		<official-title>To amend the Public Health Service Act to establish grant
		  programs to provide for education and outreach on newborn screening and
		  coordinated followup care once newborn screening has been conducted, to
		  reauthorize programs under part A of title XI of such Act, and for other
		  purposes.</official-title>

		<section id="S1" section-type="section-one"><enum>1.</enum><header>Short
			 title</header><text display-inline="no-display-inline">This Act may be cited as
			 the <quote><short-title>Newborn Screening Saves Lives Act
			 of 2007</short-title></quote>.</text>
		</section><section id="IDB582F0EE4C394D50B59BA47E2F15CB98"><enum>2.</enum><header>Findings</header><text display-inline="no-display-inline">Congress finds the following:</text>
			<paragraph id="ID72fb1709026844818067a637843af5ee"><enum>(1)</enum><text>Each year more
			 than 4,000,000 babies born in the United States are screened by State and
			 private laboratories to detect some conditions that may threaten their
			 long-term health.</text>
			</paragraph><paragraph id="IDd8e3709c1c5c44058cfe24c545606591"><enum>(2)</enum><text>However, there is
			 a lack of uniformity in the number of conditions for which newborns are
			 screened throughout the United States. While a newborn may be screened and
			 treated for a debilitating condition in one State, in another State, the
			 condition may go undetected and result in permanent disability or even
			 death.</text>
			</paragraph><paragraph id="IDa51cf104009942e9b39476b56ff4ca8c"><enum>(3)</enum><text>Approximately
			 4,000 infants born each year are diagnosed with these detectable and treatable
			 disorders. If diagnosed early, these conditions can be successfully managed or
			 treated to prevent severe and often lifelong health consequences.</text>
			</paragraph><paragraph id="IDe0fb5cd564594a63ac73ea8cbf6dc406"><enum>(4)</enum><text>In 2004, the
			 American College of Medical Genetics (ACMG) completed a report commissioned by
			 the Department of Health and Human Services which recommended that every baby
			 born in the United States be screened for 29 specific disorders, including
			 certain metabolic conditions and hearing deficiencies.</text>
			</paragraph><paragraph id="ID36b927ea4c6e4832927d3f72eb6627fd"><enum>(5)</enum><text>Currently only 11
			 States and the District of Columbia require infants to be screened for all 29
			 of these recommended disorders.</text>
			</paragraph><paragraph id="ID70d10c34ba094cd58f23ea270341c963"><enum>(6)</enum><text>Continuity,
			 especially during a public health emergency, plays a critical role in the
			 screening, diagnosis, referral, and treatment of these disorders. Currently
			 there is no national contingency plan for maintaining continuity of newborn
			 screening systems following a public health emergency.</text>
			</paragraph></section><section id="ID8DC2DF36F0D4431F882C16B2AA00C1B4"><enum>3.</enum><header>Amendment to
			 title III of the <act-name parsable-cite="PHSA">Public Health Service
			 Act</act-name></header><text display-inline="no-display-inline">Part Q of title
			 III of the <act-name parsable-cite="PHSA">Public Health Service Act</act-name>
			 (<external-xref legal-doc="usc" parsable-cite="usc/42/280h">42 U.S.C.
			 280h</external-xref> et seq.) is amended by adding at the end the
			 following:</text>

				<section id="ID975AF3E572284D01BB7CD8CE327C373C"><enum>399AA.</enum><header>Newborn
				screening</header>
					<subsection id="ID83A1BDB02D724E9EA94FC7946E6719B0"><enum>(a)</enum><header>Authorization
				of grant programs</header>
						<paragraph id="ID015356CFECB84B98A521369C48E2F739"><enum>(1)</enum><header>Grants to
				assist health care professionals</header><text>From funds appropriated under
				subsection (h), the Secretary, acting through the Associate Administrator of
				the Maternal and Child Health Bureau of the Health Resources and Services
				Administration (referred to in this section as the <quote>Associate
				Administrator</quote>) and in consultation with the Advisory Committee on
				Heritable Disorders in Newborns and Children (referred to in this section as
				the <quote>Advisory Committee</quote>), shall award grants to eligible entities
				to enable such entities to assist in providing health care professionals and
				newborn screening laboratory personnel with—</text>
							<subparagraph id="ID77B1720031F349E9B76CC53809F0FE64"><enum>(A)</enum><text>education in
				newborn screening; and</text>
							</subparagraph><subparagraph id="IDC187DE7E720B45AE83EA62D84B00BB74"><enum>(B)</enum><text>training
				in—</text>
								<clause id="ID0F78D224B40944EFA248611C4176143C"><enum>(i)</enum><text>relevant and new
				technologies in newborn screening; and</text>
								</clause><clause id="ID2262D08042A34A96AC30C8DCA5BE1C36"><enum>(ii)</enum><text>congenital,
				genetic, and metabolic disorders.</text>
								</clause></subparagraph></paragraph><paragraph id="IDD2E33218745F48228F18726E00CA5083"><enum>(2)</enum><header>Grants to
				assist families</header>
							<subparagraph id="id307D78A5B6B4460FB4CDF66FAA9DEB3F"><enum>(A)</enum><header>In
				general</header><text>From funds appropriated under subsection (h), the
