		<official-title display="yes">To expand visa waiver program to countries
		  on a probationary basis and for other purposes.</official-title>

		<section commented="no" display-inline="no-display-inline" id="S1" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Secure Travel and Counterterrorism
			 Partnership Act</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id48018BE4BE0E49F7BC2F0E7B89E83E5B" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Sense of Congress</header><text display-inline="no-display-inline">It is the sense of Congress that—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id4D11B06F475645BF9C30F20C9CAA9D05"><enum>(1)</enum><text display-inline="yes-display-inline">the United States should modernize the visa
			 waiver program by simultaneously—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id3335789F8C7E4E0CBAF364B9E1937CF0"><enum>(A)</enum><text display-inline="yes-display-inline">enhancing program security requirements;
			 and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idC2F041DAD2D84F73ABD54A44ADD3E36E"><enum>(B)</enum><text display-inline="yes-display-inline">extending visa-free travel privileges to
			 nationals of foreign countries that are allies in the war on terrorism;
			 and</text>
				</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id6F9C58292F4440B69C6B7BAEDEDD5765"><enum>(2)</enum><text display-inline="yes-display-inline">the expansion described in paragraph (1)
			 will—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="id73E4E960F50449A6AE537F22933C4D52"><enum>(A)</enum><text display-inline="yes-display-inline">enhance bilateral cooperation on critical
			 counterterrorism and information sharing initiatives;</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAD43EFF122484955A97606F869784012"><enum>(B)</enum><text display-inline="yes-display-inline">support and expand tourism and business
			 opportunities to enhance long-term economic competitiveness; and</text>
				</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idF237096DB13F4FD99EA7A8F2ABF4430C"><enum>(C)</enum><text display-inline="yes-display-inline">strengthen bilateral relationships.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="IDc04e1037a2c44824a3f9734502029031" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Discretionary visa waiver program
			 expansion</header><text display-inline="no-display-inline">Section 217(c) of
			 the Immigration and Nationality Act (8 U.S.C. 1187(c)) is amended by adding at
			 the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idF1DE2385CD334CB4A36DEAEA5C3337B6" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="IDa8921db91b3f4bf597c20845f3c79994"><enum>(8)</enum><header display-inline="yes-display-inline">Nonimmigrant visa refusal rate
				flexibility</header><text display-inline="yes-display-inline">The Secretary of
				Homeland Security, in consultation with the Secretary of State, may waive the
				application of paragraph (2)(A) for a country if—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDc6e9a05f133b45668cfdfc5eb8aab4c4"><enum>(A)</enum><text display-inline="yes-display-inline">the country meets all existing security
				requirements and enhanced security requirements described in section 4 of the
				<short-title>Secure Travel and Counterterrorism
				Partnership Act</short-title>;</text>
					</subparagraph><subparagraph id="ID6cd29e412179481fb07f1fac7eb43fef"><enum>(B)</enum><text>the Secretary of
				Homeland Security determines that the totality of the country’s security risk
				mitigation measures provide assurance that the country’s participation in the
				program would not compromise the law enforcement, security interests, or
				enforcement of the immigration laws of the United States;</text>
					</subparagraph><subparagraph id="ID15f85d3c33c547b58ecdbd997b825d29"><enum>(C)</enum><text>there has been a
				sustained reduction in visa refusal rates for aliens from the country and
				conditions exist to continue such reduction; and</text>
					</subparagraph><subparagraph id="ID5f19a30e95c9409e84594c026e672bbb"><enum>(D)</enum><text>the country
