		<section commented="no" display-inline="no-display-inline" id="id31CF191DDDD947B8882B73D6FB699915" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the
			 <quote><short-title>Restoring the Constitution Act of
			 2007</short-title></quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="id4AF1A38586EE4327B869673569ED2891" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definition of unlawful enemy
			 combatant</header><text display-inline="no-display-inline">Paragraph (1) of
			 section 948a of title 10, United States Code, is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="idE826AEA42141455A9603AA1D9F121771" style="OLC">
				<paragraph commented="no" display-inline="no-display-inline" id="idFEE91473745546F182335E4DA61ABAC4"><enum>(1)</enum><header display-inline="yes-display-inline">Unlawful enemy combatant</header><text display-inline="yes-display-inline">The term <term>unlawful enemy
				combatant</term> means an individual who is not a lawful enemy combatant
				and—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="idB4E49F598A22488A9FE5DAA858AD61A9"><enum>(A)</enum><text display-inline="yes-display-inline">who directly participates in hostilities in
				a zone of active combat against the United States; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id971A8218E51F4A6591ADCDB8D196E2E2"><enum>(B)</enum><text display-inline="yes-display-inline">who—</text>
						<clause commented="no" display-inline="no-display-inline" id="id66C91124950B40B0819B677D9FAEDD82"><enum>(i)</enum><text display-inline="yes-display-inline">planned, authorized, committed, or
				intentionally aided the terrorist acts on the United States of September 11,
				2001; or</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="id3F50BFA998F9436E89A07EBAC4A35A64"><enum>(ii)</enum><text display-inline="yes-display-inline">intentionally harbored any individual
				described in clause (i).</text>
						</clause></subparagraph><continuation-text commented="no" continuation-text-level="paragraph">The term is used solely to designate
				individuals triable by military commission under this
				chapter.</continuation-text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id0CA6FD0122DE4AB4B10DFBB67A0B45AA" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Construction with Geneva
			 Conventions</header><text display-inline="no-display-inline">Subsection (g) of
			 section 948b of title 10, United States Code, is amended to read as
			 follows:</text>
			<quoted-block display-inline="no-display-inline" id="idF31943E1C846420AABDD82588E1FBAD7" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idC995CC3D1E1B440486681CEF87B22AB3"><enum>(g)</enum><header display-inline="yes-display-inline">Construction with Geneva
				Conventions</header><text display-inline="yes-display-inline">To the extent
				that any provision of this chapter is determined to be inconsistent with the
				obligations of the United States under the Geneva Conventions, the Geneva
				Conventions shall prevail, and such provision shall be deemed to have no
				further force or
				effect.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id411F7121CCD54EAEA9E1512ACECE03A8" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Determination of unlawful enemy combatant
			 status by Combatant Status Review Tribunal not dispositive for purposes of
			 jurisdiction of military commissions</header><text display-inline="no-display-inline">Section 948d of title 10, United States
			 Code, is amended—</text>
			<paragraph commented="no" display-inline="no-display-inline" id="idEF74E466162B4A32B8E9B217389C68D0"><enum>(1)</enum><text display-inline="yes-display-inline">by striking subsection (c); and</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3E97D364FF1141F6A25D892E54C8F4DB"><enum>(2)</enum><text display-inline="yes-display-inline">by redesignating subsection (d) as
			 subsection (c).</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="idD69A1DE72C1840109CB55AB77E092916" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">Trial counsel and defense counsel</header>
			<subsection commented="no" display-inline="no-display-inline" id="idEA47215790CC42BF88BAB52339D1124F"><enum>(a)</enum><header display-inline="yes-display-inline">Repeal of authority for civilian trial
			 counsel</header><text display-inline="yes-display-inline">Subsection (b) of
			 section 948k of title 10, United States Code, is amended to read as
			 follows:</text>
