		<official-title display="yes">To amend the Office of Federal Procurement
		  Policy Act to establish a governmentwide policy requiring competition in
		  certain executive agency procurements, and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="ID815C243DC7CA42DE9D6C6D2F50BA4068" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Governmentwide procurement policy relating
			 to purchases from Federal Prison Industries</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDA6D2E514C8E549FFA017416594914B5A"><enum>(a)</enum><header display-inline="yes-display-inline">Requirements</header><text display-inline="yes-display-inline">The Office of Federal Procurement Policy
			 Act (41 U.S.C. 403 et seq.) is amended by adding at the end the following new
			 section:</text>
				<quoted-block display-inline="no-display-inline" id="ID95CB76D613D04D6BBBD2C54619973F4F" style="OLC">
					<section commented="no" display-inline="no-display-inline" id="IDB675D3CD47EE49DB8B46E2BEC37D1FF3" section-type="subsequent-section"><enum>43.</enum><header display-inline="yes-display-inline">Governmentwide procurement policy relating
				to purchases from Federal Prison Industries</header>
						<subsection commented="no" display-inline="no-display-inline" id="IDD848483E34404F38AE4C29C3BC38ABC1"><enum>(a)</enum><header display-inline="yes-display-inline">Competition Required</header><text display-inline="yes-display-inline">In the procurement of any product that is
				authorized to be offered for sale by Federal Prison Industries and is listed in
				the catalog published and maintained by Federal Prison Industries under section
				4124(b) of title 18, United States Code, the head of an executive agency shall,
				except as provided in subsection (d)—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID51F314F5C3004491A2E47151A28A8113"><enum>(1)</enum><text display-inline="yes-display-inline">use competitive procedures for entering
				into a contract for the procurement of such product, in accordance with the
				requirements applicable to such executive agency under sections 2304 and 2305
				of title 10, United States Code, or sections 303 through 303C of the
				<act-name parsable-cite="FPASA">Federal Property and Administrative Services
				Act of 1949</act-name> (41 U.S.C. 253 through 253c); or</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID80A105A8EF5C4F4AA0AE8425038D97CA"><enum>(2)</enum><text display-inline="yes-display-inline">make an individual purchase under a
				multiple award contract in accordance with competition requirements applicable
				to such purchases.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDD680C120888D41B9B991EBDC4375AB01"><enum>(b)</enum><header display-inline="yes-display-inline">Offers From Federal Prison
				Industries</header><text display-inline="yes-display-inline">In conducting a
				procurement pursuant to subsection (a), the head of an executive agency
				shall—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID4886B475AF30496ABD296DA01C846C11"><enum>(1)</enum><text display-inline="yes-display-inline">notify Federal Prison Industries of the
				procurement at the same time and in the same manner as other potential offerors
				are notified; and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC86438FCC3A34E75B90CDD92E615B1E5"><enum>(2)</enum><text display-inline="yes-display-inline">consider a timely offer from Federal Prison
				Industries for award in the same manner as other offers (regardless of whether
				Federal Prison Industries is a contractor under an applicable multiple award
				contract).</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9B01841FB2CB4F18909B9FCDA18AD5F5"><enum>(c)</enum><header display-inline="yes-display-inline">Implementation by Agencies</header><text display-inline="yes-display-inline">The head of each executive agency shall
				ensure that—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID363F8AADA381434EB68D4169CE303C51"><enum>(1)</enum><text display-inline="yes-display-inline">the executive agency does not purchase a
				Federal Prison Industries product or service unless a contracting officer of
				the executive agency determines that the product or service is comparable to
				products or services available from the private sector that best meet the
				executive agency’s needs in terms of price, quality, and time of delivery;
				and</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD164D72603DC40E68A5C900B452ADE1B"><enum>(2)</enum><text display-inline="yes-display-inline">Federal Prison Industries performs its
				contractual obligations to the executive agency to the same extent as any other
				contractor for the executive agency.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID6331DDA1BF5948FF9AA3BD4DA4724E28"><enum>(d)</enum><header display-inline="yes-display-inline">Exception</header><paragraph commented="no" display-inline="yes-display-inline" id="ID8164E6C0A9B441D58BAC04DB3EC09B40"><enum>(1)</enum><text display-inline="yes-display-inline">The head of an executive agency may use
				procedures other than competitive procedures to enter into a contract with