				cooperated with the Government of the United States on counterterrorism
				initiatives and information sharing before the date of its designation as a
				program country, and the Secretary of Homeland Security and the Secretary of
				State expect such cooperation will continue.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDebe94e90cb2745a8a749d3985208dae5"><enum>(9)</enum><header display-inline="yes-display-inline">Discretionary security-related
				considerations</header>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID545c233270a64304a62740ce56628e58"><enum>(A)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">In determining whether to waive the
				application of paragraph (2)(A) for a country, pursuant to paragraph (8), the
				Secretary of Homeland Security, in consultation with the Secretary of State,
				may take into consideration other factors affecting the security of the United
				States, including—</text>
						<clause commented="no" display-inline="no-display-inline" id="id743A90FFC61A444DB7A9EF485BB63A18"><enum>(i)</enum><text display-inline="yes-display-inline">airport security standards in the
				country;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id61BAD455C49E450C9E5C052A537A480A"><enum>(ii)</enum><text display-inline="yes-display-inline">whether the country assists in the
				operation of an effective air marshal program;</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id14B28B2B1E324103B5C018149EC5227D"><enum>(iii)</enum><text display-inline="yes-display-inline">the standards of passports and travel
				documents issued by the country; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id67400150CA6244508B4D94C1FC1CAA1E"><enum>(iv)</enum><text display-inline="yes-display-inline">other security-related factors.</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID8f6359c7f9dd4d63817f3f07b45226ec"><enum>(B)</enum><header display-inline="yes-display-inline">Overstay
				rates</header><text display-inline="yes-display-inline">In determining whether
				to permit a country to participate in the program, the Secretary of Homeland
				Security may consider the estimated rate at which nationals of the country
				violate the terms of their visas by remaining in the United States after the
				expiration of such
				visas.</text>
					</subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="IDba0fdf0a65d84143991266f69bb4747c"><enum>4.</enum><header>Security
			 enhancements to the visa waiver program</header>
			<subsection id="id05B775BCD6EE4E6690A4D742C4D3E51E"><enum>(a)</enum><header>In
			 general</header><text display-inline="yes-display-inline">Section 217 of the
			 Immigration and Nationality Act (8 U.S.C. 1187) is amended—</text>
				<paragraph id="ID995297b40392414584e0db5b22fe4046"><enum>(1)</enum><text>in subsection
			 (a)—</text>
					<subparagraph id="id0E9F0DDA9A14401E92BD6302601A7950"><enum>(A)</enum><text>by striking
			 <quote>Operators of aircraft</quote> and inserting the following:</text>
						<quoted-block display-inline="no-display-inline" id="id12C004B70A80467C8F7FCD9221B64FE9" style="OLC">
							<paragraph id="id49D98DBCE8524C5490626DA5A7759CE1"><enum>(10)</enum><header>Electronic
				transmission of identification information</header><text>Operators of
				aircraft</text>
							</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
					</subparagraph><subparagraph id="idAE8F965F3C7045A695E2B47619D04F38"><enum>(B)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id9A3E5376042F4032841E99E7A8F91857" style="OLC">
							<paragraph id="ID59c56488df3a4304b27914b1785c5736"><enum>(11)</enum><header>Eligibility
				determination under the electronic travel authorization
				system</header><text>Beginning on the date on which the electronic travel
				authorization system developed under subsection (h)(3) is fully operational,
				each alien traveling under the program shall, before applying for admission,
				electronically provide basic biographical information to the system. Upon
				review of such biographical information, the Secretary of Homeland Security
