		  Security Act to provide States with the option to expand or add coverage of
		  pregnant women under the Medicaid and State children’s health insurance

			 <quote><short-title>Prevent Prematurity and Improve Child
			 Health Act of 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID7AEFC9E3E0CD4207A936CB2C8F9284AF" section-type="subsequent-section"><enum>2.</enum><header>State option to expand
			 or add coverage of certain pregnant women under medicaid and SCHIP</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDB5F97773DAD144B5BC2C2FB9CA9EB095"><enum>(a)</enum><header>Medicaid</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDC6912424D10140FA91EC9D62C313193B"><enum>(1)</enum><header>Authority to
			 expand coverage</header><text display-inline="yes-display-inline">Section
			 1902(l)(2)(A)(i) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1396a(l)(2)(A)(i)) is amended by inserting <quote>(or
			 such higher percentage as the State may elect for purposes of expenditures for
			 medical assistance for pregnant women described in section
			 1905(u)(4)(A))</quote> after <quote>185 percent</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBB4F1D5A77EF4F438971C49E8EBEA2DE"><enum>(2)</enum><header>Enhanced
			 matching funds available if certain conditions met</header><text display-inline="yes-display-inline">Section
			 1905 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1396d) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDCB941D8A32514B948846F7F7CD9F30B4"><enum>(A)</enum><text display-inline="yes-display-inline">in the fourth sentence of subsection (b),
			 by striking <quote>or subsection (u)(3)</quote> and inserting <quote>, (u)(3),
			 or (u)(4)</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID80E524D6DAE5487BB0F250A6601DA3CD"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (u)—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID3ACD104D14094A00869254B5BE150800"><enum>(i)</enum><text display-inline="yes-display-inline">by redesignating paragraph (4) as paragraph
			 (5); and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID64C32338A0DF4179B1D3A4F449A4A195"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting after paragraph (3) the
			 following new paragraph:</text>
							<quoted-block display-inline="no-display-inline" id="ID3196792F142D47C0BA6B3198AFA8A119" style="OLC">
								<paragraph commented="no" display-inline="no-display-inline" id="ID64999B69B85D41488F5871170982F9DA" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">For purposes of the fourth sentence of
				subsection (b) and section 2105(a), the expenditures described in this
				paragraph are the following:</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID040D840902AA43A19E31CC931D6044E5"><enum>(A)</enum><header>Certain pregnant women</header><text display-inline="yes-display-inline">If the conditions described in subparagraph
				(B) are met, expenditures for medical assistance for pregnant women described
				in subsection (n) or in section 1902(l)(1)(A) in a family the income of which
				exceeds 185 percent of the poverty line, but does not exceed the income
				eligibility level established under title XXI for a targeted low-income
				child.</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID36DE91E4FFCA4CC996FA782E68A46387"><enum>(B)</enum><header>Conditions</header><text display-inline="yes-display-inline">The conditions described in this
				subparagraph are the following:</text>
										<clause commented="no" display-inline="no-display-inline" id="ID90DE8AEE6CA74D4000AF49E26410F901"><enum>(i)</enum><text display-inline="yes-display-inline">The State plans under this title and title
				XXI do not provide coverage for pregnant women described in subparagraph (A)
				with higher family income without covering such pregnant women with a lower
				family income.</text>
										</clause><clause commented="no" display-inline="no-display-inline" id="ID31D099FDDDF947CD8F2197F29FB1FD41"><enum>(ii)</enum><text display-inline="yes-display-inline">The State does not apply an effective
				income level for pregnant women that is lower than the effective income level
				(expressed as a percent of the poverty line and considering applicable income
				disregards) specified under the State plan under subsection (a)(10)(A)(i)(III)
				or (l)(2)(A) of section 1902, on January 1, 2008, to be eligible for medical
				assistance as a pregnant woman.</text>
										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID662820B1713E48BE8CACA3B756226C32"><enum>(C)</enum><header>Definition of poverty
				line</header><text display-inline="yes-display-inline">In this subsection, the
				term <term>poverty line</term> has the meaning given such term in section
				2110(c)(5).</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD58943F956DC42CAADA670B1A1B4F04C"><enum>(3)</enum><header>Payment from
			 title XXI allotment for medicaid expansion costs; elimination of counting
			 medicaid child presumptive eligibility costs against title XXI
			 allotment</header><text display-inline="yes-display-inline">Section 2105(a)(1)
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397ee(a)(1)) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID61A3930128D54137A4CC70BCD706F85C"><enum>(A)</enum><text display-inline="yes-display-inline">in the matter preceding subparagraph (A),
			 by striking <quote>(or, in the case of expenditures described in subparagraph
			 (B), the Federal medical assistance percentage (as defined in the first
			 sentence of section 1905(b)))</quote>; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5F6150E492B641C383B436322C1688E9"><enum>(B)</enum><text display-inline="yes-display-inline">by striking subparagraph (B) and inserting
			 the following new subparagraph:</text>
						<quoted-block display-inline="no-display-inline" id="ID01268C93CD7F482B86C07C05414CB64D" style="OLC">
							<subparagraph commented="no" display-inline="no-display-inline" id="IDE96D9E3F12E84A1CBE79F3B89DB86FC4"><enum>(B)</enum><text display-inline="yes-display-inline">for the provision of medical assistance
				that is attributable to expenditures described in section
				1905(u)(4)(A);</text>
							</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID43BD412A80C24C46A2726431BE14F470"><enum>(b)</enum><header>SCHIP</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID732CBE73A47E4651A97BC647D900A84C"><enum>(1)</enum><header>Coverage</header><text display-inline="yes-display-inline">Title XXI of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1397aa
			 et seq.) is amended by adding at the end the following new section:</text>
					<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="ID5FD3632BD2A74E9DA0F8C6CBBCFC1D00" style="OLC">
						<section commented="no" display-inline="no-display-inline" id="IDD7AF655DC13C4C9F9048A8CE43E6F120" section-type="subsequent-section"><enum>2111.</enum><header>Optional coverage
				of targeted low-income pregnant women</header>
							<subsection commented="no" display-inline="no-display-inline" id="ID82ECD28FE79A4984A2F08F78A085E8CF"><enum>(a)</enum><header>Optional
				coverage</header><text display-inline="yes-display-inline">Notwithstanding any
				other provision of this title, a State may provide for coverage, through an
				amendment to its State child health plan under section 2102, of
				pregnancy-related assistance for targeted low-income pregnant women in
				accordance with this section, but only if—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID3FA989589425420B91FDA32900F3AE1D"><enum>(1)</enum><text display-inline="yes-display-inline">the State has established an income
				eligibility level for pregnant women under subsection (a)(10)(A)(i)(III) or
				(l)(2)(A) of section 1902 that is at least 185 percent of the income official
				poverty line; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4CF9BDFF56F54C36AB94F9AE09AE99D9"><enum>(2)</enum><text display-inline="yes-display-inline">the State meets the conditions described in
				section 1905(u)(4)(B).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDB8D94856B2FD4C4F91A2E7E17F8B83C4"><enum>(b)</enum><header>Definitions</header><text display-inline="yes-display-inline">For purposes of this title:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID36EC781FC4754B7999D9D82F1BCE3205"><enum>(1)</enum><header>Pregnancy-related
				assistance</header><text display-inline="yes-display-inline">The term
				<term>pregnancy-related assistance</term> has the meaning given the term
				<term>child health assistance</term> in section 2110(a) as if any reference to
				targeted low-income children were a reference to targeted low-income pregnant
				women.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID0520FB790D5A4321A48B3C401600D1F5"><enum>(2)</enum><header>Targeted
				low-income pregnant woman</header><text display-inline="yes-display-inline">The
				term <term>targeted low-income pregnant woman</term> means a woman—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID381C34808AA74E20951094E04E67C57F"><enum>(A)</enum><text display-inline="yes-display-inline">during pregnancy and through the end of the
				month in which the 60-day period (beginning on the last day of her pregnancy)
				ends;</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D614DFA375B4F5EBB616F6C6E1E94E7"><enum>(B)</enum><text display-inline="yes-display-inline">whose family income exceeds the effective
				income level (expressed as a percent of the poverty line and considering
				applicable income disregards) specified under subsection (a)(10)(A)(i)(III) or
