		<official-title display="yes">To require the Nuclear Regulatory
		  Commission to conduct an independent safety assessment of the Indian Point
		  Nuclear Power Plant.</official-title>

		<section commented="no" display-inline="no-display-inline" id="H3E0C678EFA8744A6B5EAF21B7EB130F6" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Independent safety assessment</header><text display-inline="no-display-inline">Not later than 180 days after the date of
			 enactment of this Act, the Nuclear Regulatory Commission shall submit to
			 Congress a report containing the results of—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H85C3C5093EFB452480C232F0F6ED4315"><enum>(1)</enum><text display-inline="yes-display-inline">a focused, in-depth independent safety
			 assessment of the design, construction, maintenance, and operational safety
			 performance of the systems at the Indian Point Nuclear Power Plant, Reactors 2
			 and 3, located in Westchester County, New York, including the systems described
			 in section 2; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H820FA9D44FA24330AAB030162339845C"><enum>(2)</enum><text display-inline="yes-display-inline">a comprehensive evaluation of the
			 radiological emergency plan for the Indian Point Nuclear Power Plant, Reactors
			 2 and 3, conducted by the Nuclear Regulatory Commission and the Department of
			 Homeland Security, which shall include—</text>
				<subparagraph commented="no" display-inline="no-display-inline" id="H98FE51F50DE548AD86DA15CDBEE1AF55"><enum>(A)</enum><text display-inline="yes-display-inline">a detailed explanation of the factual basis
			 on which the Nuclear Regulatory Commission and the Federal Emergency Management
			 Agency relied (during the period beginning on July 25, 2003, and ending on the
			 date of enactment of this Act) in—</text>
					<clause commented="no" display-inline="no-display-inline" id="HA22CB73095304B5E9FDC8B27BDA2D0D6"><enum>(i)</enum><text display-inline="yes-display-inline">approving the radiological emergency plan;
			 and</text>
					</clause><clause commented="no" display-inline="no-display-inline" id="HFB2EBCE7AEE84375B4A8B4E4F66087E9"><enum>(ii)</enum><text display-inline="yes-display-inline">making subsequent annual findings of
			 reasonable assurance that the plan would adequately protect the public in the
			 event of an emergency; and</text>
					</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="H8290217795AD453DBDA67BFEA0F35417"><enum>(B)</enum><text display-inline="yes-display-inline">a detailed response to each of the
			 criticisms of the radiological emergency plan contained in the Review of
			 Emergency Preparedness of Areas Adjacent to Indian Point and Millstone,
			 published by James Lee Witt Associates on January 10, 2003.</text>
				</subparagraph></paragraph></section><section commented="no" display-inline="no-display-inline" id="HCEC67E6BB4634276BA844546919DD2D4" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Systems</header><text display-inline="no-display-inline">The systems referred to in section 1(1)
			 are—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="H4F7EBB837C9B4C5EB5D8337020A05E35"><enum>(1)</enum><text display-inline="yes-display-inline">the reactor protection system;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H00C992F5E1D94E17A9367875A3D2DF3B"><enum>(2)</enum><text display-inline="yes-display-inline">the control room ventilation system and the
			 containment ventilation system;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H6CA22A0D437A4F2CB536D189F25E21BA"><enum>(3)</enum><text display-inline="yes-display-inline">the 4.16 kV electrical system;</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H68821E1AF5C94DBF9B230433DA280493"><enum>(4)</enum><text display-inline="yes-display-inline">the condensate system; and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="H09F86111AFF74AC4853DD465C77D23AB"><enum>(5)</enum><text display-inline="yes-display-inline">the spent fuel storage system.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="HE6E27ABE04FB47C0863DA47C77D38500" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Independent safety assessment
			 model</header><text display-inline="no-display-inline">The independent safety
			 assessment conducted at the Indian Point Nuclear Power Plant under this Act
			 shall be equal in depth and breadth to the independent safety assessment of the
			 Maine Yankee Nuclear Power Plant, located near Bath, Maine, conducted by the
			 Nuclear Regulatory Commission during 1996.</text>