				<quoted-block display-inline="no-display-inline" id="idF1C53D2ECF1141628F73B9642930F596" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id1CFD4C64D3DE4CCAB1D1BA94485FB10B"><enum>(b)</enum><header display-inline="yes-display-inline">Military trial counsel</header><text display-inline="yes-display-inline">Subject to subsection (e), trial counsel
				detailed for a military commission under this chapter must be a judge advocate
				(as that term is defined in section 801 of this title (article 1 of the Uniform
				Code of Military Justice)) who is—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="id9D2B5278BAE944B19A7FD84F5C29DA38"><enum>(1)</enum><text display-inline="yes-display-inline">a graduate of an accredited law school or
				is a member of the bar of a Federal court or of the highest court of a State;
				and</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idD10E44CF18924E9DA0C928E170E29B2F"><enum>(2)</enum><text display-inline="yes-display-inline">certified as competent to perform duties as
				trial counsel before general courts-martial by the Judge Advocate General of
				the armed force of which he is a
				member.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id82F0C31A55A741B7A0BA3DAA54977DAA"><enum>(b)</enum><header display-inline="yes-display-inline">Authority for civilian defense
			 counsel</header><text display-inline="yes-display-inline">Subsection (c) of
			 such section is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="id611A6358A65C4DDBB108CD4B17DD51F9" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="idF0B4B2F5A471466CAD8408EFCBB59F94"><enum>(c)</enum><header display-inline="yes-display-inline">Defense counsel</header><text display-inline="yes-display-inline">Subject to subsection (e), trial counsel
				detailed for a military commission under this chapter must be—</text>
						<paragraph commented="no" display-inline="no-display-inline" id="idDC6351B7C52B480EA09886D3B71F8F20"><enum>(1)</enum><text display-inline="yes-display-inline">a judge advocate (as so defined) who
				is—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idFA2C5F0908D64D2C8A4D8C1DDDEA38D7"><enum>(A)</enum><text display-inline="yes-display-inline">a graduate of an accredited law school or
				is a member of the bar of a Federal court or of the highest court of a State;
				and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id85E8757684A64EA294F614177ACA27B1"><enum>(B)</enum><text display-inline="yes-display-inline">certified as competent to perform duties as
				trial counsel before general courts-martial by the Judge Advocate General of
				the armed force of which he is a member; or</text>
							</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68E25913791846E9AE0BEBB08B91A406"><enum>(2)</enum><text display-inline="yes-display-inline">a civilian who is—</text>
							<subparagraph commented="no" display-inline="no-display-inline" id="idE53EB0052CCF440B952C701391C00BC4"><enum>(A)</enum><text display-inline="yes-display-inline">a member of the bar of a Federal court or
				of the highest court of a State; and</text>
							</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idFFDA332A69F44F99AFF0D145DF44DC55"><enum>(B)</enum><text display-inline="yes-display-inline">otherwise qualified to practice before the
				military commission pursuant to regulations prescribed by the Secretary of
				Defense.</text>
							</subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id00D45EFAE47740F68EF592F056AE4278"><enum>(c)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Subsection (d)(1) of such section is
			 amended by striking <quote>subsection (b)(1)</quote> and inserting
			 <quote>subsection (b)</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id0D692A03336149ADB1D1A9282A3817BF" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Exclusion from trial by military commission
			 of statements obtained by coercion</header><text display-inline="no-display-inline">Section 948r of title 10, United States
			 Code, is amended by striking subsections (c) and (d) and inserting the
			 following new subsection (c):</text>
			<quoted-block display-inline="no-display-inline" id="idB795A2B694994C2DB93061AFA2E73EDD" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idD0FB71AF47344DB9A28299AF82C17394"><enum>(c)</enum><header display-inline="yes-display-inline">Exclusion of statements obtained by
				coercion</header><text display-inline="yes-display-inline">A statement obtained
				by use of coercion shall not be admissible in a military commission under this
				chapter, except against a person accused of coercion as evidence that the
