(6)</enum><text display-inline="yes-display-inline">it is in the national interest to provide
			 for appropriate commemorative activities to maximize public understanding of
			 the meaning of the War of 1812 in the history of the United States.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID2098C98C84B4412F9158368E9F1D0472"><enum>(b)</enum><header display-inline="yes-display-inline">Purposes</header><text display-inline="yes-display-inline">The purposes of this Act are to—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDB8D5211DE08E417DADDB7EFC3EE4102E"><enum>(1)</enum><text display-inline="yes-display-inline">establish the Star-Spangled Banner and War
			 of 1812 Commemoration Commission;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE210C6EBC23D4D5B9140DFC11A483CEE"><enum>(2)</enum><text display-inline="yes-display-inline">ensure a suitable national observance of
			 the War of 1812 by complementing, cooperating with, and providing assistance to
			 the programs and activities of the various States involved in the
			 commemoration;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4BD2AD88D18549BB96583DB743540B05"><enum>(3)</enum><text display-inline="yes-display-inline">encourage War of 1812 observances that
			 provide an excellent visitor experience and beneficial interaction between
			 visitors and the natural and cultural resources of the various War of 1812
			 sites;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA649B660B70A4303AC3C4FFFACAD9EDD"><enum>(4)</enum><text display-inline="yes-display-inline">facilitate international involvement in the
			 War of 1812 observances;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8EBB737B096D4623BA0E56913BBAA8B5"><enum>(5)</enum><text display-inline="yes-display-inline">support and facilitate marketing efforts
			 for a commemorative coin, stamp, and related activities for the War of 1812
			 observances; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE59EBCBA293E4087AB853BF2EDFD2490"><enum>(6)</enum><text display-inline="yes-display-inline">promote the protection of War of 1812
			 resources and assist in the appropriate development of heritage tourism and
			 economic benefits to the United States.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID62ABB0C80E194BD0B8C34AC791E407D0" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID6913887871A44DD799377E60CA7BA829"><enum>(1)</enum><header display-inline="yes-display-inline">Commemoration</header><text display-inline="yes-display-inline">The term <term>commemoration</term> means
			 the commemoration of the War of 1812.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA5A305B498E3421CAF1ED392E82B73A5"><enum>(2)</enum><header display-inline="yes-display-inline">Commission</header><text display-inline="yes-display-inline">The term <term>Commission</term> means the
			 Star-Spangled Banner and War of 1812 Bicentennial Commission established in
			 section 4(a).</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBCF47F794D004C66AD5C319B2F62C3A6"><enum>(3)</enum><header display-inline="yes-display-inline">Qualified citizen</header><text display-inline="yes-display-inline">The term <term>qualified citizen</term>
			 means a citizen of the United States with an interest in, support for, and
			 expertise appropriate to the commemoration.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF06A15FACEBB4E719C4BC96E681AEFE8"><enum>(4)</enum><header display-inline="yes-display-inline">Secretary</header><text display-inline="yes-display-inline">The term <term>Secretary</term> means the
			 Secretary of the Interior.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID46578574BBC548089587239461DCBCE1"><enum>(5)</enum><header display-inline="yes-display-inline">States</header><text display-inline="yes-display-inline">The term <term>States</term>—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="IDD44051F1E0894F58A05132B2CB382C88"><enum>(A)</enum><text display-inline="yes-display-inline">means the States of Alabama, Kentucky,
			 Indiana, Louisiana, Maryland, Virginia, New York, Maine, Michigan, and Ohio;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDACB4776BAA5849BFBAFB48BE7676108D"><enum>(B)</enum><text display-inline="yes-display-inline">includes agencies and entities of each
			 State.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="ID01D33ED439B744ACB068C6BA5196FC84" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Star-Spangled Banner and War of 1812
			 Commemoration Commission</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID859DB9A8ECAB4426BC737A7F26C516ED"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">There is established a commission to be
			 known as the <quote>Star-Spangled Banner and War of 1812 Bicentennial
