		<official-title>To ensure adequate funding for high-threat areas, and for
		  other purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>High Risk Protection
			 Act</short-title></quote>.</text>
		</section><section id="idD8EB915B85754C188DDE08DA57A5AA7E"><enum>2.</enum><header>Definitions</header><text display-inline="no-display-inline">In this Act—</text>
			<paragraph id="id40B948CDE0FD473E81FCECF474797217"><enum>(1)</enum><text>the term
			 <term>critical infrastructure</term> has the meaning given the term in section
			 2 of the Homeland Security Act of 2002 (6 U.S.C. 101);</text>
			</paragraph><paragraph id="id7D1A8E585A9A4D85B2C5BB175440274A"><enum>(2)</enum><text>the term
			 <term>Department</term> means the Department of Homeland Security;</text>
			</paragraph><paragraph id="id8C18C66C40024BC5A936D1F77101D0BA"><enum>(3)</enum><text>the term
			 <term>high-threat area</term> means an area determined to be a high-threat area
			 under section 3(a)(1);</text>
			</paragraph><paragraph id="id29C9190D2D9D4D4AB25A09271FEE0D21"><enum>(4)</enum><text>the term
			 <term>Secretary</term> means the Secretary of Homeland Security; and</text>
			</paragraph><paragraph id="idF584989CDB9B437B967D2F18A644E674"><enum>(5)</enum><text>the term
			 <term>Urban Area Security Initiative Grant Program</term> means the Urban Area
			 Security Initiative Grant Program administered by the Department from funds
			 appropriated for discretionary grants to high-threat, high-density urban
			 areas.</text>
			</paragraph></section><section id="idE083FA4B07494AA9A25C0FC2BDBE5C17"><enum>3.</enum><header>Funding for the
			 Urban Area Security Initiative Grant Program</header>
			<subsection id="id61DE2AC4A03F461AA0A118E4F488811D"><enum>(a)</enum><header>In
			 general</header>
				<paragraph id="id7086D79067AB4BC09C3F9DD798F92ABE"><enum>(1)</enum><header>Allocation
			 based on risk only</header><text>Notwithstanding any other provision of law,
			 amounts appropriated to the Department for the Urban Area Security Initiative
			 Grant Program shall be allocated based solely on risk (which shall include an
			 evaluation of threats, vulnerabilities, and consequences and consideration of
			 any previous terrorist attacks), as determined by the Secretary based on the
			 considerations listed in subparagraphs (A) and (B) of paragraph (2).</text>
				</paragraph><paragraph id="idAE001AF92FF940698E680CC9D8AD1058"><enum>(2)</enum><header>Determination
			 of high-threat areas</header><text>In determining which areas qualify as
			 high-threat areas for the Urban Area Security Initiative Grant Program, the
			 Secretary shall consider—</text>
					<subparagraph id="id6512354A5BAD4C499F76297204644788"><enum>(A)</enum><text>whether the
			 area—</text>
						<clause id="id941B9449F00340A785B1A367CA9632F8"><enum>(i)</enum><text>contains critical
			 infrastructure, including—</text>
							<subclause id="id452C1340C1C54E3E84D2C2FB657B114E"><enum>(I)</enum><text>skyscrapers and
			 large commercial buildings;</text>
							</subclause><subclause id="idF53A8ADEB1764A4EBF2B6AC6FBAC0376"><enum>(II)</enum><text>transportation
			 assets, including rail and mass transit, bridges and tunnels, and
			 airports;</text>
							</subclause><subclause id="id6517CDB5FAAE4B1AA3DEA650BD9553A8"><enum>(III)</enum><text>commuting
			 populations;</text>
							</subclause><subclause commented="no" display-inline="no-display-inline" id="id6A74FBEBEAEF4239B1DC7265B2CF5D2D"><enum>(IV)</enum><text>a national
			 monument or icon;</text>
							</subclause><subclause id="idD086F63F014B4DD48A2F09534F9F06E3"><enum>(V)</enum><text>a nuclear power
			 plant or nonpower reactor;</text>
							</subclause><subclause id="idC2E40E91AECB4C63AB1C1397314A4F06"><enum>(VI)</enum><text>a
			 seaport;</text>
							</subclause><subclause id="id6ABFE11DB7444879843F3B0E4B48337C"><enum>(VII)</enum><text>a chemical
			 facility;</text>