				shall determine whether the alien is eligible to travel to the United States
				under the
				program.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID714cbb3181564e62ac647cc7e5f69525"><enum>(2)</enum><text>in subsection
			 (c), as amended by section 3 of this Act—</text>
					<subparagraph id="id32815517727E41CA96134FC65CDB1409"><enum>(A)</enum><text>in paragraph
			 (2)—</text>
						<clause id="ID18cd1cc79a34404ab75afc8b3d6b10b3"><enum>(i)</enum><text>by
			 amending subparagraph (D) to read as follows:</text>
							<quoted-block display-inline="no-display-inline" id="id8A518A4BB5674F40A943221EDCA83B34" style="OLC">
								<subparagraph id="IDda97f43945c1462fa1835bf306d83e53"><enum>(D)</enum><header>Reporting lost
				and stolen passports</header><text>The government of the country enters into an
				agreement with the United States to report, or make available through Interpol,
				to the United States Government information about the theft or loss of
				passports within a strict time limit and in a manner specified in the
				agreement.</text>
								</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
						</clause><clause id="ID3476998058c341ef9095b01077d91f6d"><enum>(ii)</enum><text>by
			 adding at the end the following:</text>
							<quoted-block display-inline="no-display-inline" id="idD3943E470F404149ABDB6B560EFB1E80" style="OLC">
								<subparagraph id="IDd1e3973511cf45498a96d2faebb57dd5"><enum>(E)</enum><header>Repatriation of
				aliens</header><text>The government of the country accepts for repatriation any
				citizen, former citizen, or national against whom a final executable order of
				removal is issued not later than 3 weeks after the issuance of the final order
				of removal. Nothing in this subparagraph creates any duty for the United States
				or any right for any alien with respect to removal or release. Nothing in this
				subparagraph gives rise to any cause of action or claim under this paragraph or
				any other law against any official of the United States or of any State to
				compel the release, removal, or consideration for release or removal of any
				alien.</text>
								</subparagraph><subparagraph id="idD18615C313B24D39870383DC8B3CC7AB"><enum>(F)</enum><header>Passenger
				information exchange</header><text>The government of the country enters into an
				agreement with the United States to share information regarding whether
				nationals of that country traveling to the United States represent a threat to
				the security or welfare of the United States or its
				citizens.</text>
								</subparagraph><after-quoted-block>;</after-quoted-block></quoted-block>
						</clause></subparagraph><subparagraph id="id0F6EF6079A354E25AD93B7F819D6B82D"><enum>(B)</enum><text>in paragraph
			 (5)—</text>
						<clause id="id9D3435B0DE4D47ECA7D9319F4E131D65"><enum>(i)</enum><text>by
			 striking <quote>Attorney General</quote> each place it appears and inserting
			 <quote>Secretary of Homeland Security</quote>; and</text>
						</clause><clause id="idB5C1B0C9AEE444898902FC81B238F1C9"><enum>(ii)</enum><text>in
			 subparagraph (A)(i)—</text>
							<subclause id="id8D0247FD32024EC28A01897E38EC5E19"><enum>(I)</enum><text>in subclause
			 (II), by striking <quote>and</quote> at the end;</text>
							</subclause><subclause id="id2EF460A70E0A46EDBE0E9B38B8935C72"><enum>(II)</enum><text>in subclause
			 (III), by striking the period at the end and inserting <quote>; and</quote>;
			 and</text>
							</subclause><subclause id="id92C43738E8964F7A9FFD6F68467591A1"><enum>(III)</enum><text>by adding at
			 the end the following:</text>
								<quoted-block display-inline="no-display-inline" id="idF21D907E86724AAAABA769C21F1F049C" style="OLC">
									<subclause id="id280FDACE53554725BE7D93C57C508FFE"><enum>(IV)</enum><text>shall submit to
				Congress a report regarding the implementation of the electronic travel
				authorization system under subsection (h)(3) and the participation of new
				countries in the program through a waiver under paragraph
				(8).</text>
									</subclause><after-quoted-block>;
				and</after-quoted-block></quoted-block>