				(l)(2)(A) of section 1902, on January 1, 2008, to be eligible for medical
				assistance as a pregnant woman under title XIX but does not exceed the income
				eligibility level established under the State child health plan under this
				title for a targeted low-income child; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA5EEEC26DD184F188751E0A300070075"><enum>(C)</enum><text display-inline="yes-display-inline">who satisfies the requirements of
				paragraphs (1)(A), (1)(C), (2), and (3) of section 2110(b) in the same manner
				as a child applying for child health assistance would have to satisfy such
				requirements.</text>
									</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDA008ECDA547B4260B91C71EFA1E0FDF0"><enum>(c)</enum><header>References to
				terms and special rules</header><text display-inline="yes-display-inline">In
				the case of, and with respect to, a State providing for coverage of
				pregnancy-related assistance to targeted low-income pregnant women under
				subsection (a), the following special rules apply:</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID321E59612CAB4467ADBB06A52E8C5598"><enum>(1)</enum><text display-inline="yes-display-inline">Any reference in this title (other than in
				subsection (b)) to a targeted low-income child is deemed to include a reference
				to a targeted low-income pregnant woman.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDCB5720A612684A0C99CF693CB2C1B6EF"><enum>(2)</enum><text display-inline="yes-display-inline">Any such reference to child health
				assistance with respect to such women is deemed a reference to
				pregnancy-related assistance.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID27BB6336EAD540EBA0C953E9742DCF15"><enum>(3)</enum><text display-inline="yes-display-inline">Any such reference to a child is deemed a
				reference to a woman during pregnancy and the period described in subsection
				(b)(2)(A).</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID75C95DEC2C0B4199B8A76E9CA2396692"><enum>(4)</enum><text display-inline="yes-display-inline">In applying section 2102(b)(3)(B), any
				reference to children found through screening to be eligible for medical
				assistance under the State Medicaid plan under title XIX is deemed a reference
				to pregnant women.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8559949E7E6543E897E0A3B913C1BCC1"><enum>(5)</enum><text display-inline="yes-display-inline">There shall be no exclusion of benefits for
				services described in subsection (b)(1) based on any preexisting condition and
				no waiting period (including any waiting period imposed to carry out section
				2102(b)(3)(C)) shall apply.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF34EFAA3FAAE4509ACC56E51D9C96803"><enum>(6)</enum><text display-inline="yes-display-inline">In applying section 2103(e)(3)(B) in the
				case of a pregnant woman provided coverage under this section, the limitation
				on total annual aggregate cost sharing shall be applied to such pregnant
				woman.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID504E12078EF74B8698FC3BFCCFD44ECE"><enum>(7)</enum><text display-inline="yes-display-inline">The reference in section 2107(e)(1)(D) to
				section 1920A (relating to presumptive eligibility for children) is deemed a
				reference to section 1920 (relating to presumptive eligibility for pregnant
				women).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9F11AD5F77784CDAB615134F8E075742"><enum>(d)</enum><header>Automatic
				enrollment for children born to women receiving Pregnancy-Related
				assistance</header><text display-inline="yes-display-inline">If a child is born
				to a targeted low-income pregnant woman who was receiving pregnancy-related
				assistance under this section on the date of the child’s birth, the child shall
				be deemed to have applied for child health assistance under the State child
				health plan and to have been found eligible for such assistance under such plan
				or to have applied for medical assistance under title XIX and to have been
				found eligible for such assistance under such title, as appropriate, on the
				date of such birth and to remain eligible for such assistance until the child
				attains 1 year of age. During the period in which a child is deemed under the
				preceding sentence to be eligible for child health or medical assistance, the
				child health or medical assistance eligibility identification number of the
				mother shall also serve as the identification number of the child, and all
				claims shall be submitted and paid under such number (unless the State issues a
				separate identification number for the child before such period
				expires).</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID293F7A82B847437C9E1300387E4F009C"><enum>(2)</enum><header>Additional
			 allotments for providing coverage of pregnant women</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID56FBD45D41D848B9A7633531B921D165"><enum>(A)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 2104 of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1397dd)
			 is amended by adding at the end the following new subsection:</text>
						<quoted-block act-name="Social Security Act" display-inline="no-display-inline" id="ID55036300CDFF4DCCA0E54BA77067BE8E" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="IDE83E27B6591A4C4485E9CED004191395"><enum>(h)</enum><header>Additional
				allotments for providing coverage of pregnant women</header>
								<paragraph commented="no" display-inline="no-display-inline" id="ID7A5FA94FCEE94A768B1E54F31B5BB771"><enum>(1)</enum><header>Appropriation;
				total allotment</header><text display-inline="yes-display-inline">For the
				purpose of providing additional allotments to States under this title, there is
				appropriated, out of any money in the Treasury not otherwise appropriated, for
				each of fiscal years 2008 through 2012, $200,000,000.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF820D339AA7A42D6B1001C4B3109561F"><enum>(2)</enum><header>State and
				territorial allotments</header><text display-inline="yes-display-inline">In
				addition to the allotments provided under subsections (b) and (c), subject to
				paragraphs (3) and (4), of the amount available for the additional allotments
				under paragraph (1) for a fiscal year, the Secretary shall allot to each State
				with a State child health plan approved under this title—</text>
									<subparagraph commented="no" display-inline="no-display-inline" id="ID05EDA3D7AC174025005BCCB2C165B4B3"><enum>(A)</enum><text display-inline="yes-display-inline">in the case of such a State other than a
				commonwealth or territory described in subparagraph (B), the same proportion as
				the proportion of the State’s allotment under subsection (b) (determined
				without regard to subsection (f)) to the total amount of the allotments under
				subsection (b) for such States eligible for an allotment under this paragraph
				for such fiscal year; and</text>
									</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDA75859981A5D497699534DE270903291"><enum>(B)</enum><text display-inline="yes-display-inline">in the case of a commonwealth or territory
				described in subsection (c)(3), the same proportion as the proportion of the
				commonwealth’s or territory’s allotment under subsection (c) (determined
				without regard to subsection (f)) to the total amount of the allotments under
				subsection (c) for commonwealths and territories eligible for an allotment
				under this paragraph for such fiscal year.</text>
									</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID99813BE7D8324640ACEFA1DD2D207D07"><enum>(3)</enum><header>Use of
				additional allotment</header><text display-inline="yes-display-inline">Additional allotments provided under this
				subsection are not available for amounts expended before October 1, 2007. Such
				amounts are available for amounts expended on or after such date for child
				health assistance for targeted low-income children, as well as for
				pregnancy-related assistance for targeted low-income pregnant women.</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDA2F4FA653A504D65BA5121762B56C7C4"><enum>(4)</enum><header>No payments
				unless election to expand coverage of pregnant women</header><text display-inline="yes-display-inline">No payments may be made to a State under
				this title from an allotment provided under this subsection unless the State
				provides pregnancy-related assistance for targeted low-income pregnant women
				under this title, or provides medical assistance for pregnant women under title
				XIX, whose family income exceeds the effective income level applicable under
				subsection (a)(10)(A)(i)(III) or (l)(2)(A) of section 1902 to a family of the
				size involved on January 1,
				2008.</text>
								</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5F4BB5E8CDE645E9BA47811010C777E3"><enum>(B)</enum><header>Conforming
			 amendments</header><text display-inline="yes-display-inline">Section 2104 of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397dd) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID96174AEABFE844029697B7F8238B8407"><enum>(i)</enum><text display-inline="yes-display-inline">in subsection (a), in the matter preceding
			 paragraph (1), by striking <quote>subsection (d)</quote> and inserting
			 <quote>subsections (d) and (h)</quote>;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="IDF18E2BD7F9ED4CA2ABA010F061E42423"><enum>(ii)</enum><text display-inline="yes-display-inline">in subsection (b)(1), by striking