				Secretary, acting through the Associate Administrator and in consultation with
				the Advisory Committee, shall award grants to eligible entities to enable such
				entities to develop and deliver educational programs about newborn screening to
				parents, families, and patient advocacy and support groups. The educational
				materials accompanying such educational programs shall be provided at
				appropriate literacy levels.</text>
							</subparagraph><subparagraph id="id6DBFEFEFF89D401A822ADC0DD132D735"><enum>(B)</enum><header>Awareness of
				the availability of programs</header><text>To the extent practicable, the
				Secretary shall make relevant health care providers aware of the availability
				of the educational programs supported pursuant to subparagraph (A).</text>
							</subparagraph></paragraph><paragraph id="ID4F7AC43586394138B42E948E1DDAA629"><enum>(3)</enum><header>Grants for
				quality newborn screening followup</header><text>From funds appropriated under
				subsection (h), the Secretary, acting through the Associate Administrator and
				in consultation with the Advisory Committee, shall award grants to eligible
				entities to enable such entities to establish, maintain, and operate a system
				to assess and coordinate treatment relating to congenital, genetic, and
				metabolic disorders.</text>
						</paragraph></subsection><subsection id="ID88BECA0BCDAF4903AEB1E41EF9EF87E5"><enum>(b)</enum><header>Application</header><text>An
				eligible entity that desires to receive a grant under this section shall submit
				an application to the Secretary at such time, in such manner, and accompanied
				by such information as the Secretary may require.</text>
					</subsection><subsection id="ID63911A75451E4D61AE1FAAFEDABB4E00"><enum>(c)</enum><header>Selection of
				grant recipients</header>
						<paragraph id="ID9B899664B9234904922C83ABA7D9EEBD"><enum>(1)</enum><header>In
				general</header><text>Not later than 120 days after receiving an application
				under subsection (b), the Secretary, after considering the approval factors
				under paragraph (2), shall determine whether to award the eligible entity a
				grant under this section.</text>
						</paragraph><paragraph id="IDEBE4EA609D7B4E29AC4319C2C6338989"><enum>(2)</enum><header>Approval
				factors</header>
							<subparagraph id="IDDC4F3BAC302C4E4889956D248F001062"><enum>(A)</enum><header>Requirements
				for approval</header><text>An application submitted under subsection (b) may
				not be approved by the Secretary unless the application contains assurances
				that the eligible entity—</text>
								<clause id="IDAF501DBEBD5B499E82FBD939C992EC16"><enum>(i)</enum><text>will use grant
				funds only for the purposes specified in the approved application and in
				accordance with the requirements of this section; and</text>
								</clause><clause id="IDD9A71A869D4340BCAC011BE72360765E"><enum>(ii)</enum><text>will establish
				such fiscal control and fund accounting procedures as may be necessary to
				assure proper disbursement and accounting of Federal funds paid to the eligible
				entity under the grant.</text>
								</clause></subparagraph><subparagraph id="IDD7F600B9258F42719700C18BD9BCAC8D"><enum>(B)</enum><header>Existing
				programs</header><text>Prior to awarding a grant under this section, the
				Secretary shall—</text>
								<clause id="ID03AAAB53283B4B84B200379237B0AEBE"><enum>(i)</enum><text>conduct an
				assessment of existing educational resources and training programs and
				coordinated systems of followup care with respect to newborn screening;
				and</text>
								</clause><clause id="ID97FB150052DB4DC58E8EB4B0FC954D12"><enum>(ii)</enum><text>take all
				necessary steps to minimize the duplication of the resources and programs
				described in clause (i).</text>
								</clause></subparagraph></paragraph></subsection><subsection id="ID12FBB455010D4A90980021F38BA72891"><enum>(d)</enum><header>Coordination</header><text>The
				Secretary shall take all necessary steps to coordinate programs funded with
				grants received under this section.</text>
					</subsection><subsection id="ID1D19E389DA2F4A6F9C02EBE307C00543"><enum>(e)</enum><header>Use of grant
				funds</header>
						<paragraph id="IDA60FC1D5757746BAA5928B3E1552318C"><enum>(1)</enum><header>Grants to
				assist health care professionals</header><text>An eligible entity that receives
				a grant under subsection (a)(1) may use the grant funds to work with
				appropriate medical schools, nursing schools, schools of public health, schools
				of genetic counseling, internal education programs in State agencies,
				nongovernmental organizations, and professional organizations and societies to
				develop and deliver education and training programs that include—</text>
							<subparagraph id="ID526577AAB7B347A7BCB987B39BE95281"><enum>(A)</enum><text>continuing
				medical education programs for health care professionals and newborn screening
				laboratory personnel in newborn screening;</text>
							</subparagraph><subparagraph id="ID9078183337004F71AD2CA9E5DEB5523D"><enum>(B)</enum><text>education,
				technical assistance, and training on new discoveries in newborn screening and
