<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Moving to Work Charter Program Act of 2007</short-title></quote>.</text> </section>
<section commented="no" display-inline="no-display-inline" id="ID96656eac35f646f6ba44d8d0898e8224" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Moving to work charter program authorization</header> 
<subsection commented="no" display-inline="no-display-inline" id="ID4d580522b91e40a69d54d62f001769c6"><enum>(a)</enum><header display-inline="yes-display-inline">Purpose</header><text display-inline="yes-display-inline">The purpose of this Act is—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id1B61EAE7F1794705A7A7BECA6339C340"><enum>(1)</enum><text display-inline="yes-display-inline">to give public housing agencies and the Secretary of Housing and Urban Development (in this Act referred to as the <quote>Secretary</quote>) the flexibility to design and implement various approaches for providing and administering housing assistance that achieves greater cost effectiveness in using Federal housing assistance to address local housing needs for low-income families;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id393E11C28808496B88D6BC8237C69E2F"><enum>(2)</enum><text display-inline="yes-display-inline">to reduce administrative burdens on public housing agencies providing such assistance;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6CE98C850F1B4579B1049464EBFC202D"><enum>(3)</enum><text display-inline="yes-display-inline">to give incentives to assisted families to work and become economically self-sufficient;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id6519E8C588CE4DF0917BA0DAE77FDBDF"><enum>(4)</enum><text display-inline="yes-display-inline">to increase housing choices for low-income families; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id71D89AD604254F19940375731C25C3CC"><enum>(5)</enum><text display-inline="yes-display-inline">to enhance the ability of low-income elderly residents and persons with disabilities to live independently.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDd19fe2c107364846a5f8397853dd97da"><enum>(b)</enum><header display-inline="yes-display-inline">Moving to Work Charter Program authority</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id342C089B4101477DAC83F1F1578803DF"><enum>(1)</enum><header display-inline="yes-display-inline">Contract authority</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idB914C1F2748F413FAC80E26D2F325E89"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subject to the phase-in requirements under subparagraph (B), the Secretary shall enter into charter contracts, beginning in fiscal year 2008, with up to 250 public housing agencies administering the public housing program or the section 8 housing assistance program under the United States Housing Act of 1937 (42 U.S.C. 1437 et seq.).</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id23609FA1424B401589CCA210BFF0B43B"><enum>(B)</enum><header display-inline="yes-display-inline">Phase-in</header><text display-inline="yes-display-inline">The phase-in requirements under this subparagraph are as follows:</text> 
<clause commented="no" display-inline="no-display-inline" id="id18AD89B94CC74A7FBA74A0154A8FF756"><enum>(i)</enum><text display-inline="yes-display-inline">By the end of fiscal year 2008, the Secretary shall have entered into charter contracts with at least 80 public housing agencies described in subparagraph (A).</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idF139CDF60D224C118216623AABB64EBA"><enum>(ii)</enum><text display-inline="yes-display-inline">By the end of fiscal year 2009, the Secretary shall have entered into charter contracts with at least 160 public housing agencies described in subparagraph (A).</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idCA09B374F82542619A585E894ABD40C3"><enum>(iii)</enum><text display-inline="yes-display-inline">By the end of fiscal year 2010, the Secretary shall have entered into charter contracts with at least 250 public housing agencies described in subparagraph (A).</text> </clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id4BE6FC7773D94B8EB9BBF35C9F983D9C"><enum>(2)</enum><header display-inline="yes-display-inline">Charter contracts</header><text display-inline="yes-display-inline">A charter contract shall—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id7871B3E7191F46EFAEADB6946A1CF98E"><enum>(A)</enum><text display-inline="yes-display-inline">supersede and have a term commensurate with any annual contributions contract between a public housing agency and the Secretary; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id2719870F82CE48398D6B863E89ACDE61"><enum>(B)</enum><text display-inline="yes-display-inline">provide that a participating public housing agency shall receive—</text> 
<clause commented="no" display-inline="no-display-inline" id="idBD4AF6C1EB8E4931BDE5BD3B44CBB726"><enum>(i)</enum><text display-inline="yes-display-inline">capital and operating assistance allocated to such agency under section 9 of the United States Housing Act of 1937 (42 U.S.C. 1437g); and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id8C7D911BCF0B4FE38FE182254CEFBF08"><enum>(ii)</enum><text display-inline="yes-display-inline">assistance provided under section 8 United States Housing Act of 1937 (42 U.S.C. 1437f).</text> </clause></subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id60CBBA72ACAB48DCBCD77F42CDF6DBF5"><enum>(3)</enum><header display-inline="yes-display-inline">Use of assistance</header><text display-inline="yes-display-inline">Any assistance provided under paragraph (2)(B)—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id88D51876C1C34EA4A4BCF99AB7504DF6"><enum>(A)</enum><text display-inline="yes-display-inline">may be combined; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD3C2E5456E664D00A55AAAF810A4309A"><enum>(B)</enum><text display-inline="yes-display-inline">shall be used to provide locally designed housing assistance for low-income families, as such term is defined in section 3(b)(2) of the United States Housing Act of 1937 (42 U.S.C. 1437a(b)(2)), including—</text> 