				Federal Prison Industries only under the following circumstances:</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID670B4D2CB0454A379850D54E3B4662B8" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">The Attorney General personally determines
				in accordance with paragraph (2), within 30 days after Federal Prison
				Industries has been informed by the head of that executive agency of an
				opportunity for award of a contract for a product, that—</text>
									<clause commented="no" display-inline="no-display-inline" id="ID688ED45F354A49F5B37EA13540DF70DB"><enum>(i)</enum><text display-inline="yes-display-inline">Federal Prison Industries cannot reasonably
				expect fair consideration in the selection of an offeror for award of the
				contract on a competitive basis; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID6E7579A778E14C73ABB4CF8C196C9C15"><enum>(ii)</enum><text display-inline="yes-display-inline">the award of the contract to Federal Prison
				Industries for performance at a penal or correctional facility is necessary to
				maintain work opportunities not otherwise available at the penal or
				correctional facility that prevent circumstances that could reasonably be
				expected to significantly endanger the safe and effective administration of
				such facility.</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID382A1571C4E54DEF9AFAC4C00A23E6E0" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The product is available only from Federal
				Prison Industries and the contract may be awarded under the authority of
				section 2304(c)(1) of title 10, United States Code, or section 303(c)(1) of the
				<act-name parsable-cite="FPASA">Federal Property and Administrative Services
				Act of 1949</act-name> (41 U.S.C. 253(c)(1)), as may be applicable, pursuant to
				the justification and approval requirements relating to noncompetitive
				procurements specified by law and the Federal Acquisition Regulation.</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDCDF71B667858458094F03B3D0ADDBE13" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">The head of the executive agency determines
				that the product that would otherwise be furnished is to be produced, in whole
				or in significant part, by prison labor outside the United States.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8352C899CC004F42A6CF345AE945C200" indent="up1"><enum>(2)</enum><subparagraph commented="no" display-inline="yes-display-inline" id="ID4869B6509D474EBCB2BD3872168D479F"><enum>(A)</enum><text display-inline="yes-display-inline">A determination made by the Attorney
				General regarding a contract pursuant to paragraph (1)(A) shall be—</text>
									<clause commented="no" display-inline="no-display-inline" id="IDAA2FC644D4D2478795A086048FCD590E" indent="up1"><enum>(i)</enum><text display-inline="yes-display-inline">supported by specific findings by the
				warden of the penal or correctional institution at which a Federal Prison
				Industries workshop is scheduled to perform the contract;</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID5CC7247720C042BD8CBEAA8B0278CFBD" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">supported by specific findings by Federal
				Prison Industries regarding the reasons that it does not expect to be selected
				for award of the contract on a competitive basis; and</text>
									</clause><clause commented="no" display-inline="no-display-inline" id="ID99B601CB7A31495A960A803E8D585A2E" indent="up1"><enum>(iii)</enum><text display-inline="yes-display-inline">made and reported in the same manner as a
				determination made pursuant to section 303(c)(7) of the
				<act-name parsable-cite="FPASA">Federal Property and Administrative Services
				Act of 1949</act-name> (41 U.S.C. 253(c)(7)).</text>
									</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID622F5289DA2541989CA16065717AE05A" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">The Attorney General may not delegate to
				any other official authority to make a determination that is required under
				paragraph (1)(A) to be made personally by the Attorney General.</text>
								</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID0603F7F5ABB142D6A76EC85E6112DC06"><enum>(e)</enum><header display-inline="yes-display-inline">Performance as a
				Subcontractor</header><paragraph commented="no" display-inline="yes-display-inline" id="ID6DB36C794F6847D0938F419D4751E600"><enum>(1)</enum><text display-inline="yes-display-inline">A contractor or potential contractor under
				a contract entered into by the head of an executive agency may not be required
				to use Federal Prison Industries as a subcontractor or supplier of products or
				provider of services for the performance of the contract by any means,
				including means such as—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID5807026D69A34FC6A738B80E9E1DE748" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">a
				provision in a solicitation of offers that requires a contractor to offer to
				use or specify products or services of Federal Prison Industries in the
				performance of the contract;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5890F17287374053824C9CAF6A4F99CD" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">a