				the use of any related technology;</text>
							</subparagraph><subparagraph id="IDBF6565774ED4461A9B6EE8622369B0ED"><enum>(C)</enum><text>models to
				evaluate the prevalence of, and assess and communicate the risks of, congenital
				conditions, including the prevalence and risk of some of these conditions based
				on family history;</text>
							</subparagraph><subparagraph id="ID9D1BBA9D192F460A933ED9C0C119B6D9"><enum>(D)</enum><text>models to
				communicate effectively with parents and families about—</text>
								<clause id="IDE2DA048BA3644FC7B40057539D41357B"><enum>(i)</enum><text>the process and
				benefits of newborn screening;</text>
								</clause><clause id="IDE5FCF131274B4D69A54FAB663F2036D5"><enum>(ii)</enum><text>how to use
				information gathered from newborn screening;</text>
								</clause><clause id="ID72254BD165894C45BF18919858BE8434"><enum>(iii)</enum><text>the meaning of
				screening results, including the possibility of false positive findings;</text>
								</clause><clause id="ID02EB459D90FB4DB7BC54818B2E9F47BF"><enum>(iv)</enum><text>the right of
				refusal of newborn screening, if applicable; and</text>
								</clause><clause id="IDBF6A72B5097749919E562FEE2F625446"><enum>(v)</enum><text>the potential
				need for followup care after newborns are screened;</text>
								</clause></subparagraph><subparagraph id="ID237249CDA89642D2A5D50277D159E204"><enum>(E)</enum><text>information and
				resources on coordinated systems of followup care after newborns are
				screened;</text>
							</subparagraph><subparagraph id="ID286D319AF9D94B43B703AA0718497411"><enum>(F)</enum><text>information on
				the disorders for which States require and offer newborn screening and options
				for newborn screening relating to conditions in addition to such
				disorders;</text>
							</subparagraph><subparagraph id="ID0AB02F9D69B14C86AB5BB83B80D30949"><enum>(G)</enum><text>information on
				additional newborn screening that may not be required by the State, but that
				may be available from other sources; and</text>
							</subparagraph><subparagraph id="ID607D18FA32B54DFABF718F1EBA1E042C"><enum>(H)</enum><text>other items to
				carry out the purpose described in subsection (a)(1) as determined appropriate
				by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="ID9F84790918174A3988D7AFA463881E98"><enum>(2)</enum><header>Grants to
				assist families</header><text>An eligible entity that receives a grant under
				subsection (a)(2) may use the grant funds to develop and deliver to parents,
				families, and patient advocacy and support groups, educational programs about
				newborn screening that include information on—</text>
							<subparagraph id="IDFEA0811F1E4F4A0B81571C505E79F2B6"><enum>(A)</enum><text>what newborn
				screening is;</text>
							</subparagraph><subparagraph id="ID7F79D5BC1A5E44E7BEEF74C1D900281C"><enum>(B)</enum><text>how newborn
				screening is performed;</text>
							</subparagraph><subparagraph id="ID58075C15212F4F16B2B4852001C12600"><enum>(C)</enum><text>who performs
				newborn screening;</text>
							</subparagraph><subparagraph id="ID586EEAAF88FF44CD87F5CDB5F7D27718"><enum>(D)</enum><text>where newborn
				screening is performed;</text>
							</subparagraph><subparagraph id="IDB261BB7DE8694BE4A0BB31AC3E6E24DA"><enum>(E)</enum><text>the disorders for
				which the State requires newborns to be screened;</text>
							</subparagraph><subparagraph id="ID1422028BA5B6462D002290E71433E244"><enum>(F)</enum><text>different options
				for newborn screening for disorders other than those included by the State in
				the mandated newborn screening program;</text>
							</subparagraph><subparagraph id="IDF116DF9074D94BFB9DE8E62145003DC2"><enum>(G)</enum><text>the meaning of
				various screening results, including the possibility of false positive and
				false negative findings;</text>
							</subparagraph><subparagraph id="IDB867223A188E46A1A9A254E97B42A15C"><enum>(H)</enum><text>the prevalence
				and risk of newborn disorders, including the increased risk of disorders that
				may stem from family history;</text>
							</subparagraph><subparagraph id="ID8421A68A6226419BBF48ADDCC7003E67"><enum>(I)</enum><text>coordinated
				systems of followup care after newborns are screened; and</text>
							</subparagraph><subparagraph id="ID5A0E1176C5E342A8B06CAD88BC26BCA3"><enum>(J)</enum><text>other items to
				carry out the purpose described in subsection (a)(2) as determined appropriate
				by the Secretary.</text>
							</subparagraph></paragraph><paragraph id="ID80385B8E19844AB3919700B97177319C"><enum>(3)</enum><header>Grants for
				quality newborn screening followup</header><text>An eligible entity that
				receives a grant under subsection (a)(3) shall use the grant funds to—</text>
							<subparagraph id="ID401CF222794149558D5EB59EE2D38CC5"><enum>(A)</enum><text>expand on
				existing procedures and systems, where appropriate and available, for the
				timely reporting of newborn screening results to individuals, families, primary
				care physicians, and subspecialists in congenital, genetic, and metabolic
				disorders;</text>
