		<section commented="no" display-inline="no-display-inline" id="IDF16C8A90796D4E4EB66AC13998A8A41C" section-type="section-one"><enum>1.</enum><header display-inline="yes-display-inline">Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote>Border
			 Infrastructure and Technology Modernization Act of 2007</quote>.</text>
		</section><section commented="no" display-inline="no-display-inline" id="ID9307820EEB38458294510B41D7A11709" section-type="subsequent-section"><enum>2.</enum><header display-inline="yes-display-inline">Definitions</header><text display-inline="no-display-inline">In this Act:</text>
			<paragraph commented="no" display-inline="no-display-inline" id="ID0774EDFD635A430DA5A627C01EC57CB2"><enum>(1)</enum><header display-inline="yes-display-inline">Commissioner</header><text display-inline="yes-display-inline">The term <term>Commissioner</term> means
			 the Commissioner responsible for United States Customs and Border Protection of
			 the Department of Homeland Security.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID229CBACEE5324553A3035A51BA5A840A"><enum>(2)</enum><header display-inline="yes-display-inline">Maquiladora</header><text display-inline="yes-display-inline">The term <term>maquiladora</term> means an
			 entity located in Mexico that assembles and produces goods from imported parts
			 for export to the United States.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID9A272914A89D465CB8181844D2B241FC"><enum>(3)</enum><header display-inline="yes-display-inline">Northern border</header><text display-inline="yes-display-inline">The term <term>northern border</term> means
			 the international border between the United States and Canada.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDBA65CB067D3F40E0BAF252F6D90DD41E"><enum>(4)</enum><header display-inline="yes-display-inline">Southern border</header><text display-inline="yes-display-inline">The term <term>southern border</term> means
			 the international border between the United States and Mexico.</text>
			</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID54A2A60274E14D0CBCA96985CF401D1B"><enum>(5)</enum><header display-inline="yes-display-inline">Under secretary</header><text display-inline="yes-display-inline">The term <term>Under Secretary</term> means
			 the Under Secretary for Border and Transportation Security of the Department of
			 Homeland Security.</text>
			</paragraph></section><section commented="no" display-inline="no-display-inline" id="ID4A8EA0F917664EFCB5082BB0F1A2E0A3" section-type="subsequent-section"><enum>3.</enum><header display-inline="yes-display-inline">Hiring and training of border and
			 transportation security personnel</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID3F731AF1488C46B4B3059F8008ECD9FB"><enum>(a)</enum><header display-inline="yes-display-inline">Inspectors and Agents</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID418788B89C1C4263B8FBFBF00394E62E"><enum>(1)</enum><header display-inline="yes-display-inline">Increase in inspectors and
			 agents</header><text display-inline="yes-display-inline">During each of fiscal
			 years 2008 through 2012, the Under Secretary shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDF45C10B791A24C32A9400EC1D24FEE7D"><enum>(A)</enum><text display-inline="yes-display-inline">increase the number of full-time agents and
			 associated support staff in the Bureau of Immigration and Customs Enforcement
			 of the Department of Homeland Security by the equivalent of at least 100 more
			 than the number of such employees in the Bureau as of the end of the preceding
			 fiscal year; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID87DC0068FF854A549BF33D982AE6C186"><enum>(B)</enum><text display-inline="yes-display-inline">increase the number of full-time inspectors
			 and associated support staff in the Bureau of Customs and Border Protection by
			 the equivalent of at least 200 more than the number of such employees in the
			 Bureau as of the end of the preceding fiscal year.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC58EE5EE894C407CADFE76EA4B1006D0"><enum>(2)</enum><header display-inline="yes-display-inline">Waiver of fte limitation</header><text display-inline="yes-display-inline">The Under Secretary is authorized to waive
			 any limitation on the number of full-time equivalent personnel assigned to the
			 Department of Homeland Security to fulfill the requirements of paragraph
			 (1).</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID99D0C34F5D0E440F850360A88430AFDD"><enum>(b)</enum><header display-inline="yes-display-inline">Training</header><text display-inline="yes-display-inline">The Under Secretary shall provide
			 appropriate training for agents, inspectors, and associated support staff of
			 the Department of Homeland Security on an ongoing basis to utilize new
			 technologies and to ensure that the proficiency levels of such personnel are
			 acceptable to protect the borders of the United States.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID7E0B50052A5C455486D95767EBFC6283" section-type="subsequent-section"><enum>4.</enum><header display-inline="yes-display-inline">Port of Entry Infrastructure Assessment
