					<section commented="no" display-inline="no-display-inline" id="H4752B83F4A5447CD819B4100AF99041" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
		  <quote>Traumatic Brain Injury Act of 2008</quote>.</text>
					</section><section id="H90898317525640F4BD477F021581CF67"><enum>2.</enum><header>Conforming amendments
		  relating to restructuring</header><text display-inline="no-display-inline">Part
		  J of title III of the <act-name parsable-cite="PHSA">Public Health Service
		  Act</act-name> (<external-xref legal-doc="usc" parsable-cite="usc/42/280b">42 U.S.C. 280b et seq.</external-xref>) is amended—</text>
						<paragraph id="H2E33AC0D170A49A3AEB74E7FACCE8DCF"><enum>(1)</enum><text>by redesignating the
		  section 393B (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1c">42 U.S.C. 280b–1c</external-xref>) relating to the use of allotments for rape
		  prevention education, as section 393A and moving such section so that it
		  follows section 393;</text>
						</paragraph><paragraph id="H2200FE295EB340EE00878BB819625DA4"><enum>(2)</enum><text>by redesignating existing
		  section 393A (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1b">42 U.S.C. 280b–1b</external-xref>) relating to prevention of traumatic brain
		  injury, as section 393B; and</text>
						</paragraph><paragraph id="HD8660B4580EA4FF2862545E116FF63AE"><enum>(3)</enum><text>by redesignating the
		  section 393B (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1d">42 U.S.C. 280b–1d</external-xref>) relating to traumatic brain injury registries,
		  as section 393C.</text>
						</paragraph></section><section id="H1ABFE0359A5C4571A4EADE65C15850A"><enum>3.</enum><header>Traumatic brain injury
		  programs of the centers for Disease Control and Prevention</header>
						<subsection id="H6B18AB8260804DA393C317BA0072EB00"><enum>(a)</enum><header>Prevention of Traumatic
		  Brain Injury</header><text>Clause (ii) of section 393B(b)(3)(A) of the
		  <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, as so
		  redesignated, (<external-xref legal-doc="usc" parsable-cite="usc/42/280b-1b">42 U.S.C. 280b–1b</external-xref>) is amended by striking <quote>from hospitals
		  and trauma centers</quote> and inserting <quote>from hospitals and emergency
		  departments</quote>.</text>
						</subsection><subsection id="H58CEB2BF8E2D42E3957C5600CB5D33B2"><enum>(b)</enum><header>National Program for
		  Traumatic Brain Injury Surveillance and Registries</header><text>Section 393C
		  of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>, as
		  so redesignated, (<external-xref legal-doc="usc" parsable-cite="usc/42/280b">42 U.S.C. 280b et seq.</external-xref>) is amended—</text>
							<paragraph id="H977E4AD7CBCA4A6B8BCAF9C595610034"><enum>(1)</enum><text>in the section heading,
		  by inserting <quote><header-in-text level="section" style="traditional">surveillance and</header-in-text></quote> after
		  <quote><header-in-text level="section" style="traditional">national program for
		  traumatic brain injury</header-in-text></quote>; and</text>
							</paragraph><paragraph id="HB868F7C4214049BBB9AA8EDAD26EDF41"><enum>(2)</enum><text>in subsection (a), in the
		  matter preceding paragraph (1), by striking <quote>may make grants</quote> and
		  all that follows through <quote>to collect data concerning—</quote> and
		  inserting <quote>may make grants to States or their designees to develop or
		  operate the State’s traumatic brain injury surveillance system or registry to
		  determine the incidence and prevalence of traumatic brain injury and related
		  disability, to ensure the uniformity of reporting under such system or
		  registry, to link individuals with traumatic brain injury to services and
		  supports, and to link such individuals with academic institutions to conduct
		  applied research that will support the development of such surveillance systems
		  and registries as may be necessary. A surveillance system or registry under
		  this section shall provide for the collection of data
		  concerning—</quote>.</text>
							</paragraph></subsection><subsection commented="no" id="H0E8D9F592251407F8245DD958B59B6C7"><enum>(c)</enum><header>Report</header><text>Section
		  393C of the Public Health Service Act (as so redesignated) is amended by adding
		  at the end the following:</text>
							<quoted-block changed="added" display-inline="no-display-inline" id="H26F426E51AFC461BB767A01EAA451F38" reported-display-style="italic" style="OLC">
								<subsection commented="no" id="HA92DF06BEF3D4C85BE503939FE47A298"><enum>(b)</enum><text>Not later than 18 months
			 after the date of enactment of the Traumatic Brain Injury Act of 2008, the
			 Secretary, acting through the Director of the Centers for Disease Control and
			 Prevention and the Director of the National Institutes of Health and in
			 consultation with the Secretary of Defense and the Secretary of Veterans
			 Affairs, shall submit to the relevant committees of Congress a report that
			 contains the findings derived from an evaluation concerning activities and