							</subparagraph><subparagraph id="ID320414C26ABB47A789197FFBE4422BBA"><enum>(B)</enum><text>coordinate
				ongoing followup treatment with individuals, families, primary care physicians,
				and subspecialists in congenital, genetic, and metabolic disorders after a
				newborn receives an indication of the presence or increased risk of a disorder
				on a screening test;</text>
							</subparagraph><subparagraph id="ID03118098CE6B4139AA772E65E0002F8E"><enum>(C)</enum><text>ensure the
				seamless integration of confirmatory testing, tertiary care medical services,
				comprehensive genetic services including genetic counseling, and information
				about access to developing therapies by participation in approved clinical
				trials involving the primary health care of the infant;</text>
							</subparagraph><subparagraph id="IDB6BA4932662943E88253A6A8AE1C1714"><enum>(D)</enum><text>analyze data, if
				appropriate and available, collected from newborn screenings to identify
				populations at risk for disorders affecting newborns, examine and respond to
				health concerns, recognize and address relevant environmental, behavioral,
				socioeconomic, demographic, and other relevant risk factors; and</text>
							</subparagraph><subparagraph id="IDFA92838CB35D4BAEA96020BCC05CCCC4"><enum>(E)</enum><text>carry out such
				other activities as the Secretary may determine necessary.</text>
							</subparagraph></paragraph></subsection><subsection id="ID09A782ACA3AC4A71BC59318502ABFF79"><enum>(f)</enum><header>Reports to
				Congress</header>
						<paragraph id="ID4A88BF975FD2492382BC7EE35DB76D13"><enum>(1)</enum><header>In
				general</header><text>Subject to paragraph (2), the Secretary shall submit to
				the appropriate committees of Congress reports—</text>
							<subparagraph id="IDDD7BCACC7CE0497DBCB07619BA91CF60"><enum>(A)</enum><text>evaluating the
				effectiveness and the impact of the grants awarded under this section—</text>
								<clause id="ID7D06F7332A4041F8003E478787A3A92B"><enum>(i)</enum><text>in promoting
				newborn screening—</text>
									<subclause id="ID07D128FD99904D40A2B8E76100E05D6F"><enum>(I)</enum><text>education and
				resources for families; and</text>
									</subclause><subclause id="IDBE1AAD95E2FD42F79B3C9B00061DC329"><enum>(II)</enum><text>education,
				resources, and training for health care professionals;</text>
									</subclause></clause><clause id="IDBDE6F2068F574CC68F02A51832CCDEF5"><enum>(ii)</enum><text>on the
				successful diagnosis and treatment of congenital, genetic, and metabolic
				disorders; and</text>
								</clause><clause id="ID07332D71DA1E436980680562E5D70041"><enum>(iii)</enum><text>on the
				continued development of coordinated systems of followup care after newborns
				are screened;</text>
								</clause></subparagraph><subparagraph id="ID1D97D8D31A974E56BF59662D58741FAF"><enum>(B)</enum><text>describing and
				evaluating the effectiveness of the activities carried out with grant funds
				received under this section; and</text>
							</subparagraph><subparagraph id="ID3128FDD4CDD544BBAB14C9C57873D9DF"><enum>(C)</enum><text>that include
				recommendations for Federal actions to support—</text>
								<clause id="IDE979AC7C17924953A71922E42D20EAB6"><enum>(i)</enum><text>education and
				training in newborn screening; and</text>
								</clause><clause id="ID9E6F4A8D691F4CFEAABF5415E3A448B6"><enum>(ii)</enum><text>followup care
				after newborns are screened.</text>
								</clause></subparagraph></paragraph><paragraph id="ID90FB86C131E04BA6BB2EDEE89098D9DC"><enum>(2)</enum><header>Timing of
				reports</header><text>The Secretary shall submit—</text>
							<subparagraph id="IDAAA339CCAC45477AA51C515484313209"><enum>(A)</enum><text>an interim report
				that includes the information described in paragraph (1), not later than 30
				months after the date on which the first grant funds are awarded under this
				section; and</text>
							</subparagraph><subparagraph id="ID2FBBDF7DC743442B88E3E23B2E74B9B2"><enum>(B)</enum><text>a subsequent
				report that includes the information described in paragraph (1), not later than
				60 months after the date on which the first grant funds are awarded under this
				section.</text>
							</subparagraph></paragraph></subsection><subsection id="ID5DEB89BBF6D34C2089ED2D101B7FB29F"><enum>(g)</enum><header>Definition of
				eligible entity</header><text>In this section, the term <term>eligible
				entity</term> means—</text>
						<paragraph id="ID9A20266DB30A4F3E95143505A4660333"><enum>(1)</enum><text>a State or a
				political subdivision of a State;</text>
						</paragraph><paragraph id="ID2706724BC8A94400B9CE81EB6F2CBF4E"><enum>(2)</enum><text>a consortium of 2
				or more States or political subdivisions of States;</text>
						</paragraph><paragraph id="ID28054475615F42F284D7CA86966F51D1"><enum>(3)</enum><text>a
				territory;</text>
						</paragraph><paragraph id="ID51AD9C5B134D4CFB97E7D73ED01E10C6"><enum>(4)</enum><text>an Indian tribe
				or a hospital or outpatient health care facility of the Indian Health Service;
				or</text>
						</paragraph><paragraph id="ID11E4A251B5BA4694995FAD7F4EAA2948"><enum>(5)</enum><text>a nongovernmental