			 Commission</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2190FE73CC9D458CB4761EC064E5D373"><enum>(b)</enum><header display-inline="yes-display-inline">Membership</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDA7AB0B8D0E3149FD8FB2AD7ADD5527FF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall be composed of 21
			 members, of whom—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDC61282FAC6D64A50ACC090D88F29B931"><enum>(A)</enum><text display-inline="yes-display-inline">3 members shall be qualified citizens
			 appointed by the Secretary after consideration of nominations submitted by the
			 Governors of Maryland, Louisiana, and Virginia;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDa53c1bb689ec4859a14fa5c229adaeb5"><enum>(B)</enum><text display-inline="yes-display-inline">7 members shall be qualified citizens
			 appointed by the Secretary after consideration of nominations submitted by the
			 Governors of Alabama, Kentucky, Indiana, New York, Maine, Michigan and
			 Ohio;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID33545600231842A4B911F9080F87249D"><enum>(C)</enum><text display-inline="yes-display-inline">3 members shall be qualified citizens
			 appointed by the Secretary after consideration of nominations submitted by the
			 Mayors of the District of Columbia, the City of Baltimore, and the City of New
			 Orleans;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC07732BAB4244CA6A8C546D1CD72420D"><enum>(D)</enum><text display-inline="yes-display-inline">2 members shall be employees of the
			 National Park Service, of whom—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDB4E906617A5346BEBB832FBA6FFC9E20"><enum>(i)</enum><text display-inline="yes-display-inline">1 shall be the Director of the National
			 Park Service (or a designee); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDF5D6A2219CD24BF5BDAF77AB528944E7"><enum>(ii)</enum><text display-inline="yes-display-inline">1 shall be an employee of the National Park
			 Service having experience relevant to the commemoration;</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID7248a1cb1ed84557984b1c85857c0a95"><enum>(E)</enum><text display-inline="yes-display-inline">4 members shall be qualified citizens
			 appointed by the Secretary with consideration of recommendations—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID23b191638ad346afa2dfe617d273f29b"><enum>(i)</enum><text display-inline="yes-display-inline">1 of which are submitted by the majority
			 leader of the Senate;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID7e8a4ab936d844d8818c9ea3be8e53c4"><enum>(ii)</enum><text display-inline="yes-display-inline">1 of which are submitted by the minority
			 leader of the Senate;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID801382ee78bf4731b8cc809de6235eda"><enum>(iii)</enum><text display-inline="yes-display-inline">1 of which are submitted by the majority
			 leader of the House of Representatives;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDecd1422beef84dccbde604c3e9dca997"><enum>(iv)</enum><text display-inline="yes-display-inline">1 of which are submitted by the minority
			 leader of the House of Representatives; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID6A233CC8A5634C94A3F1EAAC559FDA54"><enum>(F)</enum><text display-inline="yes-display-inline">2 members shall be appointed by the
			 Secretary from among individuals with expertise in the history of the War of
			 1812.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID841FBF1F080D49ADA69FAE97A166D9C4"><enum>(2)</enum><header display-inline="yes-display-inline">Date of appointments</header><text display-inline="yes-display-inline">The appointment of a member of the
			 Commission shall be made not later than 120 days after the date of enactment of
			 this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3D52D9E48D4640FD89C6F5EE17642FB2"><enum>(c)</enum><header display-inline="yes-display-inline">Term; Vacancies</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID946216E7BE304A799EE0609EB14A85F6"><enum>(1)</enum><header display-inline="yes-display-inline">Term</header><text display-inline="yes-display-inline">A member shall be appointed for the life of
			 the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE5A4D3B897214D2FB6663F12B99AA49C"><enum>(2)</enum><header display-inline="yes-display-inline">Vacancies</header><text display-inline="yes-display-inline">A vacancy on the Commission—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDCD7575C6EE4844DB940981433B44D407"><enum>(A)</enum><text display-inline="yes-display-inline">shall not affect the powers of the
			 Commission; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID04D993FE9339468B9878B6E6C91581B4"><enum>(B)</enum><text display-inline="yes-display-inline">shall be filled in the same manner as the