			 procedures that can be implemented by the Centers for Disease Control and
			 Prevention to improve the collection and dissemination of compatible
			 epidemiological studies on the incidence and prevalence of traumatic brain
			 injury in individuals who were formerly in the military. The report shall
			 include recommendations on the manner in which such agencies can further
			 collaborate on the development and improvement of traumatic brain injury
			 diagnostic tools and
			 treatments.</text>
								</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
						</subsection></section><section id="H9A4753F9DDE94670A0F10033ECEBA21E"><enum>4.</enum><header>Study on traumatic brain
		  injury</header><text display-inline="no-display-inline">Part J of title III of
		  the <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42
		  U.S.C. 280b et seq.) is amended by inserting after section 393C, as so
		  redesignated, the following:</text>

							<section id="HD4556602DCC542FF0024F86D684B1454"><enum>393C–1.</enum><header>Study on traumatic
			 brain injury</header>
								<subsection id="H8A972E51D6684CC7ABAF401EAAAD018D"><enum>(a)</enum><header>Study</header><text>The
			 Secretary, acting through the Director of the Centers for Disease Control and
			 Prevention with respect to paragraph (1) and in consultation with the Director
			 of the National Institutes of Health and other appropriate entities with
			 respect to paragraphs (2), (3), and (4), may conduct a study with respect to
			 traumatic brain injury for the purpose of carrying out the following:</text>
									<paragraph id="HF86E80E3FF994133925C25C04CE60028"><enum>(1)</enum><text>In collaboration with
			 appropriate State and local health-related agencies—</text>
										<subparagraph id="HFAFEF46EDA3A42A4A26C1525A1B9EF7E"><enum>(A)</enum><text>determining the incidence
			 of traumatic brain injury and prevalence of traumatic brain injury related
			 disability and the clinical aspects of the disability in all age groups and
			 racial and ethnic minority groups in the general population of the United
			 States, including institutional settings, such as nursing homes, correctional
			 facilities, psychiatric hospitals, child care facilities, and residential
			 institutes for people with developmental disabilities; and</text>
										</subparagraph><subparagraph id="H50EC6D51A4474196A6C338E6A07CDA48"><enum>(B)</enum><text>reporting national trends
			 in traumatic brain injury.</text>
										</subparagraph></paragraph><paragraph id="H9460AB489B344CD8B6A2F1B5F5266D00"><enum>(2)</enum><text>Identifying common
			 therapeutic interventions which are used for the rehabilitation of individuals
			 with such injuries, and, subject to the availability of information, including
			 an analysis of—</text>
										<subparagraph id="H9DD2315DF4794801B32FB8A2C4ADF08F"><enum>(A)</enum><text>the effectiveness of each
			 such intervention in improving the functioning, including return to work or
			 school and community participation, of individuals with brain injuries;</text>
										</subparagraph><subparagraph id="H6A700C0BA4A148AEAD535EC854D052D9"><enum>(B)</enum><text>the comparative
			 effectiveness of interventions employed in the course of rehabilitation of
			 individuals with brain injuries to achieve the same or similar clinical
			 outcome; and</text>
										</subparagraph><subparagraph id="H4D6E9DD383DE47B2B399E3C7B2DFE64"><enum>(C)</enum><text>the adequacy of existing
			 measures of outcomes and knowledge of factors influencing differential
			 outcomes.</text>
										</subparagraph></paragraph><paragraph id="H46540073B16548A98BA5D7398801C494"><enum>(3)</enum><text>Identifying interventions
			 and therapies that can prevent or remediate the development of secondary
			 neurologic conditions related to traumatic brain injury.</text>
									</paragraph><paragraph id="H712B46DB90ED4231BB96E11639D070B2"><enum>(4)</enum><text>Developing practice
			 guidelines for the rehabilitation of traumatic brain injury at such time as
			 appropriate scientific research becomes available.</text>
									</paragraph></subsection><subsection id="H0693B953E7AA404A9162B43C39D326F7"><enum>(b)</enum><header>Dates Certain for
			 Reports</header><text>If the study is conducted under subsection (a), the
			 Secretary shall, not later than 3 years after the date of the enactment of the
			 Traumatic Brain Injury Act of 2008, submit to Congress a report describing
			 findings made as a result of carrying out such subsection (a).</text>
								</subsection><subsection id="HB225ECDCCA6F40599100B677C14D07A8"><enum>(c)</enum><header>Definition</header><text>For
			 purposes of this section, the term <term>traumatic brain injury</term> means an
			 acquired injury to the brain. Such term does not include brain dysfunction
			 caused by congenital or degenerative disorders, nor birth trauma, but may
			 include brain injuries caused by anoxia due to trauma including near drowning.
