		<legis-type display="yes">A BILL</legis-type>
		<official-title display="yes">To amend title 10, United States Code, to
		  repeal the statutory designation of beneficiaries of the $100,000 death
		  gratuity under section 1477 of title 10, United States Code, and to permit
		  members of the Armed Forces to designate in writing their beneficiaries of
		  choice in the event of their death while serving on active
		  duty.</official-title>

	<legis-body display-enacting-clause="yes-display-enacting-clause" style="OLC">
		<section commented="no" display-inline="no-display-inline" id="idB1CCCF5D85E74245982A13058B80EB33" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Modification of scheme for payment of death
			 gratuity payable with respect to members of the Armed Forces</header>
			<subsection commented="no" display-inline="no-display-inline" id="idAF87C52C253B40C59967548404CA7F00"><enum>(a)</enum><header display-inline="yes-display-inline">Findings</header><text display-inline="yes-display-inline">Congress makes the following
			 findings:</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDba06ea6bb8dd4074a0f33542b41fb27a"><enum>(1)</enum><text display-inline="yes-display-inline">The death gratuity authorized under
			 sections 1475 to 1480 of title 10, United States Code, was intended, when
			 originally enacted to provide an immediate cash payment to assist survivors of
			 deceased members of the Armed Forces to meet their financial needs during the
			 period immediately following a member's death and before other survivor
			 benefits become available.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDf7b7e757e1b74a3fafa0683fb0b53e7d"><enum>(2)</enum><text display-inline="yes-display-inline">The death gratuity, when first implemented
			 in 1908, amounted to six months of a service member's pay and, until 1991,
			 could not exceed $3,000.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id23191E3A4E49436C95177BA84FF0190D"><enum>(3)</enum><text display-inline="yes-display-inline">However, following the attacks of September
			 11, 2001, and the initiation of Operation Enduring Freedom and Operation Iraqi
			 Freedom, Congress determined that the death benefits available to survivors of
			 members of the Armed Forces should be substantially increased.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID31b20c65fe984d7f861e36f3ada04458"><enum>(4)</enum><text display-inline="yes-display-inline">The National Defense Authorization Act for
			 Fiscal Year 2006, which was enacted on January 6, 2006, as Public Law 109–163,
			 increased the amount of the death gratuity to $100,000, effective retroactively
			 to October 7, 2001.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID764262cbef6d4a3282413d663953c056"><enum>(5)</enum><text display-inline="yes-display-inline">Under section 1477 of title 10, United
			 States Code, the law authorizing the death gratuity, those living relatives of
			 deceased members of the Armed Forces who shall receive the death gratuity are
			 specifically designated. Service members are not provided with the opportunity
			 to make an election choosing a beneficiary other than those set forth in
			 section 1477 of title 10, United States Code.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDa00815b43f19401cafd9bce4f7a43015"><enum>(6)</enum><text display-inline="yes-display-inline">The increased death gratuity, in
			 combination with benefits available under the Servicemembers' Group Life
			 Insurance program, the Survivor Benefit Plan, and Dependency and Indemnity
			 Compensation provide significant support and compensation to the next of kin of
			 deceased members of the Armed Forces. Individual members are best qualified to
			 determine who the beneficiaries for death benefits should be and should be
			 afforded the opportunity to make these selections at appropriate times
			 throughout military service and particularly prior to mobilization or
			 deployment to a combat zone.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID26292258cd404377aff3ad744b377538"><enum>(7)</enum><text display-inline="yes-display-inline">Under the current system, many members of
			 the Armed Forces have designated individuals as beneficiaries for the death
			 gratuity in a manner not provided for by law. In these cases, the wishes of
			 these members regarding the disposition of the death gratuity has in many cases
			 not been implemented, to the detriment of their children and other loved
			 ones.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID7e1bbbefc2e84da6a5b6d36acddb3c4a"><enum>(b)</enum><header display-inline="yes-display-inline">Sense of congress</header><text display-inline="yes-display-inline">It is the sense of Congress that all
			 members of the Armed Forces should be given the opportunity to affirmatively
			 select who shall receive the death gratuity and that the Secretary of Defense
			 and the Secretaries of the military departments should take prompt action to
			 afford members the opportunity to make an election in writing about the
			 disposition of the death gratuity proceeds and to provide appropriate and
			 timely counseling about the manner in which the proceeds of the death gratuity
			 and other forms of insurance will be administered.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id3A99379400724396A0A6C10FAAA5E5D8"><enum>(c)</enum><header display-inline="yes-display-inline">Modification</header>
				<paragraph commented="no" display-inline="no-display-inline" id="idA8245DED868248D6A0399D862A40A632"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Subsection (a) of section 1477 of title 10,
			 United States Code, is amended by striking all that follows <quote>on the