			 conforming amendments</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID2F3C732C48414F14A23E309F53003F4E"><enum>(A)</enum><header>No cost sharing
			 for pregnancy-related benefits</header><text display-inline="yes-display-inline">Section 2103(e)(2) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397cc(e)(2)) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID5479183C43C24FAB914C30C967D5002B"><enum>(i)</enum><text display-inline="yes-display-inline">in the heading, by inserting
			 <quote><header-in-text level="paragraph" style="OLC">or pregnancy-related
			 services</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">preventive services</header-in-text></quote>;
			 and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID0C5CEFA94A114D98A7D31C61F5AA1123"><enum>(ii)</enum><text display-inline="yes-display-inline">by inserting before the period at the end
			 the following: <quote>or for pregnancy-related services</quote>.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID900C71B656A04D8899D0225F4C4912A2"><enum>(B)</enum><header>No waiting
			 period</header><text display-inline="yes-display-inline">Section 2102(b)(1)(B)
			 of the Social Security Act (42 U.S.C. 1397bb(b)(1)(B)) is amended—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID0DD3E76152B34B3EAEF12F6EC1CCC2A4"><enum>(i)</enum><text display-inline="yes-display-inline">in clause (i), by striking <quote>,
			 and</quote> at the end and inserting a semicolon;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID65C729EBC38A49358D00DF0013145027"><enum>(ii)</enum><text display-inline="yes-display-inline">in clause (ii), by striking the period at
			 the end and inserting <quote>; and</quote>; and</text>