				organization with appropriate expertise in newborn screening, as determined by
				the Secretary.</text>
						</paragraph></subsection><subsection id="id9DEF17CBAA494FB78EE5F1E8B4DFB1AE"><enum>(h)</enum><header>National
				contingency plan for newborn screening</header>
						<paragraph id="ID4dfef8ae935c4f119d696ef19bca9d06"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the date of enactment of
				this section, the Secretary, acting through the Director of the Centers for
				Disease Control and Prevention and in consultation with the Associate
				Administrator, shall develop a national contingency plan for newborn screening
				for use in the event of a public health emergency.</text>
						</paragraph><paragraph id="IDec83b9ac4b484bfc8066f5286ac0b00e"><enum>(2)</enum><header>Requirements</header><text>The
				contingency plan developed under paragraph (1) shall include a plan for—</text>
							<subparagraph id="ID212e7edeac3d42e598020593d9c3294a"><enum>(A)</enum><text>the collection
				and transport of specimens;</text>
							</subparagraph><subparagraph id="ID24b05b6e54e74f808f4a5555dfb560fc"><enum>(B)</enum><text>the shipment of
				specimens to State newborn screening laboratories;</text>
							</subparagraph><subparagraph id="ID61a8efe81cb4491da75a8c03c988ebba"><enum>(C)</enum><text>the processing of
				specimens;</text>
							</subparagraph><subparagraph id="IDba5e9c212a414bb6a99d9675521eb04a"><enum>(D)</enum><text>the reporting of
				screening results to physicians and families;</text>
							</subparagraph><subparagraph id="IDb858a1e02d564c7e832f497a4197adb6"><enum>(E)</enum><text>the diagnostic
				confirmation of positive screening results;</text>
							</subparagraph><subparagraph id="IDfdd22ac1d4004c8ca3137517825da0b7"><enum>(F)</enum><text>ensuring the
				availability of treatment and management resources;</text>
							</subparagraph><subparagraph id="ID558d5650f1ca4439b1d0265c61a8cc3d"><enum>(G)</enum><text>educating
				families about newborn screening; and</text>
							</subparagraph><subparagraph id="idB78DFF05623944B6BB362BC8D8610646"><enum>(H)</enum><text>carrying out
				other activities determined appropriate by the Secretary.</text>
							</subparagraph></paragraph></subsection><subsection id="ID9F1A439DC4C641E98451BD84114F93B3"><enum>(i)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section—</text>
						<paragraph id="IDF885F7AB729341CAB467C1B5F89419E6"><enum>(1)</enum><text>$15,000,000 for
				fiscal year 2008; and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID6994874762EB4FDAB7E876B450DC85A3"><enum>(2)</enum><text>such sums as may
				be necessary for each of fiscal years 2009 through
				2012.</text>
						</paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="id71E374968FCE47A5A798C721163F40DD"><enum>4.</enum><header>Improved newborn
			 and child screening for heritable disorders</header><text display-inline="no-display-inline">Section 1109 of the Public Health Service
			 Act (42 U.S.C. 300b–8) is amended—</text>
			<paragraph id="idD79A1E6F170742A382BFC26E72027A1D"><enum>(1)</enum><text>in subsection
			 (c)(2)—</text>
				<subparagraph id="idC5AA1F11767B4E76BBBB52EFC5E32873"><enum>(A)</enum><text>in subparagraph
			 (E), by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="id8A85D32B8DAC4FD1A0BDA805F1E49C98"><enum>(B)</enum><text>by redesignating
			 subparagraph (F) as subparagraph (G); and</text>

				(referred to in this section as the <quote>Advisory Committee</quote>) that are
				adopted by the Secretary and in effect at the time the grant is awarded or
				renewed under this section, which shall include the screening of each newborn
				for the heritable disorders recommended by the Advisory Committee and adopted
				by the Secretary and the reporting of results;
				and</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id54ED25B23FCB4EF7880CDE035A2954C7"><enum>(2)</enum><text>in subsection
			 (i), by striking <quote>such sums</quote> and all that follows through the
			 period at the end and inserting <quote>$25,000,000 for fiscal year 2008 and
			 such sums as may be necessary for each of the fiscal years 2009 through
			 2012.</quote>.</text>
			</paragraph></section><section id="id1A134D7E176C48A78DBDB75131EE38FD"><enum>5.</enum><header>Evaluating the
			 effectiveness of newborn- and child-screening programs</header><text display-inline="no-display-inline">Section 1110 of the Public Health Service
			 Act (42 U.S.C. 300b–9) is amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="id8B676D6696F74083B434780BE202F135" style="OLC">
				<subsection id="idF14A100603314F48BC4F19E744E8F3E8"><enum>(d)</enum><header>Authorization
				of appropriations</header><text>There are authorized to be appropriated to
				carry out this section $5,000,000 for fiscal year 2008 and such sums as may be
				necessary for each of the fiscal years 2009 through
				2012.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section id="idE567A386BFBC47838D115BD47D8E17CF"><enum>6.</enum><header>Advisory
			 committee on heritable disorders in newborns and children</header><text display-inline="no-display-inline">Section 1111 of the Public Health Service
			 Act (42 U.S.C. 300b–10) is amended—</text>