				statement was
				made.</text>
				</subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id663B29FF5B2A4339960A42CC63E2FB52" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Modification of authorities on rules for
			 military commissions</header>
			<subsection commented="no" display-inline="no-display-inline" id="idF123EF5B02B64314B381EF44D7A794C0"><enum>(a)</enum><header display-inline="yes-display-inline">Rules generally</header><text display-inline="yes-display-inline">Subsection (a) of section 949a of title 10,
			 United States Code, is amended to read as follows:</text>
				<quoted-block display-inline="no-display-inline" id="idD42A024907264880AE46759524EF6479" style="OLC">
					<subsection commented="no" display-inline="no-display-inline" id="id4504A826845145C3B4B0AA5ECB700B38"><enum>(a)</enum><header display-inline="yes-display-inline">Procedures and rules of
				evidence</header><paragraph commented="no" display-inline="yes-display-inline" id="id865ABBCDBC40446B9B7BB7824223EDA7"><enum>(1)</enum><text display-inline="yes-display-inline">Pretrial, trial, and post-trial procedures,
				including elements and modes of proof, for cases triable by military commission
				under this chapter may be prescribed by the Secretary of Defense. Such
				procedures may not be contrary to or inconsistent with this chapter. Except as
				otherwise provided in this chapter or chapter 47 of this title, the procedures
				and rules of evidence applicable in trials by general courts-martial shall
				apply in trials by military commission under this chapter.</text>
						</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id68A6B7A7283948349B4BFD7892494DCE" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Secretary of Defense may, in
				consultation with the Attorney General, make such exceptions in the
				applicability in trials by military commission under this chapter from the
				procedures and rules of evidence otherwise applicable in general courts-martial
				as may be required by the unique circumstances of the conduct of military or
				intelligence operations during hostilities. Such exceptions may not be contrary
				to or inconsistent with this
				chapter.</text>
						</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id87FDA96BAF8A4B00AE1EA873DF9D1EDC"><enum>(b)</enum><header display-inline="yes-display-inline">Exclusion of evidence seized inside the
			 united states without warrant</header><text display-inline="yes-display-inline">Subsection (b)(2)(B) of such section is
			 amended by inserting <quote>seized outside the United States</quote> after
			 <quote>Evidence</quote>.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="idA4A7B458FD3443E78D3594B53C1F5B70"><enum>(c)</enum><header display-inline="yes-display-inline">Discretion of military judge To exclude
			 hearsay evidence determined To be unreliable or lacking in probative
			 value</header><text display-inline="yes-display-inline">Subsection
			 (b)(2)(E)(ii) of such section is amended by striking <quote>if the party
			 opposing the admission of the evidence demonstrates that the evidence is
			 unreliable or lacking in probative value</quote> and inserting <quote>if the
			 military judge determines, upon motion by counsel, that the evidence is
			 unreliable or lacking in probative value</quote>.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id84FED2E4BFB9434EA34969B1FC0A6457" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Self-representation of accused before
			 military commissions</header><text display-inline="no-display-inline">Section
			 949c of title 10, United States Code, is amended by adding at the end the
			 following new subsection:</text>
			<quoted-block display-inline="no-display-inline" id="id0C02146561E94FC39A7D9F35D5612EC4" style="OLC">
				<subsection commented="no" display-inline="no-display-inline" id="idCAE8951FE4BC4D74A79FA4B264994856"><enum>(c)</enum><header display-inline="yes-display-inline">Self-representation by
				accused</header><paragraph commented="no" display-inline="yes-display-inline" id="id0C917013BA82439F8647F46F7A611AB1"><enum>(1)</enum><text display-inline="yes-display-inline">Notwithstanding any provision of subsection
				(b), the accused may represent himself in his defense before a military
				commission under this chapter.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id1CD44271E817498AA29BA255F679F83A" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The accused's representation of himself in