			 original appointment was made.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C92873FD100470FA68FC9778E5B3CE2"><enum>(d)</enum><header display-inline="yes-display-inline">Voting</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDDFD934F67D204948B2901DDC1BAFC6AF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall act only on an
			 affirmative vote of a majority of the members of the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB174ADF3B582408C93F3B03ABC416581"><enum>(2)</enum><header display-inline="yes-display-inline">Quorum</header><text display-inline="yes-display-inline">A majority of the members of the Commission
			 shall constitute a quorum.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAD90037E5A1047FE89D4B86FD19024DC"><enum>(e)</enum><header display-inline="yes-display-inline">Chairperson and Vice Chairperson</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID6027E39FFEA448B395A0B4810F0E0FA0"><enum>(1)</enum><header display-inline="yes-display-inline">Selection</header><text display-inline="yes-display-inline">The Commission shall select a chairperson
			 and a vice chairperson from among the members of the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0FB5FE1C849A42C9BEEA46728DEDC1CA"><enum>(2)</enum><header display-inline="yes-display-inline">Absence of chairperson</header><text display-inline="yes-display-inline">The vice chairperson shall act as
			 chairperson in the absence of the chairperson.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDDEB26A4366094208AF378D1215A4074D"><enum>(f)</enum><header display-inline="yes-display-inline">Initial Meeting</header><text display-inline="yes-display-inline">Not later than 60 days after the date on
			 which all members of the Commission have been appointed and funds have been
			 provided, the Commission shall hold the initial meeting of the
			 Commission.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID652D169B4FC1493EBD9D67F613DE1B24"><enum>(g)</enum><header display-inline="yes-display-inline">Meetings</header><text display-inline="yes-display-inline">Not less than twice a year, the Commission
			 shall meet at the call of the chairperson or a majority of the members of the
			 Commission.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1cc08f627f32475483599babf9dc28a6"><enum>(h)</enum><header display-inline="yes-display-inline">Removal</header><text display-inline="yes-display-inline">Any member who fails to attend 3 successive
			 meetings of the Commission or who otherwise fails to participate substantively
			 in the work of the Commission may be removed by the Secretary and the vacancy
			 shall be filled in the same manner as the original appointment was made.
			 Members serve at the discretion of the Secretary.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF357BD6DA2C64FC19E16640A9552FF04" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Duties</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID6DA3E6B22757496EA3B2D75412F8DA82"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Commission shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID2334FA820514482C9F2590850162A919"><enum>(1)</enum><text display-inline="yes-display-inline">plan, encourage, develop, execute, and
			 coordinate programs, observances, and activities commemorating the historic
			 events that preceded and are associated with the War of 1812;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID084B5FCEB8EA445BB62A34A3C517FBE0"><enum>(2)</enum><text display-inline="yes-display-inline">facilitate the commemoration throughout the
			 United States and internationally;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDFCD441D9BDC94384BF4AABF42063AC6B"><enum>(3)</enum><text display-inline="yes-display-inline">coordinate the activities of the Commission
			 with State commemoration commissions, the National Park Service, the Department
			 of Defense, and other appropriate Federal agencies;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB1DF34D39E82400D95134E1489B048E0"><enum>(4)</enum><text display-inline="yes-display-inline">encourage civic, patriotic, historical,
			 educational, religious, economic, tourism, and other organizations throughout
			 the United States to organize and participate in the commemoration to expand
			 the understanding and appreciation of the significance of the War of
			 1812;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD2BD3F835F6412B8F42340CF04532BA"><enum>(5)</enum><text display-inline="yes-display-inline">provide technical assistance to States,
			 localities, units of the National Park System, and nonprofit organizations to
			 further the commemoration and commemorative events;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB2C22C304BEC4AB69D021FCBCE9ACB87"><enum>(6)</enum><text display-inline="yes-display-inline">coordinate and facilitate scholarly
			 research on, publication about, and interpretation of the people and events