			 Study</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID53FBBF9AC7A542A881BCDE1C4421748E"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement To Update</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the
			 Administrator of General Services shall update the Port of Entry Infrastructure
			 Assessment Study prepared by the United States Customs Service, the Immigration
			 and Naturalization Service, and the General Services Administration in
			 accordance with the matter relating to the ports of entry infrastructure
			 assessment that is set out in the joint explanatory statement in the conference
			 report accompanying H.R. 2490 of the 106th Congress, 1st session (House of
			 Representatives Rep. No. 106–319, on page 67) and submit such updated study to
			 Congress.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID74EB7DF449DD4E308F1F9D525CDC9760"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In preparing the updated studies required
			 in subsection (a), the Administrator of General Services shall consult with the
			 Director of the Office of Management and Budget, the Under Secretary, and the
			 Commissioner.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDA1CD515B22054736A6252854AC21F018"><enum>(c)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">Each updated study required in subsection
			 (a) shall—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDB41DC031D4C34CBCACB34BED5379F4CB"><enum>(1)</enum><text display-inline="yes-display-inline">identify port of entry infrastructure and
			 technology improvement projects that would enhance border security and
			 facilitate the flow of legitimate commerce if implemented;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID4D34CD84C84E4E17A11E5A8968F02111"><enum>(2)</enum><text display-inline="yes-display-inline">include the projects identified in the
			 National Land Border Security Plan required by section 5; and</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDEC3A996ADEE2413BB523BB5875937201"><enum>(3)</enum><text display-inline="yes-display-inline">prioritize the projects described in
			 paragraphs (1) and (2) based on the ability of a project to—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDB6C492BAE0AD4253A1AA305807B14C39"><enum>(A)</enum><text display-inline="yes-display-inline">fulfill immediate security requirements;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID3A0EFD381DDF43C093C69182CD7CAE91"><enum>(B)</enum><text display-inline="yes-display-inline">facilitate trade across the borders of the
			 United States.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDDEA495B7183744E7B8B28003BACFE2EE"><enum>(d)</enum><header display-inline="yes-display-inline">Project Implementation</header><text display-inline="yes-display-inline">The Commissioner shall implement the
			 infrastructure and technology improvement projects described in subsection (c)
			 in the order of priority assigned to each project under paragraph (3) of such
			 subsection.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID2D674030D3004FEFA20D91F98C198B86"><enum>(e)</enum><header display-inline="yes-display-inline">Divergence From Priorities</header><text display-inline="yes-display-inline">The Commissioner may diverge from the
			 priority order if the Commissioner determines that significantly changed
			 circumstances, such as immediate security needs or changes in infrastructure in
			 Mexico or Canada, compellingly alter the need for a project in the United
			 States.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="IDA0457FC060BB407582F203F227B572A7" section-type="subsequent-section"><enum>5.</enum><header display-inline="yes-display-inline">National Land Border Security Plan</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID2D9E789329604E468F746213279A1FCB"><enum>(a)</enum><header display-inline="yes-display-inline">Requirement for Plan</header><text display-inline="yes-display-inline">Not later than January 31 of each year, the
			 Under Secretary shall prepare a National Land Border Security Plan and submit
			 such plan to Congress.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID05ABDFBC044E48F5BEC13EF100CF5F28"><enum>(b)</enum><header display-inline="yes-display-inline">Consultation</header><text display-inline="yes-display-inline">In preparing the plan required in
			 subsection (a), the Under Secretary shall consult with the Under Secretary for
			 Information Analysis and Infrastructure Protection and the Federal, State, and
			 local law enforcement agencies and private entities that are involved in
			 international trade across the northern border or the southern border.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID58D97C25D57746A5AB19EF4D717F5B29"><enum>(c)</enum><header display-inline="yes-display-inline">Vulnerability Assessment</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDC9259ED4F4DC44FF8DDECBF40291B1AC"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">The plan required in subsection (a) shall