				his defense shall be governed by such rules as the Secretary of Defense shall
				prescribe. Such rules, and any rights, privileges, or limitations under such
				rules, shall be consistent with rules applicable to self-representation by an
				accused in a criminal trial under the laws of the United States and
				international law.</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id3B6EF07AD9E6452CB93DE869F7A1070D" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">If the accused represents himself under
				this subsection, the accused—</text>
						<subparagraph commented="no" display-inline="no-display-inline" id="id92B2080220F84DF0B82CA0DBF743281B"><enum>(A)</enum><text display-inline="yes-display-inline">shall be assisted in his defense by
				military defense counsel detailed in accordance with subsection (b)(2);
				or</text>
						</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idAEAB640B42AF4E8D8172ECC7333F4DFF"><enum>(B)</enum><text display-inline="yes-display-inline">may be assisted in his defense by civilian
				defense counsel meeting the requirements of subsection (b)(3), together with
				military defense counsel so detailed.</text>
						</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="id9AD974AED2E94C9FA60C0ACE79B28871" indent="up1"><enum>(4)</enum><text display-inline="yes-display-inline">Any civilian counsel assisting in the
				defense of an accused under this subsection shall comply with the provisions of
				subsection (b)(4).</text>
					</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idDDF59701145446CAB3C4B3E014146125" indent="up1"><enum>(5)</enum><text display-inline="yes-display-inline">Subsection (b)(7) shall not apply with
				respect to any defense counsel assisting in the defense of an accused under
				this subsection, except to the extent the accused is unable to carry out his
				defense.</text>
					</paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block>
		</section><section commented="no" display-inline="no-display-inline" id="id1393AB4941BF42FE99745E4F9DF02402" section-type="subsequent-section"><enum>9.</enum><header display-inline="yes-display-inline">Enhancement of authorities on discovery of
			 witnesses and other evidence</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2172239CCB654D10891E21EFE8167E2E"><enum>(a)</enum><header display-inline="yes-display-inline">Discovery of sources, methods, and
			 activities relating to certain government actions</header><text display-inline="yes-display-inline">Subsection (c) of section 949j of title 10,
			 United States Code, is amended—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="id02B651157BA34ECEA58830DB0C96FF4A"><enum>(1)</enum><text display-inline="yes-display-inline">in paragraph (2), by striking <quote>The
			 military judge</quote> and inserting <quote>Except as provided in paragraph
			 (3), the military judge</quote>; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA793C4689C504F37B63E4D3D1E0FB618"><enum>(2)</enum><text display-inline="yes-display-inline">by adding at the end the following new
			 paragraph:</text>
					<quoted-block display-inline="no-display-inline" id="id2716B3CE12D34D3FA8A007C04A239DAF" style="OLC">
						<paragraph commented="no" display-inline="no-display-inline" id="idF0825C7F81984D329388E581C927D149" indent="up1"><enum>(3)</enum><text display-inline="yes-display-inline">Notwithstanding any other provision of this
				chapter, the military judge may, upon motion of defense counsel and at the
				discretion of the military judge, order trial counsel to disclose to defense
				counsel the sources, methods, or activities (including classified sources,
				methods, or activities) by which the United States obtained any out of court
				statement the United States intends to introduce at trial if the military judge
				determines, after ex parte review, in camera review, or both, that evidence of
				such sources, methods, or activities, as the case may be, might reasonably tend
				to affect the weight given to the out of court statement by the members of the
				military commission. The military judge shall revoke such an order in the event
				the United States elects not introduce the out of court statement concerned at
				trial.</text>
						</paragraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="id290A33D460FB4155832A552B6DA55DCC"><enum>(b)</enum><header display-inline="yes-display-inline">Discretion of military judge To take
			 certain actions if substitute for classified exculpatory evidence is