			 The Secretary may revise the definition of such term as the Secretary
			 determines
			 necessary.</text>
								</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
					</section><section id="H868C70D72DD74EBA00007BAC912C2EE6"><enum>5.</enum><header>Traumatic brain injury
		  programs of the national institutes of health</header><text display-inline="no-display-inline">Section 1261 of the
		  <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
		  300d–61) is amended—</text>
						<paragraph id="H6C62FA6FC23B40C4993D5FC446CC5C80"><enum>(1)</enum><text display-inline="yes-display-inline">in subsection (b)(2), by striking
		  <quote>Labor and Human Resources</quote> and inserting <quote>Health,
		  Education, Labor, and Pensions</quote>;</text>
						</paragraph><paragraph id="H4B53138017ED4845A3C21DF7FF2242A9"><enum>(2)</enum><text>in subparagraph (D) of
		  subsection (d)(4), by striking <quote>head brain injury</quote> and inserting
		  <quote>brain injury</quote>; and</text>
						</paragraph><paragraph id="H3E9C3D92B4CE47C200001D00CC4D48D6"><enum>(3)</enum><text>in subsection (i), by
		  inserting <quote>, and such sums as may be necessary for each of the fiscal
		  years 2009 through 2012</quote> before the period at the end.</text>
						</paragraph></section><section id="H438E2E211B6A4ACDBC1D1BE09480E8A0"><enum>6.</enum><header>Traumatic brain injury
		  programs of the health resources and services administration</header>
						<subsection id="HA1000C064D11412DB5296D852217FBE"><enum>(a)</enum><header>State Grants for
		  Demonstration Projects Regarding Traumatic Brain Injury</header><text>Section
		  1252 of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>
		  (<external-xref legal-doc="usc" parsable-cite="usc/42/300d-52">42 U.S.C. 300d–52</external-xref>) is amended—</text>
							<paragraph id="H79CEEBB6A44C4652AFFD1EC3EB237527"><enum>(1)</enum><text>in subsection (a)—</text>
								<subparagraph id="H969F77E30E824120ABE7DCA988AA4700"><enum>(A)</enum><text>by striking <quote>may
		  make grants to States</quote> and inserting <quote>may make grants to States
		  and American Indian consortia</quote>; and</text>
								</subparagraph><subparagraph id="H56DA4A7487C942E1ACC3BB7450800064"><enum>(B)</enum><text>by striking <quote>health
		  and other services</quote> and inserting <quote>rehabilitation and other
		  services</quote>;</text>
								</subparagraph></paragraph><paragraph id="H54517BD9904E48978773ABAEED086CF9"><enum>(2)</enum><text>in subsection (b)—</text>
								<subparagraph id="H974EBF73CDCB4EFA9B9718920445939B"><enum>(A)</enum><text>in paragraphs (1),
		  (3)(A)(i), (3)(A)(iii), and (3)(A)(iv), by striking the term <term>State</term>
		  each place such term appears and inserting the term <term>State or American
		  Indian consortium</term>; and</text>
								</subparagraph><subparagraph id="HDD12A2EABD9245E3B698FA5F39D86300"><enum>(B)</enum><text>in paragraph (2), by
		  striking <quote>recommendations to the State</quote> and inserting
		  <quote>recommendations to the State or American Indian
		  consortium</quote>;</text>
								</subparagraph></paragraph><paragraph id="HE55E8A7238D34E56B8147ED4ECEF981E"><enum>(3)</enum><text>in subsection (c)(1), by
		  striking the term <term>State</term> each place such term appears and inserting
		  <quote>State or American Indian consortium</quote>;</text>
							</paragraph><paragraph id="H23E45228B1F3438089D67FAA27034673"><enum>(4)</enum><text>in subsection (e), by