				State that, as of the date of enactment of the
				<short-title>Prevent Prematurity and Improve Child Health
				Act of 2007</short-title>, has an income eligibility standard under title XIX
				or this title (under section 1902(a)(10)(A) or under a statewide waiver in
				effect under section 1115 with respect to title XIX or this title) that is at
				least 185 percent of the poverty line with respect to pregnant women, the State
				may elect to use not more than 20 percent of any allotment under section 2104
				for any fiscal year (insofar as it is available under any subsection of such
				section) for payments under title XIX in accordance with subparagraph (B),
				instead of for expenditures under this title.</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3327D596F1A44A56878EBB8DE13B40F4"><enum>(B)</enum><header>Payments to
				states</header>
								<clause commented="no" display-inline="no-display-inline" id="ID1F06DE9C6275462AB5F0EC2E08D94C34"><enum>(i)</enum><header>In
				general</header><text display-inline="yes-display-inline">In the case of a
				State described in subparagraph (A) that has elected the option described in
				that subparagraph, subject to the availability of funds under such subparagraph
				and, if applicable, paragraph (1)(A), with respect to the State, the Secretary
				shall pay the State an amount each quarter equal to the additional amount that
				would have been paid to the State under title XIX with respect to expenditures
				described in clause (ii) if the enhanced FMAP (as determined under subsection
				(b)) had been substituted for the Federal medical assistance percentage (as
				defined in section 1905(b)).</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID07E4EE29F2EB4B87B0F105BBC448D427"><enum>(ii)</enum><header>Expenditures
				described</header><text display-inline="yes-display-inline">For purposes of
				this subparagraph, the expenditures described in this clause are expenditures,
				made after the date of the enactment of this paragraph and during the period in
				which funds are available to the State for use under subparagraph (A), for
				medical assistance under title XIX for pregnant women whose family income is at
				least 185 percent of the poverty line.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID0044DA1BF1A341AAB0B61097899781F9"><enum>(iii)</enum><header>No impact on
				determination of budget neutrality for waivers</header><text display-inline="yes-display-inline">In the case of a State described in
				subparagraph (A) that uses amounts paid under this paragraph for expenditures
				described in clause (ii) that are incurred under a waiver approved for the
				State, any budget neutrality determinations with respect to such waiver shall
				be determined without regard to such amounts
				paid.</text>
								</clause></subparagraph></paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDF12F89051ADF4E3B9EB4CC5B9439C3B4"><enum>(3)</enum><text display-inline="yes-display-inline">in paragraph (3), by striking <quote>and

			 a newborn</header><text display-inline="yes-display-inline">Section 1902(e)(4)
			 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396a(e)(4)) is amended in the first sentence by striking <quote>so long as the
			 child is a member of the woman’s household and the woman remains (or would
			 remain if pregnant) eligible for such assistance</quote>.</text>

			 qualified entities to presumptive eligibility for pregnant women under

			 legal immigrants under the medicaid program and SCHIP</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDE7C317FA93B044E9A9E3BB50A1157D95"><enum>(a)</enum><header>Medicaid
			 program</header><text display-inline="yes-display-inline">Section 1903(v) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.