			<paragraph id="id9CA567E1E52C4B2B862B6246FCDF5C8B"><enum>(1)</enum><text>in subsection
			 (b)—</text>
				<subparagraph id="id4014693D9A474C79AB957D4C13DBF106"><enum>(A)</enum><text>by redesignating
			 paragraph (3) as paragraph (5);</text>
				</subparagraph><subparagraph id="idB08CCB9376B0419D974FDDAEFD8BAB19"><enum>(B)</enum><text>in paragraph (2),
			 by striking <quote>and</quote> after the semicolon;</text>
				</subparagraph><subparagraph id="idAEE20F9ECCD943438A9FF57A016868D0"><enum>(C)</enum><text>by inserting
			 after paragraph (2) the following:</text>
					<quoted-block display-inline="no-display-inline" id="id4A3E353E1C0D44818598B277F6395567" style="OLC">
						<paragraph id="ID8222be4c311d4684be6d3d1df3b52b89"><enum>(3)</enum><text>recommend a
				uniform screening panel for newborn screening programs that includes the
				heritable disorders for which all newborns should be screened, including
				secondary conditions that may be identified as a result of the laboratory
				methods used for screening;</text>
						</paragraph><paragraph id="IDf83f9e5c67de4349969231a54280f4c6"><enum>(4)</enum><text>develop a model
				decision-matrix for newborn screening program expansion, and periodically
				update the recommended uniform screening panel described in paragraph (3) based
				on such decision-matrix; and</text>
						</paragraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph><subparagraph id="id8B6542FA851345E1BB416AA7B79B4406"><enum>(D)</enum><text>in paragraph (5)
			 (as redesignated by subparagraph (A)), by striking the period at the end and
			 inserting</text>
					<quoted-block display-inline="yes-display-inline" id="id63C26B255D1444FA8B9EF3E7CC6EA064" style="OLC">
						<text>, including recommendations, advice,
			 or information dealing with—</text><subparagraph id="id9C1CD8E67125409785C9CFC73A94C590"><enum>(A)</enum><text>followup
				activities, including those necessary to achieve rapid diagnosis in the short
				term, and those that ascertain long-term case management outcomes and
				appropriate access to related services;</text>
						</subparagraph><subparagraph id="id9A4FF2F74F894D909BFD0FAC33F62370"><enum>(B)</enum><text>diagnostic and
				other technology used in screening;</text>
						</subparagraph><subparagraph id="ID8f8128faf4db4221810760d71ee93578"><enum>(C)</enum><text>the availability
				and reporting of testing for conditions for which there is no existing
				treatment;</text>
						</subparagraph><subparagraph id="ID566348cb8b5447e19420bde3f5b10408"><enum>(D)</enum><text>minimum standards
				and related policies and procedures for State newborn screening
				programs;</text>
						</subparagraph><subparagraph id="IDeeb7e854de1347b59a7a1faad9262072"><enum>(E)</enum><text>quality
				assurance, oversight, and evaluation of State newborn screening
				programs;</text>
						</subparagraph><subparagraph id="IDc6031d965f9c41cdb7dc9391f7139c9b"><enum>(F)</enum><text>data collection
				for assessment of newborn screening programs;</text>
						</subparagraph><subparagraph id="IDfb936d3cd28842fcbd5981833c8b3e6e"><enum>(G)</enum><text>public and
				provider awareness and education;</text>
						</subparagraph><subparagraph id="ID7d1a69c2884a4ad68b04c65575fcf8a9"><enum>(H)</enum><text>language and
				terminology used by State newborn screening programs;</text>
						</subparagraph><subparagraph id="ID135e2ae8b621472b84e5e90d6a137150"><enum>(I)</enum><text>confirmatory
				testing and verification of positive results; and</text>
						</subparagraph><subparagraph id="IDb23764deeba7427ca8833359e9466b0f"><enum>(J)</enum><text>harmonization of
				laboratory definitions for results that are within the expected range and
				results that are outside of the expected
				range.</text>
						</subparagraph><after-quoted-block>;
				and</after-quoted-block></quoted-block>
				</subparagraph></paragraph><paragraph id="id39AFA0EB89544E37BAB5BC41E2FC3FF5"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following:</text>
				<quoted-block display-inline="no-display-inline" id="idF9A6E608524E4BE8B106445314519B0B" style="OLC">
					<subsection id="idD765799B3D3C473C91757F37E98F5814"><enum>(d)</enum><header>Decision on
				recommendations</header>
						<paragraph id="idD7558F35CC804E50BFE12111C171B372"><enum>(1)</enum><header>In
				general</header><text>Not later than 180 days after the Advisory Committee
				issues a recommendation pursuant to this section, the Secretary shall adopt or
				reject such recommendation.</text>
						</paragraph><paragraph id="id39745A9A15254356BADB6AB057B85479"><enum>(2)</enum><header>Pending
				recommendations</header><text>The Secretary shall adopt or reject any
				recommendation issued by the Advisory Committee that is pending on the date of
				enactment of the Newborn Screening Saves Lives Act of 2007 by not later than
				180 days after the date of enactment of such Act.</text>
						</paragraph><paragraph id="id076FEF7B98EC403C8FFB769EEBFC7FE5"><enum>(3)</enum><header>Determinations
				to be made public</header><text>The Secretary shall publicize any determination
				on adopting or rejecting a recommendation of the Advisory Committee pursuant to
				this subsection, including the justification for the determination.</text>