			 include a vulnerability assessment of each port of entry located on the
			 northern border or the southern border.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDD21E87C6E8EB4DCE92C7497E0DFA3794"><enum>(2)</enum><header display-inline="yes-display-inline">Port security coordinators</header><text display-inline="yes-display-inline">The Under Secretary may establish 1 or more
			 port security coordinators at each port of entry located on the northern border
			 or the southern border—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID95101BE5654245C1BB9A16F64CD1418B"><enum>(A)</enum><text display-inline="yes-display-inline">to assist in conducting a vulnerability
			 assessment at such port; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID745F4FCC0C7E4529BA3FBA19041B42DE"><enum>(B)</enum><text display-inline="yes-display-inline">to provide other assistance with the
			 preparation of the plan required in subsection (a).</text>
					</subparagraph></paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDA40D1A3E42AC42C580E2BB08FCCA6A6F" section-type="subsequent-section"><enum>6.</enum><header display-inline="yes-display-inline">Expansion of commerce security
			 programs</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDA7199F0EF05B486FB65DC90A40E8F623"><enum>(a)</enum><header display-inline="yes-display-inline">Customs-Trade Partnership Against
			 Terrorism</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9F6AA27FEE5D45778AC042A1701892D4"><enum>(1)</enum><header display-inline="yes-display-inline">In general</header><text display-inline="yes-display-inline">Not later than 180 days after the date of
			 the enactment of this Act, the Commissioner, in consultation with the Under
			 Secretary, shall develop a plan to expand the size and scope (including
			 personnel needs) of the Customs-Trade Partnership Against Terrorism programs
			 along the northern border and southern border, including—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDB8913E5C3AF6457EA47E6F324EB64BC7"><enum>(A)</enum><text display-inline="yes-display-inline">the Business Anti-Smuggling
			 Coalition;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID03CC02C7E1CA479684E4BDFA7F509745"><enum>(B)</enum><text display-inline="yes-display-inline">the Carrier Initiative Program;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDF4E40D4DC11E45DDABF13B1ECC01BF78"><enum>(C)</enum><text display-inline="yes-display-inline">the Americas Counter Smuggling
			 Initiative;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID212E7A3F82B842149EF606B16BED57A2"><enum>(D)</enum><text display-inline="yes-display-inline">the Container Security Initiative;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDE3FE818CCBAD429D953C1C634F3777B5"><enum>(E)</enum><text display-inline="yes-display-inline">the Free and Secure Trade Initiative;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID868DE427A6BD4E30B840B42E4336780D"><enum>(F)</enum><text display-inline="yes-display-inline">other Industry Partnership Programs
			 administered by the Commissioner.</text>
					</subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID2BC6C3A175CC41DAA9E775918ADF08C4"><enum>(2)</enum><header display-inline="yes-display-inline">Southern border demonstration
			 program</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Commissioner shall
			 establish a demonstration program along the southern border for the purpose of
			 implementing at least one Customs-Trade Partnership Against Terrorism program
			 along that border. The Customs-Trade Partnership Against Terrorism program
			 selected for the demonstration program shall have been successfully implemented
			 along the northern border as of the date of the enactment of this Act.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9CDAA00859EB4960BFB299EB1CD2185B"><enum>(b)</enum><header display-inline="yes-display-inline">Maquiladora Demonstration
			 Program</header><text display-inline="yes-display-inline">Not later than 180
			 days after the date of the enactment of this Act, the Commissioner shall
			 establish a demonstration program to develop a cooperative trade security
			 system to improve supply chain security.</text>
			</subsection></section><section commented="no" display-inline="no-display-inline" id="ID9DDEF7C3AFCC470793C6D7AFC0278629" section-type="subsequent-section"><enum>7.</enum><header display-inline="yes-display-inline">Port of entry technology demonstration
			 program</header>
			<subsection commented="no" display-inline="no-display-inline" id="IDADAAD9FAA60542AB95BB139FF81D21C6"><enum>(a)</enum><header display-inline="yes-display-inline">Establishment</header><text display-inline="yes-display-inline">The Under Secretary shall carry out a
			 technology demonstration program to test and evaluate new port of entry
			 technologies, refine port of entry technologies and operational concepts, and
			 train personnel under realistic conditions.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="IDC2D949FCB30445D1A6205A082C5DB083"><enum>(b)</enum><header display-inline="yes-display-inline">Technology and Facilities</header>