				under this title) to provide medical assistance under this title for aliens who
				are lawfully residing in the United States (including battered aliens described
				in section 431(c) of the Personal Responsibility and Work Opportunity
				Reconciliation Act of 1996) and who are otherwise eligible for such assistance,
				within any of the following eligibility categories:</text>
								<clause commented="no" display-inline="no-display-inline" id="IDDF952338159242D8ABE4912DB78BC072" indent="up1"><enum>(i)</enum><header>Pregnant women</header><text display-inline="yes-display-inline">Women during pregnancy (and during the
				60-day period beginning on the last day of the pregnancy).</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="ID2F6337D6CCAC4DCF818FAE4BD0FB4B9F" indent="up1"><enum>(ii)</enum><header>Children</header><text display-inline="yes-display-inline">Children (as defined under such plan),
				including optional targeted low-income children described in section
				1905(u)(2)(B).</text>
								</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID54F2A02BDF114AB2B0712F4339BCFD08" indent="up1"><enum>(B)</enum><clause commented="no" display-inline="yes-display-inline" id="ID9652937A01A940898ED26559E25E9BFE"><enum>(i)</enum><text display-inline="yes-display-inline">In the case of a State that has elected to
				provide medical assistance to a category of aliens under subparagraph (A), no
				debt shall accrue under an affidavit of support against any sponsor of such an
				alien on the basis of provision of assistance to such category and the cost of
				such assistance shall not be considered as an unreimbursed cost.</text>
								</clause><clause commented="no" display-inline="no-display-inline" id="IDB7F54A9537924CD0B8F8141E40279D7F" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">The provisions of sections 401(a), 402(b),
				403, and 421 of the Personal Responsibility and Work Opportunity Reconciliation
				Act of 1996 shall not apply to a State that makes an election under
				subparagraph
				(A).</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID75BDA8FA28534F6892B8E57ED38CD31F"><enum>(b)</enum><header>Title
			 <enum-in-header>XXI</enum-in-header></header><text display-inline="yes-display-inline">Section 2107(e)(1) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397gg(e)(1)) is amended by adding at the end the following new
			 subparagraph:</text>

			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDB0DA666973E446899E66A9C427F8E29D"><enum>(c)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section take effect on October 1, 2007, and apply to medical assistance
			 and child health assistance furnished on or after such date.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID174D8E9E879D4AC99B29A1721400CCED" section-type="subsequent-section"><enum>4.</enum><header>Promoting cessation of
			 tobacco use under the medicaid program</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDD546AF1F1346444AB07BF45331CBF49E"><enum>(a)</enum><header>Dropping
			 exception from medicaid prescription drug coverage for tobacco cessation
			 medications</header><text display-inline="yes-display-inline">Section
			 1927(d)(2) of the <act-name parsable-cite="SSA">Social Security Act</act-name>
			 (42 U.S.C. 1396r–8(d)(2)) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDBD7B2B7415884E32A0FC415215D9C2F4"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subparagraph (E);</text>

					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2F9580000A3C4038A08CC3E6797BB562"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="ID2CBF1B64CAB746789316965DDBA91CE3" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="ID89797631DC474696A7533CCFB2440045"><enum>(y)</enum><paragraph commented="no" display-inline="yes-display-inline" id="ID859C9B904B5D41E688F79941C2893FB9"><enum>(1)</enum><text display-inline="yes-display-inline">For purposes of this title, the term
				<term>counseling for cessation of tobacco use</term> means therapy and
				counseling for cessation of tobacco use for pregnant women who use tobacco
				products or who are being treated for tobacco use that is furnished—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDCFAAAFD8CC0F428FBA98BD00D1EB1100" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">by
				or under the supervision of a physician; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID13645DD041434DF1A52BB4AB33A857DE" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">by
				any other health care professional who—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDE43F6D33A2174D83869548D36DEC00CE"><enum>(i)</enum><text display-inline="yes-display-inline">is legally authorized to furnish such
				services under State law (or the State regulatory mechanism provided by State
				law) of the State in which the services are furnished; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID95308069C64C465DA29B00BAE6119233"><enum>(ii)</enum><text display-inline="yes-display-inline">is authorized to receive payment for other
				services under this title or is designated by the Secretary for this
				purpose.</text>
									</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBF80E2C950A84D388C85840550ACE836" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">Subject to paragraph (3), such term is
				limited to—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID90800A45A8A54226BB3BB698F81E35F5"><enum>(A)</enum><text display-inline="yes-display-inline">therapy and counseling services recommended
				in <quote>Treating Tobacco Use and Dependence: A Clinical Practice
				Guideline</quote>, published by the Public Health Service in June 2000, or any
				subsequent modification of such Guideline; and</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDB576B42AA28C483E810091507BD703C6"><enum>(B)</enum><text display-inline="yes-display-inline">such other therapy and counseling services
				that the Secretary recognizes to be effective.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID34BD4101181A4536B912648F1B816ED7" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Such term shall not include coverage for
				drugs or biologicals that are not otherwise covered under this
				title.</text>
							</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID27DD0E62433A4EA4AE6DB63806A0B541"><enum>(c)</enum><header>Removal of cost
			 sharing for tobacco cessation counseling services for pregnant women</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2D471CF12968477DBDB7FB22358D6ECB"><enum>(1)</enum><header>General cost
			 sharing limitations</header><text display-inline="yes-display-inline">Section
			 1916 of the <act-name parsable-cite="SSA">Social Security Act</act-name> (42
			 U.S.C. 1396o) is amended in each of subsections (a)(2)(B) and (b)(2)(B) by
			 inserting <quote>, and counseling for cessation of tobacco use (as defined in
			 section 1905(y))</quote> after <quote>complicate the pregnancy</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id26EBFF2E1A054800AE7988A465FB6D49"><enum>(2)</enum><header>Application to
			 alternative cost sharing</header><text>Section 1916A(b)(3)(B)(iii) of such Act
			 (42 U.S.C. 1396o–1(b)(3)(B)(iii)) is amended by inserting <quote>, and
			 counseling for cessation of tobacco use by pregnant women (as defined in
			 section 1905(y)) </quote> after <quote>complicate the pregnancy</quote>.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDAC517A68F3E54D0890EAEA6102B33277"><enum>(d)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this section shall apply to services furnished on or after the date that is 1
			 year after the date of enactment of this Act.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID476E51B72F764533A068CE4D858E3D30" section-type="subsequent-section"><enum>5.</enum><header>State option to
			 provide family planning services and supplies to individuals with incomes that
			 do not exceed a State’s income eligibility level for medical
			 assistance</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID64757E0385A4406700F35EFD75C200FB"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Title XIX of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C. 1396 et
			 seq.) is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID1738AE65FEE64942BDDC48B193D76110"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating section 1939 as section
			 1940; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8474CABC5BA94E3DBD09D16F8200E9EC"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after section 1938 the
			 following new section:</text>
					<quoted-block act-name="" display-inline="no-display-inline" id="ID401D88C4A29C416EA6A13CDCCD8D1600" style="traditional">
						<section commented="no" display-inline="no-display-inline" id="ID731A2FF9B55842B1A0001014C03E1F7E" section-type="subsequent-section"><enum>1939.</enum><header>State option to provide family planning services and
		  supplies</header><subsection commented="no" display-inline="yes-display-inline" id="IDA82C8310AAE044F0873CDFBDC0365DB4"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">Subject to
				subsections (b) and (c), a State may elect (through a State plan amendment) to
				make medical assistance described in section 1905(a)(4)(C) available to any
				individual whose family income does not exceed the greater of—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID39404EC0851049CBBC6FFCC6DD8BD200"><enum>(1)</enum><text display-inline="yes-display-inline">185 percent of the income official poverty
				line (as defined by the Office of Management and Budget, and revised annually
				in accordance with section 673(2) of the Omnibus Budget Reconciliation Act of
				1981) applicable to a family of the size involved; or</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4D97BD80ED724936BB3516C4F1B7D678"><enum>(2)</enum><text display-inline="yes-display-inline">the eligibility income level (expressed as
				a percentage of such poverty line) that has been specified under a waiver
				authorized by the Secretary or under section 1902(r)(2)), on October 1, 2007,
				for an individual to be eligible for medical assistance under the State
				plan.</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0C87AB815F2643FEBECB58E590F90094"><enum>(b)</enum><header>Comparability</header><text display-inline="yes-display-inline">Medical assistance described in section
				1905(a)(4)(C) that is made available under a State plan amendment under
				subsection (a) shall—</text>
								<paragraph commented="no" display-inline="no-display-inline" id="ID90C7EF5563B3483981997ED67DB5D717"><enum>(1)</enum><text display-inline="yes-display-inline">not be less in amount, duration, or scope
				than the medical assistance described in that section that is made available to
				any other individual under the State plan; and</text>
								</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID534A57CE62314550AB9C7697DD5E38EC"><enum>(2)</enum><text display-inline="yes-display-inline">be provided in accordance with the
				restrictions on deductions, cost sharing, or similar charges imposed under
				section 1916(a)(2)(D).</text>
								</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDC1F13A56BC35423A00859815CFC212DB"><enum>(c)</enum><header>Option To
				extend coverage during a Post-Eligibility period</header>