						</paragraph></subsection><subsection id="id62BB18482D004E1588A959FA4C6AE0F9"><enum>(e)</enum><header>Continuation of
				operation of committee</header><text>Notwithstanding section 14 of the Federal
				Advisory Committee Act (5 U.S.C. App.), the Advisory Committee shall continue
				to operate during the 5-year period beginning on the date of enactment of the
				Newborn Screening Saves Lives Act of
				2007.</text>
					</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</paragraph></section><section id="idDA5430E7376A40A091D56BD56CFA17C7"><enum>7.</enum><header>Laboratory
			 quality and surveillance</header><text display-inline="no-display-inline">Part
			 A of title XI of the Public Health Service Act (42 U.S.C. 300b–1 et seq.) is
			 amended by adding at the end the following:</text>
			<quoted-block display-inline="no-display-inline" id="idEFA65E8528D94F4B9DFF6C780718BFD6" style="OLC">
				<section id="id72BA75B309ED43159A7256B61018A8BF"><enum>1112.</enum><header>Laboratory
				quality</header>
					<subsection id="id4B5447A43B0C4602BC54DC5917C55919"><enum>(a)</enum><header>In
				general</header><text display-inline="yes-display-inline">The Secretary, acting
				through the Director of the Centers for Disease Control and Prevention and in
				consultation with the Advisory Committee on Heritable Disorders in Newborns and
				Children established under section 1111, shall provide for—</text>
						<paragraph id="id2CF1BCD4E97D4ED1AF0D09ACC8291596"><enum>(1)</enum><text>quality assurance
				for laboratories involved in screening newborns and children for heritable
				disorders, including quality assurance for newborn-screening tests, performance
				evaluation services, and technical assistance and technology transfer to
				newborn screening laboratories to ensure analytic validity and utility of
				screening tests; and</text>
						</paragraph><paragraph commented="no" id="ID2e00af530ae447eea64782c7e45321b2"><enum>(2)</enum><text>population-based
				pilot testing for new screening tools for evaluating use on a mass
				scale.</text>
						</paragraph></subsection><subsection commented="no" id="idA8682911116245CA86C1F1C8749EF009"><enum>(b)</enum><header>Authorization
				of appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $5,000,000 for fiscal year 2008 and
				such sums as may be necessary for each of the fiscal years 2009 through
				2012.</text>
					</subsection></section><section id="idEC6AD2BAD49544B791EACC27911A0EDC"><enum>1113.</enum><header>Surveillance
				programs for heritable disorders screening</header>
					<subsection id="id7855A7B2D3624C0C9E5AA2976032C8EB"><enum>(a)</enum><header>In
				general</header><text>The Secretary, acting through the Director of the Centers
				for Disease Control and Prevention, in consultation with the Associate
				Administrator of the Maternal and Child Health Bureau of the Health Resources
				and Services Administration, shall carry out programs—</text>
						<paragraph id="ID6BE2D2D873C0486CB28D34669BDD7DDD"><enum>(1)</enum><text>to collect,
				analyze, and make available data on the heritable disorders recommended by the
				Advisory Committee on Heritable Disorders in Newborns and Children established
				under section 1111, including data on the causes of such disorders and on the
				incidence and prevalence of such disorders;</text>
						</paragraph><paragraph commented="no" id="ID4B237F90C46A4AA8BEDDDFA3C176358F"><enum>(2)</enum><text>to operate
				regional centers for the conduct of applied epidemiological research on the
				prevention of such disorders;</text>
						</paragraph><paragraph id="ID02E0421231B74E63BBB221215753A3E1"><enum>(3)</enum><text>to provide
				information and education to the public on the prevention of such disorders;
				and</text>
						</paragraph><paragraph id="ID634BDDCA564641B2B4CCDC2A4C6395F4"><enum>(4)</enum><text>to conduct
				research on and to promote the prevention of such disorders, and secondary
				health conditions among individuals with such disorders.</text>
						</paragraph></subsection><subsection id="IDF672D6453BDE44E2A8C71FB22C030860"><enum>(b)</enum><header>Grants and
				Contracts</header>
						<paragraph id="IDB11D3D9866834953A00CBAFEDC0ABB8E"><enum>(1)</enum><header>In
				general</header><text>In carrying out subsection (a), the Secretary may make
				grants to and enter into contracts with public and nonprofit private
				entities.</text>
						</paragraph><paragraph id="ID2CBE1868355B49F895FEADDBF8DDE377"><enum>(2)</enum><header>Supplies and
				services in lieu of award funds</header>
							<subparagraph id="ID64E29509B9164059A5548D44D641CD2A"><enum>(A)</enum><header>In
				general</header><text>Upon the request of a recipient of an award of a grant or
				contract under paragraph (1), the Secretary may, subject to subparagraph (B),
				provide supplies, equipment, and services for the purpose of aiding the
				recipient in carrying out the purposes for which the award is made and, for
				such purposes, may detail to the recipient any officer or employee of the
				Department of Health and Human Services.</text>
							</subparagraph><subparagraph id="IDF5580679E0E646ED8080D6ABB98B784C"><enum>(B)</enum><header>Reduction</header><text>With