							</subclause></clause></subparagraph><subparagraph id="id6327C2E182D848E39D50190A56CED142"><enum>(C)</enum><text>by adding at the
			 end the following:</text>
						<quoted-block display-inline="no-display-inline" id="id7084465CB2D5474688BF0AECDA5685B6" style="OLC">
							<paragraph id="id31A5EB7CF0A54D398134C51D7DED15C6"><enum>(10)</enum><header>Technical
				assistance</header><text>The Secretary of Homeland Security, in consultation
				with the Secretary of State, shall provide technical assistance to program
				countries to assist those countries in meeting the requirements under this
				section.</text>
							</paragraph><after-quoted-block>;</after-quoted-block></quoted-block>
					</subparagraph></paragraph><paragraph id="ID1ef6a1d229334c2484b5691253d5599e"><enum>(3)</enum><text>in subsection
			 (f)(5), by striking <quote>of blank</quote> and inserting <quote>or loss
			 of</quote>; and</text>
				</paragraph><paragraph id="idD40D5858AFE64683A8CA3CB6487ADAD6"><enum>(4)</enum><text>in subsection
			 (h), by adding at the end the following:</text>
					<quoted-block display-inline="no-display-inline" id="idEE5C151A3A2040B09DCF3BDC06A25A61" style="OLC">
						<paragraph id="ID5238598a74954f5ca34db49afaa3d98f"><enum>(3)</enum><header>Electronic
				travel authorization system</header>
							<subparagraph id="ID3f82ae55d0b6432f89559d8bf5358a0b"><enum>(A)</enum><header>System</header><text>The
				Secretary of Homeland Security, in consultation with the Secretary of State, is
				authorized to develop and implement a fully automated electronic travel
				authorization system (referred to in this paragraph as the
				<quote>System</quote>) to collect such basic biographical information as the
				Secretary of Homeland Security determines to be necessary to determine, in
				advance of travel, the eligibility of an alien to travel to the United States
				under the program.</text>
							</subparagraph><subparagraph id="IDbfb87307cfca4674a3b9188e92691b3d"><enum>(B)</enum><header>Fees</header><text>The
				Secretary of Homeland Security may charge a fee for the use of the System,
				which shall be—</text>
								<clause id="ID426b9ddbbb0e4bba81106ef84e0a4f9c"><enum>(i)</enum><text>set at a level
				that will ensure recovery of the full costs of providing and administering the
				System; and</text>
								</clause><clause id="ID53e13b6d6af44bcc90d2bb1185b17ca2"><enum>(ii)</enum><text>available to pay
				the costs incurred to administer the System.</text>
								</clause></subparagraph><subparagraph id="IDcc3025bd6567478dbbdc9460eb0ed59f"><enum>(C)</enum><header>Validity</header>
								<clause id="IDd772c4eb7ecb4f968f04f835b048c3a3"><enum>(i)</enum><header>Period</header><text>The
				Secretary of Homeland Security, in consultation with the Secretary of State
				shall prescribe regulations that provide for a period, not to exceed 3 years,
				during which a determination of eligibility to travel under the program will be
				valid. Notwithstanding any other provision under this section, the Secretary of
				Homeland Security may revoke any such determination at any time and for any
				reason.</text>
								</clause><clause id="ID78d235bdb411495b9e3a9d71fcbfd43a"><enum>(ii)</enum><header>Limitation</header><text>A
				determination that an alien is eligible to travel to the United States under
				the program is not a determination that the alien is admissible to the United
				States.</text>
								</clause><clause id="ID7ec8538781e744bd9c4cfb19c90a339e"><enum>(iii)</enum><header>Judicial
				review</header><text>Notwithstanding any other provision of law, no court shall
				have jurisdiction to review an eligibility determination under the
				System.</text>
								</clause></subparagraph><subparagraph id="ID1cb27ee2c29f4203acbe39e775a5b2ce"><enum>(D)</enum><header>Report</header><text>Not
				later than 60 days before publishing notice regarding the implementation of the
				System in the Federal Register, the Secretary of Homeland Security shall submit
				a report regarding the implementation of the System to—</text>