<clause commented="no" display-inline="no-display-inline" id="id7B539C4D365440AEA7AA19A09BAA1967"><enum>(i)</enum><text display-inline="yes-display-inline">services to facilitate the transition to work and self-sufficiency; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id7C63A989BF0645EFB27CA8390CBF7636"><enum>(ii)</enum><text display-inline="yes-display-inline">any other activity which a public housing agency is authorized to undertake pursuant to State or local law.</text> </clause></subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDead2106af6a2403fb1c30e36044420ba"><enum>(c)</enum><header display-inline="yes-display-inline">Terms and conditions of assistance</header> 
<paragraph commented="no" display-inline="no-display-inline" id="IDce42f4acf25b42f78332b818962e4bdc"><enum>(1)</enum><header display-inline="yes-display-inline">Applicability of United States Housing Act of 1937</header><text display-inline="yes-display-inline">Except as provided in this section, the United States Housing Act of 1937 (42 U.S.C. 1437 et seq.) shall not be applicable to any public housing agency participating in the Moving to Work Charter program established under this section.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID7d8134c10f6344aca53f052e6da3e32e"><enum>(2)</enum><header display-inline="yes-display-inline">Applicable 1937 Act provisions</header><text display-inline="yes-display-inline">The following provisions of the United States Housing Act of 1937 (42 U.S.C. 1437 et seq.) are applicable to any public housing agency participating in the Moving to Work Charter program established under this section:</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="IDc1fdd814fd76468dac7e69a50ea71e5c"><enum>(A)</enum><text display-inline="yes-display-inline">Subsections (a) and (b) of section 12 (42 U.S.C. 1437j(a) and (b)) shall apply to housing assisted under a charter contract, other than housing assisted solely due to occupancy by families receiving tenant based rental assistance.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDd509b374afec4918b14b7c6d1e1fa3d8"><enum>(B)</enum><text display-inline="yes-display-inline">Section 18 (42 U.S.C. 1437p) shall continue to apply to public housing developed under such Act notwithstanding any use of the housing under a charter contract.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID465a46b1c3e94224947ce55974e7834e"><enum>(3)</enum><header display-inline="yes-display-inline">Charter contract terms</header><text display-inline="yes-display-inline">A charter contract shall provide that a public housing agency—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="IDe7c70cfe85c34337827a466270587aa9"><enum>(A)</enum><text display-inline="yes-display-inline">may—</text> 
<clause commented="no" display-inline="no-display-inline" id="id85DFE7348D4948C39EB2BE9C6C1CA75C"><enum>(i)</enum><text display-inline="yes-display-inline">combine assistance received under sections 8 and 9 of the United States Housing Act of 1937 (42 U.S.C. 1437f and 1437g), as described in subsection (b)(3); and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idBD06311CF9B245AF8ADF02D2FC2D37FB"><enum>(ii)</enum><text display-inline="yes-display-inline">use such assistance to provide housing assistance and related services for activities authorized by this section, including those activities authorized by sections 8 and 9 of such Act;</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDc236148f3c604b488386f07424de4e94"><enum>(B)</enum><text display-inline="yes-display-inline">certify that in preparing its application for participation in the Moving to Work Charter program established under this section, such agency has—</text> 
<clause commented="no" display-inline="no-display-inline" id="IDd749311478f44bb59a3a97a84799314f"><enum>(i)</enum><text display-inline="yes-display-inline">provided for citizen participation through a public hearing and, if appropriate, other means; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="ID05db3a83803d447890f5ddd5ef5130af"><enum>(ii)</enum><text display-inline="yes-display-inline">taken into account comments from the public hearing and any other public comments on the proposed activities under this Act, including comments from current and prospective residents who would be affected by such contract;</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID12f4bcb8541740eba97c11c715b05c02"><enum>(C)</enum><text display-inline="yes-display-inline">shall ensure that at least 75 percent of the families assisted under a charter contract shall be, at the time of such families’ entry into the Moving to Work Charter program, very low-income families, as such term is defined in section 3(b)(2) of the United States Housing Act of 1937 (42 U.S.C. 1437a(b)(2));</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID94fa5ce6ea9b4aba8ab257b8b2e50f98"><enum>(D)</enum><text display-inline="yes-display-inline">shall establish a reasonable rent policy, which shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="idE6409931CEFD42AFAC3BA4B2924D0E6E"><enum>(i)</enum><text