				respect to a request described in subparagraph (A), the Secretary shall reduce
				the amount of payments under the award involved by an amount equal to the costs
				of detailing personnel and the fair market value of any supplies, equipment, or
				services provided by the Secretary. The Secretary shall, for the payment of
				expenses incurred in complying with such request, expend the amounts
				withheld.</text>
							</subparagraph></paragraph><paragraph id="IDEA803C5F6B03418583035224CEF606A4"><enum>(3)</enum><header>Application for
				award</header><text>The Secretary may make an award of a grant or contract
				under paragraph (1) only if an application for the award is submitted to the
				Secretary and the application is in such form, is made in such manner, and
				contains such agreements, assurances, and information as the Secretary
				determines to be necessary to carry out the purposes for which the award is to
				be made.</text>
						</paragraph></subsection><subsection id="IDCE38116DED83428782EE1019986AFF51"><enum>(c)</enum><header>Biennial
				Report</header><text>Not later than February 1 of fiscal year 2008 and of every
				second such year thereafter, the Secretary shall submit to the Committee on
				Energy and Commerce of the House of Representatives, and the Committee on
				Health, Education, Labor, and Pensions of the Senate, a report that, with
				respect to the preceding 2 fiscal years—</text>
						<paragraph id="ID10AC1016809541EC85A0AF643F4C98B5"><enum>(1)</enum><text>contains
				information regarding the incidence and prevalence of heritable disorders and
				the health status of individuals with such disorders and the extent to which
				such disorders have contributed to the incidence and prevalence of infant
				mortality and affected quality of life;</text>
						</paragraph><paragraph id="ID95CA550E870F49F8815D55C6DA344F6F"><enum>(2)</enum><text>contains
				information under paragraph (1) that is specific to various racial and ethnic
				groups (including Hispanics, non-Hispanic whites, Blacks, Native Americans, and
				Asian Americans);</text>
						</paragraph><paragraph id="ID93B6FCD956FE4EBF8A9F6A8726A13633"><enum>(3)</enum><text>contains an
				assessment of the extent to which various approaches of preventing heritable
				disorders and secondary health conditions among individuals with such disorders
				have been effective;</text>
						</paragraph><paragraph id="ID578B44A0093447078411779E478E25F1"><enum>(4)</enum><text>describes the
				activities carried out under this section;</text>
						</paragraph><paragraph id="ID7D6358FA393842A68748CA636D3C7E52"><enum>(5)</enum><text>contains
				information on the incidence and prevalence of individuals living with
				heritable disorders, information on the health status of individuals with such
				disorders, information on any health disparities experienced by such
				individuals, and recommendations for improving the health and wellness and
				quality of life of such individuals;</text>
						</paragraph><paragraph id="IDFC52BD9D816743418497F77F5F4C7E99"><enum>(6)</enum><text>contains a
				summary of recommendations from all heritable disorders research conferences
				sponsored by the Centers for Disease Control and Prevention; and</text>
						</paragraph><paragraph id="ID203107AA1D16438C940E0F303091D526"><enum>(7)</enum><text>contains any
				recommendations of the Secretary regarding this section.</text>
						</paragraph></subsection><subsection id="IDAD4DA9BD558B456886120BBBCD7E3D40"><enum>(d)</enum><header>Applicability
				of Privacy Laws</header><text>The provisions of this section shall be subject
				to the requirements of section 552a of title 5, United States Code. All Federal
				laws relating to the privacy of information shall apply to the data and
				information that is collected under this section.</text>
					</subsection><subsection id="id45D9B7D3B8CF4A0086DD49BAF020A480"><enum>(e)</enum><header>Coordination</header>
						<paragraph id="idD92423A373FC42D193F5674DE6CE6297"><enum>(1)</enum><header>In
				general</header><text>In carrying out this section, the Secretary shall
				coordinate, to the extent practicable, programs under this section with
				programs on birth defects and developmental disabilities authorized under
				section 317C.</text>
						</paragraph><paragraph id="id5F7EE58B68A741B9B368AD6DD07BDAD3"><enum>(2)</enum><header>Priority in
				grants and contracts</header><text>In making grants and contracts under this
				section, the Secretary shall give priority to entities that demonstrate the
				ability to coordinate activities under a grant or contract made under this
				section with existing birth defects surveillance activities.</text>
						</paragraph></subsection><subsection id="id3BC9E45C14624D26B8CF8685109D7CF5"><enum>(f)</enum><header>Authorization
				of Appropriations</header><text>For the purpose of carrying out this section,
				there are authorized to be appropriated $15,000,000 for fiscal year 2008 and
				such sums as may be necessary for each of the fiscal years 2009 through
				2012.</text>
					</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