			 associated with the War of 1812;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9F2A89713E46474EBF2CD5019FF3B35E"><enum>(7)</enum><text display-inline="yes-display-inline">design, develop, and provide for the
			 maintenance of an exhibit that will travel throughout the United States during
			 the commemoration period to interpret events of the War of 1812 for the
			 educational benefit of the citizens of the United States;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7628988E57BB4A4994082107CEE6E46E"><enum>(8)</enum><text display-inline="yes-display-inline">ensure that War of 1812 commemorations
			 provide a lasting legacy and long-term public benefit leading to protection of
			 the natural and cultural resources associated with the War of 1812; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2C68277959A34229925599B4A314CA29"><enum>(9)</enum><text display-inline="yes-display-inline">examine and review essential facilities and
			 infrastructure at War of 1812 sites and identify possible improvements that
			 could be made to enhance and maximize visitor experience at the sites.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD1CC46FAFCC640BCB8A8BA48B37BD2F0"><enum>(b)</enum><header display-inline="yes-display-inline">Strategic Plan; Annual Performance
			 Plans</header><text display-inline="yes-display-inline">The Commission shall
			 prepare a strategic plan and annual performance plans for any activity carried
			 out by the Commission under this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID4C014C20DF8C4F3E8358EAFD53419656"><enum>(c)</enum><header display-inline="yes-display-inline">Reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID56AD7DA994C946CC90D0436D7330967C"><enum>(1)</enum><header display-inline="yes-display-inline">Annual report</header><text display-inline="yes-display-inline">The Commission shall submit to Congress an
			 annual report that contains a list of each gift, bequest, or devise to the
			 Commission with a value of more than $250, together with the identity of the
			 donor of each gift, bequest, or devise.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCF3B0539B90D4002B9835BE787E56AD2"><enum>(2)</enum><header display-inline="yes-display-inline">Final report</header><text display-inline="yes-display-inline">Not later than September 30, 2015, the
			 Commission shall submit to the Secretary and Congress a final report that
			 includes—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID8C4EC93558CC486A95DD3BD50D19B915"><enum>(A)</enum><text display-inline="yes-display-inline">a summary of the activities of the
			 Commission;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF594FFFDF90C4066843058834E7CB6CB"><enum>(B)</enum><text display-inline="yes-display-inline">a final accounting of any funds received or
			 expended by the Commission; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5D52C52D061546D481D78E5D9EBF024C"><enum>(C)</enum><text display-inline="yes-display-inline">the final disposition of any historically
			 significant items acquired by the Commission and other properties not
			 previously reported.</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="ID83FCA4B76F2D4D18804D83B02FC29E26" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Powers</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDEC02DA82DBA640F595BEE4617BA4DE37"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">The Commission may—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDDE28EC6B85134844BECD89F789A7F8F7"><enum>(1)</enum><text display-inline="yes-display-inline">solicit, accept, use, and dispose of gifts
			 or donations of money, services, and real and personal property related to the
			 commemoration in accordance with Department of the Interior and National Park
			 Service written standards for accepting gifts from outside sources;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID915EC19D12894C03B1887AF603BB4279"><enum>(2)</enum><text display-inline="yes-display-inline">appoint such advisory committees as the
			 Commission determines to be necessary to carry out this Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC6BDBEF0355948B49FE1E9F2A65AA934"><enum>(3)</enum><text display-inline="yes-display-inline">authorize any member or employee of the
			 Commission to take any action the Commission is authorized to take under this
			 Act;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1D65C13D99114F9FB6F481CF161D1611"><enum>(4)</enum><text display-inline="yes-display-inline">use the United States mails in the same
			 manner and under the same conditions as other agencies of the Federal
			 Government; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDDFA937B2D8DC457C961C9384A056C427"><enum>(5)</enum><text display-inline="yes-display-inline">make grants to communities, nonprofit,
			 commemorative commissions or organizations, and research and scholarly