		  striking <quote>A State that received</quote> and all that follows through the
		  period and inserting <quote>A State or American Indian consortium that received
		  a grant under this section prior to the date of the enactment of the Traumatic
		  Brain Injury Act of 2008 may complete the activities funded by the
		  grant.</quote>;</text>
							</paragraph><paragraph id="H8156DB44BC16462CAC2800CC6338FB44"><enum>(5)</enum><text>in subsection (f)—</text>
								<subparagraph id="H3305CF757D054DBCB5CAB72BAABD07EF"><enum>(A)</enum><text>in the subsection
		  heading, by inserting <quote><header-in-text level="subsection">and American
		  Indian Consortium</header-in-text></quote> after <quote><header-in-text level="subsection">State</header-in-text></quote>;</text>
								</subparagraph><subparagraph id="HCF3B928F97FD43E7B4B4882130A8CBE7"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (1) in the matter preceding
		  subparagraph (A), paragraph (1)(E), paragraph (2)(A), paragraph (2)(B),
		  paragraph (3) in the matter preceding subparagraph (A), paragraph (3)(E), and
		  paragraph (3)(F), by striking the term <term>State</term> each place such term
		  appears and inserting <quote>State or American Indian consortium</quote>;
		  and</text>
								</subparagraph><subparagraph id="H0FD302933E084EE3AEB821B6BB7BBC9B"><enum>(C)</enum><text>in clause (ii) of
		  paragraph (1)(A), by striking <quote>children and other individuals</quote> and
		  inserting <quote>children, youth, and adults</quote>;</text>
								</subparagraph></paragraph><paragraph id="H08F5C059EAF34F77AFF0BEC112517DB"><enum>(6)</enum><text>in subsection (h)—</text>
								<subparagraph id="H56A4A9A9F81540AA9DD204E19378D9AC"><enum>(A)</enum><text>by striking <quote>Not
		  later than 2 years after the date of the enactment of this section, the
		  Secretary</quote> and inserting <quote>Not less than biennially, the
		  Secretary</quote>;</text>
								</subparagraph><subparagraph id="HB5B6B9393A9B4D3C8700E37618AE5064"><enum>(B)</enum><text>by striking
		  <quote>Commerce of the House of Representatives, and to the Committee on Labor
		  and Human Resources</quote> and inserting <quote>Energy and Commerce of the
		  House of Representatives, and to the Committee on Health, Education, Labor, and
		  Pensions</quote>; and</text>
								</subparagraph><subparagraph id="H4DF15879118E4273B1A46267D8457EB4"><enum>(C)</enum><text>by inserting <quote>and
		  section 1253</quote> after <quote>programs established under this
		  section,</quote>;</text>
								</subparagraph></paragraph><paragraph id="H1AA8FB9B39044331A6E16158D2046E4E"><enum>(7)</enum><text>by amending subsection
		  (i) to read as follows:</text>
								<quoted-block changed="added" id="H36F5E3C06DF84736B82D2B3C36CDB803" reported-display-style="italic" style="OLC">
									<subsection id="HF02B7367DE6B4828960007A7CD0040B1"><enum>(i)</enum><header>Definitions</header><text>For
			 purposes of this section:</text>
										<paragraph id="H088652232C3A4F1597CA31368F28BA18"><enum>(1)</enum><text>The terms <term>American
			 Indian consortium</term> and <term>State</term> have the meanings given to
			 those terms in section 1253.</text>
										</paragraph><paragraph id="H81B31BD710E949929FA62D440009792D"><enum>(2)</enum><text>The term <term>traumatic
			 brain injury</term> means an acquired injury to the brain. Such term does not
			 include brain dysfunction caused by congenital or degenerative disorders, nor
			 birth trauma, but may include brain injuries caused by anoxia due to trauma.