			 following list:</quote> and inserting the following:</text>
					<quoted-block display-inline="no-display-inline" id="idC47D4772AEB64902826DCD77F4CDBC65" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idBB0B7F82C23E488CB9B5860BFA7956EB"><enum>(1)</enum><text display-inline="yes-display-inline">To any individual designated by the person
				in writing.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id12127B7B371842D6A103784E96DCC7F4"><enum>(2)</enum><text display-inline="yes-display-inline">If there is no person so designated, to the
				surviving spouse of the person.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB7DE53EB64994B1BAA5329E4964BEC96"><enum>(3)</enum><text display-inline="yes-display-inline">If there is none of the above, to the
				children (as prescribed by subsection (b)) of the person and the descendants of
				any deceased children by representation.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id66209CDAA61040A5890FEB13243315C4"><enum>(4)</enum><text display-inline="yes-display-inline">If there is none of the above, to the
				parents (as prescribed by subsection (c)) of the person or the survivor of
				them.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0A74936688324456800B65D254C1C8EF"><enum>(5)</enum><text display-inline="yes-display-inline">If there is none of the above, to the duly
				appointed executor or administrator of the estate of the person.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id7B331EBA6D584B2DA7A418388AA8FE7F"><enum>(6)</enum><text display-inline="yes-display-inline">If there is none of the above, to other
				next of kin of the person entitled under the laws of domicile of the person at
				the time of the person's
				death.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id75E55826501344E692EA534329670A13"><enum>(2)</enum><header display-inline="yes-display-inline">Conforming amendments</header><text display-inline="yes-display-inline">Such section is further amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id8C7407DEF6A640DA97D5FA685396739D"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (b), by striking
			 <quote>Subsection (a)(2)</quote> in the matter preceding paragraph (1) and
			 inserting <quote>Subsection (a)(3)</quote>;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id86A0F052610D4679A0864F7FFE82AE0F"><enum>(B)</enum><text display-inline="yes-display-inline">by striking (c) and inserting the following
			 new subsection (c):</text>
						<quoted-block display-inline="no-display-inline" id="id32A80DD238C3498CBD2D2D0455CF3AD2" style="OLC">
							<subsection commented="no" display-inline="no-display-inline" id="idFD499418FADF42C1905CEC6DC9196214"><enum>(c)</enum><text display-inline="yes-display-inline">For purposes of subsection (a)(4), parents
				include fathers and mothers through adoption. However, only one father and one
				mother may be recognized in any case, and preference shall be given to those
				who exercised a parental relationship on the date, or most nearly before the
				date, on which the decedent entered a status described in section 1475 or 1476
				of this title.</text>
							</subsection><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id8DCD879A3F7247D781CD4A75B62B625F"><enum>(C)</enum><text display-inline="yes-display-inline">by striking subsection (d).</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id08FD81B1838140D09A8078B88E23031B"><enum>(3)</enum><header display-inline="yes-display-inline">Effective
			 date</header><text display-inline="yes-display-inline">The amendments made by
			 this subsection shall take effect on the date of the enactment of this
			 Act.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id57604128DAD048E685D069538490BE1A"><enum>(4)</enum><header display-inline="yes-display-inline">Applicability</header><text display-inline="yes-display-inline">Notwithstanding paragraph (3), the
			 provisions of section 1477 of title 10, United States Code, as in effect on the
			 day before the date of the enactment of this Act, shall continue to apply to
			 each member of the Armed Forces covered by such section until the earlier of
			 the following—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idC2341CA088AC4A929E222FAC6CCE8CC1"><enum>(A)</enum><text display-inline="yes-display-inline">the date on which such member makes the
			 designation contemplated by paragraph (1) of section 1477(a) of such title (as
			 amended by paragraph (1) of this subsection); or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id7AAD6ED34F794866B0B8B55A015220AF"><enum>(B)</enum><text display-inline="yes-display-inline">January 1, 2008.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id12AA2440AAA44249A02FFE73C5AAD9D0"><enum>(d)</enum><header display-inline="yes-display-inline">Regulations</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id93E2794A1E1941B5A2CEE9E47DC1F8EF"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than April 1, 2007, the Secretary
			 of Defense shall prescribe regulations to implement the amendments to section
			 1477 of title 10, United States Code, made by subsection (c).</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6DD73320767646519B2531DF420824C6"><enum>(2)</enum><header display-inline="yes-display-inline">Elements</header><text display-inline="yes-display-inline">The regulations required by paragraph (1)
			 shall include forms for the making of the designation contemplated by paragraph
			 (1) of section 1477(a) of title 10, United States Code (as amended by
			 subsection (c)), and instructions for members of the Armed Forces in the
			 filling out of such forms.</text>
				</paragraph></subsection></section></legis-body>