				<paragraph commented="no" display-inline="no-display-inline" id="ID9DCEBBAA575C458E9990F5DA8EBEA6A7"><enum>(1)</enum><header display-inline="yes-display-inline">Technology tested</header><text display-inline="yes-display-inline">Under the demonstration program, the Under
			 Secretary shall test technologies that enhance port of entry operations,
			 including those related to inspections, communications, port tracking,
			 identification of persons and cargo, sensory devices, personal detection,
			 decision support, and the detection and identification of weapons of mass
			 destruction.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDC2B703EA4CB14530A2CAE38CE950A8BA"><enum>(2)</enum><header display-inline="yes-display-inline">Facilities developed</header><text display-inline="yes-display-inline">At a demonstration site selected pursuant
			 to subsection (c)(2), the Under Secretary shall develop facilities to provide
			 appropriate training to law enforcement personnel who have responsibility for
			 border security, including cross-training among agencies, advanced law
			 enforcement training, and equipment orientation.</text>
				</paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID9041938FD6A940E0A17D402E9D8C23D1"><enum>(c)</enum><header display-inline="yes-display-inline">Demonstration Sites</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDE3E49E4275174F69B026F8B2857C9F1F"><enum>(1)</enum><header display-inline="yes-display-inline">Number</header><text display-inline="yes-display-inline">The Under Secretary shall carry out the
			 demonstration program at not less than 3 sites and not more than 5
			 sites.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDAD2E633CCE2B4D2E80132913EE7709BA"><enum>(2)</enum><header display-inline="yes-display-inline">Selection criteria</header><text display-inline="yes-display-inline">To ensure that at least 1 of the facilities
			 selected as a port of entry demonstration site for the demonstration program
			 has the most up-to-date design, contains sufficient space to conduct the
			 demonstration program, has a traffic volume low enough to easily incorporate
			 new technologies without interrupting normal processing activity, and can
			 efficiently carry out demonstration and port of entry operations, at least 1
			 port of entry selected as a demonstration site shall—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID131EF44D0CC1438B924AF623B4C10EA8"><enum>(A)</enum><text display-inline="yes-display-inline">have been established not more than 15
			 years before the date of the enactment of this Act;</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID137BCC3489FB465F9B448AB062040D95"><enum>(B)</enum><text display-inline="yes-display-inline">consist of not less than 65 acres, with the
			 possibility of expansion onto not less than 25 adjacent acres; and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID5C7B50B1385240D19456C5CC2C38BB05"><enum>(C)</enum><text display-inline="yes-display-inline">have serviced an average of not more than
			 50,000 vehicles per month in the 12 full months preceding the date of the
			 enactment of this Act.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="ID088DA725675C4DDCB801A08C68D932F1"><enum>(d)</enum><header display-inline="yes-display-inline">Relationship With Other
			 Agencies</header><text display-inline="yes-display-inline">The Under Secretary
			 shall permit personnel from an appropriate Federal or State agency to utilize a
			 demonstration site described in subsection (c) to test technologies that
			 enhance port of entry operations, including those related to inspections,
			 communications, port tracking, identification of persons and cargo, sensory
			 devices, personal detection, decision support, and the detection and
			 identification of weapons of mass destruction.</text>
			</subsection><subsection commented="no" display-inline="no-display-inline" id="ID26CA12651BCC4AD5BE00A990F924A0F1"><enum>(e)</enum><header display-inline="yes-display-inline">Report</header>
				<paragraph commented="no" display-inline="no-display-inline" id="IDF1F045E66E31433998907A79D863093E"><enum>(1)</enum><header display-inline="yes-display-inline">Requirement</header><text display-inline="yes-display-inline">Not later than 1 year after the date of the
			 enactment of this Act, and annually thereafter, the Under Secretary shall
			 submit to Congress a report on the activities carried out at each demonstration
			 site under the technology demonstration program established under this
			 section.</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE4803D0558024C689AD980BC47820DA4"><enum>(2)</enum><header display-inline="yes-display-inline">Content</header><text display-inline="yes-display-inline">The report shall include an assessment by
			 the Under Secretary of the feasibility of incorporating any demonstrated
			 technology for use throughout the Bureau of Customs and Border
			 Protection.</text>
				</paragraph></subsection></section><section commented="no" display-inline="no-display-inline" id="IDD69644720CB04865B0CC9C4819AA7B2A" section-type="subsequent-section"><enum>8.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header>