			 insufficient To protect right of defendant to fair trial</header><text display-inline="yes-display-inline">Subsection (d)(1) of such section is
			 amended by adding at the end the following: “If the military judge determines
			 that the substitute is not sufficient to protect the right of the defendant to
			 a fair trial, the military judge may—</text>
				<quoted-block act-name="" display-inline="no-display-inline" id="idBD5FFAC3D4874058B87EFEF0BB6A5AC5" style="OLC">
					<subparagraph commented="no" display-inline="no-display-inline" id="idC3F9D20EF4314183A1691A300930D726" indent="up1"><enum>(A)</enum><text display-inline="yes-display-inline">dismiss the charges in their
				entirety;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idE241B36F933B4794BF9E69DFFE5BA110" indent="up1"><enum>(B)</enum><text display-inline="yes-display-inline">dismiss the charges or specifications or
				both to which the information relates; or</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="id52E8AC0D1F9E4E90AC7FCADD11F955BF" indent="up1"><enum>(C)</enum><text display-inline="yes-display-inline">take such other actions as may be required
				in the interest of
				justice.</text>
					</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id74CB0C3BDA38413489F77977192529FA" section-type="subsequent-section"><enum>10.</enum><header display-inline="yes-display-inline">Review of military commission decisions by
			 United States Court of Appeals for the Armed Forces rather than Court of
			 Military Commission Review</header>
			<subsection commented="no" display-inline="no-display-inline" id="id2E3DAC658294484D9C7828F935A85219"><enum>(a)</enum><header display-inline="yes-display-inline">Review</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id9FE5FA68B0894A78AB3A0E6A4FC0E1B2"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Section 950f of title 10, United States
			 Code, is amended to read as follows:</text>
					<quoted-block display-inline="no-display-inline" id="idC0F5EC9DF1484E4596C2C771480FD5A7" style="USC">
						<section commented="no" display-inline="no-display-inline" id="idAD8A00553979429299CA691E20D163D0" section-type="subsequent-section"><enum>950f.</enum><header display-inline="yes-display-inline">Review by Court of Appeals for the Armed
				Forces</header>
							<subsection commented="no" display-inline="no-display-inline" id="idD70406A9F58D416CA21113907E4EC5DE"><enum></enum><text display-inline="yes-display-inline">The United States Court of Appeals for the
				Armed Forces, in accordance with procedures prescribed under regulations of the
				Secretary, shall review the record in each case that is referred to the Court
				by the convening authority under section 950c of this title with respect to any
				matter of law raised by the
				accused.</text>
							</subsection></section><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idA0D38658140F4D9A83428E3E03FE4E63"><enum>(2)</enum><header display-inline="yes-display-inline">Clerical amendment</header><text display-inline="yes-display-inline">The table of sections at the beginning of
			 subchapter VI of chapter 47A of such title is amended by striking the item
			 relating to section 950f and inserting the following new item:</text>

			 offenses</header>
				<paragraph commented="no" display-inline="no-display-inline" id="id9E2533D4F4304FD1A25F50FE9AFDAC2C"><enum>(1)</enum><header display-inline="yes-display-inline">Inclusion of denial of trial rights among
			 offenses</header><text display-inline="yes-display-inline">Paragraph (1) of
			 section 2441(d) of title 18, United States Code, is amended by adding at the
			 end the following new subparagraph:</text>

				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id0EB8B777DAE04E48B2D75E883E02BFA4"><enum>(2)</enum><header display-inline="yes-display-inline">Inclusion of imposition of cruel, inhuman,
			 or degrading treatment or punishment among offenses</header><text display-inline="yes-display-inline">Such section is further amended—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="id2C976F234C5F4D18B825236D6CF8C308"><enum>(A)</enum><text display-inline="yes-display-inline">in paragraph (1), by adding at the end the
			 following new subparagraph:</text>

				treatment or punishment.</text>

					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="idB42679F90C3F4F56AC95D6C05F21E8EB"><enum>(B)</enum><text display-inline="yes-display-inline">in paragraph (2)—</text>