							</subclause><subclause id="idA257D88FD47249638E1E9DFA12C5D2F1"><enum>(VIII)</enum><text>a military
			 facility;</text>
							</subclause><subclause id="id92C9E931482E40429E68DAAF5371A91C"><enum>(IX)</enum><text>a Federal
			 facility;</text>
							</subclause><subclause id="idCCCF0A986D6546FD85B00B4AC4227A53"><enum>(X)</enum><text>a dam;</text>
							</subclause><subclause id="id0B94517912744F03ADDEB3A547092D7D"><enum>(XI)</enum><text>a nonnuclear
			 electric power plant;</text>
							</subclause><subclause id="id2A794D7FCF76410081514CC2D1F6E1AB"><enum>(XII)</enum><text>a food or
			 agriculture center;</text>
							</subclause><subclause id="id61B8B1FA818C4E36A1174FBCE58766A0"><enum>(XIII)</enum><text>an oil or
			 natural gas refinery or pipeline;</text>
							</subclause><subclause id="id0C088DC716F344D8A92D7DCBF53FF354"><enum>(XIV)</enum><text>a financial
			 center; and</text>
							</subclause><subclause id="id192CDDA2FFCF4136B00F2277FA131C78"><enum>(XV)</enum><text>a stadium or
			 arena; and</text>
							</subclause></clause><clause id="idA9FCB14C712C431FB565180E1D1DF846"><enum>(ii)</enum><text>is
			 located on an international border or coastline, including the number of border
			 crossings; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id0CD15CA6091D47D09E06A478E2B08828"><enum>(B)</enum><text>the population,
			 population density, law enforcement investigative and enforcement activity, and
			 tourism in the area.</text>
					</subparagraph></paragraph><paragraph id="id01CE414587854E06B9AE44162183667C"><enum>(3)</enum><header>Determination
			 of allocation</header><text>In allocating amounts among high-threat areas for
			 the Urban Area Security Initiative Grant Program, the Secretary shall evaluate
			 all threats (including threats to national monuments and icons) and critical
			 infrastructure vulnerabilities located in high-threat areas using the
			 considerations listed in subparagraphs (A) and (B) of paragraph (2).</text>
				</paragraph></subsection><subsection id="idDE763CBAE9054FABB4E9A0DD570F788B"><enum>(b)</enum><header>Peer
			 review</header><text>The Urban Area Security Initiative Grant Program shall not
			 be subject to the peer review process of the Department.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA17E4E27983C42BCBB4F394C9FF8CA95"><enum>(c)</enum><header>Use of
			 funds</header><text>Notwithstanding any other provision of law, funds made
			 available under the Urban Area Security Initiative Grant Program may be used
			 for overtime and other employment costs directly relating to the prevention of
			 terrorist activities and any other activity determined to be necessary by the
			 Secretary.</text>
			</subsection><subsection id="id3505FA08E0FB45C392C7ED1B4171C7B3"><enum>(d)</enum><header>Reporting
			 regarding grants</header><text>Not later than 30 days before making a final
			 allocation of grants to high-threat areas under the Urban Area Security
			 Initiative Program, the Secretary shall submit to each Member of the Senate and
			 the House of Representatives who represents a high-threat area a report
			 regarding the proposed allocation of funds, including a description of the
			 analysis of critical infrastructure used in making the proposed
			 allocation.</text>
			</subsection></section><section id="idB53F0FD2C8A24D72BF4273BDABA761D3"><enum>4.</enum><header>Reporting
			 regarding determination and evaluation</header><text display-inline="no-display-inline">The Secretary shall submit a report to the
			 Committee on Homeland Security and Government Affairs and the Committee on
			 Appropriations of the Senate and the Committee on Homeland Security and the
			 Committee on Appropriations of the House of Representatives regarding the
			 determination of high-threat areas, evaluation of threats, vulnerabilities, and
			 consequences, and consideration of any previous terrorist attacks under section
			 3(a).</text>