				contract clause that requires the contractor to use or specify products or
				services (or classes of products or services) offered by Federal Prison
				Industries in the performance of the contract; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID86E60A9E9AFC4916AD1C4A33CE9E6F79" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">any contract modification that requires the
				use of products or services of Federal Prison Industries in the performance of
				the contract.</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8A48051D7285463EA7B19C8CE12BA4CF" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A
				contractor using Federal Prison Industries as a subcontractor or supplier in
				furnishing a commercial product pursuant to a contract of an executive agency
				shall implement appropriate management procedures to prevent an introduction of
				an inmate-produced product into the commercial market.</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2012054A7C47452BB84DB22A2D01CB56" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">In this subsection, the term
				<term>contractor</term>, with respect to a contract, includes a subcontractor
				at any tier under the contract.</text>
							</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID19FD882387294F778A5184A90905EB1C"><enum>(f)</enum><header display-inline="yes-display-inline">Protection of Classified and Sensitive
				Information</header><text display-inline="yes-display-inline">The head of an
				executive agency may not enter into any contract with Federal Prison Industries
				under which an inmate worker would have access to—</text>
							<paragraph commented="no" display-inline="no-display-inline" id="ID3AF2951FDAB14456983196718D17E057"><enum>(1)</enum><text display-inline="yes-display-inline">any data that is classified or will become
				classified after being merged with other data;</text>
							</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2A8B6DF51B2541B687C7D7979833787B"><enum>(2)</enum><text display-inline="yes-display-inline">any geographic data regarding the location
				of—</text>
								<subparagraph commented="no" display-inline="no-display-inline" id="ID036A8812FDCE44E2A2CCCBB7A44D76DE"><enum>(A)</enum><text display-inline="yes-display-inline">surface or subsurface infrastructure
				providing communications or water or electrical power distribution;</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3E8DD1D95F1F4508961AC4314D543B65"><enum>(B)</enum><text display-inline="yes-display-inline">pipelines for the distribution of natural
				gas, bulk petroleum products, or other commodities; or</text>
								</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8D67ECF959FC46B284A51F733BA02870"><enum>(C)</enum><text display-inline="yes-display-inline">other utilities; or</text>
								</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1A9BA11E168E46248ADE895009C76F79"><enum>(3)</enum><text display-inline="yes-display-inline">any personal or financial information about
				any individual private citizen, including information relating to such person’s
				real property however described, without the prior consent of the
				individual.</text>
							</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDCF997BC155E74D179F86D9C0FC1AE70D"><enum>(b)</enum><header display-inline="yes-display-inline">Clerical Amendment</header><text display-inline="yes-display-inline">The table of contents in section 1(b) of
			 such Act is amended by adding at the end the following new item:</text>

			 Applicable to Department of Defense</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9822C589DB0D4ACCA0039A049730E099"><enum>(1)</enum><header display-inline="yes-display-inline">Repeal</header><text display-inline="yes-display-inline">Section 2410n of title 10, United States
			 Code, is repealed.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID998372C07DDC4A628D4ABB54382551B9"><enum>(2)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 chapter 141 of such title is amended by striking the item relating to section
			 2410n.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID067CFB3346D54F10A16311C05CDB82EB"><enum>(b)</enum><header display-inline="yes-display-inline">Repeal of Inconsistent Requirements
			 Applicable to Other Agencies</header><text display-inline="yes-display-inline">Section 4124 of title 18, United States
			 Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID5DEB113171B84EF3A69554D378A5AC9B"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsections (a) and (b);</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id8073688A86174E5DAB22EEE4FDB93D58"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsections (c) and (d) as
			 subsections (a) and (b), respectively; and</text>

			 (41 U.S.C. 48) is amended by striking <quote>which, under section 4124 of such
			 title, is required</quote> and inserting <quote>which is required by
			 law</quote>.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID47AF059521D84E938A528287A2EEFFF9"><enum>(2)</enum><text display-inline="yes-display-inline">Section 31(b)(4) of the
			 <act-name parsable-cite="SBA">Small Business Act</act-name> (15 U.S.C.