				made under subsection (a) may provide that any individual who was receiving
				medical assistance described in section 1905(a)(4)(C) as a result of such
				amendment, and who becomes ineligible for such assistance because of hours of,
				or income from, employment, may remain eligible for such medical assistance
				through the end of the 6-month period that begins on the first day the
				individual becomes so ineligible.</text>

			 the postpartum period for provision of family planning services and
			 supplies</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID6F29FE4499064B6C87128DE087C26E99"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 1902(e)(5) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1396a(e)(5)) is amended—</text>

			 provide supplemental SCHIP coverage to children who have other health

			 general</header>

					<subparagraph commented="no" display-inline="no-display-inline" id="IDA227DC672F9341FBA3724F6C4FD55C22"><enum>(A)</enum><header>State option to

				requirement of paragraph (1)(C) that a targeted low-income child may not be
				covered under a group health plan or under health insurance coverage if the
				State satisfies the conditions described in subsection (c)(9). The State may
				waive such requirement in order to provide—</text>

										</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id698DDF07D44441D295ABA334A65F2B8D"><enum>(B)</enum><header>Authority to
				limit income eligibility</header><text display-inline="yes-display-inline">In
				waiving such requirement, a State may limit the application of the waiver to
				children whose family income does not exceed a level specified by the State, so
				long as the level so specified does not exceed the maximum income level
				otherwise established for other children under the State child health
				plan.</text>
									</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDC04793FAD29F46DE9E5CF75154707BDC"><enum>(B)</enum><header>Conditions
			 described</header><text display-inline="yes-display-inline">Section 2105(c) of
			 the <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397ee(c)) is amended by adding at the end the following:</text>