			 organizations to develop programs and products to assist in researching,
			 publishing, marketing, and distributing information relating to the
			 commemoration.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID751DF481C4834E499AEBF52282959FC1"><enum>(b)</enum><header display-inline="yes-display-inline">Legal Agreements</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5BC484B1E3AF48289DFE6401FED8A6A9"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In carrying out this Act, the Commission
			 may—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDCE272844B9114B4A914BBBE43D646242"><enum>(A)</enum><text display-inline="yes-display-inline">procure supplies, services, and property;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDFBB82DE5F0E044D1B4E5FAEB3B65DCFB"><enum>(B)</enum><text display-inline="yes-display-inline">make or enter into contracts, leases, or
			 other legal agreements.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDB147FF225286408C8366F2D09569A89B"><enum>(2)</enum><header display-inline="yes-display-inline">Length</header><text display-inline="yes-display-inline">Any contract, lease, or other legal
			 agreement made or entered into by the Commission shall not extend beyond the
			 date of termination of the Commission.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB23FB3C7A6C74628B88A4B623DF93154"><enum>(c)</enum><header display-inline="yes-display-inline">Information From Federal Agencies</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDC5B2E2103B2C456FB729722F021EB077"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission may secure directly from a
			 Federal agency such information as the Commission considers necessary to carry
			 out this Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4EDA18E580C149709643361DB9F43220"><enum>(2)</enum><header display-inline="yes-display-inline">Provision of information</header><text display-inline="yes-display-inline">On request of the Chairperson of the
			 Commission, the head of the agency shall provide the information to the
			 Commission in accordance with applicable laws.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDc85d49a6ca5b41f5b7f40dbc2cc80554"><enum>(d)</enum><header display-inline="yes-display-inline">FACA application</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5
			 U.S.C. App.)—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id65AA67B2357742A5AF4B7C48E6F7C04D"><enum>(1)</enum><text display-inline="yes-display-inline">shall not apply to the Commission;
			 and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8dcfcb6b1315462a82ef173aee495970"><enum>(2)</enum><text display-inline="yes-display-inline">shall apply to advisory committees
			 established under subsection (a)(2).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDe89010b218fc496fa92dfd7dac94871a"><enum>(e)</enum><header display-inline="yes-display-inline">No effect on authority</header><text display-inline="yes-display-inline">Nothing in this Act supersedes the
			 authority of the States or the National Park Service concerning the
			 commemoration.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDF766487C3DC243CA829A96244243972F" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Personnel matters</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID5532B14FA5B3493CA15AEC3E8ED79535"><enum>(a)</enum><header display-inline="yes-display-inline">Members of the Commission</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID3A9773976E784CA7A9078B4937EC84B1"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (c)(1)(A),
			 a member of the Commission shall serve without compensation.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID7AA08C78E17640FCB27A4A30B9C8F380"><enum>(2)</enum><header display-inline="yes-display-inline">Travel expenses</header><text display-inline="yes-display-inline">A member of the Commission shall be allowed
			 travel expenses, including per diem in lieu of subsistence, at rates authorized
			 for an employee of an agency under subchapter I of chapter 57 of title 5,
			 United States Code, while away from the home or regular place of business of
			 the member in the performance of the duties of the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98ecdcaea5264ebca144647f1d30ddf7"><enum>(3)</enum><header display-inline="yes-display-inline">Status</header><text display-inline="yes-display-inline">A member of the Commission, who is not
			 otherwise a Federal employee, shall be considered a Federal employee only for
			 purposes of the provisions of law related to ethics, conflicts of interest,
			 corruption, and any other criminal or civil statute or regulation governing the