			 The Secretary may revise the definition of such term as the Secretary
			 determines necessary, after consultation with States and other appropriate
			 public or nonprofit private entities.</text>
										</paragraph></subsection><after-quoted-block>;
			 and</after-quoted-block></quoted-block>
							</paragraph><paragraph id="HA685C130D8EF4B9B9431EA72324159B7"><enum>(8)</enum><text>in subsection (j), by
		  inserting <quote>, and such sums as may be necessary for each of the fiscal
		  years 2009 through 2012</quote> before the period.</text>
							</paragraph></subsection><subsection id="H292F7801B3164CEBA614FA99967190"><enum>(b)</enum><header>State Grants for
		  Protection and Advocacy Services</header><text>Section 1253 of the
		  <act-name parsable-cite="PHSA">Public Health Service Act</act-name> (42 U.S.C.
		  300d–53) is amended—</text>
							<paragraph id="HDA9D7D78F7854E19B5FDF912629E23F8"><enum>(1)</enum><text>in subsections (d) and
		  (e), by striking the term <term>subsection (i)</term> each place such term
		  appears and inserting <quote>subsection (l)</quote>;</text>
							</paragraph><paragraph id="H4B38E10270604E360042B09184AF9BE3"><enum>(2)</enum><text>in subsection (g), by
		  inserting <quote>each fiscal year not later than October 1,</quote> before
		  <quote>the Administrator shall pay</quote>;</text>
							</paragraph><paragraph id="H21679EFA5CE441A393E79E4867B30370"><enum>(3)</enum><text>by redesignating
		  subsections (i) and (j) as subsections (l) and (m), respectively;</text>
							</paragraph><paragraph id="HCCD73516D84B4BC0A89EE28112ECB610"><enum>(4)</enum><text>by inserting after
		  subsection (h) the following:</text>

									<subsection id="H46B34F9B24C240F8BFCB30C889B87DE8"><enum>(i)</enum><header>Data
			 Collection</header><text>The Administrator of the Health Resources and Services
			 Administration and the Commissioner of the Administration on Developmental
			 Disabilities shall enter into an agreement to coordinate the collection of data
			 by the Administrator and the Commissioner regarding protection and advocacy
			 services.</text>
									</subsection><subsection id="H0FCAB53BE3BA44098039A9DC8DEAE3B1"><enum>(j)</enum><header>Training and Technical
			 Assistance</header>
										<paragraph id="H54707F32AF054798B9E0EFE23B2C82EE"><enum>(1)</enum><header>Grants</header><text>For
			 any fiscal year for which the amount appropriated to carry out this section is
			 $6,000,000 or greater, the Administrator shall use 2 percent of such amount to
			 make a grant to an eligible national association for providing for training and
			 technical assistance to protection and advocacy systems.</text>
										</paragraph><paragraph id="H5482C6B52C314DF8A4EB26F8003C2623"><enum>(2)</enum><header>Definition</header><text>In
			 this subsection, the term <term>eligible national association</term> means a
			 national association with demonstrated experience in providing training and
			 technical assistance to protection and advocacy systems.</text>
										</paragraph></subsection><subsection id="H4BAF2635A70C4A0EBFB715BCFE95120"><enum>(k)</enum><header>System
			 Authority</header><text>In providing services under this section, a protection
			 and advocacy system shall have the same authorities, including access to
			 records, as such system would have for purposes of providing services under
			 subtitle C of the <act-name parsable-cite="DDA">Developmental Disabilities
			 Assistance and Bill of Rights Act</act-name> of
			 2000.</text>
									</subsection><after-quoted-block>;
			 and</after-quoted-block></quoted-block>
							</paragraph><paragraph id="H627EF70EEDDC403CA4DF48D8A0A376E8"><enum>(5)</enum><text>in subsection (l) (as
		  redesignated by this subsection) by striking <quote>2002 through 2005</quote>
		  and inserting <quote>2009 through 2012</quote>.</text>