				provision of supplemental coverage</header><text display-inline="yes-display-inline">For purposes of section 2110(b)(5), the
				conditions described in this paragraph are the following:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="IDD6D76296AF284C918E72005201E64863"><enum>(A)</enum><header>Income
				eligibility</header><text display-inline="yes-display-inline">The State child
				health plan (whether implemented under title XIX or this title)—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID119A0198B3B547BDB3E89189FED5A901"><enum>(i)</enum><text display-inline="yes-display-inline">has the highest income eligibility standard
				permitted under this title on January 1, 2008;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="IDF65DB3F421C649E8AD272527622D1390"><enum>(ii)</enum><text display-inline="yes-display-inline">subject to subparagraph (B), does not limit
				the acceptance of applications for children; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID58B603C874D64FE7A7603000AFA3EB02"><enum>(iii)</enum><text display-inline="yes-display-inline">provides benefits to all children in the
				State who apply for and meet eligibility standards.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD2FF584598C24E87A47B303FF6D0AD42"><enum>(B)</enum><header>No waiting list
				imposed</header><text display-inline="yes-display-inline">With respect to
				children whose family income is at or below 200 percent of the poverty line,
				the State does not impose any numerical limitation, waiting list, or similar
				limitation on the eligibility of such children for child health assistance
				under such State plan.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID258B8F552353412C914F00329328F3E4"><enum>(C)</enum><header>No more
				favorable treatment</header><text display-inline="yes-display-inline">The State
				child health plan may not provide more favorable coverage of dental services to
				the children covered under section 2110(b)(5) than to children otherwise
				covered under this
				title.</text>
								</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3FD26CC5DFEA47B6B779D1527C684FBA"><enum>(C)</enum><header>State option to
			 waive waiting period</header><text display-inline="yes-display-inline">Section
			 2102(b)(1)(B) of the <act-name parsable-cite="SSA">Social Security
			 Act</act-name> (42 U.S.C. 1397bb(b)(1)(B)), as amended by section 2(b)(3)(B),
			 is amended—</text>

			 following:</text>

				expenditures described in this paragraph are expenditures for items and
				services for children described in section 2110(b)(5), but only in the case of
				a State that satisfies the requirements of section

								</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6195B1BDE8DC41B8AE366748CFA6A730"><enum>(3)</enum><header>Application of
			 secondary payor provisions</header><text display-inline="yes-display-inline">Section 2107(e)(1) of the
			 <act-name parsable-cite="SSA">Social Security Act</act-name> (42 U.S.C.
			 1397gg(e)(1)), as amended by section 3(b), is amended by adding at the end the
			 following:</text>

				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID3812338049D24EB5AF51C1106C617049"><enum>(b)</enum><header>Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 subsection (a) shall take effect on January 1, 2008, and shall apply to child
			 health assistance and medical assistance provided on or after that date.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idD4A4EB175B50497991BC2865DBE35F39"><enum>8.</enum><header>Demonstration
			 project for coverage of telemedicine services under medicaid</header>
			<subsection commented="no" display-inline="no-display-inline" id="id47CE36DA2EA24CD4A7C76E6D73792CD9"><enum>(a)</enum><header>Definitions</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idA004A35351D84540957FDC5AF15288FF"><enum>(1)</enum><header>Applicable
			 individual</header><text>The term <quote>applicable individual</quote> means an
			 individual who—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id71DDFA06B3E84A1A8904F3E609DAB8AD"><enum>(A)</enum><text>is eligible for
			 benefits under a State plan under title XIX of the Social Security Act (42
			 U.S.C. 1396 et seq.);</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF4ED3F92CD8147CF9ED61EC8EE27EC9B"><enum>(B)</enum><text>is a pregnant
			 woman;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id045B5804596A4F02A9B07F52DB5F4EB3"><enum>(C)</enum><text>is at risk of
			 complications in pregnancy or preterm birth; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id9E9FCBA039524C738BD15E602CD66891"><enum>(D)</enum><text>resides in a
			 rural area.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC674409420BC47818B455000C08FA45B"><enum>(2)</enum><header>Medicaid</header><text>The
			 term <quote>Medicaid</quote> means the program established under title XIX of
			 the Social Security Act (42 U.S.C. 1396 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id4669141C5C50483B9079E4E89C110A40"><enum>(3)</enum><header>Rural
			 area</header><text>The term <quote>rural area</quote> means an area not within
			 a Metropolitan Statistical Area (as defined by the Office of Management and
			 Budget).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id15858644443F4472914D140F25E92CFD"><enum>(4)</enum><header>Secretary</header><text>The
			 term <quote>Secretary</quote> means the Secretary of Health and Human
			 Services.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFB5A314833FF41718AFCD1AC14803DF0"><enum>(5)</enum><header>State</header><text>The
			 term <quote>State</quote> has the meaning given such term for purposes of title
			 XIX of the Social Security Act (42 U.S.C. 1396 et seq.).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8FD3B895D3EC482FBD652623F8E00817"><enum>(6)</enum><header>Telemedicine
			 services</header><text>The term <quote>telemedicine services</quote> means the
			 provision of health care consultations and diagnoses by an off-site specialist
			 using equipment that allows the specialist to be connected to a local provider
			 and a patient in real time during a patient visit.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id9082277F1A7744B2B3584A4AB13072BD"><enum>(b)</enum><header>Establishment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idFE903C53AE1D4E8887E2EEDC344DA08A"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall establish a demonstration program (in
			 this section referred to as the <quote>program</quote>) to provide payments to
			 States for the cost of providing telemedicine services for the treatment of
			 applicable individuals.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id71E25223A6DC429EB0248B64CEA3CCB1"><enum>(2)</enum><header>Sites</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="id7E187BE5048342B88921848D7EE96D51"><enum>(A)</enum><header>In
			 general</header><text>The demonstration shall be conducted at not less than 3
			 and not more than 5 sites.</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id57648EFEEF4D4B6982EEF9973BCBEE7A"><enum>(B)</enum><header>Composition</header><text>Each
			 site shall be composed of a single rural area.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id06ACC95726994A398423FAE576803AAA"><enum>(3)</enum><header>Duration</header><text>The
			 demonstration shall be conducted for a period of 3 years.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id6A0062105DB947E3B82F9D474F5B7AE3"><enum>(c)</enum><header>Use of
			 funds</header><text>Funds provided to a State under the program shall be used
			 to reimburse local providers and off-site specialists for the cost of providing
			 telemedicine services for the treatment of applicable individuals.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id39DFAF7C5A40488B913CA7FAF8EF05DB"><enum>(d)</enum><header>Evaluations and
			 reports</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id374A42DF82B14E96876AF13F8EE51E04"><enum>(1)</enum><header>Initial
			 evaluation and report</header><text>Not later than 24 months after the date of
			 enactment of this Act, the Secretary shall provide to Congress an interim
			 report on the demonstration containing an evaluation of the impact of the
			 demonstration on health outcomes and cost-effectiveness.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC60A665CF09B46ADBBF089F0E2CDAAA3"><enum>(2)</enum><header>Final
			 report</header><text>Not later than 6 months after the completion of the
			 program under this section, the Secretary shall submit to Congress a report on
			 such program, together with recommendations for such legislation and
			 administrative action as the Secretary determines to be appropriate.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="idEE91076509B746FE85ED9DD208807133"><enum>(e)</enum><header>Prohibition</header><text>Amounts
			 paid to a State under the program shall not be used for purposes of claiming a
			 Federal matching payment under section 1903(a) of the Social Security Act (42
			 U.S.C. 1396b(a)).</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idB9916EBBE8924AFA9A35015A0AD459CB"><enum>(f)</enum><header>Limitation on
			 payment amounts</header><text>In no case may the aggregate amount paid by the
			 Secretary to States under the program exceed $15,000,000.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1CD9DD8936B94FD8AD72202F3FACDFCE"><enum>(g)</enum><header>Waiver</header><text>The
			 Secretary shall waive compliance with such requirements of the Medicaid program
			 to the extent and for the period the Secretary finds necessary to conduct the
			 program.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="idEF4878ABA3C741298327775E96C5618F"><enum>9.</enum><header>Pediatric and
			 perinatal quality measures</header>
			<subsection commented="no" display-inline="no-display-inline" id="id8EF86708DDA748E8B2F9F4E4666CEDE8"><enum>(a)</enum><header>Pediatric and
			 perinatal quality measures</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id50D448CE26B143DBB4C46E1A0D4FB381"><enum>(1)</enum><header>In
			 general</header><text>The Secretary of Health and Human Services (in this
			 section referred to as the <quote>Secretary</quote>) shall develop and
			 disseminate a national set of core pediatric and perinatal quality
			 measures.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idFCDE196B722441308D745F83A6B4EB64"><enum>(2)</enum><header>Consultation
			 and collaboration</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="idD1EFCA8631E649098EF36BC9037396B5"><enum>(A)</enum><header>Collaboration</header><text>In
			 developing and disseminating such quality measures, the Secretary shall
			 collaborate with—</text>
						<clause commented="no" display-inline="no-display-inline" id="id7E6F3BF866DE409B803D7F76CD5190A1"><enum>(i)</enum><text>the Director of
			 the Agency for Healthcare Research and Quality; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="idF288523E665F46EF985616294E1DCA6A"><enum>(ii)</enum><text>other
			 appropriate entities, including—</text>
							<subclause commented="no" display-inline="no-display-inline" id="idF1026D3F6E2E4F7E8648911016337ECD"><enum>(I)</enum><text>a national
			 organization that exists for the purpose of achieving consensus among health
			 care providers, payers, and consumers on recommendations of measures of
			 quality; and</text>