			<subsection commented="no" display-inline="no-display-inline" id="ID8E038EEA25F54BAFB2603F9E273A2854"><enum>(a)</enum><header display-inline="yes-display-inline">In General</header><text display-inline="yes-display-inline">In addition to any funds otherwise
			 available, there are authorized to be appropriated—</text>
				<paragraph commented="no" display-inline="no-display-inline" id="IDFBE48B4F6AAA4B9D889F872D544347F3"><enum>(1)</enum><text display-inline="yes-display-inline">to carry out the provisions of section 3,
			 such sums as may be necessary for the fiscal years 2008 through 2012;</text>
				</paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID1843630258B64E27A6E882AB7F2D4880"><enum>(2)</enum><text display-inline="yes-display-inline">to carry out the provisions of section
			 4—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDB86C67E1BE9347F1AFA8614FC9BC053F"><enum>(A)</enum><text display-inline="yes-display-inline">to carry out subsection (a) of such
			 section, such sums as may be necessary for the fiscal years 2008 through 2012;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID9224BFCBE5254454A48D48141A5F15B6"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out subsection (d) of such
			 section—</text>
						<clause commented="no" display-inline="no-display-inline" id="ID3E101D17F9864B8AB3312018CE713451"><enum>(i)</enum><text display-inline="yes-display-inline">$100,000,000 for each of the fiscal years
			 2008 through 2012; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID9DF1710BDC8C4E459A2F0DFE146B2B50"><enum>(ii)</enum><text display-inline="yes-display-inline">such sums as may be necessary in any
			 succeeding fiscal year;</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="ID227B0C63E1234B75ABBDD9B07D4BD0AE"><enum>(3)</enum><text display-inline="yes-display-inline">to carry out the provisions of section
			 6—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="ID7EE04967DCB44F14B7469F5341196C87"><enum>(A)</enum><text display-inline="yes-display-inline">to carry out subsection (a) of such
			 section—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDF26222D8EE5145F7B9BBDA9BFEC1560F"><enum>(i)</enum><text display-inline="yes-display-inline">$30,000,000 for fiscal year 2008, of which
			 $5,000,000 shall be made available to fund the demonstration project
			 established in paragraph (2) of such subsection; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID25FA2174C8244C2AB248ACF4F5BC268E"><enum>(ii)</enum><text display-inline="yes-display-inline">such sums as may be necessary for the
			 fiscal years 2009 through 2012; and</text>
						</clause></subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="IDD67A8AB5A81A4392B746EE67F977DC60"><enum>(B)</enum><text display-inline="yes-display-inline">to carry out subsection (b) of such
			 section—</text>
						<clause commented="no" display-inline="no-display-inline" id="IDC58AD41289BE48F697A929BF0E111FE2"><enum>(i)</enum><text display-inline="yes-display-inline">$5,000,000 for fiscal year 2008; and</text>
						</clause><clause commented="no" display-inline="no-display-inline" id="ID763B9F2E6B094E9C9918744E10354730"><enum>(ii)</enum><text display-inline="yes-display-inline">such sums as may be necessary for the
			 fiscal years 2009 through 2012; and</text>
						</clause></subparagraph></paragraph><paragraph commented="no" display-inline="no-display-inline" id="IDE51A3E3C67264742989B8CA76314DCF4"><enum>(4)</enum><text display-inline="yes-display-inline">to carry out the provisions of section 7,
			 provided that not more than $10,000,000 may be expended for technology
			 demonstration program activities at any 1 port of entry demonstration site in
			 any fiscal year—</text>
					<subparagraph commented="no" display-inline="no-display-inline" id="IDA345AA168E4447D9B7905646FFAA64BF"><enum>(A)</enum><text display-inline="yes-display-inline">$50,000,000 for fiscal year 2008;
			 and</text>
					</subparagraph><subparagraph commented="no" display-inline="no-display-inline" id="ID1F436DE2C4044CEA8838313869BC04A1"><enum>(B)</enum><text display-inline="yes-display-inline">such sums as may be necessary for each of
			 the fiscal years 2009 through 2012.</text>
					</subparagraph></paragraph></subsection><subsection commented="no" display-inline="no-display-inline" id="IDBB8EB2C6899449CEAFC2A31123F2A02A"><enum>(b)</enum><header display-inline="yes-display-inline">International Agreements</header><text display-inline="yes-display-inline">Funds authorized in this Act may be used
			 for the implementation of projects described in the Declaration on Embracing
			 Technology and Cooperation to Promote the Secure and Efficient Flow of People
			 and Commerce across our Shared Border between the United States and Mexico,
			 agreed to March 22, 2002, Monterrey, Mexico (commonly known as the Border
			 Partnership Action Plan) or the Smart Border Declaration between the United
			 States and Canada, agreed to December 12, 2001, Ottawa, Canada that are
			 consistent with the provisions of this Act.</text>