			 conduct of Federal employees.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C80ECEB24F24FA0AEA1BB646ACB3F71"><enum>(b)</enum><header display-inline="yes-display-inline">Executive director and other staff</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5D261511A5B248C48412EB2F86AAFC8E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Chairperson of the Commission may,
			 without regard to the provisions of title 5, United States Code, governing
			 appointments in the competitive service and termination of employees (including
			 regulations), appoint and terminate an executive director, subject to
			 confirmation by the Commission, and appoint and terminate such other additional
			 personnel as are necessary to enable the Commission to perform the duties of
			 the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID98ef9429d86e4c18bfb59043ee868bba"><enum>(2)</enum><header display-inline="yes-display-inline">Status</header><text display-inline="yes-display-inline">The Executive Director and other staff
			 appointed under this subsection shall be considered Federal employees under
			 section 2105 of title 5, United States Code, notwithstanding the requirements
			 of such section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB073821A166448B8242709B3C5DD581"><enum>(3)</enum><header display-inline="yes-display-inline">Confirmation of executive
			 director</header><text display-inline="yes-display-inline">The employment of an
			 executive director shall be subject to confirmation by the Commission.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6CEF1B02097D470CBACC91EA11BB86D5"><enum>(4)</enum><header display-inline="yes-display-inline">Compensation</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID70C3695F3EF74641B349C929D44CC31F"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subparagraph (B), the
			 Chairperson of the Commission may fix the compensation of the executive
			 director and other personnel without regard to the provisions of chapter 51 and
			 subchapter III of chapter 53 of title 5, United States Code, relating to
			 classification of positions and General Schedule pay rates.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1CE17A97668542B68F7BC0C26976D85C"><enum>(B)</enum><header display-inline="yes-display-inline">Maximum rate of pay</header><text display-inline="yes-display-inline">The rate of basic pay for the executive
			 director and other personnel shall not exceed the rate payable for level V of
			 the Executive Schedule under section 5316 of title 5, United States
			 Code.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID712c066f57c6411bbcf9503bf2288e14"><enum>(c)</enum><header display-inline="yes-display-inline">Government employees</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID6339583f1f904300ad90fb3ac281234b"><enum>(1)</enum><header display-inline="yes-display-inline">Federal employees</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDdc1af48bbff04c5aa96971c77adfd31c"><enum>(A)</enum><header display-inline="yes-display-inline">Service on commission</header><text display-inline="yes-display-inline">A member of the Commission who is an
			 officer or employee of the Federal Government shall serve without compensation
			 in addition to the compensation received for the services of the member as an
			 officer or employee of the Federal Government.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID2723fe03326a47619d9e2f4f6c500b94"><enum>(B)</enum><header display-inline="yes-display-inline">Detail</header><text display-inline="yes-display-inline">At the request of the Commission, the head
			 of any Federal agency may detail, on a reimbursable or nonreimbursable basis,
			 any of the personnel of the agency to the Commission to assist the Commission
			 in carrying out the duties of the Commission under this Act.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID543b63f40e9e4edd880f4fe48b8ed5a9"><enum>(C)</enum><header display-inline="yes-display-inline">Civil service status</header><text display-inline="yes-display-inline">Notwithstanding any other provisions in
			 this section, Federal employees who serve on the Commission, are detailed to
			 the Commission, or otherwise provide services under the Act, shall continue to
			 be Federal employees for the purpose of any law specific to Federal employees,
			 without interruption or loss of civil service status or privilege.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDd668bc9e51554055897dcb5dced051ac"><enum>(2)</enum><header display-inline="yes-display-inline">State employees</header><text display-inline="yes-display-inline">The Commission may—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID11015e14176347d395b8ffe9058007ae"><enum>(A)</enum><text display-inline="yes-display-inline">accept the services of personnel detailed
			 from States (including subdivisions of States) under subchapter VI of chapter