display-inline="yes-display-inline">be designed to encourage employment, self-sufficiency, and homeownership by participating families, consistent with the purpose of this Act;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idB6C9D8101DBF4477843453F142B33E00"><enum>(ii)</enum><text display-inline="yes-display-inline">include transition and hardship provisions;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="idF2EF850F4E664362866F00F68503478E"><enum>(iii)</enum><text display-inline="yes-display-inline">be included in the annual plan of such agency; and</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="id872B2D1E67E3439B9A4AF59EE4D09049"><enum>(iv)</enum><text display-inline="yes-display-inline">be subject to the opportunities for public participation described in subsection (e)(1)(D);</text> </clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID82ee3d3be6d94b319444d1bd37d718f1"><enum>(E)</enum><text display-inline="yes-display-inline">shall continue to assist not less than substantially the same total number of low-income families as would have been served had such agency not entered into such contract;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID4ea93efe48c74c75bea9102742c04c63"><enum>(F)</enum><text display-inline="yes-display-inline">shall maintain a comparable mix of families (by family size) as would have been provided had the agency not entered into such contract;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDf42a34c30bce488b82308baf8497297e"><enum>(G)</enum><text display-inline="yes-display-inline">shall ensure that housing assisted under such contract meets housing quality standards established or approved by the Secretary;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID81a503b4b84c402d81f4157f60e27a71"><enum>(H)</enum><text display-inline="yes-display-inline">shall receive training and technical assistance, upon request by such agency, to assist with the design and implementation of the activities described under this Act;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID987b39a25b224ee1ac135ae7e63e621e"><enum>(I)</enum><text display-inline="yes-display-inline">shall receive an amount of assistance under sections 8 and 9 of the United States Housing Act of 1937 (42 U.S.C. 1437f and 1437g), that is not diminished by the participation of such agency in the Moving to Work Charter program established under this section; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="IDd83d143f6e8a47159a96b45489927022"><enum>(J)</enum><text display-inline="yes-display-inline">shall be subject to the procurement procedures described in such contract.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDa785cee7483b42b49f1a549d70c7fca2"><enum>(d)</enum><header display-inline="yes-display-inline">Selection</header><text display-inline="yes-display-inline">In selecting among applications to participate in the Moving to Work Charter program established under this section, the Secretary shall consider—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id6DE9DB412BE149F2A7F94EFCBB605172"><enum>(1)</enum><text display-inline="yes-display-inline">the potential of each agency to plan and carry out activities under such program;</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idD156020DC7EF411D8EE24905B5BC9486"><enum>(2)</enum><text display-inline="yes-display-inline">the relative performance by an agency under section 6(j) of the United States Housing Act of 1937 (42 U.S.C. 1437d(j));</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id625B51C7F8A44473A994DE4B2BC8F202"><enum>(3)</enum><text display-inline="yes-display-inline">the need for a diversity of participants in terms of size, location, and type of agency; and</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idA6C6D5CE5F5E425FA9D2C096DA8A0303"><enum>(4)</enum><text display-inline="yes-display-inline">any other appropriate factor as determined by the Secretary.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID1066ebd4db1f476d8410c87ad511f89c"><enum>(e)</enum><header display-inline="yes-display-inline">Charter report</header> 
<paragraph commented="no" display-inline="no-display-inline" id="ID6521662ee7cf46d2acd33d46ecc3da4c"><enum>(1)</enum><header display-inline="yes-display-inline">Contents</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="idDBCA75A8A45B471C9AE5B0DD2F12F220"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and in place of all other planning and reporting requirements otherwise required, each public housing agency that is a party to a charter contract shall submit to the Secretary, on an annual basis, a single charter report, in a form and at a time specified by the Secretary.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idBFBB4E978C2E4AF9865FA7847B53288F"><enum>(B)</enum><header display-inline="yes-display-inline">Sole means of reporting</header><text display-inline="yes-display-inline">A charter report submitted under subparagraph (A) shall be the sole means by which a public housing agency shall be required to provide information to the Secretary on the activities assisted under this section during a fiscal year, unless the Secretary has reason to believe that such agency has violated the charter contract between the Secretary and such agency.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD7C9248DF33847ACA8577E939442CA0E"><enum>(C)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">Each charter report required under subparagraph (A) shall—</text> 