			 657a(b)(4)) is amended by striking <quote>a different source under section 4124
			 or 4125 of title 18, United States Code, or the Javits-Wagner-O’Day Act (41
			 U.S.C. 46 et seq.)</quote> and inserting <quote>a different source under the
			 Javits-Wagner-O’Day Act (41 U.S.C. 46 et seq.) or Federal Prison Industries
			 under section 40(d) of the Office of Federal Procurement Policy Act or section
			 4125 of title 18, United States Code</quote>.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDB791BFAF0C5E431DB2CE755CC7C02B2F" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Clarifying amendment relating to
			 services</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID2DE15444CFC14B21852A474A1FC099ED"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">Section 1761 of title 18, United States
			 Code, is amended in subsections (a) and (c) by striking <quote>goods, wares, or
			 merchandise manufactured, produced, or mined</quote> each place it appears and
			 inserting <quote>products manufactured, services furnished, or minerals
			 mined</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID993B4777B2104F069628C28068994BCD"><enum>(b)</enum><header display-inline="yes-display-inline">Completion of Existing
			 Agreements</header><text display-inline="yes-display-inline">Any prisoner work
			 program operated by a prison or jail of a State or local jurisdiction of a
			 State which is providing services for the commercial market through inmate
			 labor on October 1, 2007, may continue to provide such commercial services
			 until—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF548586610654915BB63CA276C8C3676"><enum>(1)</enum><text display-inline="yes-display-inline">the expiration date specified in the
			 contract or other agreement with a commercial partner on October 1, 2007;
			 or</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID165F4DF12C044DD9B3E9E20857BDD6DF"><enum>(2)</enum><text display-inline="yes-display-inline">until September 30, 2011, if the prison
			 work program is directly furnishing the services to the commercial
			 market.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDEFB53B336AB44E87AE639A90AAD3EFE3"><enum>(c)</enum><header display-inline="yes-display-inline">Approval Required for Long-Term
			 Operation</header><text display-inline="yes-display-inline">A prison work
			 program operated by a correctional institution operated by a State or local
			 jurisdiction of a State may continue to provide inmate labor to furnish
			 services for sale in the commercial market after the dates specified in
			 subsection (b) if such program has been certified pursuant to section
			 1761(c)(1) of title 18, United States Code, and is in compliance with the
			 requirements of such subsection and its implementing regulations.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID77F54AC183B8496BB0B57F790287D5B6"><enum>(d)</enum><header display-inline="yes-display-inline">Existing Work Opportunities for Federal
			 Inmates</header><text display-inline="yes-display-inline">Any private
			 for-profit business entity having an agreement with Federal Prison Industries
			 in effect on the date of the enactment of this Act, under which Federal inmates
			 are furnishing services that are being introduced into the commercial market,
			 may continue to furnish such services for the duration of the term of such
			 agreement.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID1E8C98A9DBAB401CAD0F65B486F7EDA1"><enum>(e)</enum><header display-inline="yes-display-inline">Additional Amendment</header><text display-inline="yes-display-inline">Section 1761 of title 18, United States
			 Code, is further amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="ID65BF7F57FC7949AF80A4ECFB642FDB8D"><enum>(1)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (e); and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID8BFCC107A9184143921B4FF51991D941"><enum>(2)</enum><text display-inline="yes-display-inline">by inserting after subsection (c) the
			 following new subsection:</text>
					<quoted-block display-inline="no-display-inline" id="IDF5C9F61B2E3746FC8DBABF38E8CE5ECB" style="OLC">
						<subsection commented="no" display-inline="no-display-inline" id="IDDACDE3401008464DBD8A34CE7F245101"><enum>(d)</enum><text display-inline="yes-display-inline">This section shall not apply to services
				performed as part of an inmate work program conducted by a State or local
				government to disassemble, scrap, and recycle products, other than electronic
				products, that would otherwise be disposed of in a landfill. Recovered scrap
				from such program may be
				sold.</text>
						</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID1AA439D855E14594B8DE64A78C5F567D"><enum>(f)</enum><header display-inline="yes-display-inline">Conforming Amendment</header><text display-inline="yes-display-inline">Section 4122(a) of title 18, United States
			 Code, is amended by striking <quote>production of commodities</quote> and
			 inserting <quote>production of products or furnishing of
			 services</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID4BC8A7F497D24AF09817718AAF8E7DA7" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Effective date</header>
			<subsection commented="no" display-inline="no-display-inline" id="idD70360D6AAAF47DE9905003AA79B7219"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), this
			 Act and the amendments made by this Act shall take effect 180 days after the
			 date of the enactment of this Act.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id03E775C7932046A6880E82F027F7007C"><enum>(b)</enum><header display-inline="yes-display-inline">Exception</header><text display-inline="yes-display-inline">Subsections (b), (c), and (d) of section 3
			 shall take effect on the date of the enactment of this Act.</text>