								<clause id="id5FB00AB2AFD44F54A1A0DB4B6CDF3523"><enum>(i)</enum><text>the Committee on
				Homeland Security and Governmental Affairs of the Senate;</text>
								</clause><clause id="id6B4C3F535F0F455593D30B1F7A45170A"><enum>(ii)</enum><text>the Committee on
				the Judiciary of the Senate;</text>
								</clause><clause id="id9FAB5E055A194640A3834C8C11100D9C"><enum>(iii)</enum><text>the Select
				Committee on Intelligence of the Senate;</text>
								</clause><clause id="idA3C37DDE14774B638386DC6D386E813F"><enum>(iv)</enum><text>the Committee on
				Appropriations of the Senate;</text>
								</clause><clause id="id8BE03B25F7824CE3BBA5AD9B8DD5BD76"><enum>(v)</enum><text>the Committee on
				Homeland Security of the House of Representatives;</text>
								</clause><clause id="id984B9EB05626447EA4CB7713BD7F32A3"><enum>(vi)</enum><text>the Committee on
				the Judiciary of the House of Representatives;</text>
								</clause><clause id="id127263AACF344675944F01BCFE21AD9F"><enum>(vii)</enum><text>the Permanent
				Select Committee on Intelligence of the House of Representatives; and</text>
								</clause><clause id="idF223934013FC44319D2F9C6899E60241"><enum>(viii)</enum><text>the Committee
				on Appropriations of the House of
				Representatives.</text>
								</clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection id="id621E2686953D476EBDA290B0E34E1732"><enum>(b)</enum><header>Effective
			 date</header><text>Section 217(a)(11) of the Immigration and Nationality Act,
			 as added by subsection (a)(1)(B) shall take effect on the date which is 60 days
			 after the date on which the Secretary of Homeland Security publishes notice in
			 the Federal Register of the requirement of such paragraph.</text>
			</subsection></section><section id="id114C17B000444B7DA80FE4ED6D62DFE8"><enum>5.</enum><header>Exit
			 system</header>
			<subsection id="ID8bdf98b7e05649f69811e062db71311d"><enum>(a)</enum><header>In
			 general</header><text>Not later than 1 year after the date of the enactment of
			 this Act, the Secretary of Homeland Security shall establish an exit system
			 that records the departure on a flight leaving the United States of every alien
			 participating in the visa waiver program established under section 217 of the
			 Immigration and Nationality Act (8 U.S.C. 1187).</text>
			</subsection><subsection id="id072A528FC02A4330B8ADCC7247AB47D6"><enum>(b)</enum><header>System
			 requirements</header><text>The system established under subsection (a)
			 shall—</text>
				<paragraph id="ID6e7731c550a9466dbb6a64753cbd968f"><enum>(1)</enum><text>match biometric
			 information of the alien against relevant watch lists and immigration
			 information; and</text>
				</paragraph><paragraph id="id24CEC5764F0248A19E5DDC01799DF4A1"><enum>(2)</enum><text>compare such
			 biometric information against manifest information collected by air carriers on
			 passengers departing the United States to confirm such individuals have
			 departed the United States.</text>
				</paragraph></subsection><subsection id="IDf4b92c2d91f74d348b8b541100022258"><enum>(c)</enum><header>Report</header><text>Not
			 later than 180 days after the date of the enactment of this Act, the Secretary
			 shall submit a report to Congress that describes—</text>
				<paragraph id="idE07198B6AA804CAFBB17A349EEAC34F7"><enum>(1)</enum><text>the progress made
			 in developing and deploying the exit system established under this section;
			 and</text>
				</paragraph><paragraph id="idD52FE6EE75464DB7ADF46A0B153D0E34"><enum>(2)</enum><text>the procedures by
			 which the Secretary will improve the manner of calculating the rates of
			 nonimmigrants who violate the terms of their visas by remaining in the United
			 States after the expiration of such visas.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="id3E3EB4FCC216467E8C4AD364409B1F92" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Authorization of
			 appropriations</header><text display-inline="no-display-inline">There are
			 authorized to be appropriated such sums as may be necessary to carry out this
			 Act, and the amendments made by this Act.</text>