<clause commented="no" display-inline="no-display-inline" id="IDdd308f0d3736498f89f34aa9d71fa281"><enum>(i)</enum><text display-inline="yes-display-inline">document the use by a public housing agency of any assistance provided under a charter contract, including appropriate financial statements;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="ID48c4ed7e31884736ac4cca4b01a7a6c9"><enum>(ii)</enum><text display-inline="yes-display-inline">describe and analyze the effect of assisted activities in addressing the objectives of this section;</text> </clause>
<clause commented="no" display-inline="no-display-inline" id="ID8db341047dbc4703b62ade6a39c376f5"><enum>(iii)</enum><text display-inline="yes-display-inline">include a certification by such agency that such agency has prepared an annual plan which—</text> 
<subclause commented="no" display-inline="no-display-inline" id="IDc29a53009cd24fa394ffd0befa4d04d9"><enum>(I)</enum><text display-inline="yes-display-inline">states the goals and objectives of that agency under the charter contract for the past fiscal year;</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="IDfb43544e2aa240579ba03582b67a4752"><enum>(II)</enum><text display-inline="yes-display-inline">describes the proposed use of assistance by that agency for activities under the charter contract for the past fiscal year;</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="ID267afa4444834116abe43a699b14c4a6"><enum>(III)</enum><text display-inline="yes-display-inline">explains how the proposed activities of that agency will meet the goals and objectives of that agency;</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="ID6897e05871394a3fbdd17ddad4871e1f"><enum>(IV)</enum><text display-inline="yes-display-inline">includes appropriate budget and financial statements of that agency; and</text> </subclause>
<subclause commented="no" display-inline="no-display-inline" id="IDa5daf27668ec40728840f1b737738e13"><enum>(V)</enum><text display-inline="yes-display-inline">was prepared in accordance with a public process as described in subparagraph (D);</text> </subclause></clause></subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID1d672edeea0b41fca2e3e83c2a6aa16c"><enum>(D)</enum><text display-inline="yes-display-inline">describe and document how a public housing agency has provided residents assisted under a charter contract and the wider community with opportunities to participate in the development of and comment on the annual plan, which shall include at least 1 public hearing; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="ID07c332073a7e4ea6b13fbff2bdcb388a"><enum>(E)</enum><text display-inline="yes-display-inline">include such other information as may be required by the Secretary pursuant to subsection (f)(2).</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDe6b1bfdc034a4a37a04b10956ce17f2d"><enum>(2)</enum><header display-inline="yes-display-inline">Review</header><text display-inline="yes-display-inline">Any charter report submitted pursuant to paragraph (1) shall be deemed approved unless the Secretary, not later than 45 days after the date of submission of such report, issues a written disapproval because—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id2916C817C8774434B35CA4F96D86DB1F"><enum>(A)</enum><text display-inline="yes-display-inline">the Secretary reasonably determines, based on information contained in the report that a public housing agency is not in compliance with the provisions of this section or other applicable law; or</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idDACFD1034B2041F6B062ADA917235556"><enum>(B)</enum><text display-inline="yes-display-inline">such report is inconsistent with other reliable information available to the Secretary.</text> </subparagraph></paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDb6be9011c8e248baaa7b65a48eec3a12"><enum>(f)</enum><header display-inline="yes-display-inline">Records and audits</header> 
<paragraph commented="no" display-inline="no-display-inline" id="ID54201e7586a847c8914758c165fd9f22"><enum>(1)</enum><header display-inline="yes-display-inline">Keeping of records</header><text display-inline="yes-display-inline">Each public housing agency shall keep such records as the Secretary may prescribe as reasonably necessary—</text> 
<subparagraph commented="no" display-inline="no-display-inline" id="id53CAD745041148C483C3D974E496CFAF"><enum>(A)</enum><text display-inline="yes-display-inline">to disclose the amounts and the disposition of amounts under the Moving to Work Charter program established under this section;</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idA86D2E14E7E24BC89C010C2B34B0D2A5"><enum>(B)</enum><text display-inline="yes-display-inline">to ensure compliance with the requirements of this section; and</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="id10ED0852B0314EB99A0A2A8A819BB4B4"><enum>(C)</enum><text display-inline="yes-display-inline">to measure performance.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="IDa7c8ca43c3374d649d9e191720411feb"><enum>(2)</enum><header display-inline="yes-display-inline">Access to documents by the secretary</header> 
<subparagraph commented="no" display-inline="no-display-inline" id="id4E257EE9E83A48D3BEDCFAD8A3D09D6E"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The Secretary shall have access for the purpose of audit and examination to any books, documents, papers, and records that are pertinent to assistance in connection with, and the requirements of, this section.</text> </subparagraph>