			 33 of title 5, United States Code; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID01d5702b65e34754bc75a63f5b8f16c7"><enum>(B)</enum><text display-inline="yes-display-inline">reimburse States for services of detailed
			 personnel.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDcac46021e2754a7886374f9d85833e82"><enum>(d)</enum><header display-inline="yes-display-inline">Members of advisory
			 committees</header><text display-inline="yes-display-inline">Members of
			 advisory committees appointed under section 6(a)(2)—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id61EF7461C40A482092C5D8F19C6C1243"><enum>(1)</enum><text display-inline="yes-display-inline">shall not be considered employees of the
			 Federal Government by reason of service on the committees for the purpose of
			 any law specific to Federal employees, except for the purposes of chapter 11 of
			 title 18, United States Code, relating to conflicts of interest; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDed5f83137f3a4c64bf2040a8d6f168b8"><enum>(2)</enum><text display-inline="yes-display-inline">may be paid travel expenses, including per
			 diem in lieu of subsistence, at rates authorized for an employee of an agency
			 under subchapter I of chapter 57 of title 5, United States Code, while away
			 from the home or regular place of business of the member in the performance of
			 the duties of the committee.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDf74d5278eaeb4d3897d08083497f1bda"><enum>(e)</enum><header display-inline="yes-display-inline">Volunteer and uncompensated
			 services</header><text display-inline="yes-display-inline">Notwithstanding
			 section 1342 of title 31, United States Code, the Commission may accept and use
			 such voluntary and uncompensated services as the Commission determines
			 necessary.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1df422ad2efa4845a82b9ea31c148b5c"><enum>(f)</enum><header display-inline="yes-display-inline">Support services</header><text display-inline="yes-display-inline">The Director of the National Park Service
			 shall provide to the Commission, on a reimbursable basis, such administrative
			 support services as the Commission may request.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2003b80b0f4941e9884bc2c8bb3b8359"><enum>(g)</enum><header display-inline="yes-display-inline">Procurement of temporary and intermittent
			 services</header><text display-inline="yes-display-inline">The Chairperson of
			 the Commission may employ experts and consultants on a temporary or
			 intermittent basis in accordance with section 3109(b) of title 5, United States
			 Code, at rates for individuals that do not exceed the daily equivalent of the
			 annual rate of basic pay prescribed for level V of the Executive Schedule under
			 section 5316 of that title. Such personnel shall be considered Federal
			 employees under section 2105 of title 5, United States Code, notwithstanding
			 the requirements of such section.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDee214840810e4271a0c93ee503125d27" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDab035ac82bfe4ab1b83a1667e6c2b6e6"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">There are authorized to be appropriated to
			 carry out this Act such sums as are necessary for each of fiscal years 2008
			 through 2015.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDd97eda4735944509a92d6e0f9919e5d9"><enum>(b)</enum><header display-inline="yes-display-inline">Availability of funds</header><text display-inline="yes-display-inline">Amounts appropriated under this section for
			 any fiscal year shall remain available until December 31, 2015.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDc8f17e7b303f4ec99afea097bf8ac4a3" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Termination of commission</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID574ce30a72a240df9ff065d7be9eeed0"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Commission shall terminate on December
			 31, 2015.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1745e8a522ea4e65877268484b40b624"><enum>(b)</enum><header display-inline="yes-display-inline">Transfer of materials</header><text display-inline="yes-display-inline">Not later than the date of termination, the
			 Commission shall transfer any documents, materials, books, manuscripts,
			 miscellaneous printed matter, memorabilia, relics, exhibits, and any materials
			 donated to the Commission that relate to the War of 1812, to Fort McHenry
			 National Monument and Historic Shrine.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID7389e0a48f6a442ca01737ce792841d6"><enum>(c)</enum><header display-inline="yes-display-inline">Disposition of funds</header><text display-inline="yes-display-inline">Any funds held by the Commission on the
			 date of termination shall be deposited in the general fund of the
			 Treasury.</text>