						<clause commented="no" display-inline="no-display-inline" id="id37F2A918A5434D2F9018E4336E12FB05"><enum>(i)</enum><text display-inline="yes-display-inline">in subparagraph (D), by striking
			 <quote>and</quote> at the end;</text>

			 common article 3 among offenses</header><text display-inline="yes-display-inline">Paragraph (1) of such section is further
			 amended by adding at the end the following new subparagraph:</text>

				act which, if committed by a person subject to chapter 47 of title 10, would be
				punishable under that chapter by the penalty of death or confinement for one
				year or
				more.</text>
						</subparagraph><after-quoted-block>.</after-quoted-block></quoted-block>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id96B269108BFB4E3AA0F4EBA5504BE260"><enum>(4)</enum><header display-inline="yes-display-inline">Additional definitional

			</subsection><subsection commented="no" display-inline="no-display-inline" id="id1A42462131654C59868FD4615ABDDE66"><enum>(b)</enum><header display-inline="yes-display-inline">Conforming amendment</header><text display-inline="yes-display-inline">Subsection (b) of section 7 of the Military
			 Commissions Act of 2006 (Public Law 109–366; 120 Stat. 2636; 28 U.S.C. 2441
			 note) is repealed.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="id1333A10ACA3A42B5AF362494BA031350" section-type="subsequent-section"><enum>15.</enum><header display-inline="yes-display-inline">Expedited judicial review of Military
			 Commissions Act of 2006</header><text display-inline="no-display-inline">Notwithstanding any other provision of law,
			 the following rules shall apply to any civil action, including an action for
			 declaratory judgment, that challenges any provision of the Military Commissions
			 Act of 2006 (Public Law 109–366), or any amendment made by that Act, on the
			 ground that such provision or amendment violates the Constitution or the laws
			 of the United States:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="id617D9C49EBEC4F1881AC0F64DCC1257D"><enum>(1)</enum><text display-inline="yes-display-inline">The action shall be filed in the United
			 States District Court for the District of Columbia and shall be heard in that
			 Court by a court of three judges convened pursuant to section 2284 of title 28,
			 United States Code.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="idB4DA105E6AEF43E7AB27AC78DDF1D748"><enum>(2)</enum><text display-inline="yes-display-inline">An interlocutory or final judgment, decree,
			 or order of the United States District Court for the District of Columbia in an
			 action under paragraph (1) shall be reviewable as a matter of right by direct
			 appeal to the Supreme Court of the United States. Any such appeal shall be
			 taken by a notice of appeal filed within 10 days after the date on which such
			 judgment, decree, or order is entered. The jurisdictional statement with
			 respect to any such appeal shall be filed within 30 days after the date on
			 which such judgment, decree, or order is entered.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="id661D020D7A494600BDE76253CE273C5A"><enum>(3)</enum><text display-inline="yes-display-inline">It shall be the duty of the United States
			 District Court for the District of Columbia and the Supreme Court of the United
			 States to advance on the docket and to expedite to the greatest possible extent
			 the disposition of any action or appeal, respectively, brought under this
			 section.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="id7EFA7A7535DB4AABAC300401F7A94832" section-type="subsequent-section"><enum>16.</enum><header display-inline="yes-display-inline">Effective date</header>
			<subsection commented="no" display-inline="no-display-inline" id="id3B61BB2042924200A3640E8B547B7457"><enum>(a)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Except as provided in subsection (b), the
			 amendments made by this Act shall take effect on October 17, 2006, the date of
			 the enactment of the Military Commissions Act of 2006 (Public Law 109–366),
			 immediately after the enactment of that Act and shall apply to all cases,
			 without exception, that are pending on or after such date.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="id07992F88FE974D3C967B0288C0550271"><enum>(b)</enum><header display-inline="yes-display-inline">Revisions to war crimes
			 offenses</header><text display-inline="yes-display-inline">The amendments made
			 by section 13(b) shall take effect on the date of the enactment of this
			 Act.</text>