<subparagraph commented="no" display-inline="no-display-inline" id="idD588B84446B946FFADF7A7B321821069"><enum>(B)</enum><header display-inline="yes-display-inline">Limitation</header><text display-inline="yes-display-inline">Access by the Secretary described under subparagraph (A) shall be limited to information obtained solely through the annual charter report submitted by a public housing agency under subsection (e), unless the Secretary has reason to believe that such agency is not in compliance with the charter contract between the Secretary and such agency.</text> </subparagraph></paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="ID0c726295e9ac4b0fb9eb7fae54d51f65"><enum>(3)</enum><header display-inline="yes-display-inline">Access to documents by the comptroller general</header><text display-inline="yes-display-inline">The Comptroller General of the United States, or any duly authorized representative of the Comptroller General, shall have access for the purpose of audit and examination to any books, documents, papers, and records that are pertinent to assistance in connection with, and the requirements of the Moving to Work Charter program established under this section.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID32bade6985cc4041a2399acf06339438"><enum>(g)</enum><header display-inline="yes-display-inline">Procurement preemption</header> 
<paragraph commented="no" display-inline="no-display-inline" id="idBAD61CF1103D4A3EBC5F1B8B38A40CD2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Any State or local law which imposes procedures or standards for procurement which conflict with or are more burdensome than applicable Federal procurement requirements shall not apply to any public housing agency under the Moving to Work Charter program established under this section.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id14B0996F48DC480EA2560744EE108D6F"><enum>(2)</enum><header display-inline="yes-display-inline">reduction of administrative burdens</header><text display-inline="yes-display-inline">The Secretary may approve procurement procedures for public housing agencies participating in the Moving to Work Charter program established under this section that reduce administrative burdens of procurement requirements imposed by Federal law.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="IDfc981b269dfa4a2fa0f795967d14663c"><enum>(h)</enum><header display-inline="yes-display-inline">Subsequent laws preempted</header><text display-inline="yes-display-inline">A public housing agency participating in the Moving to Work Charter program established under this section shall not be subject to any provision of law which conflicts with the provisions of this section and which is enacted subsequent to the date of execution of such agency’s charter contract or Moving to Work program agreement, as described in subsection (i), unless such law expressly provides for such law’s application to public housing agencies subject to this section.</text> </subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID53468c9f7d0a4c119a3df397ca1e3c2f"><enum>(i)</enum><header display-inline="yes-display-inline">Existing agreements</header><text display-inline="yes-display-inline">Notwithstanding anything in this section or any other provision of law, any public housing agency which has an existing Moving to Work program agreement with the Secretary pursuant to section 204 of the Departments of Veterans Affairs and Housing and Urban Development, and Independent Agencies Appropriations Act, 1996 (Public Law 104–134; 110 Stat. 1321–281) and which is not in default thereof, may, at the option of such agency—</text> 
<paragraph commented="no" display-inline="no-display-inline" id="id85C395552B19473B83721BF251120D99"><enum>(1)</enum><text display-inline="yes-display-inline">continue to operate under the terms and conditions of such agreement notwithstanding any limitation on the terms contained in such contract; or</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="idBB70C11C25A24EF095D7FF46343A1EB8"><enum>(2)</enum><text display-inline="yes-display-inline">at any time, enter into a charter contract with the Secretary on terms and conditions which are not less favorable to the agency than such existing agreement.</text> </paragraph></subsection>
<subsection commented="no" display-inline="no-display-inline" id="ID8c133a9a147b48ad8cbcfcf3f5007087"><enum>(j)</enum><header display-inline="yes-display-inline">Public housing agency evaluation</header> 
<paragraph commented="no" display-inline="no-display-inline" id="id4C1D4FA7AC2B405F936DAF33AE05197E"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">By the end of fiscal year 2008, the Secretary shall appoint a Federal advisory committee consisting of public housing agencies with charter contracts, public housing industry organizations, resident organizations, other public housing and section 8 voucher stakeholders, and experts on accreditation systems in similar fields, to assess and develop a demonstration program to test standards, criteria, and practices for a national public housing agency accreditation system or other evaluation system.</text> </paragraph>
<paragraph commented="no" display-inline="no-display-inline" id="id1D2F38520BBD4429AA6FA691F4E34E07"><enum>(2)</enum><header display-inline="yes-display-inline">Report</header><text display-inline="yes-display-inline">Not later than the end of fiscal year 2010, the committee established under paragraph (1) and the Secretary shall provide a report and recommendations to Congress with respect to the establishment of a national public housing agency accreditation system.</text> </paragraph></subsection></section>