			 developing and disseminating such quality measures, the Secretary shall consult
			 with—</text>
						<clause commented="no" display-inline="no-display-inline" id="id5352CF4E7E8546E186496319645EB55E"><enum>(i)</enum><text>health
			 professionals; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id8D9FCEA5D2C64B8CA4FAB89F18CF84D2"><enum>(ii)</enum><text>consumer
			 groups.</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="idC6D8F6074E434C2FA80B5CAD1421B2C5"><enum>(3)</enum><header>Appropriation</header><text>There
			 are appropriated $50,000,000 to the Agency for Healthcare Research and Quality
			 for each of fiscal years 2009, 2010, and 2011, to carry out this
			 subsection.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id557039EFE5F44DE0B2CB5BA457F8F30B"><enum>(b)</enum><header>Collection and
			 reporting of State data</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id509963B5A4F640B88A44F95E1AE6278B"><enum>(1)</enum><header>In
			 general</header><text>The Secretary shall collect data regarding the extent to
			 which States use pediatric and perinatal inpatient and outpatient quality
			 measures on an ongoing basis.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0A784D9F7203448DB84FA3D61D8A6BD4"><enum>(2)</enum><header>Report</header><text>The
			 Secretary shall report to Congress and make publicly available the data
			 collected under paragraph (1) on an annual basis.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id5DD9C92ECE4A460CB07836598C91322F"><enum>(c)</enum><header>Requirement
			 under state plan</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id2C79DF81FB4841FBA1F57A2BB27A5692"><enum>(1)</enum><header>Medicaid</header><text>Section
			 1902(a) of the Social Security Act (42 U.S.C. 1396a) is amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB5CC2CD670614FAEBC4750C70E6BE504"><enum>(A)</enum><text>in paragraph
			 (69), by striking <quote>and</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DAE7A31AC2647329196084FF248E8A2"><enum>(B)</enum><text>in paragraph
			 (70), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
